She explained she submitted changes to staff for the January 4, 2021 minutes and these changes were not made. She recommended approval of these minutes be postponed to the January 25, 2021 City Council meeting. She recommended the Council approve the December 14, 2020 under a separate motion. A. A roll call vote was taken. Ayes — 5 Nays — 0 Motion carried. 6. PUBLIC COMMENT None. 7. SPECIAL ORDER OF BUSINESS A. Ramsey County Commission Nicole Joy Frethem. Ramsey County Commissioner Nicole Frethem thanked the Council for their time. She updated the Council on the status of TCAAP noting this property was still in litigation. She was hopeful that a resolution would be found in the next few months. She explained the County Board would be receiving a public health update on Wednesday, January 131h regarding COVID. She encouraged Mounds View residents to sign up on the County website to receive the COVID newsletter for the most up to date information. She commented further on the COVID vaccination rollout and potential funding that would be available to Ramsey County businesses. She discussed the assistance that was available to landlords and renters. She explained she would like to look at expanding and improving the Mounds View Library to include a County service center. Mayor Mueller questioned if there were any transportation projects coming up between the City of Mounds View and Ramsey County. County Commissioner Frethem stated she was not aware of any specific projects. City Administrator Zikmund explained the infrastructure under the semi -fours along Mounds View Boulevard was extremely old, from the 1970's and 1980's. He recommended the County look at replacing and updating this technology. County Commissioner Frethem commented further on the importance of having additional transit routes in the suburbs that go east and west and not just north and south. City Administrator Zikmund stated another concern for the City was access to Mounds View Boulevard. He understood accidents occur more at intersections than elsewhere, but he also Mounds View City Council January 11, 2021 Regular Meeting Page 3 1 understood that the City needed to have proper access to the properties along the Mounds View 2 Boulevard corridor. County Commissioner Frethem thanked staff for pointing out this concern. 3 4 Council Member Bergeron thanked County Commissioner Frethem for attending this meeting. 5 He stated he appreciated the fact that County Commissioner Frethem would be holding future 6 discussions with the Met Council regarding public transportation. He explained the Met Council 7 needs to consider completing transit projects in Northwest Ramsey County. He indicated Mounds s View was two halves that are divided by Mounds View Boulevard. He believed the eastern 9 portion of Mounds View needed greater access to public transit. County Commissioner Frethem 10 thanked Council Member Bergeron for his comments. She indicated she understood there was a 11 need for some east/west transit routes. She stated she would continue to push for the A Line 12 extension. 13 14 Public Works/Parks and Recreation Director Peterson stated he has had preliminary talks with 15 the Ramsey County Public Works Director on how to partner on the Mounds View Boulevard 16 intersections. He reported he was a ways from anything concrete but noted talks had begun. 17 18 Council Member Meehlhause thanked County Commissioner Frethem for attending this meeting. 19 He commented the City has great pride in its library and requested the Mounds View Library 20 remain operational. County Commissioner Frethem stated she would be working to expand and 21 improve the Mounds View Library. 22 23 Council Member Meehlhause asked what kind of social services were available for Mounds 24 View residents. County Commissioner Frethem encouraged any resident facing a crisis situation 25 to visit a Ramsey County Service Center. She reported these sites have a full suite of services 26 available to residents. She then described the types of services available to residents of Ramsey 27 County in further detail. She reported the Navigators are well equipped to identify needs and 28 provide County resources. 29 30 Mayor Mueller commented on the importance of the library to the City of Mounds View. She 31 explained this site was used by members of the community for job searches and she suggested a 32 team of Navigators be located at this library branch. County Commissioner Frethem stated the 33 Navigators program was quite new and stated a mobile unit of Navigators may be a great option 34 for this library branch. 35 36 Council Member Meehlhause commented if the library was not an option, the Mounds View 37 Community Center would be another option for the Navigators. County Commissioner Frethem 38 thanked Council Member Meehlhause for this suggestion. 39 40 Mayor Mueller thanked County Commissioner Frethem for attending and for her service to the 41 City of Mounds View. 42 43 B. MOTION/SECOND: Hull/Meehlhause. To Waive the Reading and Adopt Resolution 9369, Approving Updated Joint Powers Agreement with Blaine and Spring Lake Park regarding Cost Sharing of Spring Lake Park Fire Department, Inc. Council Member Meehlhause spoke to the numerous benefits of having a shared fire department and stated he appreciated the fact Blaine was still willing to have a JPA in place with Mounds View and Spring Lake Park. Council Member Bergeron commented he too appreciated the SBM Fire Department and noted he fully supported the JPA. Council Member Hull stated he appreciated Blaine and Spring Lake Park for coming together on this JPA noting it benefited all cities involved. A roll call vote was taken. Ayes — 5 Nays — 0 Motion carried. B. Resolution 9382, Authorizing Vacation Carryover Extension for Certain Public Works and Police Department Personnel. Human Resources Coordinator Ewald requested the Council authorize vacation carryover extension for certain Public Works and Police Department personnel. She discussed how the carryover extension would function in 2021 and recommended approval of the request. MOTION/SECOND: Meehlhause/Hull. To Waive the Reading and Adopt Resolution 9382, Authorizing Vacation Carryover Extension for Certain Public Works and Police Department Personnel. Council Member Meehlhause stated he was very supportive of moving this item forward in order to allow Public Works and Police Department personnel to use their earned vacation time. She discussed the proposed changes in further detail with the Council and recommended approval. She noted upon approval the MOU would become effective January 1, 2021. MOTION/SECOND: Hull/Bergeron. To Waive the Reading and Adopt Resolution 9373, Approving Memorandum of Understanding VCET Pay Converted to Percentage, FTO Increased to 1.00 Hour Compensatory Time, and Outreach Increased to 1.25 Hours Compensatory Time for the Law Enforcement Labor Services Local 204 Police Patrol and Investigators. Human Resources Coordinator Ewald requested the Council approve a job description for the Custodian and authorize staff to hire for this position. She discussed how the position would be funded, noted the hourly pay rate and recommended approval of the job description. MOTION/SECOND: Bergeron/Meehlhause. To Waive the Reading and Adopt Resolution 9374, Approving Job Description for the Custodian and Authorizing Hiring for the Position. A roll call vote was taken. Ayes — 5 Nays — 0 Motion carried. E. Resolution 9375, Approving Job Description for the Sports Official and Authorize Hiring for the Position. Human Resources Coordinator Ewald requested the Council approve a job description for the Sports Official and authorize hiring for this position. She commented further on the position noting it was seasonal in nature and therefore would not be benefits earning. She commented up to five Sports Official positions would be filled as needed. MOTION/SECOND: Meehlhause/Bergeron. To Waive the Reading and Adopt Resolution 9375, Approving Job Description for the Sports Official and Authorize Hiring for the Position. A roll call vote was taken. Ayes — 5 Nays — 0 Motion carried. Mounds View City Council Regular Meeting January 11, 2024 Page 7 1 F. Resolution 9376, Authorizing the Extension of Sick Leave Balances to Cover 2 COVID Related Absences. 3 4 Human Resources Coordinator Ewald requested the Council authorize the extension of sick leave 5 balances to cover COVID related absences. She explained the language of this Resolution had to 6 be reworded to allow for the extension of sick leave balances for Public Works and first 7 responder employees. 8 9 MOTION/SECOND: Bergeron/Hull. To Waive the Reading and Adopt Resolution 9376, 10 Authorizing the Extension of Sick Leave Balances to Cover COVID Related Absences. 11 12 Mayor Mueller reported the City Council was working to create a culture where employees desire 13 to work and because the federal government amended their funding, the City of Mounds View 14 would not be leaving its employees in the lurch. She stated she appreciated staff s efforts on this 15 Resolution. Human Resources Coordinator Ewald reported staff really appreciated the City 16 Council supporting this Resolution. 17 18 A roll call vote was taken. 19 20 Ayes — 5 Nays — 0 Motion carried. 21 22 9. REPORTS 23 A. Reports of Mayor and Council. 24 25 Council Member Meehlhause reported on Tuesday, January 12th he will be attending the Police 26 Foundation Zoom meeting and on Tuesday, January 19th he would be attending a convention 27 bureau meeting. He was proud to report hospitality tax revenues for 2020 through September 28 were at $423,000 and anticipated this may reach $550,000 for 2020. 29 30 Council Member Meehlhause stated in 2016 he attended a meeting with former Ramsey County 31 Public Works Director Jim Tolaas, former County Commissioner Blake Huffman, former 32 Mounds View Mayor Joe Flaherty and former City Administrator Jim Ericson, along with two 33 representatives from MNDOT. He explained the reason for this meeting was to discuss the 34 renaming of County Highway 10 to Mounds View Boulevard. He indicated it was agreed upon 35 at this meeting that this change would be made and the agreement was that MNDOT would post 36 new signs on I-35W. He commented the MNPASS project was approaching year three which led 37 him to send an email to Mark Lindberg at MNDOT to see if the name change on I-35W would 38 happen. He stated he received a reply from Jennifer Wiltgen at MNDOT noting she was happy 39 to report the Mounds View Boulevard designation has been added to the overhead signage along 40 north and southbound I-35W. 41 42 Mayor Mueller thanked Council Member Meehlhause for keeping the sign issue on his radar and 43 following up. 44 Mounds View City Council January 11, 2024 Regular Meeting Page 8 1 Mayor Mueller stated she recently attended the Five Cities Mayor meeting with City 2 Administrator Zikmund. She explained at this meeting, she was introduced to two new mayors. 3 She commented further on the new housing that would be built in Shoreview along Lexington 4 Avenue. 5 6 Mayor Mueller reported on Friday, January 15th she would be attending a virtual Minnesota 7 Women in City Government meeting and in the weeks to come she would be attending several 8 meetings with the League of Minnesota Cities. 9 1 o Further discussion ensued regarding the relocation of the Deluxe Corporation corporate campus 1 1 from Shoreview to Minneapolis. 12 13 B. Reports of Staff. 14 15 Public Works/Parks and Recreation Director Peterson reported ice rink usage was quite high 16 already this year. 17 18 Public Works/Parks and Recreation Director Peterson updated the Council on the Water 19 Treatment Plant 1 project. Director Peterson offered to share the project plans with the City 20 Council at the February work session. He explained staff was planning to come to the Council at 21 the February 8th meeting to have plans approved. The Council supported this suggestion. 22 23 Public Works/Parks and Recreation Director Peterson indicated staff has been meeting with 24 Quincy House representatives. He reported a partnership has been discussed along with usage of 25 the Cedar Room at the Community Center for youth programing. He stated the proposed 26 partnership would open up Quincy House to be a shelter for displaced youth. The Council 27 supported the proposed partnership. 28 29 City Administrator Zikmund stated he attended a workshop meeting with the Rice Creek 30 Watershed District noting they received an indirect appeal from Mr. Fields to extend the grant. 31 He noted the extension was approved for one final year. 32 33 City Administrator Zikmund explained Kennedy & Graven had heard from Mr. Dahl's attorney 34 regarding the right-of-way acquisition. He noted the appraisal had been completed and explained 35 Mr. Harstad was working through the title issues for this project. 36 37 City Administrator Zikmund questioned how the Council wanted to address future committee 38 appointments. The Council supported staff conducting these interviews and appointments. It was 39 noted staff would work to seek diversity and equity in the new committee members. 40 41 C. MEETING IS CALLED TO ORDER Mayor Mueller announced due to the COVID-19 pandemic this meeting would be held virtually. 2. PLEDGE OF ALLEGIANCE 3. OATH OF OFFICE City Administrator Zikmund confirmed that all legal documents were in order and notarized. Administrator Zikmund administered the ceremonial Oath of Office to Mayor Carol Mueller and Council Member Gary Meehlhause. Mayor Mueller announced that Council Member -elect Theresa Cermak was having technical difficulties and would take her Oath of Office when she was able to join the meeting. 4. ROLL CALL: Bergeron, Hull, Meehlhause, Mueller (Cermak joined the meeting at 6:46 p.m.) NOT PRESENT: None. 5. COUNCIL BUSINESS A. Resolution 9370, Selection of the Acting Mayor, Treasurer and Official Newspaper and Depositories for 2021. City Administrator Zikmund requested the Council select an Acting Mayor, Treasurer, Official Newspaper and Depository for 2021. He reviewed the newspaper quotes with the Council and noted Western Bank's name had changed to American National Bank. Council Member Meehlhause supported Council Member Hull serving as the Acting Mayor for 2021. MOTION/SECOND: Hull/Bergeron. To Waive the Reading and Adopt Resolution 9370, Selection of the Acting Mayor, Treasurer and Official Newspaper and Depositories for 2021 as discussed. Ayes — 4 Nays — 0 Motion carried. Council Member -elect Theresa Cermak joined the meeting at 6:46 p.m. and took her ceremonial Oath of Office administered by Administrator Zikmund. B. Resolution 9371, Appointing City Council Members and City Staff as Representatives for City Commissions and Other Organizations for 2021. Finance Director Beer requested the Council appoint City Council Members and City Staff as Representatives for City Commissions and other organizations for 2021. Council Member Meehlhause stated he was willing to continue serving as the Council liaison to the Planning Commission, Park Recreation and Forestry Commission, and the Economic Development Commission. Council Member Bergeron indicated he could serve as an alternate as the Council liaison. Mayor Mueller explained the Mayor serves as the League of Minnesota Cities (LMC) liaison and asked who could serve as the alternate. Council Member Hull reported he could serve as the LMC alternate. Mayor Mueller indicated the Mayor serves and the North Metro Mayor's Association representative along with the City Administrator. Council Member Cermak volunteered to serve as the alternate. Council Member Meehlhause noted he served as the Mounds View Business Council representative. He noted any member of the Council could attend these meetings. Council Member Bergeron and Council Member Hull stated they would be willing to continue their service on the Development Review Committee. Council Member Cermak volunteered to serve as the Fire Board representative and Council Member Meehlhause volunteered to serve as alternate. Council Member Meehlhause requested to serve as the NYFS representative and Council Mounds View City Council January 4, 2021 Special Meeting Page 3 1 Member Cermak would serve as the alternate. 2 3 Council Member Hull and Council Member Meehlhause agreed to continue serving on the 4 Human Resources Committee. 5 6 Council Member Meehlhause stated he would serve as the City's representative for the Tourism 7 Board. 8 9 Council Member Meehlhause asked if the Park and Recreation Advisory Committee would 1 o continue serving now that the City had created its own Park and Recreation Department. Public 11 Works/Parks and Recreation Director Peterson stated this group would continue for a short 12 period while programming gets going. He stated he would like to see the Committee going from 13 two Mounds View residents to three. He noted it might not be necessary to have the YMCA at 14 these meetings. He explained he was not certain how long this Committee would continue to 15 meet. 16 17 Council Member Meehlhause stated he would be willing to serve as the Park and Recreation 18 Advisory Committee representative. 19 20 Council Member Cermak volunteered to serve as the alternate. 21 22 Council Member Bergeron explained he would be willing to continue to serve as the CTV 23 representative. 24 25 MOTION/SECOND: Hull/Bergeron. The PUD Narrative (0) specifies Allowed Uses: 3. Allowed Uses: Multi -screen movie theater Office space Parking Restaurant Restaurant max 2648 seats; 16 screens max 33, 000 gross sgft. They shall earn at least 60% of their annual gross sales revenue from the sale of food. The allowance for restaurants does not include bars or taverns, or high volume, fast food restaurants. The maximum size of the restaurants shall be determined at the time of development stage plan review, based on fitting both the building and the required parking onto the parcel shown for restaurant use. WHEREAS, the Planned Unit Development (PUD) Narrative (above) was amended in 2003 to allow "Office" as an Allowed Use on Lot 1, Block 2 of Anthony Properties ("Parcel A") located at 2442 Mounds View Boulevard (Apple Tree Dental) (Resolution 5997); and, WHEREAS, the applicant intends to apply to subdivide a portion of Lot 3, Block 1 of Anthony Properties ("Parking"), commonly known as the movie theater's parking lot; and for a Development Review for a Drive-Thru Restaurant to be located in the parking lot. Prior to Res 9381 Page 2 of 3 proceeding with design costs, the applicant is requesting approval to allow Drive-Thru Restaurants as an Allowed Use on Lot 3; and, WHEREAS, the Mounds View Planning and Zoning Commission reviewed the request at its January 6, 2021 meeting, recommending approval (Resolution 1128-21); and, WHEREAS, the City Council held a Public Hearing on Monday, January 25, 2021 at 6:30 PM. A Public Hearing Notice was published in the January 5, 2021 edition of the Shoreview Press, and mailed to property owners within 350' of the subject property; and, WHEREAS, the Mounds View City Council has reviewed the Applicant's request to amend the PUD Narrative, the Staff Report, and in consideration of public testimony, makes the following Findings: Findings: The property is zoned Planned Unit Development (PUD), and guided Regional Commercial (RC) in the current Comprehensive Plan (2010). The property is guided Mixed Use in the Draft Comprehensive Plan (2040). Drive-thru restaurants are not specifically addressed in the Draft Comprehensive Plan. The Mixed Use designation intends for development to occur as a PUD, with a 60/40 % residential/commercial mix. A restaurant is consistent with this commercial mix. 2. Lot 2, Block 2 of Anthony Properties, labeled as "Parcel B" in the PUD Narrative, currently includes a drive-thru restaurant (Subway). The proposed addition of a drive- thru restaurant such as a coffee shop, on Lot 3, Block 1, labeled "Parking" (e.g. theater's parking lot) in the PUD Narrative, is consistent with allowed uses elsewhere in this PUD. 3. The Mounds View Municipal Code, Section 1120.04 provides the procedure for approving a Planned Unit Development, including submittal of a detailed General Concept Plan, Development Stage, and Final Plan. These plans were approved in 1998 (Resolutions 5119 and 5226), and amended in 2002 and 2003 (Resolutions 5803 and 5997). It is the intent that any development of a restaurant or drive-thru restaurant shall comply with the Municipal Code, and be consistent with the PUD Narrative as amended. NOW, THEREFORE, BE IT RESOLVED, the Mounds View City Council, based upon the above Findings, the Staff Report, and in consideration of public testimony, hereby Approves an Amendment to the Planned Unit Development Narrative of the O'Neil Property; adding "Drive-Thru Restaurants" as an Allowed Use on Lot 3, Block 1 of Anthony Properties, commonly known as the movie theater parking lot, with the following conditions: All Allowed Uses listed in the PUD Narrative shall be Permitted Uses, according to the Mounds View Municipal Code unless further restricted by the PUD Narrative. Review and Construction Process MOUNDS VIEW PLANNING CASE NO. 517-98/471-97 EXHIBIT 1 OF RESOLUTION NO.5226 APPROVED BY THE MOUNDS VIEW CITY COUNCIL ON 5/11/98 O'NEIL PROPERTY PLANNED UNIT DEVELOPMENT ■ General Concept Plan The approved general concept plan shall be as approved by Resolution No. 5119 including stipulations found in Exhibit 1 of Resolution 5119 and the plan prepared by HLM Architects, Inc., dated 2-7-97, and placed on file in the Mounds View Community Development Department under Planning Case No.471-97. ■ Development Stage Plan The approved develoment stage plan shall be as approved by Resolution No. 5226 and as specified in Exhibit 1 of Resolution 5226 including stipulations and attached plans dated 3/6/98 and revised on 4/24/98 and 5/11/98. Where there are conflicts or inconsistencies between the general concept plan and the development stage plan, the development stage plan shall apply. ■ Final Plan Prior to the issuance of any building or grading permits, the property owner or their agent shall obtain approval for a final plan and construction drawings from the City administration, in accordance with Sections 1120.04 and 1000 of the Mounds View Municipal Code. Approval of the final plan and construction drawings may be in phases depending on the construction schedule for the development.. The final plan shall be recorded by the property owner with the County Recorder's Office, and proof of recordation shall be provided to the Community Development Department within 30 days of the date of approval. No permits shall be issued until such proof of recordation is provided. ■ Construction In accordance with Section 1120.04, construction shall commence within one year after the approval of a final plan for the PUD. Construction may be accomplished in phases. Failure to commence O'NEIL PLANNED UNIT DEVELOPMENT 2430 HIGHWAY 10 PAGE 3 OF 10 construction within two years shall, unless an extension shall have been granted, automatically render void the approval of the PUD. In such case, the City Council shall adopt a resolution repealing the PUD plan, and re-establishing the PUD plan shall require a new application, review and approval. 7. Accessory Buildings; Outdoor Storage No accessory buildings shall be permitted in this PUD except trash enclosures. No outdoor storage of any type other than parking of customer and employee vehicles during business hours shall be permitted. 8. Preservation of Tree Coverage In its undeveloped state, this site was covered by a mature oak woodland except for the area in wetland. The applicant has completed an inventory of all trees 10 inches or more in diameter as part of the development stage plan. Every effort shall be made to preserve the existing tree coverage as part of this plan, including the use of setback and buffer areas, and parking lot islands. The approval of this PUD requires the preservation of the existing tree coverage in as natural a state as is practical in all areas not shown for either building footprints, paving, or manicured landscaping within the developed portion of the site. Tree coverage shall also be preserved in the wetland buffer, unless removal is approved by the City Council as part of a wetland alteration permit. The property owner shall address problems with infectious tree diseases such as oak wilt as directed by the City Forester. During the lifetime of this project, If trees die due to natural causes or must be cleared because of tree diseases, the property owner shall be responsible for replacing them with trees of at least 2-1/2" caliper and of similar hardwood species, as directed by the City Forester. New trees shall be spaced so as to replicate the existing density of tree coverage within 10 years. MOUNDS VIEW PLANNING CASE NO.517-98/471-97 EXHIBIT 1 OF RESOLUTION NO.5226 APPROVED BY THE MOUNDS VIEW CITY COUNCIL ON 5/11/98 O'NEIL PROPERTY PLANNED UNIT DEVELOPMENT During construction, the property owner and/or developer shall be responsible for installation of protective fencing around treed areas which are to be preserved so construction activity does not damage the trees or their root systems, and die off from construction disturbance does not occur. The type of fencing and its placement shall be approved by the City Forester prior to issuance of any grading or building permits. The property owner and/or developer shall be responsible for maintaining the fencing in good repair throughout construction and for assuring construction activity and the parking of equipment is kept out of these areas. 9. Buffer Area; Screening Fence A critical element in the approval of this PUD is the preservation of a buffer area at least 50 feet deep along County Road H2. No construction of any buildings, paving, or other improvements, other than installation of the new public street, utility lines, landscaping and berming, shall be permitted in this area. The specific treatment to be used in the buffer area shall be as shown on the approved development stage plan . Areas used for installation of utility lines shall be revegetated in accordance with the approved landscaping plan. The existing tree cover to be retained shall be preserved as provided in #8. Except for the new public street and related improvements, No pedestrian or vehicular access shall be permitted through this buffer area. A screening fence shall be installed along County Road H2 (as shown on the development stage plan) and tied off at each end to prevent pedestrian traffic from the PUD development off the site. The fence shall be opaque and at least six feet in height. The area shown for office buildings may be graded and seeded until such time as the office buildings are developed. 10. Landscaping; Highway 10 Design Theme A detailed landscaping plan showing species, numbers and sizes of all plant materials has been provided as part of the development stage O'NEIL PLANNED UNIT DEVELOPMENT 2430 HIGHWAY 10 PAGE 4 OF 10 plan. The overall character of the landscape plan shall preserve the forested feel of the site, with allowance made for visibility of the PUD development from Highway 10. Prior to approval of permits for any building construction, the property owner shall grant an easement to the City for 15 feet in width along the Highway 10 frontage for use in implementing a Highway 10 design theme, as provided in Section 21. The property owner and/or developer shall incorporate landscaping materials necessary to implement the design theme selected for the Highway 10 frontage, if such a theme has been selected at the time building permits are requested. If a theme is selected subsequent to that time, the easement shall allow the City or City's agent to implement this design theme. The design improvements shall not unreasonably obstruct the visibility of the PUD development from Highway 10. During the lifetime of the PUD development, the property owner shall be responsible for the replacement of any dead or dying plant materials, and shall maintain the landscaping through regular watering, mowing, mulching, feeding, weeding and pruning. 11. Wetland; Wetland Buffer Area The wetland on the O'Neil property is protected by the Minnesota Department of Natural Resources (#171 W). No construction is permitted in the wetland, at or below an elevation of 895.8 feet or as determined by a wetland delineation study accepted by the Department of Natural Resources and the Rice Creek Watershed District. Construction in the wetland buffer area is anticipated as shown in the development stage plan, and will include water quality ponds (NURP ponds) and a portion of the theater, restaurant, and retail buildings, trash enclosures and parking areas. The detailed location of these improvements shall be established at the development plan stage. The property owner and/or developer shall obtain approval of a wetland alteration permit from the City for these encroachments into the buffer area prior to issuance of any building and grading permits. A minimum 10 foot wide natural buffer easement shall be provided MOUNDS VIEW PLANNING CASE NO. 517-98/471-97 EXHIBIT 1 OF RESOLUTION NO.5226 APPROVED BY THE MOUNDS VIEW CITY COUNCIL ON 5/11/98 O'NEIL PROPERTY PLANNED UNIT DEVELOPMENT adjacent to the wetland. 12. Drainage The approval of this PUD includes approval of a preliminary drainage design. This design includes the construction of two NURP (National Urban Runoff Program) ponds as shown on the development stage plan. The design shows runoff from the developed portion of the site being collected and directed to these ponds, where pollutants settle, and then into the existing wetland. A 15" pipe carries water from the wetland to the storm drain system in Long Lake Road. The 15" pipe is to be left as is, since the size of the pipe keeps the rate of flow from the wetland at historic levels and prevents overloading of the storm drain system in Long Lake Road. A detailed, engineered drainage plan has been submitted with the development stage plan for review and approval by the City Engineer. Final sizing of the NURP ponds and the design of the on -site drainage system shall be based on the detailed drainage study. No building or grading permits shall be issued until a final drainage plan is approved. The drainage improvements shall be constructed prior to the issuance of any occupancy permits for the theater or the office buildings. Prior to the issuance of any building or grading permits, the property owner is responsible for obtaining : ■ approval of a permit from the Rice Creek Watershed District, Department of Natural Resources, and U.S. Army Corps of Engineers, if such approvals are required: ■ the written statement from the Minnesota Department of Natural Resources that the development plan is in compliance with State regulations regarding wetlands (letter dated 3/26/98). ■ a written statement from the U.S. Army Corps of Engineers that the development plan is in compliance with Federal regulations regarding wetlands (letter dated 4/7/98). O'NEIL PLANNED UNIT DEVELOPMENT 2430 HIGHWAY 10 PAGE 5 OF 10 13. Lighting A lighting plan submitted with the development stage plan, includes the location of lighting standards, a detail of the lighting standard design, and photometrics for the site if lighting is installed according to the plan. The most southerly row of lighting standards shall not exceed 24 feet in height. 40 foot high light standards may be used in the remaining portion of the theater/office portion of the site. The lens of the lighting fixtures shall not extend below the housing and the housing shall include sharp cutoffs so that light rays are directed downward rather than outward. Light levels shall not exceed 1.0 foot candle when measured at the center line of any abutting street, and .4 foot candle on adjacent property. 14. Parking Lot Security The property owner shall put in place security measures if it is determined by the Mounds View Police Chief that there are persistent security problems associated with this PUD development. 15. Trash Dumpsters The development stage plan shows locations for trash dumpsters for each use in the PUD development. The trash dumpsters shall be placed within enclosures. The walls of the enclosures shall be constructed from the same building materials as the primary structure and shall have solid, opaque gates with a latching mechanism so that the doors remain closed except when trash is being dumped or removed. Chain link with plastic inserts is not acceptable for the gates. The enclosures shall be sized to allow maneuvering of the dumpster by trash trucks during winter weather conditions. 16. Site Maintenance; Snow Storage The property owner(s) shall be responsible for maintaining the landscaping, paving and other site improvements in high quality MOUNDS VIEW PLANNING CASE NO. 517-98/471-97 EXHIBIT 1 OF RESOLUTION NO.5226 APPROVED BY THE MOUNDS VIEW CITY COUNCIL ON 5/11/98 O'NEIL PROPERTY PLANNED UNIT DEVELOPMENT condition throughout the life of the development. The property owner(s) shall execute and record a maintenance agreement which assigns responsibility for maintenance of any common parking areas, landscaping and open space areas. The agreement shall be in a form acceptable to the City Attorney. The theater operator shall police the parking lot and remove all trash and debris every morning, prior to 9:00 AM, and on weekend evenings, prior to 6:30 PM. During the winter months, snow shall be plowed from the parking lot and placed in areas designated for snow storage or removed off -site. Snow shall not be stacked in the parking lot where it could result in reducing available parking. The site shall be maintained in a clean, attractive manner at all times. Snow storage areas, outside of the paved parking lot area, shall be as designated on the approved development stage plan. 17. Signage Signage shall be consistent with the coordinated sign program for this site submitted as part of the development stage plan. This sign program may propose different dimensions and types of signs than are allowed by the Mounds View Sign Code, while using the overall amount of signage allowed by the Sign Code for commercial businesses as a guide. The sign program is subject to review by the Planning Commission and approval by the City Council. The sign program shall establish a design theme through using similar colors, type styles, and materials so that the signage on the site has an overall, coordinated appearance. 18. Architectural Character A colors and materials board, elevations and architectural renderings have been submitted as part of the development stage plan review for each building requesting such approval. O'NEIL PLANNED UNIT DEVELOPMENT 2430 HIGHWAY 10 PAGE 6 OF 10 ■ Theater Building: The theater building shall be of high -quality masonry construction, using either brick, split face block, stone, or exterior insulation finish system (EIFS), and shall have architectural detailing to add interest and character to the building. Materials and detailing shall be continued on all exterior sides of the building. A "false front" style of construction where materials and detailing appear only on the front facade shall not be allowed. Colors used for the theater building shall tend to minimize rather than accentuate the bulk of the building. ■ Office Buildings: The office buildings shall be of high -quality masonry construction, compatible with the theater building. The style of the buildings shall be residential in character. Materials and detailing shall be continued on all exterior sides of the building. There shall be windows on the south elevations similar to the design of the north elevation. No service doors shall be permitted on the south side. ■ Restaurant and Retail Buildings: The restaurant and retail buildings shall be high -quality masonry construction, or its equivalent, and presenting a substantial image. Allowance shall be made for the corporate style of a particular restaurant company, as long as a quality image is presented. Materials and detailing shall be continued on all exterior sides of the building. The provision of outdoor patio dining, visible from Highway 10, is encouraged. 19. Access; On -Site Circulation The development stage plan includes one signalized full access point from Highway 10 approximately midway between Long Lake Road and County Road H2. A secondary right in right out access shall be provided to Highway 10 at the southside of the property as per the MnDOT approval letter dated 5/11/98. The width and design of the MOUNDS VIEW PLANNING CASE NO.517-98/471-97 EXHIBIT 1 OF RESOLUTION NO.5226 APPROVED BY THE MOUNDS VIEW CITY COUNCIL ON 5/11/98 O'NEIL PROPERTY PLANNED UNIT DEVELOPMENT access points shall meet the requirements of the Blaine -Spring Lake Park -Mounds View Fire Department and MnDOT. There shall be constructed a new public street between Highway 10 and County Road H2 as per the MnDOT approval letter dated 5/11/98. There shall be no traffic access to Long Lake Road except from the restaurant site at the corner of Long Lake Road and Highway 10. The access from the restaurant site shall be located north of the intersection of Long Lake Road and Mounds View Drive. There shall be no vehicular access from the restaurant site to any other parcel within the PUD. The property owner/developer and the City shall undertake efforts to obtain final approval from MnDOT for a full movement signalized intersection to serve this development. The outcome of this effort shall not affect the ability of the property owner/developer to obtain use and occupancy permits for the theater complex or the office buildings. The final design of internal circulation on this site shall be determined as part of the development plan. Internal circulation shall be designed to move traffic off of Highway 10 quickly, and shall separate the drive aisles leading to the parking bays from the drop-off area in front of the theater building so congestion does not occur and traffic does not back up on Highway 10. 20. Acceleration/Deceleration Lanes; Sidewalks The property owner/developer shall construct acceleration and deceleration lanes on Highway 10 at any access point as required by MnDOT. The property owner/developer shall construct a sidewalk or pathway along Highway 10 between Long Lake Road and County Road H2, and along the north edge of the wetland to provide a connection to the existing sidewalk/trailway along Mounds View Drive which leads to Silver View Park. The design, width and placement of these sidewalks shall be determined by the City. O'NEIL PLANNED UNIT DEVELOPMENT 2430 HIGHWAY 10 PAGE 7 OF 10 21. Platting & Easements ■ Platting and Park Dedication Requirements The property is to be subdivided into 6 Iots.The land division shall be considered a major subdivision and as such shall comply with Title 1200 of the Mounds View Municipal Code. This title includes a requirement for dedication of park land or, at the option of the City of Mounds View and at its sole discretion, payment of park dedication fees in lieu of land dedication, based on the fair market value of the undeveloped land. The requirements for easements noted below shall be fulfilled as part of the platting process, except that no final plan shall be approved and no building or grading permits issued until the requirements for easements have been fulfilled either by platting or by separate recorded documents. ■ Cross Access and Parking Easement The property owner shall provide to the City a cross access and parking easement which allows use of the access point(s), drive aisles and parking by the theater complex and the office buildings. The cross access and parking easement shall be approved as to form by the City Attorney, executed and recorded prior to approval of the final plan. ■ Drainage Easement The property owner shall provide to the City perpetual drainage easement for that area lying within the delineated boundary of the wetland, and for the NURP ponds. The drainage easement shall be approved as to form by the City Attorney, executed and recorded prior to approval of the final plan. The property owner shall assume maintenance of the NURP ponds if so required by the City in the easement. MOUNDS VIEW PLANNING CASE NO. 517-98/471-97 EXHIBIT 1 OF RESOLUTION NO.5226 APPROVED BY THE MOUNDS VIEW CITY COUNCIL ON 5/11/98 O'NEIL PROPERTY PLANNED UNIT DEVELOPMENT ■ Easement for Implementation of Highway 10 Design Theme The property owners(s) shall provide to the City an easement of not less than 15 feet along the Highway 10 frontage to allow for design improvements such as landscaping, sidewalks, and lighting which would implement a design theme for Highway 10. This easement may coincide with the setback requirement for parking areas from Highway 10. A perpetual easement obtained from MnDOT for use of Highway 10 right-of-way for this purpose may be substituted for an easement on the O'Neil property. 22. Fire Protection The design of the access point(s) and placement of on -site fire hydrants shall be approved by the Blaine -Spring Lake Park -Mounds View Fire Department. The requirements of the Fire Department shall be met prior to issuance of any use and occupancy permits on the property. 23. Undergrounding of Utilities; Utility Design All existing utilities within the site boundaries and any additional utility lines installed in conjunction with this development shall be installed underground. Existing utilities may be placed underground concurrent with the installation of new utilities. A monetary guarantee for the placement of utilities underground shall be provided if required by a development agreement. Development in this PUD shall connect to public water, sewer and storm sewer systems. The requirement for utility shut-off values and service manholes shall be determined at the time of development stage plan and plat approval, based on the criteria in Section 1120.02 of the Mounds View Municipal Code. 24. Site Improvement A site improvement agreement shall be signed by the property owner prior to approval of the final plan. The agreement shall specify the on - site and off -site improvements to be constructed and shall be guaranteed through an escrow account, letter of credit or surety bond as determined by the City Clerk -Administrator. 25. Allowable Uses include sit- down restaurants, and specifically excludes fast-food restaurants and bars with less than 60% of its revenue from food sales (Moe's is not part of this PUD). New Vision Theater closed' in March 2020 due to the COVID Pandemic, and filed bankruptcy in July. The theater owner; Anthony Properties (AP Mounds View LP), has been in negotiations with another operator to assume the theater's lease. The theater industry has been hit hard by the pandemic, thus, there is no time -table as to if or when Mounds View's theater will re -open. Prior to New Vision's bankruptcy, New Vision intended to remodel the theater to include stadium style seating, which would reduce the seating capacity and parking needs by 50%. Assuming that a new theater operator will pursue a similar renovation plan, this frees up a portion of the parking lot for other uses, such as a drive-thru coffee shop. The retail/restaurant building was built in 2004, now occupied by Akway's Barber Shop, State Farm Insurance, Subway, and a vacant unit. Subway includes a drive-thru, not unlike the proposed coffee shop drive-thru. Analysis: Drive-thru restaurants are a Conditional Use (CUP) in the B-3 Highway Business District. The B-3 district includes such businesses as Steve's Appliance, CVS, Tommy's Carwash, Burger King and McDonalds. Within the B-3 District, Drive-thru restaurants must have an architectural appearance similar to surrounding buildings, and otherwise be in compliance with other requirements of the City Code.2 If the PUD Narrative is amended to include Drive-thru Restaurants as an allowable use, it is the same meaning as a Permitted Use, meaning, a CUP would not be required for any drive-thru restaurants on the Theater's parking lot. The developer intends to apply for a Subdivision and Development Review. The Development Review will be the opportunity for the Planning Commission and City Council to address any topics related to traffic flow, architecture, landscaping, etc. The current application is only for the type of use (drive-thru restaurants), not any specific design criteria. The Commission's discussion included concerns that once the PUD is amended, additional drive- thru restaurants could be built without review by the Commission. If additional restaurants are proposed, they would not require a CUP, but would require a Development Review, thereby proving an opportunity for the Planning Commission and City Council to review the project. Public Works Staff has researched and demo'd trucks available on the State Contract along with researching the plow components also available on the State Contract. Upon consensus, the recommended unit is a 2021 Mack GR4213R, single axle unit, with a Cummins ISL-D 345hp diesel engine, Allison 3000-RDS 6 speed transmission from Nuss Truck & Equipment which is under the State contract and is in the amount of $95,232.00, not including license and transfer fees. In addition to the truck itself, additional equipment and options are necessary to fully utilize this truck and they include: a dump body, front plow, wing plow, snowplowing light package, underbody scraper and controls. Chapter 801 was adopted in 1988 and has had various revisions through the years. Discussion: Public Works Staff has reviewed the current Snow & Ice Control Policy and in working with the City Attorney, City Administrator and the Police Chief is recommending changes to the Policy along with changes to Chapter 901, Ordinance 451 regarding the Parking Restrictions. These recommendations to Title 800, Chapter 802, Section 802.05 are as follows: 802.05: IMPEDING TRAFFIC OR STREET MAINTENANCE: Subd. 1. No person shall allow a motor vehicle to remain parked on public property or in the right-of-way when said motor vehicle impedes, impairs or prohibits the free flow of traffic. Subd. 2. No person shall allow a motor vehicle to remain parked on public property or in the right-of-way when said motor vehicle impedes, impairs, or prohibits maintenance or construction equipment from properly conducting their functions, including street maintenance, snowplowing, or snow removal services. Subd. 3. The Director of Public Works or his or her designee, may, in con'unction with a police officer, authorize the removal of any vehicle parked in violation of this Section, as provided by Section 802.10 of this Chapter. Subd. 4. For a violation of this Section, the Director of Public Works, or his or her designee, shall issue an administrative fine as outlined in the current year's fee schedule in addition to any additional charges, fees, or fines. SECTION 2. Provided, however, that parking shall be permitted within any block of any public street where not otherwise prohibited whenever the entire length of the roadway of such block has been cleared of snow from curb to curb or, in the case of streets without curbs, between the outer edges of the shoulders of such streets. Any vehicle parked in violation of this Section may be removed as provided by Section 802.10 of this Chapter. Subd. 2. Snow Emergency Declaration for Snow Plowing and Ice Control Operations: a. Introduction: The City of Mounds View finds that it is in the best interest of its residents to assume basic responsibility for control of snow and ice on public streets, trails, sidewalks, and parking lots under the jurisdiction of the City. Reasonable snow plowing and ice control is necessary for routine travel and emergency services. The City will use city employees, city -owned or rented equipment, and/or private contractors to provide this service. B. Purpose: The purpose of this policy is to establish standard guidelines and objectives for snow plowing and ice control operations. The City will attempt to provide such operations in a safe and cost effective manner, keeping in mind safety, budget, personnel, and environmental concerns. C. Application: This policy applies to all public streets, trails, sidewalks, and parking lots located on City property and in public rights -of -way under the jurisdiction of the City, including trails and sidewalks located within Ramsey County public rights -of -way that are maintained by the City. This policy does not apply to snow removal maintenance of ice hockey and skating rinks. D. Appointed Authority. The Public Works SupeFvisef is primarily responsible to carry out the provisions of this policy and oversee its guidelines and objectives. E. Unusual or Extenuatina Circumstances: While the City fully intends to meet the guidelines and objectives established in this policy, there may be times when this is not feasible due to unusual or extenuating circumstances involving, but not limited to, weather, equipment failure, resources, budget constraints, emergencies, and force majeure events. Commencing Snow Plowing and Ice Control Operations 1. The Public Works S4pep4sef Superintendent will decide when to begin all snow plowing and/or ice control operations. The criteria for that decision are: (a) Snow accumulation amounts; (b) Drifting of snow that causes problems for travel; (c) Icy conditions which seriously affect travel; (d) Time of snowfall in relationship to heavy use of streets; (e) Air and pavement temperatures; and (f) Weather forecast. 2. Snow plowing and ice control operations are expensive and involve the use of limited personnel and equipment. In addition, snow and ice characteristics, as well as pavement and weather conditions, vary extensively and can be unpredictable for each winter storm. Therefore, the Public Works Supervisor will exercise his or her professional judgment when evaluating the decision to begin snow plowing and ice control operations. B. Snow and Ice Control Methods 1. The City will choose from a variety of available snow and ice control methods best geared to tackle the varying conditions of snow, ice, weather, and pavement conditions for each winter storm event. Some of these methods may use sand, salt, and other chemicals when there are hazardous ice or slippery conditions. The City is concerned about the effect of such chemicals on the environment and will limit its use for that reason. 2. The following methods, or combination thereof, may be used in the City's snow plowing and ice control operations: (a) Snow Plowing is the pushing of accumulated snow with a snowplow blade and redirecting it into the boulevard areas (typically). This is the traditional and most common form of snow removal from pavements. (b) Snow Blowing is similar to snow plowing but employs a motorized rotary blowing device to propel the snow into the air and away from the area being cleared. (c) Applying Salt is the spreading of rock salt onto the pavement surface to melt snow and ice accumulations where hazardous ice or slippery conditions exist. The effectiveness of salt to melt snow and ice is typically limited to pavement temperatures above 0° F. (d) Applying Sand is used in locations where a layer of ice covers the pavement surface and air temperatures are too cold for salt to effectively melt the ice. Sand applications may be used at traffic intersections with hazardous ice or slippery conditions to improve vehicular friction for stopping and traction for acceleration. (e) Pre -wetting is when brine or other chemical solutions are added to the salt (and/or sand) mixture prior to dispersal to the pavement surface, causing the mixture to stick to the pavement instead of blowing off the pavement. (f) De-icing is a generic term for the removal of existing snow and ice from a pavement surface by either mechanical means (plowing or scraping) or chemical methods (applying salt or other ice melting chemicals). De-icing activities are intended to break the bond between a layer of ice or snow and the pavement surface. (g) Anti -icing is the pretreatment of pavements with ice melting chemicals (usually liquid brine or wetted salt) before a winter storm to prevent or delay the formation of ice and frost, or the adhesion of ice and snow, to the pavement surface. Anti -icing can significantly reduce the amount of salt needed during de-icing operations and allows easier removal by snow plows. (h) Winging Back is the pushing of snow banks further into the boulevard and away from the driving surface. Winging back is typically performed between winter storms to create additional snow storage volume for future snow storms or to increase traffic sight lines at intersections. (i) Hauling or Snow Removal is the removal of snow piles and windrows, created by prior snow plowing operations, by loading into trucks and hauling to a snow storage area. Hauling is commonly performed after other snow removal operations are complete. C. Performinp Snow Plowing and Ice Control ❑ erations Street Operations (a) A map showing the general snow plow routes for streets is included as Exhibit A. (b) Snow will be plowed in a manner to minimize traffic obstructions. (c) In general, the center of the street will be plowed first. The snow will be pushed from left to right on two-way streets. The discharge shall go onto the boulevard area of the street right-of-way. (d) In times of extreme snowfall, streets may not always be immediately cleared of snow completely. An initial pass will try to plow the street as wide as possible to allow for vehicular passage. Subsequent passes will attempt to clear the remaining snow from the street. Clean up operations will occur last to clear intersections and snow storage areas along corners and County intersections. (e) Widening and clean up operations may occur on the initial day of snow plowing or on the following working day for most winter storms. There may be major winter snow storms that will necessitate additional time to complete widening and clean up operations. 2. Trails and Sidewalks Operations (a) Trails and sidewalks adjacent to streets will typically be plowed after the adjacent street has been cleared of snow. In general, the snow will be pushed onto the boulevard area furthest from the street. In times of extreme snowfall, subsequent passes may be needed to clear additional snowfall that has fallen or been discharged from street snow plowing operations onto the trail or sidewalk. (b) Trails and sidewalks will be plowed, blown, or swept depending on the amount and type of snowfall. The City will attempt to clear trails and sidewalks as thoroughly as possible, but they may not be cleared of all snow and ice or maintained to bare pavement. 3. Municipal Parking Lots Operations (a) City -owned parking lots that are generally empty of parked vehicles and/or whose facilities closed for business at the time of plowing will typically be plowed in the most efficient manner to clear the accumulated snow from the drive lanes and parking spaces. Parking lots that contain a higher number of parked vehicles make plowing the entire lot difficult. In these cases, the drive lanes may be plowed for vehicular passage. Plowing of parking spaces and other clean up operations may need to occur later after the lot becomes emptier of parked vehicles. (b) The City will attempt to clear the parking lots as thoroughly as possible, but they may not be cleared of all snow and ice or maintained to bare pavement. The City may make exceptions with handicapped stalls and associated circulation routes. 4. Other ❑ erations (a) Metro Transit is responsible for winter maintenance of their bus stops in the city. However, if commuters are subject to hazardous or unsafe conditions due to lack of adequate space to wait, the City may attempt to clear the waiting area in conjunction with snow and ice control for trails, sidewalks, or clean up operations. (b) Private property owners are responsible for clearing snow and ice control activities associated with their properties. The City will not perform snow plowing or ice control operations for any driveways, streets, sidewalks, or parking lots owned by private entities. D. Determining Priority Snow Plow Routes and Coordinating Operations 1. Priority Snow Plow Routes for Streets (a) The City has designated certain streets as "Priority Snow Plow Routes" to set precedence for which streets provide the most benefit to the City when snow plowing and ice control demands exceed available resources. This designation was generally based on street function, traffic volume, and importance to the welfare of the community. The highest ranking streets typically have higher traffic volumes and connect major sections of the city and region, whereby providing emergency access for fire, police, and medical services to these various sectors. These high-ranking streets typically have a functional classification as arterials and collectors. Other designated priority streets that provide additional emergency access have functional classifications as local streets. These local priority streets also provide good access to schools, civic centers, commercial businesses, industrial parks, and other points of interest. Table 1 lists the street segments that make up the Priority Snow Plow Routes and includes sub -ranking and other considerations used in determining priority routes. A map showing the street segments and sub -ranking of the Priority Snow Plow Routes is included as Exhibit B. 2. Priority Routes for Trails Sidewalks, and Municipal Parkin Lots (a) Snow plowing and ice control priorities for City trails and sidewalks are based upon use, location, and connections to other trails and sidewalks. Priorities for trails and sidewalks consider school routes and zones and proximity to arterial and collector streets, city facilities, and bus routes. These priorities may change based upon time of day and day of week that snow plowing and ice control operations begin (and end) for each winter storm, compared to the schedules of the schools, bus company, and business hours. Table 2 summarizes the priorities for all city trails and sidewalks as high, medium, and low. A map showing the trail and sidewalk system, along with the parking lots, is attached as Exhibit C. (b) Prioritization for snow plowing and ice control operations for municipal parking lots also varies depending on time of day and day of week compared to usage of parking lots. Parking lots used by public safety vehicles (police, fire, etc.) will take precedence over other parking lots. Prioritization ranking for snow plowing of the municipal parking lots is summarized on Table 2 and locations shown on the Exhibit C map. 3. Coordinating Snow Plow and Ice Control Operations (a) The City has a limited number of specific pieces of equipment for snow removal and ice control. Most of this equipment is customized for only streets or trails/parking lots or sidewalks. In addition, City employees are assigned to specific routes with backups assigned. Therefore, snow plowing and ice control operations for streets, sidewalks, and trails/parking lots are more -or -less separate processes and priorities between these infrastructures seldom conflict. (b) During significant and severe winter storms, the City must be prepared to move personnel and equipment to maintain Priority Snow Plow Routes if needed. In fulfilling the need to have all priority streets safe and passable, when resources are limited, plowing of all other streets may be stopped at any time so resources can be shifted to priority routes. (c) Snow plowing and ice control operations for municipal parking lots and trails may be intertwined since travel between municipal parking lots occurs on the trail system. (d) Unforeseeable circumstances may cause delays in completing assigned plow routes. Such circumstances may include weather conditions that endanger the safety of snowplow operators and/or safe and effective operation of equipment, commuter traffic, disabled vehicles, poor visibility conditions, parked cars along streets, assistance to emergency response vehicles, equipment breakdown, and personnel shortages. 3. RULES, REGULATIONS, AND PROPERTY DAMAGE A. Traffic and Parking Regulations 1. Snowplow Operator Exemption Minn. Statutes Chapter 169 (a) The City recognizes that snowplow operators are exempt from traffic regulations set forth in Minnesota Statutes, Chapter 169 while actually engaged in work on streets, except for regulations related to driving while impaired and the safety of school children. Pursuant to this authority, snowplow operators engaged in snow removal or ice control on city streets have discretion to disregard traffic laws set forth in Chapter 169, except for laws relating to impaired driving and school children safety, when in their judgment, it is safe to disregard such laws. (b) The privileges granted herein to operators of snow removal and ice control vehicles shall apply only if the vehicle is equipped with one lighted lamp displaying a flashing, oscillating, or rotating amber light placed in such a position on the vehicle as to be visible throughout an arc of 360 degrees. 2. Snow and Ice Accumulations i Munici pal Code Section 801.40 Subd. 1 (a) "All snow accumulated from clearing or plowing operations on private property shall be stockpiled on the property from which the snow is cleared or upon other private property for which the property owner has written permission. In clearing snow and/or moving snow, it shall be unlawful to operate in such a manner as to cause any snow to be deposited in the street, on sidewalks, in the boulevard of any street or on private property for which the property owner does not have written permission for storage of snow. Snow cleared from the portion of a driveway or sidewalk in the boulevard of a street may be placed on the boulevard adjacent to the driveway or sidewalk, but may not be moved across the street to other areas without express permission of the property owner receiving the snow." 3. Parking During Snow Accumulations (Municipal Code Section 802.06) (a) "No person shall park or permit to be parked any vehicle within any block on any public street when, within the preceding forty eight (48) hours, melting or blowing snow or a combination thereof has accumulated to a depth of t#Fee two inches (32 2") or more at street level anywhere within that block. Provided, however, that parking shall be permitted within any block of any public street where not otherwise prohibited whenever the entire length of the roadway of such block has been cleared of snow from curb to curb or, in the case of streets without curbs, between the outer edges of the shoulders of such streets. Any vehicle parked in violation of this Section may be removed as provided by Section 802.10 of this Chapter." 4. Parkin — Restricted Hours (Municipal Code Section 802.08 Subd. 1 (a) "No person shall stop, stand or park a motor vehicle or trailer on any street or highway in the City between the hours of twelve two-e'sler. (2:00 12:00) A.M. and six o'clock (6:00) A.M., except as otherwise authorized by this Chapter or unless directed or authorized by a police officer or traffic -control device. The City Council may authorize exceptions from this Section. Any street or highway so excepted must be posted with a sign indicating that parking between twelve #ewe-e'Glesk (2:00 12:00) A.M. and six o'clock (6:00) A.M. is allowed." 5. Vehicle Towi na Provisions Munici pal Code Section 802.10 Subd. 3 & 4 (a) "Police officers are hereby authorized to remove, or cause to be removed, a vehicle from a street or highway to the nearest garage or other place of safety or to a garage designated or maintained by the Police Department or otherwise maintained by this City under the circumstances hereinafter enumerated: Subd. 3. Unattended, Illegally Parked Vehicles: When any vehicle is left unattended upon a street and is so parked illegally as to constitute a hazard or obstruction to the normal movement of traffic or snow plowing. Subd. 4. Violation of Provisions: When any vehicle is parked upon a public street in violation of the provisions of this Chapter." 6. Snow Emergency Declaration for Snow Plowing and Ice Control Operations: f. A snow emergency declaration shall be made by the Director of Public Works, or his or her designee. g. During a snow emergency, it shall be unlawful for any person, except an operator of an emergency motor vehicle on an emergency call, to park or leave standing any vehicle on any public property or in the right-of-way during the hours of twelve o'clock midnight (12:00) A.M. and six o'clock (6:00) A.M. h. A snow emergency shall begin at twelve o'clock midnight (12:00) A.M. on the date following the date on which the snow emergency declaration is made. The snow emergency shall last for 54 hours, or until six o'clock (6:00) A.M. on the third day after the snow emergency begins, unless the City declares an earlier end. If the snow emergency is ended early, the City will use all available methods of notification to notify residents of the canceled snow emergency. i. The Director Public Works, or his or her designee, may also, in conjunction with a police officer, authorize the removal of any vehicle parked in violation of this Section, as provided by Section 802.10 of this Chapter. j. The owner of any vehicle that is removed shall be responsible for the actual costs of removal and storage in addition to any additional charges, fees, or fines. B. Property Damage General: In accordance with Municipal Code Chapter 910, the City manages and regulates the pubic right-of-way to ensure the integrity of its streets and the appropriate use of its rights -of -way. Regulation is done through a permitting process for any work or installation that occurs in the city boulevard. Many adjacent property owners place or install private property objects or make improvements in the boulevard without City knowledge making the object or improvements subject to damage. A key function of this boulevard area during winter is snow storage from streets. Snow plowing operations can damage private property objects located in the boulevard in two general ways: 1) •; ; !,,'%�•; i',Q ;)i .i;i t; '!P f CN,'tii•:rii-f7 •, direct physical contact with the plowing equipment, or 2) damage from snow during snow plowing operations. 2. Mailboxes (a) Mailboxes may be placed in the boulevard without prior City approval. The mailbox is owned by the property owner, and the delivery of mail is an arrangement between the property owner and the US Postal Service. The City will attempt to remove snow as close to the curb lines as practical for delivery of the mail, but it is the property owner's responsibility to perform final clean up along the curb to ensure his or her mail delivery. (b) Damage to a mailbox is a risk that snowplow operators face during their winter plowing operations. The mailbox assembly (mailbox with post) should be constructed securely enough to withstand snow rolling off a snow plow blade or wing. The City will not be responsible for any mail posts that are rotten or too weak to withstand this snow mass. In addition, any mailbox or newspaper tube that is crushed, dislodged, or lost is the responsibility of the property owner. (c) The City will conduct a review of each mailbox damage claim to determine whether the City has any legal responsibility for the damage. In general, the City may claim responsibility for the damage only if direct physical contact was made between the City plowing equipment and the mailbox assembly. If the City, at its discretion, claims responsibility to remediate damage to mailbox assemblies, the City will first consider repairing the mailbox assembly. If repair is not feasible, then the City will furnish and install a new mailbox and/or post. (d) Grouped mailbox assemblies (commonly furnished and installed with street reconstruction projects) have a shared ownership. The City is responsible for the timber post and cross -beam, while the resident is responsible for his or her individual mailbox that is attached to the City's post/cross-beam. 3. Boulevard Turf Grass (a) Turf grass in the boulevard can be damaged by snow plowing equipment during winter snow plowing operations. The City will assess the damaged boulevard turf and compile a list of substantiated locations for restoration the following spring. Most restoration will use fertilizer and seed; however, some locations may require restoration with sod due to site specific conditions. The decision to use sod for restoring boulevard turf grass is at the discretion of the City. All restoration costs for damaged boulevard turf grass will be the City's responsibility. 4. Irri anion Landscaping, Tress/Shrubs Fences and Other Items (a) The City will assume no responsibility for damage to irrigation systems, landscaping, retaining walls, trees, shrubs, fences, private lighting systems, or any other private property objects located in the City's public right-of-way. Property owners are encouraged to mark these items with non-metal markers (such as wood or plastic rods) before winter to lessen the possibility of damage. (b) Garbage containers should only be brought to the curb on designated pick-up days and be placed only in the driveway or boulevard and kept entirely off the street to avoid conflicts with snow plowing operations. (c) The City will assume no responsibility for damage to vehicles, boats, RVs, equipment, and other similar items parked in the City's boulevard. Parking of these items in the boulevard is prohibited under Municipal Code Section 802.07 Subd. 4. 4. GENERAL and Administrative PROVISIONS A. Documentation and Record -Keeping The City will document snow plowing and ice control operations as described in this policy, including snow removal logs, priority route changes, property damage reports, general complaints, and policy comments. 2. Records will be retained by the City in accordance with the records retention policy. B. Employee Safety and Training 1. Snow and ice control operations will be conducted only when weather conditions do not endanger the safety of snowplow operators and equipment. Factors that may delay snow plowing and ice control operations include severe cold, significant winds, and limited visibility. 2. The City will provide training to employees responsible for snow plowing and ice control operations. Training of some employees may include education necessary to earn and maintain appropriate certifications or licenses for these operations. Training will also address standard operating procedures, proper use of equipment, emergency response, and other topics required by State and Federal regulatory agencies. C. Public Safety and Communication 1. This policy does not relieve operators of private vehicles, pedestrians, bicyclists, property owners, residents, and all others that may be using public streets, trails, sidewalks and parking lots of their responsibility to act in a reasonable, prudent, and cautious manner, given the prevailing pavement conditions. 2. Periodically, the City may inform residents of policy provisions in an effort to communicate objectives and responsibilities related to this policy. D. Complaint Procedures 1. Complaints will be recorded on telephone logs and be investigated for substantiation by the Public Works SupeFviser Superintendent. Valid complaints requiring remedial action will be prioritized by the Public WorksSupew+sef Superintendent and scheduled accordingly. Emergency complaints will be handled in an expeditious manner as resources are available. E. Deviation from Policy 1. The Public Works Supervise Superintendent may deviate from this policy when in his or her judgment it is in the best interest of the City or is necessary because of budget needs or other unusual or extenuating circumstances. F. Review and Modification of Policy 1. This policy will be reviewed periodically to ascertain if its provisions are practical, timely, and legal. Any review will consider comments and complaints since the last review and any other factors affecting the policy or its implementation. 2. The Director of Public Works is authorized to make and implement modifications to the policy after providing notification to the City Administrator. Proposed modifications that significantly affect the policy's scope of services, purpose, application, and/or budget in a negative manner will be approved by the City Council prior to implementation.
