STAFF REPORTS A. YMCA: SEE ATTACHED REPORT: MVCC will be closing effective Friday, Nov. 20, 2020 at 6:00 PM for at least the next four weeks. They will continue to have YMCA distance learning care. Rise Care will also continue. Continue to monitor the status of youth sports in MN and take registrations for upcoming programs. Have been running Senior fitness classes and some painting classes. Membership: 93 active members with 83 as Senior memberships. Daily passes are at about 25% of previous years due to COVID capacity requirements. Gym rentals are pretty consistent even with the lower capacity. Event Center and park building rentals will be shut down for the next four weeks per Governor Walz order. Rink attendant positions have been posted to be ready after the YMCA to MVCC transition so they will be ready if/when the warming houses can be opened. New air filters are being installed soon at MVCC, City Hall, and Public Works building. Do we want to rent out the outdoor rinks to teams for practices and games since they might not be able to use indoor facilities? Capacity needs to be watched in the warming houses to keep it at 10 including the rink attendant. Yes! B. Public Works: SEE ATTACHED REPORT. Forestry marking some trees for removal. Installed some new fountains at Silverview pond. Looking to get another aerator installed in the spring. 7. UNFINISHED BUSINESS - none at this time 8. NEW BUSINESS A. Update on transition of Park and Recreation Program: City Council voted to discontinue contract with YMCA and take over the recreation and operation of MVCC. Andy Thomas has been hired to be the director. Other job descriptions will be approved by City Council soon and then hiring can begin. Some current staff are willing to transfer over to these positions. Talking to New Brighton to develop a program partnership. Will continue YMCA distance learning program at MVCC and Youth in Government program as well. MVCC is working on developing programming for seniors like Silver Sneakers and summer youth. 1 1 P a g e Memberships will change over from YMCA to MVCC. Membership fees have been established through the MVCC Advisory Committee and not YMCA. These fees will continue as is. Eventually the Advisory Committee will be dissolved and absorbed by the PRF Commission. B. Review of Applications for Park and Recreation and Forestry Commission seats: Two seats are up: Arel and Zaiger. Three applications have been received. Current updates are in black text, and updates from the previous two month period are in grey. Ardan Park • Working with Stantec Engineering on some drainage issues in the Park. Application to perform some storm water pond maintenance was submitted to RCWD. 1IPage Public Works Staff Report City Hall Campus: • New Picnic Shelters are being built, will be ready for next season rental. ■ Worked with plumber and vendor to winterize the splash pad. • Installation of the New Picnic Tables started Groveland Park: • Final Inspection of Punch list items on 10/25/2018 for Tennis/Basket Ball Court Greenfield Park: Notified by the DNR that corrections to be made to the tennis court gate entrance — ADA accessible. Fencing contractor scheduled for next month Leveled the trail running in the back portion of the Park, added class 5 as needed. Commission will need to discuss at the July 2020, Green field baseball field. Take out all turf from first and third base line and replace with Ag-lime to the fence. Most all new park construction is going this way with ball fields. This would solve the wet home plate issue and uneven base line issues. Hillview Park: Hockey rink fence completed, Public Works staff completed installing the boards. Grading and fill need to be completed. Depending on the weather the base may be a 2018 project. • Ag-lime base to be completed in 2018. • Commission will need to discuss at the July 2020, playground Rehabilitation. Lambert Park • Inventory of Hockey Rink boards to re -place started. • Commission will need to discuss at the July 2020 Meeting size of the Hockey Rink. Random Park: • Commission will need to discuss at the July 2020, playground Rehabilitation Silver View Park • Ramsey County continues to work in re -profiling the draining ditch along County Road I and Silver View Road, located in Silver View Park. • Four new pond aerators installed in the Strom Water Pond Woodcrest Park • Working with Stantec Engineering and Ramsey County on some drainage issues in the Park. Application to perform some storm water pond maintenance was submitted top RCWD 2 1 P a g e PARKS AND RECREATION AND FORESTRY COMMISSION MOUNDSEW Background and Purpose: The Parks and Recreation and Forestry Commission was established by the Mounds View City Council in 1988 for the purpose of advising the Council on the operation of public recreation, parks, and playgrounds (MV Chapter 405). The Commission consists of seven (7) members appointed by the City Council (based on the recommendation of the Commission) from applications submitted by interested Mounds View citizens. Terms and Vacancies: Appointed members of the Commission will serve three (3) year staggered terms with terms expiring December 31 of each year. Appointments to a term of less than three (3) years are permissible in order to establish appropriate staggering of member terms. Both original and successive appointees shall hold their offices until their successors are appointed and qualified. 'Any vacancies during the term shall be filled by the Mayor with the approval of the majority of the Council for the unexpired portion of the term. Commission members serve without compensation take an oath of office. Organization: Commission officers include a Chair, Vice Chair, and Secretary. The City Council appoints a chairperson based upon the recommendation of the Commission. The Commission selects a Vice Chairman from its membership for a term of one year. The Secretary may be selected from the Commission membership or from City staff. The Director of Public Works/City Engineer and Parks Supervisor are City staff liaisons to the Commission. Meeting Dates and Frequency: The Commission regularly meets on the fourth Thursday of each month at 6:30 pm in the Council Chambers at the Mounds View City Hall. The meeting dates may be changed or tweaked as needed by the Commission (due to holidays, etc.), but the Commission is required to conduct at least twelve (12) regular meetings each calendar year. The Commission may occasionally have joint meetings with the City Council and/or the Planning and Zoning Commission on an as -needed basis. A quorum, or the majority of appointed members, is required for the Commission to meet. The City Council could remove an appointed Commission member who fails to attend at least nine (9) regularly scheduled Commission meetings per year. All Commission meetings are recorded and televised on local cable television. Primary Duties of the Commission: 1. Operation of City Parks and Pla rounds: Under the direction of the City Council, advise City staff to operate a program of public recreation and playgrounds upon City -owned property or other property made available to the City for such public recreation purpose. 2. Lease and Ac uisition of Property: Recommend to the City Council the leasing or acquisition of land or personal property for public recreational use as the Commission deems desirable. 3. Maintenance and Care of Publlc Recreation Prooei�y: Maintain and care for all property that the Commission has acquired and which has been assigned to the Commission for public recreation purposes. 4. Inventories of Services: Make periodic inventories of recreation and park services that exist or may be needed, and interpret the needs of the public to the City Council. 5. Cooperation with Other Agencies: Cooperate with other park and recreation departments, schools, and private agencies for establishment of a joint powers agreement to provide parks and recreation services to the City residents. 6. Policies and Functions of Department: Interpret the policies and functions of the Park and Recreation Department to the public. Overview: The Park and Recreation Commission is a volunteer board of Council -appointed Mounds View residents charged with advising the City Council on the operation of public recreation, parks, forestry and playgrounds, pursuant to the authority of Chapter 405 of the Mounds View Municipal Code. In this capacity, the Commission has the responsibility to recommend to the City Council, programs of public recreation, use of playgrounds, cooperative agreements with other agencies develop policies for consideration and recommend proposed budgets. The commission may also recommend capital improvements, and advise the Council in establishing fees for the public facilities and programs. The Commission receives citizen input, solicits all available information on an issue and recommends appropriate action to the City Council for final action. Primary Responsibilities: Advise City staff to operate a program of public recreation and playgrounds upon property which is owned or otherwise made available to the Municipality for such public recreation purpose. Recommend to the Council the leasing or acquisition of real or personal property for public recreational use as it deems desirable. 3. Maintain and care for all property which it has acquired or which has been assigned to it for public recreation purposes. 4. Take periodic inventories of recreation and park services which exist or may be needed and interpret the needs of the public to the Council. 5. Cooperate with other park and recreation departments, schools and private agencies for establishment of a joint powers agreement to provide parks and recreation services to the City residents. 6. Advise the Council and City Administrator in the preparation of the annual budget and long-range capital improvement programs. 7. Formulate and prescribe reasonable rules and regulations for the use of the general public of any facilities in any park area. 9. Advise the Council on constructing roadways, paths, buildings, fountains, docks, boat houses, bath houses, refreshment booths, amusement halls, pavilions and other necessary structures and improvements in parks. 0. Communicate regularly with the City Council and Planning and Zoning Commission through joint meetings and meeting minutes. 405.01 SECTION: 405.01: 405.02: 405.03: 405.04: 405.05: 405.06: 405.07: 405.08: 405.09: 405.02 (Rev. 02/13) CHAPTER 405 PARKS AND RECREATION AND FORESTRY CONBUSSION' (Ord. 714, 5/12/03) Commission Established; Purpose Membership; Oath; Compensation Terms and Vacancies Conflicts of Interest Removal from Office Organization and Meetings Powers and Duties Budget and Finances Rules and Regulations 405.01: COMMISSION ESTABLISHED; PURPOSE: There is hereby established a Parks and Recreation and Forestry Commission for the purpose of advising the Council on the operation of public recreation, parks, and playgrounds, pursuant to the authority of this Chapter. The Parks and Recreation and Forestry Commission is referred to herein as "the Commission". (1988 Code §34.01; Ord. 714, 5-12-03) 405.02: MEMBERSHIP; OATH; COMPENSATION: Subd. 1. Appointment of Members: The Commission shall consist of nine (9) members appointed by the City Council and based on the recommendation of the Parks and Recreation Commission, from the applications submitted. Based upon the recommendation of the Parks and Recreation Commission, the City Council shall appoint a chairperson. (1988 Code §34.02; Ord. 627, 2-8-99; Ord. 707, 10-28-02; Ord. 714, 5-12-03; Ord. 741, 6-28-04; Ord. 877, 02-07-13) Subd. 2. Oath of Office: Every appointed member shall, before entering upon the discharge of their duties, take an oath that they will faithfully discharge the duties of their office. (1988 Code §34.03) Subd. 3. Compensation: Members of the Commission shall serve without compensation. (1988 Code §34.04) 1 See Chapter 905 of this Code for parks, playgrounds and recreation. City of Mounds View 405.06 405.07 (Rev. 5/03) 405.06: ORGANIZATION AND MEETINGS: Subd. 1. Officers: The Commission shall select a Vice Chairman and Secretary. The Vice Chairman shall be selected from its membership and shall serve for a term of one (1) year. The Secretary may be selected from the Commission or City staff. (Amended, Ord. 714, 5-12-03) Subd. 2. Attorney and Engineer: The Municipal Attorney shall act as attorney for the Commission and the Director of Public Works/City Engineer shall act as its engineer. Subd. 3. Rules of Procedure: At its first meeting, the Commission shall adopt rules of procedure and elect the two (2) officers. It shall amend the rules, from time to time, as is necessary. (1988 Code §34.06) Subd. 4. Meetings: The Commission shall establish regular meeting dates, but special meetings may be called by any officer of the Commission upon seven (7) days' notice to all members. The Commission shall hold at least twelve (12) regular meetings each calendar year. (Amended, Ord. 714, 5-12-03) Subd. 5. Quorum: A majority of the appointed members shall constitute a quorum. (1988 Code §34.07) 405.07: POWERS AND DUTIES: In order to carry on the recreation provided herein, the duties of the Commission shall include: (Amended, Ord. 714, 5-12-03) Subd. 1. Operation of City Parks and Playgrounds: Under the direction of the City Council, advise City staff to operate a program of public recreation and playgrounds upon property which is owned or otherwise made available to the Municipality for such public recreation purpose. Subd. 2. Lease and Acquisition of Property: a. Recommend to the Council the leasing or acquisition of real or personal property for public recreational use as it deems desirable but shall not have the authority to acquire land or construct buildings in its own name. Any equipment or recreational facilities shall belong to the Municipality. b. Advise the Council of leasing real or personal property or both for public recreation use for periods of not longer than one (1) year. City of Mounds View 405.09 (Rev. 5/03) 405.08: BUDGET AND FINANCES: Subd. 1. Annual Presentation of Proposed Budget: The Commission, through the City Parks and Recreation Division staff, should present, no later than August 1 of each year, a proposed budget, in such details as the Council shall require, of the financial needs for the ensuing fiscal year to operate and maintain the parks and open spaces, as well as provide recreation programs. (Amended, Ord. 714, 5-12-03) Subd. 2. Fees and Charges: The Commission shall advise the Council to establish charges or fees for the restricted use of any facilities or to make any phase of the recreation program wholly or partially self-sustaining. (1988 Code §34.08) 405.09: RULES AND REGULATIONS: The Council may establish such rules and regulations for the administration of this Chapter as it may deem necessary and may delegate such rule -making authority to the Commission, and the Commission shall have power to make such rules and regulations pursuant to delegated authority as it deems necessary for the purpose of performing its duties as herein set forth. (1988 Code §34.10) City of Mounds View 1127.01 CHAPTER 1127 (Added, Ord. 785, 12-10-07) TREE PRESERVATION & LANDSCAPING SECTION: 1127.01: Purpose 1127.02: Definitions 1127.03: General Tree Protection Requirements 1127.04: Tree Removal on Lots With Construction or Grading Permits 1127.05: Landscaping 1127.06: Plan Review Process 1127.07: Appeal Process 1127.08: Violation and Penalties 1127.01 (Rev. 12/07) 1127.01: PURPOSE: The purpose of this chapter is to identify trees and woodlots which are to be preserved in general and saved when development is occurring or at any point thereafter. It is the City's goal to ensure that development is compatible with the natural environment and is accommodated without destroying desirable environmental features and natural amenities. It is not the City's intent, however, to preserve significant trees or woodlots where substandard subdivision design, poor drainage, excess slope in streets and driveways or inefficient utility construction would result. City of Mounds View 1127.03 1127.04 1127.03: GENERAL TREE PROTECTION REQUIREMENTS. Developers, landowners, and builders shall attempt to preserve the maximum number of significant and specimen trees on lots as possible by using creative design techniques for the location of structures and other improvements within property boundaries. Subd. 1. Preservation Standards. a. Structures and other amenities shall be located in such a manner that the optimum number of trees shall be preserved. b. Prior to the granting of a permit, the person requesting the permit shall demonstrate that there are no feasible or prudent alternatives to the removal of significant or specimen trees on the site. C. Forestation, reforestation or landscaping shall utilize a variety of tree species and shall not utilize any species presently under disease epidemic. d. Development including grading and contouring shall take place in such a manner that the root zone, as defined in Section 1127.02, of existing trees shall not be affected. 1127.04: TREE REMOVAL ON LOTS WITH CONSTRUCTION OR GRADING ACTIVITy5l Subd. 1. Tree Plan Required. A tree plan, which would include a tree inventory, prepared by an arborist, landscape architect or forester, shall be submitted for any project in which any trees will be impacted as a result of said project. Tree inventories shall identify existing healthy significant trees, specimen trees, woodlots and smaller groups of non -significant trees within the limits of the proposed project area. The inventory should clearly indicate which trees would be lost as a result of the project and which trees would be saved. The tree inventory shall be submitted at the same time as any other required application submittals. This requirement may be waived at the discretion of the Community Development Director and the City Forester. 58 Parcels in the R-1, Single Family Residential zoning district are exempt from the provisions of this Section. City of Mounds View 1127.05 1127.05. LANDSCAPING: 1127.05 Subd. 1. Applications for development in the R-3, R-4, B-1, B-2, B-3, B-4, I-1 and PUD districts shall be accompanied by a detailed landscape plan. The landscape plan should be developed in accordance with the site plan submitted for approval. Subd. 2. Detailed landscape plans shall include the following information; a. General: name and address of developer/owner, name and address of architect/designer, date of plan preparation, date and description of all revisions, name of project or development, scale of plan, north point indication. b. Site analysis: Boundary lines of property line with dimensions based upon certified survey, name and alignment of proposed and existing adjacent on -site streets, location of all proposed buildings, topographic contours at two (2) foot contour intervals, location of parking areas, water bodies, proposed sidewalks, and percentage of site not covered by structures and impervious surfaces. C. Landscape data: A planting schedule table shall include symbols, quantities, common names, botanical names, size of plant materials, root specifications, and special planting instructions. d. Typical sections and details of fences, retaining walls, berms and other landscape improvements. e. Typical sections of landscape islands and planter beds with identification of materials used. f. Details of planting beds and foundation plantings. g. Delineation of both sodded and seeded areas indicated in square footage. h. Where landscape or inorganic materials are used to provide required screening from adjacent and neighboring properties, a cross section shall be provided at a legible scale illustrating the prospective of the site from the neighboring property and property line elevation. City of Mounds View 1127.05 1127.07 Subd. 5. Method of Installation: All deciduous and coniferous trees shall be ball and burlap and stakes and guyed per National Nurserymen's Standards. All shrubs shall be potted. Subd. 6. Use of Landscaping for Screening: a. Where natural materials, such as trees or hedges are approved in lieu of the required screening by means of walls or fences, density and species of planting shall be such to achieve screening year round. Subd. 7. Maintenance: a. Property owners shall be responsible for the upkeep of all required plantings and landscape materials. Upon written notice from the City, a property owner shall be required to trim broken or damaged tree boughs, remove fallen trees or storm damaged trees and remove diseased trees as identified by the City Forester.59 Uprooted, damaged or diseased tree stumps shall be removed or ground down below grade. b. It shall be the property owner's responsibility to maintain the boulevard areas between the property and any adjacent street frontage. 1127.06: PLAN REVIEW PROCESS: All tree inventories, preservation plans and landscape plans shall be reviewed by the City Forester. The Parks and Recreation and Forestry Commission may also review such plans at the request of the Community Development Director or the City Forester. When such plans are required as part of a development application (e.g. development review, conditional use permit, minor or major subdivision) the Planning Commission and City Council shall have approval authority. For such plans submitted when no official planning action is necessary, the Community Development Director and City Forester shall retain administrative approval authority. 1127.07: APPEAL PROCESS: Administrative decisions by the City Forester and/or Community Development Director may be appealed to the City Council. An appeal shall be filed in writing no more than fourteen (14) days following the date of the administrative decision by the City. The appeal shall be scheduled for consideration by City Council at the next regularly scheduled City Council meeting which is at least seven (7) days from the date of the appeal. 59 Refer to Chapter 605, Tree Disease Control. Authority: The City Administrator and those agents appointed by the City Administrator (herein referred to as "tree inspector") are hereby empowered to conduct a program of shade tree disease and pest control pursuant to authority granted by Minnesota Statutes, § § 18G, 89.001, 89.01 and 89.51-.64, including the elimination of Dutch elm disease fungus, elm bark beetles, oak wilt fungus, emerald ash borer, and other potentially non-native invasive pests and epidemic diseases oftrees. (1988 Code §92.01) (Amended, Ord. 844, 5- 20-10, Ord. 871, 5-3-12) Subd. 2. Interference Prohibited: It shall be unlawful for any person to interfere, prevent or delay the authorized parties from discharging their duties pursuant to this Chapter. (1988 Code §92.11) 605.03 605.03 (Rev. 5/18) 605.03 : NUISANCES DECLARED; ABATEMENT: Subd. 1. Nuisances Declared: The following are hereby declared public nuisances whenever they may be found within the City: a Any living or standing elm tree, or part thereof, infected to any degree with the Dutch elan disease fungus Ceratoc7.slis u1mi (buisman) rrmoreau or which harbors any of the elm bark beetles Scolytus multisii•iatus (eichh.) or Hyluigo pinus niflpes (marsh). b. Any dead or dying elm tree, or part thereof; including logs, branches, stumps, firewood or other elm. material from which the bark has not been removed and burned or buried. C. Any living or standing red oak tree, or part thereof, infected to any degree with the oak wilt fungus Ceralocmis fagacea rum. d Any diseased wood from the red oak group which, by April 1 in any given year, has not been either debarked, burned, buried or split into quarter sections and completely enclosed with a covering (at least 4-mil, if plastic) adequately thick and whole so as to isolate the wood until July 15 or later, of the year immediately following the wilting of the tree from which said wood originated. Any living or standing ash tree, or part thereof, infested to any degree with the emerald ash borer A&7•ilus plaWpennis by presence of: 1) larval galleries and emerald ash borer larva or larvae; or 2) emerald ash borer adult beetles and "D"-shaped exit holes. (Added, Ord. 871, 5-3-12) Woodpecker holes and/or woodpecker activity. (Added, Ord 871, 5-14-18) f Any dead or dying ash tree, or part thereof, including logs, branches, stumps, firewood, or other ash material, to which the bark is still attached that may serve as a breeding place for emerald ash borer. (Added, Ord. 871, 5-3-12) g. Other trees with non-native invasive pests, epidemic disease, or other factors which are potentially contributory to the spread of such pests and disease. (Amended, Ord. 871, 5-3-12) Subd. 2. Nuisance Declared Unlawful: It is unlawful for any person to permit public nuisances, as herein defined, to remain on any premises owned or controlled by that person within the City. (1988 Code §92.03) City of Mounds View 605.04 Subd. 3. Responsibility for Costs: 605.05 (Rev. 5/18) a Trees which are diseased pursuant to this Chapter located on City boulevards in public rights -of -way will be removed at a cost of fifty percent (50%) to the owner of the abutting property with the City assuming the remaining costs. (Amended, Ord. 871,5-3-12) b. All other materials pursuant to this Chapter are the responsibility of the owner of the abutting property. (1988 Code §92.10) Subd. 4. Special Assessment: If the owner shall fail to pay the bill, as provided for in subdivisions 1 and 2b hereof, within ninety (90) days, the Council may then assess the amount due, plus interest, plus costs against the property as a special assessment pursuant to Minnesota Statutes'. (1988 Code § 92.06) 605.05 : DISRUPTION OF ROOT GRAFTS: Whenever a tree is found, which is actually or potentially diseased with any disease covered in this Chapter, the tree inspector may take whatever steps are necessary as recommended by the Commissioner of Agriculture to disrupt all potential root grafts. This disruption shall be performed as soon as possible. The property owner or the person in possession, if different from the owner, on which the trees stand and adjacent property owners or the persons in possession, if different from the owner, if the disruption procedure extends onto that property, shall be notified by personal service or first class mail that said disruption will be done. City of Mounds View 605.06 605.07 (Rev. 5i18) by private tree contractors shall be performed under the direction of an arborist certified by the International Society of Arboriculture (ISA) or forester certified by the Society of American Foresters (SAF) and employed by the contractor. The contractor shall also be registered with the Commissioner's Office and the Minnesota State Tree Care registration number shall be provided to the City. Licensing of tree contractors shall be required for any .routine or non -routine tree services performed on public or private property, including but not limited to tree trimming, tree removal, tree treatment by injection or trench methods, and stump grinding. (1988 Code §92.12) any of the provisions of nded, Ord. 871, 5-3-12) City of Mounds View 606.02 606.03 (Rev. 4/97) 606.02: DESTRUCTION OF WEEDS BY OWNER: All such grass and weeds shall be cut, pulled or destroyed whenever they shall exceed a height of eight inches (8"). The following areas and types of vegetation are exempted from this provision if managed in a manner so as not to become infested with noxious weeds or to create a stagnant, foul smelling condition: (1993 Code) (Ord. 594, 4-14-97) Subd. 1. Native wetland vegetation found in wetlands designated as part of the City's wetland zoning district, or in floodplains, drainage ponds or ditches which store and convey stormwater. (Ord. 594, 4-14-97) Subd. 2. Native vegetation found in natural areas which are part of public open space, parks and nature centers.. (Ord. 594, 4-14-97) Subd. 3. Areas on any occupied lot or parcel of land having wetland -type vegetation because of neighborhood drainage patterns, where the drainage pattem'is evident on contour maps and from field observation, and the vegetation is confined to a single lot, separated from adjacent lots, and managed so as not to be a nuisance. (Ord. 594, 4-14-97) Subd. 4. An area where the land and vegetation appear not to have been graded, landscaped, mowed or otherwise disturbed by human or mechanical means at any time. The Director of Community Development shall use reasonable judgement in determining what constitutes this type of area based on the present appearance of the area and research as to the history of the area if such information is available. (Ord. 594, 4-14-97) Subd. 5. An area of at least five (5) acres used by an educational institution or public agency for prairie land restoration, if the prior vegetation is eliminated and the prairie vegetation is planted through transplanting or seed. The area shall be cut at least once per year to a height of no more than eight (8) inches if weeds cover more than 25 percent (251/o) of the area. If such mowing is necessary and the area is likely to be seen by the public, a sign shall be posted advising that a meadow or prairie is being established. The size of the sign shall be one (1) square foot and it shall be no higher than three feet (3'). (Ord. 594, 4-14-97) 606.03: DESTRUCTION BY CITY AUTHORITY: When the owner or person in control of any plot of ground fails to destroy grasses or weeds growing thereon as provided herein, the Superintendent of Public Works of the City shall destroy or cause to be cut such grasses or weeds and any expense incurred by the City under the authority of the Superintendent of Public Works in so doing shall be a charge against the owner or other person so failing, which may be recovered on behalf of the City by recording a lien against the property for the cost of said cutting or by instituting an appropriate action at law. Said cost shall be an amount as determined by the City.
