MEETING IS CALLED TO ORDER Mayor Mueller stated due to the COVID-19 pandemic this meeting would be held virtually. 2. PLEDGE OF ALLEGIANCE 3. ROLL CALL: Bergeron, Cermak, Hull, Meehlhause, Mueller NOT PRESENT: None. 4. APPROVAL OF AGENDA A. Monday, March 22, 2021, City Council Agenda. MOTION/SECOND: Meehlhause/Hull. To Approve the Monday, March 22, 2021, agenda as presented. A roll call vote was taken. Ayes — 5 Nays — 0 Motion carried. 5. CONSENT AGENDA A. Approval of Minutes: March 8, 2021. B. Just and Correct Claims. C. Resolution 9409, Adopting a Special Assessment Levy for a Private Sewer Improvement for 8041 Long Lake Road. MOTION/SECOND: Bergeron/Meehlhause. Mounds View City Council March 22, 2024 Regular Meeting Page 2 1 None. 2 3 7. SPECIAL ORDER OF BUSINESS 4 A. Dana Healy — NineNorth Executive Director 5 6 Dana Healy, Executive Director of NineNorth, thanked the Council for their time. She provided 7 the Council with a presentation on the purpose, milestones, and core services provided by 8 NineNorth, while also addressing how NineNorth was measuring up and adding value to the City 9 of Mounds View. It was noted NineNorth produced community focused digital media to educate 10 and engage the public. She reviewed photographs of the newly redesigned space noting overhead 11 expenditures have been cut by 33%. She encouraged the City Council to review the NineNorth 12 annual report which had been mailed to the City or was available online. The services provided 13 to the City of Mounds View in 2020 was described at length. She described how NineNorth 14 assisted the City pivot from in person meetings to Zoom meetings after the pandemic occurred. 15 She reviewed the City Council Chamber audit that was completed in 2020 noting her only 16 recommendation would be to add an audio recording capability. She commented further on how 17 NineNorth was adding value to the community through Chamber Check In's, candidate 18 interviews, a Mayoral address and other media services. 19 20 Council Member Bergeron stated he served as the City's liaison to the Cable Commission. He 21 thanked NineNorth and Ms. Healy for their tremendous services to the community. 22 23 Council Member Meehlhause thanked Ms. Healy for her strong leadership and for making this 24 organization viable to the community. 25 26 Mayor Mueller thanked Ms. Healy coming before the Council with this detailed presentation. 27 28 8. COUNCIL BUSINESS 29 A. First Reading and Introduction, Ordinance 975, Amending the Municipal 30 Code, Chapter 1100 relating to Home Occupations. 31 32 Community Development Director Sevald requested the Council introduce an Ordinance that 33 would amend Municipal Code Chapter 1100 relating to Home Occupations. He explained a 34 resident contacted staff and was wanting to build a garage for a commercial greenhouse to grow 35 mushrooms. He indicated commercial greenhouses are prohibited in the R-1 zoning district. He 36 stated this led to a conversation with the Planning Commission and if home occupations in 37 greenhouses should be allowed in the R-1 zoning district. He discussed the proposed language 38 within the Ordinance noting the general intent was for there to be no sign of the business in the 39 greenhouse, shed or garage. He commented there were 140 businesses in Mounds View and a 40 large number of these were from the home. He stated the Planning Commission discussed this 41 matter and recommended approval of the Ordinance. 42 43 Council Member Meehlhause asked how a beauty shop operating out of the home worked in the 44 City. Community Development Director Sevald stated this was a permitted use. She noted she supported the Ordinance moving forward with the First Reading. MOTION/SECOND: Hull/Bergeron. To Waive the First Reading and Introduce Ordinance 975, Amending the Municipal Code, Chapter 1100 relating to Home Occupations. A roll call vote was taken. Ayes — 5 Nays — 0 Motion carried. B. Resolution 9410, Accepting Bids Received by the City of Coon Rapids, Joint Powers Agreement for 2021 Seal Coating. Public Works/Parks and Recreation Director Peterson requested the Council accept bids received by the City of Coon Rapids for the Joint Powers Agreement for the 2021 seal coating. He explained this JPA would assist Mounds View with completing seal coating noting the low bid was provided by Pearson Brothers. Staff recommended the Council approve the JPA. Council Member Meehlhause asked if crack sealing, striping and fog sealing was part of this JPA. Public Works/Parks and Recreation Director Peterson reported this was the case. MOTION/SECOND: Meehlhause/Bergeron. To Waive the Reading and Adopt Resolution 9410, Accepting Bids Received by the City of Coon Rapids, Joint Powers Agreement for 2021 Seal Coating. A roll call vote was taken. Ayes — 5 Nays — 0 Motion carried. 9. REPORTS A. Reports of Mayor and Council. Council Member Meehlhause stated he would be attending an NYFS board meeting on Thursday, March 25, 2021. Council Member Meehlhause reported the Twin Cities Gateway Board of Directors met last week where the 2020 yearend financial report was discussed. He shared the information presented at this meeting with the Council. Mayor Mueller explained prior to the EDA meeting this evening, the EDA met in a Closed Session to discuss real property known as the Skyline Redevelopment property, to determine an asking price, to consider offers and to review confidential appraisal information. Mounds View City Council March 22, 2024 Regular Meeting Page 4 1 Mayor Mueller reported jury selection was almost complete and the Chauvin trial would begin on 2 Monday, March 29, 2021. She noted the City's security team was in place and she assured the 3 residents that the City's first responders were committed to keeping the community safe. 4 5 Mayor Mueller commented on Thursday, April 8, 2021 she would be attending a Minnesota 6 Mayors Executive Board meeting, along with a League of Minnesota Cities loss and safety 7 workshop. 8 9 B. Reports of Staff. 10 1 1 Public Works/Parks and Recreation Director Peterson explained he would need to expedite the 12 replacement of a tractor. He noted this tractor was slated for replacement in 2028. He discussed 13 the amount of money the City was spending to keep this unit operational noting the fuel pump 14 recently went out. He stated staff would like to put the existing tractor out for auction and have it 15 replaced sooner rather than later. 16 17 Council Member Cermak stated she was a proponent of buying a new tractor and auctioning off 18 the broken tractor. 19 20 Council Member Bergeron commented he supported staff s request to purchase a new tractor. 21 22 Council Member Hull and Council Member Meehlhause agreed. 23 24 Finance Director Beer reported the 2020 audit was complete and noted MMKR would be making 25 a presentation to the Council on April 12, 2021. 26 27 1.) Set Date of Council Work Session on Diversity/Inclusion/Engagement 28 29 City Administrator Zikmund requested the Council set a date for a worksession meeting to 30 address diversity/inclusion and engagement. 31 32 Mayor Mueller suggested meeting on Monday, March 29, 2021. 33 34 Council Member Bergeron stated he would rather wait to hold this meeting in April. 35 36 The Council agreed to hold this special worksession meeting on Wednesday, April 28, 2021 at 37 6:30 p.m. 38 39 City Administrator Zikmund discussed the items that would be addressed by the Council at the 40 April worksession meeting. 41 42 C. Reports of City Attorney. 43 44 City Attorney Riggs had nothing additional to report. This Ordinance became effective on October 25, 2015. Applicant Anne Donadio, 7090 Knollwood Drive, has submitted an application to keep and raise honeybees on her property. Discussion: Ms. Donadio will have three hives on her property; the maximum allowed by Code is four hives. Ms. Donadio has informed Staff that she has been a beekeeper for many years. She learned from her father who kept bees while she was growing up. She has also indicated that her sister keeps bees as well. Ms. Donadio is just finishing a honeybee -keeping class through the University of Minnesota. She will provide a Certificate of attendance to the City when she receives it. A site plan has been provided showing that the hives will be located in the rear yard and that they have adequate setbacks from all property lines. In accordance with Ordinance 908, applications are considered by the City Council after holding a public hearing. Licenses are valid indefinitely as long as the hives operate continuously. Licenses can be revoked or denied by the City Council based on negligence or nuisance. In such event, the property owner would be provided with an opportunity to be heard by the City Council. Staff published a public hearing notice in the City's official newspaper, the Shoreview Press, on March 16, 2021. Public hearing notices were also mailed to residents within 350 feet of 7090 Knollwood Drive. The applicant received a satisfactory report from the Mounds View Police Department with no property complaints within the past 12 months. Ms. Donadio has indicated she will be present at the Zoom City Council Meeting/public hearing. The use is consistent with the purposes of the Zoning Code and the purposes of the zoning district in which the applicant intends to locate the proposed use. In attendance was Kurtis Barbeau, 8375 Sunnyside Road, who wishes to construct an accessory building to grow vegetables commercially. The Zoning Code specifically prohibits commercial greenhouses in the R-1 district. Discussion: Home Occupations is the use of a home for a business. The intent is that the property is primarily used as a residence, and its use by the business is secondary. A person standing in front of the house should not be able to tell that there is a business there. The current Ordinance is not clear regarding the use of Accessory Buildings (e.g. garage) as a Home Occupation. The proposed amendment provides clarity, in addition to fixing a couple of other items; 1. Deletes the prohibition of non-commercial greenhouses in Residential districts. 2. Allows up to two roomers or boarders in Residential districts, to be consistent with Chapter 1012 of the City Code (e.g. Rental License regulations).' Staff informally inquired with neighboring city planners as to their regulations of Home Occupations; Arden Hills: Prohibited in Accessory Buildings. CUP if within home. Little Canada: Prohibited in Accessory Buildings. Shoreview: Prohibited in Accessory Buildings. Vadnais Heights: Permitted in Accessory Buildings, 7:00 AM — 7:00 PM. By limiting Home Occupations to the home (primary building), the intent is that it would limit the type of business activity inside the home, whereas if conducted in the garage (accessory building), there is a higher probability for nuisance factors. For example, it is less likely that a resident would perform engine repair on the dining room table, but more probable that if allowed in the garage, then the primary use of the garage could be auto repair. With more space available, there is more potential to create a nuisance. By clearly allowing Home Occupations to be conducted in accessory buildings, it provides clarity to Staff when conducting enforcement. In practice, entrepreneurs are going to use whatever space is available to them, whether or not it is compliant with the City Code. It is Staff's practice Mounds View Municipal Code, Section 1012.02, Subd 4 (Definitions); Dwelling Unit: Residential accommodation in any building or portion thereof including complete kitchen facilities, permanently installed, that contains living facilities, provisions for sleeping, eating, cooking, and sanitation, for not more than one (1) family and not more than an aggregate of two (2) roomers or boarders. On occasion, the City does receive complaints from neighbors of Home Occupations, mostly related to noise and parking. Often, the complaints are not a violation of City Codes, specific to the Home Occupation, and originate from other disputes. The City Council of the City of Mounds View hereby amends Title 1100, Chapter 1106, Section 1106.03: ACCESSORY USES of the Mounds View Municipal Code by adding the underlined material and deleting the stfieke material as follows: Subd.3. Home Occupations: The regulation of home occupations within residential structures and accessory buildings is intended to ensure that the occupational use is clearly accessory or secondary to the principal dwelling use and that compatibility with surrounding residential uses is maintained. No home occupation shall be allowed which: (Ord. 664, 8-14-00) a. Involves employees other than persons residing on the premises; b. Involves alteration or construction features not customarily found in dwellings or accessory buildings; c. Has an exterior display or sign in excess of one (1) square foot. Such sign, for identification purposes only, shall be located on either the principal structure or garage. Any sign existing prior to December 29, 1972, shall not be enlarged but may be continued at the size and location upon such date, except as hereinafter specified or subsequently amended. (d) No day care center or group nursery shall be permitted where the distance from the property line for the day care center or group nursery to a premise requiring a liquor license, as provided in Section 502 of the Municipal Code, or a license for an adult establishment, as provided in Section 513 of the Municipal Code, is five hundred feet (500') or less, except that the five hundred (500) foot requirement shall not apply to any liquor establishment receiving at least sixty percent (60%) of its annual gross sales revenue from the sale of food. If the religious institution ceases operation, all urns and remains must be removed from the property within three (3) months. SECTION 2. MMKR has provided at staff's request an extension of audit services for the years' ending December 31, 2021, 2022, 2023, 2024, and 2025 for Council consideration. The City has received more than satisfactory service from MMKR and the proposed fees reflect no increase for 2021 and subsequent 2% increases for 2022, 2023, 2024, and 2025. The fee for the 2020 audit was $35,440. The proposed fee for 2021 is $35,440 plus expenses, 2022 - $36,145 + expenses, 2023 - $36,870 + expenses, 2024 - $37,605 + expenses, and 2025 — $38,360 + expenses. Background/Discussion: The City Council approved the Water Treatment Rehabilitation Project, Res. 9091, at the March 25, 2019 City Council Meeting. The Council awarded the contract for Phase I of the Water Treatment Project, Res. 9174, at the December 9, 2019 meeting. During the initial water study and testing at Water Treatment Plant No. 1 the Minnesota Department of Health (MDH) brought to the attention of AE2S and Staff, that WTP No. 1 had combined radium results above the regulated maximum contaminant level (MCL). Due to this discovery, Water Treatment Plant No. 1 was removed from the scope of bidding with WTP2, WTP3 and the Booster Station. The City Council approved a pilot study at WTP1 be completed at the October 9, 2019 City Council meeting, Res. 9174. After the pilot study was completed, AE2S presented the results of this pilot study at the November 2, 2020 Work Session. At this meeting Staff recommended that AE2S continue with the plans and specifications for Water Treatment Plant 1 Rehabilitation Project (Phase II). The anticipated start date is later this month with substantial completion of March 31, 2022 and final completion in May 31, 2022. The following steps have been completed for this project: • January 4th, 2021 Work Session, the City Council reviewed the 95% completed plans and directed Staff to have AE2S complete the plans and specs and prepare the necessary documents for bidding. • February 22nd, 2021 Council Meeting authorizes bidding of Phase II of the Water Treatment Rehabilitation Project. February 23, 2021 - Published bid and advertisement to receive bids March 31, 2021 Public Works Staff along with AE2S conducted a virtual bid opening at 2:00 PM The project bid form consists of the Base Bid for Water Treatment Plant 1, Bid Alternate 1 for Well house 1 and 2 ventilation improvements and Bid Alternate 2 for the Pressure Vessel Hatch Replacement. Bids were received from three (3) qualified contractors. The Public Bid opening occurred on Wednesday March 31, 2021 at 2:00 pm. Spring Lake Road North of Mounds Blvd is approximately 3,505 feet in length. The Pleasant View Dr. street segment has 4 inch bituminous integral curb with a with a bituminous pavement surface measuring 30-feet wide average back - to - back of curb. Pleasant View Dr. was originally constructed in 1974 and serves residential properties. Spring Lake Road South of Mounds View Blvd. is approximately 4,050 feet in length. Spring Lake Road is a rural section of road with no concrete curb or gutter and has a bituminous pavement surface measuring 24-feet wide average. Spring Lake Road was originally constructed in 1967 and serves residential properties and is a minor arterial road. Maintenance has included seal coating, pothole patching and skim coating as needed. The current pavement is in poor condition with significant surface patching, potholes, and moderate to high severity traverse cracking and pavement heaving. Staff has received a proposal for Engineering Services for the 2022-2023 Pavement Rehabilitation project, these services are broken down into four main phases 1) Preliminary Design, 2) Community Engagement, 3) Preliminary and Final Design at a cost of $416,900.00. The Mounds View Vision A Thriving Desirable Community Staff also sent out and RFP for soil borings and pavement analysis of the streets sections being proposed for re -construction. Staff received two proposal as follows: 1) Braun Intertec — Proposal Cost of $10,140.00 2) American Engineering and Testing, Inc. (AET) — Proposal Cost of $12,064.00 Residents will once again have the option of the Private Improvement Program, this is the same program that has been offered to residents in all of the street projects. The Private Improvements include widening the width of the driveway apron and replacing the sanitary sewer line from the main to the parcel property line. Residents will also have the option to have CIPP (cured -in -place -pipe) installed rather than replacing the sewer line. All driveway apron widenings must be approved by the Community Development Director. Community Development will also require all non -conforming driveways and aprons to be corrected. Stantec's final street design will be based on Braun Intertec Corporations geotechnical and pavement evaluation report. Stantec has provided a construction estimate of $4,250.000.00, this does not include any water main work, gate valves and sanitary sewer main line repairs, cured in place pipe work (CIPP). The Parks Department has in use a 2014 Aebi TT70 Terratrac Tractor unit #316. This unit is used for snow removal operations, mowing of parks, ball field maintenance and rough cutting around storm water ponds, along with other various tasks. Discussion: The past several years more repairs have been needed on this unit and yearly average repair are costing $2,264.00. In the fall of 2020 the fuel pump failed, and will need to be repaired. The cost for these repairs range from $17,000.00 to $30,000.00, depending on the option. With any of the options there would be no guarantee that further engine repairs would be required because the results of a fuel pump failure has the potential of depositing metal shavings in the engine block. Public Works Staff met with the City Administrator and Finance Director and recommended this unit would not be repaired and that the replacement year be moved up from 2028 to the present. Public Works Staff researched and tested other compact utility tractors that could replace unit #316. Staff received a quote from the State Of Minnesota Cooperative Purchasing Venture, CPV, Frontier Ag & Turf of Columbus, MN for a John Deere 5090M Utility Tractor, including a new snow blower, broom and flail mower as follows: John Deere 5090M Utility Tractor $82,042.00 Normand N86-280H Snow Blower $9,810.00 M-B USA 72" Broom $6,825.00 Diamond Rear Swing Flail Mower $16,615.00 Total $115,292.00 Public Works Staff also received a trade in value of $3,000.00. Respectfully submitted, Don Peterson Director of Public Works / Parks and Recreation Attachments: • Resolution 9421 The Mounds View Vision A Thriving Desirable Community RESOLUTION 9421 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA APPROVING THE PURCHASE OF A JOHN DEERE 5090M UTILITY TRACTOR WITH IMPLEMENTS WHEREAS, the City has utility vehicles that are utilized for the Public Works Department to perform necessary maintenance, and; WHEREAS, the City Council understands the need for Public Works to properly operate various tasks such as snow removal operations, mowing of grounds and around storm water ponds; and WHEREAS, the Public Works Staff has been using a 2014 AEBI Tectrac, unit #316 and yearly average repair are costing $2,264.00. In the fall of 2020 the fuel pump failed, and will need to be repaired. The cost for these repairs range from $17,000.00 to $30,000.00; and WHEREAS, Public Works Staff met with the City Administrator and Finance Director and recommended this unit would not be repaired and that the replacement year be moved up from 2028 to the present; and WHEREAS, Public Works Staff has received quote from the State of Minnesota Cooperative Purchasing Venture, Frontier Ag & Turf of Columbus MN., for a John Deere 5090M Utility Tractor, including a new snow blower, broom and flail mower as follows: John Deere 5090M Utility Tractor - $82,042.00 Normand N86-280H Snow Blower - $9,810.00 M-B USA 72" Broom - $6,825.00 Diamond Rear Swing Flail Mower - $16,615.00 Total $115,292.00 WHEREAS, the replacement of this equipment is in the 2021 Budget to be taken from the Vehicle and Equipment fund Park Department 460-4360-7040, with budgeted amount of $100.000.00. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View, Ramsey County, Minnesota as follows: 1. Columbus MN not including sales tax or license fees for the following - John Deere 5090M Utility Tractor - $83,076.60, Mormand N86-280H Snow Blower - $9,510.00 M-B USA 72" Broom- $6,514.20.
