HomeMy WebLinkAboutResolution 9433RESOULUION 9433 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING THE FINAL PLAT OF BELDEN RIVER VIEW (Planning Case MA2021-001) WHEREAS, the applicant, Kelly Wilson, (Belden River Properties, LLC), is requesting Final Plat approval of a Subdivision, located at 3032 County Road I, legally described as: PID: 07-30-23-22-0029 Lots 55 and 56, Spring Lake Park Knolls, Ramsey County, Minnesota WHEREAS, a Subdivision Application and Preliminary Plat were submitted on January 12, 2021, and determined to be complete as of February 5, 2021. Plans were distributed by Staff to applicable departments and agencies for their review. Comments were received from: Jan 13, 2021 Anna Grace, Regulatory Technician, Rice Creek Watershed District Jan 14, 2021 Nick Henly, Building Official, City of Mounds View Jan 14, 2021 Charlie Smith, Fire Chief, SBM Fire Department Jan 20, 2021 James Holman, Engineering Technician, City of Mounds View Jan 21, 2021 Scott Mareck, Transportation Planner, Ramsey County Jan 21, 2021 Tyler McLeete, City Engineer, Stantec Feb 9, 2021 Scott Riggs, City Attorney, Kennedy & Graven Feb 17, 2021 Jim Kosluchar, City Engineer, City of Fridley WHEREAS, Staff reviewed the Preliminary Plat dated February 4, 2021, and Site Development Plans, dated February 4, 2021, finding it to be consistent with requirements of the Mounds View Municipal Code. The Mounds View Planning Commission reviewed the Preliminary Plat at its March 3, 2021 meeting, recommending approval (Resolution 1130-21). The City Council held a duly noticed Public Hearing on March 8, 2021, approving the Preliminary Plat (Resolution 9405); and, WHEREAS, Staff reviewed the Final Plat received March 19, 2021, Title Commitment, dated March 21, 2021, and most current Final Plat received June 4, 2021, finding them to be consistent with the approved Preliminary Plat, City Code, Comprehensive Plan, and Plat Opinion. Comments were received from; Res 9433 Page 2 of 3 Mar 23, 2021 Scott Mareck, Transportation Planner, Ramsey County May 20, 2021 Nick Tomczik, Administrator, Rice Creek Watershed District (CAPROC) May 26, 2021 Nick Valle, Assistant City Attorney, Kennedy & Graven (Plat Opinion) NOW, THEREFORE, BE IT RESOLVED, the Mounds View City Council, hereby Approves the Final Plat of Belden River View, with the following conditions: Approval of this Final Plat is subsequent upon approval for water/sewer supply. The Developer shall obtain sewer/water permits from the City of Fridley (Lots 3, 4, & 5), and comply with requirements stated in Fridley's Public Works Director's letter, dated February 17, 2021. 2. The Developer shall comply with all requirements of the Mounds View City Engineer's letter, dated January 21, 2021. 3. The Developer shall comply with all requirements of the Rice Creek Watershed District. 4. The Developer shall satisfy all requirements made by the City Attorney as stated in the Plat Opinion, or as amended by the City Attorney. 5. Upon Final Plat approval, the Developer shall sign a Development Agreement. 6. Upon Final Plat approval the Developer shall reimburse the City for review fees by the City Attorney, City Engineer, and any consultants. 7. Upon Final Plat approval, the Developer shall pay a Park Dedication Fee of $3,500 per lot, with credit for one lot ($10,500 total). Prior to recording the Plat with Ramsey County, the Developer shall provide an updated and certified Abstract of Title and/or Registered Property Abstract as required by Minn. Stat. § 505.03, or in the alternative, the Developer must provide a Commitment for a Title Insurance Policy for the Property naming the City as the proposed insured and with the amount of coverage for this policy being equal to $100,000.00. 9. The Owner of Lot 1 (3032 County Road I) acknowledges that Mounds View City Code generally requires new and existing buildings to be connected to the municipal water system if a municipal water main is constructed adjacent to such property. The Owner acknowledges and agrees that it shall connect to the City's municipal water system if and when a municipal water main adjacent to the Property becomes accessible to the Property. The Owner further acknowledges and agrees that it shall abide by any and all City's requirements related to connections to the municipal water system. 10. The Developer shall remove or relocate the shed and pergola on Lot 1 and Lot 3, such that any relocation is compliant with zoning setbacks. 11. The Developer shall burry all overhead utilities.
