Meeting Conclusion Item No: 05A Meeting Date: March 17, 2021 Type of Business: Planning Case Planning Case: CU2021-001 City of Mounds View Staff Report To: Planning Commission From: Jon Sevald, Community Development Director Item Title/Subject: Resolution 1131-21, Recommending Approval of a Conditional Use Permit for an Accessory Building exceeding 952 sq ft for Curtis Goettsch, 2229 Lambert Avenue Introduction: The homeowners, Curt & Ann Goettsch, built a home addition in 2020, and now propose to replace the detached 20’ X 24’ garage (480’ sq ft) with a 28’ X 44’ garage (1,232 sq ft). The lot is 75’ X 300’. Analysis: Within the R-1 Single Family Residential District, Accessory Buildings exceeding 952 sq ft in area, require a Conditional Use Permit (CUP).1 Each lot is allowed up to three accessory buildings, totaling 1,800 sq ft. Currently, there are no accessory buildings on the property, other than the garage to be removed. The garage must be designed and maintained to provide a uniform appearance with the house. The width cannot exceed 35’ (28’ is proposed). The garage will be set back 6’ from the side (west) property line, whereas 5’ is the minimum. The western neighbor also has a large accessory building (906 sq ft). Strategic Plan Strategy/Goal: Continue BR&E program, maximize utilization of development space and current list of available sites, encourage land owners to maintain their properties, & consider residential redevelopment. Financial Impact: None. Recommendation: Staff recommends approval. The Planning Commission is requested to consider the following options: 1.Approve Resolution 1131-21, Recommending Approval of the Conditional Use Permit. 2.Recommend Denial of the Resolution, with Findings. 3.Table the Request, if additional information is needed before a Recommendation can be made. Item 05A Page 8 of 10 The Mounds View Vision A Thriving Desirable Community MOUNDS VIEW PLANNING COMMISSION RESOLUTION 1131-21 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT TO ALLOW AN ACCESSORY BUILDING EXCEEDING 952 SQUARE FEET IN AREA, LOCATED AT 2229 LAMBERT AVENUE (PLANNING CASE CU2021-001) WHEREAS, the applicant; Curtis Goettsch, plans to replace an existing garage with a 28’ X 44’ (1,232 sq ft) detached garage on property located at 2229 Lambert Avenue, legally described as: PID: 08-30-23-13-0024 Lot 16 Block 1 of LAMBERT'S ADDITION E 5O FT OF LOT 16 AND EX E 1OO FT LOT 17 BLK 1 WHEREAS, Mounds View City Code, Section 1106.03, Subd 1(c) states that no accessory building in an R-1 District shall exceed 952 sq ft in area, except by Conditional Use Permit; and, WHEREAS, the property is zoned R-1 Single-Family Residential, and guided Single- Family Detached in the Comprehensive Plan (2010). The proposed garage is subject to approval of a Conditional Use Permit; and, WHEREAS, the Mounds View Planning Commission has reviewed the Staff Report, submitted plans, and has compared the request to City Code, Section 1125.01, subd 3 (Criteria for Granting Conditional Use Permits), and in consideration of public testimony, makes the following Findings of Fact (italics): 1. The use will not create an excessive burden on existing parks, schools, streets and other public facilities and utilities which serve or are proposed to serve the area. Findings: The proposed garage will not increase the burden on existing parks, schools, streets or other public facilities. 2. The use will be sufficiently compatible or separated by distance or screening from adjacent residentially zoned or used land so that existing homes will not be depreciated in value and there will be no deterrence to development of vacant land. Item 05A Page 9 of 10 The Mounds View Vision A Thriving Desirable Community Findings: The proposed garage will comply with all zoning requirements, with approval of a Conditional Use Permit. 3. The structure and site shall have an appearance that will not have an adverse effect upon adjacent residential properties. Findings: The proposed detached garage will share the same character as the house. 4. The use, in the opinion of the City Council, is reasonably related to the overall needs of the City and to the existing land use. Findings: The proposed garage is a reasonable request. 5. The use is consistent with the purposes of the Zoning Code and the purposes of the zoning district in which the applicant intends to locate the proposed use. Findings: The proposed garage will comply with all zoning requirements, with approval of a Conditional Use Permit. 6. The use is not in conflict with the Comprehensive Plan of the City. Findings: Oversized garages are not specifically addressed within the Comprehensive Plan (2010). The proposed garage relates to the following: General Land Use Goal 1: Maintain a cohesive land use pattern that ensures compatibility and functional relationships between activities and uses. Residential Goal 3: Encourage a creative approach to the use of land and related residential development. 7. The use will not cause traffic hazards or congestion. Findings: The proposed garage will create no additional traffic. 8. Adequate utilities, access roads, drainage and necessary facilities have been or will be provided. Findings: The proposed garage will not impact utilities, roads, or drainage. WHEARAS, the City Council will hold a Public Hearing on Monday, April 12, 2021. The applicant shall obtain a Building Permit for the garage within one year of the date of approval of this Conditional Use Permit, or this approval shall become void, consistent with City Code, Section 1125.01, Subd 3(f). 2.The garage shall be similar in appearance (exterior material, color, and roof pitch) to that of the house. Adopted this 17th Day of March, 2021 Gary Rundle, Chair ATTEST: (SEAL) Jon Sevald, Community Development Director Item No: 05B Meeting Date: March 17, 2021 Type of Business: Planning Case Planning Case: ______ City of Mounds View Staff Report To: Planning Commission From: Jon Sevald, Community Development Director Item Title/Subject: Resolution 1132-21, Recommending Approval of Ordinance 975, Amending Chapter 1106 of the Mounds View City Code, relating to Permitted Accessory Uses within the R-1 Single-Family Residential district Introduction: During the Planning Commission’s March 3rd meeting, the Commission discussed amending the Zoning Code to clarify the allowance of Home Occupations to operate in Accessory Buildings. In attendance was Kurtis Barbeau, 8375 Sunnyside Road, who wishes to construct an accessory building to grow vegetables commercially. The Zoning Code specifically prohibits commercial greenhouses in the R-1 district. Discussion: Home Occupations is the use of a home for a business. The intent is that the property is primarily used as a residence, and its use by the business is secondary. A person standing in front of the house, should not be able to tell that there is a business there. The current Ordinance is not clear regarding the use of Accessory Buildings (e.g. garage) as a Home Occupation. The proposed amendment provides clarity, in addition to fixing a couple of other items; 1.Deletes the prohibition of non-commercial greenhouses in Residential districts. 2.Allows up to two roomers or boarders in Residential districts, to be consistent with Chapter 1012 of the City Code (e.g. Rental License regulations).1 Staff informally inquired with neighboring city planners as to their regulations of Home Occupations; Arden Hills: Prohibited in Accessory Buildings. CUP if within home. Little Canada: Prohibited in Accessory Buildings. Shoreview: Prohibited in Accessory Buildings. Vadnais Heights: Permitted in Accessory Buildings, 7:00 AM – 7:00 PM. When considering the Ordinance, the Commission should carefully consider every nuisance factor that could be associated with a home business primarily operating from a garage, vs. inside the home. The City has had minimal complaints regarding Home Occupations, most related to parking, and noise. These types of complaints are not unique to Home Occupations, and can just as easily be attributed to residents who are hobbyist (e.g. using the garage to restore a classic car for personal use, vs. auto repair business). Respectfully, Jon Sevald, AICP Community Development Director ATTACHED Resolution 1132-21 MOUNDS VIEW PLANNING COMMISSION RESOLUTION 1132-21 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA A RESOLUTION RECOMMENDING APPROVAL OF ORDINANCE 975, AMENDING TITLE 1100, CHAPTERS 1106 OF THE MOUNDS VIEW CITY CODE RELATING TO “HOME OCCUPATIONS” The City of Mounds View Ordains: SECTION 1. The City Council of the City of Mounds View hereby amends Title 1100, Chapter 1106, Section 1106.03: ACCESSORY USES of the Mounds View Municipal Code by adding the underlined material and deleting the stricken material as follows: Subd. 3. Home Occupations: The regulation of home occupations within residential structures and accessory buildings is intended to ensure that the occupational use is clearly accessory or secondary to the principal dwelling use and that compatibility with surrounding residential uses is maintained. No home occupation shall be allowed which: (Ord. 664, 8-14-00) a.Involves employees other than persons residing on the premises; b.Involves alteration or construction features not customarily found in dwellings or accessory buildings; c.Has an exterior display or sign in excess of one (1) square foot. Such sign, for identification purposes only, shall be located on either the principal structure or garage. Any sign existing prior to December 29, 1972, shall not be enlarged but may be continued at the size and location upon such date, except as hereinafter specified or subsequently amended. Any sign erected after December 29, 1972, but prior to the effective date hereof shall come into compliance herewith by April 1, 1983; (Ord. 672, 1-22-01) d. Involves exterior storage of equipment or materials; Res 1132-21 Page 2 of 4 e.Generates any on-street parking. All vehicles associated with a home occupation shall be parked off-street and in compliance with the City’s parking requirements; (Ord. 672, 1-22-01) f.Results in violation of the provisions of Chapter 607, Nuisances, of the Municipal Code; and (Ord. 664, 8-14-00) City of Mounds View 1106.03 1106.03 (Rev. 4/12) g.Involves activity visible from the public streets. h.Day Care Center, group nursery or adult day care operating as a secondary or accessory use in a public or semi-public recreational building, neighborhood or community center, public and private educational institution limited to elementary, junior high and senior high schools, and religious institutions, such as churches, chapels, temples and synagogues; subject to the following conditions: (Added, Ord. 832, 10-8-09). i.Massage Therapy, subject to the requirements of Chapter 514. (Amended, Ord. 870, 4-19-12) (a) No overnight facilities are provided for the persons served. The individuals shall be transported to and from the facility daily. (b) All signing and informational or visual communication devices shall meet the requirements of the Mounds View Sign Code. (c) The distance between any outdoor play yard for a day care center or group nursery and the Highway 10 right-of-way line shall be a minimum of two hundred feet (200’), except as provided in Section 1123.02, subdivision 1c. (d) No day care center or group nursery shall be permitted where the distance from the property line for the day care center or group nursery to a premise requiring a liquor license, as provided in Section 502 of the Municipal Code, or a license for an adult establishment, as provided in Section 513 of the Municipal Code, is five hundred feet (500’) or less, except that the five hundred (500) foot requirement shall not apply to any liquor establishment receiving at least sixty percent (60%) of its annual gross sales revenue from the sale of food. (e) The operator shall secure all necessary Ramsey County or State of Minnesota licenses and approvals. (Added, Ord. 832, 10-8-09) Subd 4 Noncommercial Greenhouses and Conservatories: Subd. 5. 4. Recreational Facilities: Swimming pools, patios, decks, gazebos, swing sets, play systems and play houses, outdoor living rooms, tennis courts and other recreational Res 1132-21 Page 3 of 4 facilities which are operated for the enjoyment and convenience of the residents of the principal use and their guests. Such facilities shall be set back five feet (5’) or more from a property line, except swimming pools, which shall be set back ten feet (10’) or more from a property line. (Ord. 664, 8-14-00) City of Mounds View 1106.03 1106.03 Subd. 6. 5. Boarding: Boarding or renting of rooms to not more than one (1) person two (2) roomers or boarders. Subd. 7. 6. Other Uses: Other allowed uses incidental to the dwelling unit, including but not limited to: clothes lines and poles; lawn and garden ornaments and other landscaping features; and pet house, facility or kennel. A pet house, facility or kennel shall be set back five feet (5’) or more from a property line. (1988 Code §40.10) (Ord. 664, 8-14-00) Subd. 8. 7. Solar Energy Sources and Systems and Geothermal Energy Sources and Systems as regulated by Chapter 1128 of this Title. Subd. 9. 8. Columbarium as an accessory use to a religious institution; subject to the following conditions: a.The religious institution must own the property on which the columbarium is placed. b.The exterior of the columbaria must be stone, brick, bronze, stainless steel or aluminum. c.The combined square footage of all accessory buildings, including columbaria, shall not exceed 1,800 square feet. d. Columbaria shall only be placed in a side yard or rear yard area. e.Columbaria shall have a minimum side yard and rear yard setback of five (5') feet. f.Columbaria height shall not exceed eighteen (18') feet or that of the principal structure, whichever is less. g.If the religious institution ceases operation, all urns and remains must be removed from the property within three (3) months. SECTION 2. In accordance with Section 3.07 of the City Charter, City staff shall have the following summary printed in the official City newspaper in lieu of the complete ordinance: On April 12, 2021, the City Council adopted Ordinance 975 that amends Chapter 1106 of the Mounds View City Code, relating to Permitted Accessory Uses within the R-1 Single- Family Residential district. Planning Cases A. Resolution 1130-21, Recommending Approval of the Preliminary Plat of Belden River View (Planning Case MA2021-001) Community Development Director Sevald stated Belden River Properties, LLC, requests Preliminary Plat approval for four single-family lots (one existing home), located at 3032 County Road I. This is the southeast intersection of County Road I and Pleasant View Drive. It was noted Preliminary Plats are reviewed by the Planning Commission, and approved by the City Council. Final Plats may be approved by the City Council (Planning Commission does not review, unless there are significant changes from the Preliminary Plat). Currently, the existing house (Lot 1) has Mounds View sewer, and a private well. Lots 2, 3, and 4 will have sewer/water through Fridley. At some point, the City will reconstruct County Road I and Pleasant View Drive. At that time, Lot 1 will need to connect to city water. Staff commented further on the request and recommended the Planning Commission recommend approval of the Preliminary Plat as requested. Commissioner Stevenson asked if a park dedication fee would be paid. Community Development Director Sevald explained this was a condition for approval, noting $3,500 per unit would have to be paid for each of the three new lots. Staff reviewed each of the conditions for approval in full for the record. Commissioner Nelson questioned how the City would maintain the stormwater basin given the fact it would be difficult to access. Community Development Director Sevald reported the City would have sufficient access to the stormwater basin on a 20 foot easement. Commissioner Nelson inquired if Mounds View or Fridley would be responsible for the stormwater basin. Community Development Director Sevald commented Mounds View would be responsible for the basin. Commissioner French requested further information regarding the setbacks. Community Development Director Sevald discussed the minimum setbacks for homes and noted each of the proposed lots exceeded the City’s minimum dimensions. Community Development Director Sevald questioned if the applicant would also be the builders. Kelly Wilson, the applicant, reported she would be working with Capstone Builders on the three new homes. Community Development Director Sevald asked if homes would be built this summer. Ms. Wilson stated this was the plan. MOTION/SECOND: Commissioner Nelson/Commissioner Farmer. To approve Resolution 1130-21, a Resolution Recommending Approval of a Preliminary Plat for Belden River View (Planning Case MA2021-001). Ayes – 6 Nays – 0 Motion carried. 6. Other Planning Activity A. Discussion – Signs Community Development Director Sevald stated at a previous Planning Commission meeting, the Commission asked to discuss sign regulations. Sign regulations are complicated. Mounds View’s sign regulations are outdated, in terms of regulating dynamic (digital) signs, and perhaps other types of signs (e.g. drive-thru menu boards, and temporary signs). Staff reviewed a comparison of cities’ wall and ground sign regulations, specific to zoning districts along streets that are similar to Mounds View Boulevard. He requested feedback from the Commission on the likes and dislikes regarding the signs in Mounds View. Commissioner Nelson stated he wanted to see the City properly prepared for electronic/digital signs. He noted he also wanted the City to have better language in place to address temporary signs. Community Development Director Sevald reported dynamic display signs became a big topic in 2008 when digital billboards became popular. He commented further on the history of digital signs and colored digital signs in Mounds View. He indicated the City has not kept up to date with the changing technology when it comes to signs. Commissioner Farmer commented he would like to see how other communities are dealing with safety concerns with digital signs along highways. Commissioner French indicated he did not love the idea of blinking, flashing signs in residential areas. He explained he has always been unsure about that. Further discussion ensued regarding the use of temporary signs in the City. Community Development Director Sevald explained he would report back to the Commission with a comparison on what is allowed in Mounds View versus other cities B. Discussion – Home Occupations Community Development Director Sevald stated Home Occupations are an accessory use of a home for a non-residential purpose (e.g. working from home). The general intent (how Staff has interpreted this) is that a person standing outside a home, should not be able to tell that a business is operating out of the home. Home Businesses cannot have employees, exterior storage, on-street parking; or anything that is not typically found on a residential property. Mounds View Planning Commission March 3, 2021 Regular Meeting Page 4 ________________________________________________________________________ Complaints about Home Occupations are rare, and have mostly been in regards to parking, and nuisances (noise, fumes, etc.). Staff also receives the same complaints about homes without Home Occupations. Community Development Director Sevald explained recently, a resident has asked to build a commercial greenhouse in their backyard. A noncommercial greenhouse is permitted, but a commercial greenhouse is not. This raises the question; if they look the same, then what is the difference. If a resident can use their garage as an auto repair shop, would it be any more intrusive if the garage were used as a greenhouse (or any other type of business). Staff commented on the number of home occupations operating in the City currently. He requested feedback from the Commission on how to proceed. Kurtis Barbeau, 8375 Sunnyside Road, explained he wants to construct a greenhouse to grow mushrooms and microgreens. He reported he could not do this on the scale he would like within his home, but rather would need a greenhouse. He explained the greenhouse would not be generating any noise. Commissioner Nelson questioned how this request was any different than someone selling Etsy items from their home. He indicated there were residents selling volumes of items from their home but he understood home businesses were a touchy subject. Commissioner Stevenson supported the City limiting the construction to 1,800 square feet of storage. He stated this would meet the garage and the greenhouse could be no larger than 1,800 square feet. Mr. Barbeau explained he understood this was the City’s requirement. Commissioner Munson commented if this greenhouse would not impact the neighbors, she supported the greenhouse being constructed. Commissioner Nelson anticipated the greenhouse would be less disruptive than a chicken coop. He indicated he did not want to see the City impinging on property rights. Commissioner Farmer concurred and commented on the benefit of having more people working from home as this was minimizing the number of trips on the local highways. Community Development Director Sevald stated in general, the Commission supported a greenhouse. He noted Mr. Barbeau would have to apply for a CUP for an oversized garage and noted staff would prepare an Ordinance amendment that would remove the clause that prohibits non-commercial greenhouses, noting the key would be to have the business being subordinate to the use of the property as a residence. 7. Reports A. Upcoming Planning Cases & Activity Mounds View Planning Commission March 3, 2021 Regular Meeting Page 5 ________________________________________________________________________ Community Development Director Sevald reported he had no planning cases that were current. B. Staff Updates Community Development Director Sevald provided the Commission with an update from staff. He reported Tommy’s Car Wash opened on Monday. He noted Grey Stone Flats was offering tours at this time and had 16 leases in place. He discussed the plans for the Skyline property and noted staff has been working with Bio-Clean in order to subdivide a small portion of the Skyline parcel for an addition to Bio-Clean. He explained Blaine was working on a large townhome and apartment building project (250 units total) along County Road J and Airport Road. Staff would forward these plans onto the Commission for further review. C. Council Updates Council Member Meehlhause provided the Planning Commission with an update from the City Council. He noted the Council currently approved the hire of two new police officers. He discussed the changes that were made to the MME request noting the berm would be increased from four feet to 14 feet to assist with screening the business from the adjacent properties. He explained the City Council approved a snow emergency/parking policy. He indicated the Council had directed staff to sell a portion of land from the Skyline property to Bio-Clean for a future building expansion. He commented on the benefit of homeowners completing a home energy audit noting the City recently received an award for the number of participants from Mounds View in this program. He further discussed the City’s HOP Program and stated he recently had his residential sewer line inspected. D. Planning Commissioner Reports None. 8. Approval of Minutes February 3, 2021. MOTION/SECOND: Commissioner Stevenson/Commissioner Munson. To approve the Minutes of the February 3, 2021 regular Planning Commission meetings as slightly amended. A roll call vote was taken.
