Item Title/Subject: Resolution 1133-21, Recommending Approval of Ordinance 976,
Amending the Mounds View Municipal Code, Chapters 1114 and
115, Relating to Drive -In and Convenience Food Establishments
Introduction:
El Loro Restaurant, 2535 Mounds View Boulevard, has been vacant since 2017. The property
is zoned B-4 Regional Business, which prohibits drive-thru restaurants. Paster Properties
(owner) has had some interest from fast-food restaurants. The topic was discussed by the City
Council's Development Committee, which favored allowing a drive-thru. This was further
discussed during the City Council's April 5' Work Session regarding Development Opportunities
and Constraints. The City's intent is to remove zoning constraints (when warranted) that may
be prohibiting redevelopment opportunities.
Discussion:
Mounds View Square shopping center consists of three buildings; (1) the main L-shaped
building, (2) El Loro; and (3) the Caribou Coffee/H&R Block/Little Caesars Pizza building. The
main building and El Loro are zoned B-4. The Caribou building (formerly Hardee's) is zoned B-
3. The B-3 district allows drive-thru's as a Conditional Use Permit (CUP). The B-4 district
prohibits them.
For the El Loro site, there are two options; (1) amend the B-4 district to allow drive-thru
restaurants, similar to the B-3 district; or (2) rezone the property from B-4 to B-3. The end result
is the same, but the path differs.
The original intent when Mounds View Square was developed in 1974 was for a traditional sit-
down restaurant (e.g. Bridgeman's, Totino's, El Loro). Since this time, dining habits have
changed, favoring fast-food restaurants (e.g. McDonalds, Subway), and fast casual restaurants
(e.g. Chipotle, Noodle's & Company). In winter/spring 2020, there was a proposal to remodel El
Loro into "Sota Tap House and Grill", but was pulled due to the pending Covid-19 pandemic.
If requiring a Conditional Use Permit, the intent is for the Planning Commission/City Council to
review the use of the drive-thru portion of the restaurant, such as, is there enough stacking
space, and is there enough buffering of car headlights, etc. The same items are reviewed as
part of a Development Review, required for new buildings or building expansions more than
10% or 10,000 sq ft. Thus, the CUP and Development Review process may duplicate each
other at times. CUP's require a Public Hearing. Development Reviews do not.
The proposed Ordinance Amendment removes duplicate language (# a - k), which refers to
other sections of the City Code. In Staff's opinion, this provides a false -sense that the drive-thru
must only comply with those regulations referenced, and not others.
The Commission may also want to consider allowing Drive-Thru Restaurants as a Permitted
Use, instead of a CUP.

buildings or area as to cause impairment in property values or
constitute a blighting influence within a reasonable distance

than ten feet (10') shall be landscaped and screened in
compliance with subdivisions 1103.08(1) through (5) of this
Title.
c. Each light standard island and all islands in the parking lot shall
be landscaped or covered.
d. Parking areas shall be screened from view of abutting
residential districts in compliance with subdivisions 1103.08(1)
through (5) of this Title.
e. Parking areas and driveways shall be curbed with continuous
curbs not Tess than six inches (6") high above the parking lot
or driveway grade.
f. Vehicular access points shall be limited, shall create a
minimum of conflict with through traffic movement, shall
comply with Chapter 1121 of this Title and shall be subject to
the approval of the Director of Public Works/City Engineer.
g. All lighting shall be hooded and so directed that the Tight
source is not visible from the public right of way or from an
abutting residence and shall be in compliance with Section
1103.09 of this Title.
h. The entire area shall have a drainage system which is subject
to the approval of the Director of Public Works/City Engineer.
i. The entire area, other than that occupied by buildings or
structures or plantings, shall be surfaced with a material
which will control dust, drainage and erosion which is subject
to the approval of the Director of Public Works/City Engineer.
j. All signing and informational or visual communication devices
shall be in compliance with the Mounds View Sign Code
k. The provisions of subdivision 1125.01(1)e of this Title are
considered and satisfactorily met.
Strategic Plan Strategy/Goal:
Continue BR&E program, maximize utilization of development space and current list of available
sites, encourage land owners to maintain their properties, & consider residential development.

Financial Impact:
None.
Recommendation:
Staff recommends discussion of the Ordinance Amendment, and to provide direction on
whether to allow Drive-Thru's as a Conditional Use vs. a Permitted Use. The end -goal is to
provide options for a drive-thru restaurant at the El Loro site.
The proposed Amendment is written such that it is a Conditional Use in the B-4 district (currently
prohibited), and removes duplicate requirements from both B-3 and B-4 districts (items a — k). If
approved as a CUP, it would allow the Planning Commission/City Council to make site specific
requirements (e.g. more screening), whereas this would not be an option if a Permitted Use.

A RESOLUTION RECOMMENDING APPROVAL OF ORDINANCE 976, AMENDING
TITLE 1100, CHAPTERS 1114 AND 1115 OF THE MOUNDS VIEW CITY CODE
RELATING TO "DRIVE-IN AND CONVENIENCE FOOD ESTABLISHMENTS"
The City of Mounds View Ordains:
SECTION 1. The City Council of the City of Mounds View hereby amends Title 1100, Chapter
1114, Section 1114.04: CONDITIONAL USES of the Mounds View Municipal Code by adding the
underlined material and deleting the stricken material as follows:
Subd. 1. Drive-in and convenience food establishments; provided, that:

SECTION 3. In accordance with Section 3.07 of the City Charter, City staff shall have the following
summary printed in the official City newspaper in lieu of the complete ordinance:
On , the City Council adopted Ordinance 976 that amends Chapter 1115 of the Mounds
View City Code, relating to Drive-in and Convenience Food Establishments within the B-4 Regional
Business District.
A printed copy of the ordinance is available for inspection during regular business hours at Mounds
View City Hall and is available on line at the City's web site located at www.ci.mounds-view.mn.us.
SECTION 4. This ordinance shall take effect and be in force 30 days from and after its passage and

Discussion:
Previously, the Planning Commission asked to discuss sign regulations. At the March 3rd
Commission meeting, the scope was narrowed more toward the brightness of dynamic (digital)
signs.
Attached is a comparison of sign codes specific to city corridors similar to Mounds View
Boulevard, for Ground, Wall, and Dynamic signs. Since the March meeting, information has
been added regarding the maximum brightness of Dynamic Signs. Although Mounds View has
maximum brightness standards, we do not have a tool to enforce this (costs about $2,000).
Rather, the City requires that dynamic displays be installed with a manual override, in the event
the sign's automated dimmer fails.
Community Development Staff are not aware of any complaints about signage (excluding
temporary signs), other than complaints generated by other City Staff.
The Commission is encouraged to drive the Boulevard a few times, and provide an opinion as to
what Commission members would change, if anything. For example, if there is a most favored,
or least favored sign characteristics. One thing to note is that older signs which are non-
conforming, can be repaired or replaced, but cannot be expanded. This means that some of the
lesser desirable signs will likely stay until the property is re -developed. Also, a number of
variances have been approved for signs over the years (e.g. McDonalds, BP, & Days Inn,
Interactive Playground).
Recommendation:
Staff requests that Commissioners drive Mounds View Boulevard, and be prepared to discuss
likes & dislikes. If Staff were to change anything, it would be to add diagrams to the Ordinance
to visually explain requirements.

The meeting was called to order by Chair Rundle at 7:00 p.m. for March 17, 2021. Due to the
COVID-19 pandemic this meeting was held virtually.

A. Resolution 1131-21, Recommending Approval of a Conditional Use Permit
for an Accessory Building exceeding 952 square feet for Curtis Goettsch at
2229 Lambert Avenue
Community Development Director Sevald stated the homeowners, Curt & Ann Goettsch, built a
home addition in 2020, and now propose to replace the detached 20' X 24' garage (480' square
feet) with a 28' X 44' garage (1,232 square feet). The lot is 75' X 300'. Within the R-1 Single
Family Residential District, Accessory Buildings exceeding 952 square feet in area, require a
Conditional Use Permit (CUP). Each lot is allowed up to three accessory buildings, totaling
1,800 square feet. Currently, there are no accessory buildings on the property, other than the
garage to be removed. The garage must be designed and maintained to provide a uniform
appearance with the house. The width cannot exceed 35' (28' is proposed). The garage will be
set back 6' from the side (west) property line, whereas 5' is the minimum. The western neighbor
also has a large accessory building (906 square feet). Staff commented further on the CUP and
recommended approval as requested.
Curtis Goettsch, 2229 Lambert Avenue, explained the front of the garage would look like the
front of the house, noting it would have stone and Masonite siding. He indicated his garage
needs to be rebuilt, and instead of building a two car garage and a shed, he would rather build an
oversized garage.
Chair Rundle commented on how large these lots were.
MOTION/SECOND: Commissioner Farmer/Commissioner Stevenson. To approve Resolution
1131-21, a Resolution Recommending Approval of a Conditional Use Permit 2229 Lambert
Avenue.

B. Resolution 1132-21, Recommending Approval of Ordinance 975, Amending
Chapter 1106 of the Mounds View City Code, relating to Permitted
Accessory Uses within the R-1 Single -Family Residential District

Community Development Director Sevald stated during the Planning Commission's March 3rd
meeting, the Commission discussed amending the Zoning Code to clarify the allowance of Home
Occupations to operate in Accessory Buildings. In attendance was Kurtis Barbeau, 8375
Sunnyside Road, who wishes to construct an accessory building to grow vegetables
commercially. The Zoning Code specifically prohibits commercial greenhouses in the R-1
district. Home Occupations is the use of a home for a business. The intent is that the property is
primarily used as a residence, and its use by the business is secondary. The current Ordinance is
not clear regarding the use of Accessory Buildings (e.g. garage) as a Home Occupation. The
proposed amendment provides clarity, in addition to fixing a couple of other items:
1. Deletes the prohibition of non-commercial greenhouses in Residential districts.
2. Allows up to two roomers or boarders in Residential districts, to be consistent with
Chapter 1012 of the City Code (e.g. Rental License regulations).
Community Development Director Sevald explained staff informally inquired with neighboring
city planners as to their regulations of Home Occupations. Staff commented further on the
Ordinance amendment and recommended approval as requested.
Commissioner Farmer asked if there was a further definition for conservatory within City Code.
Community Development Director Sevald reported there was no further definition.
MOTION/SECOND: Commissioner Stevenson/Commissioner Munson. To approve Resolution
1132-21, a Resolution Recommending Approval of Ordinance 975, Amending Title 1100,
Chapters 1106 of the Mounds View City Code Relating to "Home Occupations".

Community Development Director Sevald discussed upcoming planning cases with the
Commission. He explained staff received a request from Caribou Coffee to subdivide a lot from

B. Staff Updates
Community Development Director Sevald provided the Commission with an update from staff
and noted the Council would be holding a worksession meeting on April 5, 2021 to discuss
development opportunities and constraints.
C. Council Updates
Council Member Meehlhause provided the Planning Commission with an update from the City
Council. He noted the Council approved the Preliminary Plat for Belden View and the EDA
discussed the potential sale of a portion of the Skyline Motel property, along with the City
owned lot along Groveland Road.
D. Planning Commissioner Reports
None.
8. Approval of Minutes
March 3, 2021.
