MEETING IS CALLED TO ORDER 2. PLEDGE OF ALLEGIANCE 3. ROLL CALL: Bergeron, Cermak, Hull, Meehlhause, Mueller NOT PRESENT: None. 4. APPROVAL OF AGENDA A. Monday, July 12, 2021, City Council Agenda. Mayor Mueller requested Item 5D be added to the Consent Agenda for Resolution 9444, Approving the 2021 Festival in the Park Agreement. MOTION/SECOND: Hull/Bergeron. To Approve the Monday, July 12, 2021, agenda as amended. Ayes – 5 Nays – 0 Motion carried. 5. CONSENT AGENDA A. Approval of Minutes: June 28, 2021. B. Just and Correct Claims. C. Resolution 9442, Approving Charitable Gambling Permit for the Mounds View Police Foundation to Conduct Excluded Bingo at the 2021 Mounds View Festival in the Park. D. Resolution 9444, Approving the 2021 Festival in the Park Agreement. MOTION/SECOND: Bergeron/Meehlhause. To Approve the Consent Agenda as presented. Ayes – 5 Nays – 0 Motion carried. 6. PUBLIC COMMENT Mounds View City Council July 12, 2021 Regular Meeting Page 2 Thui Bui, 2075 Hillview Road and 2081 Hillview Road, explained her husband died last September which led her to have problems with fixing her buildings. She stated she had no problems with her buildings prior to last September. She stated the City had revoked her rental license. She indicated she has had a hard time finding a repair person and requested the Council grant her more time to fix her buildings. Mayor Mueller reported the City had been sending written correspondence to Ms. Bui for some time. She asked if Ms. Bui responded to these letters. Ms. Bui explained she had not responded to these letters. Mayor Mueller explained if Ms. Bui brought her building into compliance with City Code, the City would reconsider granting a rental license for these properties. She indicated action had already been taken to revoke the license due to the conditions at these properties. She encouraged Ms. Bui to work with City staff to bring the rental properties into compliance with City Code. 7. SPECIAL ORDER OF BUSINESS A. Recognition of Sherry Gunn – 17 Years of Dedicated Service to the City of Mounds View, Resolution 9441. Mayor Mueller read a Resolution in full for the record recognizing Sherry Gunn for her 17 years of dedicated service to the City of Mounds View. A standing ovation and round of applause was offered by all in attendance. Mayor Mueller presented former Council Member Sherry Gunn with a plaque thanking her for her 17 years of service to the City of Mounds View. Council Member Hull presented former Council Member Gunn with a street sign. MOTION/SECOND: Motion inadvertently missed. Resolution 9441 will be officially approved at the July 26, 2021 City Council Meeting. 8. COUNCIL BUSINESS A. Public Hearing: Resolution 9440, Approving a Temporary On-Sale Intoxicating Liquor License for Festival in the Park of Mounds View to Allow Big Ten Catering to Sell and Serve Liquor at the 2021 Festival in the Park, Saturday, August 21, 2021. City Administrator Zikmund requested the Council approve a temporary on-sale intoxicating liquor license for Festival in the Park to allow Big Ten Catering to sell and serve liquor at the 2021 Festival in the Park on Saturday, August 21, 2021. Mayor Mueller opened the public hearing at 6:49 p.m. Bob King, 7408 Silver Lake Road, reported Big Ten Catering did a great job at Festival in the Park in 2019 and he looked forward to working with this organization again this year. To Waive the Reading and Adopt Resolution 9440, Approving a Temporary On-Sale Intoxicating Liquor License for Festival in the Park of Mounds View to Allow Big Ten Catering to Sell and Serve Liquor at the 2021 Festival in the Park, Saturday, August 21, 2021. Ayes – 5 Nays – 0 Motion carried. B. Second Reading and Approval of Ordinance 976, An Ordinance Adopting the Recodification of the Mounds View Municipal Code and Updating the City of Mounds View’s 2021 Fee Schedule. City Administrator Zikmund requested the Council adopt an Ordinance that would recodify the Mounds View Municipal Code along with updating the Mounds View 2021 fee schedule. He reported the Council held the first reading of this Ordinance two weeks ago and since that time staff has received no further comments from the public. Staff recommended approval of the Ordinance. MOTION/SECOND: Meehlhause/Bergeron. To Waive the Second Reading and Adopt Ordinance 976, An Ordinance Adopting the Recodification of the Mounds View Municipal Code and Updating the City of Mounds View’s 2021 Fee Schedule directing staff to publish an Ordinance summary. ROLL CALL: Bergeron/Cermak/Hull/Meehlhause/Mueller. Ayes – 5 Nays – 0 Motion carried. C. Public Hearing: First Reading and Introduction of Ordinance 977, an Ordinance Amending the Mounds View Municipal Code, Title XV, Chapter 160, Sections 160.198 and 160.218 related to Drive-Thru Businesses. Community Development Director Sevald requested the Council introduce an Ordinance that would amend the Mounds View Municipal Code related to drive-thru businesses. He explained this amendment would allow a drive thru business as a conditional use in the B-3 zoning district. He reported the proposed amendment would allow for greater flexibility within the B-3 zoning district. Mayor Mueller opened the public hearing at 6:56 p.m. Hearing no public input, Mayor Mueller closed the public hearing at 6:57 p.m. MOTION/SECOND: Hull/Bergeron. To Waive the First Reading and Introduce Ordinance 977, an Ordinance Amending the Mounds View Municipal Code, Title XV, Chapter 160, Sections 160.198 and 160.218 related to Drive-Thru Businesses. Public Hearing: Resolution 9443, Approving the Preliminary Plat of Anthony Properties, Second Addition; Amending the PUD Narrative for the O’Neil Property; and Approving a Development Review for Caribou Cabin; 2404 Mounds View Boulevard. Community Development Director Sevald requested the Council approve the Preliminary Plat of Anthony Properties, Second Addition; Amending the PUD narrative for the O’Neil Property; and approve a Development Review for Caribou Cabin at 2404 Mounds View Boulevard. He stated the applicant is proposing to subdivide a portion of the movie theater parking lot for a Caribou Cabin for a drive-thru coffee shop. He reviewed the proposed subdivision in further detail with the Council noting the location of the Caribou Cabin. He explained the subdivision requires a public hearing. He reported the Planning Commission reviewed this item on July 7, 2021, discussed traffic and parking concerns, and recommended approval. He stated the applicant submitted a revised Preliminary Plat to the City last week. Staff recommended the project not be approved this evening in order to allow staff more time to review these new plans, but that the Public Hearing be held. It was noted this item would come back to the Council for consideration on July 26, 2021. Mayor Mueller opened the public hearing at 7:02 p.m. Bob King, 7408 Silver Lake Road, asked what the City would be gaining through this project. He questioned if the City had considered having a Dunkin Donuts at this location instead. Mayor Mueller reported this was private property and not City owned property, which meant the market would drive the use. Community Development Director Sevald added that it was up to the property owner and developer to determine the use on this land. He indicated a park dedication would be paid to the City for this project. Hearing no further public input, Mayor Mueller closed the public hearing at 7:05 p.m. Mark Krough, Java Companies, stated he was super excited to be bringing the Caribou Cabin concept to the City of Mounds View. He noted this would be a drive-thru only coffee shop. He believed this use would be a great offsetting use adjacent to Moe’s and the movie theater. Council Member Meehlhause asked if Caribou would manage the cabin or would this be a franchise. Mr. Krough reported this site would be managed by corporate. Council Member Meehlhause requested further information about what it would mean to have two Caribou’s in Mounds View. Mr. Krough explained each location had different AM traffic patterns. He estimated 75% of Caribou’s businesses was during the AM peak traffic hours. Mayor Mueller thanked Mr. Krough for attending this meeting. MOTION: Meehlhause. Ayes – 5 Nays – 0 Motion carried. 9. REPORTS A. Reports of Mayor and Council. Council Member Hull discussed the Lights On program that began in the City of Minneapolis. He recommended the Mounds View Police Department consider adopting this program as it would assist residents with getting their taillights fixed versus writing citations. City Administrator Zikmund stated he would discuss this program with Police Chief Harder. Council Member Bergeron reported he would be attending a Nine North Cable Commission meeting on Thursday, July 15, 2021. Mayor Mueller requested Council Member Bergeron speak with Nine North to see if they could attend Festival in the Park to film the car accident reenactment sponsored by the Mounds View Police Department, SBM Fire Department, Allina and Life Link that would be held at 3:00 p.m. Council Member Cermak stated the Mounds View Police Foundation would be meeting at Random Park at 4:30 p.m. on Tuesday, July 13, 2021. Council Member Meehlhause discussed the meetings he would be attending in the next two weeks. He reported he would be attending an NYFS HR Committee meeting on Wednesday, July 14, 2021 and a Twin Cities Gateway Board meeting on Tuesday, July 20, 2021. Mayor Mueller stated she attended a mayors and city managers meeting where each city discussed what was happening in their community. She indicated there was a lot of development occurring in the surrounding communities. Mayor Mueller explained the Festival in the Park Committee would meet next on Tuesday, July 13, 2021 at 7:00 p.m. at the Community Center. She encouraged those interested in volunteering for this event to consider attending. Mayor Mueller stated she would be attending a Ramsey County League of Local Government workshop meeting on Thursday, July 15 where the group will discuss mental health. She also announced she would be attending an Executive Board meeting of the Minnesota Mayor’s Association on Thursday, July 15. Mayor Mueller reported that on Friday, July 16 she would be attending a Minnesota Women in City Government Board Meeting. B. Reports of Staff. Mounds View City Council July 12, 2021 Regular Meeting Page 6 Finance Director Beer stated MWF did not receive any bonding money for their affordable housing request which meant they would try again in January. City Administrator Zikmund discussed the splash pad and how staff was working to address the chlorins. 10.
