HomeMy WebLinkAboutResolution 9465RESOLUTION 9465 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION AMENDING THE CROSSROAD POINTE PUD NARRATIVE WHEREAS, the applicant, Corey Gerads (Alliance Building Corp.), representing property owner, Crossroads Pointe MV LLC; is requesting an Amendment to the Crossroad Pointe PUD Narrative, on property located at 2390 Mounds View Boulevard, legally described as: PID: 08-30-23-31-0078 Lot 1, Block 1, Crossroad Pointe WHEREAS, a Planned Unit Development (PUD) was approved for Crossroad Pointe (now known as Gray Stone Flats) in 2019 (Resolution 9132). The PUD Narrative (#6) specifies Dimensional Requirements; and, WHEREAS, the building foundation as constructed, deviates from these Dimensional Requirements, for which the applicant is requesting to amend the PUD Narrative, to be consistent (reduces north side yard building foundation setback from 17' to 14.5', and east side yard building foundation setback from 27' to 26.5'). Additionally, at the time the PUD Narrative was approved, the Landscaping Plan did not include details on fence height for the pet exercise area, and other areas of the yard. The applicant is requesting to maintain a 5' tall chain -link fence around the pet exercise area; and to install an 8' tall panel fence in portions along the patio for aesthetic reasons; and, WHEREAS, the Mounds View Municipal Code §160.315(B) intends PUD's to encourage; (2) Higher standards of site and building design through the use of trained and experienced land planners, architects and landscape architects. (10) To allow variation from the provisions of this chapter, including setbacks, height, lot area, width and depth, yards and the like; and, WHEREAS, the Mounds View Planning Commission reviewed the proposed amendment, recommending approval (Resolution 1137-21); and, WHEREAS, the Mounds View Municipal Code §160.302 (Special Procedures) includes PUD amendment procedures, referencing § 160.450(E) (Adverse Effects), and § 160.450(G) (Findings of Fact). The City Council makes the following Findings (italics); Resolution 9465 Page 2 of 4 Relationship to the Comprehensive Plan. Finding: The project area is guided Mixed Use (2040 Comprehensive Plan; "The City of Mounds View seeks to achieve Mixed Use Districts by... ...Demanding high quality design to ensure compatibility between residential and commercial uses. Creating attractive, community -oriented development that positively reflects on the identity and quality of life in Mounds View " (Comprehensive Plan, p. 2-9, 2-10). A. The proposed amendment to the PUD Narrative to reduce building foundation setbacks is consistent with the Comprehensive Plan. B. The proposed amendment to the PUD Narrative to allow a fence within a front yard to exceed 48" (specifically, 60" around pet exercise area) is consistent with the Comprehensive Plan. C. The proposed amendment to the PUD Narrative to allow a fence within a front yard to exceed 48 " (specifically, 8' tall panel fence around portions of the patio) is consistent with the Comprehensive Plan. 2. The geographical area involved. Finding: The geographical area has been considered. 3. Whether the use will tend to or actually depreciate the area in which it is proposed. Finding: There is no evidence that the proposed amendment to the PUD Narrative will affect property values, or depreciate the area. 4. The character of the surrounding area; and Finding: A. The proposed amendment to the PUD Narrative to reduce building foundation setbacks is consistent with the surrounding area. The deviation is minimal (6" on the east, and 2.5' on the north), and is not visibly noticeable. B. The proposed amendment to the PUD Narrative to allow a fence within a front yard to exceed 48" (specifically, 60" around pet exercise area) is consistent with the character of the surrounding area along Edgewood Drive. C. The proposed amendment to the PUD Narrative to allow a fence within a front yard to exceed 48 " (specifically, 8' tall panel fence Resolution 9465 Page 3 of 4 5. around portions of the patio) is consistent with the character of the surrounding neighborhood. The demonstrated need for the use. Finding: The applicant has sufficiently demonstrated the following needs for an amendment to the PUD Narrative; A. A demonstrated need for reduced building foundation setbacks is to be consistent with the intent of the Comprehensive Plan and Zoning Code, allowing creative use of lands for PUD's. B. A demonstrated need for increased fence height, from 48" to 60 ", around the pet exercise area is for increased security to contain pets within those confines. C. A demonstrated need to increase fence height from 48"to 8' for panel fencing along County Road H2 is to be consistent with the intent of the Comprehensive Plan and Zoning Code, allowing creative use of lands for PUD's. WHEREAS, a Public Hearing was held on Monday, September 13, 2021 at 6:30 PM. A Public Hearing Notice was published in the August 17, 2021 edition of the Shoreview Press, and mailed to property owners within 350' of the subject property; and, NOW, THEREFORE, BE IT RESOLVED, the Mounds View City Council approves the following Amendment to the Crossroad Pointe Planned Unit Development Narrative (Stfieke text to be amended by underlined text): Dimensional Requirements: Minimum Building Setbacks -lam 14.5' North (County Road 1-12) 2- 26.5' East (Mounds View Boulevard) 50' South 66' West (Edgewood Drive Landscaping: All landscaping shall be consistent with the landscape plan (p.L010) included in the City Council's July 8, 2019 packet, to be revised as detailed in the July 8, 2019 City Council Staff Report [Revised Plan = p. LO 10, dated Sept 6, 2019]. It is the itent that t after the building is built and landscaping is installed (e.g. whining one year after), Staff and the Developer shall inspect the property, and determine if additional landscaping is necessary; (1) as a buffer between the Edgewood Road sidewalk and Stormwater retention basin; and (2) along the south property line; and (3) elsewhere as agreed upon between City Staff and the developer. Resolution 9465 amends the Landscaping Plan dated Sept 6 2019 to allow; (1) a 5' tall fence around the net exercise area: and (2) an 8' tall fence along portions of the patio consistent with the September 13, 2021 City Council Staff Report attachments Resolution 9465 Page 4 of 4 Adopted this 13th day of September, 2021 Attest: (SEAL) 4,w G4L4� Carol A.
