1 A. Public Hearing: Resolution 9449, Chicken -Keeping License Request for
2 Shannon Ramirez at 8381 Eastwood Drive.

4 City Administrator Zikmund requested the Council consider a chicken -keeping license for
5 Shannon Ramirez at 8381 Eastwood Drive. He reported the applicant has met all City requirements
6 and staff recommends approval. It was noted three neighbors emailed staff in support of the
7 request.

9 Acting Mayor Hull opened the public hearing at 6:35 p.m.

11 Shannon Ramirez, 8381 Eastwood Drive, thanked the Council for their consideration. She noted
12 she has been a resident of Mounds View for the past two years and would like to take up chicken-
13 keeping.

15 Council Member Meehlhause asked how many chickens Ms. Ramirez would be keeping. Ms.
16 Ramirez reported she would like to keep eight hens.

18 Hearing no further public input, Acting Mayor Hull closed the public hearing at 6:37 p.m.

20 MOTION/SECOND: Meehlhause/Bergeron. To Waive the Reading and Adopt Resolution 9449,
21 Chicken -Keeping License Request for Shannon Ramirez at 8381 Eastwood Drive.

25 B. Introduction and First Reading of Ordinance 978, an Ordinance Continuing a
26 Franchise Fee on Center Point Energy Natural Gas Operations within the City
27 of Mounds View.

29 Finance Director Beer requested the Council introduce an Ordinance that would continue a
30 franchise fee with Center Point Energy Natural Gas for operations within the City of Mounds
31 View. He reported this franchise was continued in 2019 and had to be reconsidered every three
32 years. He recommended this franchise be continued for another five years. It was noted the
33 funding gained through franchise fees was used to assist with street maintenance. He explained
34 Center Point Energy had only one customer in Mounds View.

36 MOTION/SECOND: Hull/Cermak. To Waive the First Reading and Introduce Ordinance 978,
37 an Ordinance Continuing a Franchise Fee on Center Point Energy Natural Gas Operations within

View. He reported this franchise was continued in 2013 with a sunset provision at the end of 2021.
He recommended this franchise be continued for another five years. It was noted the funding
gained through franchise fees was used to assist with street maintenance.

D. Resolution 9451, Authorizing Revisions to Section 2.02 (Direct Deposits);
Section 2.03 (Holidays); Section 2.04 (Sick Leave); and Section 2.05 (Vacation)
of the Personnel Manual.
Human Resources Coordinator Ewald requested the Council authorize revisions to Section 2.02
(Direct Deposits), Section 2.03 (Holidays), Section 2.04 (Sick Leave), and Section 2.05 (Vacation)
of the Personnel Manual. She reviewed the proposed changes to the Personnel Manual in detail
with the Council and recommended approval.
MOTION/SECOND: Bergeron/Cermak. To Waive the Reading and Adopt Resolution 9451,
Authorizing Revisions to Section 2.02 (Direct Deposits); Section 2.03 (Holidays); Section 2.04
(Sick Leave); and Section 2.05 (Vacation) of the Personnel Manual.
Council Member Meehlhause thanked staff for making the proposed changes. He anticipated the
proposed changes would assist with hiring and maintaining future hires when it comes to benefits.
Council Member Bergeron agreed stating it was difficult for smaller cities to recruit and retain
personnel.

E. Resolution PUD Concept Plan Review for the Properties at 2840 Mounds View
Boulevard and 7861 Groveland Road.
City Administrator Zikmund stated Sabry Sharara (developer) is requesting a concept plan review
of a Mixed -Use Planned Unit Development (PUD) to be located at 2840 Mounds View Boulevard
(former Simons/ABC Liquor) and 7861 Groveland Road (EDA property). The project includes a
four-story building, with Mounds View Family Dental (relocated) and retail (speculation) on the
first floor, and apartments above (market rate). A Concept Plan does not have the level of detail
expected for a Development Review. The intent is for the City Council members to provide
individual opinions of the project. There is no formal Resolution or approval at this time. These
opinions will assist the developer in refining plans before submitting a formal application. He
discussed the proposed plans for these properties in further detail with the Council and asked for
comments or questions.

Kevin Green, TL Green, introduced himself to the Council noting he was the project architect. He
discussed the concept plan in further detail stating he would be looking for ground level tenants
that would compliment the proposed apartments. The challenges on the site were reviewed which
included the location and size of the property. He commented on how the property would be
accessed from Mounds View Boulevard.
Council Member Meehlhause asked if the apartments would be market rate. Mr. Green reported
this was the case.
Council Member Meehlhause questioned if underground parking was an option for this site. Mr.
Green stated there were access issues and other restraints on this site that would not allow for
underground parking.
Council Member Meehlhause commented he liked the design concept and encouraged the
developer to keep the building colors neutral. He supported the City collecting park dedication
fees for this project rather than developer paying for a trail extension since this is already being
considered for the 2022 / 2023 street projects.
Acting Mayor Hull asked if the Council supported allowing a PUD that was less than four acres.
The Council supported this action.
Council Member Bergeron indicated this project was working to fit into the neighborhood and
would dominate the neighborhood if it was four acres in size. He stated he was very impressed
with the proposed plans.
Acting Mayor Hull agreed stating he was in support of the project.
Council Member Cermak noted she was in favor of the project as well.
Council Member Meehlhause explained he fully supported this project moving forward as well.
He looked forward to this corner redeveloping.
F. Resolution 9456, Authorize Sanitary Sewer CIPP (Cured -In -Place -Pipe) at the
Bronson Lift Station.
Public Works/Parks and Recreation Director Peterson requested the Council authorize Sanitary
Sewer CIPP (Cured -In -Place Pipe) at the Bronson Lift Station. He reported over the past several
months Public Works has received calls regarding a pipe near the Bronson Lift station. He
explained it appears the pipe has some jagged edges and the flushable wipes were getting caught
up which was causing backups. He stated after speaking with a contractor, it was recommended
the pipe be slip lined. He reviewed the quotes he received for this work and recommended this
pipe be lined.
MOTION/SECOND: Bergeron/Cermak. To Waive the Reading and Adopt Resolution 9456,
Authorize Sanitary Sewer CIPP (Cured -In -Place -Pipe) at the Bronson Lift Station.

2 the sewer lines.

6 G. Resolution 9457, Authorization for Storm Sewer Maintenance.

8 Public Works/Parks and Recreation Director Peterson requested the Council authorize Storm
9 Sewer Maintenance. He discussed several areas of the City that require maintenance which
10 included cleaning and repairing the Arden ditch pipe, along with cleaning and replacing the Silver
11 View Park drain pipe.

13 Council Member Meehlhause asked if the storm sewer ditch in Arden Park was the City or Rice
14 Creek's responsibility. Public Works/Parks and Recreation Director Peterson reported this was
15 the City's responsibility.

23 A. Reports of Mayor and Council.

25 Council Member Cermak thanked the members of the community for hosting a great number of
26 Night to Unite parties. She stated she was able to attend nine of the 21 parties that were hosted in
27 Mounds View.

29 Council Member Bergeron explained he was able to attend six Night to Unite parties. He thanked
30 the Mounds View residents for hosting these great community events.

32 Council Member Meehlhause discussed a well written article by a Mounds View resident that was
33 in the Star Tribune in the Opinion section of the paper.

35 Acting Mayor Hull reported Festival in the Park would be held on Friday, August 20 and Saturday,
36 August 21.

38 B. Reports of Staff.

40 Finance Director Beer reported the preliminary tax levy would be reviewed and approved by the
41 Council in September. He explained not much has changed in the budget since June. He noted he
42 was still waiting to receive health insurance numbers.

44 Public Works/Parks and Recreation Director Peterson provided the Council with an update on the
45 sealcoating project, noting this project would begin on August 24, 2021.

1 Public Works/Parks and Recreation Director Peterson reported work on the water treatment plants
2 wrapping up.

4 Public Works/Parks and Recreation Director Peterson stated he was thankful for the small amount
5 of rain the City has received. He indicated the odd/even watering restrictions would remain in
6 place for the time being.

Public Works/Parks and Recreation Director Peterson commented on the two UV systems that
were installed at the splash pad and reported the combined chlorine issue has been addressed.
Human Resources Coordinator Ewald stated the City had taken nominations for Citizen of the
Year and explained staff was seeking direction from the City Council as to which candidate should
be selected. She reported the Citizen of the Year Award will be presented to the chosen candidate
at the Town Hall Meeting on September 20, 2021 at 6:00 p.m. at the Mounds View Event Center.
Mayor Mueller and Acting Mayor Hull supported Candidate A.
Council Member Bergeron, Council Member Cermak and Council Member Meehlhause supported
Candidate B.
City Administrator Zikmund explained Candidate B would be awarded the Citizen of the Year for
2021.
Council Member Meehlhause requested the Citizen of the Year from 2020 be invited to attend this
year's Town Hall meeting in order to be publicly recognized.
City Administrator Zikmund reported staff was scheduling a badge pinning ceremony for a
September meeting.

Hanson to the Position of Police Sergeant
Background:
The Police Department has an immediate need to fill the fourth police sergeant position
previously approved by the council.
Discussion:
In 2020 the Mounds View City council voted to approve a fourth sergeant positon. The
officer to be promoted left the agency and the vacancy was not filled. The vacancy was
re -posted and three candidates interviewed with the oral board consisting of supervisors
from several outside agency.
At this time, staff would like to promote Michael Hanson to Sergeant.
Mr. Hanson successfully passed the required testing procedures, which included an oral
board, and an assessment and interview with Dr. Laura Pendergrass at Martin McAlister.
We are requesting the promotion be effective as of September 1, 2021.
Recommendation:
Staff recommends City Council approval of Resolution 9450 a resolution authorizing the
promotion of Michael Hanson to Police Sergeant. Sergeant Hanson will be at Step 2
($41.69 per LELS contract) with probation until March 1, 2022 at which time he will go to
step 3.

COUNTY OF RAMSEY
STATE OF MINNESOTA
APPROVING THE PROMOTION OF MICHAEL HANSON
TO THE POSITION OF POLICE SERGEANT
WHEREAS, the City Council has approved a promotion to fill the vacancy of Police
Sergeant in the Police Department, and the City of Mounds View has approved the
procedures to fill these vacancies, and;
WHEREAS, the approved hiring procedures consist of training and experience
scoring, oral board interview, a psychological and leadership assessment, and;
WHEREAS, staff of the Police Department has met with Michael Hanson, and the
Chief of Police recommends that he be appointed to the position of Police Sergeant.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Mounds View, Ramsey County, Minnesota does hereby appoint Michael Hanson to the
position of Police Sergeant at the step two rate of pay ($41.69/hour) as indicated in the
Law Enforcement Labor Services contract.

Introduction:
State Statute requires the governing body of each municipality to designate polling place
locations annually, even when no elections are regularly scheduled as the requirement
would apply to any special elections that may arise. A resolution for 2021 was
inadvertently omitted for 2021, and merged into this document. Ramsey County has been
made aware of the omission.
Discussion:
The Community Center has been Mounds View's designated polling place for the City's
four (4) precincts since the year 2000. Polling places are to be designated and Ramsey
County Elections notified of the City Council's polling place decision by December 4th
annually.

Provide high quality public services.
Financial Impact:
None, this is a budgeted item.
Recommendation:
Approve Resolution 9458 Designating Polling Places for the 2021 and 2022 State Primary

STATE OF MINNESOTA
ANNUAL POLLING PLACE DESIGNATIONS FOR 2021 and 2022
WHEREAS, Minnesota Statutes 20413.16, subd 1 requires the City Council, by
ordinance or resolution, to designate polling places for the upcoming year; and
WHEREAS, changes to the polling place locations may be made at least 90 days
before the next election if one or more of the authorized polling places becomes
unavailable for use; and
WHEREAS, changes to the polling place locations may be made in the case of an
emergency when it is necessary to ensure a safe and secure location for voting.
NOW, THEREFORE, BE IT RESOLVED, that the Mounds View City Council
hereby designates the following polling place for elections conducted in the City in 2021
and 2022:
Precincts 1,2,3,4 Mounds View Community Center
5394 Edgewood Drive, Mounds View MN 55112
AND, BE IT FURTHER RESOLVED, that the City Administrator or their designee
is hereby authorized to designate a replacement meeting the requirements of the
Minnesota Election Law for any polling place designated in this Resolution that becomes
unavailable for use by the City;
AND, BE IT FURTHER RESOLVED, that the City Administrator or their designee
is hereby authorized to designate an emergency replacement polling place meeting the
requirements of the Minnesota Election Law for any polling place designated in this

WHEREAS, the Mounds View Citizen of the Year Award recognizes ordinary citizens who
have demonstrated initiative to improving the community, whose service or performance exemplifies
the spirit of giving back and who inspire others in their volunteer efforts; and
WHEREAS, nominations were solicited from the public and were reviewed by the City
Council; and
WHEREAS, George Winiecki, President and Owner of Win Insurance Agency in Mounds
View for over 40 years, was selected for the 2020 award and meets the criteria outlined in the policy;
and
WHEREAS, George Winiecki has exemplified the courage and determination to follow his
values; and
WHEREAS, George Winiecki is a past President and remains an active member of our
Chamber of Commerce, was a charter member of the Mounds View Business Council, and continues
recommending Mounds View as a great place to live, work and play; and
WHEREAS, George Winiecki reaches out to City staff to understand new policies and
regulations and shares what he has learned to promote and support our City; and
WHEREAS, George Winiecki embraced the name change of Old County Highway 10 to
Mounds View Boulevard after he learned how negatively impacted other businesses were; and
WHEREAS, George Winiecki has been a keynote speaker at several community events,
mentored many people as they've started businesses, is a strong supporter of the Ralph Reeder
Food Shelf and the Alternative Learning Center, and his pride in the City of Mounds View is
unparalleled; and
WHEREAS, George Winiecki has contributed his efforts unselfishly, not expecting anything
in return.

Attached is an ordinance to receive a public hearing and adoption. Notice of the public

This ordinance continues the agreement with CenterPoint Energy under which Center
Point Energy will collect a franchise fee in the amount of 4% of Center Point's natural gas
gross operating revenues for services within the City of Mounds View during the year
2022 thru 2026.
Ordinance 962 was considered on August 12 and 26 and passed on August 26, 2019. It
provides that the City may impose a franchise fee of not more than 4% of CenterPoint's
gross operating revenues at any time through July 1, 2039. The franchise fee was first
adopted in 1999 and collected in 2001.
It has been the practice to include a sunset provision in the ordinance requiring it to be
continued to the sunset date. Franchise fees collected under this agreement are minimal
due to Center Point Energy's small customer base within the City of Mounds View.
It will be published in the Shoreview Press and take effect as provided in the ordinance
after publication. Staff would request that a summary ordinance be published with the
complete ordinance available on-line and at City Hall.

THE CITY OF MOUNDS VIEW ORDAINS:
SECTION 1. The City of Mounds View Municipal Code Appendix D is hereby amended
to include reference to the following Special Ordinance.
Subdivision 1. Purpose. The Mounds View City Council has determined that it is
in the best interest of the City to impose a franchise fee on those public utility companies
that provide natural gas and electric services within the City of Mounds View.
a. Pursuant to City Ordinance No. 962, which is the Franchise Agreement
("Franchise Agreement") between the City of Mounds View (the "City") and
CenterPoint Energy (formerly Reliant, formerly Minnegasco), its successors and
assigns, a franchise fee of not more than four (4.0) percent of CenterPoint Energy's
gross operating revenues may be imposed by the City at any time during the 20
year term of the Franchise in amount and fee designs as set forth in Section 2.1 of
the CenterPoint Energy Franchise.
Subd. 2. Franchise Fee Statement. A franchise fee is hereby imposed on Center
Point Energy under its natural gas Franchise Agreement in the amount of four percent
(4%) of Center Point Energy's gross revenues, as defined in Section 9 of the Franchise
Agreements commencing with Center Point Energy's January 2022 billing month.
Subd. 3. Payment. The said franchise fee shall be payable to the City in
accordance with the terms set forth in Section 9 of the Franchise.
Subd. 4. Surcharge. The City recognizes that the Minnesota Public Utilities
Commission may allow each said utility company to add to its effective rates for the utility
service on which the public utility gross earnings fee is imposed, a surcharge to reimburse
such utility company for the cost of the fee.
Subd. 5. Proof of Company Gross Revenues. Center Point Energy shall make
each payment when due and shall quarterly furnish a complete and correct statement of
gross revenues for said quarter. Center Point Energy shall permit the City and its
designated representative free access to the company's records for the purpose of
verifying such statements.
Subd. 6. Enforcement. Any dispute, including enforcement of a default regarding
this ordinance will be resolved in accordance with the Franchise Agreement.
Subd. 7. Effective Date of Franchise Fee. Notwithstanding the effective date of
this ordinance and notwithstanding any contrary provisions in Section 9 of the Franchise,
the effective date of the fee collected under Subdivision 9 of this ordinance is the later of
ten (10) days after the publication and after the sending of written notice enclosing a copy
of this adopted ordinance upon Center Point Energy by certified mail.
Subd. 8. Sunset Clause. This ordinance shall automatically sunset on December
31, 2026.
SECTION 2. This ordinance takes effect as provided herein.

between the General Fund and the Street Improvement Fund.
Ordinances 875 and 876 passed on January 28, 2013 extended the original 20 year
franchise agreement for another 20 years. It provides that the City may impose a
franchise fee of not more than 4% of Xcel's gross operating revenues at any time during
the 20-year term of the franchise. The 20-year term runs from January 2013 through
January 28, 2034. The franchise fee was first collected in 1993.
It has been the practice to include a sunset provision in the ordinance that continues the
ordinance to the sunset date. The ordinance will be brought back to the City Council for
a public hearing, second reading, and adoption at the August 23, 2021 meeting. It will
then be published in the Shoreview Press and take effect as provided in the ordinance.

Background:
In accordance with Chapter 110 of the Mounds View City Code, a public hearing is required
for any liquor license issued. American Multi -Cinema, Inc. (AMC) has applied for an on -sale
intoxicating liquor license to sell beer and wine at the Mounds View 15 Theater. In addition,
they are also requesting a Class B Restaurant License and an Amusement Device License
(Dean Superior Vending is the applicant). Public hearings are not required for these two
licenses, however, City Council approval is required.
Discussion:
As you know, New Vision Theaters was the previous operator of the Mounds View 15
Theater. The business did not reopen after its closure due to the COVID-19 Pandemic in
2020. The business was sold to AMC, Inc. who opened its door for business on Friday
August 6, 2021. The previous business was issued a license to sell alcoholic beverages on
site for enjoyment during a movie. AMC too is requesting a liquor license to sell beer and
wine behind a counter for patrons to bring to their seats. AMC, Inc. has submitted all required
liquor license application materials and fees (which includes Sunday Sales and an optional
2:00 a.m. liquor license). Currently their hours of operation are 4:00-8:00 p.m., however,
they are looking to expand their hours as they continue to hire and monitor the COVID-19
situation with late night release times scheduled once things get back to normal, hence the
optional 2:00 a.m. liquor license. Also, the Certificate of Insurance provided expires
01/22/2022 so we are working with the applicant to get a certificate that continues through
the entire license period, 06/30/2021.
A public hearing notice was published in the August 3, 2021 edition of the Shoreview Press
and notices mailed to property owners located within 350 feet of the theater property.
A Class B Restaurant License is required due to their extended menu (attached). These
foods items are prepared and served on site for patrons to either sit at a table in an open
area near the concessions or bring back to their seats. Ramsey County Environmental
Health conducted an inspection of the concession area and a food service license was
issued.
As in previous years, an amusement device license for this site is being requested. Dean
Superior Vending is the applicant and is requesting a license to provide 17 various machines
that will be located in a small arcade room adjacent to the concession area. Games will
include devices such as cranes, video games, driving games, air hockey and a basketball
game. A complete list can be obtained from the applicant if desired by the Council.

The following investigations and inspections were conducted:
Mounds View Police Department
The Mounds View Police Department has issued a satisfactory background report for the
applicants, Adam Aron, President and CEO, Sean Goodman, Executive Vice President and
CFO, John McDonald, Executive Vice President and Kevin Connor, Senior Vice President,
General Counsel and Secretary, representing American Multi -Cinema, Inc. (AMC, Inc.)
City Billing (Mounds View Finance Department)/Ramsey County Property Taxes)
The theater is up to date on payment of all water/sewer bills. There are no other outstanding
fees owed to the City. The Finance Department issued a satisfactory report. In addition,
there are no outstanding property taxes for this property.
Fire Inspection (SBM Fire Department)
Inspector Schoeman conducted a fire inspection on July 28, 2021, which revealed some
minor Fire Code violations. A reinspection was conducted on August 17, 2021, all violations
were remedied, and the inspection passed.
Recommendation:
Staff recommends approving Resolution 9459 approving an On -Sale Intoxicating Liquor
License to American Multi -Cinema, Inc. (to include Sunday Sales and optional 2:00 a.m.
liquor license). Staff also recommends approval of Resolution 9460 issuing a Class B
Restaurant License to American Multi -Cinema, Inc. and Resolution 9461 issuing an
Amusement Device License to Dean Superior Vending.

NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council does

WHEREAS, Dean Superior Vending Co. has made application to the City of Mounds
View for an Amusement Device License for the AMC Mounds View 15, 2430 Mounds View
Boulevard; and
WHEREAS, Chapter 111.021 of the Mounds View City Code states that no person
shall operate any amusement machine in the City without first obtaining a license from the
City; and
WHEREAS, all applicable license application materials and fees have been submitted
to the City.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council does
hereby approve an Amusement Device License for Dean Superior Vending Co. for AMC
Mounds View 15, 2430 Mounds View Boulevard.

BE IT FINALLY RESOLVED that this is an annual license and will expire June 30,

name under which it was originally organized was. American Royal Cinema, Inc.

Item Title/Subject: First Reading and Introduction, Ordinance 980, Amending
Title XI of the Mounds View City Code to Add a New Chapter
Regulating Mobile Food Vehicles and Vendors
Introduction:
Staff normally starts receiving inquiries regarding food truck in early spring. This year,
we had received a lot more inquires than usual, and our City Code does not address
food trucks specifically. They are processed using our transient merchant portion of the
Code. Therefore, Staff saw the need to add a section to our Code to address mobile
food vehicles and vendors.
Discussion:
With current social distancing guidelines still in place, people are having more
celebrations outside and in parks. Staff saw the need to include a new section in the
Code to address the increased inquires and requests for mobile food vehicles and
vendors. Staff brought this issue to your May 3 City Council Work Session for
discussion. With your support, Staff worked with our City Attorney to draft an ordinance
which was brought to your June 6 Work Session for review. Attached please find

ADD A NEW CHAPTER REGULATING MOBILE FOOD VEHICLES AND VENDORS
THE CITY OF MOUNDS VIEW ORDAINS:
SECTION 1. The City Council of the City of Mounds View hereby amends Title XI of the
Mounds View Municipal Code by adding a new Chapter 120 as follows:

§ 120.001 DEFINITIONS
For the purpose of this chapter, the following definitions shall apply unless the context clearly
indicates or requires a different meaning.
(A) ISSUING A UTHORITY. The City Administrator or its authorized designee.
(B) LICENSING TERM. Licenses may be issued for terms of one day, thirty days or
one year.
(C) MOBILE FOOD VEHICLE. Any vehicle or trailer used for the purpose of selling
food or beverage prepared for consumption inside the vehicle and while the vehicle is
parked.
(D) MOBILE FOOD VENDOR. Any vehicle or trailer used for the purpose of selling
prepackaged food or beverages while parked or while going from street -to -street
including, but not limited to, ice cream trucks/vendors.
§ 120.002 LICENSE REQUIRED
It is unlawful for any person to sell food or beverages out of a Mobile Food Vehicle in the City or
operate as a Mobile Food Vendor in the City without a license from the City issued under this
chapter. Any person operating pursuant to a duly issued license required in this chapter does not
need a separate City license under chapter 113 of the City Code.

§ 120.003 LICENSE REQUIREMENTS
(A) Application. Applications for Mobile Food Vehicle Licenses and Mobile Food Vendor
Licenses will be made on forms supplied by the City. All license applications must be
submitted to the Issuing Authority a minimum of fifteen (15) regular business days
before the applicant desires to begin conducting business within the City. The Issuing
Authority may require such information on the application, as it deems reasonable and
necessary.
(B) Fee. All applications for a license shall be accompanied by a fee established in the
City's approved Fee Schedule
(C) Licensing Procedure. Upon receipt of the application and of the license fee, the Issuing
Authority will, within three (3) regular business days, determine if the application is
complete. An application will be considered complete if all required information is
provided. If an application is determined incomplete, the Issuing Authority must inform
the applicant of what required or otherwise necessary information is missing. If the
application is complete, the Issuing Authority will forward the application to any other
department deemed necessary to conduct background checks and investigations, as
required in part (D) of this section, and to verify eligible zoning locations. Within
fifteen (15) regular business days of receiving a completed application, the Issuing
Authority must issue the license unless grounds exist for denying the license
application under section 120.005.
(D) Background Check. The City will perform a background investigation on any and all
persons that will conduct any Mobile Food Vehicle or Mobile Food Vendor operations
in the City.
(E) License Duration. Licenses for mobile food vehicles may be issued for periods of one
day, thirty days or one year. Applicants may choose one from the following two (3)
types of licenses during the initial application process:
(1) A one -day license that shall be valid for one day from 12:00 a.m. to 11:59 p.m.
(2) A thirty -day license that shall be valid for thirty days from the date of issuance.
(3) A one-year license that shall be valid -for one year from the date of issuance.
Licenses for mobile food vendors may be issued for periods of one day or one year.
(1) A one -day license shall be valid for one day from 12:00 a.m. to 11:59 p.m.
(2) A one-year license shall be valid for one year from the date of issuance.
(F) Display of License. All licenses issued shall be visibly displayed or accessible on the
inside of the vehicle or trailer at all times during business conduction.

(G) ID Badges. Any individual preparing or selling products from a Mobile Food Vehicle
or otherwise operating as a Mobile Food Vendor must pass a background check as part
of the licensing process. The City will issue ID badges to each approved individual
and said badges shall be worn at all times while operating within the City pursuant to
this chapter.
(H) Site Plan. Applicants shall provide a site plan showing the location of the parked truck
or trailer on the property and its distance from all permanent structures and property
lines. (Moving mobile food vendors are exempt from this requirement).
(I) Location Duration. Applicants shall operate no more than 21 days annually at any one
place without the approval of the regulatory authority as defined in Minnesota Statutes.
(J) Insurance. Applicants shall provide, along with their application, a certificate of
insurance by an insurance company authorized to do business in the state, evidencing
the following forms of insurance:
a. Commercial general liability insurance with a limit of not less than $1,000,000 per
each occurrence. If such insurance contains an annual aggregate limit, the annual
aggregate limit shall be not less than $1,500,000;
b. Automobile liability insurance with a limit of not less than $1,000,000 combined
single limit. The insurance shall cover liability arising out of any automobile,
including owned, hired, and non -owned vehicles;
c. Food products liability insurance, with a limit of not less than $1,000,000 per each
occurrence; and
d. Workers compensation insurance (statutory limits) or evidence of exemption from
state law.
§ 120.004 LICENSING EXCEPTIONS
(A) City Events. Mobile Food Vehicles and Mobile Food Vendors participating in
organized events approved by the City, including, but not necessary limited to, City -
sanctioned festivals, shall be exempt from the licensing requirements of this chapter;
provided, however, that said Mobile Food Vehicles and Mobile Food Vendors
otherwise adhere to any County or State licensing requirements or any_other City
requirements related to such organized events.
(B) Private Events. Mobile Food Vehicles and Mobile Food Vendors participating in
events that are entirely private and not open to the public are not exempt from the
licensing requirements of this chapter; however, no background investigations shall be
required. Written authorization from the property owner is required. Mobile Food
Vehicles and Vendors may be allowed on City -owned property, including parks, with
prior authorization in writing from the City Administrator or its designee.
§ 120.005 INELIGIBILITY FOR LICENSE OR REGISTRATION
The following shall be grounds for denying a license or registration required under this chapter:

(A) The failure of an applicant to obtain and demonstrate proof of all necessary licenses or
permits required by state, county, or local health and transportation authorities.
(B) The failure of an applicant to truthfully provide any information requested by the city
as part of the application process.
(C) The failure of an applicant to sign the application.
(D) The failure of an applicant to pay the required fee, if any, at the time of application.
(E) A conviction within the past five (5) years of the date of application for any violation
of any federal or state statute or regulation, or of any local ordinance, which adversely
reflects upon the person's ability to conduct the business for which the license or
registration is being sought in a professional, honest and legal manner. Such violations
shall include, but are not limited to, burglary, theft, larceny, swindling, fraud, unlawful
business practices, and any form of actual or threatened physical harm against another
person or property.
(F) The revocation within the past five (5) years of any similar licenses issued to an
applicant in any jurisdiction.
(G) Evidence of any unresolved or ongoing government or legal action against the business
filed by any state or government entity.
(H) The existence of three (3) or more substantiated complaints about the business conduct
within the preceding three (3) years from city residents or other jurisdictions where
licenses have been issued to the applicant.
(I) When the Issuing Authority has learned the applicant has changed any name or names
relating to the applicant or business in an attempt to hide or escape any legal
obligation(s).
(J) If after investigation, the Issuing Authority finds the character and business
responsibility of the applicant to be unsatisfactory or a potential harm to the public.
(K) The failure to meet or comply with fire codes or safety standards upon inspection
completed by any local, county, or state authorities.
§ 120.006 LICENSE DENIAL PROCEDURE
If the city denies the license or registration application, the applicant must be notified in writing
of the decision and the reason for denial. Notice shall be delivered in person or by regular mail to
the applicant at the address provided in the application and shall inform the applicant of the
applicant's right to appeal the denial by requesting in writing, within ten (10) calendar days of
receiving notice of denial, a hearing before the City Council. The City Council shall then hear the
appeal within twenty (20) calendar days of the date of the request for a hearing and, during or
before its next regular meeting, shall either affirm or reverse the denial and make written findings
supporting its decision.

§ 120.007 SUSPENSION AND REVOCATION
(A) Generally. Any license issued under this chapter may be suspended or revoked at the
discretion of the Issuing Authority for violation of any of the following:
(1) Subsequent knowledge by the city of fraud, misrepresentation or incorrect
statements provided by an applicant on the application form.
(2) Fraud, misrepresentation or false statements made during the course of the
licensed activity.
(3) Subsequent event to which the granting of the license could have been denied
under section 120.005.
(4) Engaging in any prohibited activity as provided under section 120.009.
(B) Notice and Right to Hearing. Prior to revoking or suspending any license, the Issuing
Authority shall provide a license holder with written notice of the alleged violations
and inform the licensee or registrant of his or her right to a hearing on the alleged
violations. Notice shall be delivered in person or by regular mail to the applicant at the
address provided in the application and shall inform the applicant of the applicant's
right to a hearing. If no request for a hearing is received within ten (10) calendar days
following the service of the notice, the Issuing Authority may proceed with the
suspension or revocation. For the purpose of a mailed notice service shall be considered
complete as of the date the notice is placed in the mail. If a hearing is requested within
the stated time frame, a hearing shall be scheduled before the City Council within
twenty (20) calendar days from the date of the request. During or before its next regular
meeting following said hearing, the City Council shall make a decision regarding
suspension or revocation and make written findings supporting said decision.
(C) Emergency. If, in the discretion of the Issuing Authority, imminent harm to the health
or safety of the public may occur if any operations licensed under this chapter are
allowed to continue, the Issuing Authority may immediately suspend a license and
provide notice of the right to hold a subsequent hearing as prescribed in part (B) of this
section. Immediate suspension shall result unless and until the City Council holds a
hearing and makes a subsequent determination pursuant to the process outlined in said
part (B).
§ 120.008 TRANSFERABILITY
No license or registration issued under this chapter -is transferable.
§ 120.009 RESTRICTIONS
No person licensed hereunder to operate as a Mobile Food Vehicle or Mobile Food Vendor shall
conduct business in any of the following manners and in the following areas:

(A) Calling attention to his or her business or the items to be sold by means of blowing any
horn or whistle, ringing any bell, crying out, or by any other noise, so as to be
unreasonably audible.
(B) Obstructing the free flow of traffic, either vehicular or pedestrian, on any street,
sidewalk, alleyway, or other public right-of-way.
(C) Conducting business in a way as to create a threat to the health, safety and welfare of
any specific individual or the general public.
(D) Conducting business before 7 a.m. or after 10 p.m., unless expressly authorized in the
license issued hereunder.
(E) Failing to provide proof of license and identification when requested.
(F) Using the license of another person.
(G) Alleging false or misleading statements about the products being sold, including untrue
statements of endorsement. No Mobile Food Vehicle or Mobile Food Vendor shall
claim to have the endorsement of the City solely based on the City having issued a
license to that person.
(H) Remaining on the property of another when requested to leave or returning to that
property after leaving, without written permission of the property owner.
(I) Otherwise operating their business in any manner that a reasonable person may find
obscene, threatening, intimidating or abusive.
(J) Conducting business in a City park or parking lot unless expressly authorized in the
license issued hereunder.
(K) Operate business less than two thousand (2,000) feet away when there is a permit issued
for another food or similar permitted event, festival, celebration, or tournament at the
same location unless expressly authorized in the license issued hereunder.
(L) Failing to maintain their vehicle or trailer in good repair, order, and neat appearance.
(M) Failing to clean up around their vehicle or trailer at the end of each business day.
(N) Dispensing liquid and or other waste products from their vehicle or trailer on to City,
public, and private property.
(0) Conducting business less than two thousand (2,000) feet away from any food service
business unless expressly authorized by the City.
SECTION 2. In accordance with Section 3.07 of the City Charter, City staff shall have the
following summary printed in the official City newspaper in lieu of the complete ordinance:

On , 2021, the City Council adopted Ordinance 980, entitled "AN
ORDINANCE AMENDING TITLE XI OF THE MOUNDS VIEW CITY CODE TO ADD
A NEW CHAPTER REGULATING MOBILE FOOD VEHICLES AND VENDORS."
The ordinance establishes a new chapter in the City Code, which regulates mobile food
vehicles and mobile food vendors, and requires that such business activities obtain a license
from the city prior to operating. The ordinance also establishes procedural requirements
for issuing, denying, suspending, and revoking such licenses, and it further implements
certain regulations relating to said business activities to further public health, safety, and
welfare. A printed copy of the ordinance is available for inspection during regular business
hours at Mounds View City Hall and is available online at the City's website located at
www.moundsviewmn.org.
SECTION 3. This ordinance shall take effect and be in force 30 days from and after its passage and
publication, in accordance with Section 3.09 of the City Charter.

Background/Discussion:
The City is in the process of rehabilitating streets throughout the City that were not included
in the 2007 Street Rehabilitation Plan.
Area K project area includes Spring Lake Road from County Road I to Hillview Road (map
attached). This section of Spring Lake Road is approximately 1,584 feet in length. The
street has a bituminous pavement surface measuring 28-feet wide average, with no
concrete curb and gutter. Spring Lake Road was originally constructed in 1967 and is a
Minnesota State Assistance Road or MSA street. MSA designations qualify funding from the
State for reconstruction.
Discussion:
The City Council approved Stantec to perform engineering services for the street project at
the April 12, 2021 City Council meeting, Resolution 9420. During the preliminary design
phase and working with the Minnesota Department of Transportation - State Aid, a portion of
Spring Lake Road does not meet the design standards for State Aid and requires a variance
for design. Specifically one existing horizontal design curve, within the Right of Way meets a
design speed of 20 mph. Challenges prompting this variance request include the existing
offset location of the roadway within the Right of Way, existing Right of Way width, proximity
of Spring Lake, proposed typical section, and potential needs for Right of Way acquisition.

Discussion:
As part of the digitization/archival project of public records and data, a significant
amount of steel shelving/racking was no longer needed and has been stored on the
mezzanine at public works for nearly three years.
The New Brighton/Mounds View Rotary Club has a need for a small quantity racking for
their storage unit. There are several members of the club whose businesses are in
Mounds View along with the City Administrator being a member. The club regularly
supports activiees in the community.
Recommendation:
Provide the limited but needed racking to the New Brighton/Mounds View Rotary Club
until such time it is no longer needed upon which they would return the racking to the
City.

Second Addition (Planning Case MU2021-001)
Introduction:
Java Companies is requesting approval of the Final Plat of Anthony Properties Second Addition,
subdividing the parking lot of AMC Classic 15 Mounds View into three lots; (1) Caribou Cabin;
(2) theater parking lot; and (3) additional parking for Moe's.
Discussion:
Anthony Properties was approved as a Planned Unit Development (PUD) in 1998, and
subdivided in 1999. As a PUD, lot sizes and setbacks are customized to the project. This
project requires approvals of; (1) Subdivision; (2) Amendment to the PUD Narrative; and (3)
Development Review of the coffee shop. The PUD Narrative was amended, and the
Development Review was approved on July 12, 2021 (Resolution 9443).
The project subdivides the movie theater's parking lot into three lots:
Lot 1 0.55 acres Caribou Cabin
Lot 2 3.56 acres AMC Classic 15 Mounds View (parking lot)
Lot 3 0.25 acres Moe's (additional parking)
Since the Preliminary Plat was approved (Resolution 9443), changes have been made to the
grading & drainage plan to comply with RCWD requirements. These include raising the
building's low floor elevation 3', thereby adding a 2'-Y retaining wall east of the building; moving
the sidewalk connection to the trail because of the retaining wall; replacing the eastern
stormwater infiltration basin with underground storage; and increasing the western basin (wider
and shallower (2' depth).
The Landscaping Plan (June 11, 2021) needs to be updated to reflect the August 3, 2021 Civil
Plans. The Resolution includes a condition requiring this prior to any land disturbance or
issuance of a Building Permit, and provides Staff discretion in approving the plan
administratively.
Analysis:
Prelim Plat' The Final Plat is consistent with the approved Preliminary Plat, pending
administrative approval of the Landscaping Plan.
Plat Opinion The City Attorney has provided a Plat Opinion. The Owner (AP Mounds View) is
requesting to amend the 1999 Declaration of Easements and Restrictions
regarding maintenance and cost sharing amongst the three property owners.
The Resolution authorizes the Mayor and City Administrator to sign this
amendment, if and when the City Attorney advises to do so.

RESOLUTION APPROVING THE FINAL PLAT OF
ANTHONY PROPERTIES SECOND ADDITION
WHEREAS, the applicant; Mark Krogh (Java Companies), representing the owner; AP
Mounds View, LP (land owner), has applied for approval of the Subdivision of Anthony
Properties Second Addition, 2430 Mounds View Boulevard, legally described as:

Lot 3, Block 1, ANTHONY PROPERTIES ADDITION,
according to the recorded plat thereof, Ramsey County, Minnesota
WHEREAS, the Mounds View City Council approved; (1) the Preliminary Plat; (2)
Amendment to the PUD Narrative of the O'Neil Property to reflect this change; and (3) a
Development Review for Caribou Cabin (Resolution 9443); and,
WHEREAS, the Final Plat has been compared to requirements of the Municipal Code;
Section § 158.024 (Necessary Data for Final Plat), finding it to be satisfactory; and,
NOW, THEREFORE, BE IT RESOLVED, the Mounds View City Council approves
of the Final Plat of ANTHONY PROPERTIES SECOND ADDITION, contingent upon the
following;
1. Prior to land disturbance and issuance of a Building Permit, the Developer shall submit a
revised Landscaping Plan to reflect the Civil Plans dated August 3, 2021. The
Landscaping Plan shall comply with the Mounds View Municipal Code, and comply with
the Development Review (Resolution 9443). Additional plantings may be required at
Staff s discretion. The Landscaping Plan shall be reviewed and approved
administratively.
2. Prior to issuance of a Building Permit, the Developer shall submit a landscape escrow
equal to 150% of the cost of labor and materials, consistent with the approved
Landscaping Plan. Return of the escrow shall be described in the Development
Agreement.
3. Prior to land disturbance, and issuance of a Building Permit the Developer shall comply
with Rice Creek Watershed District (RCWD) regulations, and obtain applicable permits.
4. The Developer shall comply with the City Engineer's letter, dated April 2, 2021.
5. The Developer shall submit the Final Plat to the County Engineer for review, and comply
with all requirements of Ramsey County, per MN Statute §505.03.
6. The Developer shall comply with the Plat Opinion, dated August 19, 2021, including
requirements #2 (Plat Corrections), and #3(c) (amended Declaration, regarding cost
sharing obligations).
7. This Resolution authorizes the Mayor and City Administrator to sign the First Amendment
Resolution 9464

to Declaration of Easements and Restrictions (amendment to the Original Declaration,
Document #3135381), if and when advised to do so by the City Attorney.
8. The Developer shall pay a Park Dedication Fee for Lot 1 equal to 10% of the Estimated
Market Value ($16,771), minus credit for fees paid when platted in 1998 ($2,468), for a
Total fee of $14,303. Park Dedication Fees for Lot 2 (theater parking lot) and Lot 3
(Moe's parking lot) shall be deferred until which time the lots are re -subdivided, for a
more intensive use. The Developer shall pay this fee for Lot 1 prior to the City signing
the Final Plat mylars.
9. The Developer shall agree and sign a Development Agreement with the City of Mounds
View, prior to the City signing the Final Plat mylars.
10. The Developer shall record the Final Plat within six months (January 21, 2022),
consistent with Municipal Code § 158.026(E) and (F).
