HomeMy WebLinkAboutResolution 9497RESOLUTION NO. 9497 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA APPROVING A PLANNED UNIT DEVELOPMENT; AND DEVELOPMENT REVIEW FOR THE VILLAS OF MOUNDS VIEW, 4889, 4943 OLD HIGHWAY 8 (Planning Case MA2021-002) WHEREAS, the Applicant; Peter Worthington (The Villas of Mounds View, Limited Partnership), representing property owners; Mounds View Economic Development Authority (4889 Old Highway 8); and the City of Mounds View (4943 Old Highway 8); has requested approval of a Planned Unit Development; and Development Review. The properties are legally described as: PI D: 17-30-23-14-0002 A strip of land 130 feet wide measured at right angles southwesterly of and adjacent to, a line running southeasterly from a point on the north line of the Southeast Quarter of the Northeast Quarter of Section 17, Township 30 North, Range 23 West, Ramsey County, Minnesota, and 385 feet from the east line of said Section 17, to a point on the south line of the North Half of the Southeast Quarter of the Northeast Quarter of said Section 17, and 250 feet from the east line of said Section 17, and measuring 132.94 feet on the north line of said Southeast Quarter of Northeast Quarter, and 132.92 feet on the south line of said North Half of the Southeast Quarter of the Northeast Quarter, excepting the North 75 feet and the South 75 feet of said tract. WHEREAS, Mounds View City Code §160.135 (Planned Unit Developments, Purpose and Intent) intends for Planned Unit Developments (PUD), to encourage innovation in residential development, higher standards, convenience, preservation and enhancement of desirable site characteristics, efficient use of land, and to provide a more desirable environment than would be possible through the strict application of the zoning and subdivision regulations. The Villas of Mounds.View includes requests for deviations from the City Code, thereby requiring a Planned Unit Development. Such deviations include; Density. The project will include 120-units on 3.8 acres. Mounds View City Code §160.056(2)(c) requires a lot area equal to 2,500 SF per unit for multi -family (no matter the zoning). Example; 120-units requires 6.89- acres (or 67 units if 3.8 acres). Mounds View City Code §160.317(A)(5) allows a 10% density bonus for Residential PUD's. Example: 120-units requires 6.2-acres (or 73 units if 3.8 acres). Mounds View City Code §160.316(F) (Density) states; "The exact density allowable shall be determined by standards agreed upon between the applicant and the city." 2. Parking. The project will include 88 garage stalls, and 114 surface stalls. Mounds View City Code §160.342 (Schedule of Off -Street Parking — Multiple - family dwellings) requires one garage stall per unit (e.g. 120 garage stalls), and Resolution 9497 Page 4 of 7 1.5 surface stalls per unit (e.g. 180 surface parking stalls). 3. Building Setbacks. The project will include building setbacks of 0' (east front yard), and 15' (south side yard). Using standards of the R-4 Multi -family Residential zoning district as a guideline for this PUD (Mounds View City Code §160.055(C); the R-4 district requires a minimum front yard building setback of 30', and a side yard setback of 20' 4. Building Height. The project will include four stories over a parking garage (partially underground). Using standards of the R-4 Multi -family Residential zoning district as a guideline for this PUD (Mounds View City Code §160.056(C)(2), the R-4 district states that no building or structure shall have a height greater than three stories. 5. Sidewalk Setback. The project will include a private sidewalk set back about 1' from the south side yard property line, whereas the Mounds View City Code §160.055(E)(3) requires a minimum 2' setback. WHEREAS, Mounds View City Code §150.054(3) (Development Controls) requires a Development Review for all new construction, and expansions of existing buildings by 10% or greater, and in which the expansion is 10,000 square feet or greater. The Villas will be new construction, and will include a building footprint of 29,720 square feet. A Development Review is required; and, WHEREAS, the Villas of Mounds View is proposed to include a 120-unit apartment building on 3.8 acres (after platting of "Skyline"). The applicant submitted a Sketch Plan, which was reviewed by the Planning Commission on July 21, 2021, and was reviewed by the City Council on July 26, 2021. Plans for the Planned Unit Development and Development Review, together with plans for the Skyline subdivision, were submitted on October 4, 2021, and November 2, 2021, and distributed to applicable staff and agencies for comments. Much of these comments are duplicative of the review conducted for the Preliminary Plat and Final Plat of Skyline (Resolution 9496); and, WHEREAS, the Planning Commission reviewed the request on November 3, 2021, recommending approval (Resolution 1141-21). Consistent with Mounds View City Code 160.045(G) (Finding of Fact), the Commission provided the following Findings (italics); Adequate property control will be established. The PUD will not include any outlots, nor land owned by an Owners Association. Resolution 9497 Page 5 of 7 2. The parking lot's internal circulation has been reviewed by the SBM Fire Department, and access onto Old Highway 8 approved by Ramsey County Public Works. 3. A sufficient amount of Open Space is provided. Mounds View City Code §160.056(B)(d) establishes a guideline that each multiple -family dwelling site shall contain at least 625 square feet of usable open space intended and maintained for either active or passive recreation (or both), and accessible to all residents of the PUD. The project includes 84,035 square feet of non -impervious surfaces (700 square feet per unit). 4. The arrangement of buildings does not unreasonably disturb the privacy or property values of surrounding residential uses (e.g. Townsedge Terrace). 5. The architectural design of the project is compatible with the surrounding area. 6. The drainage and utility system plans are adequate, subject to approval of the City of Mounds View/Rice Creek Watershed District (joint application/review for watershed permit). 7. The development schedule, protecting the public's interest. 8. The development is in compliance with Mounds View City Code §§154 (Floodplain Management), 155 (Surface Water Drainage Management and Development Control), 156 (Construction Site and Land Disturbance Runoff Control), 157 (Storm Drainage Systems), 158 (Wetland Zoning), pending approvals of subsequent permits (with conditions). 9. Dwelling Unit and Accessory Use requirements are in compliance as a Residential Planned Unit Development WHEREAS, consistent with Mounds View City Code §160.032 (PUD; Special Procedures); and §160.450(I) (Public Hearing); a Public Hearing was held November 22, 2021. Notice was published by the Shoreview Press on November 9, 2021, and mailed to property owners within 350' of the subject property, and to property owners along Mustang Drive, Mustang Circle, and Townedge Terrace (manufactured home park); and, NOW, THEREFORE BE IT RESOLVED THAT, based upon the Planning Commission's Findings and recommendations, the Staff Report, and in public testimony, approves the Planned Unit Development, and Development Review of The Villas of Mounds View, with the following conditions: The City's review of construction plans is ongoing, and will continue through its review for construction permits. The City reserves the right to require changes to construction plans, for compliance with City regulations. Resolution 9497 Page 6 of 7 2. Construction shall be consistent with the plan set, dated October 4, 2021, as may be amended upon City Staff's approval. Upon City Council approval of this Resolution, it is the intent that the City prepares a PUD Narrative, memorializing the allowable City Code deviations, as described in this Resolution. 3. The Developer shall obtain a Watershed Permit from the City, prior to any construction. The Watershed Permit shall be inclusive of a Wetland Alteration Permit. 4. The Developer shall submit an exterior lighting plan, consistent with City Code §160.031 (Glare). The Plan may be reviewed and approved administratively, as part of the Building Permit plan review. 5. Vinyl Lap Siding shall be (PlyGem Mastic Carvedwood 44 (or similar), as presented at the November 3, 2021 Planning Commission meeting, and consistent with architectural plans dated October 4, 2021. 6. Any monument signage (if located near the shared driveway entrance) shall accommodate off -premise signage of any user of the shared driveway. All signage shall otherwise comply with City Code regulations for the R-4 zoning district. 7. The Landscape Plan, dated October 4, 2021, shall be revised to include a pollinator seed mix (NRCS 327) in areas identified for "dry short prairie seed mix". The quantity and size of plantings shall comply with City Code. 8. The Landscape Plan, dated October 4, 2021, shall be revised, based on the review/recommendations by the City Forester. The City may require additional landscaping, specifically in the front yard. 9. The Landscape Plan, dated October 4, 2021, shall be revised such that the park bench and surrounding landscaping in the southwest corner of Lot 1, is entirely on Lot 1 (is shown to be encroaching onto Lot 2). 10. The Landscape Plan (and related), dated October 4, 2021, shall be revised to include a picnic area (e.g. pergola, patio, or deck, with table/seating area, and grilling area of a sufficient size). 11. Prior to issuance of a Building Permit, the Developer shall submit a Landscape Escrow equal to 150% of the cost of materials and labor. The City shall inspect landscape mortality on or about one year after installation, and shall return a proportionate amount of the escrow based on mortality. Dead or diseased landscaping shall be replaced by the Developer, and inspected one year after installation, and the remaining escrow refunded, based on mortality. Resolution 9497 Page 7 of 7 12. The Developer shall agree to a Development Agreement, consistent with Mounds View City Code §160.318(C)(4)(d) (PUD Agreement). 13. Prior to issuing a Building Permit, the developer shall reimburse the City for any and all consulting costs, including the City Engineer's review, and City Attorney's review. 14. Construction shall commence within one year of this PUD approval (e.g. by November 22, 2022), unless an extension is granted by the City Council, consistent with Mounds View City Code §160.0318(D)(6) (Limitation of final plan approval).
