Item Title/Subject: Sign Ordinance (Dynamic Displays)
Introduction:
Dynamic Displays (e.g. digital signs) are permitted in the B2, B3, B4, and PUD zoning districts,
and conditionally permitted (CUP) in residential districts for churches and non-commercial uses.
They are not permitted in the Industrial district.
In 2021 Bauer Welding, 2159 Mustang Drive (Industrial zoning district), applied for a ground
sign permit with a dynamic display, which was denied. Albright Sign Company indicated its
intent to apply for a City Code Text Amendment to permit dynamic displays in Industrial districts.
Discussion:
Dynamic Display regulations came about in 2008 as many static billboards around the Twin
Cities were replaced with digital billboards. Staff skimmed through City Council minutes finding
no discussions as to why they are not permitted in the Industrial district. The Industrial district
includes Central Sandblasting, and properties along Mustang Drive and Mustang Circle.
As the technology has advanced, dynamic displays have become more affordable and popular.
In the past couple of years, dynamic displays have been installed at The Station, Holiday,
McDonalds, Taco Bell, Popeye’s, Subway, and Tommy’s Express Car Wash, and soon The
Bear Lot, and Caribou Cabin.
In the early days (2008), it was anticipated that dynamic displays would distract motorists and
offend residents. To Staff’s memory, there have been no complaints.

Staff is introducing this item in anticipation of a Text Amendment application. Conversely, the
City Council may direct Staff to prepare an amendment without waiting for an application.

Item Title/Subject: Outdoor Vending Kiosks
Discussion:
Staff received an inquiry from ByBox regarding locating an outdoor kiosk at a local business.
ByBox is a business-to-business outdoor locker, in which venders deliver goods to the locker to
be picked up by customers, similar to an Amazon Hub Locker.
This type of kiosk is not permitted. Outdoor Vending Kiosks are a permitted accessory use in
the B1, B2, B3, B4, and PUD zoning districts, limited to the rental of movies and video games
(e.g. redbox), and located at retail stores, gas stations, and restaurants.1 Outdoor redbox’s are
located at Holiday and Walgreens.
The City Code was amended in 2012 to allow Outdoor Vending Kiosks. At that time, the City
Council and Planning Commission discussions focused on if they should be a permitted use vs.
conditionally permitted (CUP), and concerns about vandalism and clutter. Staff is not aware of
any problems with redbox kiosks. There has been vandalism (attempted theft) to other types of
kiosks containing cash, such as ATM’s and car wash code kiosks.
ByBox intends to apply for a Text Amendment once they’ve worked out an agreement with the
business owner. The kiosk measures 5’ X 2.5’ X 7’, and would be bolted to concrete outside the
business, similar to a propane tank locker.

Recommendation:
None. Staff is introducing this topic in anticipation of a Text Amendment application. By
introducing the topic prior to an application, it can speed up the process by a month. If the
Council has strong opinions for or against this use, making those opinions known now may save
the applicant and Staff considerable time.
