Monday, August 22, 2022, City Council Agenda. 22 23 Mayor Mueller requested the agenda be amended to have Item 7A, Special Order of Business — 24 Swearing in of Officer Nina Katzenmaier addressed after approval of the agenda. 25 26 MOTION/SECOND: Hull/Meehlhause. To Approve the Monday, August 22, 2022, agenda as 27 amended. 28 29 A roll call vote was taken. 30 31 Ayes — 5 Nays — 0 Motion carried. 32 33 7. SPECIAL ORDER OF BUSINESS 34 A. Swearing in of Officer Nina Katzenmaier. 35 36 Police Chief Harder introduced newly hired Police Officer Nina Katzenmaier to the City Council. 37 He administered the Oath of Office to Officer Katzenmaier and welcomed her to the Mounds View 38 Police Department. A round of applause was offered by all in attendance. 39 40 Mayor Mueller recessed the City Council meeting to the Economic Development Authority 41 meeting at 6:42 p.m. 42 43 Mayor Mueller reconvened the City Council meeting from the Economic Development Authority 44 meeting at 7:39 p.m. 45 Mounds View City Council Regular Meeting August 22, 2022 Page 2 1 7. SPECIAL ORDER OF BUSINESS - CONTINUED 2 B. 2°d Quarter PD Report — Police Chief Harder. 3 4 Police Chief Harder reviewed the Mounds View Police Department's second quarter report with 5 the Council. He stated drug arrests were down, but noted VCET was still active in the community. 6 He explained DUI offenses were up along with theft offenses. He stated this was not just a Mounds 7 View issue, but rather theft was up 30% throughout the entire metro area. He encouraged the 8 residents of Mounds View to register their catalytic convertors with the Mounds View Police 9 Department. 10 11 Mayor Mueller stated she lives on Groveland Road between Mounds View Boulevard and 85tn 12 She discussed how the construction traffic along Groveland Road was adversely impacting the 13 residents in her neighborhood. She requested the Mounds View Police Department place extra 14 enforcement along Groveland Road. Police Chief Harder discussed how his officers were 15 distributed throughout the City to address crime and speeding. 16 17 Council Member Meehlhause thanked the Mounds View Police Department for their tremendous 18 efforts on behalf of the community, and Chief Harder for his leadership. 19 20 C. Jill Brown and Troy Olsen — North Metro Mayors. 21 22 Jill Brown, Executive Director of the North Metro Mayors, introduced herself to the City Council. 23 She thanked the Council for being a member of the North Metro Mayors organization. She 24 commented on the great work this organization has done by pulling together the mayors in the 25 North Metro. 26 27 Troy Olsen, North Metro Mayors representative, introduced himself to the Council noting he was 28 a lobbyist for North Metro Mayors. He discussed the roadway projects North Metro Mayors was 29 lobbying for at this time. He commented further on the candidate forums that are hosted by North 30 Metro Mayors. 31 32 Mayor Mueller thanked Ms. Brown and Mr. Olsen for their presentation and for working 33 effectively on behalf of the City of Mounds View. 34 35 Mayor Mueller recommended the Council address Item 6 — Public Comment next. 36 37 6. PUBLIC COMMENT 38 39 Sheryl Hoye, 7750 Long Lake Road, discussed the rerouting of Bus Route 25. She explained she 40 received a letter from Metro Transit letting her know that a bus would now be driving past her 41 home. She highly opposed this. She questioned how many of the Councilmembers lived on a bus 42 route. 43 44 Mayor Mueller reported she lives on a bus route and noted this has not been a problem. 45 46 Ms. Hoye asked if Mounds View was incentivized in any way by having buses. Mounds View City Council Regular Meeting August 22, 2022 Page 3 1 2 Mayor Mueller reported the City was blessed to have some form of transit in the community. 3 4 Ms. Hoye inquired if the City had ridership numbers for the Metro Transit buses in Mounds View. 5 6 Mayor Mueller stated she did not have any of this information. 7 8 Ms. Hoye asked what the average daily traffic numbers were for Long Lake Road. 9 10 Mayor Mueller explained she was uncertain but noted Groveland Road had 3500 cars per day. 11 12 Ms. Hoye reported the 2020 numbers show there are 2200 cars per day using Long Lake Road. 13 She expressed frustration with the number of City lawn mowers that went up and down her street 14 every day. She stated she did not want any more traffic on her street. She explained she works 15 from home four days a week and was very distracted by the number of vehicles using Long Lake 16 Road on a daily basis. 17 18 City Administrator Zikmund encouraged Ms. Hoye to speak with Metro Transit because the City 19 does not control their bus routes. He explained the City Council had asked for more bus service in 20 the community, but had no control over where these routes went. He indicated he could forward a 21 link to this meeting onto Metro Transit to make them aware of the residents' comments and 22 concerns with the new bus routes. 23 24 Mayor Mueller reported the City has been requesting more public transit services for the past 16 25 years. 26 27 Ms. Hoye indicated she supported the bus routes, but questioned why the routes were being 28 rerouted, given the fact ridership numbers were down. 29 30 James Kavanaugh, 7956 Red Oak Drive, discussed the letter he received from the MTC regarding 31 the bus reroute. He explained he was caught short and unawares of this change and it was 32 negatively impacting his neighborhood. He understood the Council requested more transportation 33 and that this matter had been discussed with the Council for some time. He expressed frustration 34 with this situation noting he was a 51 year resident of Mounds View and noted many of his 35 neighbors were also long time residents in the community. He questioned if a transportation or 36 traffic study was completed for the bus reroute. 37 38 Mayor Mueller stated to her knowledge a transportation or traffic study was not completed by the 39 City. She reiterated that the changes were made by Metro Transit and not the City of Mounds 40 View. She encouraged Mr. Kavanaugh to speak directly with Metro Transit. 41 42 Mr. Kavanaugh explained he had no problem with transportation running through the community 43 so long as it is a win -win situation. He stated at this time the residents living on Red Oak Drive 44 and Quincy Street were losers in this situation. 45 Mounds View City Council Regular Meeting August 22, 2022 Page 4 1 Council Member Cermak reported she lives on Hillview Road and has lived in this community for 2 the past 35 years. She understood residents did not want this, but noted for the past 35 years, she 3 has had to walk over five miles to get to public transportation. She questioned why this situation 4 was bringing about such animosity from residents. 5 6 Mr. Kavanaugh stated this was a matter of safety. He reported Long Lake Road was over 45 feet 7 wide and Red Oak Drive was a 30 foot street. 8 9 Jim Healy, 7960 Red Oak Drive, noted he did call Met Council today. He reported he spoke with 10 Nicolas, a customer relation person. He understood the Council requested more buses in the 11 community without understanding what the actual usage was in the community. He stated letter 12 he received states the bus route was being rerouted to get closer to apartment buildings, mobile 13 homes, jobs and community resources. He was of the opinion Long Lake Road was a better fit for 14 these categories than Red Oak Drive. 15 16 David Moredock, 7629 Noah Drive, addressed the Council regarding the unsafe conditions for the 17 portable soccer goals at Oakwood Park. He reported portable soccer goals can tip over easily and 18 should be anchored. He stated he contacted the City last Wednesday regarding this matter and 19 nothing has been done to rectify this situation. He requested the City properly secure and anchor 20 these goals. He also requested the City add soccer nets to the permanent goals at Silver View Park. 21 He stated after numerous conversations with the City he learned that his workorder from July 22 would not be completed. He questioned why the City was not allowing residents to use a public 23 park for its intended use. He discussed how popular soccer was in the community noting pick up 24 soccer games were crucial for some athletes. He encouraged the City to reconsider his request and 25 to place soccer nets on the permanent goals at Silver View Park. 26 27 Joy Dick, 8059 Red Oak Drive, stated she has run a licensed daycare out of her home for the past 28 33 years. She reported it was a chore getting in and out of her driveway during rush hour because 29 her road was narrow. She commented on how dangerous it would be if a bus route were now 30 running on Red Oak Drive. She encouraged the City or Met Council to review the ridership 31 numbers and to further consider if this route is necessary. She suggested the City think about the 32 safety of the neighborhood. She reported she wrote a letter to the MTC and explained she would 33 like to have a neighborhood meeting with the MTC. 34 35 Susan Mitchell, 5493 Quincy Street, stated she has lived in her home for the past 37 years, where 36 she raised her eight children who all attended Pinewood Elementary School. She explained she 37 lived at a busy intersection and served as a crossing guard for Pinewood Elementary. She stated 38 she was worried about how the MTC buses would impact the safety of the children trying to get 39 to the elementary school. She reported children come to the school to play all summer and she 40 feared for their safety. She discussed how busy County Road I was already with police and 41 ambulances. She expressed frustration with how the recent article that was printed in the Mounds 42 View Matters and questioned if the new bus routes were due to the City or Metro Transit. She 43 indicated she paid very high taxes for her home and she stated she would like her voice to be heard. 44 45 Charles Brost, 7959 Red Oak Drive, stated Red Oak Drive was repaved four years ago and was 46 already cracking. He discussed how the amount of foot traffic has increased along his roadway Mounds View City Council Regular Meeting August 22, 2022 Page 5 1 since COVID and noted there were no sidewalks. He feared how buses would be able to fit along 2 this roadway given the number of cars parked along the street and pedestrians using it. He 3 anticipated that all of the extra bus traffic would further deteriorate the roadway and would be a 4 safety hazard. 5 6 Tom Pick, 2725 Sherwood Road, reviewed the fall 2022 Mounds View Matters article that has 7 everyone concerned stating it reads: at the request of the City Council MTC is considering 8 rerouting 25 to serve eastern portions of the City where there are more apartments and 9 manufactured homes. He commented he was not anti -transit or anti -bus. He stated when he was 10 younger he lived in an apartment and rode the bus. He reported it made sense to run buses by 11 apartments but noted there were no apartments along Red Oak Drive. He explained Red Oak Drive 12 was a narrow residential road. He believed it did not make sense to run a City bus down Red Oak 13 Drive for ridership purposes, or for safety purposes. He encouraged the Council to do what they 14 could to speak with the MTC to reconsider the rerouting of bus route 25. 15 16 City Administrator Zikmund reported the MTC would listen to this meeting and would make 17 adjustments. 18 19 Barb Peterson, 8125 Red Oak Drive, stated she found it difficult that the City Council had not seen 20 article that was printed in the Mound View Matters. She reported she received her copy of the 21 City's newsletter last week. She then reviewed a copy of the MTC bus schedule and noted she 22 would now have 31 bus trips going down her very narrow street. She explained Red Oak Drive 23 was not built for buses and has no sidewalks. She discussed how the cut outs along Red Oak Drive 24 were put in place for traffic calming and stated parking was allowed on only one side of the street. 25 She recommended the bus route be moved back to its original route for the safety of her 26 neighborhood. 27 28 Catherine Harrington, 2735 Sherwood Road, explained she loved Mounds View and she loves 29 meeting her neighbors. She commented on how many of her neighbors she has met being outside 30 with neighbors walking by. She anticipated she would not be meeting with her neighbors if the 31 bus routes continued because pedestrian safety would be impacted. She discussed the number of 32 children walking in her neighborhood to get to the park. She encouraged the Council to consider 33 the sense of community that would be lost if the bus routes continue through her neighborhood. 34 35 Robert Eickstadt, 8136 Red Oak Drive, stated he believed the buses on Red Oak Drive was 36 primarily as safety concern. He explained when he was walking along Red Oak Drive, the MTC 37 buses were passing within 12 inches of him. He reported there was not a green buffer and a 38 sidewalk on his roadway, but rather pedestrians were walking on the street. He indicated the 39 residents in his neighborhood would like to see the traffic levels reduced and not increased. He 40 requested the "Local Traffic Only" sign be posted in the neighborhood again. He discussed the 41 high level of truck traffic that used Red Oak Drive and noted how much of this traffic was passing 42 through the neighborhood from US 10 to County Road 10. He believed this problem had to be 43 addressed by the City. He ended his comments by stating the rerouting of bus 25 was a safety 44 concern and should be reconsidered by the MTC. 45 Mounds View City Council Regular Meeting August 22, 2022 Page 6 1 Jerry Peterson, 8125 Red Oak Drive, stated he agreed with all of the issues that have been brought 2 up. He explained Red Oak Drive was made narrow on purpose, to address the traffic levels on this 3 roadway. He commented on how narrow Red Oak Drive was and stated he believed this was 4 positively helping with the speed of traffic. He reiterated that Red Oak Drive does not have a 5 sidewalk, which meant pedestrians were now walking right next to the MTC buses. He discussed 6 how if the 825 express route were reinstated, there would be even more buses along his street. He 7 encouraged the Council and the MTC to reconsider the route for buses 25 and 825 both for 8 ridership and safety purposes. 9 10 Steven Foust, 8136 Red Oak Drive, echoed the safety concerns that were voiced by his neighbors. 11 He explained he walked along Red Oak Drive a quite a bit with his children and stated he was 12 concerned for the safety of his children. 13 14 Melissa Foust, 8136 Red Oak Drive, commented there are a lot of children in her neighborhood. 15 She reported she used to commute downtown every day for work and she took a bus. She explained 16 she now works from home as do many other individuals post-COVID. She suggested the City 17 speak with MTC regarding ridership numbers to see if the bus routes through Mounds View were 18 necessary. She discussed how unsafe it was to walk down Red Oak Drive with her family given 19 the fact there were no sidewalks and a high level of traffic. She reported the MTC buses would 20 only compound this concern. 21 22 Rebecca Scholl, 2467 Hillview Road, encouraged the residents in attendance to trust the process. 23 She noted she does not live on Red Oak Drive. She reported the letter that was mailed out was sent 24 in good faith in order to allow the residents to give their opinion. She stated she agreed with the 25 residents that were in attendance and she did not want to see additional buses on Red Oak Drive. 26 She indicated there were residents in Mounds View that needed public transportation. She 27 explained she was all for public transportation and encouraged the residents in attendance to trust 28 the process and she anticipated after the MTC views this meeting, the buses will not be going down 29 Red Oak Drive. 30 31 Sherry Gunn, 5485 Landmark Circle, thanked the City Council for a wonderful Festival in the Park 32 weekend. She thanked all of the volunteers that made the event possible. She believed it was the 33 best Festival in a long, long time, noting the parade was great and the weather was perfect. 34 35 Mayor Mueller thanked all of the residents in attendance for coming forward and voicing their 36 concerns. She noted this meeting would be passed along to the MTC for their viewing and 37 consideration. 38 39 5. CONSENT AGENDA 40 A. Approval of Minutes: August 8, 2022. 41 B. COUNCIL BUSINESS 4 A. Public Hearing: Resolution 9619, Approval of a Chicken -Keeping License for 5 Becky Whitehead at 5209 Jeffery Drive. 6 7 City Administrator Zikmund requested the Council consider a chicken -keeping license for Becky 8 Whitehead at 5209 Jeffery Drive. He explained staff received one call and one email opposing the 9 request. He reported Ms. Whitehead had submitted all of the necessary paperwork to the City and 10 would be meeting the City's conditions. 11 12 Becky Whitehead, 5209 Jeffery Drive, stated she would like to have chickens in order to allow her 13 children to grow up more connected to their food. She discussed how the chickens would help her 14 family eliminate food waste, which would be better for the environment. 15 16 Mayor Mueller opened the public hearing at 8:57 p.m. 17 18 Teresa Lexcen, 5229 Jeffery Drive, noted she has been a homeowner in Mounds View for the past 19 41 years and she does not support her neighbors having chickens given the size of the small lots 20 in the community. She stated she does not want to deal with the smell or the noise. She discussed 21 how the chickens would draw coyotes and fox into the neighborhood. 22 23 Tiffany Alexander-Susens, 5209 O'Connell, stated she supported the Whitehead family having 24 chickens, as they would also eat ticks and other pests. She anticipated there would not be much 25 noise from the hens and she wanted to offer her support to the request. 26 27 Hearing no further public input, Mayor Mueller closed the public hearing at 9:02 p.m. 28 29 Council Member Meehlhause asked how many chickens the Whitehead family would be keeping. 30 Ms. Whitehead stated she would be keeping four chickens. 31 32 Council Member Hull inquired if staff has received an abundance of complaints regarding the eight 33 individuals who have chickens in the City. City Administrator Zikmund reported he was unaware 34 of any complaints. 35 36 Mayor Mueller stated she moved to the community 47 years ago and chickens were allowed in 37 Mounds View. She reported this changed when her son was in elementary school. She indicated 38 she was not aware of any complaints, nor has anyone called her with complaints regarding 39 chickens. 40 41 MOTION/SECOND: Hull/Cermak. Resolution 9622, Authorize a Recruitment Process for the Recreation 2 Coordinator Position and Change the Employment Status of Darryl 3 Thibodeaux from Full -Time to Part -Time. 4 5 City Administrator Zikmund requested the Council authorize the recruitment process for the 6 Recreation Coordinator Position and change the employment status of Darryl Thibodeaux from 7 full-time to part-time. He explained Mr. Thibodeaux would be leaving the City to pursue a dream 8 but would be able to work up to 15 hours per week for the City going forward. He commented 9 further on the staffing change and requested the Council authorize the recruitment process for the 10 Recreation Coordinator Position. 11 12 MOTION/SECOND: Meehlhause/Hull. To Waive the Reading and Adopt Resolution 9622, 13 Authorize a Recruitment Process for the Recreation Coordinator Position and Change the 14 Employment Status of Darryl Thibodeaux from Full -Time to Part -Time. 15 16 A roll call vote was taken. 17 18 Ayes — 5 Nays — 0 Motion carried. 19 20 9. REPORTS 21 A. Reports of Mayor and Council. 22 23 Council Member Hull commented on a question he received regarding milkweed. City 24 Administrator Zikmund explained the City could not ban milkweed and noted this information 25 would be posted on the City's website. 26 27 Mayor Mueller questioned why the City would want to ban milkweed when this plant was 28 necessary for monarch butterflies. City Administrator Zikmund reported there were over 100 29 varieties of milkweed now and some were extremely invasive. 30 31 Council Member Hull stated Festival in the Park was a great event and he enjoyed bringing his 32 grandchildren to the event. 33 34 Council Member Meehlhause reported on behalf of the Lions Club he would like to thank the 35 residents of Mounds View for their support at Festival in the Park. He thanked Public Works 36 Director Peterson and the entire Public Works Department for all of his efforts to make Festival in 37 the Park possible. 38 39 Council Member Cermak thanked all of the residents who attended Festival in the Park and 40 participated in the Mounds View Police Foundation sponsored children's games. She stated she 41 appreciated all of the youth from the NYFS Diversion program that helped on Saturday. 42 43 Council Member Bergeron thanked all of the volunteers that made Festival in the Park possible. 44 He stated he was sad to miss it, noting he recently came down with COVID. 45 Mounds View City Council Regular Meeting August 22, 2022 Page 9 1 Mayor Mueller thanked all of the residents that hosted or participated in a Night to Unite party on 2 Tuesday, August 2. 3 4 Mayor Mueller invited residents to visit with Ernie and Jeannette LaPort who live at the corner of 5 Arden and Groveland Road. She explained Ernie and Jeannette would be hosting their last story 6 time of the summer on Tuesday, August 23 at 10:00 a.m. 7 8 Mayor Mueller encouraged the MTC to hear the concerns that were voiced at this meeting 9 regarding the bus traffic along Red Oak Drive. 10 11 Mayor Mueller thanked Council Member Cermak for all of her years volunteering on the Festival 12 in the Park Committee. She explained this committee has a strong foundation and put on another 13 wonderful event this year. She stated she enjoyed seeing everyone come out to Festival in the Park. 14 She reported the food was amazing this year. She welcomed the Casina Kitchen to the City of 15 Mounds View, which was adjacent to the Filipino Village. She encouraged residents to try out this 16 new restaurant in the community. 17 18 Mayor Mueller commented on the Festival in the Park parade and thanked the Ramsey County 19 Sheriff's Department for participating in this event. 20 21 B. Reports of Staff. 22 23 Finance Director Beer explained last week he began his strength finding training. He reported he 24 continues to work on the electronic timesheets and he was making progress on getting the new 25 accounting software operational. 26 27 City Administrator Zikmund stated K9 Officer Ace had his first apprehension over the weekend. 28 29 City Administrator Zikmund commented the City received 10 applications for the two open police 30 officer positions. He indicated the City would be looking to replace four officers by the end of the 31 year. 32 33 City Administrator Zikmund reported he has had a number of exchanges with Mr. Moredock 34 regarding the soccer nets. He stated there was a miscommunication between him and Public 35 Works. He noted he apologized to Mr. Moredock for the miscommunication. 36 37 C. This resolution created a standardized hiring process for all seasonal positions. Discussion: City Council approved the hiring of seasonal Ice Rink Attendants beginning in 2020 after the Parks and Recreation Department was formed. Resolution 5546 requires the approval of seasonal staff take place six (6) weeks prior to the actual hiring. Staff is requesting to fill up to 10 part-time seasonal Ice Rink Attendant positions. Maintain and repair park and recreation facilities and equipment involving playgrounds, baseball and softball fields, tennis, basketball, and volleyball courts, athletic and security lighting, ice hockey and staking rinks, drinking fountains, fencing, site amenities, and other park equipment. • Operate, maintain, and repair the park and grounds irrigation systems including setting clocks and controllers, adjusting and replacing broken heads and valves, and repairing irrigation line breaks. • Perform janitorial and light building maintenance duties in park buildings and shelters including cleaning and sanitizing restrooms, stocking supplies, picking up litter, emptying trash containers, replacing light bulbs, painting, washing windows, and cleaning outdoor furniture. • Participate in inspecting and diagnosing park and recreation facilities and equipment for unsafe and hazardous conditions. Take notice of park activities during work assignments that may cause harm to the public or park facilities. Remove graffiti and repair damage from acts of vandalism. Forestry: • Completes tree planting and re -forestation of City property as assigned. Thorough knowledge of procedures, polices, and practices of tree planting maintenance (wrapping, guying, watering, mulching, weeding), pruning, trimming, disease inspection removal requirements. • Monitors and inspects diseased and hazardous trees in the community on both public and private property. Meeting Date: September 12, 2022 Type of Business: Council Business City Administrator Review: To: Honorable Mayor and City Council From: Mark Beer, Finance Director Item Title/Subject: Resolution 9629 Authorizing Certification of the Preliminary General Fund Budget and Preliminary Property Tax Levy for Fiscal Year 2023 State law requires that the City certify a preliminary General Fund Budget and preliminary property tax levy to Ramsey County by September 30. The City Council reviewed the General Fund budget at the May Special work session and will review the budget again before final approval in December. The Charter limits the levy increase to 6.5% with a simple majority or up to 9% with a 4/5ths super majority unless otherwise excluded (referendums and debt service/capital levies are excluded from the charter limit). (Inflation is 8.5% for the 12 months ending in July) Each 1% levy increase is an additional $61,789. The state has certified Local Government Aid (LGA) for 2023 at $856,860. The Strategic Plan adopted by the City Council calls for less dependence on LGA. LGA is included in the General Fund budget at 90% of the certified amount. The Strategic Plan also calls for reducing dependence on the Levy Reduction Assigned Fund balance by 5-8% per year. Prior budgets have used $250,000, we used $238,000 for 2022 to balance the budget. For 2023, $232,000 is proposed and $226,000 for 2024 is proposed to meet the goal of the Strategic Plan. Unassigned fund balance was $5,037,325 at December 31, 2021 and represents 49.4% of draft 2023 budgeted expenditures and transfers out. The Assigned Levy Reduction fund balance was $4,835,391 at December 31, 2021 and will be approximately $4,627,101 at December 31, 2022. Staff is recommending that the preliminary levy be set at 6.5% to provide flexibility for the Council in case there are additional unforeseen challenges between now and final adoption. The goal is to have the smallest levy increase needed. The base General Fund levy would be $5,365,207 and special levies for Fire Debt Service of $127,164, 2004 police personnel referendum of $255,000, 2017 police personnel referendum of $130,000, PERA rate increase special levy of $39,145 for a total General Fund levy of $5,916,516. A debt service levy for the 2017A PW Facility Debt Service is $413,983, a decrease of $2,783 over 2022. A base levy for the Street Improvement fund of $150,000 will be continued for 2023. The EDA levy of $100,000 is no increase over 2022. The total of all base and special levies proposed is $6,580,499, 6.50% increase over 2022. Once this amount is set, the levy cannot be increased but can be lowered. The final levy will be adopted on or about December 12, 2022 along with the General Fund budget and all other City budgets. The EDA levy will be set in a separate resolution. The draft General Fund budget for preliminary approval is $10,193,540. This amount is subject to change as the Council gets additional information and provides additional direction to staff before final approval in December. Respectfully submitted, Mark Beer, Finance Director The Mounds View Vision A Thriving Desirable Community RESOLUTION NO. 9629 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA Resolution Authorizing Certification of the Preliminary General Fund Budget and Preliminary Property Tax Levy for Fiscal Year 2023 WHEREAS, current state statute requires cities to certify a preliminary budget and tax levy to the county auditor; and WHEREAS, guidelines established by the Commissioner of Revenue require certification to occur on or before September 30, 2022; and WHEREAS, the Department of Revenue has certified the amount of Local Government Aid payable to the City in 2023; and WHEREAS, the City Council has elected to have a preliminary levy increase of 6.50% and; WHEREAS, a referendum levy passed in 2004 for two additional police officers is set at $255,000 and a referendum levy passed in 2017 for one police officer is set at $130,000; and WHEREAS, a street levy of $150,000 will be continued to improve streets that were not part of the Street Improvement Program and to maintain the streets that were recently improved. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View that the preliminary expenditure budget for the General Fund for fiscal year 2023 is $10,193,540. NOW THEREFORE, BE IT FURTHER RESOLVED that the proposed 2023 base property tax levy is $5,362,424 and $150,000 and the proposed 2023 special levies are $965,292 for a total net property tax levy of $6,580,499. These tax increment revenues were discontinued as required by state statute when the districts were decertified. This left the City with limited resources to continue existing business outreach, marketing, advertising, small scale incentives, property acquisitions, professional services, and staff training and development. The EDA established a levy of $100,000 in 2017 for these purposes. There is no proposed increase in this amount for 2023. The City's EDA is requesting that the City levy on behalf of the EDA $100,000 to support the above activities within the City of Mounds View. The EDA has been authorized with joint powers of an Economic Development Authority (EDA) and a Housing and Redevelopment Authority (HRA). The EDA may choose to establish either an EDA levy or an HRA levy, or both, to fund the above activities. The proposed EDA budget of $254,567 is attached, there may be changes as additional information becomes available. Once this amount is set, the levy cannot be increased but can be lowered. A Truth -In -Taxation meeting will be held December 5, 2022 at 6pm at City Hall or via remote meeting. The final levy will be adopted on or about December 12, 2022. Meeting Date September 12, 2022 Type of Business: Council Business Administrator review: To: Honorable Mayor and City Council From: Scott J Riggs, Kennedy & Graven, City Attorney Item Title/Subject: Resolution 9631 Approving the Suspension of License for a Massage Parlor Background The City of Mounds View issued an individual therapeutic massage license to Eric Roy Rautio and an enterprise therapeutic massage license to Eric Roy Massages LLC on December 29th, 2021. Mr. Rautio has been running his business, Eric Roy Massages LLC, from his home located at 8373 Groveland Court, Mounds View, MN for several years. On August 26, 2022 the City Administrator Nyle Zikmund received an email from an attorney representing a former client of Mr. Rautio, requesting that the City investigate and revoke Mr. Rautio's massage therapy license. In an attached memorandum, the attorney stated that her client was receiving a massage from Mr. Rautio when he digitally penetrated her vagina without her consent. After she asked him to stop, Mr. Rautio informed the client that he was using a "Yoni Massage" technique (yoni is a Sanskrit word that connotes female sexual organs). A criminal complaint charging Mr. Rautio with 1 count of criminal sexual conduct in the third degree stemming from this incident was filed by the Ramsey Count Attorney's office on May 27, 2022. Discussion Under Mounds View City Ordinance 114.014, the City Council may suspend or revoke a therapeutic massage license subsequent to a public hearing, when the licensee violates a provision of Subchapter 114. City Ordinance 114.001 (E) prohibits a therapist from intentionally massaging, or offering to massage, a client's genitalia. The alleged behavior Mr. Rautio engaged in is a clear violation of this ordinance. Further, this alleged behavior creates serious safety concerns for the City if Mr. Rautio were to continue offering massages to clients. Notice of a public hearing to take place during the September 12, 2022, Mounds View City Council meeting was personally served on Mr. Rautio, sent to him via U.S. Mail, and emailed to the email address provided on his license application on September 8th, 2022. In February of 2022, the Client had been a client of Eric Roy Massage LLC for about one year and had received multiple massages from the Licensee at the Business. 2. On February 19, 2022 the Client arrived at the Business for a pre -scheduled massage to be given by the Licensee. 3. During the massage, the Licensee asked the Client if he could massage below her naval, and the Client consented. 4. The Licensee began to massage the Client's groin area and during the massage digitally penetrated the Client's vagina. DOC SOPEN\MU 125\65\822107.v3-9/8/22 5. The Client told the Licensee to stop, and the Licensee apologized and informed her that he was attempting to use a "Yoni massage" technique. WHEREAS, Section 114.001 (E) of the City Code prohibits massage therapists from intentionally massaging or offering to massage the "mons veneris, vulva, or vaginal area of a person"; and WHEREAS, On May 27, 2022 the Licensee was formally charged in Ramsey County District Court with Criminal Sexual Conduct in the 3rd degree -Penetration -Prohibited occupational relationship, a felony, based on the aforementioned conduct; and WHEREAS, in light of the events outlined above, City staff initiated formal proceedings to suspend both the Business' enterprise therapeutic massage license and the Licensee's individual therapeutic massage license and scheduled a suspension hearing for September 12, 2022 during the regular Mounds View City Council meeting; and WHEREAS, on September 8, 2022, the city attorney mailed written notice of the suspension hearing to the Licensee via regular United States mail and personally served the Licensee with notice of the suspension hearing to his home address; and WHEREAS, on September 8, 2022, the city attorney emailed written notice of the suspension hearing to the Licensee at the email address provided on the Licensee's most recent renewal application; and WHEREAS, the City Council held a formal suspension hearing regarding the Licensee's city - issued massage licenses during its September 12th regular meeting whereby the Licensee was provided with due notice and an opportunity to be heard and, based on all evidence and testimony provided during that hearing, the council hereby finds and determines the following: a. The above recitals are adopted and included as express findings of the council in relation to this matter and are hereby incorporated into these findings as if fully set forth herein. b. The Licensee has violated Section 114.001 (E) of the City Code which prohibits massage therapists from intentionally massaging or offering to massage the genital area of a person. c. City Code Section 114.014 provides that a therapeutic massage license may be suspended or revoked for any violation of subchapter 114. d. Pursuant to City Code Section 114.014, massage therapy licenses may be suspended for cause following a public hearing where the licensee shall be provided with due notice and an opportunity to be heard on the matter. e. The City Council is charged with protecting the public health, safety, and welfare of its residents, including from illegal activities of businesses and activities licensed by the City, and is further authorized to exercise its sound discretion when considering the suspension of such licenses; provided, however, that the council's actions are reasonable under the circumstances and not arbitrary or capricious. f. Engaging in unlawful sexual touching of a client constitutes a violation of the aforementioned City Code provision. This violation is sufficient grounds on which to suspend an enterprise therapeutic massage license and an individual therapeutic massage license and the City Council determines DOC SOPEN\MU 125\65\822107.v3-9/8/22 that suspending both of the Licensee's licenses is reasonable and appropriate to protect public health, safety, and welfare and to further prevent unlawful behavior within the City. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Mounds View, as follows: 1. The enterprise therapeutic massage license issued by the City to Eric Roy Rautio for Eric Roy Massage LLC is hereby suspended, effective immediately. 2. The individual therapeutic massage license issued by the City to Eric Roy Rautio is hereby suspended, effective immediately. The City Administrator, or his designee, is hereby authorized and directed to provide the Licensee with a copy of this resolution to serve as notice of the license suspensions established herein and to take any additional action to implement and effectuate this Resolution. Specifically, a client alleges that you digitally penetrated her vagina during a massage and subsequently told her that you were performing a "Yoni Massage" technique. This behavior is a violation of Mounds View City Ordinance 114.001 (E) "A therapist may not intentionally massage or offer to massage the penis, scrotum, mons veneris, vulva or vaginal area of a person.". A criminal complaint and summons, charging you with Criminal Sexual Conduct in the 3rd degree, has also resulted from this allegation. Under Mounds View City Ordinance 114.014 "A license granted under this subchapter may be suspended or revoked by the City Council by resolution upon notice and public hearing for any violation of this subchapter". The City Council intends to hold a public hearing regarding the indefinite suspension of both the Individual Therapeutic Massage License and the Enterprise Therapeutic Massage License granted to you by the City of Mounds View on December 29, 2021. The suspension will not take effect until final action has been taken by the City Council and you have been given an opportunity for a hearing before the Mounds View City Council to address these issues. The hearing is scheduled for the September 12, 2022 City Council meeting at 6:35 P.M. Please advise me as to whether or not you will be attending the public hearing regarding these matters. At the hearing, the City Council will make a final determination as to the suspension of both your individual and enterprise therapeutic massage licenses, whether or not you attend the hearing and the City Council meeting.
