PUBLIC COMMENT 41 42 Vince Meyer, 8380 Spring Lake Road, stated he had several concerns with the street improvement 43 project. He explained there was some issues with the dust control on his road. He noted he has a 44 light -sided house that was covered with dust and debris. He indicated his garbage hauler was not 45 picking up his garbage because of the road construction. He understood the water trucks do not 46 work on the weekends. He asked when the boulevard tree stumps would be removed. He Mounds View City Council September 26, 2022 Regular Meeting Page 2 1 questioned who would be paying for the utility lines that were broken. He expressed frustration 2 with how this project has been managed by the contractor and encouraged the City to step. 3 4 Zack Lindstrom, 8378 Long Lake Road, reported he has been out campaigning and noted speed 5 was an ever present concern for Mounds View residents. He explained there was support for the 6 City deploying more electronic speed monitoring devices and making them permanent in known 7 speed areas. In addition, he indicated residents supported the City forming a partnership with 8 Shoreview and New Brighton in order to have one membership for all three Community Centers, 9 while also allowing for access to the middle school in order to have access to the pool. He reported 10 he checked into the fitness equipment and noted there was a local resident the City could purchase 11 equipment from at a reasonable rate. 12 13 Mayor Mueller asked if anyone else in the audience would like to speak. With no one coming 14 forward, she closed the Public Comment period. 15 16 Council Member Bergeron asked if the other three candidates in the audience would also like to 17 take three minutes to campaign during Public Comment. The three candidate all declined. 18 19 Mayor Mueller mentioned at the previous City Council meeting, she has displayed the t -shirts 20 being sold as a fundraiser for the Mounds View Police Foundation. She then showed an example 21 of the toy K9 that the Ramsey County Sheriff Foundation is selling as a fundraiser for their K9 22 program. She stated that Ramsey County Sheriff has seven K9s in their department, and you 23 could order the one matching your favorite K9 if you wanted. Residents could contact her for 24 more information. 25 26 Council member Cermak stated that the Mounds View Police Foundation would be selling K9 27 toys as a fundraiser in October. 28 29 7. SPECIAL ORDER OF BUSINESS 30 31 None. 32 33 8. COUNCIL BUSINESS 34 A. Resolution 9643, Authorizing Software as a Service Agreement with BSA. 35 36 Community Development Director Sevald requested the Council authorize the purchase of 37 software as a service agreement with BSA. He stated during COVID staff working from home 38 brought about frustrations with the City's permitting software. He explained after speaking with 39 neighboring communities staff determined BSA would be a good software system for the City to 40 consider purchasing. He commented on the benefits of the program, along with the costs and 41 recommended approval of the purchase. 42 43 Council Member Hull asked if this program would be used by multiple users. Community 44 Development Director Sevald reported this program would be used by the majority of the staff 45 members at City Hall. 46 Mounds View City Council September 26, 2022 Regular Meeting Page 3 1 Council Member Meehlhause questioned how long the City has had the current software. 2 Community Development Director Sevald stated the City has had PermitWorks since 1998. 3 4 City Administrator Zikmund thanked Community Development Director Sevald for being 5 thorough when investigating program options available to the City. He stated he believed BSA 6 would be a great option for the City going forward. 7 8 Mayor Mueller inquired if neighboring communities were using this software and if they liked it. 9 Community Development Director Sevald reported this was the case. 10 11 Mayor Mueller asked if the BSA program was the best value for the community. Community 12 Development Director Sevald stated he believed the BSA software was the best value for the City 13 of Mounds View given the price and the product the City would be receiving. 14 15 MOTION/SECOND: Hull/Bergeron. To Waive the Reading and Adopt Resolution 9643, 16 Authorizing Software and a Service Agreement with BSA. 17 18 Mayor Mueller questioned how the City would be paying for this purchase. Finance Director Beer 19 reported this expenditure would come out of the Special Projects Fund. 20 21 Ayes — 5 Nays — 0 Motion carried. 22 23 B. Resolution 9634, Approving Change Order #13 for Upgrades to Well #4. 24 25 Public Works/Parks and Recreation Director Peterson requested the Council approve Change 26 Order #13 for upgrades to Well #4. He discussed the history of Well #4 noting maintenance was 27 required over the years. He explained last year, the Department of Health required the City to put 28 the well back into production or seal the well. He indicated this led the City to put the well back 29 into production as a standby well. He commented further on the proposed change order and 30 recommended approval. 31 32 Council Member Meehlhause questioned how the City would operate this well if it is not connected 33 to the water treatment plant. Public Works/Parks and Recreation Director Peterson explained if it 34 were used it would strictly go out to distribution without filtration of manganese or iron. 35 36 Mayor Mueller reported the City was keeping this well active and viable so that in the event the 37 City needs to have another well online, Well #4 could be utilized. Public Works/Parks and 38 Recreation Director Peterson reported this was the case. 39 40 Mayor Mueller inquired if this project would be grant eligible. Public Works/Parks and Recreation 41 Director Peterson indicated he would look into this. He commented because this was an 42 emergency or backup well he did not believe it would be grant eligible. 43 44 Council Member Meehlhause questioned if this project would be funded by the Water Treatment 45 Plant project dollars. Resolution 9635, Approving the Hire of Angela Gornik to the Position of 8 Recreation Coordinator. 9 10 Human Resources Director Ewald requested the Council approve the hire of Angela Gornik to the 11 position of Recreation Coordinator. She reported 20 candidates applied for the position and seven 12 interviews were held. After conducting the interviews, staff was recommending Angela Gornik be 13 hired for this position. 14 15 MOTION/SECOND: Bergeron/Hull. To Waive the Reading and Adopt Resolution 9635, 16 Approving the Hire of Angela Gornik to the Position of Recreation Coordinator. 17 18 Ayes — 5 Nays — 0 Motion carried. 19 9. REPORTS 20 A. Reports of Mayor and Council. 21 22 Council Member Cermak invited residents to attend the 2nd Annual K9 Walk on Saturday, October 23 1 at Silver View Park at 10:00 a.m. 24 25 Council Member Meehlhause reported retired K9 Niko would be making an appearance at the K9 26 Walk along with the City's two current K9 officers. He noted the Mounds View Lions would be 27 providing hot dogs, chips and water for an in -kind donation at this event. 28 29 Council Member Meehlhause stated the Charter Commission met last week and passed two 30 Resolutions that will be coming to the City Council regarding changes to the City Charter 31 regarding special elections and the removal of language that was unconstitutional. 32 33 Council Member Meehlhause explained the Parks, Recreation and Forestry Commission passed a 34 recommendation that will be coming to the City Council to consider a park name change. 35 36 Council Member Meehlhause asked if a stormwater study report update would be provided to the 37 Council next Monday. City Administrator Zikmund reported staff would be providing the Council 38 with an update at the work session meeting on Monday, October 3. 39 40 Mayor Mueller stated the Festival in the Park Committee would be meeting Tuesday, September 41 27 at 7:00 p.m. at the Public Works Facility. She invited residents interested in planning next year's 42 event to attend. 43 44 Mayor Mueller requested an update on the catalytic convertor marking event that was held on 45 Saturday, September 24. Public Works/Parks and Recreation Director Peterson reported over 30 46 cars attended this event. Mounds View City Council September 26, 2022 Regular Meeting Page 5 1 2 Mayor Mueller commented on the fatal accident that occurred at the intersection of US Highway 3 10 and Highway 96 last week. She explained this was a very dangerous intersection and she hoped 4 Ramsey County would be considering how to make this intersection safer. 5 6 B. Reports of Staff. 7 8 Finance Director Beer reported he and Community Development Director Sevald attended a Zoom 9 meeting with Ramsey County regarding three grant programs the City would be pursuing. 10 11 Public Works/Parks and Recreation Director Peterson provided the Council with an update on the 12 water treatment plant (WTP). He reported WTP #1 was up and running and noted the variable 13 frequency drives should be delivered in December. 14 15 Public Works/Parks and Recreation Director Peterson updated the Council on the progress being 16 made on the street improvement project. He stated there was a shortage of concrete at this time. 17 He feared there would not be enough concrete to complete the aprons this fall. He hoped that the 18 curbing would be complete by the end of October and noted staff would be meeting with the 19 contractor to discuss concrete shortage concerns. 20 21 Mayor Mueller questioned if the City could make the driveway aprons a priority over the curbs. 22 Public Works/Parks and Recreation Director Peterson reported he would recommend the curbs be 23 installed in order to allow the first layer of asphalt to be installed before winter. He stated the 24 aprons could be patched with asphalt for the winter noting the City would not leave them gravel 25 through the winter. Further discussion ensued regarding how staff was managing the street 26 improvement project. 27 28 Mayor Mueller encouraged the City to install temporary asphalt aprons for residents if concrete 29 was not available. She asked what the process would be to remove these aprons in order to install 30 concrete in the future. Public Works/Parks and Recreation Director Peterson explained he was 31 hoping the City would be able to secure concrete. 32 33 Public Works/Parks and Recreation Director Peterson provided the Council with an update from 34 the Parks, Recreation and Forestry Commission. He noted this group was looking to replace the 35 Greenfield Park playground in 2023. He reviewed the proposed plans for the park noting the cost 36 would be around $171,000. 37 38 Council Member Hull stated he supported the City pursuing the proposed park option. 39 40 Finance Director Beer reported the City had enough funding in the Park Dedication Fund to cover 41 the proposed park improvements. 42 43 MOTION/SECOND: Hull/Meehlhause. To Authorize Staff to Acquire the Proposed Playground 44 Equipment for Greenfield Park for $171,000. 45 46 Ayes — 5 Nays — 0 Motion carried. He discussed how well this group was working 4 together and noted the two recommendations were coming with unanimous support from the 5 Charter Commission. 6 7 C. Meeting Date: October 10, 2022 Type of Business: Council Consent Administrator Review: Honorable Mayor and City Council Mark Beer, Finance Director Resolution 9636 Adopting a Special Assessment Levy for a Private Sewer Improvement for 8270 Spring Lake Road The City offers residential property owners the opportunity to improve their sanitary sewer connection during street reconstruction projects. This will reduce the need to cut into the new asphalt on a future date. The owner of 8270 Spring Lake Road has elected to participate in this program and will have sanitary sewer service repairs performed. The property owner has signed an agreement to waive their right to a public hearing and has agreed to pay the full cost of the private improvement plus interest and the administrative fee. This will be a five year assessment. The property owner may pay the amount due by 5:00 P.M. on Monday, October 10, 2022 in order to avoid the $35.00 administrative fee. The owner may prepay the assessment between October 11, 2022 and November 10, 2022 without paying additional interest. After that, interest at the rate of 5.50% will accrue from October 10, 2022 through the payment date. This interest rate and administrative fee were set by the City Council in Resolution 7135. On or after November 14, 2022, we will forward the assessment roll to Ramsey County for collection with the 2023 property taxes. Respectfully submitted, Mar Deer Mark Beer, Finance Director RESOLUTION NO. 9636 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA Adopting a Special Assessment Levy for a Private Sewer Improvement for 8270 Spring Lake Road WHEREAS, the City has received signed petition and waiver agreement from the property owner at 8270 Spring Lake Road agreeing to the proposed assessments in the attached assessment roll for private sewer improvement as part of the street reconstruction project. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Mounds View approves the following: 1. Such proposed assessment roll, a copy of which is attached hereto and made a part hereof, is accepted and shall constitute a special assessment against the lands named therein, and each tract of land therein is hereby found to be benefited by the private sewer improvement in the amount of the assessment levied against it. 2. The assessments as adopted and confirmed shall be payable in equal annual installments over a period of five (5) years if greater than $1,000, the first of the installments to be payable on or before the first Monday in January 2023, and shall bear interest at the rate of five and one half (5.5) percent per annum. To the first installment shall be added interest on the entire assessment from October 10, 2022 through December 31, 2023. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may at any time prior to the certification of the assessments to the County Auditor pay the whole of the assessment, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and the owner may, at any time thereafter, pay to the City Treasurer the entire amount of the assessment, with interest from the date of adoption of this resolution through the date of payment, such payment must be made before November 14, 2022, or interest will be charged through December of the succeeding year. 4. The City Administrator shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the county, and such assessments shall be collected and paid over in the same manner as other municipal taxes. Mr. Clawson and Ms. Munson stated publicly that they would not be seeking reappointment nor did they submit applications. Thus, there are two current members seeking reappointment and two vacancies. COVER LETTER Question 1: When I migrated to the USA on July 13, 1996 I lived in Scotland Green Apartments which is a few block from the City Hall. Since then, I have been a part of this community for over 25 years. I have seen the community grow in many areas and I am fascinated by the internal workings of the city. I have volunteered during the annual celebrations of Festivals in the Park and got to know some of the city officials along the way. As a member of the New Brighton Mounds View Rotary Club, I feel like the Charter Commission is fundamental to the city and its development and I want to be a part of channeling the future of the city in my own small way. Question 2: I have very unique qualities and insight. I am an immigrant from Africa and I know I represent a lot of the new comers to the city of NB. I will probably represent the minority in this Board and they deserved to be heard as well. The city has evolved over the last 25 years. I remember when I lived arrived in Mounds View in 1996, there were very few people that looked like me in the apartment but now, it is almost half of the residents who look like me. Secondly, I have been a part of many boards and organizations in the last 25 years that I think I have been prepared for something like this. Moreover, I am young, energized and articulate. The Commission needs to remain relevant to this current generation and the generations to come. I will represent the voice of the younger generations as well and probably see things differently than the older members of the board. Question 3: I have been the President of my Rotary Club in the last two years. I am currently a board member in charge of Communication and Publicity for my Club. I am also a Member of the Board that selects Global Grant winners ($25,000) for the District 5960 of the Rotary Club. I was part of the commission that worked on updating all the infrastructures in the Mounds View School District. We made a recommendation and got the referendum passed that raise over 70 million to update all the facilities in all the schools in the district. I have lived in Mounds View for 13 years and have started to become more involved in the community. My initial community involvement has been as a Board member with the Mounds View Police Foundation since 2020. The Foundation partners with the Mounds View Police Department's community outreach effort by holding various fundraisers over the year to provide financial support for the outreach events. The Foundation members also, obviously, volunteer at the outreach events. Through my involvement with the Police Foundation, I have become more informed about the City's local government operation and structure and that it is a home rule charter city. My rudimentary understanding of the City Charter and the role it plays in both providing resident rights and governance guidelines for the City Council and City staff has piqued my interest in learning more about the collaboration and partnership that needs to occur between the Charter 1 Commissioners, who are obviously appointed by the Court, the City Council, who are elected by the residents, and the City. My business background as a business owner obviously requires interacting with a wide spectrum of individuals, and my ability to work successfully to the benefit of the individual and my business would serve me well as a Charter Commissioner. As a Commissioner, I would work to ensure the citizen's rights provided by the Charter are maintained, but also at the same time partner with the elected officials to ensure the Charter's governance guidelines are allowing them to serve the residents and businesses demands, expectations, and needs from both a policy and financial perspective. In closing and my apologies for being repetitive, the successful operation of a home rule charter city appears to be very reliant on a true partnership between the elected officials, staff, and court appointed Commissioners, and without a collaborative partnership between the entities the City will not provide services to its residents and businesses in a satisfactory manner. I have lived here much of my life and I believe that it is more important now than ever to be involved in the city of Mounds View. I understand the role of the Charter Commission and how it plays a part in good governance and good public policy. I am raising my family here in Mounds View, and I want to make sure that my son will grow up knowing that I played a big part in making sure the city he grew up in cared about the community and was ran by the very people that make up this wonderful city. What qualities do you have that would help accomplish the mission of the Commission? One of my greatest qualities is my passion to help my community. I am a volunteer firefighter for the Spring Lake Park Blaine Mounds View Fire Department and am always looking for other ways to help my community. The expansion envisions a regional facility drawing visitors to the area resulting in investments by the private sector specific to commercial and retail. The expansion would allow increased recreational and entertainment opportunities to Mounds View Residents. The Council authorized and received an economic assessment specific to operations as a regional youth amateur sports venue from CSL earlier this year as part of this exploration. Feasibility of the project is dependent upon State Bonding inclusion, which requires concept drawings, and validated construction cost estimates. The Council has also interviewed and selected a governmental relations firm to assist in the bonding process. At their September 2022 workshop, council directed staff to seek out up to three architectural firms qualified to provide concept drawing and validated cost estimates and interviewed Adkins, Kodet, and Oertel at their October 2022 workshop. Council further directed staff to have follow up conversations with Kodet and Oertel specific to their experience with project that have received state bonding. Staff will be interviewing Kodet and Oertel on Monday morning October 10, 2022 and will be providing a verbal report/recommendation to Council at their meeting held at 6:30 pm.
