HomeMy WebLinkAbout1141-21 Skyline & The Villas of Mounds ViewMOUNDS VIEW PLANNING COMMISSION RESOLUTION 1141-21 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF THE PRELIMINARY AND FINAL PLAT OF SKYLINE; AND, ZONING MAP AMENDMENT; AND, PLANNED UNIT DEVELOPMENT; AND, DEVELOPMENT REVIEW; AND, WETLAND ALTERATION PERMIT; FOR THE VILLAS OF MOUNDS VIEW, 2151 MUSTANG DRIVE, 4889, AND 4943 OLD HIGHWAY 8; WHEREAS, the Applicant; Peter Worthington (The Villas of Mounds View, Limited Partnership), representing property owners; Gregory Kelley and Jane Kelley (2151 Mustang Drive); Mounds View Economic Development Authority (4889 Old Highway 8); and the City of Mounds View (4943 Old Highway 8); has requested approval of (1) the Preliminary/Final Plat of Skyline; (2) Zoning Map Amendment; (3) Planned Unit Development; and (4) Development Review. The properties are legally described as: P I D: 17-30-23-14-0002 A strip of land 130 feet wide measured at right angles southwesterly of and adjacent to, a line running southeasterly from a point on the north line of the Southeast Quarter of the Northeast Quarter of Section 17, Township 30 North, Range 23 West, Ramsey County, Minnesota, and 385 feet from the east line of said Section 17, to a point on the south line of the North Half of the Southeast Quarter of the Northeast Quarter of said Section 17, and 250 feet from the east line of said Section 17, and measuring 132.94 feet on the north line of said Southeast Quarter of Northeast Quarter, and 132.92 feet on the south line of said North Half of the Southeast Quarter of the Northeast Quarter, excepting the North 75 feet and the South 75 feet of said tract. (Torrens Property) WHEREAS, the applicant submitted a Sketch Plan, which was reviewed by the Planning Commission on July 21, 2021, and was reviewed by the City Council on July 26, 2021; and, WHEREAS, an application for Preliminary Plat and Final Plat approval was submitted on October 4, 2021, and distributed to applicable staff and agencies. Comments were received from: August 18, 2021 Scott Mareck, Ramsey County Public Works Res 1141-21 Page 4 of 8 October 5, 2021 Charlie Smith, SBM Fire Department October 18, 2021 Scott Mareck, Ramsey County Public Works October 21, 2021 Chris Ambourn Stantec October 25, 2021 Dan Edgerton, Stantec (City Engineer) (City of Mounds View, MN Permit Report) October 25, 2021 Tyler McLeete, Stantec (City Enigineer) October 26, 2021 David Elvin, MnDOT WHEREAS, in compliance with the Mounds View City Code §158.020(H), a Public Hearing notice was published by the Shoreview Press on November 9, 2021, and mailed to property owners within 350' of the subject properties. A Public Hearing was held by the City Council on November 22, 2021; and, WHEREAS, the Preliminary Plat has been evaluated for compliance with requirements of the Mounds View City Code, §158.020 (Preliminary Subdivision Plan Application), and the Comprehensive Plan; and, WEHREAS, the Final Plat has been evaluated for consistency with the Preliminary Plat, and compliance with all requirements deemed necessary to preserve neighborhood aesthetics and to protect the public health, safety and welfare of neighboring landowners and future residents within the subdivision, consistent with Mounds View City Code §158.026(B)(3); and, NOW, THEREFORE BE IT RESOLVED THAT the Planning Commission recommends approval of the Preliminary/Final Plat of SKYLINE, with the following conditions: The Developer shall revise the Preliminary Plat and Final Plat, in compliance with the City of Mounds View, MN Permit Report, dated October 25, 2021; the City Engineer's report, dated October 25, 2021; and, the Community Development Director's review report dated October 28, 2021; Changes to the Plat shall be reviewed and may be approved administratively by Staff. 2. The Final Plat shall conform to the Preliminary Plat, as approved by the City Council, in conformance with Mounds View City Code §158.0026(A) (Filing of final plat). 3. The Final Plat shall adhere to all requirements of the City Attorney's Plat Opinion, dated . The Final Plat shall be recorded within six months, and provide the City with a reproducible copy. 4. The Developer shall enter into a private ingress/egress easement between Lot 1, Block 1 (The Villas of Mounds View), and Bauer Welding, 2159 Mustang Drive. This easement shall run with the land. This easement shall be recorded by the Developer prior to the City issuing a building permit for The Villas of Mounds View. Res 1141-21 Page 5 of 8 5. The Developer shall submit a Landscape Escrow equal to 150% of the cost of landscape materials and labor, prior to the City releasing the mylars for recording. 6. The Developer shall pay a Park Dedication Fee of; (1) $420,000 for Lot 1 (The Villas of Mounds View, Limited Partnership); and (2) $5,945 for Lot 2 (Gregory Kelley and Jane Kelley). Fees shall be paid prior to the City releasing the Final Plat mylars for recording.. 7. All new electrical distribution lines, telephone service lines and other utilities proving services to residential customers of the plat shall be buried underground, consistent with Mounds View City Code §158.0049(A)(1). 8. Approval of the Preliminary/Final Plat and Development Review shall constitute approval of a Wetland Buffer Permit to allow the planned apartment building (Lot 1) to encroach within the 100' setback of a wetland, consistent with City Code 159.007(C)(3), and consistent with the Site Plan, dated October 4, 2021. NOW, THEREFORE BE IT FURTHER RESOLVED THAT the Planning Commission makes the following Findings (italics) in support of its recommendation for approval of a Planned Unit Development for Lot 1 (The Villas of Mounds View), consistent with Mounds View City Code 160.318(C)(6) ([Development Stage] Review and evaluation criteria; and Final Plan): Findings: 9. Adequate property control will be established. The Residential PUD will consist of Lot 1 (The Villas of Mounds View). The PUD will not include any outlots, nor land owned by an Owners Association. 10. The parking lot's internal circulation has been reviewed by the SBM Fire Department, and access onto Old Highway 8 approved by Ramsey County Public Works. 11. A sufficient amount of Open Space is provided. Mounds View City Code §160.056(B)(d) establishes a guideline that each multiple -family dwelling site shall contain at least 625 square feet of usable open space intended and maintained for either active or passive recreation (or both), and accessible to all residents of the PUD. The project (Lot 1) includes 84,035 square feet of non -impervious surfaces (700 square feet per unit). 12. The arrangement of buildings on Lot 1 does not unreasonably disturb the privacy or property values of surrounding residential uses (e.g. Townsedge Terrace). Res 1141-21 Page 6 of 8 13. The architectural design of the project is compatible with the surrounding area. 14. The drainage and utility system plans are adequate, subject to approval of the City of Mounds View/Rice Creek Watershed District (joint application/review for watershed permit). 15. The development schedule, protecting the public's interest. 16. The development is in compliance with Mounds View City Code §§154 (Floodplain Management), 155 (Surface Water Drainage Management and Development Control), 156 (Construction Site and Land Disturbance Runoff Control), 157 (Storm Drainage Systems), 158 (Wetland Zoning), pending approvals of subsequent permits (with conditions). 17. Dwelling Unit and Accessory Use requirements are in compliance as a Residential Planned Unit Development NOW, THEREFORE BE IT FURTHER RESOLVED THAT the Planning Commission in compliance with the Mounds View City Code §160.316(B), the Planning Commission finds the project compliant with the Comprehensive Plan. The Commission recommends approval of a Planned Unit Development for Lot 1 (The Villas of Mounds View), with the following conditions: 18. The Developer shall agree to a Development Agreement, consistent with Mounds View City Code §160.318(C)(4)(d) (PUD Agreement). 19. Construction shall commence within one year of this PUD approval (e.g. by November 22, 2022), unless an extension is granted by the City Council, consistent with Mounds View City Code §160.0318(D)(6) (Limitation of final plan approval). NOW, THEREFORE BE IT RESOLVED THAT the Planning Commission recommends approval of a Development Review, consistent with the Mounds View City Code §150.054 (Development Controls). A Development Review is required for all new construction and building expansions of 10% or 10,000 sq ft. The Development Review is specific to Lot 1 (The Villas of Mounds View), and includes the following conditions: 20. The Developer shall sign a Development Agreement. 21. The Developer (Lot 1) shall submit an exterior lighting plan, consistent with City Code §160.031 (Glare). The Plan may be reviewed and approved administratively, as part of the Building Permit plan review. Res 1141-21 Page 7 of 8 22. Vinyl Lap Siding shall be (PlyGem Mastic Carvedwood 44 (or similar), as presented at the November 3, 2021 Planning Commission meeting, and consistent with architectural plans dated October 4, 2021. 23. Any monument signage on Lot 1 (if located near the shared driveway entrance) shall accommodate off -premise signage of any user of the shared driveway. All signage shall otherwise comply with City Code regulations for the R-4 zoning district. 24. The Landscape Plan, dated October 4, 2021, shall be revised to include a pollinator seed mix (NRCS 327) in areas identified for "dry short prairie seed mix". The quantity and size of plantings shall comply with City Code. 25. The Landscape Plan, dated October 4, 2021, shall be revised such that the park bench and surrounding landscaping in the southwest corner of Lot 1, is entirely on Lot 1 (is shown to be encroaching onto Lot 2). NOW, THEREFORE BE IT RESOLVED THAT the Planning Commission recommends approval of a Wetland Alteration Permit, consistent with Mounds View City Code §159.008(B)(3) (Development overlapping wetland and wetland buffer area). The Developer submitted required materials as part of the plat application package, on October 4, 2021. Wetland delineations were conducted in 2019 and 2021, finding a wetland in the northwest area of Lot 1, thereby establishing a Wetland Buffer Area within 100' of the delineated wetland. Mounds View City Code §159.007(C)(3) (Building Setback) requires a minimum 100' building setback from a wetland, unless a Variance is granted by the City Council through an approved Wetland Alteration Permit. The proposed building on Lot 1 has a setback of about 95' from the delineated wetland. Mounds View City Code §159.008(D) (Standards for approval of permits) establishes Findings for the City Council's approval of a Wetland Alteration Permit. The City Council makes the following Findings (italics): Findings: 26. The alteration shall not cause a reduction in the flood storage capacity of the wetland. The wetland has a bottom elevation of 889'. The project is in Flood Zone X. The nearest Floodplain (Zone AE) has a base elevation of 874' (e.g. the wetland is upstream from Zone AE). NOW, THEREFORE BE IT RESOLVED THAT the Planning Commission recommends approval of a Wetland Alteration Permit with the following conditions; 27. Civil plans, dated October 4, 2021, shall be amended to comply with the City of Mounds View, MN Permit Report, dated October 25, 2021, and to comply with the City Engineer's letter, dated October 25, 2021. Res 1141-21 Page 8 of 8 NOW, THEREFORE BE IT RESOLVED THAT the developer shall reimburse the City for any and all consulting costs, including the City Engineer's review, and City Attorney's review; and, NOW, THEREFORE, BE IT FINALLY RESOLVED, that the Mounds View Planning Commission directs Staff to forward this resolution to the City Council prior to approval of the minutes.
