Dear Honorable Chief Judge Guthmann:
M y firm represents the City of Mounds View and its Charter Commission (collectively, the "City")
in the above-referenced matter, which is scheduled for a hearing on Monday, August 5, 2019.
Unless the intent of the hearing next week is to discuss how the case should proceed, the purpose
of this correspondence is to respectfully request any additional information or details regarding the
type of hearing that you wish to conduct on the aforementioned date, so as to allow the parties to
adequately prepare.
This matter stems from the district court's authority under Minn. Stat. 410.05, subd. 2 to remove
a charter commission member. Unfortunately, the statute does not provide any procedural
requirements or direction for removal and, in recognition of that, the City merely seeks any
information that you think might provide the parties an ability to properly prepare for the hearing.
Although court staff was very helpful in providing the parties with some general information,
knowing your expectations for the hearing will certainly allow the parties to adequately meet those
expectations. The City assumes that the hearing will not be an evidentiary hearing and, unless
otherwise instructed by Your Honor, the City will not be prepared to offer evidence or testimony
at this stage of the proceedings.
