Quick Mounds View Charter Commission Chair Russell Warren: Pursuant to Minnesota Statutes § 410.12, subd. 1, a petition committee shall seek preapproval from the city charter commission for purposes of compliance with petition language when the proposed amendment exceeds 1000 words. The amendment being proposed by our petition committee does not exceed this limit, but we respectfully request that the city charter commission and staff review the attached materials for form and substance to assure that it is in full compliance with the amendment procedures found in Minnesota Statutes § 410.12. We also request that the charter commission determine the number of registered voters required to sign the petition under state law, which would be 5% of the total votes cast in the last previous state general election in the city. We seek a written response within ten days after receipt of our proposed petition. City of Founds View Ballot Question Petition - Initiative A proposal to place into the city charter, establishing a limit of 3 residential licensed haulers and 3 commercial licensed haulers to operate in the city, maintaining choice & reducing truck traffic. Maintaining the ability of single family, multi -family, HOA, and commercial properties to choose from any city licensed hauler. -------------------------------------- Limitation on number of licenses. (a) Purpose. It is the intent of the city to reduce the number of solid waste collection licenses issued. The means of this reduction will be through attrition. The limitation is deemed necessary to protect the health, safety and welfare of the city and its residents. (b) Limitation exception. No more than three residential collection licenses and three commercial collection licenses may be in force at any time, except that all companies licensed by the city as of September 1, 2015, may be relicensed according to the following conditions: (1) The licensee has conformed to all city, county, state and federal laws related to solid waste collection. (2) There is no lapse in the license period (3) The licensee submits a fully completed annual renewal form, payment and all required documentation by the due date for renewals. Incomplete applications shall be returned to the licensee and must be resubmitted by the original due date. Failure to submit a renewal, payment and all required documentation by the original due date will be cause for the city to deny the renewal of the license. (4) Licenses are nontransferable, except when an existing licensee undergoes incorporation, sale or merger with another existing city licensed collector, so long as the ownership, control, and interest in the license remain with a pre-existing licensee. (5) The type of service offered (i.e., commercial/industrial/multifamily or residential) has not increased from the previous license period. (6) There has been no increase in the number of trucks as listed in the application for the previous year's license. (7) Licenses must not have been suspended more than two times in a 12-month period, or revoked. (c) Merger or acquisition. In the event that a licensed hauler is merged or acquired by another licensed hauler, the number of trucks listed shall be added together. (d) Additional licenses. The city council may add additional licenses by ordinance, after making findings that doing so would increase competition, lower prices, and result in better service.
