HomeMy WebLinkAbout1164-23RESOLUTION 1164-23 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING APPROVAL OF AN ADMINISTRATIVE VARIANCE FOR DRIVEWAY MODIFICATIONS AT 8421 SPRING LAKE ROAD; WHEREAS, the Mounds View City Code has provisions for an Administrative Variance in Section 160.470, authorizing the Director of Community Development to review and approve certain variances subject to review by the City Planning Commission; and, WHEREAS, Bruce and Joy Eklund own the property at 8421 Spring Lake Road in Mounds View, legally described as follows: Lot 38, Auditor's Subdivision No. 89 PIN 06-30-23-22-0009, and WHEREAS, the Mounds View Zoning Code requires residential driveways to maintain a 10-foot side setback; and, WHEREAS, the Eklund's driveway is on or near the north property line, a legal non -conforming situation, and they propose modifications to the driveway that meet the criteria in Sect. 160.470 for consideration of an Administrative Variance, and have applied for an Administrative Variance to modify the driveway by removing part of the pavement and adding additional pavement to be no closer than 1 foot from the north property line, and, WHEREAS, the Acting Community Development Director has issued a report approving the Administrative Variance for the Eklund's driveway date October 4, 2023, and submitted it to the Planning Commission for review; and, WHEREAS, the Mounds View Planning Commission reviewed the Eklund's request and the Acting Community Development Director's report at their meeting of October 4, 2023, and voted to approve the Administrative Variance. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning Commission makes the following finding of fact related to this request: 1. Bruce and Joy Eklund own the home at 8421 Spring Lake Road in the R-1 zoning district. 2. The required side setback for a driveway in the R-1 district is 10 feet. Members of the Eklund household use a wheelchair and a cane and require easy access to vehicles from the driveway. 4. The home has an existing asphalt driveway about 27 feet wide that is paved out to the north lot line, within the required setback. There is a notch of unpaved area near the north side of the garage, making access difficult to and from vehicles, the house, and garage for a wheelchair and walking with a cane. The applicants want to square off the paved area for easier access, requiring a variance. The applicants did not create this non -conforming condition. 5. The proposed modification adds paved area that does not meet the setback but removes some asphalt that is closer to the lot line, improving the situation in that area. 6. The proposed driveway modification is a reasonable solution, with dimensions and a shape conducive to easy and safe access. 7. The request meets the criteria for granting an Administrative Variance in Section 160.470 and for variances generally in Section 160.466. NOW, THEREFORE, BE IT FURTHER RESOLVED that the Mounds View Planning Commission, based upon the above findings of fact, does hereby approve the Administrative Variance for driveway modifications at 8421 Spring Lake Road as described in the Eklund's application and the Acting Community Development Director's report of October 4, 2023.
