Commissioner Amber Urlacher April 19, 2023 Witness: Jon Sevald, Community Development Director Item No: 05A Meeting Date: April 19, 2023 MOLlyis VIEW Type of Business Planning Case Planning Case City of Mounds View Staff Report To: Planning Commission From: Jon Sevald, Community Development Director Item Title/Subject: Resolution 1159-23, Recommending Approval of the Preliminary/Final Plat of Long Lake Cove, 7700 Long Lake Road Introduction: The applicant, Twin Cities Holding Company LLC, requests approval to subdivide 7700 Long Lake Road into three single-family lots (one existing home). Discussion: A Concept Plan for a Planned Unit Development (PUD) with duplexes (6-8 units total) was presented to the City Council on August 1, 2022, and to the Planning Commission on August 3, 2022, and January 18, 2023. The Commission's comments included; turnaround for delivery trucks, additional yard space (vs. stormwater infiltration basin), units facing Long Lake Road (vs facing internal driveway), additional landscaping, and support for R-4 zoning vs. PUD. The project has been redesigned to preserve the existing home, and add two single-family lots (3 units total). The previous City Council and Planning Commission comments are no longer applicable to the current plan for single-family lots. Accessory buildings (kennel, screen porch) will be removed. A commercial kennel has been located on this property since 1948. The plan set, dated March 2023, incorrectly shows duplexes on Lots 1 and 3 (if duplexes, this would require amending the Comprehensive Plan and Zoning Map). The plat will be corrected to show single-family, to be consistent with the Comprehensive Plan and current zoning. Staff's review is ongoing, but Staff feel comfortable enough to forward the plat to the Planning Commission, if corrections can be made prior to City Council approval. A Public Hearing is tentatively planned for May 8, 2023. Analysis: Comprehensive Plan Single -Family Detached, 1-5 units p/acre Zoning R-1 Single -Family Residential Floodplain Zone X, 0.2% annual chance flood hazard, areas of 1 % annual chance flood with average depth less than 1' or with drainage areas of less than 1 sq mi. Wetlands None Stormwater Management Under review. An infiltration basin is on Lot 3 (NW corner of plat). The property is heavily wooded. Most trees on Lot 2 (existing house) will be preserved. Trees on Lots 1 and 3 will be removed. Outside of the R-1 district, the City Code empathies preserving High Value, and Specimen trees. Of the trees to be removed, only one is identified as High Value. Most trees on Lot 2 (existing home) will remain. Staff recommends that as many trees as practical be preserved, but the City Code does not require this. Consideration should be given to require custom grading the house pads on Lots 1 and 3, in order to preserve trees in the front yards. OTHER There are several minor corrections needed to the plan set, dated March 2023, most notably removal of duplex building pads on Lots 1 and 3; and changing the front yard setbacks along Long Lake Road. Strategic Plan Strategy/Goal: Townhomes & Condos that are more financially appealing than single-family homes or apartments: Identify and set aside strategic lots within the City like the Sham O Kennel lot, Ardan Park Redevelopment area, and MV Square. Ensure townhomes are integrated into the neighborhood with proper style and landscaping. 1 City Code §160.055(C)(1) (Setbacks for principal buildings) 2 NOTE: In reviewing files for 7700 Long Lake Road, at the time Bayport Acres was subdivided (1979), building setbacks were also an issuing, noting the least setback on Long Lake Road was 49.3' (7750 Long Lake Road). At that time, 7740 Long Lake Road was not built (survey, May 14, 1986). 3 City Code §160.418(A)(2) (Tree Removal on Lots with Construction or Grading Activity) 4 City Code §160.416 (Definitions); SIGNIFICANT TREE. Any live healthy high value tree measuring eight inches in diameter or greater, measured at four and one-half feet above the ground. A "High Value" tree is defined in the City Code among a list of specific tree species. All silt fences must be repaired, replaced, or supplemented when they become nonfunctional or the sediment reaches 1/3 of the height of the Q fence. If sediment escapes the construction site, off -site accumulations of sediment must be removed in a manner and at a frequency sufficient to minimize off -site impacts. W 17. Oil, gasoline, paint and any hazardous substances must be properly stored, including secondary containment, to prevent spills, leaks or other discharge. Restricted access to storage areas must be provided to prevent vandalism. Storage and disposal of hazardous waste must be in compliance with MPCA regulations. 22. External washing of trucks and other construction vehicles must be limited to a defined area of the site. Runoff must be contained and waste properly disposed of. No engine degreasing is allowed onsite. 23. All liquid and solid wastes generated by concrete washout operations must be contained in a leak -proof containment facility or impermeable liner. A compacted clay liner that does not allow washout liquids to enter ground water is considered an impermeable liner. The liquid and solid wastes must not contact the ground, and there must not be runoff from the concrete washout operations or areas. Liquid and solid wastes must be disposed of properly and in compliance with MPCA regulations. A sign must be installed adjacent to each washout facility to inform concrete equipment operators to utilize the proper facilities. 24. The Bear Lot, 2375 Mounds View Boulevard, would like to add a rooftop sign, "The Bear Lot", in addition to installing a bear statute on the roof. OTHER Sign regulations are complicated, with a lot of detail and interpretation. One item that Staff has struggled with is the base of Ground Signs; § 161.038 SPECIFIC SIGN TYPE STANDARDS AND REQUIREMENTS. (A) Ground signs. The following standards shall be maintained for all ground signs, excluding incidental, temporary, home occupation, identification and real estate signs. (7) Ground signs must include masonry construction materials such as stone, brick or stucco. When referring to the attached photo examples, few signs include masonry. Many have been permitted without masonry as part of a PUD or Development Review (e.g. Tommy's Carwash). Some Ground Signs include a DIY block wall border around the base of the sign (e.g. Abiding Savior, City gateway signs). Staff has interpreted this as compliant with the "masonry construction" requirement, but it's also Staff's opinion that it's not keeping with the spirit and intent of the Code, to have a brick (masonry) sign, vs. a metal sign with block wall flower garden around the sign. This has not been an issue to anyone other than Staff, thus, Staff is looking for guidance from the Planning Commission, if Staff's interrelation that masonry around the base of a sign, is equal to a sign with masonry construction. Strategic Plan Strategy/Goal: • ID, expand, and maintain City's strengths to include splash pad, parks, trails/sidewalks, park programs, Community Center, & beautification of Mounds View Boulevard. Consider other areas of the city to connect and add additional trails, walkways, amenities, features and improved appearances. • Beautification of Mounds View Blvd: Cooperate with Ramsey County in implementing new features and improved beautification, aesthetics, and landscaping including but not limited to different plant species in median that looks professional, clean, and neat. At the March 3rd Commission meeting, the scope was narrowed more toward the brightness of dynamic (digital) signs. Attached is a comparison of sign codes specific to city corridors similar to Mounds View Boulevard, for Ground, Wall, and Dynamic signs. Since the March meeting, information has been added regarding the maximum brightness of Dynamic Signs. Although Mounds View has maximum brightness standards, we do not have a tool to enforce this (costs about $2,000). Rather, the City requires that dynamic displays be installed with a manual override, in the event the sign's automated dimmer fails. Community Development Staff are not aware of any complaints about signage (excluding temporary signs), other than complaints generated by other City Staff. The Commission is encouraged to drive the Boulevard a few times, and provide an opinion as to what Commission members would change, if anything. For example, if there is a most favored, or least favored sign characteristics. One thing to note is that older signs which are non- conforming, can be repaired or replaced, but cannot be expanded. This means that some of the lesser desirable signs will likely stay until the property is re -developed. Also, a number of variances have been approved for signs over the years (e.g. McDonalds, BP, & Days Inn, Interactive Playground). Recommendation: Staff requests that Commissioners drive Mounds View Boulevard, and be prepared to discuss likes & dislikes. If Staff were to change anything, it would be to add diagrams to the Ordinance to visually explain requirements. Planned Unit Development Discussion with City Council Community Development Director Sevald stated Planned Unit Developments (PUD) are intended to provide flexibility from City Code requirements, in exchange for creating a more desirable project than what would be built otherwise. The PUD ordinance includes many requirements, but ultimately allows the City Council discretion of what deviations from the City Code to allow. In Staff s opinion, PUD's are being overused when it would be more appropriate to amend the City Code to allow every development to benefit from higher density, smaller lots, and higher architectural and landscape standards than is currently required (without a PUD). Community Development Director Sevald reported; if the Council's intent is to promote affordable housing (e.g. less than the median $302,000 house, $275,000 townhouse), then there is a fine -line, "give & take" between taking higher standards (architecture & open space), and giving deviations from the City Code (higher density and lesser setbacks). The goal of this discussion between the City Council and Planning Commission, is to have a high-level discussion of what the Council & Commission values, and how development can contribute toward those values (and vision). Councilmember Gunn questioned what the alternative was to a PUD. Community Development Director Sevald stated this would be straight zoning. Councilmember Gunn asked if PUD's stay with the property. Community Development Director Sevald reported this was the case, noting the PUD would stay with the property forever. Further discussion ensued regarding how PUD's can be amended and revoked as a CUP. Councilmember Lindstrom stated with the limited amount of space left to develop, he did not support moving away from the current model. Commissioner Munson questioned when the PUD zoning language was written. Community Development Director Sevald estimated this occurred in 1988. Commissioner Munson supported the PUD language being rewritten. Community Development Director Sevald questioned if there was anything the Commission or Council would change with the Boulevard or Bel Rae developments. Staff commented on how these developments were accessed. The consensus of the group was that there were no concerns with either of these projects. Community Development Director Sevald inquired if the Commission or Council had comments on the Gray Stone Flats development. The only concerns with this development were the exterior colors. Councilmember Meehlhause stated he has heard INH enjoyed working with the City on this project. Community Development Director Sevald questioned if the City should consider putting a limit on building height. He anticipated the City would be considering a PUD for town homes. Councilmember Lindstrom stated he would like to see projects other than apartment complexes along Mounds View Boulevard. Commissioner Curtis indicated he would like to see future multi -family projects along Mounds View Boulevard having some form of retail included. Councilmember Gunn commented on how the City has to have more people in order to support more retail and restaurants in the community. Community Development Director Sevald commented on how the cost for commercial development was higher than residential development, which made it more difficult in the suburbs. Commissioner Munson stated Mounds View was not as walkable as other communities which may make it difficult to successfully develop mixed use projects. Councilmember Lindstrom discussed how people's patterns have changed since COVID and how people liked staying closer to home. Councilmember Gunn stated she would not rule mixed use out as an option, but anticipated the City would have work to do on its trail and transportation system before this type of development could occur. Community Development Director Sevald indicated the City may have to consider how badly it would like to see mixed use developments, and if the City would be willing to subsidize these commercial spaces if they were not able to find or maintain tenants. Commissioner Farmer discussed how mixed use developments in the suburbs would have to look different than mixed use developments in an urban area. Community Development Director Sevald questioned if the Commission and the Council supported smaller lot sizes in order to create more affordable housing. He commented on how the Council must balance the number of affordable housing units with the need for market rate units and single family homes. Mounds View Planning Commission Regular Meeting February 15, 2023 Page 4 Councilmember Gunn supported smaller lots in order to offer more affordable housing in Mounds View. Councilmember Gunn asked if the City allowed accessory dwelling units. Community Development Director Sevald discussed how City Code addressed ADU's. He questioned how the Council and Commission felt about ADU's or tiny homes. Chair Rundle stated he supported tiny homes, but he was uncertain where they should be located in Mounds View. Councilmember Gunn feared that if the City did not allow tiny homes, that the City would be limiting who could move into the community. Commissioner Curtis suggested the City consider locating tiny homes on vacant lots in Mounds View. He supported the City being mindful of existing residents and the quiet enjoyment of their property, while also making it easier for developers to bring tiny homes into the community. City Administrator Zikmund stated Belden River Estates may be a good location for tiny homes. Commissioner Farmer agreed that zoning would assist with allowing tiny homes in the community. He understood this was an emerging market and he could support a cluster of tiny homes in Mounds View. Councilmember Lindstrom stated it was his understanding tiny homes would range in price from $200,000 to $250,000, which was not exactly affordable. Councilmember Gunn explained she was not advocating for tiny homes in back yards, but she did support a tiny home neighborhood on vacant lots in the community. Jamie Stolpestad, Yard Homes representative, introduced himself to the Council and Commission noting his company manufactures compact dwellings used as ADU's. He reported there were 50 cities, counties and townships in Minnesota that allow ADU's. He explained some of these communities allow for clustered developments or cottage home parks. He stated an overlay district was created for these communities. He commented the biggest pressure for ADU's was for the senior population. Councilmember Curtis stated he would like to see potential zoning language from staff on how the City should regulate ADU's. He stated the goal would be to get in the governors bonding for 2024. He indicated the City was considering a local sales tax to assist with funding the Community Center expansion. He reported a mailing would be sent to residents with specific information regarding the local sales tax and why this was needed for the Community Center. He explained six community meetings were scheduled in order to invite the public in to learn more about the project. City Administrator Zikmund discussed the recently approved agreement with the Rice Creek Watershed District regarding maintenance of the City's ditches. He commented further on how the City would be working to restore its stormwater ponds and ditches. C. Council Updates Council Member Meehlhause provided the Planning Commission with an update from the City Council. He discussed how local legislators support the Community Center expansion and the regional impact this facility would have on the community. He noted the City has met with the National Sports Center to ensure that the City's efforts were not taking away from their facility. The change is one of many proposed by the city's Planning and Economic Development Department, which is leading a major overhaul of the zoning code. Wondering what's on the table, and what it means for residents? Here's a quick breakdown: What is zoning? Most cities, townships and some counties have local ordinances that control how land can be used, and zoning is usually part of a larger, long-term plan for orderly growth and change. In the United States, zoning typically divides land into areas for residential, commercial, industrial or other uses and often has additional rules regarding lot and building size, parking or secondary structures. Why are city planners proposing changing the zoning code? Under current laws, nearly half of the land in St. Paul can only be used for single-family homes. The city has largely been built out, leaving limited land for new development — so planners are suggesting allowing more density in the neighborhoods that already exist. Additionally, city officials want to give residents a wider variety of choices when it comes to housing. Some residents may prefer a duplex for a lower -maintenance lifestyle, or a town home to downsize. What would be allowed if the changes are approved? St. Paul city planners are emphasizing that single-family homes will still be allowed if their proposal passes. Their main focus is creating more flexibility for what urban policy experts call "neighborhood -scale" or "missing middle housing," such as duplexes, townhomes and carriage houses. This category of housing contains multiple units but is seen as compatible, in size and appearance, with standalone single-family homes, according to the city's memo. In practice, this could look something like splitting an existing single-family lot in two or adding an accessory dwelling unit in a backyard. An important note: Allowing this type of housing doesn't mean it will be built. City planners say the code changes are mostly geared toward long-term housing goals. They aim to promote the reuse of existing homes and development in lots and backyards, said city planner Emma Brown, the lead author of the proposed amendments. "A zoning change just opens up the possibility for other development," Brown said. "But land use —that doesn't change overnight." How would my neighborhood's zoning change? It depends where you live. The proposed amendments would condense the city's seven low -density residential zoning districts into four, with new standards regulating lot area, building heights, setbacks and lot coverage. City planners noted that this district is used only in a small portion of St. Paul's Highwood area, which is a hilly part of the Mississippi River bluff that is not consistently served by city sewer or water services. In H1 and H2 districts, it would be possible to add up to two additional units by complying with certain requirements. If one or two units contain at least three bedrooms, or if the owner rents out one or two units at prices affordable to someone making 80% of the area median income, they would be eligible for what the city is calling a "density bonus." What other changes are being proposed? The city would update dimensional standards and other requirements so someone could feasibly build the type of housing the new zoning districts would permit. For instance, planners heard from the community and industry experts that setback and per -unit lot area minimums often limit a property owner's options — so the city wants to reduce both standards to allow more flexibility. The proposal also tackles standards for cluster developments, which are groups of multiple 1-to-4-unit dwellings on one lot, with a shared common space like a courtyard. Have other cities passed policies like this? Yes. All this may sound familiar because Minneapolis drew national attention in 2018, when it became the first city in the nation to loosen single-family zoning rules. St. Paul also studied subsequent state laws passed in Oregon and California and drew particular inspiration from changes to Portland, Ore.'s zoning code passed in 2021. In Minneapolis, the changes have been slow to catch on. The city is in the process of updating its zoning code standards to align with the broader changes. After reviewing feedback, the commission will decide whether to recommend the zoning amendments to the City Council. The public would have another chance to weigh in on the proposed changes at a council hearing, likely in late spring or early summer. After that, if the council votes in favor of the changes, the city would likely update some of its processes to reflect the new laws. City planners acknowledged that financing and building code requirements can create challenges for small-scale projects, which may not be viable for large developers looking to make a market rate return of 15% or more, according to the memo. If the changes pass, staff said they would look for ways to engage and empower small-scale developers and homeowners, who could use the additional units to house a relative or earn extra income. "We know construction costs are very expensive," Planning Director Luis Pereira said. "So will this encourage some folks across the city to consider investing in an additional unit on their property, or converting what they have now?" "We expect this to continue to evolve as the market changes, as preferences change, as the population ages, as the population gets more diverse," he said.
