7 Mayor Lindstrom welcomed Officer Torres to the Mounds View Police Department. He expressed
8 that he looks forward to having her as a member of the Police Departments and wished her well at
9 the City of Mounds View.

29 A. Lynette Harris — Care #4All Youth Haven.

31 Lynette Harris, Care #4A11 Youth Haven representative, thanked the Council for their time. She
32 provided the Council with further information on the services and transitional housing that was
33 provided by her organization to the youth in the community.

35 Mayor Lindstrom asked if the kids served were typically not in school. Ms. Harris reported this
36 was the case, noting many of the kids have to be redirected back to school or other employment
37 training. She commented further on the work she does with the Bush Foundation.

39 Mayor Lindstrom thanked Ms. Harris for her presentation and for the great work she was doing on
40 behalf of the community.

42 B. Public Informational Meeting — Silver View Storm Water Pond.
43
44 Public Works/Parks and Recreation Director Peterson provided the Council with information on
45 the Silver View storm water pond. He explained this this was the second meeting regarding this
46 topic, noting the first was held at the park last September. He reviewed aerial photography of the

1 pond, noting this pond was originally an agricultural ditch. He discussed how the City has been
2 working with Stantec to study and analyze this pond. He reported staff recently met with the
3 watershed district to discuss potential grant opportunities.

5 Dan Edgerton, Engineer with Stantec, commented on the modeling that was completed for the
6 proposed pond improvements. He reported two linear bioretention ponds were being
7 recommended for the runoff from the parking lot. He explained the existing infiltration basins
8 would be rehabilitated and spot dredging would be completed.
9
10 Sarah Harding, Landscape Architect with Stantec, discussed the vegetation management plans for
11 the Silver View storm water pond and described how the plans would help keep soil in place. She
12 stated the vegetation improvements would also assist in protecting the old growth oak trees.
13
14 Public Works/Parks and Recreation Director Peterson explained costs estimates are being finalized
15 with Stantec. He provided further comment on the infiltration improvements that would be made
16 to the pond and asked for comments or questions from the Council.
17
18 Council Member Meehlhause asked what parts would not be mowed in the future. Public
19 Works/Parks and Recreation Director Peterson described the area that would not be mowed in the
20 future, noting this would be the area from the trail to the pond, not on the house side of the trail.
21
22 Council Member Meehlhause questioned if the box elder trees were considered invasive and would
23 these trees be removed. Ms. Harding reported the box elder trees were considered native flood
24 plain trees and there would be selective removal of these trees. She discussed how the pond bank
25 would have to be stabilized if any trees were removed.
26
27 Mayor Lindstrom requested further information on how alum would be used in the pond. Mr.
28 Edgerton described how alum assisted with address the phosphorous levels within the pond.

30 Council Member Gunn asked if the native plantings would be pollinator friendly. Public
31 Works/Parks and Recreation Director Peterson reported this was the plan.

33 Council Member Gunn inquired how long this project would take to complete. Public Works/Parks
34 and Recreation Director Peterson reported the proposed improvements were long-term in nature
35 and estimated the plans would take two or three years to complete.

37 Karen Arciero, 7417 Parkview Drive, explained she lived right on the pond. She stated once the
38 vegetation was removed, she wondered how the wildlife would be impacted. Public Works/Parks
39 and Recreation Director Peterson reported the work would be done in late fall or during the winter.
40 She indicated no work would be done during the nesting season so as not to impact the water fowl
41 or turtles.

43 Shawn Dorameco, 2628 Lake Court Drive, questioned if the wood on the east side of the pond
44 would be replaced and if this was replaced, would this impact the level of the water in the pond.
45 Mr. Edgerton explained the concrete wall controls the water level and noted the wooden wear acts

1 as a skimmer. He explained the wooden wear does not control the water level. He understood the
2 wooden wear wall was decaying and would be removed and replaced with a concrete wear wall.

4 Gayle Rock, 7413 Park View Drive, stated she lived on the southwest end of the pond. She
5 questioned how the path near her home would be impacted. Public Works/Parks and Recreation
6 Director Peterson indicated he does not have this information at this time.

8 Randy Miller, 7409 Park View Drive, explained he has lived in his home for the past 39 years. He
9 applauded the City's efforts to improve the storm pond and noted he supported the City moving
10 the path. He recommended the deadfall be removed from the pond as well. He discussed how the
11 aerators that were installed in the pond were noisy, noting they work 24 hours per day.

13 Ms. Arciero asked if the sledding hill was part of this conversation. Public Works/Parks and
14 Recreation Director Peterson stated the sledding hill was not part of this project. He recommended
15 the Parks, Recreation and Forestry Commission look at putting the sledding hill back to natural
16 prairie.
17
18 Ms. Arciero explained she would appreciate the sledding hill remaining in place for the children
19 in the neighborhood.
20
21 Public Works/Parks and Recreation Director Peterson reported the next phase of this project would
22 be to finalize the plans and for the City to apply for grants.
23
24 Council Member Meehlhause indicated he has lived in the Park View neighborhood for the past
25 40 years and he appreciated the City's efforts to address the quality of the storm water pond.
26
27 City Administrator Zikmund thanked Public Works/Parks and Recreation Director Peterson for
28 his efforts to address the storm water quality in the City of Mounds View.

30 7. PUBLIC COMMENT

32 Cheryl Hagstrom, property owner in Mounds View, expressed concern with the fact property
33 owners within the community were not being notified of issues that were effecting their properties.

35 8. COUNCIL BUSINESS
36 A. PUBLIC HEARING: Second Reading, Resolution 9880 Private Property
37 Inflow and Infiltration (I&I) Grant Program.

39 Public Works/Parks and Recreation Director Peterson requested the Council hold the second
40 reading and adopt a Resolution regarding the City's private property inflow and infiltration (I&I)
41 grant program.

4 Mayor Lindstrom stated he supported this program moving forward and appreciated the assistance
5 it would provide to Mounds View residents.

9 B. Resolution 9891, Approving the Proposal from WSB for a Park System Master
10 Plan.

12 Public Works/Parks and Recreation Director Peterson requested the Council approve a proposal
13 from WSB for a Park System Master Plan. He stated the City maintains 11 parks with numerous
14 park amenities on over 123 acres of grounds. He discussed how a park system master plan would
15 assist the City with addressing needs analysis and community engagement. It was noted staff
16 recommends the community center be part of this project. The cost proposal for this project was
17 further reviewed and staff recommends approval of the proposal from WSB.

19 Mayor Lindstrom questioned if a task force committee would be created for this project. Public
20 Works/Parks and Recreation Director Peterson reported WSB was recommending a steering
21 committee be created for this project.

23 Mayor Lindstrom asked when work would begin on this project. Public Works/Parks and
24 Recreation Director Peterson noted work would begin in April or May and would be wrapped up
25 by the end of the year.

27 Council Member Meehlhause inquired how the steering committee would be formed. Public
28 Works/Parks and Recreation Director Peterson anticipated user groups and volunteers would be
29 asked to serve on the steering committee, along with members from the Parks, Recreation and
30 Forestry Commission.

35 Council Member Meehlhause stated he fully supported the City moving forward with the creation
36 of a Park System Master Plan.

40 C. Resolution 9890, Organized Trash Hauling Negotiations.

42 City Administrator Zikmund requested the Council adopt a resolution regarding organized trash
43 hauling negotiations. He explained the Council addressed this matter in a workshop last
44 Wednesday. He stated it was staff s recommendation to terminate negotiations at this time and to
45 restart the options committee.

1 Mayor Lindstrom discussed the history of organized collection in Mounds View. He stated the
2 Council first approached this topic in 2015 and at that time Haulers for Choice asked residents to

oppose the negotiations. He explained in subsequent weeks, the Council directed staff to stop
looking into the issue. Since that time, a previous Council wanted to bring back this topic for
further discussion. He stated in March of 2023, this Council directed staff to research and plan for
an organized collection system and the City notified its intention to organize collection in April of
2023. Surveys were sent to residents and in June of 2023 a meeting was held with haulers. He
indicated the City and haulers met on January 4, 2024 and haulers were to provide a final and best
proposal by January 11, 2024. It became clear that the haulers were not prepared to make a
proposal by January 11 and therefore the City notified them that it would establish an organized
collection option committee.
Mayor Lindstrom reported this committee would look at the issue of organized collection and if
the City's collections services should go out for RFP. He commented on January 8, 2024 the
Council established an organized collection option committee and this group met on January 17,
24 and 31, 2024. He noted the City met with the haulers on January 8 to negotiate and the haulers
asked for more time. The City extended the deadline with the haulers until January 31.
Mayor Lindstrom explained on January 19, 2024 the City was served with a lawsuit by Ace and
Walters. He indicated on January 29, subsequent to the January 31 deadline, the City was served
with a temporary restraining order. After a hearing on the restraining order, the judge denied four
out of the five claims and issued an order on the remaining item to continue to negotiate in good
faith. The City continued to negotiate on February 5, 8, 12, 19, 26, 27 and March 5, 2024. All in
all, the City produced 18 drafts of the residential solid waste contract with all parties coming to an
agreement on the written contract on February 26, 2024. Only then would the haulers provide a
price. The haulers said the City had to wait for a price until all of the details were worked out.
Mayor Lindstrom stated when the pricing was provided, the City asked if this was the best and
final proposal. Even though the haulers waited until all of the details were agreed to before
providing a price, but then said they could do better. The City told the haulers that a proposal
would be brought to the Council on March 5, 2024 and explained the City was looking for a best
and final offer. He noted the haulers offered no amended prices. He indicated the March 5 City
Council meeting had to be rescheduled to March 6 because the Council could not meet on an
election day.
Mayor Lindstrom reported notice was sent to all haulers encouraging them to attend the March 6
meeting and explained this would be an opportunity to address the City Council directly. He stated
on March 6 the Council held a work session to discuss the contract to which only one hauler
showed up. He noted the City did not hear from any other haulers. When asked, the hauler in
attendance stated the City had acted in good faith. The Council reviewed a spreadsheet created by
City staff that listed rates being paid by current Mounds View residents along with a spreadsheet
of rates being paid by other organized cities in Ramsey County.
Mayor Lindstrom indicated the haulers had access to both of these documents prior to the meeting.
Due to the pricing being significantly higher than the averages being paid in nearby cities, the
Council directed staff to reconvene the options committee so they could issue a report regarding

1 their findings. The Council did not believe further negotiations were worth the investment in staff
2 and attorney time for several reasons, including the large gap between the hauler proposal rates
3 and other organized cities, and the fact the haulers did not submit a new proposal, even though
4 they stated it was not their best price and that only one of the five haulers appeared the address the
5 Council.
7 Mayor Lindstrom stated Council told staff that the City Council was ready to move on from the
8 contract negotiation. He indicated the Council's efforts paint a very clear picture through 19
9 meetings with the haulers, 18 draft contracts and the Council has been discussing this matter for
10 over a year. He noted the City has held every meeting requested by the haulers, even holding a
11 meeting on a federal holiday and has repeatedly offered to accommodate their needs in any way.

13 Mayor Lindstrom reported the haulers have provided the City with a proposal that they admitted
14 should be better. He explained the City had negotiated in good faith. He commented on the
15 companies that have chosen to align themselves with Haulers for Choice. According to Haulers
16 for Choice's website, Ace and Walter's were participating haulers. Ace and Walters have aligned
17 themselves with a group that has been involved in local politics and were party to intimidating
18 potential candidates if they do not toe the hauler line. In addition, they were encouraging
19 recruitment of anti -organization candidates to run against incumbents, send mailers to residents
20 stating residents were being stripped of their rights and were directly involved in petitions to stop
21 organized collection. He questioned how this was negotiating in good faith and how was the
22 Council to believe these haulers care about the community.

24 Mayor Lindstrom stated haulers have every right to express their opinion about the election, but
25 their actions were showing they were not negotiating in good faith by giving Mounds View the
26 best price. The haulers very publicly don't want the negotiations to be successful and were not
27 giving the City the best price. He indicated the City had to ask why this was occurring. He stated
28 to quote their attorney, are they trying to just protect their book of business. He questioned if it
29 was because the haulers care so deeply about the community they serve. That is what they were
30 telling the City or were they protecting their profits.

32 Mayor Lindstrom commented on the bill analysis that was conducted by the City stating one hauler
33 charges one resident $40 per month for service and another $30 for the same service. He reported
34 Ace charges one customer $46.92 and another customer $25.94. He indicated Republic charges
35 one customer $58.75 and another customer $20.83, while Walters charges one customer $69.69
36 and another $42. He encouraged residents to keep in mind this was for the same tote service.

38 Mayor Lindstrom reported St. Anthony just received a fresh contract in 2023 was paying $18.34
39 for a 65 gallon tote through organized collection. He stated these prices were the lowest when
40 compared to any prices provided by Mounds View residents for the same 65 gallon tote. He asked
41 Mounds View residents what this was about. He asked if it was about providing a service for a
42 good price or for profits. He questioned residents were supportive of the haulers making maximum
43 profits from Mounds View residents or did residents want to come together in order to be treated
44 fairly. He commented on the profits that were generated by Republic, Waste Management and Ace
45 in 2023. He understood Ace and Walters were circulating a letter to residents telling them the
46 Council was trying to take away their rights. He indicated Ace and Walters was sending out anti-

1 organized propaganda in the community which was not acting in good faith.
3 Mayor Lindstrom believed Ace and Walters had zero desire to act in good faith which was why a
4 better offer was not provided to the City. Furthermore, saying the Council doesn't support residents
5 right to choose was erroneous. He explained the Council has unanimously supported every part of
6 the Charter initiative. He discussed how the City has published information in the Mounds View
7 Matters in order to keep the public informed on this topic. To say the City feared the question and
8 was restricting rights was an egregious misrepresentation of the truth. He believed haulers feared
9 putting forth a competitive price would make residents see how badly haulers have been gouging
10 them on price for years. He stated if haulers valued the relationships they have in the community
11 so much, a competitive price should be provided to the City.

13 Mayor Lindstrom explained the Council has stated since the beginning that they wanted to see this
14 through to the end and that a price should be provided to allow for a broader conversation with
15 constituents. He indicated the Council was ready to reject the proposed price because it was not
16 good for Mounds View residents. He asked how the haulers have acted in good faith throughout
17 these negotiations when not all parties were acting in good faith. He stated it was the City's
18 sincerest desire to have a clean and fair process for everyone.

20 Mayor Lindstrom stated for the companies that aligned themselves with Haulers for Choice he
21 hoped the value of this relationship was fully evaluated and that these haulers would consider if
22 they truly acted in good faith with their municipal partners. That being said, he made it crystal
23 clear that the City would like to seek a price from these haulers. He wanted to consider the best
24 and final price from the haulers. He requested the Council table action on this item to terminate
25 negotiations until 12:00 p.m. on March 25 to deliver a final and best offer. He indicated the offer
26 presented to the City should be in line with other organized communities. He encouraged the
27 haulers to look at the rates being offered to Blaine and St. Anthony. He hoped the haulers would
28 bring back a good price for its residents, given the fact Mounds View has the lowest median income
29 in the area. He stated it was the City Council's responsibility to take care of its people. He asked
30 the haulers to be thoughtful about the community and the final price they present.

32 Mayor Lindstrom asked for comments from the public. There were none at this time.

34 Council Member Gunn thanked the Mayor for his comments.

36 Council Member Meehlhause thanked the Mayor for his comments as well

39 2024 City Council meeting requesting haulers to submit a revised proposal to the City with a final
40 and best offer by Thursday, March 21, 2024.

9. REPORTS
A. Reports of Mayor and Council.
Mayor Lindstrom reported there would be an Easter egg hunt at Silver View Park on Saturday,
March 30 at 10:00 a.m.
Council Member Gunn stated the Tribute Park Committee would be meeting on Tuesday, March
12 at 6:30 p.m. at City Hall.
Council Member Meehlhause reviewed a list of recent meetings he attended in the Mayor's
absence.
Council Member Meehlhause explained Abiding Savior Lutheran Church has asked the Mounds
View Lions to host a waffle dinner on Wednesday, March 13 from 4:30 p.m. to 6:30 p.m. for an
in kind donation. All proceeds from the event will be donated to the Ralph Reeder Food Shelf.
Council Member Meehlhause commented on Thursday, March 14 he would be attending a Mounds
View Business Council meeting.
Council Member Meehlhause stated he would be attending the 3 on 3 basketball tournament at the
Mounds View Community Center on Thursday, March 14.
Council Member Meehlhause indicated he would be participating in a board member interview
process with NYFS on Thursday, March 14.
Council Member Meehlhause reported on Sunday, March 17 the Community Center would be
celebrating St. Patrick's Day from 3:00 p.m. to 6:00 p.m. and the Mounds View Lions would be
serving corned beef, cabbage and carrots. The cost for the event is $10 per adult and $5 for children
under the age of 10.
Council Member Meehlhause stated the Twin Cities Gateway board would be meeting next on
Tuesday, March 19.
Council Member Meehlhause explained on Wednesday, March 20 he would be attending an NYFS
finance committee meeting with City Administrator Zikmund.
Council Member Meehlhause reported a City Council Candidate Forum would be held on
Thursday, March 21 at 7:00 p.m. and 8:00 p.m. for the two candidates running for City Council.
Council Member Meehlhause commented on the dead trees that had been removed from within
Silver View Park. He thanked the Public Works Department for their efforts.

1 Mayor Lindstrom stated on Wednesday, March 13 he would be having a conversation with the
2 City Administrator and Commissioner Frethem to discuss the City's library.

4 Mayor Lindstrom explained the options committee would be meeting on Wednesday, March 20.

6 Mayor Lindstrom reported he would be attending the Met Council's regional conference on Friday,
7 March 22.

11 Finance Director Bauman stated the $21 million conduit debt issuance that began last year would
12 be moving ahead in the next few months.

14 Finance Director Bauman reported work continues on the 2023 audit.

16 Public Works/Parks and Recreation Director Peterson discussed the meter change out project that
17 would begin in the coming weeks. He encouraged residents to test out their shut off valves and to
18 clear the area surrounding their water meters.

21 insurance, noting the City has no association with these organizations.

23 City Administrator Zikmund reported the Council tried to attend the legislative day on the hill for
24 the League of Minnesota Hills where a letter was presented to Representative Muller and Senator
25 Marty on the missing in the middle bill. He commented this bill would allow property owners to
26 put up to 10 houses on a Mounds View lot and prohibits any public comment. He indicated this
27 was a far reaching bill and noted Representative Muller would be opposing this bill.

the two new properties the City of Mounds View purchased. She recommended the racial

2 Robert Edmond, 7835 Groveland Road, commented on the property that was sold or given to
3 Medtronic. He asked if the land had a prior agreement in place that required the land to remain
4 recreational.

6 Assistant City Administrator Beeman explained he has not seen an agreement that would have
7 required this land to remain recreational. He reported the land was previously a golf course.

9 City Attorney Riggs indicated he was not aware of any title restriction either.

1 1 Councilmember Gunn recalled that when Medtronic purchased and built on this land, there was
12 talk that Medtronic would install a walking trail for their employees and all Mounds View residents
13 would be allowed to use this trail. She indicated this was an idea from Medtronic and was not
14 required by the City.

20 City Administrator Zikmund requested the Council consider a chicken -keeping license for Megan
21 Oswald Schwerr at 5381 Jackson Drive. He reported all necessary paperwork and fees have been
22 submitted to the City and staff recommends approval.

28 City Administrator Zikmund provided brief background information on this topic. He explained
29 the Council tabled action on this item two weeks ago and staff was directed to work with the
30 haulers encouraging them to provide a final and best offer. He noted there was a call between the
31 haulers and the City Attorney where this information was conveyed and a deadline was set for
32 March 21 at noon. He reported the haulers did come through with an offer and the haulers met at
33 City Hall today from 9:00 a.m. to 11:00 a.m.

35 City Attorney Tierney reported the Council directed staff to request a best and final offer from the
36 haulers. She explained the City received a letter on Thursday stating the haulers would not be
37 submitting an offer, but they would welcome an offer from the City. Staff developed an offer from
38 the City based on comparable cities with organized collection (St. Anthony, White Bear Township,
39 Vadnais Heights). She indicated this offer was presented to the haulers and she had hoped the
40 haulers would take this offer. However, at 3:00 p.m. today the City received a counteroffer from
41 the haulers.

43 City Attorney Tierney stated the counteroffer was reviewed and the prices were compared to the
44 three comparable cities (St. Anthony, White Bear Township, Vadnais Heights). She indicated the
45 offer from the haulers was interesting as it changed the structure of the proposal in a meaningful
46 way. She stated the proposal provided a fee for picking up the trash throughout the City but then

1 proposed the City pay the disposal fee. She reported this would increase the overall fees charged
2 by the City to residents and would increase administrative time to manage garbage hauling. She
3 explained throughout the negotiation process, the City has made it clear to the haulers that they
4 were to make their money on the actual picking up of the trash and not the disposal. She stated
5 the proposed bid would have the haulers sending out bills for half of the work and the disposal fee
6 would then have to be charged by the City.
8 City Attorney Tierney indicated comparisons were run for the prices from the haulers and a
9 spreadsheet was provided to the Council. She reviewed this spreadsheet in further detail with the
10 Council. Based on this information staff has prepared two Resolutions for the Council to consider.
11 She explained the Council could terminate negotiations with the haulers and pursue request for
12 proposals. The other option available to the Council would be to continue negotiations with a
13 deadline of May 13.

15 Mayor Lindstrom asked if the City Attorney had ever seen a contract where the haulers require the
16 City to pay the disposal fee. City Attorney Tierney stated this was not unheard of. She indicated
17 the City of White Bear Lake has this arrangement. However in this case, it appears that White
18 Bear Lake is paying the disposal rates, versus passing them along to its residents.
19
20 Mayor Lindstrom indicated the first proposal that was put in front of the City was still higher than
21 what they were charging other cities with the disposal fee. He feared the proposal really missed
22 the mark on where the City was trying to get to and there would be no lowering of costs. He asked
23 how the Council wanted to proceed with this matter.

25 MOTION/SECOND: Meehlhause/Gunn. To Waive the Reading and Adopt Resolution 9890,
26 Ending Negotiations with the Current Licensed Haulers and Directing Staff to Convene the
27 Organized Collection Options Committee.

29 Council Member Meehlhause explained the City was asked to make a counter offer from the
30 haulers original offer. He stated this rate was similar to the rate charged to the City of St. Anthony
31 and the haulers choose to not support this offer. This said to him that further negotiations would
32 not lead to the St. Anthony pricing.

34 Mayor Lindstrom reported the City has been clear about its expectations. He expressed frustration
35 with the fact the haulers came back to the City saying they were going to do nothing. He did not
36 see that the haulers were making substantive movement in the right direction and therefore he
37 supported the City ending negotiations.

42 A. Reports of Mayor and Council.

44 Council Member Meehlhause reported he attended the Twin Cities Gateway board meeting last
45 week. He discussed the year end financials for this organization noting he was pleased to report
46 revenues were up. He explained the City would be receiving $10,680 from the visitor's bureau in

1 2024. He thanked the visitor's bureau for their tremendous efforts to draw people into the
2 community. He commented further on how the board officer positions would now be a two year
3 commitment.
5 Mayor Lindstrom reported the Festival in the Park Committee would be hosting an Easter egg hunt
6 on Saturday, March 30 at 10:00 a.m. at Silver View Park.
8 Mayor Lindstrom explained he attended a meeting with Arden Hills Mayor Grant and
9 Councilmember Rousseau to discuss recreational programming and potential partnerships. In
10 addition, he had a discussion with Arden Hills Councilmember Monson regarding organized trash
11 collection.

13 Mayor Lindstrom then read a letter in full for the record to the citizens of Mounds View. He stated
14 organized collection...

16 "To the citizens of Mounds View,
17 Organized collection has been a hot topic as of late, and we have spent a lot of time talking about it. I
18 realize you are tired. I'm tired, and we are tired. At the last meeting, I laid out the timeline of events
19 up until that meeting. Since then, I have received a letter from the president of Walters, Mike Moroz,
20 stating,
21 "Mayor Lindstrom, I am writing on behalf of the Mounds View Haulers to acknowledge your speech
22 given at the Mounds View City Council meeting on Monday, March 1 lth, 2024. Please be advised
23 that the Mounds View hauler group will meet to discuss the draft contract and pricing for proposed
24 waste services. We understand that our response must be delivered to the city by Thursday, March
25 21, at 12 p.m., and it is our goal to meet that deadline. "
26 The haulers subsequently met on 3/18 and came back with an offer on the afternoon of 3/20 stating
27 that they would not lower the price but were open to offers, so we submitted the St. Anthony pricing,
28 which we believe is fair based on the fact we are similar cities, and they have a new contract.
29 The haulers met again today and gave us another proposal and though it was better; it is higher than
30 the average cost per tote with the exception of the 35 gallon of all the cities that we looked at in an
31 organized environment in Hennepin and Ramsey County. It is not the St Anthony pricing we asked
32 for. We believe that our pricing should be in line with or better than theirs since we are a denser city
33 with a similar easy access footprint.
34 The Haulers were unable to get there, further reinforcing the fact that we are at an impasse in this
35 negotiation. We made it crystal clear what we wanted and that we are not going to continue a back
36 and forth with them. We appreciate their efforts, but they simply are not good enough for our city
37 and in my opinion it's time to move on.
38 We also received another mailer from haulers for choice, this time with some amped-up rhetoric and
39 pictures and phone numbers of council members. Which has been characterized on social media as
40 dehumanizing tactics.
41 I now want to take some time to talk about each member of this council, starting with the man
42 "leading the charge," according to our most recent mailer, Councilmember Meehlhause.
43 Gary has lived in Mounds View for over 40 years; he raised his children here. He has been on
44 council for close to 12 years and was on various commissions for over a decade prior to that. Gary is
45 also a member of the Lions and has helped with Festival in the Park and the Police Foundation over
46 the years.

1 He most recently volunteered at the Community Center for the 3-on-3 basketball tournament. Gary is
2 a guy who cares deeply about this community and has given countless hours of time for absolutely
3 nothing. Has Gary said some things over the years that could have had a little more polish on them?
4 Sure, we all have, but do we really think that a person who lives in this community, serves this
5 community, and is as dedicated to the community as Gary; has bad intentions for this city?
6 You may not agree with his vision, but do you think it's coming from a place with bad intentions, or
7 do you think that he truly believes that he is doing what he thinks is best for the community he lives
8 in, serves in, and is invested in? I want you all to really think about this.
9 Next, I will move on to Councilmember Gunn. She grew up in this area, raised her children here, and
10 has been involved with most groups and organizations in the city at some point in time or another. By
11 the time her term is finished, she will be the longest -serving elected official in the history of this city.
12 When you think about Sherry, you think about her working at Irondale with either you or your
13 children.
14 There is a resident I have gotten to know who says Sherry is like a second mother to her. She, like
15 Gary, donates countless hours of time every year to this city and its people. I saw Sherry on trunk or
16 treat night at the community center, serving punch and water by herself while 1100 people walked
17 through the building that night with a smile on their faces, she was purely enjoying the joy in the
18 room.
19 Does this sound like someone who hates you and wants to be some type of maniacal overlord of the
20 city, or do you think maybe she does what she thinks is best for the city because she cares about this
21 community and its people? I want you to really think about this.
22 On to Councilmember Cermak, she, like the other 2 councilmembers, has been a long-term resident,
23 raised her family here, and put in endless hours of donated time into this community. Theresa ran the
24 festival in the park for 25 years for literally nothing other than the joy of doing it. I can tell you that
25 the event is a lot of work, and it literally takes a year to plan, and she did it year after year after year
26 after year.
27 She is active in the Police Foundation and has been since its inception, and she prides herself on
28 working collaboratively on many of their events. In a conversation with her just the other day, she
29 was already talking about the Daddy -Daughter Dance for next year.
30 Do you really think that someone who has been involved with the city for close to 30 years and who
31 is already thinking about the next Daddy Daughter Dance wants to leave the city in a worse place
32 than she found it? Or do you think she may care about this community and is doing what she thinks
33 is best? I want you to really think about this.
34 Then there is me, the newcomer, who has lived here for almost 11 years. I am raising my two
35 children here, and both of my parents moved here. That's right, my whole family lives here right
36 now. You have elected me twice in the last 2 years, most recently giving me the privilege and honor
37 of serving as Mayor, and I am so humbled and grateful for the opportunity.
38 I have been on the Festival in the Park Committee for the last 3 years. I was on the board of the
39 Alano in town for two years, serving as Vice President and President. I once volunteered to fill in as
40 Santa for the Police Foundation.
41 I publish my version of the minutes of every meeting for you all to read. I post our agendas and
42 packets for you all to see. I engage with you on social media, and I am out there every week with an
43 open invitation to talk to you about whatever is on your mind and act on what I can.
44 I have spoken with many of you at all times of the day and night to make sure I am doing the best 1
45 can to represent you. I most recently responded to a resident at 2 a.m., and they replied to me with a
46 surprise thank you.

1 I love this city! I will ask you: do you think I make the decisions I do because I believe it is what is
2 best for the community, or do you believe what this newest mailer is trying to propagate? I want you
3 to really think about this.
4 You may be asking yourself. Who might be behind these mailers and propaganda? According to our
5 most recent one, it is John M. Kysylyczn. You might be asking who that is. He is the former mayor
6 of Roseville, who served one term from 2000-2004.
7 According to a Star Tribune article, his term was going so well that a group of residents formed and
8 started a movement to get him to resign in 2002. According to his constituency, they said he engaged
9 in "arrogant bullying behavior toward staff members and citizens". They also said he has brought
10 about changes, effectively eliminating the democratic process.
11 A citizen raised a complaint regarding his ethics alleging a conflict of interest due to lobbying at the
12 state capitol, which was not sustained, but then voted to have the city pay his legal fees in that case.
13 Which in turn generated another complaint, and you know how he responded? He voted to abolish
14 the ethics committee.
15 The citizens of Roseville were so enamored by his performance that they rejected him at the ballot
16 box in 2003 and again in 2007. According to a Pioneer Press article, he was then removed as
17 chairman of the 4th congressional district Republican Party in 2012 by members of his own party.
18 So, this is the person who has decided to involve themselves in the fabric of our community.
19 I want you to ask yourself: do you think the four people who are dedicating their lives to this city
20 care more about you and its future?
21 Or do you believe that an out-of-town guy who no investment in our community other than the
22 paycheck he is getting from the haulers he represents, who is clearly a mercenary for hire whose own
23 community said he has a track record of bullying and intimidation and refused to put him back in
24 office on multiple separate occasions?
25 To me, it seems like he is using the trash market to take out his unresolved anger on local
26 governments across the state because he cannot garner enough support to wield the power he would
27 like to in government, so he has resorted to using trash and politics on communities to impose his
28 will. It is for you to decide who has your best interests in mind, and I really want you to think about
29 this.
30 So now we know all the players. We know the haulers; we know the lobbyists; and we know our
31 representatives. Haulers for Choice, in total, has many entries on their website in relation to their
32 influence in cities across the state regarding organized collection.
33 You have to ask yourself. What is at stake here? Is it about preserving your choice, or is it about
34 profits? The open market and competition only work when we have price transparency, and right
35 now, we have none. There is so much inequality out there in pricing; that I can see why they are
36 fighting so hard to preserve it.
37 What this is really about is who controls the price, and the answer is that right now they do, and they
38 want to keep it that way. With a good contract, you as residents will control the price of trash
39 collection in Mounds View, and you are voting on this issue, so the choice is truly yours. I will ask
40 you again, "Mounds View, are the actions we are seeing that of people who care about us? Or does it
41 appear to be something else?
42 You may be asking, What else does Haulers for Choice do besides sending mailers that instill fear
43 and prey on your emotions? Well, most recently in our community, they have been trying to
44 influence one of our candidates for City Council, and to be honest, it's not the lawsuit or the mailers
45 that really bothered me all that much; I consider that part of the job; this is what has crossed the line
46 for me.
47 You elected me to be the leader of this city, and I will not sit back and watch this group use and bully
48 candidates seeking to serve this community for their own gain because they are in a vulnerable

1 position. This is the most disgusting predatory behavior I have witnessed. It's literally abusive at
2 every level to a brand-new person who is seeking office.
3 I have two handwritten letters that were given to candidate Clark written by John. The first one said:
4 "I need names and contact info for Mounds View residents who would like to be quoted in a city-
5 wide mailing along with their photo. Looking to recruit about 6-8 people." (I call this recruitment.)
6 Next, I quote, "I would do a sign just for you. Can be reused. Would do a 2x4 sign." (I call this

bribery.)
"Can tie yourself to the yes vote by placing your sign next to the "vote yes" sign in supporters'
yards" (I call this influencing).
This one is my personal favorite, and I quote, "Looking forward to the Nov 24 election, if you recruit
two people to run in that election and ride this government -managed trash train to the ballot box, you
could find yourself as the majority leader on the council, and you can run the place starting Jan 25
and overhaul the place." (I call this election interference and corruption.)
He also sent an email to candidate Clark asking her to circulate a letter that their attorney sent the city
to "her group."
To Haulers for Choice,
Quite frankly, these are deplorable predatory activities, and they have absolutely no place in Mounds
View with our residents and our candidates. Preying on a brand-new candidate like Julie for your
own gain to influence our election is completely unacceptable and will not be tolerated in this city.
To try to bribe her, get her to recruit for you, and leech on her hard work to build a group for your
own gain is just plain disgusting. To be clear, Julie gave me and the city attorney the correspondence
that you have been sending her. You have taken advantage of the fact that she is in an impossible
situation with a ballot question looming, trying to manipulate her, and trying to influence her
campaign for your own gain to steer the outcome of this election.
You know that she cannot say anything for fear of you torpedoing her campaign and ending her
dreams of serving this community. She may not be in a position to say something to you, but I am,
and if you do not understand what that means, I will spell it out for you. Candidate Clark does not
want to be a party to your activities, propaganda, or influence. I am going to respectfully ask you to
cease and desist from all further communications with her and leave her alone.
Just to shore it up for you again, this is not a good look for your organization or your clients. You
may want to consider changing your name from Haulers for Choice to Haulers for Profits. In my
opinion, it's actually quite pathetic that you would stoop to this level of preying on a new candidate
to try to achieve your desired outcome but given your history it fits your behavior pattern of
"bullying and intimidation" going all the way back to the early 2000's according to your own
constituents.
I know that you are going to try to find some people to run against us in the fall, and I hope that any
resident of Mounds View will have the good sense to see just how disingenuous this whole scheme is
and turn you down. I will also let you know that if those candidates emerge, I am ready and will be
happy to make sure that this community knows exactly who they are attached to and exactly what
you are about.
I know Mounds View is better than this, and I know that this community will not stand for this kind
of influence and corruption in our elections. If you are sick of these tactics and propaganda in our
community, I would encourage all residents of Mounds View to kindly mail Garbage Haulers for
Choice a cease -and -desist letter requesting no more mailing solicitations to their address at Po box
13738, Roseville, MN 55119.

I will close with this and say that We want you to know that the easiest thing to do would have been
to say nothing and just let this story play out like it has in city after city with haulers for choice

1 running propaganda and playing the games that they do and allowing them to bully their way to the
2 ballot box unchecked, but we cannot do that.
3 We cannot have someone bullying and preying on the candidates and residents of this city without
4 taking a stand and fighting to the end. We will most certainly see heavy opposition this fall, even
5 more tasteless mailers, and possibly some well -funded candidates. We know that taking this stand
6 could mean the end of our political careers, and if it does, we're ok with that because we know this is
7 the right thing to do.
8 I will also say it says a lot about Candidate Clark to have the guts, and integrity to bring this forward
9 knowing that this too could cause an onslaught from haulers for choice against her and cost her the
10 election and dash her dreams of serving this community. If that happens now you know why, and I
11 hope you will see through it and judge her on her merits and make your decision independent of any
12 propaganda from haulers for choice.
13 We as a council support your right to choose and we are encouraging you to vote in the special
14 election. A yes vote to the charter amendment will ensure the power to go organized stays in your
15 hands. We just want this to be a fair and honest choice, and with all the propaganda and tactics going
16 on in this election you needed to know the whole picture.
17 2 weeks ago, you learned the timeline, and the efforts we have made to be a good municipal partner.
18 Now you know the attempts to influence the outcome of this election that have been taking place. In
19 the end, whatever the outcome is, we are good with it. We all love this city, and we love all the
20 people in it.
21 We may not always agree on everything, but we care deeply about all of you and the future of this
22 city. We are asking you to whether the storm with us, and wherever we end up, we are completely ok
23 with it, but we are asking that we do it together and not let this group and these companies take
24 advantage of us.
25 We know that together we will get to the right decision and outcome independent of their messaging,
26 propaganda, and mafia style tactics, and we look forward to doing that with you! Thank You Mounds

Human Resources Director Ewald stated each year the Council considers nominations for Citizen
of the Year. She reported nominations are accepted all year long and a selection is made in the
spring of each year. She requested the Council review the Citizen of the Year candidates and make
a recommendation to staff.
Council Member Meehlhause reported he supported Candidate C.
Council Member Gunn supported Candidate A.
Council Member Cermak recommended Candidate A as well.
Mayor Lindstrom indicated he was indifferent and could support Candidate A.
Council Member Gunn commented on the connection Candidate A had with the community and
what this candidate has accomplished as a woman.
Mayor Lindstrom agreed Candidate A had significant achievements, as has Candidate C.
City Administrator Zikmund reported the Council could elect to have two Citizens of the Year.
Council Member Gunn and Council Member Meehlhause supported Candidate A and Candidate
C being named Citizen of the Year.
Council Member Cermak questioned if the City had awarded a Citizen of the Year Award to a
candidate that was no longer living.
Council Member Meehlhause stated this had been done in the past for Betty Wahl (2017) and Jerry
Skelly (2011).
Council Member Cermak indicated she could support Candidates A and C for Citizen of the Year.
2. Legal Notices on City Website.
City Administrator Zikmund stated a Mounds View resident requested the City post legal notices
on the City's website as well as in the City's official newsletter. He explained this would provide
residents with another avenue to read through the notifications without having to pay for a
newspaper subscription.
City Attorney Riggs reported this was something the legislature has not brought forth yet, but
noted it was standard to post legal notifications on City websites. He indicated this change would
provide the public with more communication from the City.
The Council supported posting legal notices on the City's website.
City Administrator Zikmund reported he met with Howard Pastor from Pastor Enterprises today.

Item Title/Subject: Resolution 9897 Accepting the 2024 Twin Cities Gateway Grant
Introduction
Since 2009, the City of Mounds View has been a member of the Twin Cities Gateway. One of
the Twin Cities Gateway's programs is the "Member City Marketing Grant." Beginning in 2011,
the program was structured so that each member city receives an annual grant based on the
percentage of lodging taxes collected from the prior year.
Discussion
As part of accepting the grant funds, the City Council is required to enter into the attached
agreement. Upon accepting the grant, the City must disperse the funds to community festival(s),
and/or event(s) the City Council wants to support. The amount received in 2023 was $10,090.
Approximately $3,600 of this was applied toward Community Center marketing with the balance
going toward the Festival in the Park.
Recommendation
Staff recommends approving Resolution 9897, accepting the Twin Cities Gateway 2024 Member
City Marketing Grant, and applying the grant funds towards the marketing and promotion of the
2024 Festival in the Park and the Mounds View Community Center.

RESOLUTION ACCEPTING THE 2024 TWIN CITIES GATEWAY MEMBER CITY

WHEREAS, the City of Mounds of View is a member of the local Convention and Tourism
Bureau, Twin Cities Gateway; and
WHEREAS, the City of Mounds View has enacted a tax on lodging within the City to help
fund Twin Cities Gateway, along with nine other member cities, in accordance with Minnesota
Statutes Section 469.190; and
WHEREAS, Twin Cities Gateway Member City Marketing Grant program provides each
member city with an annual grant based on the percentage of lodging taxes collected from the
prior year; and
WHEREAS, upon the executed "Mounds View 2024 Member City Grant Agreement"
between Twin Cities Gateway and the City of Mounds View, the City will receive $10,620.00 in
grant funding in 2024; and
WHEREAS, the City of Mounds View is responsible to disperse the grant funds to the
community festival(s) and/or events that the City wants to support; and
WHEREAS, the grant funds shall be used for marketing and promotional efforts that
extend beyond the City's borders in order to draw tourists to the community,
NOW, THEREFORE BE IT RESOLVED, that the Mounds View City Council does hereby
accept the 2024 Twin Cities Gateway Member City Marketing Grant in the amount of $10,620.00,
for the marketing and promotion of the Mounds View Festival in the Park Celebration and the
Mounds View Community Center.

Mounds View 2024 Member City Grant Agreement
This Agreement between the City of Mounds View, 2401 Mounds View Blvd., Mounds View,
MN 55112, hereinafter the "City," and Twin Cities Gateway, a Minnesota non-profit
corporation, 7071 University Avenue NE Fridley, MN 55432, hereinafter the "Bureau," contains
the terms and conditions for a grant to the City in the amount of $10,620 from the Bureau.
Whereas the grant funding provided is based on local option lodging taxes collected by the City
and the nine other member cities of the Bureau and
Whereas the City agrees to expend the grant funding in compliance with MN Statute 469.190
which states the proceeds shall be used for the purpose of marketing and promoting the City as
a tourist or convention center and
Whereas the Bureau has specified that grant funds must be used for advertising, marketing,
and promotional efforts to increase participation, attendance, or visitation to an event, activity,
or facility located within the City, and / or to add new activities to enhance existing events, and
Whereas the Bureau specifies that advertising, marketing, and promotional efforts for which
said grant funding is used must extend beyond the borders, or boundaries of the City and
Whereas it is agreed that prior to December 31, 2024, the City will provide an overview of
how the Bureau grant funding was utilized and, in accordance with this Agreement,
documentation of actual expenses by providing copies of actual receipts or invoices.

WHEREAS, in 1872, J. Sterling Morton proposed to the Nebraska Board of Agriculture
that a special day be set aside for the planting of trees, and
WHEREAS, This holiday, called Arbor Day, was first observed with the planting of more
than a million trees in Nebraska, and
WHEREAS, Arbor Day is now observed throughout the nation and the world, and also
WHEREAS, Earth Day is an annual event on which day, events worldwide are held to
demonstrate support for environmental protection, and
WHEREAS, each year, Arbor Day is celebrated on the last Friday in April, and Earth
Day is observed every April 22; and
WHEREAS, Trees and forests improve our physical health by cleaning the air, reducing
exposure to the sun's UV rays, and decreasing temperatures during the summertime;
and
WHEREAS, Forests create high -quality drinking water by acting as a natural filter; and
WHEREAS, in 50 years, one tree provides $62,000.00 worth of air pollution control; and
WHEREAS, Trees and forests improve our mental health by reducing stress and
increasing concentration; and
WHEREAS, Getting a daily dose of trees is healthy for all Mounds View Residents and
all Minnesotans; and
WHEREAS, Minnesotans pay a special tribute to rural and community trees and all the
natural resources, and dedicate themselves to the continued vitality of our state's
forests.

Introduction: Chapter 90.005 of the Mounds View Code allows limited and controlled raising and
keeping of chickens and/or ducks on properties zoned R-1, Single Family. Jeffrey Hedstrom has
submitted an application to raise and keep chickens on his property.
Discussion: The applicant, Jeffrey Hedstrom, has submitted an application to raise and keep
chickens on his property located at 7748 Woodlawn Drive. The City Code allows for up to twelve
chickens at one time and requires that backyard areas within which the chickens roam be
fenced. Mr. Hedstrom has indicated that he plans to raise and keep eight chickens at this time.
The chickens will have a designated fenced area in the rear yard. The submitted site plan
indicates that the chicken coop will have the required minimum 20 foot setbacks from all property
lines. It appears Mr. Hedstrom meets all requirements of Chapter 90.005.
If issued, this will be the 14t" chicken -keeping license that is current in the City. We also have
three more applications being processed at this time.
In accordance with Chapter 90.0005, initial applications shall be considered by the City Council after
holding a public hearing. Approval of renewal applications are done administratively unless the City
has received substantial complaints or related violations have been documented during the previous
year.
As required, staff has published a public hearing notice in the March 27, 2024, edition of the St. Paul
Pioneer Press, the City's official newspaper. In addition, as required, notices were mailed to
residents within 350 feet of the subject property.
Mr. Hedstrom has indicated that he will be present at the City Council Meeting/Public Hearing to
answer any questions you may have.
Strategic Plan Strategy/Goal: Our ordinance and this application are consistent with the Vision
Statement, "...welcoming a desirable destination to all ages and cultures... and a place where
residents can live, work and play."
Financial Impact: None
Recommendation: Staff recommends opening the public hearing for comment and approval of
Resolution 9898 approving a chicken -keeping license for Jeffrey Hedstrom This is an annual
license, January 1 to December 31.

2. Limit of a total of 12 chickens and/or ducks
3. New chicken/duck keeping permits require a public hearing (notices will be mailed to all property owners with 350 feet of applicant's
property) and approval by the City Council
4. Annual renewal permits may be approved administratively unless there have been substantiated complaints or related violations during
the previous year

6. Zoning permit if the coop will be a new structure. The coop must meet all accessory building requirements in Section 1106.06 of the
Zoning Cod
No more than 3 accessory buildings are allowed per property (this includes all garages, sheds and coops)
Maximum of 1,800 square feet total of accessory building per property.
Coop Structure and Bird Containment Requirements:
1. Cool structures must be set back at least 20 feet from all property lines and the applicant's house,
2. Coop structures shall only be located in rear yards,
3. Backyard areas within which chickens or ducks are allowed to roam shall be fenced to confine the birds to applicant's property (zoning
permit required for new fences).
Additional Requirements:
1. No roosters or drakes allowed,
2. No slaughtering or beheading of the birds is permitted,
3. Food shall be stored in a watertight, rodent -proof container.

Subject: Resolution 9892, Resolution to Consider an Individual Therapeutic
Massage License for Crystal Noon, Minnesota Muscle Recovery,
LLC.
Introduction:
Mounds View City Code requires that the practice of therapeutic massage in the City of
Mounds View requires a City license. Crystal Hoon of Minnesota Muscle Recover, LLC
in St. Paul is applying for an individual therapeutic massage license to practice
therapeutic massage in the City of Mounds View.
Discussion:
Ms. Hoon of Minnesota Muscle Recovery, LLC, has applied for an individual therapeutic
massage license. Her intensions are to conduct continuing education classes at the
Mounds View Community Center for graduate students of massage programs or other
bodywork fields.
Ms. Hoon is currently the dean of students at the Massage School in St. Paul. She has
been running the school, teaching, operating the student clinic, and managing the
student body since a few months after the school opened in 2016.
She also has her own business in the City of St. Paul, Minnesota Muscle Recovery,
LLC. She is the sole proprietor of the business. She has expressed, however, that she
would like to bring her instructional classes to her home community as she presently
lives in the City of Mounds View. This would be the first of her continuing education
workshops.
Mounds View City Code states that individual licenses for therapeutic massage
therapists are required to be affiliated with an enterprise license issued by the City.
However, since her business is located in the City of St. Paul, she would not have an
enterprise license here in Mounds View. She does currently have a license with the
City of St. Paul that has been verified.
Ms. Hoon has provided the information required on the application in addition to the
following items listed in Chapter 114 of the Mounds View City Code:
Evidence that the applicant:
Has legal work status in the United States. Applicant is self-employed at
Minnesota Muscle Recovery, LLC (1.5 years to date) and Instructor for eight

years at The Massage School in St. Paul. Also self-employed at Awaken for
Wellness in St. Paul for 1.5 years.
2. Has a diploma or certificate of graduation from a recognized school. Transcripts
attached.
3. Has insurance coverage with liability limits of at least $1,000,000 for professional
liability in the practice of massage. Copy of insurance certificate is attached.
The City of Mounds View would be added as an additional insured should her
license be approved.
4. Is affiliated with, employed by or owns a therapeutic massage enterprise licensed
by the city. The is where the City Council has to determine if we want to issue an
individual license because Ms. Hoon is not affiliated with an actual enterprise
license located in the City. The Code states that a therapist license cannot be
issued to someone who does not hold, a therapeutic massage enterprise license.
But again, she does hold one with the City of St. Paul. (Copy attached). The City
may want to consider revising the City Code Chapter 114 to specifically address
these types of extended continuing education classes and workshops.
5. In addition to the 70 hours of resident study, applicant must complete at least 400
hours of certified therapeutic massage training as part of earning a diploma or
certificate from a recognized school.
6. Has at least one year of experience practicing massage therapy as established
by an affidavit.
I would also like to note that the City Code, Chapter 114, also states, "A licensed
therapeutic massage therapist may perform on -site massage at a business, public
gathering, private home or other sites not on the therapeutic massage enterprise
premise." The applicant has also expressed interest in participating in the Mounds View
Festival in the Park. We can request additional information from the applicant regarding
this matter should Ms. Hoon decide to pursue this possibility.
Ms. Hoon has paid the required permit fees and received a satisfactory report from the
Mounds View Police Department regarding her criminal background check.
Just a reminder that the City Council must grant or deny the application within 120 days
receipt of her license application.
In accordance with the City Code, this license would expire on December 31, 2024 and
would be renewed annually.
Recommendation:
Staff recommends the consideration of Resolution 9892. Staff also recommends taking
a look at therapeutic massage therapist licenses that are long-term to provide for more
mobile -type activities and class instruction where the enterprise business is not located
within Mounds View city limits.

RESOLUTION APPROVING A THERAPEUTIC MASSAGE
THERAPIST LICENSE FOR CRYSTAL HOON
WHEREAS, the City Code requires that a massage therapist must be licensed to
perform massage therapy in the City of Mounds View; and
WHEREAS, Crystal Hoon is applying for a Therapeutic Massage Therapist License
to conduct continuing education classes at the Mounds View Community Center; and
WHEREAS, the City Code requires that the applicant have one year of experience
practicing massage therapy as established by an affidavit and can document that the
applicant has completed seventy (70) hours of resident study and an additional four
hundred (400) hours of certified therapeutic massage training from a recognized school;
and
WHEREAS, Ms. Hoon has completed the necessary application materials, provided
proof of massage training hours and proof of legal status to work in the United States; and
WHEREAS, Crystal Hoon has a satisfactory criminal background check report by the
Mounds View Police Department; and
WHEREAS, Ms. Hoon shall provide evidence of liability insurance coverage in
accordance with Mounds View City Code.
NOW, THEREFORE BE IT RESOLVED that an individual therapeutic massage
therapist license be issued to Crystal Hoon.
BE IT FURTHER RESOLVED that the license may be revoked or denied by the City
Council based on negligence, nuisance, or violation Chapter 114 of the Mounds View City
Code.
BE IT FINALLY RESOLVED that the license will expire December 31, 2024, and
shall be renewed annually.

THERAPEUTIC MASSAGE
§ 114.001 FINDINGS.
It is found and determined that:
(A) Persons who have recognized and standardized training in therapeutic massage, health and
hygiene provide a legitimate and necessary service to the general public;
(B) Health and sanitation regulations governing therapeutic massage enterprises and massage
therapists will minimize the risk of the spread of communicable diseases and promote health and
sanitation;
(C) License qualifications for therapeutic massage enterprises and massage therapists will
minimize the risk that the businesses and persons may facilitate prostitution and other criminal activity
in the city; and
(D) Massage services provided by persons without recognized and standardized training in
massage can endanger citizens by facilitating the spread of communicable diseases, by exposing
citizens to unhealthy and unsanitary conditions and by increasing the risk of personal injury.

§ 114.002 DEFINITIONS.
For the purpose of this subchapter, the following definitions shall apply unless the context clearly
indicates or requires a different meaning.
CLEAN. The absence of dirt, grease, rubbish, garbage and other offensive, unsightly or extraneous
matter.
IN GOOD REPAIR. Free of corrosion, breaks, cracks, chips, pitting, excessive wear and tear, leaks,
obstructions and similar defects.
IN THE CITY. Physical presence as well as telephone referrals such as phone -a -massage
operations in which the business premises, although not physically located within the city, serves as a
point of assignment of employees who respond to requests for services in the city.
MASSAGE. The rubbing, stroking, kneading, tapping or rolling of the body of another person with
the hands for the purpose of physical fitness, health care referral, relaxation and for no other purpose.
OPERATE. To own, manage or conduct, or to have control, charge or custody over.
RECOGNIZED SCHOOL. Any school or institution of learning which has for its purpose the teaching
of the theory, method, profession or work of a massage therapist that requires a resident course of
study that requires not less than 70 hours before the student is issued a diploma or certificate of
graduation. If the school or institution is located in the United States, it must have current membership
in good standing in the American Massage and Therapy Association or other recognized professional
massage organization. If the school or learning institution is located outside of the United States, the
applicant must provide the city with decipherable documentation that shows that he or she attended a
school or learning institution that is equivalent to attending a school or learning institution in the United
States in both its course of study and diploma or graduation requirements. Schools offering a
correspondence course not requiring actual physical attendance of class shall not be deemed a
RECOGNIZED SCHOOL.
THERAPEUTIC MASSAGE ENTERPRISE. A place of business providing massage services to the
public for consideration: the term does not include a hospital, sanitarium, rest home, nursing home,
boarding home or other institution for the hospitalization or care of other human beings duly licensed
under the provisions of M.S. §§ 144.50 through 144.69, as they may be amended from time to time.
THERAPEUTIC MASSAGE THERAPIST. A person who practices or administers massage to the
public for consideration.

§ 114.003 LICENSE REQUIRED.
(A) Therapeutic massage enterprise. It is unlawful to operate, offer, engage in or carry on massage
services in the city without a therapeutic massage enterprise license.
(B) Therapeutic massage therapist license. It is unlawful to practice, administer or provide massage
services in the city without a therapeutic massage therapist license.

§ 114.004 EXEMPTIONS.
A therapeutic massage enterprise license or therapeutic massage therapist license is not required
for the following persons and places:
(A) Persons licensed by the state to practice medicine, surgery, osteopathy, chiropractic, physical
therapy or podiatry; provided that, the massage is administered in the regular course of the medical
treatment not provided as part of a separate and distinct massage business;
(B) Persons licensed by the state as beauty culturists or barbers; provided, the persons do not hold
themselves out as giving massage treatments and provided that massage by beauty culturists is
limited to the head, hand, neck and feet and the massage by barbers is limited to the head and neck;
(C) Persons working solely under the direction and control of a person duly licensed by the state to
practice medicine, surgery, osteopathy, chiropractic, physical therapy or podiatry;
(D) Places licensed or operating as a hospital, nursing home, hospice, sanitarium or group home
established for hospitalization or medical care; and
(E) Athletic coaches, directors and trainers employed by public or private schools.

§ 114.005 GENERAL RULE.
The owner or operator of a licensed therapeutic massage enterprise may employ only licensed
therapeutic massage therapists to provide massage services. The owner or operator of a licensed
therapeutic massage enterprise need not be licensed as a therapeutic massage therapist unless that
owner or operator personally provides massage services.

§ 114.006 LICENSE APPLICATION.
(A) Therapeutic massage enterprise. The application for a therapeutic massage enterprise license
must contain the following information:
(1) For all applicants:
(a) Whether the applicant is an individual, corporation, partnership or other form of
organization;
(b) The legal description of the premises to be licensed together with a plan of the area
showing dimensions, location of buildings, street access and parking facilities;
(c) The floor number, street number and rooms where the massage services are to be
conducted;
(d) Whether all real estate and personal property taxes that are due and payable for the
premises to be licensed have been paid and, if not, the years and amounts that are unpaid;
(e) If the application is for premises either planned or under construction or undergoing
substantial alteration, the application must be accompanied by preliminary plans showing the design
of the proposed premises; if the plans for design are on file with the Building Inspector, no plans need
be submitted;
(f) The name and street address of the business if it is to be conducted under a designation,
name or style other than the name of the applicant, and a certified copy of the certificate required by
M.S. § 333.02, as it may be amended from time to time;
(g) Written consent of property owner, if applicant is not the property owner; and
(h) Other information that the City Council may require.
(2) For applicants who are individuals:
(a) The name and date of birth of the applicant and the applicant's residence address;
(b) If the applicant has ever used or been known by a name other than the applicant's name
and, if so, the name or names and information concerning the dates and places where used;
(c) Residence addresses of the applicant during five years preceding the date of application;
(d) The type, name and location of every business or occupation the applicant has been
engaged in during the preceding five years;
(e) Names and addresses of the applicant's employers for the preceding five years;
(f) If the applicant has ever been convicted of a felony, crime or violation of an ordinance other
than a minor traffic offense; if so, the applicant must furnish information as to the time, place and
offense involved in the convictions; and
(g) If the applicant has ever been engaged in the operation of massage services; if so, the
applicant must furnish information as to the name, place and length of time of the involvement in the
activity.
(3) For applicants that are partnerships:
(a) The names and addresses of general and limited partners and the information concerning
each general partner described in division (A)(2) above;
(b) The managing partners must be designated, and the interest of each general and limited
partner in the business must be disclosed; and
(c) A true copy of the partnership agreement must be submitted with the application, and if the
partnership is required to file a certificate as to a trade name under M.S. § 333.02, as it may be
amended from time to time, a certified copy of that certificate must be submitted. The license if issued
will be in the name of the partnership.
(4) For applicants that are corporations:
(a) The name of the organization, and if incorporated, the state of incorporation;
(b) A true copy of the certificate of incorporation, and, if a foreign corporation, a certificate of
authority as described in M.S. § 303.02, as it may be amended from time to time;
(c) The name of the general manager, corporate officers, proprietor and other person in charge
of the premises to be licensed, and the information about those persons described in division (A)(2)
above;
(d) A list of the persons who own or have a controlling interest in the corporation or organization
or who are officers of the corporation or organization, together with their addresses and the
information regarding the persons described in division (A)(2) above.
(B) Therapeutic massage therapist. An application for a therapeutic massage therapist license must
contain the following information:
(1) The applicant's name and address;
(2) The applicant's current employer;
(3) The applicant's employers for the previous five years, including employer's name, address
and dates of employment;
(4) The applicant's residence address for the previous five years;
(5) The applicant's Social Security number, date of birth, home telephone number, weight, height,
color of eyes and color of hair;
(6) If the applicant has ever been convicted of a felony, crime or violation of an ordinance other
than a minor traffic offense and, if so, the time, place and offense involved in the convictions;
(7) If the applicant has ever used or been known by a name other than the applicant's name and,
if so, the name or names and information concerning dates and places where used;
(8) Evidence that the applicant:
(a) Has legal work status in the United States;
(b) Has a diploma or certificate of graduation from a recognized school;
(c) Has current insurance coverage with liability limits of at least $1,000,000 for professional
liability in the practice of massage;
(d) Is affiliated with, employed by or owns a therapeutic massage enterprise licensed by the
city;
(e) In addition to the 70 hours of resident study, applicant must complete at least 400 hours of
certified therapeutic massage training as part of earning a diploma or certificate from a recognized
school; and
(f) Has at least one year of experience practicing massage therapy as established by an
affidavit.
(9) Other information that the City Council may require.

§ 114.007 APPLICATION AND INVESTIGATION FEES.
The fees for a massage enterprise and therapist licenses are set forth per the city's approved fee
schedule. An investigation fee will be charged for therapeutic massage enterprise licenses. An
application for either license must be accompanied by payment in full of the required license and
investigation fees, if applicable.

§ 114.008 APPLICATION VERIFICATION AND CONSIDERATION.
(A) Therapeutic massage enterprise license. The City Administrator must verify the information
supplied on the license application and investigate the background, including the criminal background,
of the applicant to assure compliance with this section. Within 90 days of receipt of a complete
application and fee for a therapeutic massage enterprise license, the City Administrator must make a
written recommendation to the City Council as to issuance or non -issuance of the license. The City
Council may order additional investigation if it deems it necessary, but must grant or deny the
application within 120 days of receipt by the City Administrator of the complete application and
required fees.
(B) Therapeutic massage therapist license. Within 90 days of receipt of a complete application and
fee for a therapeutic massage therapist license, the City Administrator must grant or deny the
application. Notice will be sent to the applicant upon a denial informing the applicant of the right to
appeal to the City Council within 20 days. If an appeal is properly made, the matter will be placed on
the next available City Council agenda.

§ 114.009 PERSONS INELIGIBLE TO HOLD LICENSE.
(A) Therapeutic massage enterprise license. A therapeutic massage enterprise license may not be
issued to or held by an individual who:
(1) Is a minor;
(2) Has been convicted of any crime directly related to the occupation licensed as set forth in
M.S. § 364.03, subd. 2, as it may be amended from time to time, and who has not shown competent
evidence of sufficient rehabilitation and present fitness to perform the duties and responsibilities of a
licensee as prescribed by M.S. § 364.03, subd. 3, as it may be amended from time to time;
(3) Is not of good moral character or repute;
(4) Is not the real party in interest of the enterprise; and/or
(5) Has misrepresented or falsified information on the license application.
(B) Therapeutic massage therapist license. A therapeutic massage therapist license may not be
issued to or held by a person who could not qualify for a therapeutic massage enterprise license or
who is not-
(1) Affiliated with;
(2) Employed by; or
(3) Does not hold, a therapeutic massage enterprise license.

§ 114.010 LOCATIONS INELIGIBLE FOR THERAPEUTIC MASSAGE ENTERPRISE LICENSE.
(A) General. A therapeutic massage enterprise may not be licensed if the enterprise is located on
property on which taxes, assessments or other financial claims to the state, county, school district or
city are due and delinquent. In the event a suit has been commenced under M.S. §§ 278.01 through
278.13, as they may be amended from time to time, questioning the amount or validity of taxes, the
City Council may on application waive strict compliance with this provision; no waiver may be granted,
however, for taxes or any portion thereof, which remain unpaid for a period exceeding one year after
becoming due.
(B) Zoning compliance. A therapeutic massage enterprise may not be licensed if the location of
such enterprise is not in conformance with Ch. 160 of this code of ordinances.

§ 114.011 GENERAL LICENSE RESTRICTIONS.
(A) Posting. A therapeutic massage enterprise license issued must be posted in a conspicuous
place on the premises for which it is used. A person licensed as a therapeutic massage therapist must
have in possession a copy of the license when therapeutic massage services are being rendered.
(B) Area. A therapeutic massage enterprise license is effective only for the compact and contiguous
space specified in the approved license application. If the licensed premises are enlarged, altered or
extended, the licensee must inform the City Administrator. A licensed therapeutic massage therapist
may perform on -site massage at a business, public gathering, private home or other site not on the
therapeutic massage enterprise premises.
(C) Transfer. The license issued is for the person or the premises named on the approved license
application. Transfer of a license from place to place or from person to person is not permitted.
(D) Coverings. The therapist must require that the person who is receiving the massage will at all
times have that person's breasts, buttocks, anus and genitals covered with non -transparent material or
clothing. A therapist performing massage must have the therapist's breasts, buttocks, anus and
genitals covered with a non -transparent material or clothing.
(E) Prohibited massage. A therapist may not intentionally massage or offer to massage the penis,
scrotum, mons veneris, vulva or vaginal area of a person.

§ 114.012 SANITATION AND HEALTH.
(A) A therapeutic massage enterprise must be equipped with adequate and conveniently located
toilet rooms for the accommodation of its employees and patrons. The toilet room must be well
ventilated by natural or mechanical methods and be enclosed with a door. The toilet room must be
kept clean and in good repair and be fully and adequately illuminated.
(B) A therapeutic massage enterprise must provide single -service disposal paper or clean linens to
cover the table, chair, furniture or area on which the patron receives the massage. If the table, chair or
furniture on which a patron receives the massage is made of material impervious to moisture, the
table, chair or furniture must be sanitized after each massage.
(C) The therapeutic massage therapist must wash the therapist's hands and arms with water and
soap, anti -bacterial scrubs, alcohol or other disinfectants prior to and following each massage service
performed.
(D) Massage tables, chairs or furniture on which the patron receives the massage must have
surfaces that can be readily disinfected after each massage.
(E) Rooms in a therapeutic massage enterprise must be fully and adequately illuminated.
(F) A therapeutic massage enterprise must have a janitor's closet that provides for the storage of
cleaning supplies.
(G) Therapeutic massage enterprises must provide adequate refuse receptacles that must be
emptied as required by this code.
(H) Therapeutic massage enterprises must be maintained in good repair and sanitary condition.
(1) Therapeutic massage enterprises must comply with the requirements of the state's Indoor Clean
Air Act, being M.S. §§ 144.411 et seq., as amended from time to time.
(J) A therapeutic massage enterprise must take reasonable steps to prevent the spread of
infections and communicable diseases on the licensed premises.
(K) Massage therapists must wear clean clothing when performing massage services.

§ 114.013 LICENSE TERM; RENEWALS.
(A) Licenses expire annually on December 31.
(B) The license fee will be prorated in 30-day increments for licenses issued after June 30.
(C) The City Administrator must prepare an application form for the renewal of a license requiring

§ 114.014 SUSPENSION; REVOCATION.
A license granted under this subchapter may be suspended or revoked by the City Council by
resolution upon notice and public hearing for any violation of this subchapter, a conviction of any crime
directly related to the therapeutic massage occupation unless competent evidence can be shown of
sufficient rehabilitation and present fitness to perform the duties of the occupation as set forth in M.S.
§ 364.03, as it may be amended from time to time, or any fraud, misrepresentations or incorrect
statement in the license application or in the course of operating or conducting business.

§ 114.015 TEMPORARY THERAPIST LICENSE.
(A) The City Administrator may issue a temporary therapeutic massage therapist license as
provided in this section.
(B) A temporary massage therapist license maybe issued to a person who:
(1) Is qualified to hold a massage therapist license under this section; and
(2) Has completed the required application and paid the license fee at least seven days prior to
the effective date of the license.
(C) A temporary license is effective for four consecutive days. A person may not be issued more
than three temporary licenses in any period of 360 consecutive days.
(D) All other provisions of this subchapter apply to temporary licenses.

§ 114.016 HOURS OF OPERATION.
A licensed therapeutic massage enterprise may not operate for business between the hours of 9:00
p.m. and 7:00 a.m.

Introduction:
The residential property owners at 8441 Fairchild Avenue (Alexander) and 8492 Long Lake Road
(Wilcox) were granted preliminary plat approval for the Alexander Gardens plat, which adjusted
the common rear lot lines, adding property from the south end of 8492 to the rear yard of 8441,
and also adding a new easement in the middle of the new rear yard of the Alexanders' lot next to
an existing 5-ft-wide easement. The Alexanders are now petitioning to have the original 5-ft-wide
easement vacated. If approved, they would resubmit the Alexander Gardens plat without the
easements, to be considered at this same Council meeting. Other easements at the edges of the
lot would remain. See graphic on the next page.
Discussion:
The City Public Works Director and City Engineer recommend approval of the vacation request.
Staff Recommendation:
Staff recommends the City Council adopt Ordinance 1013 approving vacation of the easement
by motion and majority vote.

AN ORDINANCE VACATING A DRAINAGE AND UTILITY EASEMENT WITHIN
THE PROPERTY LOCATED AT 8411 FAIRCHILD AVENUE IN THE CITY OF
MOUNDS VIEW
WHEREAS, Dale and Gayle Alexander (Alexanders), are requesting approval of the Final
Plat of Alexander Gardens. The project has included adjusting a common rear lot line of two
properties, one owned by the Alexanders and one owned by Todd Wilcox and Laurie -Ann Wilcox
(Wilcoxs); adding a new easement along the adjusted property line; and a request by the
Alexanders to have the 5-foot easement along the original property line, as described on Exhibit
A, (Original Easement) and includes easements for utilities, driveways and parking, vacated by
the City of Mounds View; and,
WHEREAS, the establishment of the new easement along the adjusted property lines to
be established in the plat know as Alexander Gardens, which will be executed by both the
Alexanders and the Wilcoxs, means that the Original Easement is no longer needed for a public
purpose; and,
WHEREAS, the City of Mounds View held a duly noticed public hearing on the proposed
vacation on March 25, 2024 and all persons desiring to be heard were provided an opportunity to
speak at the public hearing.
NOW, THEREFORE, THE CITY OF MOUNDS VIEW ORDAINS:
SECTION 1. The City of Mounds View Municipal Code Appendix D is hereby amended to
include reference to the following Ordinance 1013:
Subdivision 1. The City has made a determination that the land constituting drainage and
utility easement as described below is no longer needed for a public purpose, and as such, it is in
the public interest to vacate such portion of the drainage and utility easement described as follows:
See Exhibit A
Subdivision 2. The drainage and utility capacity for which the to -be -vacated easement, as
described in Exhibit A, was established will be provided for in the new easement to be dedicated
to the public as part of the plat of Alexander Gardens. The proposed vacation of the easement
therefore will not adversely affect the ability of the City or other utility to maintain, repair, or
replace public utilities.
Subdivision 3. There are no apparent public utilities, buried or otherwise, within the
easements to be vacated.
Subdivision 4. The City Council finds that there is no longer a public need for the Original
Easement, to be vacated, as described in Exhibit A of this ordinance.
Subdivision 5. The Original Easement, as described in Exhibit A of this ordinance is hereby
vacated.

SECTION 2. In accordance with Section 3.07 of the City Charter, City staff shall have the
following summary printed in the official City newspaper in lieu of the complete ordinance:
On March 25, 2024, the City Council adopted Ordinance 1013, vacating a drainage and
utility easement within certain private property that was replaced with an easement
providing similar benefit to the public and which will be dedicated via the plat known as
Alexander Gardens.
A printed copy of the ordinance is available for inspection during regular business hours at Mounds
View City Hall and is available online at the City's web site located at www.moundsviewmn.org.
SECTION 3. This ordinance shall take effect and be in force 30 days from and after its passage and
publication, in accordance with Section 3.09 of the City Charter.
Introduction and First Reading by the Mounds View City Council on March 25, 2024.
Second Reading and Adoption by the Mounds View City Council on April 8, 2024

Item Title/Subject: Resolution 9899, Approving Various Sanitary Sewer Manhole
Repairs
Background / Discussion:
During regular cleaning and inspection of the sanitary sewer system, Staff discovered
several manholes that require repairs due to cracking which is allowing infiltration/ground
water to enter the system.
Staff contacted two contractors to provide proposals for the repairs on the manholes. The
repairs include power washing, removing old motor, sealing all joints and lining of the
manhole structures.
Staff received proposals for the repairs as follows:
• Thul Specialty Contracting Inc.- (6 manholes) $29,700.00
• Innovating High Performance Costings (6 manholes) $44,000.00
The funding for these repairs is budgeted in the Sanitary Sewer fund, which includes
$30,000.00 for the sewer manhole lining.
Strategic Plan Strategy/Goal: Maintain and Plan for Infrastructure Improvements.
Financial Impact: No Impact to the 2024 Budget as repairs are budgeted in the Sanitary
Sewer Fund, 730-4823-7050, for these necessary repairs.
Recommendation:
Staff recommends approval and authorization for Thul Specialty Coatings of Elk River,
MN for $29,700.00 to repair the sanitary sewer manholes as proposed in the quote dated
February 12, 2024 from 730-4823-7050. It should be noted that Thul Specialty has
performed many repairs for the City; their craftsmanship and product has responded very
well to our system.

APPROVING VARIOUS SANITARY SEWER MANHOLE REPAIRS
WHEREAS, During regular cleaning and inspection of the sanitary sewer system,
Staff discovered several manholes that require repairs due to cracking which is allowing
infiltration/ground water to enter the system; and
WHEREAS, Staff determined that the best method for the necessary repairs is to
grout seal and line the manholes; and
WHEREAS, Staff contacted two contractors to provide a quote to facilitate the
repairs:
o Thul Specialty Contracting Inc.(6 manholes) $29,700.00
o Innovating High Performance Costings (6 manholes) $44,000.00
WHEREAS, the funding for these repairs is budgeted in the Sanitary Sewer fund,
730-4823-7050, which includes $30,000.00 for the sewer manhole lining.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds
View, Ramsey County, Minnesota as follows:
1. The City hereby approves the quote from Thul Specialty Coatings of Elk River
MN, for $29,700.00 for repairs to several City sanitary sewer manholes.
2. Funding will be from the Sanitary Sewer Budget, 730-4823-7050.
3. The Mayor and City Administrator are hereby authorized and directed to
execute all appropriate documents to effectuate the actions contemplated by
this resolution.
4. The Mayor and City Administrator, Staff and consultants are hereby authorized
and directed to take any and all additional steps and actions necessary or
convenient in order to accomplish the intent of this Resolution.
