Aaron Nielsen, Principal with MMKR, presented the 2023 audit to the City Council. He commended the City for receiving a clean or unmodified opinion. He reviewed the financial statements, fund balances and provided a summary of net position for the City in detail with the Mounds View City Council May 13, 2024 Regular Meeting Page 2 1 Council. He commended the City for their strong financial position and stated he was available for 2 comments or questions. 3 4 Mayor Lindstrom thanked Mr. Nielsen for the detailed presentation on the City's audit. 5 6 MOTION/SECOND: Gunn/Meehlhause. Presentation of 2023 Coach of the Year — Roscoe Curry. 18 19 Parks, Recreation, & Forestry Commission Chair Gerald Arel read the Resolution in full for the 20 record naming Roscoe Curry Coach of the Year for 2023. A round of applause was offered by all 21 in attendance. 22 23 Roscoe Currey thanked those who nominated him for this award. He stated he was fortunate to 24 have great kids on his team along with supportive parents. 25 26 MOTION/SECOND: Meehlhause/Clark. To Adopt Resolution 9925, Naming Roscoe Curry 27 Coach of the Year for 2023. 28 29 Ayes — 5 Nays — 0 Motion carried. 30 31 D. 2024 Mounds View Police Department Quarter 1 Report — Chief Zender. 32 33 Police Chief Zender provided the Council with a presentation on Quarter 1 from the Mounds View 34 Police Department. He welcomed Julie Clark to the City Council and stated she would be a great 35 asset for the community. He reported this week was National Police Week. He commented on the 36 tremendous success of the Daddy Daughter Dance and stated residents have also enjoyed attending 37 Coffee with a Cop at City Hall. He discussed the career fairs his officers attended in recent months 38 and noted he currently had 17 officers and was budgeted for 21. He noted the department currently 39 had one officer in training and another going through the background process. He reported Officer 40 Dison was recently promoted to Sergeant, which made her the first female sergeant within the 41 Mounds View Police Department. He commented on the recent events the City's K-9 team had 42 attended and stated the department's reserve program was helping with outreach to the community. 43 He explained the VCET program continues to be busy in the City. He provided further comment 44 on the training his officers received and discussed how the public safety funding from the State 45 would assist in improving the safety of the department and its officers. He reported the department 46 had two new solar signs and the department was considering placement. He indicated the City now Mounds View City Council May 13, 2024 Regular Meeting Page 3 1 had nine FLOCK cameras installed throughout the community and provided generalized stats on 2 how the cameras were being utilized. He then reviewed numbers from Ramsey County's 3 appropriate response model stating some calls were being diverted and triaged at the County level. 4 5 Council Member Meehlhause asked what happens to the money that is retrieved as part of the 6 VCET cases. Police Chief Zender explained this was forfeited money and these funds will 7 eventually go to VCET and the DEA. 8 9 Mayor Lindstrom stated he had the opportunity to go to Blaine this past weekend where a live 10 incident was occurring and a crowd was forming. He explained he appreciated the amount of 11 professionalism, restraint and patience exuded by the officers. He applauded the Mounds View 12 officers for their efforts and how they present themselves to the public. 13 14 Dan Mueller, Groveland Road, questioned if cities of this size typically had 15 SWAT teams. Police Chief Zender reported this was not the case. He discussed how Mounds View 16 had officers that joined with Ramsey County to form a SWAT team. 17 18 raised a concern about the high speed traffic or racing that was occurring 19 down Mounds View Boulevard in the overnight hours. Police Chief Zender encouraged the 20 resident to contact the police department when these events occur. 21 22 Council Member Gunn thanked the Mounds View Police Department for their tremendous efforts 23 on behalf of the community. 24 25 Mayor Lindstrom stated 26 27 E. Bridging.Com — Diana Dalsin. 28 29 Diana Dalsin, Bridging.Com, thanked the Council for their time. She discussed how Bridging.Com 30 serves as a furniture bank for the nine county metro. She reported Minnesota was very fortunate 31 to have residents willing to donate their reusable items for the benefit of others. She explained 32 115,000 households have been served since 1987. She noted 35% of those helped live in Ramsey 33 County. She commented on how there was a growing need for housing and housing goods for the 34 working poor. She invited the Council to come visit her site. She encouraged Mounds View 35 residents to consider making a donation or to get involved with Bridging.Com. 36 37 City Administrator Zikmund questioned if Mounds View could host a city-wide cleanup/recycling 38 day where items could be donated to Bridging.Com. Ms. Dalsin stated she would love to partner 39 with the City on this. 40 41 Mayor Lindstrom recommended Bridging.Com work in partnership with the Community Support 42 Center (CSC) in New Brighton. 43 44 Council Member Cermak spoke to how Bridging.Com assisted her family when she moved to the 45 community in 1988. 46 Mounds View City Council May 13, 2024 Regular Meeting Page 4 1 7. PUBLIC COMMENT 3 Vince Meyer, 8380 Spring Lake Road, questioned why his road issue was not addressed within 4 the recent edition of the Mounds View Matters. He suggested his curb be sealed with a warranty 5 that lasts five years. He commented on how painting catalytic converters was no longer effective. 6 7 Dan Mueller, Groveland Road, asked if Groveland Road could be finished. He 8 understood the roadway was set up as a parking lane, two driving lanes, a bike lane and nice six 9 foot sidewalk. He reported the bike lanes have never been marked and were now using the 10 sidewalk. In addition, he recommended fire hydrants be marked appropriately with no parking 10 t t feet on each side surrounding City parks. 12 13 Luke Edmund, 8407 Spring Lake Road, congratulated Councilmember Clark for being elected to 14 the City Council. He passed along his appreciation to the City Council for their service to the City 15 of Mounds View. He stated he was concerned with the Keystone utility meter swap out and that 16 every residents would have to sign a waiver. He reported he emailed Keystone last week to 17 schedule an appointment and he was not finding any license or bond for this company. He 18 questioned why the City contracted with a company out of state. He explained he requested a 19 master plumber name and license and no information has been provided. He stated his main 20 concern was that the City was allowing this contractor into the City and what would happen if they 21 did faulty work on the meter swap out for thousands of homes in the community. He believed this 22 was a huge liability, especially given the fact each homeowner had to sign a waiver. 23 24 Mayor Lindstrom explained the waiver was for residents who need to have their valve replaced. 25 He reported the Council decided to intervene and cover the expense for the valve replacement in 26 tandem with the water meter replacement for an efficiency standpoint. 27 28 City Administrator Zikmund stated as a general rule, the City has residents sign a waiver any time 29 the City comes onto their personal property, whether for a tree removal or any other work as a 30 standard liability release. He explained public works employees can swap out commercial water 31 meters, but they are not licensed plumbers. 32 33 Public Works/Parks and Recreation Director Peterson reported Keystone was a subcontractor of 34 WinWater. He noted the City put out a bid for the water meter replacement and the project was 35 awarded to WinWater who hired Keystone as a subcontractor. He explained Keystone was known 36 for completing water meter swap outs throughout the country. He stated they do have a licensed 37 master plumber on standby. He indicated the bonding is with WinWater and public works has this 38 information on file. He commented further on how and when valves are replaced by the contractor. 39 40 Mr. Meyer explained his water meter was replaced and when he returned home after work, his 41 basement was flooded. He stated he called the contractor and no one was answering his call. He 42 indicated he finally got a hold of somebody and they came out and fixed the leak, but he had to 43 clean up the mess. He reported he asked how their contractor was and has not received any 44 information. 45 Mounds View City Council May 13, 2024 Regular Meeting Page 5 1 Council Member Cermak stated she believed the contractor was doing a great job based on how 2 the meter at her four-plex was replaced. 3 4 Council Member Clark indicated her water meter was replaced as well and she has had no 5 problems. 6 7 Mr. Mueller asked if a licensed plumber were brought in to change the valve, would this require a 8 permit from the City. City Administrator Zikmund stated he would look into this and would follow 9 up with Mr. Mueller. 10 11 8. COUNCIL BUSINESS 12 A. PUBLIC HEARING: Resolution 9915, Approving an Amendment to the 13 Conditional Use Permit for the Property at 2375 Mounds View Boulevard to 14 allow Auto Body Work and Auto Painting. 15 16 Kristin Baldonado, Planner at Stantec, requested the City consider an amendment to the 17 Conditional Use Permit for the property at 2375 Mounds View Boulevard to allow auto body work 18 and auto painting. She explained auto body work and auto painting was not currently allowed 19 under the current CUP, which was issued in 1992. She reported the applicant was not proposing 20 any exterior changes to the building. She commented further on the request and recommended 21 approval with conditions. 22 23 Council Member Meehlhause reported the exterior of the property may change slightly, noting the 24 conditions for approval would require an enclosed area to house the damaged cars. 25 26 , representative for the applicant, noted there were 35 spaces behind the 27 building that were fully screened by the pine trees at the rear property line. She reported the 28 property owners would be willing to install additional screening if necessary. 29 30 Mayor Lindstrom opened the public hearing at 7:20 p.m. 31 32 Vince Meyer, 8380 Spring Lake Road, asked if the paint booth was up to code. He expressed 33 concern with the fumes that would be going into the community from an auto body paint booth. 34 35 Melanie Emery, representative for the applicant, reported there was no paint booth at this time. 36 She commented further on how the City regulates auto body uses within the Highway B-3 zoning 37 district. She explained any paint booth installed would have to comply with all City Codes. 38 39 Rebecca Scholl, 2467 Hillview, stated regarding code compliance, codes are only enforced if the 40 city has adopted the code. She questioned if the City had any code for paint booths. City 41 Administrator Zikmund reported the City of Mounds View has State codes in place with respect 42 to paint booths within the building and fire code that were adopted by Ordinance. 43 44 Hearing no further public input, Mayor Lindstrom closed the public hearing at 7:24 p.m. 45 46 MOTION/SECOND: Gunn/Meehlhause. Council Member Meehlhause stated this amendment to the CUP was presented to the Planning Commission and this group offered their unanimous approval. Mayor Lindstrom explained he was excited to retain this business in the community. Ayes — 5 Nays — 0 Motion carried. B. PUBLIC HEARING: Resolution 9917, Approving the Voyager Subdivision Preliminary Plat at 7900 Sunnyside Road. Ms. Baldonado requested the Council approve the Voyager Subdivision Preliminary Plat at 7900 Sunnyside Road. She reported the proposed plat would split the existing property into two lots. The first lot would be a new lot for a proposed single family home residence and the second lot would have an existing home on the corner lot. She explained both lots meet all R-1 zoning requirements. She commented further on the request and noting the park dedication fees would be collected upon final plat approval before the plat recording. Staff recommended approval of the Voyager Subdivision Preliminary Plat. City Attorney Riggs stated there were several items that should be added to the Resolution noting this parcel shall enter into a City subdivision agreement, which will have all of the terms and agreements for the plat. In addition, the Resolution shall be amended to read the applicant will provide title work and the attorneys plat opinion and engineers opinion will be completed from the title work. Mayor Lindstrom opened the public hearing at 7:29 p.m. Molly Tanner, 7935 Sunnyside Road, explained she lived across the street. She indicated she was somewhat concerned about this because both lots would become quite small. She questioned if sewer and water would be added to the new lot. Ms. Baldonado reported this was proposed, but noted the City did not have an official plan for this lot. Ms. Tanner indicated she moved into her home in 1978. She indicated she proposed several additions to her house over the years and they were refused because the building would take up too much of the lot size. She questioned when Mounds View changed and lot size didn't matter anymore. She stated she did not support the proposed lot split. Brian Amundson, 3048 Woodale Drive, stated he understood this was a residential lot being divided by the current property owner. He commented on how there was a need for additional affordable housing in the community. He suggested the City not charge a park dedication fee as this would drive up the cost for the residential lot and would make the property less affordable. He recommended the park dedication fee be excluded for this lot subdivision. Rebecca Scholl, 2467 Hillview, respectfully disagreed with the previous speaker. She explained Mounds View City Council May 13, 2024 Regular Meeting Page 7 1 this was an out of town property owner that was splitting the lot for profit. She indicated she would 2 like to see the City collecting the park dedication fee. She was bothered by the fact an out of town 3 owner could cash in on a project like this and a Mounds View homeowner was not able to renovate 4 their home. She stated she would like to see lot splits occurring only on owner occupied properties 5 in the future. 6 7 Hearing no further public input, Mayor Lindstrom closed the public hearing at 7:34 p.m. 8 9 City Attorney Riggs reported park dedication fees were part of City Code and were charged for 10 every development that was subdivided. He did not recommend the City Council approve a 11 variance to waive the park dedication fee. 12 13 Assistant City Administrator Beeman stated Stantec updated the Resolution to include the park 14 dedication fees. 15 16 Council Member Gunn reported the lots being created were meeting all R-1 residential zoning 17 district standards. 18 19 MOTION/SECOND: Gunn/Clark. To Waive the Reading and Adopt Resolution 9917, Approving 20 the Voyager Subdivision Preliminary Plat at 7900 Sunnyside Road as amended by the City 21 Attorney. 22 23 Council Member Clark requested staff review the size of the new lots. Ms. Baldonado discussed 24 the lots sizes for both lots in further detail with the Council. She reiterated that both lots meet the 25 minimum zoning requirements for the R-1 zoning district. 26 27 Ayes — 5 Nays — 0 Motion carried. 28 29 C. PUBLIC HEARING: Resolution 9918, Approving a Chicken -Keeping License 30 for Kimberly Wanner, 2622 Clearview Avenue. 31 32 City Administrator Zikmund requested the Council consider a chicken -keeping license for 33 Kimberly Wanner, 2622 Clearview Avenue. He reported the applicant meets all City requirements 34 and noted staff has received two supportive comments from neighbors. Staff recommended 35 approval of the request. 36 37 Mayor Lindstrom opened the public hearing at 7:41 p.m. 38 39 Kimberly Wanner, 2622 Clearview Avenue, explained her daughter, Izzy, got to raise chickens in 40 girl scouts and she was hoping to keep two of the chickens. She stated Izzy and her brother have 41 been raising money and would be building a chicken coop. 42 43 Hearing no further public input, Mayor Lindstrom closed the public hearing at 7:43 p.m. 44 45 MOTION/SECOND: Meehlhause/Cermak. To Waive the Reading and Adopt Resolution 9918, 46 Approving a Chicken -Keeping License for Kimberly Wanner, 2622 Clearview Avenue. Mounds View City Council May 13, 2024 Regular Meeting Page 8 2 Council Member Meehlhause thanked Ms. Wanner and her daughter for providing the Council 3 with excellent drawings and pictures for the chicken coop. 4 5 Ayes — 5 Nays — 0 Motion carried. 6 7 D. Resolution 9916, Approving the Purchase of One Ford Police Utility Vehicle 8 Along with Additional Equipment and Setup Costs. 9 10 Police Chief Zender requested the Council approve the purchase of one Ford Police Utility vehicle 11 along with additional equipment and setup costs. He explained he was due to replace one 12 unmarked squad car. He reported a State bid was received for this purchase. He reviewed the bid 13 for the vehicle and setup costs and recommended approval. It was noted forfeiture funds would be 14 used to purchase the radar equipment. He commented updates would be made on the squad video 15 cameras when the body cameras were updated. 16 17 MOTION/SECOND: Clark/Cermak. To Waive the Reading and Adopt Resolution 9916, 18 Approving the Purchase of One Ford Police Utility Vehicle Along with Additional Equipment and 19 Setup Costs. 20 21 Mayor Lindstrom questioned if a squad camera would be installed in this vehicle. Police Chief 22 Zender stated squad cameras would be installed once he receives the vehicle, which would be in 23 six months or so. 24 25 Ayes — 5 Nays — 0 Motion carried. 26 27 E. Resolution 9919, Adopting a Five Year Financial Plan for 2025 thru 2029. 28 29 Finance Director Bauman requested the Council adopt a five year financial plan for 2025 thru 30 2029. She explained the Council reviewed the five year capital plan at their worksession meeting 31 on Monday, May 6. She noted the only change made to the plan had to do with amendments to 32 the streets plan. Staff commented on the five year plan in further detail and recommended approval. 33 34 Brian Amundsen, 3048 Woodale Drive, expressed concern with the streets that were sealcoated 35 several years ago, noting there were large patches that were in poor repair. He understood 36 additional repairs would not occur in 2024. He noted these roads have been in poor condition for 37 two seasons, including two winters. He was concerned the five year plan had not considered this 38 matter. He discussed how the Charter speaks to how the five year plan should include the financial 39 services for regular public services. He stated he had been exchanging emails with Finance 40 Director Bauman and she indicated it was too early to do that based on the fact she would only be 41 applying inflation to revenues and expenses. His concern was the Council did not fully understand 42 the impact to the budget. He further discussed how the charter called for this information to be 43 included and urged the Council to revise the five year plan in order to better understand the five 44 year impact for special projects. 45 46 Mayor Lindstrom commented on the timing of the charter. He believed the date should be kicked Mounds View City Council May 13, 2024 Regular Meeting Page 9 1 out further. He questioned what type of timeframe was necessary in order to better understand the 2 impacts. Finance Director Bauman explained for the record, the City set aside funding annually 3 for sealcoating, fogging and reclamite. She reported with respect to the Charter, she does have all 4 operating costs for the capital outlay funds. She indicated the General Fund does not have capital 5 outlay. She believed it would be misleading to complete a General Fund projection with the 2024 6 budget and an inflationary figure because so many changes were coming up that would change the 7 2025 budget. She anticipated by July she would have more confidence in the numbers. 9 Mr. Amundsen invited Ms. Bauman to attend the next Charter Commission meeting, which would 10 be held on Tuesday, May 21 to discuss the timing issue in further detail. He stated he was following 11 the calendar that was established by Finance Director Beer and noted as staff makes changes, the 12 calendar could be adjusted. He indicated his real concern was with the fact the Council didn't have 13 a whole picture of what the five year financial plan is if the Council was only looking at the 14 proposed projects. 15 16 Mayor Lindstrom stated one of the changes that should be considered would be to add a provision 17 for citizens to bring project concerns before that timeline. 18 19 Council Member Meehlhause indicated there were two different topics here. He noted the five year 20 capital improvement plan and the special projects plan were one piece. He stated the other piece 21 was a projection on the general fund budget. He reported Mr. Beer always said when this plan was 22 approved, that it was out of date because numbers were always changing. He suggested the Charter 23 be further looked at, noting dates may have to be amended. He indicated the capital projects that 24 were three or four years out, may not have a funding mechanism in place at this point in time. He 25 stated the City Charter serves different entities, but it has to work for the Charter Commission, 26 residents, City Council and City staff. He explained the timing may be off a little and the Charter 27 Commission may need to consider an amendment. 28 29 Rebecca Scholl, 2467 Hillview, commented one of her concerns was that the Council was being 30 asked to approve a report that does not comply. She explained Mr. Amundsen was looking for this 31 report to meet the Charter's requirements. She understood this may not happen by June 1st and 32 noted she would like to see the City and the report in compliance with the current charter going 33 forward. 34 35 Mayor Lindstrom stated he appreciated Finance Director Bauman's commitment to accuracy in 36 the numbers she was presenting to the Council. He agreed the plan was not perfect this year, but 37 the Council would continue to have budget conversations and the numbers would continue to be 38 updated and filled in. 39 40 Public Works/Parks and Recreation Director Peterson indicated this was a five year plan and as 41 the Council begins working through the budget for 2025 projects would be picked, but not every 42 project would be completed. 43 44 MOTION/SECOND: Gunn/Meehlhause. Resolution 9921, Authorizing the Purchase of One Rifle Rated Ballistic Shield 4 and Transport Bag. 5 6 Police Chief Zender requested the Council authorize the purchase of one rifle rated ballistic shield 7 and transport bag. He explained this piece of equipment would assist with officer safety. He stated the City has been working through this process for over a year. He 20 reviewed several minor corrections to the RFP, along with the proposed weighing matrix and 21 recommended approval. 22 23 Council Member Gunn supported the matrix as presented. 24 25 Council Member Cermak agreed. 26 27 Council Member Gunn requested further information regarding the lawsuit stipulation. City 28 Attorney Riggs explained this stipulation was a disclosure requirement to ensure any future vendor 29 could perform the requested services under the contract. 30 31 Council Member Clark asked if the contract would include a spring and fall cleanup. City Administrator Zikmund commented on how the feedback from the public was integrated into the RFP. City Attorney Riggs reported the RFP allows for flexibility noting there may not be apples to apples comparisons, and this was the reality of the process that was allowed by statute. Mayor Lindstrom indicated the commitment of the Council was to see this process through to the end. He stated he voted yes for the Charter amendment because he wanted people to have the right to choose at the ballot box. He further reviewed the rates Vadnais Heights just received for their organized collection, noting the rates were far better than anything the City of Mounds View residents were receiving. Ayes — 5 Nays 0 Motion carried. H. Introduction/Council Discussion — General Election/Holiday — Mayor Lindstrom. Mayor Lindstrom read a statement in full for the record. He was of the opinion Election Day should be a fully paid holiday as this would assist with getting people to the polls in this country. The consensus of Council was to support this recommendation. City Administrator Zikmund stated he would work with the City Attorney to make this an aspirational holiday. I. Community Engagement Committee — Mayor Lindstrom. Mayor Lindstrom stated the City had a Human Rights Task Force that was approved by the Council. He noted this group worked on human rights issues and eventually ran into some stalemates and dissolved. He was of the opinion there was still work to be done. He noted he has been working with the City Administrator and proposed listening sessions be held going forward to find out how Mounds View can be a more welcoming and engaging community. He stated the first event would be held on Saturday, June 22 from 1:00 p.m. to 3:00 p.m. at the Community Center. City Administrator Zikmund commented on how the goal and mission of the listening session would be to gather information in order to create a mission for the Human Rights Task Force going forward. He stated the slogan for the listening sessions would be "Welcome Home" as the goal would be to create a welcoming community for all in the community. REPORTS A. Reports of Mayor and Council. Council Member Gunn reported last week she attended the NYFS leadership luncheon and the CPY career day. Council Member Gunn indicated the Tribute Park meeting has been postponed for May. Council Member Gunn explained she would be attending a law enforcement memorial ceremony at the Calvary Church in White Bear Township on Thursday, May 16. Council Member Gunn commented on Saturday, May 18 from 12:00 p.m. to 4:00 p.m. there would be a resource fair in the open space outside the library. Council Member Gunn reported the splash pad would be opening on Friday, May 24. Council Member Clark stated the Festival in the Park Committee would be meeting next on Tuesday, May 21 at the Community Center. Council Member Clark noted there would be a community wide garage sale in Mounds View from May 30 through June 2. Council Member Cermak explained the Mounds View Police Foundation would meet next on Tuesday, May 14th at Hodges Park at 5:30 p.m. Council Member Cermak reported she attended the NYFS leadership luncheon last week. Council Member Cermak noted she would be attending the law enforcement memorial on Thursday, May 16. Council Member Cermak indicated she attended the recent Anoka County Fire Board meeting. Council Member Cermak commented on a recent trip she took and stated she really appreciated the fact the City had bus routes in place to get residents to and from the airport. He explained a price was received for the modifications to 23 the wings, noting the bid was $20,000 higher than the previous contractor and this was only for 24 eight driveways. He reported continuing conversations would be held on this topic and he would 25 update the Council on May 28. 26 27 Public Works/Parks and Recreation Director Peterson stated the 2024 street project has been 28 postponed. He described how the parking along Edgewood Drive and the parking lot off of 29 Bronson Drive has been amended. The Council supported the proposed changes. 30 31 Public Works/Parks and Recreation Director Peterson explained he has been meeting with Stantec 32 to discuss grants for Ardan and Silver View Parks. He was pleased to report these grants could be 33 used for future maintenance within the parks. Staff and Stantec agree that the City should apply with the Minnesota Board of Water and Soil Research (BWSR) Habitat Enhancement Landscape Program Grant and for the DNR Conservation Partners Legacy Grant Program. Both the Ardan and Silver View projects have the potential to receive grant funding. An amendment to the current professional service agreement with Stantec Engineering Services is required to allow them to apply for Grants from the MN DNR and BWSRS for various storm water projects. The system was first constructed in the 1970's and as with other similar core functions, research, innovation and best management practices have changed over the years. In September 2022 Stantec Engineering Services completed a wetland delineation in Ardan Park as part of a development proposal. Stantec also indicated that the current wetland area, in addition to other green spaces, could be developed into a wetland banking project. The Engineer estimated that the City could develop wetland banking and sell these credits to developers, these credits were estimated to value 1 million dollars. The City Council directed Staff to look into the option of creating wetland banking in this area. An application was submitted notifying the following agencies of the project and for these agencies to provide the City with feedback regarding the proposed project. MN Department of Natural Resources (DNR), Rice Creek Watershed District (RCWD), Board of Water and Soil Resources (BWSR), Ramsey County and the U.S. Army Corps of Engineers (USACE). Staff received comments from the Army Corps of Engineers and one of larger concerns in establishing this wetland banking close to the Anoka County Airport of potential bird strikes was addressed. The proposed wet land types, wetland meadow and scrub, are typically attractive habitats for large flocks of potentially hazardous waterfowl. Both FAA and the USDA have determined the creation of the wetland banking will not increase wildlife hazards to the Anoka Airport. Staff and Stantec agree that the project is worth moving forward, there remain eight (8) additional comments that the City must address: 1) Potential Adjacent Landowner Impacts 2) Size of the Proposed Mitigation Bank 3) Road Authority 4) Easement 5) Encroachment 6) Long Term Management 7) Baseline Information 8) Buffer Stantec has provided a Cost Proposal of $11,400.00 for the next steps as outlined at the March 6, 2024 Work Session: 1) Meet with the various agencies to clarify and respond to the comments. 2) Installing shallow monitoring wells to better determine the hydrology of the current wetland and adjacent properties. 3) Updating the Draft Prospectus narrative to include how the agency comments were addressed. Upon routine inspection of the metal corrugated pipe (CMP) it was observed that the pipe has rusted out in sections, allowing ground water to infiltrate under Lois Drive which is creating voids under sections of the road. Directly under the storm sewer pipe is a large sanitary sewer main, should the storm sewer pipe collapse it would damage the sanitary sewer line. Staff has consulted with various contractors and the City Engineer on the best method to repair the pipe. Staff obtained a quote from Dave Perkins Contracting Inc. to excavate, remove and replace the storm sewer pipe for a cost of $126,091,00. Staff also explored and received quotes for lining of the storm sewer pipe: Thul $172,440.00 Engineering & Construction Innovations Inc. $99,855.00 Additional Costs: In order to complete the repairs, a number of trees are required to be removed at an approximate cost of $15,278.00 Turf Restoration of $2,285.00 • Installing 2 catch basins with curbing at $5,428.00 Staff is also recommending a 7% contingency for any unforeseen issues that may arise during the repairs. The funding for this repair is budgeted in the Storm Sewer fund, 745-4415-5150, which includes $250,000.00 for Storm Sewer Repairs. Gary Meehlhause, 7400 Park View Drive. Even though my comments tonight are based on my experience as a City elected official, they are being made as a resident of the City of Mounds View and reflect my thoughts only and do not represent the City Council. In fact, my Council colleagues are not aware of these thoughts nor my intent to present them to the Charter Commission. May 20th was a tragically historic day for the City of Mounds View with the unfortunate passing of my Council colleague and personal friend Al Hull. For the first time in the City's 65 year history, the office of Mayor became vacate before the Mayor's term had actually expired. As you know, both the City Charter and state statue provide a mechanism for temporarily filling a Mayor vacancy with the requirement that the City Council appoint a "Acting Mayor" at each year's first City Council meeting. With the Acting Mayor temporarily filling the vacate Mayor's seat, the question was asked what happens if the Acting Mayor isn't available to conduct a Council meeting or sign documents that are time sensitive. The Council obviously got out in front of the Charter Commission by adopting an ordinance creating a "Vice Acting Mayor" appointment in the event the appointed Acting Mayor had to temporarily fill the Mayor's position. I want to thank the Charter Commission for also recognizing this need, and passing a resolution updating the Charter to reflect this unfortunate scenario. As an update, the Council has unanimously passed the first and second readings for the Charter update. As an aside there was a situation where documents involving a conduit bond financing project had to be signed on a specific date, and this closing would have been impacted if the Acting Mayor wasn't available and there was no appointed alternate. When the Charter Commission decided to maintain the Charter's present requirement that any Council vacancy would be filled through a special election if there was 365 or more days left in the term, I thanked the Commission for at least giving consideration to changing this time frame. I did also indicate that I could think of a scenario where the Council could operate as a 4 member Council for 5 to 6 months because of the State Legislature's decision to define only specific months for holding a special election. The Mounds View City Council has been officially operating as a 4 person Council since May 20t' and in reality since April Is'when Mayor Hull began his chemo treatments as the last City Council meeting he officially led was the second meeting in March. Thus, the Council has operated as a 4 person Council for 7 months. With Council member Lindstrom's election to Mayor on November 7t'', the Council will continue to act as a 4 person Council until next April's special election to fill the remainder of Mayor Lindstrom's council term. Thus, the Council will have operated as a 4 person Council for one year. A 4 person Council obviously can work, but it is not an ideal scenario particularly when it becomes 5 or more months. Major decisions can be decided by the opposition of 2 votes rather than 3 votes for or against. I will also tell you there are other items that are not time sensitive that the current 4 person Council has chosen to table until there is a 5 person Council. I personally recommended tabling one item I am opposed to because I wanted it to either pass or fail on a 3 — 2 vote rather than fail with 2 votes which was the likely outcome. There is another scenario that could happen with full recognition that the odds of it occurring is remote. With the current 4 person Council, there is no current solution provided by the City Charter in the event not one but two additional seats became unexpectedly vacant. I know City Attorney Joe Sathe has provided a memo to the Commission related to Council vacancies, and thus I won't elaborate any further in that regard. As a further addendum, since I made this presentation to the Charter Commission, the 4 person Council had to operate as a 3 person Council for at least one if not two meetings when Council Member Gunn was away for personal reasons dealing with her father's declining health and ultimate passing. This scenario creates an additional challenge as all votes have to be 2 unanimous, and a Comprehensive Plan Amendment need could not be addressed because this requires four votes to approve the change. My primary purpose for speaking tonight is I believe the Charter Commission needs to revisit the process for filling an open Council seat when the seat is going to be vacant for 5+ months. I support filling the seat as soon as a special election can be held. However, I believe there should be some Charter approved appointment process to temporarily fill the vacancy until the election can occur. A statuary City has this option, and it was exercised in 2022 by both Shoreview and Arden Hills, and in Shoreview's situation the vacancy occurred in the 4t' year of the Council term. I recognize the Charter Commission has in the past expressed concern about the appointment process possibly resulting in the Council majority appointing a "friend" who they may have also recruited. I have a recommendation for the Commission to consider if there is willingness to discuss a temporary Council appointment process. The Charter could identify an appointment process that designates the following City Commission Chairs as the temporary vacancy replacement until the election is held. Just as there is a succession sequence for the office of President of the United States (Vice -President, Speaker of the House, etc.) I would recommend the following sequential succession for temporarily filling a vacate Council seat could be established in the Charter: 1. Current Charter Commission Chair 2. Current Planning Commission Chair 3. Current Parks, Recreation, and Forestry Commission Chair 4. Current Charter Commission Vice -Chair This identified approach takes away the Council choosing the "temporary" replacement. In fact, as you well know the Council has no ultimate say in the appointment of Charter Commission members nor its Chair and Vice -Chair selections. The Council does appoint members to the City Commissions and approves the Commission Chairs. However, these appointments and approvals usually following the Commission's recommendations. The temporary appointee would continue to serve on their Commission, but would temporarily step aside as the Committee's Chair during their temporary City Council assignment. 3 I thank you for your time this evening. As a resident with elected official experience, I seriously hope that the Commission will take into consideration both my and City Attorney Sathe's concern about a Council vacancy that is 5+ months in duration, and consider the identification of a temporary solution to this situation in the City of Mounds View's City Charter. Further addendum: The Charter Commission discussed this proposal at their May 21St meeting, and is interested in Council feedback to this proposal. 4 Proposal If a vacancy occurs in the council or mayor's position, whether by death, disability, change of residency or any other reason, and the vacancy will last longer than 120 days because of election requirements, the remaining council and mayor may choose as a temporary councilmember or mayor the chair of the Mounds New Charter Commission, If this person is unwilling or unable to serve, the remaining council and mayor may choose the chair of the Mounds View Planning Commission. If this person is unwilling or unable to serve, the remaining council and mayor may choose the chair of the Mounds View Economic Development Commission. If that person is unwilling or unable to serve, the remaining council and mayor may choose the Vice Chair of the Mounds View Charter Commission. If that person is unwilling or unable to serve, the position will remain vacant. The person chosen shall have all the responsibilities, obligations and duties of the chosen position. The person chosen shall remain in office until a replacement is elected and sworn in. Questions Rmardint! Proposal The following are high level answers to questions posed about the proposal above. 1. Do we need to address the condition of vacancy here, since they already exist in the Charter elsewhere? No, the vacancy language in Section 2.05 already applies and there is no need to list reasons a vacancy exists in a new section. 2. Is there any window where an election can be held within 120 days? Potentially, however, it would require the Ramsey County elections office to also sign off on conducting the election and the timing of a regular or special council meeting occurring at the same time. 3. Isn't the Council defined already as the council members and mayor elsewhere, so we can drop any reference to "and mayor"? Correct, the "members of the council" are defined in Section 2.03 and include both councilmembers and the mayor. 4. Can the word "temporary" be used in the language, once appointed the person isn't "temporary" are they? The appointed individual would be a full council member with a shorter term than typical. I think the term is unnecessary. 5. Can the person continue to server on their original appointment while filling the vacancy? The Planning Commission makes advisory recommendations to the City Council. The Economic Development Commission makes advisory recommendations to the Economic Development Authority (which consists of the members of the Council). This would result in a member of the council making an advisory recommendation on an item that that member of the council will vote on in the future. Minnesota Statutes allows members of the council to serve on a charter commission unless that city's charter prohibits a person from holding both offices. The Mounds View Charter provides: Section 2.04. Incompatible Offices. No member of the Council shall hold any municipal office or employment through the City other than that to which elected. Further, until one year after the expiration of member's term, no Mayor or Councilmember shall be appointed or employed by the City in a compensated position which was created, or the compensation for which was increased, during member's term as Mayor or Councilmember. "Municipal office" is not defined in the Charter. 6. Is a time certain needed to define how soon the appointment can be made, example at the time of the vacancy declaration or as soon as the council orders the election and it is determined to be more than 120 days? No, it is common for a city council to establish its own process for appointing a councilmember to fill a vacancy. 7. Is it clear when the appointment would end or does it require more definition? The standard language is that the appointed person will serve "until a successor is elected and qualifies." I would recommend using that same language. 8. Is the Council obligated to still hold an election after the appointment since the vacancy is filled with the appointment? It depends on the language that is adopted. Each council seat must be up for election in four-year cycles and the mayor must be up for election every two years. 9. Is the Mounds View Economic Commission only filled with Mounds View residents? No, the Economic Development Commission shall include four residents and three business representatives and the business representatives do not need to be residents. 10. Since this idea is coming from a sitting council member, regardless of being presented as if from a citizen without Council review, is it a valid proposal or does it need to use the Council proposed change process as outlined in 410.12? If the Charter Commission proposed the amendment it would be considered a Charter Commission instigated proposal not a City Council instigated proposal. The Council initiated process starts when the City Council acts to propose an amendment. 11. Was there any issue before the Council in the last year which could not be addressed with Council action, because of only four council members rather than five, example a unanimous vote required and K&G advised that no Council action could be due to only four members? I do not know the answer to this question. Voting thresholds generally fall into two categories in Mounds View because of the language in Section 3.04 stating that "Except as otherwise provided in this Charter, state law or a more restrictive City ordinance, an affirmative vote of three or more members of the Council shall be required for the adoption of all ordinances, resolutions and motions." Thresholds that are more restrictive generally call for a "unanimous vote" or "a four -fifths vote". These type of thresholds require a calculation based on the number of sitting councilmembers. For example, four -fifths of a full five member council is four votes. Four -fifths of a four member council would also be four (since 4/5ths of four is 3.2). 12. What additional definitions need to be created around this language for clarity? If the proposal is the direction the Charter Commission wants to go, I would propose redrafting the proposal to follow the direction of the Commission and then could establish whether additional definitions are needed. 13. Lastly, can you provide some examples from other charter cities of how their charters handle council vacancy appointments? THREE EXAMPLES FROM OTHER CITIES City of Hopkins, Section 2.05 (2) If the vacancy occurs before the first day to file affidavits of candidacy for the next regular city election and more than two years remain in the unexpired term, a special election shall be held at the next regular city election and the appointed person shall serve until the qualification of a successor elected at a special election to fill the unexpired portion of the term. If the vacancy occurs on or after the first day to file affidavits of candidacy for the regular city election or when less than two years remain in the unexpired term, there need not be a special election to fill the vacancy, and the appointed person shall serve until the qualification of a successor. A person appointed to fill a vacant position can file an affidavit of candidacy to seek election to the position. Faribault, Section 2.05 In each case, the council shall by resolution declare such vacancy to exist and shall appoint an eligible person to fill the vacant office until the next regular city election is held. In the case of a tie vote in the council for a vacancy in the position of a council member, the mayor shall make the appointment, selecting one of the finalists that was before the council for consideration for appointment. In the case of a tie vote in the council for a vacancy in the position of mayor, the vice mayor shall make the appointment, selecting one of the finalists that was before the council for consideration for appointment. If the vacancy occurs before the first day to file affidavits of candidacy for the next regular city election and more than two years remain in the unexpired term, a special election shall be held at or before the next regular city election and the appointed person shall serve until the qualification of a successor elected at a special election to fill the unexpired portion of the term. I'm interested in serving on this committee because I did this in St. Paul about 15 years ago when they closed and sold many smaller rec centers and redesigned their available park amenities and locations. I witnessed the positive and negative factors in their decisions and feel my experience and knowledge may be beneficial for Mounds View. It's cliche to say that but my grandparents once toured almost every St Paul Rec Center and my grandpa was the main person who pushed for the multi -million dollar Northdale Rec Center in St Paul's District 10/Como/North End and got the approval for grants and funding to have the building built. Grandpa had 6 kids but was "Coach" to many and started Northdale Hockey in the days of playground hockey in the late 60's and early 70's. He served on the D10 council for 50 years and I got dragged to many meetings as a kid hearing boards/councils/proceedings etc. At the time of building planning, the city council and Norm Coleman wanted the building amenities to be sufficient for the present and future community needs and sent my grandparents on several tours with staff/architects to see what they liked and did not like at other centers. Grandpa worked with the architect and had his own blueprints as his "tablecloth" for several years during planning and construction and parked his van at the construction site daily to watch his building be built. A painter by trade who worked for Hamernicks for 45 years of his life, his true passion was community involvement and district council work and that's what I saw most of and often got hauled along to events. Sort of instilled those same traits to help the community in all of us "kids". When I say Parks run deep in my family, my cousin is Jerome Krieger who worked for St Paul Parks for many years as a facilities director and is now the director or asst director of Blaine Parks n Rec. He's also the sitting president of the MN State Parks Board/Association. He's pushing 40 years of experience directing and coordination parks n rec needs for St Paul and Blaine. As for myself, as mentioned, I worked with St Paul to replace their facilities. The then director Mike Hahm and his staff (Kathy Korum, Nate G, Derek Hollanitsch) on planning pocket parks, neighborhood parks, and community centers within St Paul. The goal was to have a park within 4-6 blocks of any residence. Some just swings or tot lot only. Some with fields and larger playgrounds. Others like Northdale, Phalen, Palace, Hillcrest etc. where they are more of a community center with other amenities and community needs/wants - craft rooms, conference rooms, exercise/weight facilities, indoor walking tracks, etc. The goal was to eliminate any small rec centers that was overlapped by another rec center who could serve or handle the needs. Staffing was an issue due to break coverage requiring 2 staff members working at facilities that had little more than a Connect4 and checkers board next to some markers and construction paper. City was done paying 2 employees to be a daycare. Griggs and Sylvan for example were closed and the Sylvan building was converted to restrooms. Griggs was sold but the city eventually reacquired it because per their original maps, West Minnehaha and Hancock rec centers appeared they could cover the needs. They realized that wasn't the case when many local neighbors voiced their concerns with kids having to cross Snelling and/or Lexington to access those parks if they lived between those 2 major roads. The city agreed and bought Griggs back! I feel my knowledge and experience of things like the above would be a good fit and beneficial for planning. I also volunteered for 6 years on the St Paul Outdoor Ice Committe when they purchased the 3 refrigerated outdoor rinks for Northdale, Phalen, and Palace. My dad sold hockey rinks for a living. Through his knowledge and industry connections, I was able to assist in acquiring accessories and equipment for the rinks and help coordinate flooding, scraping, shaver schedules, and helped schedule ice time for Northdales rink use. Their refrigerated systems were 20'x20' rubber coils that interlocked and then got filled with the glycol and pressurized for ref6gation then had sand dumped and spread on top to flood on the sand. They budgeted $80k annually, $40k for install and $40k for dismantling. In driving bobcats over their coils to spread sand, they beat up up the coil systems pretty bad and the EPA once got involved for glycol leaking. The sand never fully got collected so their plan to use the rinks in summer for rollerhockey became merely impossible due to sand flowing onto rink with every rain because the boards were elevated to allow room for coils and sand so debris ran under the boards onto the playing surface. I obtained quotes and worked with Norm Colemans assistant and budget committe to pour concrete and refrigeration lines like a normal hockey rink and ceased the use of the rubber coils at all 3 rinks. This also made it possible for roller hockey as the sand was eliminated from the process and the city no longer had an annual $80k expense. They can now flip a switch, refrigeration is pressurized and the concrete cools for flooding. As for my professional life, I started working for Allina Home Oxygen and Medical equipment in May of 2018 doing insurance and order qualification for patients to have home oxygen, nebulizers, hospital beds, and other durable medical equipment. In February of 2021, Allina sold their home medical division to Adapthealth where I still work as a lead in the intake department with a staff of 18 under me. I have a 20yo son who resides in St. Paul. My wife Anna and I purchased our home in June of 2020 in Moundsview and we now have 2 boys, a 2yo and 4mo old who will have me using the MV parks more than I have thus far as they grow up. I feel helping people and planning/organizing is my calling in life. I've had plenty of experience in the arena of what this committee is being formed for. I respect others opinions and try to look at and approach everything with an open mind and see both sides of situations or thoughts. I enjoy doing this type of stuff so I'm applying. My biggest negative quality in this is simply lack of park use and park knowledge thus far. My work schedule does somewhat revolve around patients medical needs as I deal with life sustaining emergency medical equipment - oxygen, tube feedings, vents, etc. Its rare to interfere with my life after 6pm but before 6pm is always up in the air a bit. If planning daytime meetings, I would most likely not be able to attend. I'm sorry this got so long but I'm a wealth of knowledge with St Paul's parks history!lol I'm also a die hard medallion hunter for the Winter Carnival treasure hunt. Jerome found it in 2017 and my mom's aunt found it in 1970 so I have 2 family members as finders. If you're at all familiar, the hunt gets you into parks and history and you learn about areas of the city and park history. We're always looked at funny showing up at a park on say January 27th at midnight with a garden hoe and a headlamp speaking in tongue with some clues that make no sense to us, but we're there to dig thru the snow, even if it's -50 with a polar vortex wind chill of-65!haha I have nothing to attach but if you have any questions or If I can be of assistance, please let me know. The 2023 Street Project included Pleasant View Drive from County Road H2 to County Road I. The West side of Pleasant View Drive, Stinson Boulevard, lays within the City of Fridley resulting in a joint street project. The Cities of Mounds View and Fridley have in place a JPA for pavement maintenance and reconstruction for Pleasant View Drive/Stinson Boulevard. Discussion: Pleasant View Road was designed with a shared use bike and walking trail on the East side of the road, with mail boxes being installed on the West side. During final construction the United Stares Post Office of Minneapolis and St. Paul required that the mailbox posts be installed on both sides of the road in accordance to each area for postal coverage. With the trail constructed and the mailboxes now installed in the trail, the 2-foor clear zone does not meet with the design requirements of the MN Department of Transportation State Aid. Staff as well as Stantec have been with working with State Aid to acquire a variance in order to resolve the issue of the mailboxes placed in the trail.
