XXX CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA AN ORDINANCE AMENDING CHAPTER 33 OF THE MOUNDS VIEW CITY CODE REGARDING MAKING APPOINTMENTS TO CITY ORGANIZATIONS THE CITY OF MOUNDS VIEW ORDAINS: SECTION 1. The City Council of the City of Mounds View hereby amends Title 3, Chapter 33, sections 33.002-33.005 by adding the double -underlined material and deleting the str-icken material as follows: § 33.002 MEMBERSHIP; TERMS; OATH; COMPENSATION. (A) Membership; terms. The Planning and Zoning Commission shall consist of seven members from the resident population of the city, other than persons elected to a public body, te-H A ointments shall be made pursuant to the Standard Aj2n2intment Process is City Code, section 33.100 et seg. The appointees shall have three-year staggered terms; at least two of these terms, but not more than three terms, shall expire each year on December 31. Based upon the recommendation of the Planning and Zoning Commission, the City Council shall appoint a Chairperson. (B) Oath and taking of office. The appointees shall be duly sworn and take office at the first regular meeting of the Commission in the month of January each year. Both original and successive appointees shall hold their offices until their successors are appointed and qualified. (C) Compensation. All members of the Commission shall serve without compensation. Both original and successive appointees shall hold their offices until their successors are appointed and qualified. § 33.063 CONFLICTS OF INTEREST. No member shall be personally interested in any contracts in which the Commission may enter. § 33.064 fReservedl does not attend nine regularly scheduled meetings per year. SECTION 3. The City Council of the City of Mounds View hereby amends Title 3, Chapter 33, sections 33.082-33.085 by adding the double -underlined material and deleting the strieken material as follows: § 33.082 COMPOSITION; MEMBERS; QUALIFICATIONS; TERMS OF OFFICE. The City Council of the City of Mounds View hereby amends Title 3, Chapter 33, by adding new sections 33.100-33.088 as follows: STANDARD APPOINTMENT PROCESS § 33.100 PURPOSE The adoption of the standard appointment process is to promote participation in city processes in a manner that is uniform and consistent with the City's goals of encouraging civic engagement. § 33.101 DEFINITIONS MU210\54\944238.v1 City Commission refers to the Planning and Zoning Commission, the Parks and Recreation and Forestry Commission, or the Economic Development Commission. Appointing Authority means the body authorized to make appointments to the respective City Commission. The City Council is authorized to make appointments to the Planning and Zoning Commission and the Parks and Recreation and Forestry Commission, and the Economic Development Authority is authorized to make appointments to the Economic Development Commission. Standard Appointment Process means the process for making appointments established in City Code, section 3 3. 100 et seq. § 33.102 APPLICABILITY The Standard Appointment Process shall apply to City Commissions. Each City Commission may have additional standards and requirements that are outlined in the City Code section establishing that City Commission. Language in the City Code section related to a City Commission will govern if it conflicts with language in the Standard Appointment Process. § 33.103 APPLICATION PROCESS (A) Each person desiring to serve of a City Commission must: (1) complete the application form provided by the City. (2) consent to a background check consisting of a review of the applicants criminal history and driving offenses. This does not include a civil or fiscal history check. (3) participate in an interview with applicable City Commission's chair, staff liaison, mayor, and one of two councilmembers serving on the City Council's human resources committee. § 33.104 DISQUALIFYING FINDINGS (A) Two of more members of the same family may not be appointed to the same City Commission. Family members include domestic partners, married couples, parents, children, siblings, aunts and uncles, cousins, grandparents, and grandchildren. (B) An applicant does not meet the City Commission specific criteria established in the relevant City Code section. (C) Conflict of Interest. No applicant with a private or personal interest likely to conflict with the general public interest shall be appointed to a City Commission. A conflict of interest may be based on the subject matter considered by the City Commission. § 33.105 TERM LIMITS No term limits shall be established for any City Commission. § 33.106 APPOINTMENT AND VACANCIES (A) A City Commission may recommend applicants who have completed the steps in Section 33.102 and who are not disqualified pursuant to Section 33.103 to the Appointing Authority for appointment. MU210\54\944238.v 1 (B) Vacancies will be filled using the same process as the original appointment and appointees will serve the remainder of the unexpired term. (C) The Appointing Authority may make appointments it determines, in its sole discretion, are in the best interest of the City. (D) An appointment is not effective until the appointee takes an oath that they will faithfully discharge the duties of the appointed position. § 33.107 VACANCIES Vacancies may occur on a City Commission for the following reasons: (A) Resignations. Commissioners may resign their appointed position prior to the expiration of their term by giving written notice to the City Commission's chair. The Chair is responsible for communicating the resignation to the other commissioners and the City Council or Economic Development Authority. (B) Removal — Commission Vote. Commissioners may be removed from office by an affirmative vote of four -fifths of the City Council or Economic Development Authority. (C) Removal — Absence. A Commissioner who is absent from meetings as described below, maybe removed by a majority vote of the Appointing Authority: (1) Planning and Zoning Commission — Absent from twenty regularly scheduled meetings per year without the consent of the Planning and Zoning Commission. (2) Parks and Recreation and Forestry Commission — Absent from nine regularly scheduled meetings per year. (3) Economic Development Commission — Absent from three consecutive meetings, or from five meetings in a calendar year. SECTION 5. This ordinance shall take effect and be in force 30 days from and after its passage and publication, in accordance with Section 3.09 of the City Charter. ELIGIBILITY: Nominee must possess and demonstrate a generous community spirit. Nominee has proven their commitment and a pattern of effort directed toward the community. You are encouraged to submit any background information, letters of support, or any other material that demonstrates the nominee's contribution to the community as it relates to the selection criteria. All materials must be received by the close of the nomination period, and become the property of the City of Mounds View. Eligibility Nominee must possess and demonstrate a generous community spirit. Nominee has proven their commitment and has a pattern of effort directed toward the community. Nominee is a role model in the community and thereby raises the standards of social responsibility. Please note that City employees, City contractors, or past Citizen of the Year Award recipients are ineligible.
