PUBLIC COMMENT 43 44 Carol Mueller, 8343 Groveland Road, explained she received a survey regarding stop signs on 45 Groveland Road. She explained she would be handing her survey in to the City. She expressed 46 concern with the addresses that the survey was sent to. She discussed how surveys were collected Mounds View City Council July 8, 2024 Regular Meeting Page 2 1 from people who do not live on Groveland Road. She commented on how the stop signs have not 2 detoured traffic, as previously anticipated,but rather have slowed the speed of passing traffic. She 3 questioned why more opinions were needed versus the opinions of those most impacted on 4 Groveland Road. She hoped that anyone who received the survey understood there was more going 5 on. 6 7 Vince Meyer, 8380 Spring Lake Road, commented on the Spring Lake Road project. He reported 8 he had debris on his roadway and sidewalks. He explained he was told by the Public Works 9 Director that the rocks and debris would be cleaned up. He asked the debris and trash be cleaned 10 up. 11 12 Barb Lucarelli, 8381 Groveland Court, discussed the notice regarding the flashing stop signs. She 13 reported the letter stated the survey was being sent to Mounds View residents that live on 14 Groveland Road and Groveland Court. She indicated she lives on Groveland Court and not one of 15 the residents on Groveland Court received the notice. She encouraged the City to review their 16 mailing list to ensure impacted residents receive the proper information. 17 18 City Administrator Zikmund stated he would follow up on this. 19 20 Luke Edmond, 8407 Spring Lake Road, reported 160 trees were cut down for the Spring Lake 21 Road project. He understood the trees were to be replanted on a 3:1 ratio. He asked where in 22 Mounds View the new trees had been planted. He explained he lives on Spring Lake Road and he 23 did receive the Groveland Road survey information. He was of the opinion the stop signs should 24 remain in place. He reported his wife was working on a petition to have stop signs installed on 25 Spring Lake Road. 26 27 Mayor Lindstrom commented on how the Groveland Road survey results will be broken down by 28 street. 29 30 6. SPECIAL ORDER OF BUSINESS 31 A. SBM Fire Chief Dan Retka- Update. 32 33 Fire Chief Retka provided the Council with an update from the SBM Fire Department. He was 34 pleased to report he was trending under budget for 2024, due to streamlining decisions that were 35 made by the department. He commented on how calls for service were up 30% and explained the 36 new staffing model was improving response times. 37 38 Assistant Chief Scavo discussed the fire corps initiative the SBM Fire Department was pursuing. 39 He explained the fire corps was a group of civilians that want to give back to the community. He 40 noted the fire corps currently has 26 members. He stated in 2023 the volunteers logged over 3,400 41 hours of volunteer time and worked to assist with rehab, taking photos/videos, assist with hosting 42 special events, and provide a care team. He commented further on the outreach that was conducted 43 by the fire department. He discussed the work that was completed on the safety house, noting the 44 fire corps worked to revamp this vital piece of equipment for the SBM Fire Department. 45 46 Mounds View City Council July 8, 2024 Regular Meeting Page 3 1 Fire Chief Retka stated he was really proud of the great work that was being done by the fire corps 2 team. 3 4 Mayor Lindstrom thanked Fire Chief Retka and the entire SBM Fire Department for their 5 dedicated service to the community. 6 7 8. COUNCIL BUSINESS 8 A. Resolution 9950, Supporting Mapping Prejudice — Director Dr. Kirsten 9 Delegard,Michael Corey, Technical Lead. 10 11 Dr. Kirsten Delegard thanked the Council for their public service. She discussed the work she has 12 been doing with Mapping Prejudice in order to bring light to how race has shaped the environment 13 over the past century. She commented on the policies that were put in place to steer public and 14 private investments as well as determining who has access to highly resourced schools and 15 greenspace. She indicated the Twin Cities metro area has one of the highest racial gaps when it 16 came to home ownership. She reviewed an example of the racial covenants that were in place in 17 Mounds View. She commented further on how her team has worked to map prejudice and had 18 worked to flag deeds that have racial covenants in place. She discussed how she has worked with 19 more than 9,000 volunteers on this project. She reported more than 30,000 racial covenants have 20 been identified to date. She commented how racial covenants drove segregation in the metro area 21 and legitimized violence against black residents, while also impacting generational wealth for 22 decades. She believed the City was sitting in a moment of historic opportunity and she appreciated 23 how the City Council was addressing this matter. She appreciated how the City was 24 acknowledging the racial covenants or structural racism that was in place and she looked forward 25 to working with Mounds View residents to have these covenants discharged. 26 27 A round of applause was offered by all in attendance. 28 29 Mayor Lindstrom thanked Dr. Delegard for her detailed presentation on Mapping Prejudice. 30 31 City Administrator Zikmund requested the Council approve a Resolution supporting Mapping 32 Prejudice. He explained the City has been working to bring awareness in order to have racial 33 covenants within the City of Mounds View properly discharged. He explained the City would be 34 donating $1,000 in charitable gambling funds to Mapping Prejudice in order to assist with their 35 efforts. 36 37 Council Member Clark requested further information on the letters that were sent from the City to 38 residents. City Administrator Zikmund explained per the Council's direction staff sent letters to 39 residents that have racial covenants in place. He noted the packet of information sent to residents 40 included a letter from staff explaining racial covenants,along with a form to assist with discharging 41 the covenants. He reported he has had residents reaching out to him or visiting City Hall in order 42 to have their racial covenants discharged. 43 44 MOTION/SECOND: Gunn/Clark. To Waive the Reading and Adopt Resolution 9950, 45 condemning the use of Discriminatory Covenants, Discharging Discriminatory Covenants on City 46 Property and Supporting Mapping Prejudice. Mounds View City Council July 8, 2024 Regular Meeting Page 4 1 2 Mayor Lindstrom thanked Dr. Delegard and her staff for all of her efforts. It was his hope Mapping 3 Prejudice would receive the funding they need to continue their good work. 4 5 Ayes—5 Nays—0 Motion carried. 6 7 B. Resolution 9951, Condemning the Use of Discriminatory Covenants, 8 Discharging Discriminatory Covenants on City-Owned Property and 9 Authorizing the City of Mounds view to Participate in the Just Deeds Coalition 10 — Ramsey County Just Deeds Coordinator Amber Bougie, Maria Cisneros — 11 Just Deeds Director. 12 13 City Administrator Zikmund requested the Council adopt a Resolution that condemns the use of 14 discriminatory covenants, discharging discriminatory covenants on City-Owned property and 15 authorizes the City of Mounds View to participate in the Just Deeds Coalition. 16 17 City Attorney Riggs explained Just Deeds is a coalition of cities and private entities that was 18 working to assist with discharging racial covenants. He reported his firm has assisted with this 19 work. 20 21 MOTION/SECOND: Meehlhause/Gunn. To Waive the Reading and Adopt Resolution 9951, 22 Condemning the Use of Discriminatory Covenants, Discharging Discriminatory Covenants on 23 City-Owned Property and Authorizing the City of Mounds View to Participate in the Just Deeds 24 Coalition. 25 26 Ayes—5 Nays—0 Motion carried. 27 28 C. Introduction and First Reading Ordinance 1014, Discharging of Racial 29 Covenants required at Point of Sale — Todd Uecker Ramsey County 30 Recorder/Registrar of Titles. 31 32 City Administrator Zikmund requested the Council introduce an ordinance that would require 33 discharging of racial covenants at the point of sale. He reported Mounds View would be the first 34 City in the State of Minnesota to adopt an Ordinance requiring property owners to discharge 35 covenants prior to point of sale. 36 37 City Attorney Riggs explained the Ordinance would codify the requirement to remove 38 discriminatory covenants in Mounds View prior to point of sale. He reported the Ordinance 39 addresses all materials that were discussed tonight. He indicated this Ordinance was unique, as no 40 other communities have a similar Ordinance in place. It was his hope this Ordinance would be 41 considered by other communities as it would be a great step forward for all. 42 43 Mayor Lindstrom read a portion of the Ordinance aloud for the record and stated he was proud of 44 the great work the City was doing to address racial covenants. He stated he did not want to see 45 Mounds View or any other community taking a step backwards. 46 Mounds View City Council July 8, 2024 Regular Meeting Page 5 1 Mayor Lindstrom opened the meeting for public comment. 2 3 Rene Johnson, 7385 Pleasant View Drive, explained she and her husband supported this 4 Resolution. She discussed her journey with Mapping Prejudice and reported having their racial 5 covenants discharged. She commented on the power of words,how they can hurt or they heal. She 6 hoped to set a strong example in this community for her family as she wanted everyone to be 7 treated with kindness and respect. She thanked the City Council and staff members for all of their 8 efforts to address this matter. She urged those who received a letter from staff to have their racial 9 covenants discharged. 10 11 Joyce Jones-Strait, 7728 Knollwood Drive, spoke to the Council regarding racial covenant 12 language. She thanked the Mayor for his work to have the racial covenants on City-owned 13 properties discharged. She explained her property did not have racial covenant in place but when 14 reviewing the map of Mounds View, she learned that many of her neighbors did. She encouraged 15 her neighbors to have these covenants discharged, even though they were not enforceable,because 16 it was the right thing to do to dismantle the hate that was perpetuated by former systems. It was 17 her hope Mounds View would be a beloved community that brings justice to this issue. 18 19 Dr. Jean Strait, 7728 Knollwood Drive, explained she supported the discharging of racial 20 covenants on all properties in Mounds View. She stated she was a Hamline University Professor 21 and wrote the first ever Truth and Racial Healing Grant which created the Truth, Racial Healing 22 and Transformation Center at Hamline University. She discussed how removing racial covenants 23 was one way to dismantle systemic injustice and wanted Mounds View to lead by example. She 24 reported after first reviewing the map for Mounds View, she was shocked to see how many 25 properties had racial covenants in place. She indicated these covenants were felt as racist 26 discriminatory language of exclusion. She urged all residents of Mounds View to have their 27 covenants discharged in order to assist in creating an inclusive community for all. 28 29 Andre Cohen,7951 Greenwood Drive,stated he was proud of this community and the City Council 30 for stepping up and defending liberty and freedom through action. He understood freedom was not 31 free. He explained the cost for freedom was action and he was proud of his community. 32 33 Timothy David Wood, 2501 Sherwood Road, reported he has a degree in sociology and he 34 sometimes felt that racism didn't necessarily impact him.He stated it wasn't until he learned about 35 other ways discrimination impacted him or other people that he became more aware. He 36 commented on the time he spent studying abroad in Ireland and how important religion was to 37 those in that country. He discussed how things have been given or handed to him because of the 38 color of his skin. He explained he tried to consider how a black man would feel walking into 39 similar situations as him. He stated he completely supported the City approving the discharging 40 of racial covenants in the City of Mounds View. 41 42 Bob King, 7408 Silver Lake Road, noted he had a covenant on his property. He explained he was 43 proud of Mounds View for making it easy for residents to have their covenants discharged. He 44 understood it was important to have these covenants discharged and he did not ever want this to 45 be an issue for his property. 46 Mounds View City Council July 8, 2024 Regular Meeting Page 6 1 Ben Gillespie, 7980 Fairchild Avenue,reported his home has racial covenants in place and that he 2 was in the process of having them discharged. He thanked the Council for the manner in which 3 they were addressing this issue. He explained this was one very important issue that was being 4 brought to light and noted there were many other systemic or institutional oppression issues that 5 happen in cities. He encouraged residents to watch how they speak to their neighbors and to work 6 to better understand where their neighbors are coming from in order to spread kindness. 7 8 Jacinta Moss, 2970 Mounds View Blvd., explained she moved to Mounds View to be in a 9 community that supports change. She stated she worked to love her neighbors in this community 10 and she appreciated how the Mayor held his head high. 11 12 Murwo Mohamed,2657 Mounds View Blvd,reported she has lived in this community for the past 13 11 years. She believed this was a beautiful City to live in. She indicated she would consider 14 purchasing a home in the community and she was pleased the racial covenants were being 15 discharged. 16 17 Paula Mielke, Councilmember from Falcon Heights, explained when Philando Castile was killed 18 in her community eight years ago, some residents were asking why their community was so white. 19 She discussed how this led her to research deeds in search of racial covenants. She reported she 20 found the horrible story as to why Falcon Heights was so white. She indicated she was very proud 21 of Mounds View for passing this ordinance and she looked forward to doing the same in Falcon 22 Heights. 23 24 Sharon Kirscher, 8406 Red Oak Drive, reported her family has lived in Mounds View since 1957 25 when her parents purchased their first home. She noted her home does not have a racial covenant 26 in place, but she would be looking into the platting of her property. She explained she supported 27 the City doing away with all racial covenants as she wanted systemic racism done away with. 28 29 Sarah McClindon, 7710 Greenwood Drive, stated she supported the City doing away with racial 30 covenants. She commented on how removing the covenants would not undue the harm of forced 31 racial segregation, but she believed this would confront the racial roots the country has as well as 32 the values of the community, which was that racism was not welcome in Mounds View. 33 34 Kelly Moller, State Representative in District 48, thanked the Council for inviting her to this 35 meeting and for their historic work. She explained she appreciated the great work the City of 36 Mounds View was doing and noted she would go back to the Capitol to see how this could be done 37 on a State-wide basis. 38 39 John Marty, State Senator for District 40, thanked the Council for their strong leadership on this 40 issue. He reported this was a great community and he appreciated how the community was 41 acknowledging this shameful practice publicly. 42 43 Luke Edmond, 8407 Spring Lake Road, thanked the City for their efforts on this matter. He 44 explained he supported it becoming a criminal charge for those who chose not to discharge their 45 racial covenants. 46 Mounds View City Council July 8, 2024 Regular Meeting Page 7 1 Rebecca Scholl, 2467 Hillview Road, thanked the Council for their great work. She appreciated 2 how the community was coming together to not be racist, but to also fight against racism. She 3 reported she was aware of racial covenants years ago when she worked in the mortgage industry. 4 She appreciated how simple the City has made it for residents to have their covenants discharged. 5 She stated she understood that words mattered and she wanted everyone in this community and 6 outside of this community to know who this community was. 7 8 Darnell Baker, 3024 County Road J, reported he does not have a covenant in place on his home. 9 He explained he works with the Quincy House and their new property in Mounds View does have 10 a racial covenant in place. He discussed how the Quincy House works primarily with children of 11 color. He explained he was honored to be a part of this community and he was proud of the work 12 being done by the City. 13 14 Mayor Lindstrom closed the meeting for public comment. 15 16 MOTION/SECOND: Meehlhause/Clark. To Waive the First Reading and Introduce Ordinance 17 1014, Discharging of Racial Covenants required at Point of Sale. 18 19 City Administrator Zikmund reported it was the Mayor who asked if an Ordinance of this manner 20 could be approved. He explained after discussing the matter with the City Attorney he understood 21 that an Ordinance of this type could be approved and made law. 22 23 ROLL CALL: Cermak/Clark/Gunn/Meehlhause/Lindstrom. 24 25 Ayes—5 Nays—0 Motion carried. 26 27 Mayor Lindstrom stated today marks a historic day for Mounds View. He appreciated the step the 28 City had taken to being to right the wrongs of the past and to begin to take steps towards equality 29 for all. He explained today was the end for racial covenants in Mounds View and also make it 30 illegal to have any type of exclusionary covenant. He commented on his Juneteenth speech and 31 how it was focused on the children in this community. He was proud that if asked by his children, 32 did you do something to address racial covenants, he could say yes. He reported the children in 33 this community should know that the local leaders in this community stood up and took action on 34 July 8, 2024 to put an end to racial covenants to right the wrongs of the past. He stated there was 35 no room for prejudice in Mounds View,Minnesota. He then recognized and thanked all who were 36 involved in moving this Ordinance forward. He thanked all of the residents of Mounds View that 37 had already discharged their racial covenants. It was his hope the City's Ordinance would become 38 a model for all communities in the State. A round of applause was offered by all in attendance. 39 40 Mayor Lindstrom recessed the City Council meeting at 7:42 p.m. 41 42 Mayor Lindstrom reconvened the City Council meeting at 8:07 p.m. 43 44 D. Resolution 9953, Organized Trash RFP Recommendation and Authorizing 45 Negotiations. 46 Mounds View City Council July 8, 2024 Regular Meeting Page 8 1 City Administrator Zikmund requested the Council approve the organized trash RFP 2 recommendation and authorize staff to move forward with negotiations. He explained the City 3 received seven responses to the RFP and reported the RFP's were reviewed by Council Member 4 Meehlhause, Council Member Clark, himself and City Attorney Tierney. He reported price, 5 customer service, cart roll out, experience and community presence were considered. He noted 6 LRS received the highest ratings and Aspen received the second highest ratings. 7 8 MOTION/SECOND: Gunn/Meehlhause. To Waive the Reading and Adopt Resolution 9953, 9 Organized Trash RFP Recommendation and Authorizing Negotiations. 10 11 Council Member Clark stated a lot of time was spent reviewing the RFP's and she hoped 12 negotiations would continue in a positive manner. 13 14 Mayor Lindstrom thanked Council Member Meehlhause and Council Member Clark for all of their 15 time and efforts. He was confident that one of the top two vendors would serve the community 16 well. 17 18 City Administrator Zikmund explained half or more of the residents of Mounds View would see 19 significant savings for their trash collection. He explained if the Council approves this Resolution 20 staff would begin negotiation efforts tomorrow. 21 22 Ayes—5 Nays—0 Motion carried. 23 24 E. Resolution 9954, Calling for a Special Election November 8, 2024 for Ballot 25 Question on Organized Trash. 26 27 City Administrator Zikmund requested the Council call for a special election November 8, 2024 28 for ballot question on organized trash. He reviewed the proposed yes or no organized trash ballot 29 question and recommended approval for the November ballot. 30 31 Mayor Lindstrom asked if the ballot question could be condensed. City Attorney Riggs reported 32 the ballot question was similar to language that has been used by other cities. He explained distinct 33 language had to be used. He recommended the ballot question remain as is. 34 35 MOTION/SECOND: Meehlhause/Clark. To Waive the Reading and Adopt Resolution 9954, 36 Calling for a Special Election November 8, 2024 for Ballot Question on Organized Trash. 37 38 Ayes—5 Nays—0 Motion carried. 39 40 F. Resolution 9955, Three Year contract with Community Partners in Youth. 41 42 City Administrator Zikmund requested the Council approve a three year contract with Community 43 Partners with Youth.He explained the Council discussed this matter in 2023.He noted this contract 44 was included in the 2024 budget and was preliminarily included in the 2025 and 2026 budget. 45 46 MOTION/SECOND: Meehlhause/Cermak. Resolution 9956, Approving a Janitorial Cleaning Contract for City Hall, 6 Police, Public Works, Community Center. 7 8 Public Works/Parks and Recreation Director Peterson requested the Council approve a janitorial 9 cleaning contract for City Hall, Police, Public Works and the Community Center. He discussed 10 the proposed three year contract, noting the contract was with a local vendor and recommended 11 approval. 12 13 Mayor Lindstrom explained he had the privilege of meeting the cleaning folks and stated he was 14 very pleased by the quality of their work. 15 16 MOTION/SECOND: Gunn/Clark. To Waive the Reading and Adopt Resolution 9956,Approving 17 a Janitorial Cleaning Contract for City Hall, Police, Public Works, Community Center. 18 19 Ayes—5 Nays—0 Motion carried. 20 21 H. Resolution 9957, Approving a Service Contract for the Standby Emergency 22 Generators. 23 24 Public Works/Parks and Recreation Director Peterson requested the Council approve a service 25 contract for five standby emergency generators. He discussed where the emergency generators 26 were located throughout the City and commented on the importance of having these generators 27 routinely maintained/load tested. He commented further on the proposed service contract and 28 recommended approval. 29 30 Mayor Lindstrom asked if the City has had to use these generators. Public Works/Parks and 31 Recreation Director Peterson explained the generators are used by the City in the event of a power 32 outage to keep the wells and lift stations operational. He reported the generators can run for 33 approximately eight hours if the power were to remain out. 34 35 MOTION/SECOND: Meehlhause/Cermak. Reports of Mayor and Council. 42 43 Council Member Gunn reported the Tribute Park Committee would be meeting on Tuesday, July 44 9 at 6:30 p.m. at City Hall. 45 Mounds View City Council July 8, 2024 Regular Meeting Page 10 1 Council Member Gunn explained she would need someone to attend the Cable Commission 2 meeting on Thursday, July 18. 3 4 Council Member Cermak stated the Mounds View Police Foundation would be meeting on 5 Tuesday, July 16 at Random Park at 5:30 p.m. where future fundraisers will be discussed. He indicated this perfect attendance record would end in two weeks as he 21 will not attend the July 22 City Council meeting. 22 23 Council Member Meehlhause explained one week ago a non-Mounds View resident spoke at a 24 neighboring community and this individual made disparaging and false statements about Mayor 25 Lindstrom. He clarified for the record that Mayor Lindstrom was not lazy. He indicated Mayor 26 Lindstrom did not attend the negotiation sessions with the trash haulers because this would have 27 been inappropriate regardless of the subject matter. He commended Mayor Lindstrom for the 28 amount of time he devotes to his position stating he was greatly appreciated. He reported he has 29 served with four different mayors on his time with the City Council and stated Mayor Lindstrom 30 was the best Mayor he has served with when it comes to representing the community and 31 establishing community partnerships. 32 33 Mayor Lindstrom thanked Council Member Meehlhause for his kind words. He 8 explained he had two officers in shadow training at this time. He reiterated that Night to Unite 9 would be held on Tuesday, August 6. 10 11 Police Chief Zender explained he was chosen as the law enforcement liaison for NYFS and stated 12 he looked forward to serving with this organization. 13 14 Police Chief Zender indicated he would be working with staff to address the parking concerns at 15 Oakwood. 16 17 Police Chief Zender commented on the event that occurred at the splash pad on July 4 noting his 18 officers showed a tremendous amount of restraint and professionalism. 19 20 Police Chief Zender discussed the Intern and CSO programs that had been created noting he hoped 21 these would assist with bringing officers to the department. 22 23 City Administrator Zikmund commended the Mounds View Police Department for handling the 24 issue at the splash pad extremely well. These procedures are adopted to comply with the requirements of the Minnesota Government Data Practices Act (the "Act"), specifically Minnesota Statutes Sections 13.03, subd. 2 and 13.05, subd. 5. It is the intent of the City of Mounds View("City")to remain in compliance with the Act. These procedures shall be supplemented by the requirements of the Act, as needed, and if any procedure contained herein is inconsistent with those requirements, as they may be amended, the specific provisions of the Act shall be controlling and the City will deviate from these procedures, to the extent required. 2.0 Responsible Authority; Compliance Official. The City Administrator is the Responsible Authority and Compliance Official responsible for the collection, use and distribution of government data and is accountable for City compliance with the Act. The Responsible Authority has authorized certain other City employees to collect, maintain, disseminate and otherwise assist in complying with the Act ("Designees"). It does not mean any type of entity created by law, such as a corporation. ** Private and confidential data on decedents become public data 10 years after the death of the data subject and 30 years after the creation of the data. 3.1 People Entitled to Access. Any person has the right to inspect or view public data or to have an explanation of the meaning of the data. The person does not need to state his or her name or give the reason for the request, unless a statute specifically authorizes the City to request such information. The Responsible Authority may ask a person to provide identifying or clarifying information for the sole purpose of facilitating access to the data. Examples of when identifying information may be requested include, but are not limited to, obtaining a mailing address when the person has requested that copies be mailed or requesting identification when copies have been paid for by check. Additionally, any person has the right to obtain a copy of public data except in the case of copyrighted materials in the possession of the City for which the City does not have express written permission to reproduce. 3.1A Copyrighted Documents. Copyrighted public documents may be shown to anyone but shall not be reproduced or photocopied without express written permission from the copyright holder. (Exhibit 7 and, for copyrighted building plans, Exhibit 11) 3.1A1 The Responsible Authority reserves the right to refuse to provide copies of copyrighted data in accordance with the copyright law of the United States (Title 17, United States Code) which governs the making of photocopies or other reproductions of copyrighted material. 3.1A2 Public documents created by the City of Mounds View or its officials or employees on behalf of the City do not qualify for copyright protection and shall be available for viewing and reproduction in accordance with the Act. In certain cases,the City may enforce a copyright or acquire a patent for a computer software program or components of a program created by the City. In such cases,the data shall be treated as trade secret information. 3.2 Form of Request. The request for public data may be verbal or written. The Responsible Authority or designee may require a verbal request to be made in writing whenever a written request will assist the Responsible Authority or designee in performing his or her duties. (Exhibit 3). 3.3 Identification of Requesting Party. The Responsible Authority may not require the requesting party to provide identification to view public documents unless contact information is required in order to clarify the request. The Responsible Authority must %� 3 verify the identity of the requesting party as a person entitled to reproductions when reproductions of copyrighted public data are requested. Identity can be established through personal knowledge, presentation of photo identification, comparison of the data subject's signature on a consent form with the person's signature in City records,or other reasonable means. 3.4 Form of Copies. Where public data is maintained in a computer storage medium, the Responsible Authority shall provide copies of the public data in electronic form upon request,provided a copy can reasonably be made in that form. The Responsible Authority is not required to provide the data in an electronic format or program that is different from the format or program in which the Responsible Authority maintains the data. The Responsible Authority may charge a fee for the actual cost of providing the copy. 3.5 Time Limits. Requests will be received and processed only at Mounds View City Hall during normal business hours. If copies cannot be made at the time of the request, copies must be supplied as soon as reasonably possible. Whenever possible, the Responsible Authority will immediately allow the requesting person to inspect the public data. When providing an immediate response to the requester, it should not interfere with the City's efficient operations. The Responsible Authority may require that the requesting person make an appointment or return at a later time to inspect or to pick up copies of the requested data. When data is requested by the individual that is the subject of the data and an immediate response is not possible, the authorized City employee will provide the data within 10 days of the date of the request, excluding Saturdays, Sundays and legal holidays. 3.6 Fees. Anyone may inspect or view public data for any reason without charge. Fees may be charged only if the requesting person asks for a copy or electronic transmittal of the data. Fees will be charged according to the City's current fee schedule or based on actual cost and may not include time necessary to separate public from nonpublic data. A summary of fees generally associated with data requests is contained in Exhibit 2. 4.0 Access to Private and Confidential Data on Individuals. Information about individual persons is classified by law as public,private,or confidential. A list of the private and confidential information maintained by the City is contained in Appendix A, although such list is subject to the Act, as it may be amended, and therefore is not necessarily exhaustive. 4.1 Persons Entitled to Access. 4.1 A Public information about an individual may be shown or given to anyone for any reason. 4.113 Private information about an individual maybe shown or given to: 4.1131 The individual, but only once every six months, unless a dispute has arisen or additional data has been collected or created. %�4 4.1B2 A person who has been given access by the express written consent of the data subject. (Exhibit 6) 4.1B3 Persons, or another responsible authority, which are authorized access by the federal, state, or local law or court order. 4.1114 Persons within the City staff,the City Council,and outside agents (such as attorneys) whose work assignments or responsibilities reasonably require access. 4.1C Confidential information may not be given to the subject of the data, but may be given or shown to: 4.1C1 Persons who are authorized access by federal, state, or local law or court order. 4.1C2 Persons within the City staff, the City Council, and outside agents (such as attorneys) whose work assignments or responsibilities reasonably require access. 4.2 Form of Request. Any individual may request data verbally or in writing. Data will be released depending on whether or not the City has stored the data requested and whether the data is classified as public,private, or confidential. The Responsible Authority must verify the identity of the requesting party as a person entitled to access when private or confidential data is requested. Identity can be established through personal knowledge,presentation of photo identification, comparison of the data subject's signature on a consent form with the person's signature in City records, or other reasonable means. 4.4 Time Limits. Requests will be received and processed at Mounds View City Hall only during normal business hours. Access to the data will be provided as soon as is reasonably possible. Data requested by the individual that is the subject of the data will be provided within 10 days of the date of the request, excluding Saturdays, Sundays and legal holidays if an immediate response is not possible. 4.5 Fees. Fees will be charged in the same manner as for public information and are summarized in Exhibit 2. J45 4.6 Summary Data. The term"summary data"refers to statistical records and reports derived from data on individuals but which does not identify an individual by name or reveal any other characteristic that could uniquely identify an individual. Summary data derived from private or confidential data is public. The Responsible Authority will prepare summary data upon request, if the request is in writing and the requesting party pays for the cost of preparation. The Responsible Authority must notify the requesting party about the estimated costs and collect these costs before preparing or supplying the summary data. This should be done within 10 days after receiving the request. If the summary data cannot be prepared within 10 days, the Responsible Authority must notify the requester of the anticipated time schedule and the reason for the delay. Summary data may be prepared by"blacking out"personal identifiers, cutting out portions of the records that contain personal identifiers, creating a spreadsheet, programming computers to delete personal identifiers, or other reasonable means. The Responsible Authority may ask an outside agency or person to prepare the summary data i£ (1) the specific purpose is given in writing; (2) the agency or person agrees not to disclose the private or confidential data; and(3)the Responsible Authority determines that access by this outside agency or person will not compromise the privacy of the private or confidential data. (Exhibit 4) 4.7 Records of Minors and Incapacitated Persons. The following applies to private (not confidential) data about minors (persons under the age of 18) and about those persons who are incapacitated as defined by Minnesota Statutes Section 524.5-102, subd. 6. 4.7A Parent/Guardian Access. In addition to minors and incapacitated persons as defined above who may have access to private data, a parent may have access to private information about a minor or an incapacitated person. For the purposes of these procedures, "parent"shall include guardians and individuals acting as parents or guardians in the absence of parents or guardians. A parent is presumed to have this right unless the minor has requested that the Responsible Authority withhold the data and withholding the data would be in the best interest of the minor, or it has been given evidence that there is a state law, court order, or other legally binding document, which prohibits this right. 4.7B Notice to Minors and Incapacitated Persons. Before requesting private data from minors and incapacitated persons, City personnel must notify the minors and incapacitated persons that they may request that the information not be given to their parent(s) or guardian(s). (Exhibit 5) 4.7C Denial of Parent or Guardian Access. The Responsible Authority may deny parent or guardian access to private data when the individual requests this denial and the Responsible Authority determines that withholding the data would be in the best interest of the individual. The request from the individual must be in i�6 writing, stating the reasons for the request. In determining the best interest of the individual, the Responsible Authority will consider: 4.7C1 Whether the individual is of sufficient age and maturity to explain the reasons and understand the consequences; 4.7C2 Whether denying access may protect the individual from physical or emotional harm; 4.7C3 Whether there are reasonable grounds to support the individual's reasons; and 4.7C4 Whether the data concerns medical, dental, or other health services provided under Minnesota Statutes Sections 144.341 to 144.347. If so, the data may be released only if failure to inform the parent or guardian would seriously jeopardize the health of the individual. The Responsible Authority may also deny parental/guardian access without a request from the juvenile or incapacitated person under any state or federal statute that allows or requires denial of parental or guardian access and that provides standards for denying parental or guardian access 5.0 Access to Private and Confidential Data on Decedents. Private data on decedents means data which, prior to the death of the data subject, were classified by statute, federal law, or temporary classification as private data. Confidential data means data which,prior to the death of the data subject,were classified by statute, federal law, or temporary classification as confidential data. A list of the private and confidential information maintained by the City is contained in Appendix A, although such list is subject to the Act, as it may be amended, and therefore is not necessarily exhaustive. Information about individuals who are deceased will be treated the same as data that is about individuals who are living except: 5.OA Private and confidential data on decedents will become public data 10 years after the death of the data subject and 30 years after the creation of the data in accordance with Minnesota Statutes Section 13.10, subd. 2. An individual is presumed dead if either 90 years have elapsed since the creation of the data or 90 years have elapsed since the individual's birth, whichever is earlier, except that an individual is not presumed to be dead if the Responsible Authority has information readily available to him or her indicating the individual is still living. 5.OB A representative of the decedent may exercise the rights that the decedent could have exercised as a living individual. A "representative of the decedent" means a personal representative of the estate of the decedent during the period of administration, or if no personal representative has been appointed or after discharge, the surviving spouse, any child of the decedent, or, if there is no surviving spouse or children, the parents of the decedent. i47 6.0 Access to Data Not On Individuals. Information not about individuals is classified by law as public, nonpublic, and protected nonpublic. Information that is not about individuals will generally be treated the same as data about individuals. Nonpublic and protected nonpublic information, except for security information, becomes public either 10 years after it was created by the City or 10 years after the data was received or collected by the City unless the Responsible Authority reasonably determines that if the information was made public or made available to the data subject that the harm to the public or the data subject would outweigh the benefit to the public or the data subject. 6.1 People Entitled to Access. 6.1A Public information not about an individual may be shown to anyone. Copyrighted documents will not be reproduced or photocopied without express written permission from the copyright holder. (Exhibit 7 and, for copyrighted building plans, Exhibit 11) 6.1B Nonpublic information not about an individual may be shown or given to: 6.1B1 An authorized representative of the subject entity of the data, but only once every six months, unless a dispute has arisen or additional data has been collected. 6.1B2 A person who has been given access by the express written consent of the authorized representative of the entity which is the subject of the data. (Exhibit 6) 6.1B3 Persons who are authorized access by the federal, state, or local law or court order. 6.1114 Persons within the City staff, the City Council, and outside agents (such as attorneys) whose work assignments or responsibilities reasonably require access. 6.1C Protected nonpublic information may not be given to the authorized representative of the entity, but may be given or shown to: 6.1C1 Persons who are authorized access by federal, state, or local law or court order. 6.1C2 Persons within the City staff, the City Council, and outside agents (such as attorneys) whose work assignments or responsibilities reasonably require access. 48 6.2 Form of Request. Any person may request data verbally or in writing. Data will be released depending on whether or not the City has stored the data requested and whether the data is classified as public, nonpublic, protected nonpublic or is copyrighted. All requests to view or receive a reproduction of nonpublic or protected nonpublic information must be made in writing in order to verify identity. All requests to receive a reproduction of copyrighted public, nonpublic or protected nonpublic information must be made in writing in order to determine if the request for copyrighted material qualifies for release under copyright law of the United States (Title 17 of the United States Code). The Responsible Authority will provide a form (Exhibit 3) to document the requesting party's identity, the information requested, and the City's response; however, any person may request data verbally or in writing as long as the request includes documentation of the requesting party's identity and a detailed description of the information requested. 6.3 Identification of Requesting Party. The Responsible Authority must verify the identity of the requesting party as a person entitled to access when nonpublic or protected nonpublic data is requested. The Responsible Authority must also verify the identity of the requesting party as a person entitled to access when copies of copyrighted private, nonpublic, or protected nonpublic data is requested. Identity can be established through personal knowledge, presentation of photo identification, comparison of the data subject's signature on a consent form with the person's signature in City records,or other reasonable means. 6.4 Time Limits. Requests will be received and processed at Mounds View City Hall only during normal business hours. The response must be immediate,if possible,or prompt and reasonable, if an immediate response is not possible. 6.5 Fees. Fees will be charged in the same manner as for public information and are summarized in Exhibit 2. 6.6 Accessibility of Records. Upon request by an individual, records must be made available within a reasonable time period to persons with disabilities in a manner consistent with state and federal laws prohibiting discrimination against persons with disabilities. Reasonable modifications must be made in any policies, practices and procedures that might otherwise deny equal access to records to individuals with disabilities. This requirement does not apply to (1) technology procured or developed prior to January 1, 2013, unless substantially modified or substantially enhanced after January 1, 2013 or(2) records that cannot be reasonably modified to be accessible without an undue burden as defined in Minnesota Statutes Section 16E.015, subd. 4 to the public entity or (3) except as otherwise provided in Minnesota Statutes Chapter 16E. 7.0 Temporary Classification. If the Responsible Authority determines information not expressly classified by law should be protected, the Responsible Authority may apply to the Department of Administration Commissioner for permission to classify information as private, confidential, nonpublic or protected nonpublic for its own use and for the use of other i�9 governmental entities on a temporary basis. The application and the classification of the information shall be in accordance with Minnesota Statutes Section 13.06. 8.0 Denial of Access. If the Responsible Authority determines that the requested data is not accessible to the requesting party, the Responsible Authority must inform the requesting party verbally at the time of the request or in writing as soon after that as possible. The Responsible Authority must give the specific legal authority, including statutory section, for withholding the data. The Responsible Authority must place a verbal denial in writing upon request. This must also include the specific legal authority for the denial. 9.0 Collection of Data on Individuals. The collection and storage of information about individuals will be limited to that necessary for the administration and management of the programs specifically authorized by the state legislature, City Council, or federal government. 9.1 Tennessen Warning. When an individual is asked to supply private or confidential information about the individual, the City employee requesting the information must give the individual a Tennessen warning. (Exhibits 8 and 9) 9.1A This warning must contain the following: 9.1A1 The purpose and intended use of the requested data; 9.1A2 Whether the individual may refuse or is legally required to supply the requested data; 9.1A3 Any known consequences from supplying or refusing to supply the information, and 9.1A4 The identity of other persons or entities authorized by state or federal law to receive the data. 9.1B A Tennessen warning is not required when: 9.1B1 An individual is requested to supply investigative data to a law enforcement officer; 9.1112 The data subject is not an individual (e.g., the data subject is a corporation or partnership); 9.1B3 The data subject offers information that has not been requested by the City; 9.1134 The information requested from the individual is about someone else; 10 9.1135 The City receives information about the subject from someone else; or 9.1B6 The information requested from the subject is classified as public data. 9.1C A Tennessen warning may be on a separate form (Exhibit 9) or may be incorporated into the form which requests the private or confidential data (using language in Exhibit 8). 9.11) Collection of Data on Individuals through the Use of the City's Computer System. When an individual gains access to government information or services through the City's computer system, the City may create, collect, or maintain electronic access data or use its computer to install a cookie on an individual's computer. The City must inform individuals gaining access to the City's computer system of the creation, collection, or maintenance of electronic access data or the City's use of cookies before requiring the individual to provide any data about the individual to the City. As part of that notice, the City must inform the individual how the data will be used and disseminated. Notwithstanding an individuals' refusal to accept a cookie on its computer, the City must allow the individual to gain access to data or information,transfer data or information, or use government services by means of the City's computer system. 9.2 Data Quality Procedures. The City is required to establish procedures that data on individuals are accurate, complete and current. The Responsible Authority shall work with employees that collect, use, or disseminate data on individuals to implement the following procedures: 9.2A At the time that data is collected from the individual data subject, the individual should be advised of his or her right to review and contest the accuracy or completeness of public or private data concerning him/herself. 9.213 An individual data subject should be encouraged to review his/her file for accuracy, completeness and currency. 9.2C Whenever possible and practical, collect data about an individual from the individual subject of the data rather than from third parties (e.g., birth date, address, etc.) (This directive does not prohibit employees from collecting data from third parties). 9.21) Design forms to collect objective types of data elements whenever possible, rather than data which calls for an opinion or conclusion or other subjective entry. Forms for the collection of data on individuals should request only necessary data. i�&11 9.2E Department heads should periodically review forms used to collect data on individuals. Data elements that are not necessary or that lend themselves to ambiguity or subjectivity should be removed and the forms redesigned. 9.2F Department heads should periodically conduct quality/validity checks on sample case files that contain data on individuals. 10.0 Data Accuracy and Completeness. 10.1 Challenge to Data Accuracy or Completeness. An individual who is the subject of public or private data may contest the accuracy or completeness of that data maintained by the City of which they are the subject. "Accurate"means the data are reasonably correct and free from error. "Complete" means the data describe all of the subject's transactions with the City in a reasonable way. To challenge the accuracy or completeness of data, the individual must notify the City's Responsible Authority in writing describing the nature of the disagreement. The statement should describe why or how the data are inaccurate or incomplete and should also state what the individual wants the City to do to make the data accurate or complete. Within 30 days, the Responsible Authority or designee must respond and either(1) correct the data found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or incomplete data, including recipients named by the individual, or (2) notify the individual that the Responsible Authority believes the data to be correct. Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data. The Responsible Authority should provide the data subject with a written statement that informs the data subject of the right to appeal and should also provide a copy of Minnesota Rules, Part 1205.1600. An individual who is dissatisfied with the Responsible Authority's action may appeal to the Commissioner of Administration,using the contested case procedures under Minnesota Statutes, Chapter 14. The Responsible Authority will correct any data if so ordered to do so by the Commissioner. 10.2 City Employee Data. All City employees will be requested, and given appropriate forms, to annually provide updated personal information to the Responsible Authority, as necessary for tax, insurance, emergency notification, and other personnel purposes. Other individuals who provide private or confidential information will also be encouraged to provide updated information when appropriate. 10.3 Review. City department managers should periodically review forms used to collect data on individuals to delete items that are not necessary and to clarify items that may be ambiguous. All records must be disposed of according to the City's records retention schedule. 11.0 Data Protection. *�&12 11.1 Legal Requirement. The adoption of this Section by the City satisfies the requirement in Minnesota Statutes, Section 13.05, subd. 5 to establish procedures ensuring appropriate access to not public data. By incorporating employee access to not public data in the City's Data Inventory in the individual employee's position description, or both, the City's policy limits access to not public data to employees whose work assignment require reasonable access. Please direct all questions regarding this Section to the Responsible Authority. 11.2 Data Inventory. Under the requirement in Minnesota Statutes, Section 13.025, subd. 1,the City has prepared a Data Inventory which identifies and describes all not public data on individuals maintained by the City. To comply with the requirement set forth in Minnesota Statutes, Section 13.05, subd. 5, the City has also modified its Data Inventory to represent the employees who have access to not public data. 14.3 Data Safeguards. 11.3A Not public data will be stored by the City in files or databases which are not readily accessible to individuals who do not have authorized access and will be secured during hours when the offices are closed. 11.3B Not public data must be kept only in City offices, except when necessary for City business. 11.3C The City will assign appropriate security roles to its employees, limit employee access to appropriate shared network drives and implement password protections for not public electronic data. 11.31) Only those City employees whose job responsibilities require them to have access will be allowed access to City files and records that contain not public data. Employee position descriptions will contain provisions identifying any not public data accessible to the employee when a work assignment reasonably requires access. If a City employee does not have a work assignment allowing access to the not public data, the City will ensure that the not public data are secure. The City's employees will be instructed to: 11.3D1 Release or disclose not public data only to those persons,within and outside of the City, who are authorized by law to have access to the data; 11.3D2 Do not leave not public data where unauthorized individuals might see it; 11.3D3 Password protect their computers and lock their computers before leaving work stations; *�&13 11.3D4 Secure not public data within locked work spaces and in locked file cabinets; and 11.3D5 Shred not public data before disposing of them. In the event of a temporary duty assigned to a City employee, the employee may access certain not public data for as long as the work is assigned to the employee. 11.4 Data Sharing with Authorized Entities or Individuals. H AA When a contract with an outside party requires access to not public data, the contracting party will be required to use and disseminate the information consistent with the Act. The City must include in a written contract the language contained in Exhibit 10 or substantially similar language. IIAB In addition to the employees listed in the City's data inventory (see Appendix A), the Responsible Authority, the City's criminal prosecutor, the City Attorney,the City Engineer, and the City Building Inspector may have access to all not public data maintained by the City if necessary for specified duties. Any access to not public data will be strictly limited to the data necessary to complete the work assignment. HAC State or federal law may authorize the sharing of not public data in specific circumstances. Not public data may be shared with another entity if a federal or state law allows it or mandates it. Individuals will have notice of any sharing in applicable Tennessen warnings, or the City will obtain the individual's informed consent. The City will also obtain informed consent from an entity submitting not public data for the purposes of a building permit application (Exhibit 11). Any sharing of not public data will be strictly limited to the data necessary or required to comply with the applicable law. 11.5 Penalties for Unlawfully Accessing Not Public Data. The City will utilize penalties for unlawful access by its employees to not public data as provided for in Minnesota Statutes, Section 13.09, if necessary. Penalties include suspension, dismissal, or referring the matter to the appropriate prosecutorial authority who may pursue a criminal misdemeanor charge. 4,14 EXHIBIT 1 LIST OF DESIGNEES The Minnesota Data Practices Act establishes a system for compilation and distribution of data gathered by government agencies. All data collected and maintained by the City of Mounds View ("City") is presumed public and is accessible to the public for both inspection and copying,unless classified as Private, Confidential, Nonpublic or Protected Nonpublic in accordance with federal law, state statute or a temporary classification. If information is to be provided via digital means (CD or USB drive), a new, unopened product shall be provided to the City by the requestor. Security Service Data CLASSIFICATION(S): Nonpublic//Public GOVERNING STATUTE: Minn. Stat. §§ 13.861, 13.37 and 13.82, subd. 2, 3 and 6. DESCRIPTION OF DATA: Data collected, created, or maintained by a security service for the purpose of providing security services to the City that are similar to the data described as request for service data and response or incident data in Minn. Stat. § 13.82, subd. 3 and 6 are public. If personnel of a security service make a citizen's arrest,then any security service data that are similar to the data described as arrest data in Minn. Stat. §§ 13.7411, subd. 4 (d), 115A.93, subd. 5 DESCRIPTION OF DATA: Customer lists provided to the City by solid waste collectors are private data on individuals or nonpublic data with regard to data not on individuals. 4Appendix A-8 PLANNING Appraisal Data CLASSIFICATION(S): Confidential/Protected Nonpublic/Public GOVERNING STATUTE: Minn. Stat. § 13.44, subd. 3 DESCRIPTION OF DATA: Estimated or appraised values of property that are made by the City or by an independent appraiser acting for the City for the purpose of selling or acquiring land through purchase or condemnation are classified as confidential data on individuals or protected nonpublic data. However, this data becomes public at the discretion of the City Council, determined by majority vote of the City's governing body. Appraised values of property that are made by appraisers working for fee owners or contract purchasers who have received an offer to purchase their property from a government entity are classified as private data on individuals or nonpublic data. Appraisal data made confidential or nonpublic become public when the data are submitted to a court appointed condemnation commissioner, the data are presented in court in condemnation proceedings or the parties enter into an agreement for the purchase and sale of the property. Award Data CLASSIFICATION(S): Private/Nonpublic GOVERNING STATUTE: Minn. Stat. § 13.48 DESCRIPTION OF DATA: Financial data on business entities submitted to the City for the purpose of presenting awards to business entities for achievements in business development or performance are private data on individuals or nonpublic data. Benefit Data CLASSIFICATION(S): Private/Public GOVERNING STATUTE: Minn. Stat. § 13.462 DESCRIPTION OF DATA: Data on individuals collected or created when an individual seeks information about becoming, is or was an applicant for or a recipient of benefits or services provided under any housing, home ownership, rehabilitation and community action agency, Head Start, or food assistance programs administered by the City are private data on individuals with the exception of the names and addresses of applicants for and recipients of the benefits, which are classified as public data on individuals. Community Center Data CLASSIFICATION(S): Private/Nonpublic/Public GOVERNING STATUTE: Minn. Stat. § 13.55 DESCRIPTION OF DATA: Letters or documentation from any person who makes inquiry to or who is contacted by the community center facility regarding availability of the facility for staging events; identity of firms and corporations that contact the facility; the type of event that the contacting person wants to stage in the facility; suggested terms of rentals and responses of staff to such inquiries are nonpublic or private data on individuals. Harassment CLASSIFICATION(S): Confidential/Private GOVERNING STATUTE: Minn. Stat. § 13.43 subd. 8 DESCRIPTION OF DATA: When there is a harassment complaint against an employee, the employee may not have access to data that would identify the complainant or other witnesses if the data would threaten the personal safety of the complainant or witness or subject the complainant or witness to harassment. Stat. § 13.37 DESCRIPTION OF DATA: Management positions on economic and noneconomic items that have not been presented during the collective bargaining process or interest arbitration, including information specifically collected or created to prepare the management position is classified as nonpublic data with regard to data not on individuals and as private data with regard to data on individuals. Personnel and Employment Data CLASSIFICATION(S): Private/Public GOVERNING STATUTE: Minn. Stat. § 13.43. DESCRIPTION OF DATA: Certain government data on individuals maintained because the individual is or was an employee of or an applicant for employment by, performs services on a voluntary basis for, or acts as an independent contractor with the City are public as set forth in Minn. Stat. § 13.43, subd. 2. All other personnel data is private data on individuals but may be released pursuant to a court order. Undercover Law Enforcement Officer CLASSIFICATION(S): Private/Public GOVERNING STATUTE: Minn. Stat. § 13.43 subd. 5 DESCRIPTION OF DATA: All personnel data about an undercover law enforcement officer is private until no longer assigned to those duties. Then, the officer is subject to the same rules applicable to other employees unless the law enforcement agency determines that revealing the data would threaten the officer's safety or jeopardize an active investigation. Public Safety Peer Counseling and Critical Incident Stress Management Data CLASSIFICATION(S): Private 4-Appendix A-14 GOVERNING STATUTE: Minn. This includes group sessions led by a peer support counselor, one-to-one contact with a peer support counselor, and meetings with a peer support counselor to obtain referrals to appropriate mental health or community support services. "Critical incident stress management services" means consultation,risk assessment, education, intervention, and other crisis intervention services provided by a critical incident stress management team or critical incident stress management team member to an emergency service provider affected by a critical incident. The data shall not be disclosed to third parties as it is classified as private data. Exceptions include when disclosure: (1) is necessary to prevent harm to self by the recipient of the services or to prevent the person from harming someone else;(2)is required by mandatory reporting laws; (3) is authorized by the person who received services and the person provides written consent; (4) is authorized by the living spouse or estate administrator of a deceased person who received services; or(5) is required under limited circumstances related to testimony. Child Abuse Report Records CLASSIFICATION(S): Confidential/Private GOVERNING STATUTE: Minn. Stat. §§ 13.871, subd. 6 (b), 13.82, subd. 8 and 9 and 626.556, Minn. Stat., Chapter 260E DESCRIPTION OF DATA: Active or inactive investigative data that identify a victim of child abuse or neglect reported under Minn. Stat. § 626.556 are private data on individuals. Active or inactive investigative data that identify a reporter of child abuse or neglect under Minn. Stat. § 626.556 are confidential data on individuals, unless the subject of the report compels disclosure under Minn. Stat. § 626.556, subd. 11. Investigative data that become inactive under Minnesota Statutes, Section 626.556, subd. 7(a) or(b) and that relate to the alleged abuse or neglect of a child by a person responsible for the child's care, as defined in Minn. Stat. § 13.85 DESCRIPTION OF DATA: Data on individuals created, collected,used or maintained because of their lawful confinement or detainment in state reformatories, prisons and correctional facilities, municipal or county jails, lockups, work houses, work farms and all other correctional and detention facilities are classified as private to the extent that the release of the data would either: (a) disclose medical,psychological or financial information or personal information not related to their lawful confinement or detainment or (b) endanger an individual's life. Corrections and detention data are confidential to the extent that the data would (a) endanger an individual's life, (b)endanger the effectiveness of an investigation authorized by statute relating to the enforcement of rules or law, (c) identify a confidential informant, or (d) clearly endanger the security of any institution or its population. Crime Victim Notice of Release CLASSIFICATION(S): Private GOVERNING STATUTE: Minn. WHEREAS, the City is owner of City Hall, City Hall Park, Silver View Park and the Community Center (collectively the "Park") located within the City; and WHEREAS, the Corporation desires to sponsor and coordinate an annual community event entitled, "Festival in the Park of Mounds View" (the "Festival"), to be held on August 16 and 17, 2024; and WHEREAS, pursuant to Minnesota Statutes, and other laws, the City has the authority to operate a program of public recreation and enter into agreements with the Corporation pertaining to the conduct thereof; and WHEREAS, the City desires that the Corporation sponsor and coordinate the Festival; and WHEREAS, the City is willing to support the Festival, as set forth in this Agreement; and WHEREAS, the Corporation is willing to undertake the Festival sponsorship and support of the City in accordance with the terms and conditions of this Agreement. NOW THEREFORE, the parties agree as follows: 1. Scope of Festival. The Corporation will sponsor and coordinate all aspects of the Festival. 2. Time and Performance. This Agreement will begin as of August 16, 2024, and will terminate as of August 17, 2024 (the "Termination Date"). 3. City Contribution. The City will provide the assistance of City staff to assist the Corporation as set forth on Exhibit A, which is incorporated herein by reference. The City will provide the assistance of City equipment to assist the Corporation as set forth on Exhibit B, which is incorporated herein by reference. The City will allow use of the Park upon the Corporation requesting and obtaining the appropriate permits from the City for the Park. The City agrees to waive the permit fee for the Park. In support of the community-based Festival, the City will provide assistance in additional expenditures, not to exceed $5,000, to assist the Committee in payment of the Fireworks Show. If the Agreement should be terminated for any reason prior to the Termination Date, the City's assistance to the Corporation will cease upon termination. In such case any unfulfilled assistance as set forth in Exhibits A and B will remain unfulfilled.—The Corporation shall pay any and all taxes due to federal, state, and local governments, and the City shall not withhold any amounts therefore. In addition, the Corporation shall be responsible for any necessary workers compensation and unemployment insurance required for the individuals performing services hereunder, and the City shall have no obligation whatsoever in this regard. 4. Independent Contractor. The Corporation and neither it nor any of its volunteers, employees or agents performing services hereunder shall be an employee of the City. The Corporation is an independent contractor and it shall retain control over the manner and means of the work set forth above. The Corporation understands and acknowledges that the City shall not provide any benefits of any type in connection with this Agreement, including but not limited to health or medical insurance, workers compensation insurance, or unemployment insurance. The Corporation shall in no case have the power to bind or obligate the City in any way to any third-party. 5. Insurance. a. The Corporation shall provide comprehensive general liability insurance for bodily injury and property damage with a combined single limit of $1,000,000 per occurrence. Such comprehensive general liability insurance shall include, but not be limited to, coverage for mechanically-operated amusement devices, alcohol sales, and fireworks displays. The policies of insurance shall name the City of Mounds View as an additional insured. b. The Corporation shall provide evidence of automobile and mobile equipment insurance coverage for all motorized vehicles used in connection with work under this Agreement with a combined single limit for bodily injury and property damage of not less than $1,000,000 per occurrence. C. A Certificate of Insurance showing coverage as indicated above with a carrier that is acceptable to the City of Mounds View as well as a copy of all policies of insurance shall be submitted to the City Administrator at least 30 days prior to the Festival. The City reserves the right to reject the carrier if it is not an A+ carrier licensed to do business in the State of Minnesota. d. Nothing herein shall be construed as a waiver of any immunity or limitation on liability to which the City is entitled under law. 6. Termination. If either party fails to perform its obligations under this Agreement, the other party may terminate this Agreement by giving written notice of the intention to terminate to the other party at least thirty (30) days prior to such termination, provided, however, that if Corporation's failure to perform its obligations hereunder creates or constitutes, in the sole judgment of the City, a threat to the public health, safety, or welfare, the City may immediately terminate this Agreement. 7. General Terms and Conditions. a. The Corporation will provide all equipment used by the Corporation, except the City equipment as set forth in Exhibit B, which is incorporated herein by reference. b. The Corporation will control its own schedule of work hours as necessary to sponsor and coordinate the Festival. C. Any and all reports, and other work products, whether completed or not, that are prepared or developed by the Corporation as a part of this Agreement shall be jointly owned by the City and the Corporation and shall be made available to the City promptly at the City's request or at the termination of this Agreement. The Corporation shall provide annual financial reports including all revenues and expenditures related to the Festival for the present year within thirty days of the date of the Festival, and the City will retain these records for three (3) years. d. Any titles of the several parts of the Agreement are inserted for convenience of reference only and shall be disregarded in construing or interpreting any of its provisions. e. This Agreement, together with its Exhibits, which are incorporated by reference, constitutes the complete and exclusive statement of all mutual understandings between the parties with respect to this Agreement, superseding all prior or contemporaneous proposals, communications, and understandings, whether oral or written, concerning this Agreement. This Agreement may not be amended nor any of its terms modified except by written authorization and executed by both parties hereto. 8. The Corporation shall protect, indemnify, defend, and hold harmless the City and its governing body members, officers, agents, servants, and consultants_against and from any claim, demand, suit, action, or other proceeding whatsoever by any person or entity whatsoever arising or purportedly arising from this Agreement or the activities undertaken pursuant to it. General Fund: The main source of revenue for the City is property taxes and these come in twice a year. Expenditures are at 40.1% of budget through the end of the quarter, compared to 35.4% last year. Some of this difference is due to the timing of invoices. Most of the General Fund revenues come in late in the second quarter and then again late in the fourth quarter, so it is important to maintain a fund balance that approximates 50% of budgeted expenditures and transfers for cashflow purposes. The General Fund ended 2023 with unassigned fund balance that is equal to 54.86% of the 2024 budgeted expenditures and transfers compared with 54.15% in 2022. Other Funds: The Street Improvement Capital Projects Fund ended 2023 with a fund balance of$1,286,624. This fund is integral in maintaining the newly reconstructed streets and reconstructing streets still in need. Some of the capital projects included in the various funds of the City are work on the Park System Master Plan, CIPP sanitary sewer lining, replacement of water meters, and storm water maintenance. Investments & Economy: Investment income to date for 2024 is $217,013 compared with $168,395 for the same period in 2023. The market value of our portfolio for June 30, 2024 was 19,490,005 compared with $21,931,462 for 2023. The decrease is mainly due to the water meter replacement, sewer lining, and 2023 street improvement projects. The Federal Open Market Committee (FOMC) has decided to maintain the target range for the federal funds rate at 5 '/4 to 5 '/2 percent. It seeks to achieve maximum employment and inflation at the rate of 2 percent over the longer run. The economic outlook is uncertain, and the Committee remains highly attentive to inflation risks. Inflation has eased over the past year but remains elevated. Treasury securities are presently providing the following rates-of-return: Treasury Securities 2024 2023 1 year 5.090 5.400 2 year 4.710 4.870 5 year 4.330 4.130 10 year 4.360 3.810 30 year 4.510 3.850 State unemployment for May was 2.8% which compares to national unemployment of 4.0%. Nationally, inflation is at 3.0%, which is the same as it was a year ago. The high was back in 2022 at 9.1%. At the state level, the legislature is working with a $3.7 billion surplus based on the February 2024 forecast. The Legislature needed to adopt any budget amendments by May 20" Finance Department Operations: The annual financial audit and the 5 Year Financial Plan have been completed. Work on the 2025 Municipal budget is in process. Budget work will continue thru the summer and into the fall. Recommendation Staff recommends the City Council review and accept the quarterly report. Upon completion of the form, and submission to Ramsey County Recorders office, which is waiving the $43 filing fee, the discharge process is completed. The City Council of the City of Mounds View hereby amends Title III by adding a new chapter as follows: Chapter 38: Discriminatory Covenants 38.001 Findings 38.002 Definitions 38.003 Discharge of Discriminatory Covenants 38.004 Discriminatory Covenants Prohibited 38.999 Penalty § 38.001 Findings. (A) Discriminatory covenants were tools used by real estate developers to prevent persons of color and non-Christian individuals from buying or occupying property in certain areas, and they were common throughout the United States from the early 1900s to the 1960s; and (B) The purpose of discriminatory covenants was to racially and religiously homogenize communities by excluding persons of color and non-Christian individuals from Mounds View. These tools segregated the metro area and built a hidden system of apartheid; and (C) In 2016, the University of Minnesota founded Mapping Prejudice to expose the racist practices that shaped the landscape of the metro area. Mapping Prejudice researched restrictive covenants in Ramsey County and created the first-ever comprehensive map of racial covenants in an American city. As of February 2024, the project mapped 5458 covenants in Ramsey County, including 517 covenants in Mounds View; and (D) An example of a covenant in Mounds View declared that "No person or persons other than of the Caucasian race shall be permitted to occupy said premises or any part thereof'; and (E) The discriminatory covenants exist in Mounds View throughout the city; and (F) Restrictive covenants are no longer enforceable. Legal efforts to eliminate Discriminatory Covenants include Shelley v. Kraemer, 334 U.S. 1 (1948), in which the United States Supreme Court prohibited courts from enforcing Discriminatory Covenants and the Minnesota legislature in 1953 enacted statutes that prohibited new covenants, but existing covenants were still legal in Minnesota until 1962; and (G) As a result of these judicial and legislative actions, today, Minnesota law and federal Ordinance No. 1014 Page 2 law prohibit discrimination in the sale or lease of housing based on race, color, creed, religion, national origin, sex, marital status, status with regard to public assistance, disability, sexual orientation, or familial status and those state and federal prohibitions extend to the refusal to sell or to circulate, post or cause to be printed, circulated, or posted, any limitation, specification, or discrimination as to race, color, creed, religion, national origin, sex, marital status, status with regard to public assistance, disability, sexual orientation, or familial status; and (H) In 2019, the Minnesota Legislature passed a law authorizing property owners to individually discharge or renounce discriminatory covenants by recording a discharge form in the county property records; and (I) Discriminatory covenants promoted and established residential racial segregation, which historically and currently has impacted property ownership, accumulation of wealth, property transfers, mortgage eligibility, rental eligibility, property values, property tax base, internet access, and more. Discriminatory covenants fortified systemic racism and compounded economic divestment in specific communities within Ramsey County; and (J) The State of Minnesota, including the City of Mounds View, recognizes the harm that Discriminatory Covenants, and the racial, religious, and other discriminatory practices that they represent, cause to society in general and to the individuals who are adversely affected by racial, religious, and other discrimination through the presence of discriminatory covenants in the public land records; and (K) The City of Mounds View disavows and condemns the past use of discriminatory covenants and prohibits discriminatory covenants from being used in the future. § 38.002 Definitions. "Discriminatory Covenant"means any restrictive covenant filed against any property that restricts to whom property may be conveyed based on race, color, creed, religion, national origin, sex, marital status, status with regard to public assistance, disability, sexual orientation, or familial status. § 38.003 Discharge of Discriminatory Covenants. (A) Required. No person shall sell, give, or transact a change in title or property ownership of real property with one or more buildings or structures,without receiving a certificate from the city. (B) Application. Unless the property owner already has a certificate for a property, the owner or owner's representative is required to obtain a certificate before the property is sold, gifted or transferred, and before the owner or owner's representative enters into any contract for deed or other transaction changing the party responsible for the property. (C)Issuance of Certificate (1) A certificate shall be issued by the city if- (a) The applicant submits title evidence showing no discriminatory covenant for the property. (b) The applicant submits documentation showing the discriminatory covenant has been discharged. Ordinance No. 1014 Page 3 (c) The applicant submits the form required to discharge discriminatory covenants to the city for filing with Ramsey County. The City may provide notary and mailing services. The certificate shall not be issued unless the form is accepted and filed with Ramsey County. (d) The applicant files the required form to discharge the discriminatory covenant at the time of closing. (D) City Records. The city shall maintain a list of all properties that it has been informed have a discriminatory covenant and a list of all properties for which a certificate has been issued. § 38.004 Discriminatory Covenants Prohibited. Discriminatory covenants are prohibited in the City of Mounds View and may not be filed against any property in the City. 38.999 Penalty. Violation of this section shall not result in a petty misdemeanor or criminal prosecution. Violations of this Chapter shall be charged as an administrative offense subject to City Code, section 130.002. SECTION 2. In accordance with Section 3.07 of the City Charter, City staff shall have the following summary printed in the official City newspaper in lieu of the complete ordinance: On July 22, 2024, the City Council adopted Ordinance 1014, adding a new chapter 38 to Title III of the Mounds View City Code regarding the discharge of Discriminatory Covenants. A printed copy of the ordinance is available for inspection during regular business hours at Mounds View City Hall and is available online at the City's web site located at www.moundsviewmn.org. The system was first constructed in the 1970's and as with other similar core functions, research, innovation, and best management practices have changed over the years. In 1974 the Federal Government adopted the Clean Water Act, this resulted in Cities applying for a MS4 storm water permit with the MPCA that includes best management practices (BMPs), the City has put many of these BMPs in place to comply with the permit. One of the many BMPs implemented is the practice of keeping debris out of the lakes and streams by sweeping the streets. Due to the many Storm Water Infiltration devices (SIP) installed the Public Works Department has taken a more aggressive approach to this BMP by sweeping, on an average, of 6-7 times during the spring, summer and fall seasons. (More sweeping will occur if build up is evident along the gutter lines.) These sweepings over the years have been accumulated at Ardan Park, behind the Ramsey County Compost site. The City Council approved Resolution 9783 authorizing Stantec to complete the assessments regarding Ardan Park, AA-1.P1 and AA-1-.P2 storm water ponds. Stantec and Staff are currently preparing and reviewing the 90% completed plans for dredging and improvements to Ardan Park storm water ponds; the project will also include the removal of the sweeping pile. With the proposed removal of this sweeping pile, the Public Works Department will need to change its operation and BMPs for sweeping. This change will require building an additional material storage bin at the Public Works facility. (See pictures for reference) The sweeping debris will be stored in the bin and every two years screened for trash and sand that can be recycled. Staff reviewed different options and determined that the same type of cement panel that was installed originally would be the best fit. Staff obtained a quote from Hanson Silo Company for 10 panels, transitions, installation, and freight for a cost of$20,000.00.
