Contract for the Random Park Building
Replacement Project
Background:
On December 12, 2005, the City Council waived the Public Improvement
Hearing, held a Public Information Meeting, ordered the project, Approved a
contract to demolish the existing building at Random Park, and authorized the
preparation of plans and specifications for the Random Park Building
Replacement Project.
On January 9, 2006, the City Council adopted Resolution 6717 approving the
plans and specifications and authorizing the advertisement for bids and setting a
February 2, 2006 bid date for the Random Park Building Replacement Project.
On January 23, 2006, Staff presented an alternate design for the parking lot. The
proposed design moved the parking lot to the east and placed its access off of
Ridge Lane. The City Council gave direction to include this design as an
alternate and to have Staff review this alternate plan with the adjacent property
owners. The plan that showed the parking lot access from Long Lake Road was
noted as Alternative A. The plan that showed the parking lot access from Ridge
Lane was noted as Alternative B.
Discussion:
Based on the direction from the City Council, an addendum was sent to the plan
holders of this project informing them of the two bid alternates. Staff also met
with the adjacent property owners to discuss Alternate B (Ridge Lane Access
Alternate). The adjacent property owners did not have any objection to Alternate
B.
Bid Review - Bids for the Random Park Building Replacement Project were
received at 10:00 a.m. on Tuesday, February 2, 2006 at the Mounds View
Community Center.
A total of six (6) bids were received; a seventh bids was attempted to be
submitted after the bidding was closed and was therefore was not accepted.
A complete bid summary is as follows:

Review of Low Bidders Bid Bond and References
As a standard course of action, the City's consult starting to review references of
the apparent low bidder. During this process it was discovered there maybe
issues with references and / or bonding irregularities of the apparent low bidder.
Due to these issues the City's consultant recommended that the City review the
bid bond that was submitted. Staff has contact the surety company that issued
the bid bond of the apparent low bidder on Wednesday, February 8, 2006. The
surety company indicated to Staff that the bond submitted to the City may not be
in order and would fax a letter summarizing their position on this matter on
Thursday, February 9, 2006. This fax was received at 1;47 p.m. on Thursday. It
is attached for Council's review. The City's legal counsel has been contacted,
briefed on this matter, and will be providing consultation on how the City should
proceed.
The remainder of this report and resolution will be written with the
assumption the city's legal counsel has determined that the bid bond
submitted by Olympic Construction does not meet the requirements as set
forth in the bidding specifications and therefore their bid is deemed non-
responsive, and should therefore be rejected on this basis.
On December 12, 2006 funding for this project was established via Resolution
6700. The financing for this project is as follows: all tax increment eligible
expenses will be financed utilizing the City's Tax Increment Fund (TIF). All
remaining expenses are to be financed using an even split (50/50) between the
Park Dedication Account and the Special Project Fund.
Recommendation:
It is recommended the Council adopt a resolution to award a contract to Jay
Bros., Incorporated in the amount of $244,647.75 for Bid Alternate B (parking lot
access from Ridge Lane) for the Random Park Building Replacement Project.

AWARDING A CONSTRUCTION CONTRACT FOR THE RANDOM PARK
BUILDING REPLACEMENT PROJECT
WHEREAS, on January 9, 2006, the City Council adopted Resolution
6717 approving the plans and specifications and authorizing the advertisement
for bids and setting a February 2, 2006 bid date for the Random Park Building
Replacement Project; and
WHEREAS, an addendum was sent to the plan holders of this project
informing them of the two bid alternates- with the parking lot access from Long
Lake Road and Alternative B with the parking lot access from Ridge Lane; and
WHEREAS, bids for the Random Park Building Replacement Project were
received at 10:00 a.m. on Tuesday, February 2, 2006 at the Mounds View
Community Center, and
WHEREAS, six (6) bids were received, of which the apparent low bid
submitted by Olympic Construction Services, Incorporated was found to be non-
responsive and therefore rejected; and
WHEREAS, the low responsive bid was submitted by Jay Bros.,
Incorporated of Forest Lake, Minnesota in the amount of $245,646.00 for
Alternative A, and $244,647.75 for Alternative B.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Mounds View, Ramsey County, Minnesota as follows:
NOTE: City Council must choose la. -OR- 1b.
1 a. That a construction contract for Bid Alternate A (parking lot access
from Long Lake Road) of the Random Park Building Replacement
Project in the amount of $245,646,00 is hereby awarded to Jay
Bros., Incorporated.
1 b. That a construction for Bid Alternate B (parking lot access from
Ridge Lane) of the Random Park Building Replacement Project in
the amount of $244,647.75 is hereby awarded to Jay Bros.,
Incorporated.
2. That the Mayor and City Administrator are hereby authorized and
directed to execute and enter into a contract for the Random Park
Building Replacement Project.

Bid Results
Bids were opened for the Project stated above on Thursday, February 2, 2006, at 2:00 P.M. A total of six bids were
received prior to the advertised deadline for submittal. An attempt was made after the specified time of opening to
submit an additional, seventh bid on the project. Therefore that bid was not received. The identity of the potential
seventh bidder is not known.
The six bids received were opened and read. Following the opening, detailed review of the bids was performed.
During review, it was found that the bid submitted by James Steele Construction Company was not complete, and
therefore that bid was rejected. The remaining Bids were found to be in order.
A Bid Tabulation of the five Bids found to be in order was performed. Transmitted herewith is a copy of the Bid
Tabulation for your information and file. Copies will also be distributed to each Bidder. A summary of the results
of these Bids is shown below. The Engineer's Estimate for the Project is also shown for comparison.
As you know, this Project consists of two main components. The first component is the relocation of the existing
club house building from the former Bridges Golf Course site to Random Park, including new foundation and
building alterations. The second component is site improvements at Random Park, including grading and
construction of a new parking lot.
There are two alternatives for the location of the parking lot, as described in documents submitted to the City by us
on January 23, 2006. One alternate would access the parking lot off of Long Lake Road, while the other alternate
would access the parking lot off of Ridge Lane. Each alternative is viable. It is our understanding that the City is
considering both alternatives, and will select the preferred alternate, based on public input and other factors, prior to
making award of contract for this Project.

For purposes of bidding, the work was separated into parts and identified as follows: the work associated with the
relocation of the building was identified as the Total Base Bid — Building Improvements; the site improvements
associated with the alternative that would access the parking lot off Long Lake Road were identified as Total
Alternate A — Site Improvements; and the site improvements associated with the alternative that would access the
parking lot off Ridge Lane were identified as Total Alternate B — Site Improvements.
The total work to be included in this Project would then be the combination of the Total Base Bid plus either Total
Alternate A or Total Alternate B. The combination of the Total Base Bid and an alternate has been defined for this
Project as the Total Adjusted Base Bid. In the Bid Documents these combined totals were identified as Total
Adjusted Base Bid: Alternate A and Total Adjusted Base Bid: Alternate B, respectively.
The summary of Bids shown previously in this letter identifies and compares the results by Total Base Bid, Total
Adjusted Base Bid: Alternate A, and Total Adjusted Base Bid: Alternate B. It is seen from the results that the order
of the Bids remains the same in each of these comparisons. The low Bidder on the Project under either Alternate
was Olympic Construction Services, Inc.
Once the City has selected their preferred alternate for the parking lot location at Random Park, then consideration
can be given to a contract award as follows:
• Preferred alternate — access off Long Lake Road (Alternate A):
In this case, if the City wishes to award a contract to the low bidder, the corresponding
action would be to award the Project to Olympic Construction Services, Inc. on the
Total Adjusted Base Bid: Alternate A amount of $187,795.00.
• Preferred alternate — access off Ridge Lane (Alternate B):
In this case, if the City wishes to award a contract to the low bidder, the corresponding
action would be to award the Project to Olympic Construction Services, Inc. on the
Total Adjusted Base Bid: Alternate B amount of $186,040.00.
The City is entitled to include all relevant information when considering award of the Project. We do not have
direct previous experience with Olympic Construction Services, Inc. It is also our understanding that the City of
Mounds View has not been involved in any previous contract with Olympic Construction Services, Inc. Therefore,
we have requested that the low bidder, Olympic Construction Services, Inc. as well as the second low bidder, Jay
Bros., Inc. submit a list of references so that additional information can be obtained if desired. We will provide the
reference information to the City under separate cover when it is received.
