Approval of minutes from the November 15, 2007 meeting. 3. Public Input - Citizens are encouraged to speak to the Parks and Recreation and Forestry Commissioners on issues of concern. 4. YMCA Update - Skating Rink Update... 5. Unfinished Business: a.) Parks Promotional Video — Any further discussion / coordination for the Parks Promotional Video. Taping at the Mounds View Community Center will commence following this meeting. b.) Greenfield Park Pubic Meeting Notice — A public meeting notice to discuss the long term plan for the current parkland and trailway will be published in the January edition of the Mounds View Matters. The meeting was set for January 24, 2008 at 6:30pm (just before the regularly scheduled Parks and Recreation Meeting). How does the Commission want conduct the meeting? What information does the Commission want to make available? What displays does the Commission want? Should the notice be directly mailed to nearby property owners? Attached is a copy of the notice that could be sent out. It is a slightly modified version of the article that will be published. If the Commission wants to send out a direct notice to nearby property owners, what area should that be? Attached is the area that was notified regarding the proposed disc golf course. c.) Developing a Volunteer Coach of the Year award and naming it after Patrick "Homer" Holmes — The Commission developed selection criteria, who would be eligible, and the process for approval. The Commission will next finalize the application and set deadlines for this award. The Commission may want to review and recommend the wording for the plaque. Attached is a copy wording that was on the Citizen of the Year plaque along with the current draft of the nomination form. 6. New Business: a.) Establish 2008 Meeting Dates — a draft schedule has been developed with the meetings scheduled for the forth Thursday of the month (except for November and December). b.) Commission to recommend a Chairperson, Appoint a Vise -Chairperson, and Secretary for 2008 c.) Oakwood Park: 2008 Striping and Implementation Plan - The YMCA and Staff will present a plan for review and approval by the Parks and Recreation and Forestry Commission on how should Oakwood Park be utilized in 2008. d.) Neighborhood Park Meetings — discuss the concept of holding Neighborhood Park Meetings for selected parks each year. The intent would be to solicit more public input regarding the long term vision and plan for a particular neighborhood park. e.) Other New Business? 7. Commissioner/Staff Reports: a) Parks and Recreation Appointments — On December 10, 2007 the City Council appointed Jerry Kunz and Cindy Palm to another term on the Parks and Recreation and Forestry Commission. Attached is an updated Commissioner List. b) Woodcrest Park — As directed by the Commission, and based on the guidance from City's Forester, Rick Wriskey, Staff has removed some trees from around the two ponds closest to Woodcrest Drive. c) Tree Preservation Ordinance - On December 10, 2007 the City Council approved Ordinance No. 785 establishing a Tree Preservation Ordinance. This version of the ordinance targets undeveloped areas and not existing residential property. Attached is a copy of this ordinance. d) Park Sign Replacement Program Update — The Commission selected the style and colors for the park sign on August 23, 2007. Four signs have been ordered and delivered on November 16t1'. These are for: Silver View, Random, Hillview, and Groveland parks. e) ALRC Biking Committee —Darren Peterson will be a representative for that committee f) Lakeside Lions Park Playground Equipment Replacement Project — On November 26, 2007 the City Council approved the expenditure of funds from the Park Dedication Fund to help finance the Lakeside Lions Park Playground Equipment Replacement Project in an amount not to exceed $20,000. g) Any Other Reports? 8. Roll Call: Kunz, Kroeger, Long, Arel, Palm, Peterson Staff Present: Lee, Dazenski, Weldon, Prindle 2. Approval of minutes from the October 25, 2007 meeting. Motion by Arel, 2" `' by Long to approve minutes. Motion passed 6-0. 3. Public Input - Citizens are encouraged to speak to the Park and Recreation and Forestry Commissioners on issues of concern. No residents approached. 4. YMCA Update: Weldon reported on activities: Basketball has increased, especially with colder weather and days off of school. Dec. 8th picture with Santa 9-10:30 am. Ice rinks flooded mid -December. Accepting applications for rink supervisors. April -October rentals: Hillview 32 rentals; Random 63 rentals, SilverView 60, City Hall 20, Groveland 12 rentals. Hillview, Lambert, and Groveland had the park programs with use four days a week, Rentals include Lions Club, Boy and Girl Scouts as well as private residents. 5. Unfinished Business: a.) Parks Promotional Video — Any further discussion / coordination for the Parks Promotional Video. MVCC, Oakwood, Lakeside, Hillview, and Lambert are left to shoot. MVCC after December meeting. b.) Disc Golf Course — The Commission directed staff to prepare a rough estimate for cost of foot bridges; and a bottom line cost estimate for the three options of 9, 12, and 15-hole courses for this meeting. An updated spreadsheet of the estimated costs has been completed and include foot bridges and a parking lot. 9-hole: $54,860; 12-hole: $53,180; 15-hole: $65,500; 18-hole: $75,820 The 9 hole course could be a problem to make user friendly because of the elimination of the southern holes. It would end at a substantial distance from the 1st hole, leaving a long walk back to the car. The 12 hole is very user friendly and requires only three bridges. A 15' bridge on the 4th hole, a 15 footer on the 9th hole, and a 20' bridge on the loth hole. We can plan on $500.00 per bridge The 15 hole course does not require any additional bridges over the 12 hole course. The Commission also directed Staff to contact the City's Forester, Rick Wriskey, for a quantitative tree impact. Rick Wriskey reviewed the site on November 14`1'. Mr. Wriskey reported that minor removals would be necessary. Concerns by the commission include cost, neighborhood reaction, unexpected funds toward Lakeside Park playground. We want to see what residents want done about the park as well as other ideas the community may have to spend park money on. If not an additional disc golf course, then what? We will put in a segment in the Mounds View Matters asking for input from residents to come to the January meeting to discuss possible ideas. Motion by Peterson, 2" by Kunz to table the disc golf course idea and ask for input from residents as to how to revitalize Oakwood Park. Motion Passed 6-0. Council Member Flaherty spoke to address the Oakwood Park issue. Asked the Commission to put concrete ideas out to residents. Ideas include disc golf, improving the trail, adding other amenities to the trail, making it a nature walk with labeling trees, etc. inviting Pinewood School to get involved in ideas. Commissioner Peterson will draft something for the Mounds View Matters. Commissioner Palm will contact Pinewood School science teacher for ideas. c.) Commissioner/Staff Reports: a) Oakwood Playground Equipment Replacement Project Update — The play equipment has been installed. Grass is doing well and will be ready for next soccer season. Commissioner contacted an area soccer association that would be willing to assist with equipment for the Oakwood fields. City staff will work with MVCC /YMCA to look into lacrosse equipment and the desire to start some programs for MV youth. b) Woodcrest Park —Staff was directed to look into the cost of dredging the ponds. It would cost $7-$9 per cubic yard if we had a place to build a berm or drop excess sediment in the city. If the material needed to be moved off site it would increase the cost to $12-1 3 dollars per Cu/yard. Staff will utilize these unit costs to develop an overall estimated cost to dredge the ponds at Woodcrest Park. City Forester, Rick Wriskey reported via email that the "wetland/holding pond areas of Woodcrest park were viewed on 11/14/07 and found to be in functional balance from a vegetation point of view. The mix of cattails and fringe willow pretty much follows the intent and plan of this wetland. While occasional dredging for water volume purposes might be a concern over time, I don't see any reason to cut or trim the fringe area of willows or other woody vegetation. With no public objective of such an activity, this action and the follow-up control of re -growth would not be in line with the natural wetland function and intent." Council Member Flaherty reported his concerns about safety for mothers at the park with children. Direct staff to trim and remove trees and vegetation from the access trail to the east. c) Policy/program for memorials within City Parks. This was presented to the City Council on November 5, 2007 for review. The City Council was very pleased with the efforts of the Parks, Recreation, and Forestry Commission on this matter. This policy will be presented to the City Council for consideration of approval on November 26th. d) Lakeside Lions Park — A meeting was held on October 30, 2007. Commissioner Kroeger is the City's representative for this park. The playground will be installed spring 2008. The funds for the playground recommended by the Commission are on the Capital Improvement Plan for 2008 and will be addressed by the city council for final approval at upcoming meetings. e) Recognition of Commissioner Aukee in attendance f) Park Sign Replacement Program Update — The Commission selected the style and colors for the park sign on August 23, 2007. The purpose of the meeting is to discuss what should be the long term plan for the parkland area and existing trailway located north of Oakwood Park and east / northeast of Greenfield Park (see attached map). In recent months the Parks and Recreation and Forestry Commission has been investigating the feasibility of constructing a disc golf course in this area. However, the cost of the course, including the cost of other needed infrastructure items such as a parking lot and bridges to cross the creek, made this proposal less appealing. The Commission also conducted a neighborhood meeting to discuss the proposed disc golf course in which nearby property owners voiced several concerns. At the November Parks Commission Meeting, the Commissioners made a motion to table further investigation on the feasibility of constructing a disc golf course and to set a public meeting to discuss what should be the long term vision for this area. Possible options that may be considered and discussed: A) Eliminate the existing trail and let the area become fully natural B) Keep the existing trail "as is" and do minimal maintenance C) Upgrade the trail and increase maintenance in this area. Possible additions could be: 1) Pave the trail - this will make it handicapped accessible 2) Add the two bridges acquired from the golf course 3) Add a storm water feature near the intersection of Quincy and Hillview 4) Make this an educational nature trail with native plantings and informational plaques for these plantings D) Develop a Disc Golf Course - can be done with other options E) Develop a regional pond(s), noise berm, and trailway (based on previous proposal - 2002) F) Other possible options? The direction of the Council at the meeting was support of the ordinance with the exemption of R-1 and R-2 zoned properties from the tree removal restrictions, along with these other changes: 9 Deletion of the section for tree removal on lots WITHOUT construction, O Exempted R-1 properties from the section for removal on lots WITH construction, O Reduced the number of replacement trees required, O Eliminated the varying replacement requirements depending on lot size (under 1/2 acre versus 1+ acre). Staff and the City Forester are proposing that a tree preservation & landscaping ordinance be added to the Mounds View Zoning Code. An amendment to Chapter 1103 subd, 4 is also recommended. This would be a reference to Chapter 1127.05 for specific landscaping requirements. City Council Action The City Council held a public hearing on the proposed ordinance on November 26, 2007, and approved the first reading and introduction, Recommendation: Staff recommends approving the second reading and adoption of Ordinance 785 and the publication of the ordinance summary (attached) in lieu of the whole ordinance, as provided by City Charter. The ordinance, along with the full text of the City's Wetland Zoning Code, are on file and available for public viewing at the office of the Clerk Administrator. Chapter 1103, Section 1103.08 subd, 4, "Landscaping Required", is hereby amended with the proposed addition underlined: 1103,08: FENCING, SCREENING AND LANDSCAPING Subd. 4. Landscaping Required: In all zoning districts, the lot area remaining after providing for off-street parking, off-street loading, sidewalks, driveway, building site and/or other requirements shall be planted and maintained in grass, sodding, shrubs or other acceptable vegetation or treatment generally used in landscaping. The requirements of Chapter 1127.05 must be met for all new developments in the R- 3, R-4, B-1, B-2, B-3, B-4, 1-1 and PUD districts. SECTION 2. The City Council of the City of Mounds View, has hereby determined that the Mounds View Zoning Code be amended by adding a Tree Preservation & Landscaping Ordinance as follows: CHAPTER 1127 TREE PRESERVATION & LANDSCAPING SECTION: 1127.01: Purpose 1127.02: Definitions 1127.03: General Tree Protection Requirements 1127.04: Tree Removal on Lots With Construction or Grading Permits 1127.05: Landscaping Requirements 1127.06 Plan Review Process 1127.07 Appeal Process 1127.08 Violation and Penalties 1127.01. PURPOSE. The purpose of this chapter is to identify trees and woodlots which are to be preserved in general and saved when development is occurring or at any point thereafter. It is the City's goal to ensure that development is compatible with the natural environment and is accommodated without destroying desirable environmental features and natural amenities. It is not the City's intent, however, to preserve significant trees or woodlots where substandard subdivision design, poor drainage, excess slope in streets and driveways or inefficient utility construction would result. 1127.02: DEFINITIONS: When used in this Chapter, the following words and phrases shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: DRIP LINE: The imaginary line at the outer edge of a tree or shrub, the point where water would drip to the ground from the outermost branches or leaves. HIGH VALUE TREES: Any tree from the list below, • Birches (River & Paper) la Black Walnut • Catalpa • Cherry • Al I Firs • Flowering Crabapples & Hawthorns • Hackberry • Hybrid American Elm • Ironwood • Japanese Tree Lilac • All Lindens • Al I Maples • All Oaks • Ohio Buckeye • Pines (except Jack) • All Spruce ROOT ZONE: That area of effective tree rooting (out to the extent of the branches plus 5 five feet). SIGNIFICANT TREE: A significant tree is defined as any live healthy High Value tree measuring eight (8) inches in diameter or greater, measured at 4.5 feet above the ground. SPECIMEN TREE: Any High Value Tree over 16 inches in diameter, or any other species over 30 inches in diameter. TREE CROWN: The upper part of a tree, including the branches and leaves. WOODLOT: An area of trees of significant or specimen size on at least twenty-five (25) percent of the total lot area. 1127.03: GENERAL TREE PROTECTION REQUIREMENTS. Developers, landowners, and builders shall attempt to preserve the maximum number of significant and specimen trees on lots as possible by using creative design techniques for the location of structures and other improvements within property boundaries. Subd, 1, Preservation Standards, a. Structures and other amenities shall be located in such a manner that the optimum number of trees shall be preserved. b. Prior to the granting of a permit, the person requesting the permit shall demonstrate that there are no feasible or prudent alternatives to the removal of significant or specimen trees on the site. c. Forestation, reforestation or landscaping shall utilize a variety of tree species and shall not utilize any species presently under disease epidemic. d. Development including grading and contouring shall take place in such a manner that the root zone, as defined in Section 1127.02, of existing trees shall not be affected. 1127.04: TREE REMOVAL ON LOTS WITH CONSTRUCTION OR GRADING ACTIVITY Subd 1. Tree Plan Required. A tree plan, which would include a tree inventory, prepared by an arborist, landscape architect or forester, shall be submitted for any project in which any trees will be impacted as a result of said project. Tree inventories shall identify existing healthy significant trees, specimen trees, woodlots and smaller groups of non -significant trees within the limits of the proposed project area. The inventory should clearly indicate which trees would be lost as a result of the project and which trees would be saved. The tree inventory shall be submitted at the same time as any other required application submittals. This requirement may be waived at the discretion of the Community Development Director and the City Forester. Subd. 2. Replacement Standards. Replacement tree species shall be approved by the City Forester in accordance with Section 1127.05. a. No additional plantings shall be required on lots less than one acre where five or more replacement and high value trees over eight inches in diameter would remain, or on lots one acre or larger where ten or more replacement and high value trees over eight inches in diameter would remain. For every significant tree removed, the permit holder or property owner shall plant a new tree on a one-to-one replacement basis, up to a maximum of five new trees. Parcels in the R-1, Single Family Residential zoning district are exempt from the provisions of this section, b, For every specimen tree removed, the permit holder or property owner shall plant a minimum of two new trees, up to a maximum of five new trees. c. Replacement trees shall be planted no later than twelve months beyond the date of tree removal. The owner or permit holder shall guarantee the survival of the replacement trees for two full growing seasons beyond the year of planting. In cases where replacement cannot occur within the specified timeframe, an extension may be granted at the discretion of the City Forester and Community Development Director. d. Replacement Quantity Reductions. The number of required replacement trees may be reduced when deemed appropriate at the sole discretion of the City Forester based on existing site conditions, e, Exceptions. Replacement requirements shall not apply to trees lost as a result of utility trimming or maintenance, work conducted by or on behalf of a governmental agency in pursuance of its lawful activities or functions, disease, storms or other acts of natural occurrence. Subd. 3, Trees within development areas designated for preservation shall be protected from construction damage by placing a snow fence or flags in a perimeter five feet beyond the tree's dripline, within which area no equipment shall traverse or materials, debris or fill shall be placed. Subd. 4. Additional Removals. If, through the course of a development activity, it becomes necessary to remove additional trees beyond what was previously approved in the Tree Plan. It shall be the responsibility of the applicant to submit such request to the City in writing, explaining the reasons necessitating the additional removals, and obtain written approval of the Community Development Director or designee before proceeding. 1127,05 LANDSCAPING: Subd. 1. Applications for development in the R-3, R-4, B-1, B-2, B-3, B-4, 1-1 and PUD districts shall be accompanied by a detailed landscape plan. The landscape plan should be developed in accordance with the site plan submitted for approval. Subd, 2. Detailed landscape plans shall include the following information: a. General: name and address of developer/owner, name and address of architect/designer, date of plan preparation, date and description of all revisions, name of project or development, scale of plan, north point indication. b. Site analysis: Boundary lines of property line with dimensions based upon certified survey, name and alignment of proposed and existing adjacent on - site streets, location of all proposed utility easements and right-of-way, location of existing and proposed buildings, topographic contours at two (2) foot contour intervals, location of parking areas, water bodies, proposed sidewalks, and percentage of site not covered by structures and impervious surfaces. c. Landscape data: A planting schedule table shall include symbols, quantities, common names, botanical names, size of plant materials, root specifications, and special planting instructions. d. e. Typical sections and details of fences, retaining walls, berms and other landscape improvements. Typical sections of landscape islands and planter beds with identification of materials used. f. Details of planting beds and foundation plantings. g. Delineation of both sodded and seeded areas indicated in square footage. h. Where landscape or inorganic materials are used to provide required screening from adjacent and neighboring properties, a cross section shall be provided at a legible scale illustrating the prospective of the site from the neighboring property and property line elevation. Subd. 3. Number of plant materials required: In order to achieve an appropriate and complete quality landscaping of a site, the following minimum number of plant materials shall be provided as indicated below: a. One (1) overstory deciduous shade tree for every two thousand (2,000) square feet of the total building footprint. b. One (1) coniferous tree for every two (2,000) square feet of building or one (1) coniferous tree for every two hundred (200) feet of site perimeter, whichever is greater. c. One (1) understory shrub for every three hundred (300) square feet of building or one (1) shrub for every thirty (30) feet of site perimeter, whichever is greater. d. One (1) ornamental tree for every two thousand (2,000) square feet of building or one (1) ornamental tree for every two hundred (200) feet of site perimeter, whichever is greater. e. The number of plant materials required in Subdivision 3 a-d may be reduced by fifteen percent in each category in the 1-1 districts, f. In the event a site plan layout does not have adequate space to accommodate plant quantities as required herein, such quantities per species can be reduced, provided that total required height or caliper is maintained. The Community Development Director and City Forester must approve all changes. Subd, 4. Minimum size of plantings and species requirements: a. Only tree species from High Value Tree list or other tree species as approved by the City Forester shall be used. b. Overstory deciduous — 2'/2 inch caliper. c. Coniferous — 6 feet in height as measured from grade. d. Shrubs — 24 inch plant (potted). e. Ornamental trees — 2 inch caliper. Subd. 5. Method of installation: All deciduous and coniferous trees shall be ball and burlap and staked and guyed per National Nurserymen's Standards, All shrubs shall be potted. Subd. 6. Use of Landscaping for Screening: a. Where natural materials, such as trees or hedges are approved in lieu of the required screening by means of walls or fences, density and species of planting shall be such to achieve screening year round. Subd. 7. Maintenance, a. Property owners shall be responsible for the upkeep of all required plantings and landscape materials. Upon written notice from the City, a property owner shall be required to trim broken or damaged tree boughs, remove fallen trees or storm damaged trees and remove diseased trees as identified by the City Forester.2 Uprooted, damaged or diseased tree stumps shall be removed or ground down below grade. 2 Refer to Chapter 605, Tree Disease Control. b. It shall be the property owner's responsibility to maintain the boulevard area between the property and any adjacent street frontage. 1127 06 PLAN REVIEW PROCESS All tree inventories, preservation plans and landscape plans shall be reviewed by the City Forester, The Parks and Recreation and Forestry Commission may also review such plans at the request of the Community Development Director or the City Forester. When such plans are required as part of a development application (e.g. development review, conditional use permit, minor or major subdivision) the Planning Commission and City Council shall have approval authority. For such plans submitted when no official planning action is necessary, the Community Development Director and City Forester shall retain administrative approval authority. 1127.07 APPEAL PROCESS Administrative decisions by the City Forester and/or Community Development Director may be appealed to the City Council. An appeal shall be filed in writing no more than fourteen (14) days following the date of the administrative decision by the City. The appeal shall be scheduled for consideration by City Council at the next regularly scheduled City Council meeting which is at least seven (7) days from the date of the appeal. 1127.08 VIOLATION AND PENALTIES Except as provided herein, no significant or specimen tree shall be removed from any property in the City. Any violation of any provision of this Chapter shall constitute a misdemeanor offense. Property owners or permit holders having been cited for illegal tree removal may be fined up to $750 for each significant or specimen tree illegally removed. In addition to the punishment specified in this section, the City may enforce this Code by any other appropriate form of action which could include withholding a Certificate of Occupancy, forfeiture of all or part of a bond, escrow or financial guarantee and stoppage of the project. SECTION 3. This ordinance takes effect 30 days after its publication in the official City newspaper. One of the issues discussed was the Lakeside Lions Park Playground Improvement Project. The playground equipment is planned to be replaced. Plans have been created along with a cost estimate of $90,000. The Lions have donated $50,000 toward this project. The Spring Lake Park Parks and Recreation Commission have committed to dedicating $20,000 towards this project. The City of Spring Lake Park has asked if the Mounds View Parks and Recreation Commission would consider providing $20,000 in matching funds. At the August 23, 2007 Parks and Recreation Commission Meeting, the Commission reviewed this proposal and requested Staff to provide information pertaining to the long range financial plan for the City as it relates to the Park Dedication Fund. On September 27, 2007 the Parks and Recreation Commission made a motion to recommend to the City Council the dedication of $20,000 to the playground structure at Lakeside Lions Park. The Lakeside Park playground was added to the Mounds View 2008 proposed budget under Park Dedication Funds. The City Council reviewed this portion of the budget on Monday, November 5th, at a Work Session, The Council did not comment on this proposed expenditure at the Work Session meeting and no official action was taken. The City Council is scheduled to approve the 2008 budget on December 10th. Discussion: Attached is a copy of the overall proposed playground equipment layout and price list quotation provided by Minnesota / Wisconsin Playground. The City of Mounds View has purchased playground equipment from Minnesota / Wisconsin Playground for the last three playground replacement projects; Greenfield, Hillview, and Oakwood. Installation of the playground equipment and associated wood fiber fill has been eliminated from the quote ($18,941). It is proposed that The City of Spring Lake Park and the City Mounds View work together to install and assemble this project A breakdown of the proposed Lakeside Lions Park Playground Equipment Replacement Project follows: Lions Club Donations: $50,000 City of Spring Lake $20,000 City of Mounds View: $20,000 Total: $90,000 The City of Spring Lake was recently contacted by Minnesota / Wisconsin Playground and informed that the prices given in the quotation expire on December 1, 2007 and that should they wish to take advantage of this pricing before an annual rate increase, a purchase order would need to be submitted by the expiration date. The City of Spring Lake Park then requested official confirmation from the City of Mounds View for the dedication of funds As with the existing playground equipment, the proposed replacement equipment will be owned and maintained jointly between the cities of Mounds View and Spring Lake Park. Recommendation: Staff, along with the Mounds View Parks and Recreation Commissioners, recommends that the City Council authorize the expenditure of Park Dedication Funds in the amount not to exceed $20,000 for the Lakeside Lions Park Playground Equipment Replacement Project. Staff also recommends that the City Council authorize the Mounds View Public Works Department to assist the City of Spring Lake Park in the installation and assembly of said playground equipment.
