STAFF REPORTS A. Parks and Recreation — Don. Painting began at Hodges Park. Fall Program Brochure will come out next week and Fall Youth Leagues registration will open. Explore More Summer Camp has 5 more weeks and has 107% of last year's enrollment. Seniors are looking forward to two fall trips. Pop up parks visits- hope to receive community engagement on park feedback. Community Events: Walk in the Park (8/3), Festival in the Park Penny Carnival (8/16), Community Resource Fair(9/14), Community Bonfire (9/19), Puzzle Competition (10/12), Fall festival (10/24), Turkey Bingo (11/9) Park Revenue: YTD total very similar from last year. See packet for details. B. Public Works— Pete: July has been very busy. Soccer fields and ball fields maintenance and prep. General maintenance: mowers, weeding, mowing, trash clean up,. Ordered playground tamarack fiber fill for the playgrounds. Most of the playgrounds need some, some need more than others. City arborist has been extremely busy with daily resident messages on ash and oak trees. If there is an ash tree in residents' yards- residents can take it down and have the wood and store the wood. Ramsey county will take resident brush (but not city). City Hall Campus: Splash Pad has been running but a lot of components have been running down and breaking. Props to the maintenance crew for working hard to make sure it has continued to be in working condition. Greenfield park: have needed to replace two locks (one broken, one missing) Oakwood park: the field is being heavily used, if it starts to deteriorate we may have to change plans for fall soccer. There are signs designating field use by permit only. Per Arel- parking looks to be an issue- no parking signs on mailbox side might alleviate issue. Silver View Park: Hawk attacked maintenance worker that was removing buckthorn near the disc golf course. Resident also had hawk attack. Raptor center recommended carrying an umbrella or wearing a helmet near the area. The hawk is apparently trying to protect a nest. Resident put up a hawk warning sign. Off-leash dog areas: No news is good news. They are being used but no complaint. 7. UNFINISHED BUSINESS A. Community Garden —Verbal Update Timothy Wood @ 2501 Sherwood road: met with Edgewood middle school teacher to look at proposed space at school for community garden. Principal, groundskeeper and teacher didn't see a problem with community using the grounds area blocked off for community gardening. Created a survey around community gardening in the past month; so far 17 responses. Some interest in forming a committee. Responses indicated senses of inclusivity, community, space. Feedback indicated that Edgewood space may eventually be too small. Per Arel-would be interested in having a survey end date so we could gauge appropriate number of interest in gardening so we can see if Edgewood appropriate size. Pete has been reaching out to Superintendent Chris Lennox: hasn't heard back yet. Recommendation for Wood to bring back update with survey results at commission meeting on October 24th so we can have better information to guide decisions on appropriate space. Homework for commissioners: go to Edgewood and check out sites (the currently proposed site is what is now an overgrown site. The current in use space is for students). B. Park Information Video —Verbal Update- Don reached out to 9-north. 9-north and staff will write the snippets for each park and bring back to commission. 8. NEW BUSINESS A. Rental of Park Facilities: On July 4th there was an incident at splash pad pavilions. They alerted MVPD they would be having a festival with a large gathering of people. They had vehicles on City trails and sidewalk. They sold merchandise. They had an ice cream truck drive up on the trial. When other residents tried to use the splash pad, the group restricted residents' use. When residents asked to turn the volume down, they treated residents disrespectfully. They also lit fireworks on the splash pad. MVPD had to respond multiple times. It overloaded staff day of and the following day for clean-up and response. They were charged damage deposit for clean up. Trail guards have been ordered- it will allow bicycles and wagons through but not a vehicle. Park takeovers is a metro-wide phenomenon that is using social media to try to take over a park, where around 300 people may show up and block use of residents or other users using the park. This incident was not related to that- but it is something else to watch out. B. Park Rules: Looking for update of park rules. Suggested adding no fireworks. Currently the pavilions have a 4-hour rental window- suggested verbiage to explain to residents the purpose behind the 4-hour window (to allow as many residents as possible to utilize the space) and an offer that if the resident is interested in more than 4 hours to contact staff so staff can work with them to make it work. Playgrounds (and the splash pad) are always considered open to the public- even when renting a pavilion or any park space- the playground is always open. Updated rules signs in each park would be helpful for police if/when they have to come in to deal with park activity. Posted signs at the park give the police something to point to. C. Festival in the Park- Verbal Update: Coming up August 16th and 17th. Friday night will be the parade (NOTE THE PARADE ROUTE HAS BEEN CHANGED). Penny carnival run by the recreation department on Friday night. Splash pad. Food trucks. Saturday: everything at silver view park. Free shuttle bus from community center to silver view. 45 crafters and vendors plan on being there. Car show will be happening. 10am safari bob. Medallion hunt. Pony rides, petting zoo. Children games. Police foundation is doing bingo. Canine demo. Car show presentation at 2. Ramsey county sheriff demonstration. SLP-B-MV fire department demonstration. Touch a truck. Fire department will spray water. 4-7 will be foam party. Raffle going on. Live music and dancing. Power of 10 is the band performing. Fireworks. Food vendors: 17 vendors and food trucks. Seniors are having yoga jenga. Bags tournament. Silver View park parking is preferred to be reserved for handicap- residents should utilize the shuttle. 9. COMMISSIONER REPORTS Lillemo: checked out edgewood for community garden space, but will check out again. Mills: Tribute park will meet again on July 30th. Focus is fundraising. 10. They are 11-13-years-olds who went through job training and worked in program all summer 8-16 hours a week. They did a great job, got valuable job experience and hopefully will be future counselors. (2 fulltime Park Workers, Arborist and 4 seasonal workers) worked on the following items since Aug. 1, 2024. Parks Maintenance • Weekly cutting and painting of soccer, lacrosse and ball field lines • Daily Ballfield game preparations • Splash Pad daily maintenance • Added new playground chips to: City Hall, Groveland and Lambert playgrounds • Several irrigation system repairs and assessments • Repaired old soccer goals in preparation of fall soccer • Mowing, whipping and trash clean up at all parks • Festival in the park set up, August 12-16: Temporary fencing set up, field marking for crafters and car show, 70 picnic tables distributed, 6 tent set ups, location marking Forestry Staff worked on the following items this last month: • Resident phone consults and site visits, daily (Responded to dozens and dozens of calls and emails) • Contractor meets and calls • Buck thorn removal • Several hazard removals on city property • Rough cutting buckthorn • Watering trees and the circle garden at Silverview • Started full tree survey of the city (started marking trees) • Festival Preparation • Working on city tree sale • Working on prairie kits • Assisting Parks 11Page Public Works Staff Report The following is the List of Parks and projects/ maintenance activities ongoing or planned this year. Background The Parks and Recreation and Forestry Commission requested Staff to investigate the possibility for the City of Mounds View to have community gardens. Staff reached out to several neighboring Cities and received the information on the attached spread sheet. Included on the spread sheet is each City's Parks Operating budget and the number of employees in the parks departments. Staff also reached out to Edgewood Middle school about using an old garden area, that could possibly serve as a location for a trial basis for the City to gauge the interest level on Community Gardens. Staff has several questions for the Commission before moving forward: City of Mounds View Garden Club (A partnership between#621 Mounds View Schools and The City of Mounds View 2025) - Does the garden club need to have an official presentative i.e. president and vice president? - What would be the role of this position? - Does the garden lot users pay a deposit? - The deposits would be paid the City of Mounds View? - What should the deposit be? - Damage Deposit—would be returned after the garden bed is cleaned up in the fall? - What rules to include on the Community Garden sign: • Open 7am to Sunset? • Parking lot open from 7am to ? • Respect the plots of others • No alcohol, drugs or nicotine use • No glass allowed • Do not leave personal items on the school premise • All weeds trash and litter must be taken after each use Item: 7A MOUNDS VIEW PUBLIC WORKS • PARKS&RECREATION • This Community Garden Area is subject to the Mounds View School #621 rules and regulations • No sales or solicitations on school grounds • Always leave this area better than you found it Labor Costs: (2) FT PW Staff at the site for 4 hours* would cost the City approximately $500.00. *Hours are based on the scenario that the garden areas were left in a bad condition at the end of the season Staff is requesting the Commission review and provide further direction. Staff is recommending that the rules be incorporated into the Park Rules signs that would be posted at all City Parks as well the rental agreements. The rules sign would include the most common or standard rules with added QR code that link to Chapter 92 of The City Ordinance. Staff is requesting that the Commission review the policies and Park Rules to provide feedback and or comments to Staff. Respectfully submitted, Don Peterson Director of Public Works/Parks and Recreation CHAPTER 92: PARKS AND RECREATION Section 92.001 Purpose 92.002 Definitions 92.003 Construction and scope 92.004 Hours and access 92.005 Permits 92.006 Special activities 92.007 General conduct 92.008 Traffic rules 92.009 Additional rules and regulations 92.999 Penalty §92.001 PURPOSE. This chapter is enacted to govern the conduct of members of the public during their use and enjoyment of the city's open space system so as to further the safety,health, enjoyment and welfare of all persons in the use of those facilities and to protect public property and resources for posterity. (Prior Code,§909.01) (Ord.557,passed 03-27-1995) §92.002 DEFINITIONS. For the purpose of this chapter,the following definitions shall apply unless the context clearly indicates or requires a different meaning. DEPARTMENT.The City of Mounds View Parks and Recreation Department. DIRECTOR.The Director of Parks and Recreation.The person authorized by the City Council to direct the Department of Parks and Recreation. LAW ENFORCEMENT OFFICER.Any person duly deputized or commissioned by the city, Board of County Commissioners or the state for the purpose of enforcing the laws, ordinances and regulations of their respective jurisdictions. MOTOR VEHICLE. (1) Every vehicle which is self-propelled and does not derive its power from overhead wires. (2) MOTOR VEHICLES include,but shall not be limited to,automobiles,trucks, motor bikes, mini bikes,all-terrain vehicles and snowmobiles,with the exception of battery powered wheelchairs. OPEN SPACE SITE.Any park,reserve,special use area, golf course,linear park or any other area owned, improved maintained,operated or otherwise controlled by the city for recreation and natural resource preservation purposes. OPEN SPACE WATERS.Any public shoreline owned by or under the authority of the city. PARK.Any area designed or used for active or passive recreation and which is owned,operated or controlled by the city or controlled by another government unit. PARK SYSTEM.The city's park system which includes the sites and facilities owned, maintained and operated by or otherwise under the authority of the city. (Prior Code,§909.02)(Ord. 557, passed 03-27-1995) §92.003 CONSTRUCTION AND SCOPE. In the interpretation of this chapter,all provisions contained are to be construed as follows. (A) Any requirement or prohibition by any provision extends to and includes the causing, procuring,aiding or abetting directly or indirectly,of such acts;and the permitting or allowing any minor by the responsible parent,guardian or custodian to commit any such act. (B) No provision shall make unlawful any act necessarily performed by any law enforcement officer or Department employee in the line of duty or work as such, or by any person,that person's agents or employees, in the proper and necessary execution of the terms of any contract or agreement with the city. (C) Any act otherwise prohibited by statute or local ordinances,is lawful if performed under, by virtue of and strictly within the provisions of a Department permit to do so,and to the extent authorized thereby. (Prior Code,§909.03)(Ord.557,passed 03-27-1995) §92.004 HOURS AND ACCESS. (A) The recreation and education opportunities of the system are available to all members of the public regardless of race,sex,age,creed,national origin or place of residency. (B) (1) The park system shall be open to the public between the hours of 6:00 a.m.and 10:00 p.m.,prevailing time in the city. No person shall remain,stop,use or be present within the confines of any open space site between the hours of 10:00 p.m.and 6:00 a.m. Exceptions may be made at the discretion of the Director in the case of emergency or when use permits have been authorized or for other reasons the Director may determine necessary or desirable. (2) Open space sites are subject to curfew hours in force in the city. (C) Any section or part of any open space site may be declared closed to the public by the Director at any time or for any interval of time,either temporarily or at regular and stated intervals,and either entirely or for certain uses as the Director shall find necessary. (Prior Code,§909.04)(Ord.557,passed 03-27-1995) §92.005 PERMITS. (A) Permits are required for the exclusive use of all or portions of specific areas, buildings and other system facilities;and for conducting special events such as those of a cultural,educational, political,religious or recreational nature;and for specific exemption from any provision of this chapter.Any person,group or association of persons required to obtain a permit must file an application for a permit with the Director. (B) The grantee of a permit is bound by this chapter and any department regulations in force as though the same were inserted in the permit. (C) The grantee of a permit is liable for any loss,damage or injury sustained by the system or by any person whatever, by reason of the negligence of the person or persons to whom the permits are issued. (D) The grantee of a permit may not transfer or relinquish the permit to another person or group of persons without the written permission of the Director. (E) The Director may revoke a permit upon evidence of a violation of this chapter. (F) No person may disturb, harass or interfere with the grantee of a valid permit, nor with any of the grantee's property or equipment. (G) Permits may be issued to adults only and an adult must be on the premises at all times during the duration of the permit. (H) No person or group may place or keep any goods,wares, merchandise or other articles on park property or facilities without the written permission of the Director. (I) No person may use park facilities such as picnic areas, ballfields,tennis courts or volleyball courts which have been reserved by another party,or to conduct picnic activity at reservation picnic sites in violation of a permit. (Prior Code,§909.05)(Ord.557,passed 03-27-1995)Penalty,see§92.999 §92.006 SPECIAL ACTIVITIES. (A) Swimming. (1) No person may bathe,wade or swim in any open space waters or at any city beach,except in such areas specifically designated for such use,and only at such times when a"beach open"sign is posted and an authorized lifeguard is on duty. (2) No person may bathe,wade or swim at any beach, except when dressed in bathing attire which is conducive to water safety. (3) No person may use at any beach any inner tube,water wings,raft, U.S.Coast Guard-approved life jackets when property attached or other inflatable or buoyant object,except if parents or a guardian adult is in the water with the child and is within arm's reach. (4) No person may possess, carry onto or scatter on any beach, any glass container, broken glass, metal can or other debris which could be a safety hazard. (5) No person having custody of any animal may permit the animal to enter any beach area during the swimming season so established by the Director. (6) No person may launch,dock or operate any watercraft in any designated swimming area. (7) No person may violate the rules of Lakeside Park. (B) Bicycling. (1) No person may ride or operate a bicycle in any open space site,except on designated bikeways or surfaces normally provided for vehicular traffic. (2) Persons riding a bicycle must observe and obey all traffic and directional signs. (3) No person may ride or operate a bicycle in any open space site,except in a prudent and careful manner,and unless the person shall be capable of effective control and operation of the vehicle.Pedestrians and motorized vehicles shall have the right-of-way where a bikeway intersects pedestrian trails or roadways. (4) No person may ride or operate a bicycle in any open space site faster than is reasonable and safe,with regard to the safety of the operator and other persons in the immediate area. (5) No person may ride or operate a bicycle in any open space site 30 minutes after sunset and 30 minutes before sunrise without appropriate front and rear lighting. (6) All bicycle riders must remain in single file and proceed in the extreme right-hand lane of a drive or bikeway at all times,except when passing another vehicle or bicyclist parked or traveling in the same direction. (7) Bicycles must be parked in locations,wherever provided,set aside specifically for their storage. (C) Boating. (1) No person may on any lake,pond or stream within the city use any mechanically propelled watercraft unless being used for emergency rescue or the maintenance of the lake, pond or stream. (2) No person may operate any watercraft on any open space waters contrary to or in violation of state law. (3) No person may operate, row or paddle a boat,canoe or other watercraft on any open space waters unless able to handle the same with safety to themselves,other occupants or in a manner as not to annoy or endanger the occupants of other boats. (4) No person may leave any watercraft unattended,except in areas specifically designated for mooring,anchoring or beaching. (5) No person may operate watercraft within an area which has been designated as a swimming area. (6) No person may drop or throw from any watercraft garbage,litter or other debris. (7) All watercraft launched from a system facility or operating on open space waters must have a Coast Guard- approved life preserver for each occupant. (8) No person may operate any watercraft in a careless or reckless manner. (D) Motorized recreation vehicle. (1) No person shall operate a motorized recreation vehicle within any open space site,except in such areas specifically designated for such use. (2) No person may operate a non-licensed vehicle on any parkway or other roadway within an open space site. (3) No person may place any vehicle for sale or exchange on park property. (4) No person may wash,grease, repair,change oil or maintain in any way a vehicle,except as necessary in an emergency. (E) Camping.No person may establish or maintain any camp or other temporary lodging or sleeping place in any open space site. (Prior Code,§909.06)(Ord.557,passed 03-27-1995;Ord.955, passed 03-11-2019)Penalty,see§92.999 §92.007 GENERAL CONDUCT. (A) Defacement, destruction of property and resources. (1) No person may tamper with,climb on,injure,deface,destroy,disturb,damage, move or remove any part of any park building,portable bathrooms,structure,sign,fight pole,drinking fountain, hydrant, picnic table,grill,trash receptacle, equipment,statue or other property found therein.This does not prohibit appropriate use of play equipment. (2) No person may deface,disturb or remove in any manner any soil, artifact,fossil, rock or other mineral resource. (3) No person may excavate any ditch,trench,tunnel or hole in any open space site. (4) No person may erect or maintain a shelter, hockey goals or other structures on the ice unless the structure is portable and removed each day. (B) Preservation of vegetation. (1) No person may injure,cut,destroy, mutilate, uproot,disturb or remove any flower,tree,shrub or any plant whether wild or cultivated,or any part thereof. (2) No person may plant or cause to be planted any wild,cultivated or exotic tree,shrub or plant, except in specifically designated areas with the written permission of the Director. (3) No person may fell or climb any tree; pick any flowers,fruit or vegetable(not self-grown);trample any flowers,tree seedlings,flowerbeds,vegetable gardens or new turf seedlings. (4) No person may hitch any animal or fasten,anchor or otherwise attach any wire, rope,cable,signs,posters or other articles to any tree,shrub or plant. (5) No person may make any unauthorized use of any open space site which is detrimental to the turf and soil conditions. (6) No person may remove any device,apparatus or material installed for the protection,support or preservation of any tree,shrub or plant. (7) No person may construct or place any type of structure including, but not limited to,deer tree stands,playhouses, treehouses,temporary storage buildings, motorcycle or bicycle launches,temporary shelters,tents,tarps,canopies or other such devices upon park land without permission by the Director. (C) Animals. (1) No person owning, being in custody, or having control of an animal,whether wild, pet or domestic, may cause or allow the animal to roam or be at large in any open space site. (2) No person being in custody of any animal may permit said animal to enter any beach area,nature interpretive area, wildlife refuge,golf course or park building,whether leashed or otherwise, except trained animals assisting disabled persons. (3) No person in custody of any pet or animal may allow the animal to disturb,harass or interfere with other open space users or their property. (4) No person may feed wild animals or birds or deposit a food source for wild animals or birds in the park system. (5) Any unattended domestic animal or pet found roaming or at large within any open space site will be impounded. (6) All state and local ordinances relating to the licensing and muzzling of animals and pets apply to any open space site. (7) No person may release or possess any exotic or wild animal in any open space site without written permission of the Director. (8) It is unlawful for any person who owns, harbors or has custody of a dog,cat or other animal to permit the animal to defecate on any public property unless the person immediately removes the excrement and properly disposes of it. (D) Hunting, fishing and molesting wildlife. (1) No person may kill, hunt,trap, pursue,injure, molest or unnecessarily disturb or have in possession any species of wildlife including birds,waterfowl,fish or other animals found within the confines of any open space site;except that,fishing may be permitted in designated areas subject to laws and regulations as established by the state. (2) No person may rob,disturb or molest the nest,eggs or young of any birds,or other animals within the confines of any open space site. (E) Fires. (1) No person may start or maintain a fire in any open space site, except small recreational fires in fireplaces,fire rings 9 and grills provided for that purpose in areas specifically designed for such use. Private grills may be used in designated areas provided that all ashes and residue are disposed of in containers provided for the disposal. (2) Any person who starts or maintains a fire in an authorized area must exercise continuous supervision from the time the fire is kindled until it is extinguished. No fire may cause damage or constitute a threat to site vegetation and resources, nor may it cause discomfort to other open space users. (3) The Director may,at the Director's discretion,prohibit fires for limited periods at any location for any purpose when it is necessary for the continued protection of park property and resources. (4) Minors Mino s are prohibited from possessing any means of starting a fire in city open o space sites. P (F) Waste and litter. (1) No person may throw,cast, drop, pour,spill or discharge,or permit to escape in or upon any land, pond, river, creek,stream,ditch,storm sewer or drain flowing into or through any open space site,any substance, matter or thing whether solid,liquid or gas,which may result in the pollution of the waters, interfere with the conservation management of the water resource or endanger the health of the public. (2) No person may deposit in public trash receptacles any household refuse, including all organic material resulting from the manufacture, preparation or serving of food or food products;spoiled,decayed or waste products from any source; bottles,cans or glassware;paper or paper products;crockery,ashes,rags, discarded clothing,tree or lawn clippings, leaves,weeds,waste resulting from building construction,remodeling or demolition;and other waste products,unless the refuse is the result of activities in the park in which the public receptacles are located. (3) No person may drop,throw or otherwise leave unattended in any open space site lighted matches,burning cigars, cigarettes,tobacco,paper or other combustible material. (G) Firearms, weapons, fireworks. (1) No person may possess,fire,discharge,or set off any firearm,missile,fireworks or explosives in any open space site.Permits for fireworks will only be issued upon proof of adequate insurance and compliance with state statutes. (2) No person,except a law enforcement officer,shall possess or carry a firearm of any description in any open space site. No person may possess or carry in any open space site any air gun, bow and arrow, knife with a blade greater than three inches,slingshot,dart or projectile thrower,or any other dangerous or illegal weapon. (3) Any unauthorized or illegal weapon within an open space site is subject to seizure by a law enforcement officer. (H) Disturbing the peace;conduct. (1) No person,or group of persons,may disturb the peace and good order in any open space site by either word or act. (2) No person,or group of persons,may engage in fighting, quarreling,wrangling,riotous clamor or tumult. (3) No person,or group of persons,may disturb, harass or interfere with any open space user or the user's property. (4) No person may solicit or ask anyone to commit, perform or engage in any lewd, lascivious,obscene or indecent act or behavior. (I) Audio devices. No person may operate or play any musical instrument, radio,television,record or tape players, loudspeaker,public address system or sound amplifying equipment of any kind in any open space site in such as manner that the sound emanating therefrom is audible beyond the immediate vicinity of the set or instrument,and subsequently interferes with the use of the open space site by other users or disturbs the residents of adjacent property. (J) Loitering. No person may lurk or loiter in or around any toilet facility or other system structure,except to use the facility for the purpose of which it is intended. (K) Alcoholic and intoxicating beverages. (1) No person may possess, have within their immediate control,display,consume or use intoxicating liquor or 3.2% malt liquor in or upon any public park open space,except as permitted by temporary license,pursuant to§110.047(D)of this code of ordinances. (2) This does not include the sale or consumption of alcoholic and intoxicating beverages at"The Bridges"golf course. (L) Parades, entertainment,public meetings.No procession, parades,pageants,ceremonies,exhibitions,celebration, training exercises,speeches,entertainment or other public gatherings may be allowed to take place in any open space site or on any parkway, except with written permission of the City Council or Director. (M) Games. No person may engage in any potentially dangerous games involving thrown or propelled objects,such as horseshoes,golf balls,darts or similar objects,except in appropriate areas specifically designated for such usage. (N) Use of tennis and basketball courts. (1) No person may use a bicycle, roller skates, roller blades, roller skis,skateboard or scooter,or allow a dog to be on a color-coated tennis or basketball court surface,excluding hockey rink pavement,which is specially designed for roller blade use. (2) No person may use a tennis court or basketball court while not wearing tennis shoes. (3) No person may play continuously upon a tennis court for more than one hour while others are waiting to use the court. (4) No person may play hockey on a tennis court. (0) Skateboards. (1) A skateboard is a footboard or similar object mounted on wheels and designed or intended to propel a rider by human power or force of gravity, but without mechanical assistance.The following is not a skateboard:a wheelchair operated by a disabled person. (2) It is unlawful to operate a skateboard upon a state or county road within the city. (3) It is unlawful to operate a skateboard carelessly or heedlessly in disregard of the rights of others,or in a manner that endangers or is likely to endanger persons, property or the operator of the skateboard. (4) It is unlawful to operate a skateboard in a place where the surface or traffic conditions render the place unsafe for skateboarding. (5) It is unlawful to operate a skateboard on private property without the prior express permission of the owner of the property. (6) An operator of a skateboard must yield the right-of-way to any other type of vehicle or a pedestrian while the operator is entering or traveling upon a street,alley,sidewalk or bicycle path. (7) The operation and use of skateboards is restricted to paved trails, paved hockey rinks and paved parking lots which are unoccupied,located in the parks. (P) Advertising. (1) No person may distribute or disseminate any leaflets,pamphlets,circulars, handbills,advertisements or other written or printed material except with the written permission of the Director. (2) No person may post,display,affix or attach any sign,poster,placard, notice, banner or advertisement to any tree, building,shelter,fence, pole or other structure,except with the written permission of the Director. (3) No person may use loudspeakers,sound amplifying equipment, musical equipment or cause any noise to be made for advertising purposes or for the purpose of attracting attention to any exhibition, performance,event or other purpose, except with the written permission of the Director. (Q) Unlawful sales. (1) No person may sell,offer for sale,hawk, peddle or lease any object,merchandise or service or carry on any manner of business or commercial enterprise,except those concessions authorized or operated by the city. (2) No person may park or occupy a vehicle or stand to sell any farm produce,flowers, merchandise or any other product or for conducting any business or selling of services unless authorized by the city. (R) Soliciting alms.No person shall beg or solicit alms,donations or contributions without a valid permit. (S) Photography. No person may take any photographs,or motion or sound pictures for commercial purposes or for use in commercial advertising, except with the written permission of the Director. (T) Utilities. (1) The location,construction or erection of any sewer,gas pipe,water pipe,hydrant,lamp post,telephone and electric power post,conduit,pump, lift station and other utility feature proposed in any open space site is subject to the approval of the city. (2) No person,firm or corporation may construct or relocate any of these utility installations or fixtures without the written permission of the Director. (3) Every person,firm or corporation who receives a contract or permit to do work must,after the work has commenced and until the same has been completed,isolate the construction area by security fencing,warning lights and signs or other appropriate measures that will protect the public from exposure to danger and prevent unnecessary accidents. (U) Lost and found articles.Lost or mislaid articles or money or personal property which are found in any open space site shall be delivered or turned over to the city's Parks and Recreation Department. If the lawful owner of any article or money deposited with the Department does not claim the same within a period of 60 days, it may be returned to the finder upon request. (V) Law enforcement officers and employees. (1) No person may willfully resist, refuse or fail to comply with any order, direction or request lawfully given by any law enforcement officer or Department employee acting under the authority of the city and in accordance with this chapter. (2) No person may interfere with,or in any manner hinder any Department employee or law enforcement officer during the performance of their assigned duties; nor any employee of a contractor engaged in construction,repairing or caring for any open space site or part thereof,or while in the discharge of duties conferred by this chapter. (W) Posted regulations, directional signs and graphics.No person may disregard or fail to comply with any posted regulations, directional signs and graphics,barriers or other control devices located within any open space site or on any parkway. (Prior Code,§909.07)(Ord.557, passed 03-27-1995;Ord.618, passed 04-27-1998;Ord.955, passed 03-11-2019) Penalty,see§ 92.999 §92.008 TRAFFIC RULES. (A) No person may drive or operate a motor vehicle within any open space site,except upon roadways, parking areas, parkways or other areas designated for such use. Disabled vehicles may be moved off a paved area to allow for the continued flow of traffic, but the vehicle must be repaired or removed within two hours,unless other arrangements are made with the Director. (B) No person may operate a motor vehicle within any open space site or on any parkway,in violation of posted regulations and directional signs;M.S. Ch. 169,as it may be amended from time to time;county or municipal traffic ordinances, or orders or direction of law enforcement officers or Department employees. (C) No person may drive or operate a vehicle on or along any roads,drives or parking lots which have been restricted, closed or posted with appropriate signs or barricades.The Director will have the authority to order roads,drives or parking lots within any open space site or any roadway closed during the process of construction, reconstruction or repair or when, in the Director's opinion,weather conditions render travel unsafe or unduly destructive. (D) No person may operate a motor vehicle in a careless or reckless manner or without due regard for the safety and rights of pedestrians and drivers and occupants of all other vehicles,so as to endanger the life,limb or property of any other person while in lawful use of an open space site. (E) No person may park,stop or leave a vehicle in any open space,site or on any parkway or parking lot between the hours of 10:00 p.m.to 6:00 a.m., unless a permit is obtained from the Director. (F) No person may operate a vehicle in any open space site or on any parkway at a speed in excess of 15 mph or in excess of posted speed limits. (G) No persons may operate a vehicle in any open space site which emits excessive or irritating noise, noxious fumes, dense smoke or other pollutants. (H) No person may wash,grease or change oil on any vehicle in any open space site.All disabled vehicles shall quickly be made operational or removed from the open space site. (I) No person shall park a vehicle adjacent to any curb painted yellow in any open space site. (J) Vehicles illegally parked,disabled or abandoned may be towed away and impounded at the owner's expense.The vehicle may be sold if unclaimed after 60 days to pay towing and storage charges. (K) No person may drink,consume or have in his or her possession an open bottle or container of an alcoholic or intoxicating beverage in any motor vehicle when the vehicle is in an open space site or on a parkway. (L) Vehicles must yield the right-of-way at all times to pedestrians. (M) No person may participate in a drag race or test of unreasonable acceleration in any open space site or on any parkway. (Prior Code,§909.08)(Ord. 557, passed 03-27-1995)Penalty,see§92.999 §92.009 ADDITIONAL RULES AND REGULATIONS. The Director may adopt additional rules and regulations not contrary to the provisions of this code governing the use and enjoyment of parks,trails,playgrounds,lakes,ponds,streams and other publicly-owned properties which shall be prominently posted or publicly announced in the places where they are intended to apply.Any person who violates a rule or regulation so posted may be excluded from the use of the park system and may in addition be prosecuted as for a misdemeanor. (Prior Code,§909.10)(Ord.557, passed 03-27-1995) §92.999 PENALTY. (A) (1) Violating any of the provisions of this chapter shall be a misdemeanor. (2) Any person violating any of this chapter may be expelled,ejected or ousted at such time from an open space site at the discretion of a law enforcement officer. (B) A person who violates§92.007(0)of this chapter is guilty of a petty misdemeanor. The shed would be used to store pitching mounds, rakes, base line chalker's and other equipment used be IBL. The Commission directed Staff to talk to IBL about a possible rental fee and agreement. IBL has indicated they would be willing to pay $10.00 a month or $100.00 a year for rental. Staff is requesting that the Commission provide Staff with further direction.
