3 A. 211 Ardan Park Storm Water Pond Meeting.

5 Public Works/Parks and Recreation Director Peterson explained notices were sent to 31 properties
6 regarding the Ardan Park Storm Water Ponding project. He noted this was the second meeting the
7 City has hosted regarding this project. It was noted the first storm water pond meeting was held in
8 September of 2023. He stated two individuals from Stantec were in attendance to discuss this
9 project in further detail.

11 Dan Edgerton, Stantec, discussed the Ardan Park Storm Water Pond restoration project with the
12 Council. He reviewed the feedback he received from the public from the first storm water pond
13 meeting. He commented further on the data collection and field survey that was conducted on the
14 storm water pond. He described the amount of heavy pond sediment that has built up at the inlet
15 over the years. He proposed going in and removing the sediment to the ponds natural condition,
16 noting permitting was in the process.

18 Larissa Motti, Stantec, discussed the upland vegetation within the storm water ponding area and
19 discussed the park restoration work that could be completed. She stated the goal would be to
20 expand the quality of the water control buffer in and surrounding the pond. She proposed removing
21 some of the invasive trees and shrubs, in addition to removing dead and diseased trees. She
22 described the proposed vegetation that would be replanted in the park noting the goal would be to
23 enhance and improve the wildlife habitat within the park.

25 Public Works/Parks and Recreation Director Peterson asked for feedback, comments or questions
26 from the Council or residents that were in attendance at this meeting.

28 Council Member Clark asked if the grants being applied for would assist with the cost of a trail.
29 Public Works/Parks and Recreation Director Peterson stated the grants would not cover the cost
30 of a trail.

32 Mayor Lindstrom inquired if the grant funding could assist with buckthorn removal. Public
33 Works/Parks and Recreation Director Peterson explained the City would have to provide matching
34 funds and manpower if the City were to receive a grant for the removal of invasive species.

36 Mayor Lindstrom requested further information regarding why the City was looking to dredge and
37 restore this storm water pond. Public Works/Parks and Recreation Director Peterson reported the
38 dredging was required due to the sediment within the pond which was impacting upstream
39 waterways. He explained the pond would be dredged to its original capacity. He commented on
40 how the removal of the invasive species would assist with restoring the wildlife habitats
41 surrounding the pond. He indicated the oaks, walnuts and other high quality tree species would be
42 preserved.

44 Mayor Lindstrom discussed how poor the water quality was within the storm water pond and stated
45 the pond would greatly benefit from being dredged.

1 Council Member Gunn asked where the sediment from the pond would go. Public Works/Parks
2 and Recreation Director Peterson anticipated the material would go to a landfill or lined landfill.

4 Council Member Clark stated when heavy rains occur her streets fill with water. She asked if the
5 dredging would assist with removing the water from her street.Public Works/Parks and Recreation
6 Director Peterson reported the dredging should assist with this concern.

8 Sharon Kirscher, 8406 Red Oak Drive, questioned what the timeline was for the grants.
9
10 Public Works/Parks and Recreation Director Peterson stated he would be coming back to the
1 1 Council on September 23 to send this project out for bid. He reported the project would be bid on
12 September 25 and the project would be approved in October. He explained this would be a winter
13 project as the dredging and tree removal had to occur in the winter. He indicated the City should
14 hear in mid-September regarding the BWSR grant.
15
16 Dr. Jean Strait, 7728 Knollwood Drive, explained she spoke with a few friends today and she
17 understood there were additional grants available to the City for outdoor recreational projects. She
18 indicated she could forward an email to staff regarding these grant opportunities.
19
20 Joel Kopp, 8388 Long Lake Road, asked if the proposal included the removal of the aggregate
21 stockpiles at the stub end of Ardan.
22
23 Public Works/Parks and Recreation Director Peterson indicated this work was included in the
24 proposal.
25
26 Council Member Clark stated it would be nice to know if the City could pursue wetland banking
27 through this improvement project, as this may impact the funding for the trail.
28
29 Vince Meyer, 8380 Spring Lake Road, questioned why this park hasn't been maintained prior to
30 this.

32 Mayor Lindstrom explained the main purpose of this project was to restore the pond. He indicated
33 the park was walkable at this time.
34
35 Public Works/Parks and Recreation Director Peterson discussed how some cities put their pond
36 dredging projects on hold after Eden Prairie had issues with the MPCA on how to manage the
37 sediment that was removed from their storm water ponds.

39 Council Member Meehlhause asked how many other cities have a stormwater management plan
40 in place like the City of Mounds View. Public Works/Parks and Recreation Director Peterson
41 commented in the group he was in, he understood Mounds View was very far ahead of other
42 communities when it came to stormwater pond management. City Administrator Zikmund
43 indicated when he began with the City seven years ago, he was told by Public Works/Parks and
44 Recreation Director Peterson that stormwater ponds would become an issue. He discussed how the
45 City has been setting aside funds in anticipation of this project. He reported the City had a capital

1 improvement plan in place to address both Ardan and Silver View Ponds. He commented further
2 on the data that had to be collected in order for the City to apply for grants.

4 Brian Amundsen, 3048 Woodale Drive, recognized this project was about Ardan Park, but asked
5 when neighborhood stormwater features would be addressed. He stated he recently saw public
6 works working on the pond in his neighborhood. He suggested the City pursue additional grants
7 in order to address these storm water ponds.
8
9 Public Works/Parks and Recreation Director Peterson explained the inlets were recently cleared
10 by the City to ensure water can get into the infiltration features. He stated he had spoken with Rice
11 Creek Watershed to see if there were other grants available for this work.
12
13 Dr. Strait asked what the total cost of this project would be. She questioned how much grant
14 funding the City had applied for.
15
16 City Administrator Zikmund stated this would remain unknown until the bids come back to the
17 City. Public Works/Parks and Recreation Director Peterson explained the City had applied for a
18 grant with BWSR in the amount of$230,000.
19
20 Ms. Kirscher inquired how much the City would spend to dispose of the sediments.
21
22 Council Member Gunn explained the City would not have this information until the dredging was
23 complete.
24
25 Public Works/Parks and Recreation Director Peterson reported he has an engineer's estimate for
26 this work, but noted the final costs would not be known until the project was bid.

28 Jim Wilson, 7025 Pleasant View Drive, stated the engineer could come up with an estimate and
29 contractors could put in a bid, but noted the cost for the disposal of this material would not be
30 known until the material is tested after the dredging is completed.

32 7. PUBLIC COMMENT

34 Mayor Lindstrom encouraged the public to speak with kindness and respect when addressing the
35 City Council during Public Comment.
36
37 Vince Meyer, 8380 Spring Lake Road, explained there was a sign posted at 851h and Spring Lake
38 Road shutting his road down. He indicated the school buses cannot get around this sign. He
39 requested this sign be removed by the City.
40
41 Cindy Clark, 8180 Spring Lake Road, stated signs were posted at County Road J and Highway 10
42 that says Spring Lake Road will be closed to through traffic. She questioned if additional work
43 would be done on the roadway.

45 City Administrator Zikmund commented this was not a City project,but rather was an Xcel Energy
46 utility project.

2 Brian Amundsen, 3048 Woodale Drive, explained he received a notice that Silver Lake Road
3 would be closed by Ramsey County. He understood this was being done to allow for work on the
4 stormwater treatment at Woodcrest Drive. He expressed concern with the proposed detour and
5 asked if Ramsey County had consulted with the City on this matter. Secondly,he noted there have
6 been a number of individual running the stop sign at Knollwood and H2. He asked that the police
7 department patrol this area in the afternoons. Lastly, he thanked the Council for considering the
8 recommendations from the Charter Commission. He provided further information on the two
9 recommendations that came forward from the Charter Commission.

11 Public Works/Parks and Recreation Director Peterson discussed the storm sewer work the County
12 would be completing on Silver Lake Road noting work should begin mid-September and would
13 be done by the early October.
14
15 Dr. Jean Strait, 7728 Knollwood Drive, discussed where CR and Noelle live on Spring Lake Road.
16 She explained the neighbors to the left were both blind and she was concerned with how traffic
17 was zooming past this property. She was afraid someone was going to hit these residents. She
18 asked that a sign be posted along this roadway requesting traffic to use caution. She indicated she
19 was also concerned about the proposed levy and how residents of Mounds View would be
20 impacted.

22 Luke Edmond, 8407 Spring Lake Road, explained he has not been able to attend the past few
23 meetings. He thanked everyone who was involved with Festival in the Park. He reported his wife
24 was working to collect signatures for stop signs along Spring Lake Road. He questioned if this
25 work should continue. He asked if the Mounds View Police Department had a plan in place to
26 ensure all residents were comfortable voting during the upcoming election.

28 City Administrator Zikmund reported the City did not need a petition for the stop signs because
29 the City Council had provided staff with direction to post stop signs on Spring Lake Road. He
30 indicated the Mounds View Police Department was trained and prepared.

32 Mayor Lindstrom commented this topic was discussed at the Regional Council of Mayors meeting
33 where the Secretary of State was present. He reported it was not legal to have a licensed police
34 officer to be in a polling location. He stated he had high confidence that the election judges would
35 be able to manage the election this fall.

37 Mr.Edmond encouraged residents to ensure they are driving safely on City streets because children
38 and buses were back on the roadways.

40 Rebecca Scholl, 2467 Hillview Road, thanked the Council for considering the succession
41 recommendation from the Charter Commission. She stated she appreciated the fact a change was
42 going to be made to ensure the Council could find a replacement and would not have to have a
43 long-term vacancy until an election could be held. She encouraged the residents in Mounds View
44 that were on a fixed income or with an income under$96,000 but over the age of 65 years to look
45 into the State property tax deferral program.

2 A. Resolution 9982, Approve a Service Agreement with Trane Building Services
3 for the facilities of City Hall and Community Center.

5 Public Works/Parks and Recreation Director Peterson requested the Council approve a Service
6 Agreement with Trane Building Services for the facilities of City Hall and Community Center. He
7 explained the City owns 13 facilities with HVAC equipment that requires complex contractor
8 assistance to ensure reliable operations. He noted public works conducts some routine
9 maintenance, but public works staff was not trained to complete the annual inspections on the
10 HVAC units. He commented further on the five year service agreement with Trane and
11 recommended approval.

13 Mayor Lindstrom reported this was not only a preventative maintenance agreement,but it was also
14 a data subscription agreement because Trane monitors the City's HVAC units.

16 MOTION/SECOND: Meehlhause/Clark. To Waive the Reading and Adopt Resolution 9982,
17 Approve a Service Agreement with Trane Building Services for the facilities of City Hall and
18 Community Center.

22 B. Resolution 9980 Approving the Preliminary Property Tax Levy for Fiscal
23 Year 2025 and Setting the Public Hearing Date.

25 Finance Director Bauman requested the Council approve the preliminary property tax levy for
26 fiscal year 2025 and setting the public hearing date. She explained per State Statute the City
27 Council had to set a preliminary levy by September 30. She discussed how 100% of the LGA
28 funds would be placed in the budget and noted the Medtronic money helped the City get to 2033
29 when the TIF expires. She further reviewed the preliminary property tax levy in detail with the
30 Council noting the final levy would be adopted in December.

32 Council Member Clark stated she wanted to stay under 6.5% for the levy increase but she
33 understood the Council was not involved in the day to day workings of City staff. She asked if
34 another $70,000 could be cut from the budget to allow the levy increase to be reduced to 6.5%.
35 She stated 9% was a big increase that would impact Mounds View residents. Finance Director
36 Bauman explained she could provide the Council with information on where increases were
37 occurring and noted the Council could then make decisions on how to proceed with the budget.
38 City Administrator Zikmund reported this was the Council's budget and reiterated that staff takes
39 direction from the Council. He stated if direction was provided to make cuts, this could be done.

41 Mayor Lindstrom anticipated the majority of the increases in the 2025 budget were coming from
42 pay increases due to the new pay plan.

44 Council Member Gunn explained at this time,the Council needs to approve or deny the preliminary
45 tax levy. She indicated the Council could then further discuss the levy between now and December.

1 Council Member Clark supported the Council further discussing the levy in order to make
2 additional cuts.

4 Council Member Gunn stated she understood further discussions could be held,but noted the City
5 ran with a lean staff which made cuts difficult.

7 Mayor Lindstrom reported the Council could approve a 6.5% levy increase by placing $70,000 in
8 Medtronic money into the budget, but this would mean the City was deficit spending, or another
9 source would have to be found to cover the deficit.

t t Council Member Meehlhause commented there was an opportunity to cut into the built in deficit
12 that has been in place since 2008, noting this would free up funding to meet the needs of the City.
13 He stated the City was working on a parks master plan and there were streets that still needed to
14 be completed. He believed he heard at the worksession meeting that the majority was willing to
15 approve a levy that would lead to a balanced budget with no deficit spending plan and that this
16 could be adjusted between now and December if there was a difference of opinion.

18 Mayor Lindstrom commented the 9.13%proposed tax levy increase was inclusive of debt service,
19 the street levy and the referendum levies. He discussed how the City could drop the street levy,
20 but noted this would lead to assessments for property owners and he did not anticipate any
21 homeowner wanted to write a check for $8,000 when their street was redone at some point in the
22 future.

24 Dr. Jean Strait, 7728 Knollwood Drive, stated it was not fair to threaten assessments when
25 considering a tax levy. She questioned where the City got $400,000 to cover the expenses for the
26 community center exploration and garbage collection work. She indicated the City had so many
27 residents that were living on a fixed income and she believed taxes were too high. She stated
28 Mounds View was not Bloomington or St.Paul. She explained she wanted Mounds View to remain
29 a great community,but she feared the City Council was bleeding its residents dry by being fiscally
30 irresponsible by spending money on the wrong things. She urged the City to get out of deficit
31 spending and to begin making some tough decisions when it comes to the budget. She stated if the
32 Council were to move forward with a 9.13% tax levy, she would be knocking on doors in the
33 community to do everything she could to get residents to speak against this tax levy. She indicated
34 she wanted to be supportive of the Council, but the proposed tax levy was ridiculous.

36 Council Member Meehlhause discussed how the planned deficit spending was put in place to assist
37 the City Council with managing its budget since 2008.

39 Brian Amundsen, 3048 Woodale Drive,reminded the Council that the Charter has limits.He noted
40 the current limit is 9%, if four Councilmembers agree. He indicated if only three supported a 9%
41 increase, then the levy increase would be reduced to 6.5%. He noted the Council could also get
42 out of deficit spending by asking the voters to support a levy increase. He provided historical
43 information on the Medtronic sale noting the amount set aside from Medtronic was to allow the
44 City to continue to provide services that were going to be burdens on the City because of the
45 Medtronic build, like well maintenance and waste management. He noted the funding was not set
46 aside for special expenses. He indicated the Council has chosen to do deficit spending. He reported

1 this was the Council's budget and it should not be placed on staff to decide how much should be
2 spent. He pointed out the EDA has no taxing authority and then reviewed Statute 469.107, noting
3 the EDA can request a levy and stated this amount should be included in the percentage limit
4 within the Charter. He indicated there was no special street levy that was approved by the voters
5 for street improvements. He explained the proposed levy at 9.13% exceeded the Charter, which
6 meant the levy would have to be placed on the ballot for a referendum vote.

s Council Member Meehlhause indicated the fire debt and GO debt would have to be reduced from
9 this percentage.

t t Mr. Amundsen indicated the Council was still trying to approve a levy that did not meet Charter
12 standards. He stated last year the Council approved a levy increase of 6.5% and this year was
13 proposing an increase of 9%. He encouraged the Council to begin cutting programs especially
14 considering the fact the Council transferred $1.2 million to other funds in 2023. He suggested the
15 Council take a closer look at how to use these funds.He stated he was frustrated by both the budget
16 and tax levy. In addition,he encouraged the Council to support the Charter and the language within
17 the Charter when it comes to levy increases.

19 Valeria Amundsen, 3048 Woodale Drive, explained when the Charter language was changed to
20 allow for a higher levy limit, the Council vowed to only go to 9% in the event of an emergency.
21 She indicated there was no emergency at this time. She recommended the Council reconsider the
22 budget and tax levy in order to take into the real concerns of older taxpayers in Mounds View. She
23 wanted to see the City Council acting modestly because this was the way the residents in Mounds
24 View lived.

26 Council Member Gunn noted if the fire debt and GO debt were removed from the 9.13% the tax
27 levy would then be reduced to 7.83%.

29 Rebecca Scholl, 2467 Hillview Road, indicated she owned two properties in Mounds View and
30 taxes were a concern for her. She explained she broke down the taxes for one of her properties and
31 noted the Mounds View portion was $1,200.72. She stated if she applied a factor of 9.14%, she
32 would have an increase from the City of$109.74. She clarified that the proposed 9% increase was
33 only on the City's portion of taxes and not on residents overall tax bill. She commented further on
34 the cost of cuts, noting this would impact the raises the Council just approved for the Police
35 Department along with the employment status change for Barb Benesch. She discussed how the
36 City had to find a way to balance capital improvements, special projects and the cost of operating
37 a City. She noted the voters have approved levies for additional officers in the community. She
38 understood$68,000 was a lot of money as was$109. She recommended the City provide the public
39 with better information on the proposed levy increase to ensure the City Council was in compliance
40 with the Charter.

42 Mayor Lindstrom stated in order to remain in compliance with the Charter, the Council would
43 have to approve a levy increase at 9% or less. Finance Director Bauman stated the Council could
44 opt to do this and she would make adjustments to the street levy or use deficit spending to balance
45 the budget.

1 Council Member Meehlhause discussed which items were excluded from the 9.13%tax levy.

3 Further discussion ensued regarding the Charter tax levy cap.
4
5 Ms. Scholl suggested the tax levy be reported to the County at 9% with the understanding the
6 residents will be looking for further information on the levy in the coming weeks.
7
8 Council Member Meehlhause questioned if action on this item should be tabled to the September
9 23 City Council meeting.

11 Council Member Gunn and Mayor Lindstrom did not support this action.
12
13 Ms. Amundsen stated she would like the City Attorney to investigate and verify the legality of the
14 EDA levy.
15
16 Mr.Amundsen commented when looking at the General Fund summary page he noticed the Street
17 Pavement Management was $265,000 in 2024 and would be $302,000 next year. He asked why
18 that much money was being set aside on a yearly basis when the streets were built to last for 40
19 years.

21 Mayor Lindstrom explained there were some streets that were eroding quicker than anticipated
22 and the City needed to maintain these roadways.

24 Jim Wilson,7025 Pleasant View Drive,reported he has worked for MNDOT for a number of years.
25 He explained the sealcoating on his roadway was blistering up because it was applied prior to the
26 oil coming out of the street. He indicated he did not understand why the City was paying a
27 contractor to sealcoat streets. He recommended the City allow the streets to erode longer and that
28 the roadways then be milled and overlayed.

1 Brian Amundsen, 3048 Woodale Drive, explained under the EDA's two pieces of information he
2 noticed the fund balance increased by $30,000 between 2023 and 2024. He indicated this would
3 go down by $10,000 or $15,000. In addition, he wanted to know more about the $350,000
4 expenditure that was placed in the EDA levy.

6 Finance Director Bauman indicated this expenditure was a placeholder per the request of Assistant
7 City Administrator Beeman, noting there were several properties the City had their eye on for
8 future redevelopment.

15 Council Member Gunn reported the Tribute Park Committee would be meeting next on Tuesday,

19 Center on Saturday, September 14 from 10:00 a.m. to 1:00 p.m.

21 Council Member Gunn indicated the SBM Fire Department would be having a live burn on
22 Sunday, September 15.

24 Council Member Meehlhause stated he attended the Mounds View Police Department versus the
25 SBM Fire Department softball game on Saturday. He was pleased to report the Mounds View
26 Police Department was victorious.

28 Council Member Meehlhause commented he would be attending a Twin Cities Gateway Board
29 meeting on Tuesday, September 17 and on Wednesday, September 18 he would be attending an
30 NYFS meeting.

35 Tuesday, September 17 at 6:30 p.m. at the Public Works building.

40 Mayor Lindstrom commented on the interview he attended this morning in relation to the change
41 of services with Allina. He reported he then attended a Regional Council of Mayors meeting in
42 Minneapolis where the upcoming election was discussed by the Secretary of State. He explained
43 he then attended the Nine Cities Mayors meeting where the group discussed cannabis zoning and
44 levies.

7 utilities and trees, and letters would be sent out in two weeks.

9 Public Works/Parks and Recreation Director Peterson stated over 300 trees have been marked by
10 the City Forester for removal. He noted these were ash and oak trees on City property.

12 City Administrator Zikmund stated candidate forums would be held at City Hall on October 9 and
13 October 10 at 7:00 p.m.

15 City Administrator Zikmund reported the Town Hall State of the City meeting would be held on
16 October 21 at the Community Center from 6:00 p.m. to 8:00 p.m.

18 City Administrator Zikmund indicated the community dinner would be held on December 11.

20 City Administrator Zikmund reported he and Councilmember Meehlhause would be in mediation
21 on Tuesday, September 17 as part of the trash lawsuit that was levied against the City.

Sergeant Sydney Dison
Introduction:
A Memorandum of Understanding was approved on September 9, 2024 for the LELS 204, which
increased the Patrol Officers top wages by $3.00 per hour. The 100% top patrol rate is now
$47.60. Our recently promoted Sergeant, Sergeant Sydney Dison, earns $47.40, which is below
the 100% top patrol rate.
Discussion:
Sergeant Dison is scheduled to receive a six-month wage increase effective October 22, 2024.
However, due to the wage difference, staff is requesting to increase Sergeant Dison's wage from
Step 2 to Step 3 retroactive to September 1, 2024. Sergeant Dison would remain on schedule to
receive her Step 4 increase on October 22, 2025, and Step 5 October 22, 2026. The HR
Committee supports the recommendation.

Logan Tan was selected to advance in the hiring process. Mr. Tan successfully passed the oral
board examination, Chief's interview, physical agility testing, police background investigation, pre-

BACKGROUND
The proposed amendment to the Mounds View City Charter shifts the timeline for adopting and
amending the City's Five-Year Plan to be later in the year. The following timeline shifts are proposed:
Five-Year Plan: Council-Approval May 20 to June 1 July 15 to August I
Five-Year Plan: Published to Public August 1 to August 15
CHARTER AMENDMENT PROCESS
There are multiple ways to amend the City Charter.The method chosen for this amendment is to amend
the City Charter by ordinance.
To amend the City Charter by ordinance, the Charter Commission proposes the amendment and the
City Council must have all members of the council vote in favor of the amendment.
The amendment becomes effective 90 days from the date of publication,unless a petition is signed by
5% of registered voters in the City is received with 60 days. If a petition is received, then the
amendment is presented to the public at an election and would become effective after voter approval.
If the Council does not unanimously approve the ordinance, then the amendment process stops.
The public hearing and first reading of this ordinance took place on September 3, 2024.

Second Reading and Consideration of Ordinance No. 1018
BACKGROUND
On September 3, 2024, the City Council held the public hearing and first reading of a proposed
amendment to the City Charter allowing the City Council to make appointments from a specified
list to fill councilmember and mayoral vacancies.
The purpose of this memo is to provide a legal review of the amendment and provide feedback. I
have provided a high-level overview of six issues that I believe could be improved,need additional
clarity, or should be revised.
I do not recommend approving the amendment as written. Since the Council cannot change the
language in the ordinance once presented by Council, I recommend voting against approval so
revisions can be made by the Charter Commission.
I have also provided potential alternative language of the amendment that reflects some of the
items below and which the Charter Commission could use to propose an amendment by ordinance.
The enclosed has not been reviewed by the Charter Commission.
1) Process Direction—City Administrator Role
The appointment process is well described in the amendment. I suggest being more specific about
the process and explicitly include that the City Administrator is to reach out to the list of potential
appointees and present the first person who is willing to serve on the Council and qualifies.

2) Remaining on Appointed Board
The amendment includes a list of eligible individuals who could be appointed to a vacancy from
certain city commissions. The language provides that when serving on the council, the individual
will retain their commission seat but shall be excused from and not participate in the commission.
There should be no conflict for Charter Commission members or Parks, Rec. and Forestry
Commission,but the city code criteria provides that Planning Commission members are appointed
"from the resident population of the city, other than persons elected to a public body." City Code,
section 33.002.
Use of the phrase "elected" could be interpreted to exclude an"appointment"to the City Council.
My recommendation is to have the City Council provide direction on whether it wants to allow a
person to serve on the Planning Commission and on the City Council and then revise the City Code
and/or request a revision to the amendment, as necessary.
3) Additional Revisions to Chapter 2
Chapter 2 of the Charter establishes the "Form of Government". The following two points are
recommendations for the Charter Commission that could be considered along with revisions to
Section 4.05:
• Section 2.04 establishes what offices members of the council may not hold while on the
council ("any municipal office or employment through the City other than that to which
elected") — I recommend clarifying that appointment to an advisory board or commission
is not considered an"incompatible office".
• Section 2.05 describes when a vacancy occurs — I recommend amending this section to
reference Section 4.05 and making appointments.
4) Mayor Duties
The amendment language provides: In the case of vacancy of the mayor term the appointed person
shall serve as a member of the council and the acting or vice mayor will continue to serve as mayor,
for emergency powers, until the successor mayor is elected and qualifies.
The Mayor is the ceremonial head of government with limited official duties. However, three
official duties include that "[a] local emergency may be declared only by the mayor of a
municipality ... or their legal successors"; every ordinance adopted and must be signed by the
Mayor; and certain agreements binding the City are signed by the Mayor.
The Acting Mayor acts as the Mayor"during the disability or absence of the Mayor or, in the case
of vacancy in the office of Mayor, until a successor has been appointed and qualifies." Having a
person in the office of the Mayor who is available and able to serve, but having an Acting Mayor
performing official duties would, at minimum,be unique and could lead to confusion and conflict.

Particularly because of the statutory language on declaring local emergencies, I recommend the
language be revised or removed.
Serving as "chair" of the City Council under rules of procedure is not an official duty and the
Council could choose to have any other member of the Council chair meetings by motion or
resolution if desired. This would not require an amendment to the Charter.
5) Appointments Near Regular Election
The current code and amendment language provide that if a vacancy is declared in the office of a
member of the council within 120/130 days, respectively, of a general city election, and the last
day to file for office has passed, then there shall be no appointment made prior to the election but
the successful candidate shall be appointed to serve the remainder of the term.
Since two members of the council are on the ballot at a general municipal election, I recommend
amending the language to provide that if the vacancy is in a council seat that is up for election,the
candidate receiving the most votes will be appointed to serve the remainder of the term.
6) Voting Threshold
Almost all Council actions require three affirmative votes pursuant to the Charter. Given that the
appointment will be taking place when the Council is already down at least one member and the
language is not intended to provide Council with discretion in making the appointment, I
recommend lowering the voting threshold to a simple majority of members of the Council voting
on the appointment to make the process simpler to accomplish.A quorum would still be necessary.
7) Repeal and Replace—Alternative Language
Enclosed is draft language that could be proposed by the Charter Commission that is in the form
of a repeal and replace the entire Chapter 4. The current amendment does a good job of presenting
the information in an amendment format, but, given the number of revisions, I recommend a full
repeal and replace of Chapter 4 to make review and approval easier. The enclosed draft of a repeal
and replace has not been reviewed by the Charter Commission and would be subject to change
based on Charter Commission direction.
8) Next Steps
If the Council desires to see any revisions,corrections,or clarifications to the proposed amendment
language, it should vote against adopting the amendment by ordinance.Amending the Charter by
ordinance requires unanimous council approval, so without five votes, the action would fail and
the amendment process would stop.The Charter Commission could then propose a new ordinance,
that could take the form of the enclosed or whatever form the Charter Commission chooses.
Council should not take any official action on the enclosed draft potential alternative, but can
provide feedback as part of a collaborative process to amend the Charter. The Charter Commission
has a regular meeting in November that the Council could consider in December-January.

Exhibit A- Potential Alternative Language
Section 4.05 Vacancy in Municipal Elected Office
Subdivision 1. Vacancy and 365 days or more remain in term. The following timelines shall
be followed when addressing a vacancy in an elected office of the City that occurs with 365 days
or more remaining in the term of the vacated office:
a. The vacancy will be filled at the next uniform election date specified in Minnesota
Statutes, section 205.10, subd. 3a, for which all legal requirements for special elections
can be met by the City.
b. If the date of the vacancy is more than 130 days from the date of the next eligible election
the City Council must follow the appointment process in this Section 4.05 to fill the
vacancy. No appointment may be made if the next eligible special election date is 130 or
fewer days from the date of the vacancy.
Subdivision 2. Vacancy and less than 365 days remain in the term. The following timelines
shall be followed when addressing a vacancy in an elected office of the City that occurs with less
than 365 days remaining in the term of the vacated office:
a. If the date of the vacancy is more than 130 days before the regular municipal election,
then the vacancy shall be filled by appointment following the appointment process in this
Section 4.05.
b. If the date of the vacancy is 130 or fewer days before the regular municipal election at
which the vacant seat is up for election, then the vacancy shall remain until the results of
the election are canvased by the City Council. The individual receiving the most votes at
the election shall be appointed to fill the remainder of the term.
Subdivision 3.Appointment
If,pursuant to subdivisions 1-2(a), the City Council may appoint an individual to fill a vacancy,
the following process must be used:
a. The Council declares a vacancy via resolution.
b. Within 30 days of the date of the vacancy, the City Administrator shall present an
individual from the list in Subdivision 3 (d)to the City Council for appointment using the
process described in this Subdivision 3.
c. The City Administrator shall contact the individuals in the order of the list provided in
Subdivision 3 (d), beginning with the Chair of the Mounds View Charter Commission,
and determine if that person is willing and qualified to serve as a member of the City
Council. If the person is not willing or is not qualified, the City Administrator will move
on to the next person. If no person on the list is willing and qualified, then the vacancy
shall remain unfilled until the appropriate election is held.

d. The following is the list of individuals that may be presented for appointment to fill a
vacancy:
i. Chair of the Mounds View Charter Commission
ii. Chair of the Mounds View Planning Commission
iii. Chair of the Mounds View Parks, Recreation, and Forestry Commission
iv. Vice Chair of the Mounds View Charter Commission
e. If an individual on the list is qualified and willing to serve, the City Administrator will
present that individual to the City Council for appointment to fill the vacancy.
f. A majority of members of the City Council voting on the appointment are necessary to
make the appointment. If there is a tie vote, the Mayor shall make the appointment of the
individual presented to the City Council for appointment.
g. A person appointed under this Section 4.05 is not required to vacate their commission seat
but will be excused from all meetings and may not participate in the commission until they
are no longer serving as a member of the City Council.
Subdivision 4. Special Election to Fill Vacancy.
a. The City Administrator shall give at least sixty days published prior notice of the date of
the special election and such notice shall comply with all notice requirements under
Minnesota Statutes, section 205.16.
b. The procedure at such election and assumption of duties of elected officers following
such election shall conform as nearly as practicable to that prescribed for other municipal
elections under this Charter.

Subdivision 1 Vacancy when 365 days or more remain in term.
a. When a vacancy in an elected office of the City occurs with 365 days or more remaining in the term of
the vacated office,there shall be a special election held to elect a successor to serve for the remainder of
the unexpired term of the vacated office. The special election shall be held at the next uniform
election date specified in Minnesota Statute 205.10, subd 3a, as it may be amended from time to
time, for which all legal requirements for special elections can be met by the City. (The
determination of vacancy is found in Chapter 2, Section 2.05 Vacancies.) (Amended 2005 o 748;

b. When a vacancy in an elected office of the City occurs with 365 days or more remaining in the
term of the vacated office and the special election date of subdivision la is not within 130 days after
the date of Council's vacancy declaration. the Council, after passage of the resolutions of vacancy
and special election date, shall within 30 days and by majority vote appoint a successor using the

method in subdivision 1 c. In case of a tie vote of the Council, the mayor shall make said appointment
by the same method as in subdivision lc. The appointed successor may continue to serve until a
successor is elected and qualifies. If none of these persons are willing to serve then the position shall
remain vacant until a special election candidate is elected and qualifies.
c. The appointment shall be made from the following commissions positions in the order listed,
unless that person is unwilling to serve or not qualified to serve: first the Mounds View Charter
Commission chair: second the Mounds View Planning Commission chair: third the Mounds View
Parks Recreation and Forestry chair. fourth the Mounds View Charter Commission vice-chair. In the
case of vacancy of the mayor term the appointed person shall serve as a member of the council and
the acting or vice may_ or will continue to serve as mayor, for emergency powers.until the succesor
mayor is elected and qualifies. While serving on the council the appointed person shall be excused
from and shall not participate in their appointed commission position. The person will regain their
commission position for the remaining term of their appointment to the commission. The appointed

AN ORDINANCE AMENDING SECTION 4.05 OF THE CITY OF MOUNDS VIEW
CHARTER PERTAINING TO VACANCY OF MUNICIPAL ELECTED OFFICE
THE CITY OF MOUNDS VIEW ORDAINS:
Section 1. Background; findings; authoritX.
1.01. The city of Mounds View ("City") is governed by a home rule charter (the "City
Charter"), adopted pursuant to the Constitution of the State of Minnesota and Minnesota
Statutes, chapter 410 (the "Act").
1.02. The Mounds View Charter Commission has proposed the adoption of an amendment to
section 4.05 of the City Charter (the "Amendment") and recommended to the City Council
that the Amendment be adopted by ordinance in the manner prescribed by section 410.12,
subdivision 7 of the Act.
1.03. A public hearing on the Amendment was held on September 3, 2024 by the Mounds View
City Council after published notice containing the text of the Amendment, as required by the
Act, and all persons desiring to be heard with reference to the Amendment were heard at said
public hearing.
1.04. The Mounds View City Council finds and determines that it is in the best interests of the
City and its inhabitants that the Amendment be adopted.
Section 2. Adoption; effective date; filing.
2.01 The Mounds View City Charter is hereby amended by adding the double-underlined
language and deleting the str4Eken language as follows:
Section 4.05. Vacancy of Municipal Elected Office. Subdivision 1 Vacancy when 365
days or more remain in term.
a. When a vacancy in an elected office of the City occurs with 365 days or
more remaining in the term of the vacated office, there shall be a special election
held to elect a successor to serve for the remainder of the unexpired term of the
vacated office. The special election shall be held at the next uniform election
date specified in Minnesota Statute 205.10, subd 3a, as it may be amended from
time to time, for which all legal requirements for special elections can be met by
the City. (The determination of vacancy is found in Chapter 2, Section 2.05
Vacancies.) (Amended 2005 o 748; 2023 o 995; 2023 o 996.)

b. When a vacancy in an elected office of the City occurs with 365 days or
more remaining in the term of the vacated office and the special election date
of subdivision 1a is not within 130 days after the date of Council's vacancy
declaration, the Council, after passage of the resolutions of vacancy and
special election date, shall within 30 days and by majority vote appoint a
successor using the method in subdivision 1 c. In case of a tie vote of the
Council,the mayor shall make said appointment by the same method as in
subdivision 1 c. The appointed successor may continue to serve until a
successor is elected and qualifies. If none of these persons are willing to
serve then the position shall remain vacant until a special election candidate
is elected and qualifies.
c. The appointment shall be made from the following commissions positions
in the order listed unless that person is unwilling to serve or not qualified to
serve; first the Mounds View Charter Commission chair; second the Mounds
View Planning Commission chair; third the Mounds View Parks Recreation
and Forestry chair, fourth the Mounds View Charter Commission vice-chair.
In the case of vacancy of the mayor term the appointed person shall serve as
a member of the council and the acting or vice mayor will continue to serve
as mayor_, for emergency powers,until the succesor mayor is elected and
qualifies. While serving on the council the appointed person shall be excused
from and shall not participate in their appointed commission position. The
person will regain their commission position for the remaining term of their
appointment to the commission. The appointed council position will expire

Discussion:
The department is requesting to purchase one 2025 Ford Police F-150 Responder
Truck to replace older vehicles as scheduled.
The Ford Police F-150 Responder Truck is offered at $46,483.16 each, at state bid.
The total for set up cost and additional equipment for this vehicle will be approximately
$ 27,667.01 (460-4200-7040). One light bar ($2,500.00/approx.) will be purchased out
of forfeiture funds (225-4200-7040).
The total purchasing cost, setup, and equipment for the squad will be approximately
$74,150.17 (460-4200-7040). The cost for a light bar will be approximately $2,500.00
(Fund 225-4200-7040).
Recommendation:
Staff recommends approving Resolution 9983, authorizing the purchase of one Ford

WHEREAS, the Mounds View Police Department maintains a replacement
schedule of police vehicles to ensure that the police department can provide reliable
quality service to the community with a dependable fleet of police vehicles, and;
WHEREAS, the Mounds View Police Department planned and budgeted for the
replacement of one police Community Service Officer (CSO) vehicle in 2025; and
WHEREAS, the Mounds View Police Department is in immediate need to
replace one marked Community Service Officer (CSO) vehicle; and
WHEREAS, Tenvoorde Ford has the state bid for a Ford Police F-150 Responder
Truck available at $46,483.16 with set up cost and additional equipment at approximately
$27,667.01.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Mounds View, Ramsey County, Minnesota to authorize the purchase of one 2025 Ford
Police F-150 Responder Truck at an approximate cost of $46,483.16 plus additional
equipment and setup costs of approximately $27,667.01 for a total expense of

Strategic Plan Strategy/Goal: Resolution 9986 is consistent with the Vision Statement,
"...welcoming a desirable destination to all ages and cultures...and a place where residents can
live, work and play."
Financial Impact: As detailed in contract but offset by PEG fees collected.

level of industry standards;

Professional and Technical Services Agreement
This contract is between the North Suburban Access Corporation, a Minnesota Municipal
Corporation, (herein "the NSAC") and the City of Mounds View, Minnesota (herein
"the City").
Recitals
1. Under Minnesota law, the NSAC is empowered to provide such professional and
technical services as are desired by the City.
2. The City desires to engage the NSAC for video webcasting services and archiving
services (herein "the Services").
3. The City represents that it is empowered to engage the NSAC.
Agreement
1. Term of Contract
1.1. Duration. This Agreement will become effective January 1, 2025,and
will remain in effect for a period of three(3)years. At the expiration
of the one(1)year period,the Agreement will automatically renew for
another period of one(1)year,unless notice to terminate this
Agreement is provided no less than ninety(90) days prior to the end of
the current term. If this Agreement is terminated prior to the
completion of a one(1)year period,the NSAC will be entitled to
payment,determined on a pro rata basis, for Services satisfactorily
performed.
1.2. Survival of Terms. The following clauses will remain in effect after the
termination of the Agreement: Section 5. Liability, Section 6.
Government Data Practices and Intellectual Property, Section 8.
Governing Law, Jurisdiction, and Venue; and Section 9. Disclosure.
2. Services Provided
2.1. Services. The NSAC will provide the Services described in Schedule A
(attached).
2.2. Additional Services. The City may also request additional services during
the term of the Agreement(see Section 1.1. Duration). If accepted by
the NSAC, Schedule A will be amended to include a description of the
additional services and according compensation.Unless otherwise
specified, all terms of this Agreement will apply to any amendments to
Schedule A.
2.3. Standard of Care. To the extent any property, such as camera or computer
equipment, is loaned by the NSAC to the City,the City will exhibit a
standard of care consistent with Minnesota law.
2.4. City Assistance. Depending on the nature of the Services,the NSAC may
from time to time require access to public and private lands or
property. To the extent the City is legally and reasonably able,the City
will provide access to and make provisions to enable the NSAC or its
agents or employees to enter upon public and private land and property
as required for the NSAC to perform the Services.
The City will famish the NSAC with a copy of any special standards or
criteria promulgated by the City relating to the Services, including,but not
limited to, design and construction standards,that is necessary for the
NSAC to prepare for its performance of the Services.
3. Payment
3.1. Compensation. The City will pay for all Services to be performed by the
Contractor as specified in Schedule A(attached).
3.2. Fee Adjustment. The NSAC reserves the right to annually adjust the fees
associated with the Services specified in Schedule A.
Such adjustments, if any,will be enacted on January 1 of a given year.
Prior to enacting any fee adjustments,the NSAC must provide written
notice of such to the City at least ninety(90) calendar days prior to the
effective date of the fee adjustment.
3.3. Invoices. The City must promptly pay the NSAC after the NSAC presents
an invoice for those Services that have been actually performed. The
NSAC must timely submit invoices.
3.4. Event Cancellation. The City agrees to pay 70%of the expected event
amount for any cancellation unless sufficient prior notice is provided.
"Prior Notice" is defined as at least 10 business days (including the
day of the event)before the scheduled event.
4. Assignment,Amendments,Waiver, and Completeness
4.1. Assignment. The City may not assign, license, or transfer any rights or
obligation under this Agreement without prior written consent of the
NSAC and a fully executed Assignment Agreement, executed and
approved by the same parties who executed and approved this
Agreement, or their successors in office.
4.2. Amendments. Any amendments to this contract must be made in writing
and will not be effective until executed and approved by the same
parties who executed and approved this Agreement, or their successors
in office.
4.3. Waiver. If the NSAC fails to enforce in a timely manner any provision of
this Agreement,that failure does not waive the provision or the
NSAC's right to enforce the provision.
4.4. Completeness. This Agreement contains all negotiations and agreements
between the NSAC and the City. No other understanding regarding
this Agreement,whether written or oral,may be used to bind either
party.
5. Liability
The City must indemnify and hold harmless the NSAC, its agents, and its employees
from any claims or causes of action, including attorney's fees incurred by the NSAC
arising from performance of this Agreement by the City, its agents,or its employees. The
clause must not be construed to preempt any legal remedies the NSAC may have for the
City's failure to fulfill its obligations under this Agreement.
6. Government Data Practices and Intellectual Property
6.1. Government Data Practices. To the extent applicable,the City and NSAC
must comply with the Minnesota Government Data Practices Act,
Minn. Stat. Ch. 13. The civil remedies of Minn. Stat. § 13.08 apply to
the release of the data referred to in this Clause by either the City or
the NSAC.
Each Party shall notify the other of any Data Practices Act request for
video recordings created pursuant to this Agreement. All requests for the
release or sale of video recordings created pursuant to this Agreement
shall be directed to and fulfilled by the NSAC.
7. Endorsement
The City must not claim that the NSAC endorses its products or services.
8. Governing Law,Jurisdiction,and Venue
Minnesota Law governs this Agreement.Venue for all legal proceedings arising from this
Agreement shall be in the appropriate state or federal court with competent jurisdiction in
Ramsey County,Minnesota.
9. Disclosure
The City consents to disclosure of its social security number, federal employer tax
identification number,and Minnesota tax identification number,to the Commission as is
necessary for compliance with Minnesota and other applicable law.
10. Severability
If any section or clause of this Agreement is held to be invalid or unenforceable,then the
meaning of that section or clause shall be construed so as to render it enforceable to the
extent feasible. If no feasible interpretation would save the section or clause,it shall be
severed from this Agreement with respect to the matter in question, and the remainder of
the Agreement shall remain in full force and effect. However, in the event that such a
section or clause is essential or substantially alters the Agreement,the Parties shall
negotiate a replacement section or clause that will achieve the intent of such
unenforceable section or clause to the extent permitted by law.
11.Employment
Employees of the NSAC performing work pursuant to this Agreement shall remain at all
times employees only of the NSAC. The NSAC will be responsible for worker's
compensation, salary, and training.

Background:
The City owns thirteen separate facilities with heating, ventilation and air conditioning
(HVAC) equipment, which require more complex contractor assistance with preventative
maintenance to allow reliable, efficient and safe operation while providing comfortable
indoor air climates. While the Public Works Staff can perform limited and basic
maintenance, City Staff is not trained and nor the necessary credentials to perform the
required annual inspections and testing on the majority of the HVAC systems, especially
those at the Public Works Facility, Park Buildings and Water Treatment Plants. The City
has traditionally contracted with qualified HVAC contractors to perform this needed
service, most recently with Architect Mechanical Inc.
Discussion:
Service agreements with Architect Mechanical Inc. have expired and the Public Works
Staff recently evaluated the best approach to perform preventative maintenance to the
HVAC equipment needs for reliable efficient and cost-effective operations. After careful
consideration, Public Works is recommending that Architect Mechanical Inc. perform
HVAC equipment maintenance to Public Works, Parks Buildings and Water Treatment
Plant Facilities. The following is a break down for the costs:
Architect Mechanical Inc.:
Year 1: $8,250.00 annually
Year 2: $8,662.00 annually
Year 3: $9,075.00 annually
Year 4: $9,570.00 annually
Year 5: $10,048.00 annually
Strategic Plan Strategy/Goal: Maintain and Plan for Infrastructure Improvements.
Financial Impact No impact to the 2024 budget, funds 100-4460-3030, and 100-4360-
5120 and 700-4823-5120 and, would be used for this service. No additional transfer of
funds is necessary.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View,
Ramsey County, Minnesota as follows:
1. Approves the service agreement with Architect Mechanical Inc. to perform HVAC and
equipment maintenance at Public Works, Park Buildings and Water Treatment
Facilities.
2. The Director of Public Works is hereby authorized and directed to execute all
appropriate documents to effectuate the actions contemplated by this resolution.
3. The Mayor and City Administrator, Staff and consultants are hereby authorized and
directed to take any and all additional steps and actions necessary or convenient in
order to accomplish the intent of this Resolution.

Item Title/Subject: Resolution 9988 Approving a 3 year Contract with Upper Cut
Tree Service for Diseased Tree Removals
Background/Discussion:
Public Works is charged to oversee the Forestry duties in the City, this includes trees in and
on City grounds as well as trees in the ROW (right of way) also included with the Forestry
duties are privately owned diseased/hazardous trees.
Included with the Diseased Tree Ordinance are the Elm, Oak, and Ash. (Emerald Ash borer
is currently the main concern of this Ordinance.) City Council has expressed the desire to
continue to obtain quotes for tree removals with resulting in providing a lower cost for the
Mounds View property owners to remove their trees.
Staff sent a Request for Quote (RFQ) to sixteen (16) tree companies asking for costs
regarding the removal of private Front and Backyard trees without stump removals. Staff
also requested, as an alternate, costs associated with stump removals and seed/dirt
restoration. NOTE: To eliminate hazards within the ROW and on City owned properties, tree
stumps are removed.
Further Discussion:
The City Arborist is recommending not to remove the tree stumps based on recent data
stating removal or keeping the stumps has minimal impact on disease spreading.
The City Shade Tree Disease and Pest Control code includes the following language within
153.004 Section A-2, sub e:
For any tree removal by the city, the city shall not be responsible for restoration of the removal site,
including, but not limited to, seeding or replacement of sod, trees, shrubs, flowers, underground
irrigation or any other improvements not specifically mentioned herein, which may be damaged,
destroyed or removed during the tree removal process.
Though the code states the City is not responsible for restoration to these areas, contractors
have been instructed to do so because of past practice. Tree removal costs continue to rise
and to assist the property owners in keeping costs down, Staff is recommending not to
remove the tree stumps but instead, leave the stump at 3 inches or less above ground level.
(This will also assist City Staff because many times the Contractor cannot remove the stump
at the time of tree removal therefore resulting in phone calls/emails inquiring on the status of
the removal by the property owners; this practice also delays invoicing by Finance.)
Contract Information:
Past contracts have been every two to three years; the current contract for the tree removals
expired in 2024.
The proposal was broken down in both the accessible (front) and non-accessible (back) by
Diameter Breast Height (DBH).

The apparent low quote for accessible and for non-accessible trees is Upper Cut Tree
Service tree service and has held municipal contracts with other cities.

Recommendation:
Staff recommends the City Council approve Resolution 9988 awarding a contract for the
remainder of 2024 through December 31, 2027 with Upper Cut Tree Service of Forest

for diseased/hazardous private front and backyard properties, and City owned trees to

1. That a 3-year contract for diseased/hazardous tree removals as per Code 153 is
hereby awarded to Upper Cut Tree Service for both front and back trees based on
the annual proposed amount.
2. The Mayor and City Administrator are hereby authorized and directed to enter into
a contract with Upper Cut Tree Service to perform tree removals for the City of
Mounds View. Said contracts shall expire on December 31, 2027.
3. The Mayor and City Administrator, staff and consultants are hereby authorized
and directed to take all additional steps and actions necessary or convenient in

Pond Projects and Accept the Grant from BWSR for the projects
Background/Discussion:
The Public Works Department has many responsibilities, and one is to efficiently operate and
manage the storm water system. The system was first constructed in the 1970's and as with other
similar core functions, research, innovation, and best management practices have changed over
the years.
City Council approved Resolution 9544 to have Stantec Engineering Services complete an overall
Storm Water Pond assessment with a final report providing a list of ponds, features, and
maintenance needs, including a Capital Improvement Plan (CIP).
City Council further approved Resolution 9783 and 9784 authorizing Stantec to complete the
assessments on Ardan Park, AA-1.P1 and AA-1-.P2, and the Silver View Park Storm Water
Ponds. Neighborhood meetings were held to receive feedback on concerns of the draft plans.
Stantec has completed the plans and specifications for both Ardan Park and Silver View Park
Storm Water Ponds, including a cost estimate for dredging the Ardan ponds and upland vegetation
management plans at both project locations.
The project at Ardan Park will primarily focus on dredging the two (2) ponds along with the upland
vegetation management, while the Silver View project will focus on the water quality and upland
vegetation management.
Stantec has provided engineer estimates as follows:

Upland Vegetation Management $ 33,473.00
