Resolution 10040, Approving the Tribute Memorial Park Concept and 44 Design Plans. 45 Mounds View City Council January 13, 2025 Regular Meeting Page 3 1 Public Works/Parks and Recreation Director Peterson stated in 2022 the City Council requested 2 staff look into installing a veterans memorial park. He indicated this concept grew to include 3 honoring first responders, military veterans and those residents that lost their lives in local 4 tragedies. He commented on the community input that has been gathered by the Tribute Park 5 Committee. He reviewed the layout of the proposed Tribute Park adjacent to City Hall. He noted 6 there were a number of speakers that would be addressing the City Council regarding the proposed 7 park. 9 Former Mayor Carol Mueller read prepared remarks regarding the Tribute Park. She noted she was 10 a newlywed when she moved to Mounds View in 1979. She commented on the love, generosity 11 and pride this community bestowed when building the playground structure at the Pinewood 12 Elementary School. She appreciated how Mounds View had pulled together to support one another 13 through this project, but she understood this community had done the same thing when two 14 different tornadoes cut a deadly path through this community in 1965. She stated on July 8, 1986 15 the City was awoken by a loud explosion and huge fire on Long Lake Road. She noted over 200 16 people had to be evacuated from this event. 17 18 Former Mayor Mueller noted on August 1, 2007, she was working a shift at the local liquor store 19 when she learned the I-35W Bridge had collapsed. She discussed how devastating this event was 20 for the community and the I I I vehicles that dropped 115 feet down to the river. She explained 21 first responders and law enforcement responded within minutes to rescue and render aid. She 22 reported local coach Patrick "Homer" Holmes was lost in this tragedy. She reported since 2008, 23 an annual coach of the year was recognized in Homer's memory. She stated Paul Egstad was a 24 kind, reserved man who loved to go fishing. She indicated Paul was also lost during this tragic 25 event when his semi -truck jack knifed in order to stop from going off the edge of the bridge, which 26 prevented a school bus from going around him and also going off the bridge. She discussed how 27 the Egstad family had donated a piece of the bridge to the City in Paul's honor. She described how 28 Kim, the bus driver was seriously injured but survived the bridge collapse, along with the 50 29 children on board. She explained Jeremy Hernandez, a 20 year old worker at the daycare, managed 30 to get the rear door open and he carried the injured children and escorted all of the other children 31 out of the bus to safety. She commented further on the number of people that were injured and lost 32 that day. She reported on August 1, 2011, the City of Minneapolis dedicated an I-35W Bridge 33 remembrance garden on West River Road for the 13 victims and 171 survivors of the bridge 34 collapse. She read somewhere the garden project cost $900,000. 35 36 Former Mayor Mueller explained during her last term as Mayor she asked the City Council to find 37 dollars within the budget to honor the people who were lost during these three disasters. She stated 38 after much discussion, the Council agreed to support such a project, if a veterans memorial were 39 included. She thanked Council Member Bill Bergeron for shifting the concept to a Tribute Park, 40 in order to honor the living as well. After further discussion the Council supported paying tribute 41 to first responders, which included the Mounds View Police Department, SBM Fire and Allina 42 Ambulance. She reported in December of 2022, she volunteered to serve on the Tribute Park 43 Committee. She discussed how the park would now honor those lost to local tragedies, first 44 responders and those who have served in the military. She indicated the Tribute Park Committee 45 has worked really hard on this project for the past two years. She discussed how the major expenses 46 would be for basic construction, lighting, and the engraved monuments. She commented on how Mounds View City Council January 13, 2025 Regular Meeting Page 4 1 the committee was seeking donations at this time by selling pavers. She hoped the construction 2 bids came in as expected, noting the committee has already raised 12% of the expenses. She hoped 3 the Tribute Park could be dedicated on Veteran's Day, November 11, 2025. 5 City Administrator Zikmund introduced the next speakers, Cindy and Don Spano. 6 7 Cindy Spano thanked the Council for allowing her to speak. She spoke to the Council about what 8 a first responder means to her and what an impact they had on her family after the pipeline burst. 9 She indicated she was not in Mounds View at the time, but she heard about it from her husband. 10 She discussed how she had been contacted regarding the Mounds View Tribute Park and she 1 1 appreciated the fact the City would be recognizing those lost in local tragedies, along with veterans 12 and first responders. She explained after speaking with Commissioner Bob Jacobsen, she learned 13 how tragic events can impact first responders as well. 14 15 Ms. Spano stated on July 8, 1986 the Williams pipeline burst in Mounds View. She commented 16 on how there were two critical victims that needed attention, which included both Bev (Don's 17 previous wife), and Don's daughter, Jennifer. She noted fellow firefighters worked to put out 18 flames amidst the hysteria. She indicated Commissioner Jacobsen went home a changed man after 19 seeing the horror that occurred that day. She stated she was eternally grateful that Bev was not 20 alone, in pain and waiting. She explained for first responders, these events are never ending. These 21 first responders have to push through the events, go home and show up for work again the next 22 day. She commented on how first responders provide hope and care loved ones so desperately 23 need. She appreciated the fact the Tribute Park would include a beautiful space for reflection on 24 those who have been lost, those who have suffered and those who have served this community. 25 26 Don Spano thanked the Council for inviting him to speak. He felt honored when the City 27 Administrator contacted him regarding this project. He noted he had a meeting at his home which 28 included the City Administrator, Police Chief Zender, Fire Chief Dan Retka and Public Safety 29 Commissioner Bob Jacobsen. He noted this was the first time he had met most of these individuals, 30 but this was not the first time he had met Commissioner Jacobsen. He noted the first time he met 31 Commissioner Jacobsen was on July 8, 1986 in the front of his Mounds View home. He stated 32 Commissioner Jacobsen was the first responder he had contact with that day. He saw 33 Commissioner Jacobsen as a heroic, helpful and dedicated person. He noted there were many 34 EMT's onsite that day, who assisted him and the entire Mounds View population. He commented 35 on how the emergency responders acted like best friends that day to the citizens of Mounds View. 36 He discussed how the emergency responders in Mounds View were loyal, trustworthy, supportive, 37 honest and reliable. In addition, they exhibit traits of leadership, problem solving, compassion and 38 teamwork, while performing whatever task they are assigned too. He believed first responders 39 served an admirable purpose. He thanked the City for pursuing the Tribute Park and for honoring 40 those who sacrifice their time, effort and lives, to make Mounds View a great place to live and 41 work. He reported he no longer lives in Mounds View, as he moved out of the community in 1994. 42 However, he noted he has fond memories of the City and the friendships he made and retained. 43 He thanked the City again for thinking of him and for working to complete a Tribute Park. 44 45 Police Chief Zender introduced Minnesota Department of Public Safety Commissioner Bob 46 Jacobsen to the City Council. Mounds View City Council January 13, 2025 Regular Meeting Page 5 2 Public Safety Commissioner Bob Jacobsen thanked the Council for their time. He appreciated how 3 the City Council was looking to recognize and honor the significant events, tragedies and many 4 heroes in the community. He thanked the Spano's for welcoming him back into their home and 5 hearts. He explained Mr. Spano and the Spano family was a real tribute to the community. He 6 commended the Spano family for moving on and for their resiliency. He appreciated the Spano's 7 kind words for first responders and discussed how it was his honor and calling to serve this 8 community. He stated he would never forget the day he spent with Bev on the day of her passing. 9 He explained he appreciated reconnecting with the Spano family noting out of bad things, there 10 are often good things that come. He discussed how the Office of Pipeline Safety came out of the 11 Mounds View tragedy and noted he now oversees this office. 12 13 Council Member Gunn stated she has served as a Councilmember for a lot of years. She discussed 14 the surveys that have been completed in the community over the years and one thing people really 15 like about Mounds View is the small town feel. She explained the Council and staff have had 16 discussions about what small towns have that Mounds View doesn't have. She reported a veteran's 17 memorial was at the top of this list. She commented on how discussions continued and it was 18 determined the City's first responders should also be honored, along with those who were lost to 19 the three tragedies in the community. She thanked former Council Member Bill Bergeron for his 20 work to bring about the Tribute Park. She introduced the members of the Tribute Park Committee 21 to the City Council and thanked them for all of their hard work in planning for the park. She 22 discussed how the committee has been working to fundraise for the park with the assistance of a 23 501c3 through the fire department. She urged residents to consider purchasing a paver in memory 24 of a loved one. She was pleased that people passing through the community would be able to see 25 the Tribute Park from Mounds View Boulevard and perhaps these individuals would stop, reflect 26 and remember. 27 28 Council Member Meehlhause reported he had the privilege of representing the Mounds View 29 Lions at this meeting. He explained 2025 represents the 61s' year the Mounds View Lions have 30 served and partnered with the City. He was proud to announce the contribution of $2,500 towards 31 the Tribute Park construction. He noted the club also hopes to donate another $2,500 as the group 32 will be applying for a grant with a charitable foundation that works to impower Minnesota Lions 33 Club by boosting their ability to complete community projects with matching grants. He stated the 34 club will also be purchasing a paver to honor the Lions Club members who have served in the 35 United States military. He noted the Lions will also be purchasing a paver honoring Amanda Lee, 36 who grew up in Mounds View, currently serves in the US Navy and is the first female F-15 fighter 37 pilot. He reported a private individual has made a $1,500 contribution to the club and the club has 38 agreed to donate this generous contribution to the Tribute Park. 39 40 Fire Chief Retka stated it was an honor to be in attendance at this meeting. He explained as the 41 Fire Chief of the SBM Fire Department, he understood that tragedies strike every community. He 42 was very proud with how the City of Mounds View was stepping up and recognizing the tragedies 43 the community has faced. He noted he had the privilege of meeting with the Spano family in 44 Wisconsin and he appreciated how deeply touched Commissioner Jacobsen was. He appreciated 45 going back and reading the stories from the police reports when the pipeline event occurred. He 46 thanked the City for recognizing the first responders who serve this community and stated he Mounds View City Council January 13, 2025 Regular Meeting Page 6 1 looked forward to promoting the Tribute Park. He then introduced Chief Anthony Scavo to the 2 City Council, noting he serves as the Fire Relief Association President. 3 4 Chief Anthony Scavo introduced himself to the Council and thanked the City of Mounds View for 5 honoring first responders within the proposed Tribute Park. He explained the Fire Relief 6 Association would like to make a donation in the amount of $50,000 to the Tribute Park. A round 7 of applause was offered by all in attendance. 9 Mayor Lindstrom accepted the check on behalf of the City of Mounds View. 10 1 1 Karen Mills, Tribute Park Committee member, stated she has been working with the committee 12 for the past two years and she appreciated all of the efforts from the members. She appreciated 13 how the proposed park was designed with a focus on heart, safety and service. She was thankful 14 the park would be visible from Mounds View Boulevard and all who pass through the community 15 would be able to see it. 16 17 City Administrator Zikmund described the reform and safety measures that were now in place 18 along the pipeline due to the Office of Pipeline Safety. 19 20 Public Works/Parks and Recreation Director Peterson reviewed the costs for the park construction 21 noting the Public Works Department would be serving as the general contractor. He explained 22 staff reached out to a number of vendors to receive estimates. Staff estimated the total project costs 23 would be $258,160. He noted staff was working with some of the contractors in order to have costs 24 lowered. In addition, staff would be seeking grants to assist with offsetting costs. 25 26 Council Member Clark asked if the project had gone to bid. Public Works/Parks and Recreation 27 Director Peterson reported the Resolution before the Council would approve and finalize the 28 concept plans and allow staff to bid the project. 29 30 MOTION/SECOND: Gunn/Meehlhause. To Waive the Reading and Adopt Resolution 10040, 31 Approving the Tribute Memorial Park Concept and Design Plans. 32 33 Council Member Clark noted she had forwarded several grant ideas on to staff. She indicated she 34 was excited about this project and hoped the City could find grants to assist with funding the 35 project. 36 37 Council Member Meehlhause thanked State Representative Kelly Moller and Ramsey County 38 Commissioner Tara Jebens-Singh for attending this meeting. He noted he was a member of the 39 2022 City Council that approved moving forward with a Tribute Park. He explained this was a 40 historic meeting for the Mounds View City Council. He commented on Council Member Bill 41 Bergeron proposal naming this a Tribute Park because it would recognize members of the military, 42 first responders and victims of the three tragedies in the community. He thanked the Spano family 43 for being in attendance and for their comments. He thanked Public Safety Commissioner Bob 44 Jacobsen for being in attendance at this meeting and for his dedicated service to the community. 45 He thanked Committee members for their time and efforts. She thanked all of the committee members for bringing their visions forward and working to make this park a reality. Mayor Lindstrom thanked everyone who has participated in this meeting. He thanked Cindy and Don Spano for sharing their experience with the City Council. He thanked the committee members and Public Works Director Peterson for their efforts. He thanked the Fire Relief Association for their generous donation to the Tribute Park. He commented on the tragedies that happened in the community and noted on January 21, 2018 there was a tragedy that didn't happen to him because of a paramedic. He stated he wanted to buy this person a paver for saving his life when he overdosed. He commented on how this project was meaningful to so many residents of Mounds View because people have been impacted in many, many ways. Council Member Gunn requested a roll call vote. Mayor Lindstrom read a Resolution of Appreciation in full for the record recognizing Adriana Moe for her service on the Economic Development Commission. MOTION/SECOND: Meehlhause/Clark. Mayor Lindstrom read a Resolution of Appreciation in full for the record recognizing Kris Lillemo for his four years of service on the Parks, Recreation and Forestry Commission. PUBLIC COMMENT 2 3 Mayor Lindstrom encouraged the public to speak with kindness and respect when addressing the 4 City Council during Public Comment. 5 6 Murwo Mohamed, 2657 Mounds View Boulevard, requested the City Council invest in new 7 workout equipment, including a smith machine and leg press for the Community Center. She 8 recommended that the lighting along Mounds View Boulevard also be improved for pedestrian 9 safety. She discussed how she takes the bus to work every day and noted she has almost been hit 10 twice on Long Lake Road when walking home from the bus stop. She asked that the police 11 department monitor the driver behavior in this area. She asked that a bus shelter be created at Long 12 Lake Road for warmth during the winter months. 13 14 Mayor Lindstrom indicated he would be speaking with the Met Council and explained he would 15 discuss lighting and a bus shelter. 16 17 Vince Meyer, 8380 Spring Lake Road, explained he submitted an information disclosure request 18 to the City. He reported he heard back from the City that they do not have the information he was 19 requesting. He understood staff had information on which driveways were installed incorrectly 20 and he would like this information to be passed along to him. 21 22 Joyce Jones Strait, 7728 Knollwood Drive, spoke to the Council regarding the Tribute Park. She 23 indicated she was born in St. Paul and moved to Mounds View when she was in kindergarten. She 24 explained she was now a school teacher and she lived through the pipeline explosion. She 25 remembered the funerals for the Spano girls. She reported she stood in her parent's living room 26 when the 35W Bridge collapsed. She appreciated how bridge and pipeline safety has been 27 improved since these events occurred. She noted she has multiple military members in her family. 28 She was of the opinion the Tribute Park should be community funded and not City funded. 29 30 Dr. Jean Strait, 7728 Knollwood Drive, stated she learned so much about the history of this 31 community by attending this meeting. She explained she grew up in a small town named 32 Johnstown where her father was the fire chief and her godfather was the police chief. She noted 33 she almost lost her dad in the 1977 flood. She understood the fear of not knowing if your loved 34 one will come home from. She stated she believed the Tribute Park was a wonderful idea that 35 needs to move forward. However, she was confused with how the City could agree to spend 36 $175,000 from the Special Projects Fund. She believed it was a conflict of interest that Council 37 Member Meehlhause had voted to move this project forward when he was a Mounds View Lion. 38 She feared the Council was getting sloppy with their actions. 39 40 Sharon Kirscher, 8406 Red Oak Drive, explained she lived through each of the tragedies in 41 Mounds View. She stated she liked the way this came together as a Tribute Park because this 42 would honor military and all first responders. 43 44 8. COUNCIL BUSINESS 45 46 None. Reports of Mayor and Council. 4 5 Council Member Gunn stated she would be attending Police Foundation and Tribute Park meetings 6 tomorrow. In addition, she would be attending a Planning Commission meeting on Wednesday, 7 January 15 and a Cable Commission meeting on Thursday, January 16. 8 9 Council Member Meehlhause reported he would be attending an NYFS Finance Committee 10 meeting on Wednesday, January 15. B. Reports of Staff. Finance Director Bauman reported the Finance Department was working on yearend reports and W-2's. She noted auditors would be coming in at the end of the week to do some preliminary work and the quarter four utility bills would be going out this week as well. Public Works/Parks and Recreation Director Peterson provided the Council with an update on the water meter change out project. He noted there were 250 to 300 meters that have yet to be replaced. Public Works/Parks and Recreation Director Peterson explained the Ardan Park pond dredging was moving along. He stated a change order may be brought forward. Public Works/Parks and Recreation Director Peterson commented the signal lights on Mounds View Boulevard was originally estimated to cost the City $800,000, and the City's portion has come in at $1,051,000. He reported he would be speaking with Ramsey County regarding this matter. Mayor Lindstrom asked if staff had an update on the wetland banking. Public Works/Parks and Recreation Director Peterson stated this would be further discussed at the February workshop meeting. Police Chief Zender thanked the City Council for their support of the Tribute Park. He thanked the committee members and staff for all of their efforts as well. He explained the Daddy Daughter Dance would be held on February 8. He reported he was trying to get enough officers together to do a polar plunge for Special Olympics. He noted he was currently short four officers. He explained he held interviews last Friday and he would be moving forward with one of the candidates that comes with experience. He commented further on two incidents that occurred over the weekend and he thanked his officers for their tremendous professionalism. City Administrator Zikmund stated he was working with Minnesota Roots on the Simons property. City Administrator Zikmund explained he was waiting to hear from the Dahl attorney in order to close on this property. 10. Permittee shall notify the Board's representative at least 48 hours in advance of permitted activities. The Board's representative, Mike Knutson, can be reached during normal worl<ing days at (cell) 651-775-6192 between the hours of 8:00 a.m. and 3:30 p.m. 6. The Board shall. have the option and authority of assigning its inspector or inspectors to the site at any time and for such periods as the Board or its engineer deems necessary or expedient for the safety and protection of employees or works of the Board or of other persons or property whomsoever or whatsoever because of any condition arising out of said permitted activity or from acts or operations of Permittee in the operation within the Premises. It is understood and hereby agreed by and between the parties hereto that any plans or data supplied by the Board or its engineer in respect of but not necessarily limited to work of the Board or of others located within or adjacent to said Premises are approximations only and that the Board explicitly does not guarantee any said plans or data to be either complete or correct. 8. Within sixty (60) days of expiration or termination of this Agreement, Permittee shall restore the Premises to a condition equal to or exceeding the existing condition prior to construction of permitted improvements and activities. 9. The use of explosives of any kind or for any purpose whatsoever within and adjacent to the Premises, including ammunition in hand-held impact -driven type tools, is expressly prohibited. 10. Permittee shall operate no heavy earth moving equipment or other heavy equipment over the Premises. 11. Permittee shall neither make any excavation: nor alter any works or improvements therein other than as expressly provided for in this Agreement, except with and according to SPRWS General Manager's written consent thereto. 12. Pennittee shall not allow hazardous substances within the Premises for any reason and shall be responsible for any environmental, ecological, or other damage caused by the presence of any hazardous substance introduced to the Premises during any permitted activities. 13. The Board reserves to itself the right to install additional works within the Premises and to continue maintenance of existing works located therein. 14. Permittee shall not damage or obstruct or cause any interference or otherwise damage said Premises or any improvement or works of the Board or others located therewithin, thereupon or thereunder and Permittee shall pay for or otherwise make good to the satisfaction of the Board any damage caused to said. Premises or to any improvement or works of the Board by Permittee and that any repair or replacement of works of the Board which might be damaged, destroyed or rendered unsuitable to the purpose thereof by any reason arising out of acts of Permittee shall be accomplished by the Board with its own forces or by its contractor, as the Board may elect, and by use of materials furnished by the Board or its contractor as hereinafter provided, all at the cost and expense of Permittee. 15. Permittee shall forever indemnify and save harmless, protect and defend the City of Saint Paul and the Board, their employees and agents from any or all liability, suits or demands, including the legal defense costs thereof, for bodily injuries (including death) or property damages, including loss of use, arising out of the activity pennitted by this Agreement. This provision shall not, however, apply to the extent that such bodily injury or property damage is caused by the negligence of the City of Saint Paul or the Board, its agents or employees. This provision shall further be subject to the following: any liability of the City of Saint Paul or the Board shall be governed by Minnesota Statutes, Chapter 466 and shall be subject to Nue 2 <,r; the conditions and limitations therein. 16. The obligations of Perinittee hereinabove set forth shall not be extinguished or modified in any respect by reason of the fact of any insurance taken out in pursuance of other pertinent provisions of this Agreement. 17. During permitted activity, Permittee or Pertuittee's contractor shall take out and maintain comprehensive public liability insurance for and on behalf of Permittee. The City of Saint Paul and the Board of Water Commissioners of the City of Saint Paul shall be named as additional insureds, protecting the parties from claims for damages and bodily injuries, including accidental death, as well as from claims for damage to property owned by the Board, which may arise from operations incidental to this Agreement, including coverage for damage to structures of any kind or underground structure of any kind, whether such operations be by Permittee or by any contractor or subcontractor or by anyone directly or indirectly employed by any of them. Such insurance shall also include contractual liability coverage and shall insure the liability assumed by Permittee under the indemnification clause contained in this Agreement. The minimum amount of such liability insurance shall be as follows: Combined single limit: of not less than $1,500,000 per occurrence .For bodily injury and property damage, subject to $2,000,000 aggregate. Lessee may satisfy this requirement with underlying insurance and/or an umbrella policy. Acceptable written proof of insurance shall be. delivered to the Board well in advance of the time contemplated for commencing any operationpursuant to this Agreement and no operations shall be commenced, carried out, continued or pertnitted except after the Board has given Permittee its written approval of said insurance, and said insurance so approved is in force and effect. 18. Should it be necessary that the Permittee's works or improvements be removed or damaged as a result of Board operations, all replacement costs or modification costs to restore the Permittee's works shall be borne solely by the Permittee. Such replacement or modification shall not require an additional. permit unless Permittee is so notified by SPRWS General Manager. 19. The exercise of privileges granted in this permit shall be without cost or expense to the Board and shall be subject to inspection and approval of SPRWS General Manager or a designated representative. 20. It is intended. that the permission granted, and the obligations set forth herein shall run with the Premises and shall be binding upon the Permittee, its successors or assigns and upon the Board, its successors or assigns. 21. The permit may not be transferred or assigned by Penmittee except with and according to written permission of SPRWS General Manager. 22. The granting of this permit creates in the Permittee no property rights. Pagc 3 01'5 23. This Agreement maybe terminated at any time by Permittee without cause upon thirty (30) days written notice to Board. 24. If Pennittee should fail to comply with any tens of this Agreement for a period of thirty (30) days after receiving written notice specifying said default, then the Board may at its option and without limiting the Board in the exercise of any other remedy or right it may have on account of such default, and without any further notice or demand: Terminate this Agreement and enter the Premises, remove or remedy said default to the terms of this Agreement and charge the costs thereof to the Permittee. 25. Permittee agrees to abide by all applicable federal, state and local rules and regulations governing the performance of the activity hereby permitted. 26. The undersigned represent that they have the power and authority to execute this Agreement on behalf of their respective parties. 27. The parties may sign this Agreement in counterparts, each of which constitutes an original, but all of which together constitute on instrument. 28. The parties agree that the electronic signature of a party to this Agreement shall be as valid as an original signature of such party and shall be effective to bind such party to this Agreement. The parties further agree that any document (including this Agreement and ally attachments or exhibits to this Agreement) containing, or to which there is affixed, an electronic signature shall be deemed (i) to be "written" or "in writing," (ii) to have been signed and (iii) to constitute a record established and maintained in the ordinary course of business and an original written record when printed from electronic files. NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council ("City Council") hereby approves the addition of a separate driveway for Lot 3 Block 1 of Long Lake Cove, revising the conditions of approval for the plat as previously approved, with the following conditions and findings of fact: Section 1. The Mounds View Economic Development Authority (EDA) will remain the same with the City Council serving at the EDA. There is a sub -committee called the Development Review Committee that is a sub -committee of the EDA that reviews development proposals and decides if the developments are worthy to bring forward to the full EDA. The City Council has the option of calling upon a couple of former EDC Commissioners or other non -City Council Members to participate on that committee as -needed. Code Official Schoeman inspected the property in May, 2024 and issued corrective actions in writing on May 20, 2024. A deadline was established of June 27, 2024. Code Official Schoeman re -inspected the property in late July and found no action had been taken and issued another letter dated July 25, 2024 providing a deadline of August 29, 2024. The letter detailed failure to comply would result in the City taking all necessary steps to remediate the situation, including abatement which costs would be born by the property owner. Administrator Zikmund received public information disclosure request from the property owner immediately north and adjacent to 8391 regarding any and all documents relating to cleaning up the property. The requester also provided additional photos as evidence no clean up had occurred. Administrator Zikmund conducted a drive -by inspection on January 9, 2025 of was able to view/observe items/junk in both the front yard (north side) and in the back yard. A letter was sent to Richard Mitchell, the property owner at 8391 Spring Lake Road advising him of the violation and advising the council would be taking action at their January 27, 2025 council meeting to move forward with abating the hazard. Discussion: Council has two remedies to address the situation, abatement and/or criminal charges. The abatement process gives us legal authority to enter the property and remove the "junk" materials, and assess all costs to the property owner. Failure to pay would result in assessment directly to the property. The draft ordinances are based on city council feedback provided at previous council meetings. The administrative section establishes the process for cannabis retailers to register with the City prior to making any sales to the public and outlines the enforcement process related to cannabis businesses. The entire ordinance is being provided in full for context, however, the sections related to zoning still must go through the zoning amendment process. Section 1 of the enclosed are the administrative regulations and Section 2 of the ordinance contains the zoning provisions. Additionally, the buffers contained in Section 121.008 of the administrative section will be part of the Planning Commission's review and are referenced in the zoning section when a cannabis retailer is mentioned. The City Council of the City of Mounds View hereby amends Title XI of the Mounds View Municipal Code by adding a new Chapter 121 as follows: CHAPTER 121: CANNABIS AND HEMP BUSINESSES § 121.001 PURPOSE. The City of Mounds View makes the following legislative findings: The purpose of this ordinance is to protect the public health, safety, welfare in the city by implementing regulations pursuant to Minnesota Statutes, chapter 342 related to cannabis and hemp businesses within the city. The city finds and concludes that these regulations are appropriate and lawful, that the proposed amendments will promote the community's interest in reasonable stability in the development and redevelopment of the city for now and in the future, and that the regulations are in the public interest and for the public good. § 121.002 DEFINITIONS The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this chapter, except where the context clearly indicates a different meaning: Applicant means an entity with a license or endorsement issued by the OCM that is applying for an initial registration or for registration renewal. The Act means Minnesota Statutes, Chapter 342, as is may be amended from time to time. Cannabis Business has the same meaning as defined in Minnesota Statutes, section 342.01. Cannabis Retailer means a business with a cannabis retailer license or cannabis retail endorsement from OCM. Retailer means every business that is licensed under the Act and required to register with the city under Minnesota Statutes, section 342.22. Including cannabis businesses and lower -potency hemp edible retailers. OCM means the Minnesota Office of Cannabis Management. School means a public school, as defined in section 120A.05, subdivisions 9, 11, 13, and 17, or a nonpublic school, or church or religious organization in which a child is provided instruction in compliance with this section and section 120A.24, but does not include a home school. Day Care means a location licensed with the Minnesota Department of Human Services to provide the care of a child in a residence or other facility outside the child's own home for gain or otherwise, on a regular basis, for any part of a 24-hour day Park Feature means an attraction within a public park that is regularly used by minors, including a playground or athletic field. § 121.003 LOCAL GOVERNMENT AS A CANNABIS RETAILER Pursuant to Minnesota Statutes, section 342.32, the city of Mounds View may establish, own, and operate a municipal cannabis store. The municipal cannabis store shall be subject to applicable cannabis retailer requirements as established by Minnesota Statutes, Chapter 342 and the rules adopted thereunder. § 121.004 PRE -LICENSE CERTIFICATION OF CANNABIS BUSINESSES (A) The City Administrator is authorized to certify whether a proposed Cannabis Business complies with the city's zoning ordinances, this Chapter, and if applicable, with state fire code and building code pursuant to Minnesota Statutes, section 342.13. (B) Potential licensees are responsible for obtaining all necessary zoning approvals prior to the City receiving the request for certification from the OCM. If a potential licensee fails to obtain necessary zoning approvals prior to the city receiving a request for certification, the city will inform the OCM that the potential licensee does not meet zoning and land use laws. If, at the time the city receives a request for zoning certification, there are no further intended alterations to the building where the business is to be conducted, the city will also certify compliance with building and fire code regulations, provided that the potential licensee has obtained inspections prior the city's receipt of a request for certification from the OCM. Building and fire code inspections will be valid for 1 year from completion. § 121.005 RETAILER REGISTRATION (A) Retail Registration Required. Before making retail sales to customers or patients, a Retailer must register with the city. Making retail sales to customers or patients without an active registration is prohibited. Subject to Minn. Stat. 342.22, subd. 5(e) the city may impose a civil penalty, as specified in the city's fee schedule, for making a sale to a customer or patient without a valid registration from the City and a valid license from the OCM. Ordinance No. 1025 Page 3 of 9 DOCSOPEN\MU21 0\317\1 001 615.v2-1/15/25 (B) Retail Registration Limits (1) The city will issue two cannabis retailer registrations pursuant to this chapter, except that the city will not issue any registrations if there is one registration per 12,500 residents in Ramsey County. (2) The number of registrations available will be calculated by dividing the state demographer's estimate of the city's population by 12,500 and rounding up to the nearest whole number. (3) The city will update the number of registrations available based on the most recent data available from the state's demographer. (4) The number of registrations in the County will be based on the number of registrations in the County on the day the application is received. (5) If the number of registrations available within the city decreases based on the County reaching the one per 12,500 threshold, businesses with current registrations will be allowed to maintain and renew their registrations but no new registration will be issued. (6) Registrations issued to businesses with a license preapproval will count toward the city's registration limit. (7) Businesses operating under a tribal compact entered into under Minnesota Statutes, section 3.9224 or 3.9228 and tribally issued licenses and registrations are counted towards the city's registration limit and the County registration limit. (8) A municipal cannabis store within the city of Mounds View shall not count towards the registration limit in this section. (C) Processing Registrations (1) Applications will be processed on a first -come, first -served basis based on the city receiving a complete application. Applications will be considered complete when all materials in Section 121.005 (D) are received by the city and include all required information and the fee described in Section 121.005 (D)(5) and as adopted in the city's fee schedule is received (2) The date a certification under Section 121.004 is issued will have no impact on the applicant's registration processing. (D) Application. The applicant must submit a registration application or renewal form provided by the city. The form may be amended from time to time by the City Administrator, but must include or be accompanied by: (1) Name of the property owner (2) Name of the applicant (3) Address and parcel ID for the property for which the registration is sought (4) Certification that the applicant complies with the requirements of this Chapter (5) Fee Required. At the time of initial application, and prior to the city's consideration of any renewal application, each Retailer must pay the applicable fee as established in the city's fee schedule. Initial registration fees and renewal registration fees are nonrefundable. (7) A copy of a valid state license or written notice of OCM license preapproval (E) Preliminary Compliance Check. Prior to issuing any retail registration, the city shall conduct a preliminary compliance check to ensure compliance with this Chapter and any other regulations established pursuant to Minnesota Statutes, section 342.13. (F) Reasons for Denial. The city shall not issue a registration or renewal if any of the following conditions are true: (1) The applicant has not submitted a complete application. (2) The applicant does not comply with the requirements of this Chapter. (3) The applicant does not comply with applicable zoning and land use regulations. (4) The applicant is found to not comply with the requirements of the Act or this Chapter at the preliminary compliance check. (5) The applicant or property owner is not current on all property taxes and assessments at the location where the retailer is located. (6) The maximum number of registrations, pursuant to Section 121.005 (B), have been issued by the city or within the County. (7) The applicant does not have a valid license from the OCM. (G) Issuing the Registration or Renewal. The city shall issue the registration or renewal if the Retailer meets the requirements of this article, including that none of the reasons for denial in Section 121.005(F) are true. (H) Nontransferable. A registration is not transferable to another person, entity, or location. (I) Registration Enforcement. (1) Generally. The City Council may impose a fine or suspend a registration under this Chapter on a finding that the registered business has failed to comply with the requirements of this Chapter or any applicable statute or regulation. (2) Notice and Right to Hearing. Prior to imposing a fine or suspending any registration under this chapter, the city shall provide the registered business with written notice of the alleged violations and inform the registered business of his or her right to a hearing on the alleged violation. Notice shall be delivered in person or by regular mail to the address of the registered business and shall inform the registered business of its right to a hearing. The notice will indicate that a response must be submitted within ten (10) business days of receipt of the notice, or the right to a hearing will be waived. 2. The registered business will be given an opportunity for a hearing before the City Administrator before final action to fine or suspend a registration. Provided, the registered business has submitted a written application for appeal within ten (10) business days after the notice was served. The City Administrator shall give due regard to the frequency and seriousness of the violations, the ease with which such violations could have been cured or avoided and good faith efforts to comply and shall issue a decision to fine or suspend the registration only upon written findings. Within ten (10) business days of the City Administrator's order, the decision may be appealed to the City Council. 3. If no request for a hearing is received within ten (10) business days following the service of the notice, the matter shall be submitted to the City Council for imposition of the fine or suspension of the registration. (3) Emergency. If, in the discretion of the city, a registered business poses an imminent threat to the health or safety of the public, the City may immediately suspend the registration and provide notice of the right to hold a subsequent hearing as prescribed in part (B) of this section. (4) Reinstatement. The city may reinstate a registration if it determines that the violations have been resolved. The city shall reinstate a registration if the OCM determines the violations have been resolved. § 121.006 COMPLIANCE CHECKS The city shall complete at minimum one compliance check per calendar year of every registered business to assess if the business meets age verification requirements, as required under the Act and any applicable cannabis or hemp regulations adopted by the city. Age verification compliance checks shall involve persons at least 17 years of age but under the age of 21 who, with the prior written consent of a parent or guardian if the person is under the age of 18, attempt to purchase adult -use cannabis flower, adult -use cannabis products, lower - potency hemp edibles, or hemp -derived consumer products under the direct supervision of a law enforcement officer or an employee of the city. Any failures under this section are a basis for enforcement action and must be reported to the OCM. Ordinance No. 1025 Page 6 of 9 DOCSOPEN\MU21 0\317\1 001 615.v2-1/15/25 § 121.007 HOURS OF OPERATION Cannabis Retailers may only make retail sales of cannabis, cannabis flower, cannabis products, lower -potency hemp edibles, or hemp -derived consumer products pursuant to the hours established in Minnesota Statues, section 342.27, subd. 7 (a). § 121.008 DISTANCE REQUIREMENTS (A) The city prohibits the establishment and operation of a cannabis retailer within the following buffer zones: • 300 from a School • 300 feet from a Day Care • 300 feet from an attraction with a Park Feature (B) The buffers in Section 121.008 (B) will be measured from the potential licensee's proposed business location based on the location of schools, day cares, residential treatment facilities, and park features on the date the city receives the request from the OCM for certification pursuant to § 121.004. Buffer distances will be measured from the shortest line between the entrance to the cannabis business and the structure consisting of the school, day care, residential treatment facility, or park feature. (C) Nothing in this section shall prohibit a cannabis business from continuing to operate at the same location if a school, day care, residential treatment facility, or park feature establishes within the buffer. § 121.009 CANNABIS BUSINESS COMPLAINTS The City Administrator is authorized to make complaints to the OCM related to cannabis businesses the city believes is in violation of the act or the administrative rules adopted pursuant thereto. The City Administrator is also authorized to file a complaint against a cannabis business that poses an immediate threat to the health or safety of the public and request immediate action by the OCM. § 121.010 PENALTIES ADMINISTRATION AND ENFORCEMENT Any violation of the provisions of this Chapter or failure to comply with any of its requirements constitutes a misdemeanor and is punishable as defined by law. Each day each violation continues or exists, constitutes a separate offense. Violations of this ordinance can occur regardless of whether or not a permit is required for a regulated activity listed in this ordinance. Violations of this Chapter may also be addressed under City Code, section 130.002 — Administrative Offenses. Ordinance No. 1025 Page 7 of 9 DOCSOPEN\MU210\317\1001615.v2-1/15/25 Violation of this Chapter shall be grounds for enforcement against any business license issued by the City of Mounds View § 121.011 SEVERABILITY If any section, clause, provision, or portion of this chapter is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of this chapter shall not be affected thereby SECTION 2. Section 505.03 of the Mounds View City Code is hereby amended by the addition of the bold and double underlined language and the deletion of the bold and StFielien language, as follows, and reorganization of Section 505.03 to insert the terms in the appropriate alphabetical order: Cannabis business has the same meaning as in Minnesota Statutes. section 342.01. Cannabis cultivation business - A business with a cannabis cultivator license. medical cannabis cultivator license, or cultivation endorsement from the State of Minnesota Office of Cannabis Management. Cannabis delivery business - A business with a cannabis delivery service license or delivery service endorsement from the State of Minnesota Office of Cannabis Management. Cannabis manufacturing business - A business with a cannabis manufacturer license. or manufacturing endorsement from the State of Minnesota Office of Cannabis Management. Cannabis retailer - A business with a cannabis retailer license, medical cannabis retailer license, lower -potency hemp edible retailer license, or retail endorsement from the State of Minnesota Office of Cannabis Management. Cannabis testing business - A business with a cannabis testing facility license or testing endorsement from the State of Minnesota Office of Cannabis Management. Cannabis transportation business - A business with a cannabis transporter license or transportation endorsement from the State of Minnesota Office of Cannabis Management. Cannabis wholesaling business - A business with a cannabis wholesaler license or wholesaling endorsement from the State of Minnesota Office of Cannabis Management. SECTION 3. Section 160.181 (B), B-2, Limited Business District — Permitted Uses, of the Mounds View City Code is hereby amended by the addition of the bold and double underlined language, as follows: (0) Cannabis Retailer, subiect to the requirements in City Code, section 121.008.
