Mayor Mueller stated due to the COVID-19 pandemic this meeting would be held virtually.

1 David Farrell, 7700 Bona Road, discussed the rain gardens that were installed in 2013 with the
2 street improvement project. He explained he now has a large hole in his yard that collects no
3 water from the street, except for the water from his driveway. He indicated tree roots were
4 growing up through the rain garden and stated he would like to see it filled in. He reported he
5 discussed this matter with staff and provided staff with photos of the rain garden.

7 City Administrator Zikmund stated he was familiar with this rain garden and noted Mr. Farrell
8 was a volunteer firefighter with the SBM Fire Department. He indicated he was working with the
9 Rice Creek Watershed District to see if there was an alternative. He commented well testing was
10 being completed, along with the numerics for the drainage.

12 Council Member Hull requested further information from staff on the progress that was being
13 made on this matter at a future workshop meeting. City Administrator Zikmund reported he
14 would provide the Council with a weekly update and noted rain gardens would be discussed at
15 the July workshop meeting.

17 Mayor Mueller discussed how the Rice Creek Watershed District had relaxed their rain garden
18 standards and hoped this change should assist staff with the request from Mr. Farrell. She
19 thanked Mr. Farrell for his service to the community and reported staff would continue to work
20 on this matter.

22 Public Works/Parks and Recreation Director Peterson stated he spoke with James Holman,
23 Mounds View's Engineering Technician, and noted measurements would be taken of the
24 driveway to better understand how much water was being taken into the rain garden. He
25 anticipated he would have an answer from the watershed district later this week.

27 Council Member Meehlhause asked if the City would have more control over the rain gardens
28 once it became an LGU. City Administrator Zikmund indicated this would not be the case.

30 7. SPECIAL ORDER OF BUSINESS
31 A. Chief Smith — Quarterly Fire Department Update.

33 Fire Chief Smith presented the Council with a quarterly update from the SBM Fire Department.
34 He discussed the night time volunteer crew that was being considered for Station 5. He noted the
35 Centennial Fire District requested a proposal from the SBM Fire Department and explained SBM
36 would now be providing services for the Centennial Fire District. He reported he would be
37 working on a contract to provide these services.

39 Council Member Meehlhause asked if this contract would be financial neutral or would there be
40 a slight positive impact on operating costs. Fire Chief Smith anticipated the department would
41 see a net profit from the contract.

43 Council Member Meehlhause questioned what the equipment requirements would be for Station
44 5 if a night time crew were created. Fire Chief Smith explained the equipment required would be
45 firefighting gears for the firefighters. He noted this would be a minimal cost to the department.

2 Finance Director Beer inquired what impact the night crew at Station 5 would have on Station 6.
3 Fire Chief Smith reported there would not be any impact, except for reducing response times.

5 Mayor Mueller questioned how large or what size area would be covered for the Centennial Fire
6 District. Fire Chief Smith indicated the department would be gaining two fire stations and
7 estimated area was four square miles. City Administrator Zikmund clarified that SBM would not
8 be taking over the Centennial Fire District, rather they were hiring SBM for two staff members
9 and administrative services. He indicated the Centennial Fire District would be covering
10 Centennial and SBM would be assisting with administrative coverage. He explained that SBM
11 trucks would not be responding to Centennial calls, except if mutual aid was requested.

13 Fire Chief Smith discussed recent training the department attended from MN Fire. He
14 commented on the importance of his firefighters having two sets of gear. He explained he
15 requested $1.9 million from the State for a Regional Public Safety Training Facility for police
16 and fire. He noted the organization was working on updating its strategic plan and all
17 stakeholders will be urged to contribute in this process. Planning for civil unrest was discussed in
18 further detail. He commented on the role of the duty chief for nights and weekends within the
19 department. He described how the department was responding to COVID requirements. Lastly,
20 he discussed the property that was being considered for Station 6.

22 Council Member Meehlhause asked if the SBM Fire Department has been eligible for any federal
23 or state COVID funding. Fire Chief Smith reported the first round was quite restrictive. He
24 noted some reimbursements were required and he thanked the City of Mounds View for their
25 generosity and assistance with this. He stated he was thankful the department did not incur any
26 additional costs during the pandemic.

28 Further discussion ensued regarding the departure of Deputy Fire Chief Maddison Zikmund and
29 how his position would be filled within the department.

31 Mayor Mueller asked when the Fire Chief would be coming before the Council next. Fire Chief
32 Smith anticipated he would be coming to the City Council in September.

34 Mayor Mueller thanked Fire Chief Smith for his presentation.

1 Council Member Meehlhause thanked the public for attending the Lions garage sale and for
2 supporting the Mounds View Police Foundation sale of brats and hot dogs. He commented
3 further on the Mounds View Police Foundation fundraiser that occurred at the Manitou Grill in
4 White Bear Lake. He thanked all of the residents that participated in the K-9 walk that was held
5 on Saturday, May 22na

7 Council Member Meehlhause proudly reported MnDOT now has two signs posted for Mounds
8 View Boulevard on US Highway 10.

10 Council Member Bergeron explained he attended a Nine North Cable meeting last week where
11 the group discussed production and the budget. He indicated David Rosenblum would be
12 retiring from Nine North. He commended Dana Healy for the changes she has implemented
13 since she became Director.

15 Mayor Mueller reported last Tuesday she attended a Ramsey County Dispatch meeting noting the
16 group discussed budgeting.
17
18 Mayor Mueller stated the Festival in the Park Committee met last Tuesday as well and this group
19 was still seeking volunteers to assist with planning this year's event. She commented further on
20 the schedule of events that were in place for Festival in the Park which would be held Friday,
21 August 201h and Saturday, August 215t
22
23 Mayor Mueller explained the North Metro Mayors group met last Wednesday and on Thursday
24 the Ramsey County League of Local Government Collective Workforce met to discuss mental
25 health issues.

27 Mayor Mueller reported the Minnesota Women in City Government Board of Directors met last
28 Friday to evaluate the April "MWCG Presents: Lessons Learned During the Pandemic Program"
29 panel discussion. The MWCG Board is currently planning their annual membership meeting that
30 is held during the LMC Annual Conference in June each year. MWCG Presents is planning a
31 special program in September regarding HR matters and a special presentation in November to
32 celebrate 101 years of Women's Suffrage. It was rescheduled from 2020 due to Covid-19)
33
34 Mayor Mueller stated May 25th would mark the one year anniversary of the tragic death of
35 George Floyd. She commented on the media coverage this event would be getting. She
36 discussed the crime rates in Minneapolis and understood crime was up everywhere in the metro
37 area.

39 Mayor Mueller reported she would be attending a Met Council Environmental Services Budget
40 meeting on Tuesday, May 251h

42 Mayor Mueller discussed the Back to the 50's car show event that was being planned for June
43 17th through June 20th at the State Fair grounds.

1 Council Member Meehlhause provided the Council with an update from the Twin Cities
2 Gateway Board. He noted Arden Hills was interested in joining this group.

4 B. Reports of Staff.

6 Community Development Director Sevald discussed several grant opportunities the City could
7 pursue for the beautification of the Mounds View Boulevard corridor. He indicated the City
s currently has no funding set aside for this. He questioned what the Council wanted to do long-
9 term with respect to the corridor.

1 1 Finance Director Beer reported MSA funds may be a possible funding source to assist with the
12 beautification of the Mounds View Boulevard corridor. City Administrator Zikmund clarified
13 $400,000 in MSA funds would be available in three years.

15 Community Development Director Sevald commented further on the grant opportunities
16 available to the City Council. It was noted one of the grants has a due date of June 1, 2021.

18 Council Member Hull asked if staff supported the City spending $2,000 on a grad student at this
19 time. Community Development Director Sevald reported the quality of the work completed by a
20 grad student would not be the same as the services that could be provided by Stantec.
21
22 Council Member Cermak indicated she did not support the City spending $2,000 for this work at
23 this time.

25 Council Member Meehlhause stated the Council may need to readdress the Mounds View
26 Boulevard corridor within the strategic plan at a future workshop meeting. He stated it was
27 important to have the County mowing the medians and picking up trash consistently.

29 Council Member Hull agreed it would benefit the Council to further discuss this matter prior to
30 spending funds on engineers.

32 Assistant City Administrator Beeman indicated he spoke with the County on Friday and
33 understood the County wants cities applying for their corridor update planning grants.

35 City Administrator Zikmund explained the Council could discuss this matter further at the July
36 workshop meeting. He stated there was a communication and safety component for the corridor.

38 Mayor Mueller agreed it would be prudent for the Council to discuss this matter further at the
39 July workshop meeting.

41 Council Member Meehlhause stated the plans that were done in 1998 and 2002 were before his
42 time of community involvement. He understood that the project was estimated to cost $25
43 million back then and would cost a great deal more today. He questioned if MSA funding could
44 be used for semi -four replacement. Finance Director Beer reported this would be allowed.

Finance Director Beer explained MWF was going to abandon the tax credits and was now
considering conduit debt for their project. He indicated this matter would be coming before the
Council on June 141h. It was noted the conduit debt would not be a responsibility of the City but
rather would be MWF's responsibility.
Assistant City Administrator Beeman stated a TIF letter of support for MWF would be
considered by the EDA on June 141h. He commented further on how this project had changed
noting Bauer and MWF had not come to an agreement on the two acre parcel. He explained this
meant only the 112 units of senior housing would be going forward at this time.
City Administrator Zikmund indicated all of these changes took place this week. He asked if the
Council wanted to keep an easement in place to provide access to the Bauer property. The
Council supported the City keeping an easement in place directing staff to speak with Bauer.
City Administrator Zikmund explained the Public Works staff was testing the Splash Down pad
system in order to prepare it for opening on Saturday, May 29th
Public Works/Parks and Recreation Director Peterson provided the Council with an update from
the Public Works Department. (DIRECTOR PETERSON'S AUDIO WAS DIFFICULT TO
HEAR).
Council Member Hull recommended Public Works/Parks and Recreation Director Peterson
provide the Council with an email update.
C. Reports of City Attorney.
City Attorney Riggs had nothing additional to report.

Introduction:
Staff is requesting that the City Council conduct a Revocation Hearing to consider the
revocation of Rental Licenses issued for two 6-unit apartment buildings, due to numerous
violations, dating back to January 2021, that have not been adequately corrected. The property
owner has failed to comply with numerous correction orders. It is Staff's opinion that the owner
is unable to manage the property, and that it is in the best interest of the tenants and the
community that the licenses be revoked.
If the City Council revokes the Rental Licenses, the tenants (11 units currently occupied) will
need to vacate the properties because an unlicensed rental property cannot be occupied by
tenants. A statewide eviction moratorium has been in place since March 23, 20201, and is in
effect until the termination of the Governor's Peacetime Emergency related to COVID-19. Staff
and the City Attorney will work to determine how to enforce any license revocation should the
council take that route.
Discussion:
2075 Hillview Road, and 2081 Hillview Road are six -unit apartment buildings owned by Thuy Thi
Bui since 2002. According to Thu Bui (pronounced Twee Boy), she has had difficulties
managing the properties since her partner's death in 2020.
The City renewed rental licenses for both properties in November, 2020. Annual licenses are
valid January 1st thru December 31st
In January, 2021, City inspectors found two persons living in a garage unit at 2075 Hillview
Road, and issued orders to vacate the garage. Staff conducted a thorough inspection of both
apartment buildings and garages pursuant to code requirements and found numerous
violations, and corrective orders were subsequently mailed in January, March, April, and May
2021. Numerous re -inspection occurred prior to each subsequent notice.
Violations at 2075 Hillview Road, include units #4, #5, #6, Laundry Room, garages, exterior
storage, and damage to an exterior wall due to a vehicle collision. An electrical fire occurred in
Unit 4 in April, 2021 (unit is presently condemned).
Violations at 2081 Hillview Road, include units #3, #4, #6, inoperable laundry appliances,
missing smoke alarms, exterior storage behind the garages, inoperable vehicles, cluttered
combustible materials in three garage units and unpermitted electrical work.
It is staff's opinion that the owner is unable to manage the properties or make necessary repairs
as required. The owner has regularly communicated with inspectors, but has failed most re -
inspections. Among other things, staff is concerned that if another fire were to occur, that the
tenants would be endangered.

In previous years, the properties had code violations (2013, 2015, 2017, and 2019), most
commonly related to exterior storage, trash & debris, and an unenclosed dumpster. In 2015,
more significant violations found related to interior water damage at 2081 Hillview Road.
Analysis:
A Rental Dwelling License is required, if units are to be occupied.Z A license may be
suspended, revoked, denied, or not renewed, if the property or license holder fails to comply
with corrective orders, or is found to be in violation of any other code provision.3 The City has
issued several corrective orders since January 2021, and most recently on May 19, 2021 (see
attached). Upon re -inspections, most corrections were not completed.
Notice of this Public Hearing, and a web link to this remote meeting was provided to Ms. Bui via
US mail, dated June 2, 2021. Staff received verbal confirmation from Ms. Bui on June 81h that it
was received.
A re -inspection is scheduled for Thursday, June 101h for compliance with the May 1911 corrective
orders. Staff will provide an update during the June 14th Council meeting (the outcome of this
inspection effects the blank numbered items in the Resolution).
Strategic Plan Strategy/Goal:
Increase community engagement while being sensitive to the changing demographics & their
needs and inclusive to all socioeconomic situations.
Financial Impact:
The City will incur legal costs to enforce the license revocation, and eviction process.
Recommendation:
Staff recommends that the 2021 Rental Licenses be revoked for 2075 Hillview Road, and 2081
Hillview Road, and that the properties be vacated in accordance with a timeline determined in
consultation with the City Attorney.
Once all required corrections and repairs are duly made and inspected, together with the
securing of any required permits related to such corrections and repairs, new rental license(s)
may be applied for.

are currently licensed by the City of Mounds View (the "City") to operate 12 rental dwelling
units in the two multi -family buildings located at 2075 Hillview Road and 2081 Hillview Road (
collectively, the "Rental Properties"). Since January of 2021, City staff has made numerous inspections
at said Rental Properties pursuant to its City-wide rental licensing program requirements.
Following those inspections, a total of ten corrective notices, five for each address, have
been mailed to you outlining numerous items that need to be corrected to ensure that the Rental
Properties are safe and otherwise meet City standards. Despite
the repeated corrective notices and numerous inspections conducted over the course
of the past five months, you have failed to comply with the City's requirements. Specifically,
as of the date of this letter, none of the corrections required in the City's most recent corrective
notices, which were mailed on May 20, 2021, have been made in accordance with City standards
and requirements, and the only permit that has been requested is for a water heater replacement.
In addition to those corrective notices, the City also sent you a separate letter on April
22, 2021 following a fire that started in Unit #4 of 2075 Hillview Road. The requirements set
forth in that letter have also not been adequately addressed. Copies of all three of the above - referenced
and most recent corrective notices are enclosed herewith for your reference. Mounds
View City Code, section 1012.05, subd. 2 allows the city council to revoke a rental dwelling
license if a licensee is in violation of the City's rental licensing requirements, including a
licensee's failure to correct deficiencies noted in City corrective notices. Based on your inability to
make the required corrections to the Rental Properties and your longstanding disregard of City requirements,
I will recommend to the city council that it revoke your rental dwelling licenses for the
Rental Properties unless all required corrections are deemed satisfied during the next inspections,
which are scheduled for June 10, 2021. Before any adverse action is taken in relation

RE: Inspection of 2075 HILLVIEW ROAD
To whom it may concern,
The property located at 2075 HILLVIEW ROAD was recently inspected for compliance with the City of
Mounds View Housing Maintenance Code, preparatory to renewal of the Multiple Dwelling License. The
following items present require corrective actions.
Garages
Housing - Fire Safety— (MSFC 304.1) Combustible Material. Combustible material creating a fire
hazard shall not be allowed to accumulate in buildings or structures or upon premises. Garages
1, 2, and 3 have cluttered combustible storage. Remove all items not in use for the
maintenance of the property. All items used in the maintenance of the property must be
stored in an orderly fashion in a single garage unit.
Laundry Room
Housing - Mechanical - Dryer Vent Repair or replace dryer vent. Exhaust ducts for domestic
dryers shall be constructed of metal and shall have a smooth interior finish. The exhaust duct
size shall be 4 inches nominal in diameter. Ducts shall not be joined with screws or similar
fasteners that protrude into the inside of the duct. (IMC 504.6) Remove all screws from
existing dryer ducting and replace with foil HVAC tape. Ensure all sections of ducting are
properly connected including at the back of the dryer.
Unit #4
This unit recently had a fire. The corrections below are in addition to the fire correction orders.
Housing - Structural — Doors. Repair and/or replace damaged door(s). (IPMC: 305.3) Repair the
front door frame at the strike plate, and replace all damaged trim on the interior side of door.
Housing - Structural — Floors, walls, and ceilings. Repair and/or replace damaged flooring, walls

hitting the outside of the building in 2020. Upon inspection in 2020 a crack to the exterior wall
was visible and a bid was received for repairs. According to the owner recommended repairs
were not performed. The crack was sealed and the wall covered with sheetrock. Interior wall
needs to be re -inspected, sheetrock will need to be removed at that time. A determination
will be made by the Housing Inspector and the Mounds View Building Official if a structural
assessment is warranted at that time. This work will co -inside with exterior wall repairs that
need to be made. An updated list of corrections will be issued by the Building Official.

dangers to the safety and well-being of children and other citizens. The accumulation and
outside storage of such vehicles is in the nature of rubbish, litter, and unsightly debris and is a
blight on the landscape and detriment to the environment. No person in charge or control of
any property within the City, whether as owner, tenant, occupant, lessee, or otherwise shall
store or keep abandoned, junk, and unsafe motor vehicles on private or public property.
Remove the Volkswagen Beetle license number (265VRN) from the property.
Garages
Housing - Fire Safety — Storage. Storage of combustible rubbish shall not produce conditions that
will create a nuisance or a hazard to the public health, safety or welfare. (MSFC 304.2) Garages
1, 2, and 3 have cluttered combustible storage. Remove all items not in use for the
maintenance of the property. All items used in the maintenance of the property must be
stored in an orderly fashion in a single garage unit.

wall a/c unit is not properly fit to the opening. It is held in place by flammable foam pieces.
Repair or replace as necessary to ensure proper fitment and finishing materials.

Premises in Violation: 2075 Hillview Rd Unit #4 — Revised Correction Notice
Ms. Bui,
This letter is issued to serve as notification that 2075 Hillview Rd, Unit #4 is condemned due to
damage to the unit sustained in a fire that occurred on afternoon of April, 19th, 2021. The
resulting damage from the fire has left the unit as uninhabitable under the following property
maintenance code until corrections and repairs can be completed.
Housing - Condemned — Unfit for human occupancy. A structure is unfit for human occupancy whenever
the code official finds that such structure is unsafe, unlawful or, because of the degree to which the
structure is in disrepair or lacks maintenance, is unsanitary, vermin or rat infested, contains filth and
contamination, or lacks ventilation, illumination, sanitary or heating facilities or other essential
equipment required by this code, or because the location of the structure constitutes a hazard to the
occupants of the structure or to the public. (PMCMV 108.1.3)
The following corrective actions must be taken before the unit can be re -occupied.
1) Housing - Electrical - Minimum Standard Electrical panels, wiring, switches and outlets must be
installed to meet the minimum requirements of the State Electrical Code (IPMC: 605.1)
After the fire the City has received reports of about electrical safety concerns throughout the
building. Based on those concerns and the concerns of the City regarding safety of all tenants
throughout the building we are requiring a full State permitted safety check inspection of all
electrical components in all units and common areas throughout the building. This permitted
work is to be completed by a licensed electrical contractor. Once it is determined what repairs
and corrections are to be made they must be completed by a licensed electrical contractor and
a final inspection signed off by the State Electrical Inspector.
2) Housing - Structural — Floors, walls, and ceilings. Repair and/or replace damaged flooring, walls
and/or Ceilings. (IPMC: 305.3)
Once all electrical work is completed. Repairs to damaged walls and ceiling can be done by a
licensed contractor. This work will require a Building Permit issued by the City of Mounds
View.

RESOLUTION REVOKING THE RENTAL LICENSES
FOR 2075 HILLVIEW ROAD AND 2081 HILLVIEW ROAD
WHEREAS, the City of Mounds View, Minnesota (the "City") administers rental
dwelling licensing to protect the public health, safety and welfare of the community, including
residents of rental dwellings, to ensure that rental housing is decent, safe and sanitary, and to ensure
that such housing is operated and maintained as not to become a nuisance to the neighborhood or
to become an influence that fosters blight and deterioration, or creates a disincentive to
reinvestment in the community; and
WHEREAS, the City issued a rental dwelling license pursuant to Mounds View City Code,
Section 1012 (the "Rental Licensing Ordinance") for a multi -family building (a single building
containing six rental units) located at 2075 Hillview Road ("2075 Hillview"); and
WHEREAS, the City also issued a rental dwelling license pursuant to the Rental Licensing
Ordinance for a second multi -family building (a single building containing six rental units) located
at 2081 Hillview Road ("2081 Hillview"); and
WHEREAS, the licenses issued for 2075 Hillview and 2081 Hillview (together, the
Rental Properties") are in the name of the owner of those properties, Thuy Thi Bui (the "Owner");
and
WHEREAS, since January 2021, City staff has made numerous inspections and re -
inspections at the Rental Properties pursuant to its rental licensing program requirements; and
WHEREAS, following all of those inspections and re -inspections, a total of ten corrective
notices, five for each of the two Rental Properties, were mailed to the Owner outlining numerous
corrective actions to ensure that the Rental Properties are safe and meet City standards; and
WHEREAS, Section 1012.05, subd. 2 of the Code provides that the City Council (the
Council") may revoke a rental license for "[f]ailure to correct deficiencies noted in a notice of
violation within the time specified in the notice" and "[a]ny other violation of [the rental licensing]
Chapter;" and
WHEREAS, due to the Owner's failure to correct deficiencies noted in the numerous
notices of violation within the times specified in the notices, the City provided notice and an
opportunity to be heard to the Owner, conducted such a rental license revocation hearing on June
14, 2021, and considered whether to take any action on the licenses previously issued to the Owner
for the Rental Properties; and

WHEREAS, following such revocation hearing, the Council hereby finds and determines
as follows:
a. The City issued to the Owner a rental dwelling license for 2075 Hillview Road that is set
to expire on December 31, 2021;
b. The City issued to the Owner a rental dwelling license for 2081 Hillview Road that is set
to expire on December 31, 2021;
c. On January 6, 2021, the City sent letters to the Owner regarding scheduled inspections at
both 2075 Hillview Road and 2081 Hillview Road, per the Rental Licensing Ordinance;
d. On January 25, 2021, the City sent a "no occupancy" posting to the Owner regarding 2081
Hillview Road, Garage #3, placarded the garage as unfit for human occupancy, and also
sent a correction notice to the Owner regarding 2075 Hillview Road and identified
corrective actions related to all six units and common areas;
e. On January 26, 2021, the City sent a correction notice to the Owner regarding 2081
Hillview Road and identified corrective actions related to all six units and common areas;
f. On January 29, 2021, the City sent a violation and trespass notice to the Owner regarding
2081 Hillview Road, Garage #3 regarding violations of the "no occupancy" posting and
January 25, 2021 placard;
g. On February 5, 2021, the City sent a correction notice to the Owner regarding 2081
Hillview Road, Garage #3, summarizing required work and continued no occupancy of
said garage;
h. On February 12, 2021, the City issued an administrative citation regarding the occupancy
of 2081 Hillview Road, Garage #3;
On March 1, 2021, following a re -inspection, the City sent updated correction notices to
the Owner regarding both 2075 Hillview Road and 2081 Hillview Road, and identified
corrective actions related to all units and common areas;
On March 1, 2021, the City also sent a second notice to the Owner regarding the unpaid
administrative citation related to 2081 Hillview Road, Garage #3;
k. On April 15, 2021, following another re -inspection, the City sent updated correction
notices to the Owner regarding both 2075 and 2081 Hillview Road and identified corrective
actions related to multiple units and common areas;
1. On April 19, 2021, a police report was filed regarding afire at 2075 Hillview Road, Unit
4;
in. On April 20, 2021, the City sent a correction notice to the Owner indicating that 2075

Hillview Road, Unit #4 was condemned due to damage sustained in a fire that unit was
uninhabitable under the city code until corrections and repairs can be completed and
identified corrective actions related to the installation of minimum standard electrical
panels, wirings, switches and outlets, and repair or replacement of damaged flooring, walls,
and ceilings;
n. On April 22, 2021, the City sent a revised correction notice to the Owner regarding 2075
Hillview Road, Unit #4 and the fire damage and required corrective actions;
o. On April 29, 2021, following another re -inspection, the City sent a correction notice to the
Owner indicating that 2081 Hillview Road was inspected for compliance and identified
corrective actions related to the following:
i. The exterior of 2081 Hillview Road, including actions related to rubbish
accumulation and abandoned, junk, or unsafe vehicles;
ii. The garages of 2081 Hillview Road, including actions related to storage and
installation of minimum standard electrical panels, wirings, switches and outlets;
iii. The laundry room of 2081 Hillview Road, including actions related to the dryer
vent repair or replacement, maintenance, and fire safety;
iv. 2081 Hillview Road, Unit #3, including actions related to maintenance, installation
of minimum standard electrical panels, wirings, switches and outlets, and fire
safety;
v. 2081 Hillview Road, Unit #4, including actions related to floors, walls, and ceilings,
maintenance, and structural repairs or replacements of doors;
vi. 2081 Hillview Road, Unit #6, including actions related to repair of plumbing
facilities;
p. On May 19, 2021, following another re -inspection, the City sent a correction notice to the
Owner indicating that 2075 Hillview Road was inspected for compliance and identified
corrective actions related to the following:
i. The garages of 2075 Hillview Road, including actions related to fire safety;
ii. The laundry room of 2075 Hillview Road, including actions related to the dryer
vent repair or replacement;
iii. 2075 Hillview Road, Unit #4, including actions related to structural repairs or
replacements of doors, floors, walls, and ceilings, and electrical repairs;
iv. 2075 Hillview Road, Unit #5, including actions related to maintenance;
v. 2075 Hillview Road, Unit #6, including actions related to repair or replacement of
floors, walls, and ceilings;
vi. The exterior of 2075 Hillview Road, including actions related to rubbish
accumulation and structural repairs or replacement related to missing or damaged
siding;
q. The April 29th and May 19th correction notices each notified the Owner of a follow-up
inspection scheduled for June 10, 2021 at 3:15 P.M. and warned the Owner that failure to
adequately address the required corrective actions would result in City staff s

recommendation of the revocation of rental licenses for the Rental Properties;
r. On June 2, 2021, the City sent another notice summarizing outstanding corrective actions
and again made clear that the Owner's failure to adequately address the required corrective
actions could result in revocation of the licenses;
s. An inspection occurred on June 10, 2021 and the Rental Properties remained in non-
compliance with the required corrective actions, including:
t. The owner has been provided adequate notice of the revocation hearing held by the City
Council on June 14, 2021 regarding the recommended revocation of the rental licenses for
failure to adequately address the required corrective actions listed in the notices and
numerous other issues related to the Rental Properties;
u. The Owner [did/did not] appear at the June 14, 2021 public hearing and [did/did not]
address the City's concerns;
v. The Owner [did/did not] submit anything in writing to the City for the hearing;
w. Adverse action regarding the licenses is appropriate as the Owner has violated the Rental
Licensing Ordinance on numerous occasions by failing to address numerous corrective
actions within the time specified in said notices;
x. When considering such a decision, Section 1012.03 of the Rental Licensing Ordinance
requires the Council to "give due regard to the frequency and seriousness of violations, the
ease with which such violations could have been remedied or avoided, and good faith
efforts to comply;"
y. Given the frequency and seriousness of violations, the ease with which such violations
could have been remedied or avoided, and the lack of the Owner's good faith efforts to
comply with correction notices, the Council determines it is appropriate to exercise its
authority under Section 1012 of the Code to revoke the rental licenses for both 2075
Hillview Road and 2081 Hillview Road. Additionally, the Council is cognizant of the fact
that one of the licensed units recently had a fire and, therefore, the Council is significantly
concerned for the safety and health of the residents of the Rental Properties. The decision

to revoke is not taken lightly, and for the reasons outlined above, such a decision is more
than justified under these circumstances.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Mounds
View, as follows:
Effective immediately, the rental dwelling license issued for the property located at 2075
Hillview Road (#2021-00202) , which was set to expire on December 31, 2021, is hereby
REVOKED. The revocation for said license applies to all parts and units of 2075 Hillview
Road.
2. Effective immediately, the rental dwelling license issued for the property located at 2081
Hillview Road (#2021-00203), which was set to expire on December 31, 2021, is hereby
REVOKED. The revocation for said license applies to all parts and units of 2081 Hillview
Road.
3. The Owner shall not be entitled to obtain new rental dwelling licenses for the subject
properties unless and until all required corrective actions are duly made in accordance with
the requests of City staff, and as otherwise required by the Rental Licensing Ordinance.
4. The City Council directs City staff and the City Attorney to take all actions to enforce this
resolution and its results, including, but not necessarily limited to, City Code, Section
1012.03, subd. 1, which states; "[n]o person shall allow to be occupied or let to another for
occupancy any rental dwelling unit unless the owner has first obtained a rental dwelling
license." Without a rental dwelling license, none of the dwelling units may be occupied.
City staff and the City Attorney shall remain aware of any state orders that might prevent
or limit the enforcement of this order and to the extent deemed advisable by the City
Attorney.

Introduction: The Mounds View City Council passed Ordinance 903, which amended Chapter
701 of the Code, to provide for limited and controlled raising and keeping of chickens and/or ducks
on properties zoned R-1, Single Family. Residents are limited to no more than eight chickens or
ducks restricted to only backyard areas. This Ordinance became effective on August 3, 2015.
Melinda Christensen has submitted an application to raise chickens on her property.
Discussion: The applicant, Melinda Christensen, has submitted an application to raise eight
chickens on her property located at 2085 Terrace Drive. The City requires that backyard areas within
which the chickens roam must be fenced. A site inspection conducted on May 18, 2021, indicated
that a fence exists enclosing the rear yard. The site plan submitted shows that the coop will have
the required minimum 20' setbacks from all property lines. It appears Ms. Christensen meets all
requirements under Ordinance 903.
In accordance with Ordinance 903, initial applications shall be considered by the City Council after
holding a public hearing. Approval of renewal applications are done administratively unless the City
has received substantial complaints or related violations have been documented during the previous
year.
Staff has published a public hearing notice in the May 25, 2021, edition of the Shoreview Press, the
City's official newspaper. In addition, as required, notices to residents within 350 feet of the subject
property were mailed on May 26, 2021.
Ms. Christensen has indicated that she will be present at the Zoom City Council Meeting/Public
Hearing.
Strategic Plan Strategy/Goal: Our ordinance and this application are consistent with the Vision
Statement, "...welcoming a desirable destination to all ages and cultures... and a place where
residents can live, work and play."
Financial Impact: None
Recommendation: Staff recommends opening this public hearing for public comment and
approval of Resolution 9429 approving a chicken/duck-keeping license for Melinda Christensen
This is an annual license, and if approved, will expire on December 31, 2021.

RESOLUTION APPROVING A CHICKEN/DUCK-KEEPING LICENSE FOR
MELINDA CHRISTENSEN, 2085 TERRACE DRIVE
WHEREAS, the City Council passed Ordinance 903, which amended Chapter 701
of the Municipal Code to provide limited and controlled raising and keeping of chickens
and/or ducks on properties zoned R-1, Single Family Residential; and
WHEREAS, Melinda Christensen has submitted an application with an approved
site plan and the appropriate fees to keep and raise chickens and/or ducks on her property
located at 2085 Terrace Drive; and
WHEREAS, Staff has reviewed the application and it appears to meet all
requirements set forth in Ordinance 903; and
WHEREAS, in accordance with Ordinance 903, initial applications shall be
considered by the City Council after holding a public hearing which was held June 14,
2021;
NOW, THEREFORE BE IT RESOLVED, that the Mounds View City Council does
hereby approve a Chicken/Duck-Keeping License for Melinda Christensen, 2085 Terrace
Drive, for no more than eight chickens or eight ducks or a combination of both;
BE IT FURTHER RESOLVED, that this license is effective from June 15, 2021 to
December 31, 2021.

on Monday, June 14, 2021 at 6:30 p.m. to consider a request from Melinda Christensen, for a

Mounds View Business License Renewals (excluding Liquor)
Introduction: In accordance with the Mounds View City Code, the business licenses
shown in Exhibit A require annual licensing. In addition, City Council approval is
required. The City of Mounds View issued licenses for these businesses effective July
1, 2020, and their renewals are before the City Council for consideration, as they will
expire June 30, 2021.
Discussion: All applicants have submitted their city business license application
materials and the applicable fees with the exception of Mounds View Little Caesar's #9.
Timeline of process/events:
03/25/2021 Staff sent by U.S. Mail initial letters for renewal with a deadline of 05/14
2021.
05/20/2021 Staff sent email to applicant indicating application was past due.
05/21/2021 Received a response from applicant asking me to send another application.
05/21/2021 Staff emailed an application and asked them to verify the email address as
another person responded versus what was on last year's application.
05/21/2021 Applicant said they received the application and advised she would be
talking with an "Andy" on Friday, it was now Wednesday.
05/21/2021 Staff sent another email informing them that I needed all materials by the
following Tuesday so that we could process the application in time for the
City Council packet.
05/26/2021 After no response on Tuesday, Staff sent follow-up email Wednesday,
May 26, asking verification they had received email. Staff inquired when
we would expect to receive their renewal materials. Staff has not heard
from them that week nor the following week.
06/09/2021 Staff called the phone number on last year's application and left a voice
mail message. Staff has not heard from them since nor have we received
their application.
Staff has had this issued for at least the last five years. They do not get their
application in until the end of June. Last year we received the application on June 30
expiration date) and payment in July. Staff recommends some type of punitive action.
The City conducted the following investigations and inspections to determine whether
there is cause for the City to consider denial of any of the other businesses shown in
Attachment A:

The following businesses are delinquent:
Moe's American Grill 2400 Mounds View Blvd. 115.50 (late fee)
R.J. Riches 2145 County Road H 1 $493.23
Ramsey County Property Taxation (Excluding Garbage Haulers)
as of June 8, 2021).
All property taxes are current.
Ramsey County Health Department (Restaurant, Food Licensing Service)
as of June 9, 2021).
It appears that Tony's Sandwich Shop has an issue with their Ramsey County Food
License. The applicant indicates they submitted and paid for their County license
renewal. However, when Staff contacted Ramsey County, they were unable to find a
record of it. Staff received a response from Ramsey County on June 8, 2021, indicating
that the applicant had paid for their County license but never submitted an application.
The County resent an application that day. Staff will continue to monitor this situation.
Fire Inspection (City of Mounds View Fire Inspector, excluding Garbage/Recycling
Haulers)
All properties were inspected for fire code violations. The following businesses failed their

orders.
Strategic Plan Strategy/Goal: Our licensing ordinance and its requirements along with the
renewal applications listed relate to our Vision Statement; "...welcoming a desirable destination
to all ages and cultures... and a place where residents can live, work and play safely" and by
approving the license renewals the City will "....maintain a positive business climate where
businesses want to locate and remain in Mounds View".

Financial Impact: None
Recommendation: Staff is recommending that the Council approve licenses for the
businesses listed in Resolution 9430 (Exhibit A) for the period from July 1, 2021 to June
30, 2022 contingent upon delinquent water/sewer bills being paid and all fire inspection
orders remedied.
In addition, Staff recommends approval of the restaurant license for Tony's Sandwich
Shop contingent upon verification of a Ramsey County Food License.
Staff also recommends some type of penalty or warning be given by the City Council to
the applicant of Mounds View Little Caesar's #9, PMD Growth Partners, LLC, for their
repetitive disregard for the City's licensing requirements. Mounds View City Code does
not address corrective actions regarding restaurant licensing. The City's fee schedule
allows penalty in the amount of 20 percent of the application if late. Staff does not
recommend approval of this license as no application or fee has been received as of June
10, 2021.
Staff (Administrator Zikmund) visited Little Caesars on June 10, 2021 at 11:30 am and
advised on -site manager license will be not be renewed.

Introduction: In accordance with Ordinance 951, a public hearing is no longer required for liquor
license renewals. The City of Mounds View issued liquor licenses for the subject businesses
effective July 1, 2019, and their renewals are before the City Council for consideration, as they will
expire June 30, 2021.
Discussion: All applicants have submitted their city liquor license application materials and the
applicable fees. The following investigations and inspections have been conducted to determine
whether there is cause for the City to consider denial of any of the above referenced liquor license
applications:

orders.
Strategic Plan Strategy/Goal: Our licensing ordinance and it requirements along with the renewal
applications listed relate to our Vision Statement; "...welcoming a desirable destination to all ages
and cultures... and a place where residents can live, work and play safely" and by approving the
license renewals the City will "....maintain a positive business climate where businesses want to
locate and remain in Mounds View".
Financial Impact: None.
Recommendation: Staff is recommending that the Council approve liquor licenses for the
businesses listed in Resolution 9431 (Exhibit A) for the period from July 1, 2021 to June
30, 2022. Speedway and Merwin Liquors' approval is contingent upon passing their fire
inspection and Moe's approval is contingent upon payment of any delinquent water/sewer
bills.

WHEREAS, all City of Mounds View's liquor licenses expire June 30, 2021; and
WHEREAS, all City of Mounds View liquor licenses must be approved by the City
Council; and
WHEREAS, Staff has received all pertinent application materials and fees from
those businesses shown in Exhibit A (attached); and
WHEREAS, all businesses shown in Exhibit A appear to meet the provisions of
Chapter 502 of the Mounds View Municipal Code entitled, "Intoxicating Liquor" or Chapter
503 entitled, "3.2 Percent Malt Liquor".
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council does
hereby approve Liquor License renewals for all businesses shown in Exhibit A pending a
satisfactory inspection report from the Mounds View Fire Inspector and all delinquent
utility bills being paid;

Item Title/Subject: Consideration of resolution 9432, a resolution relating to the issuance of
conduit revenue bonds to finance the costs of a multifamily housing development under
Minnesota statutes, chapter 462c; granting preliminary approval thereto; establishing
compliance with certain reimbursement regulations under the internal revenue code of 1986,
as amended; and taking certain other actions with respect thereto (skyline apartments project)
Introduction: Skyline Apartments, Limited Partnership, a Minnesota limited partnership (or
another entity to be formed by or affiliated with MWF Properties, LLC, the "Borrower") has
requested that the City of Mounds View, Minnesota ("Mounds View") issue up to $14,500,000
of tax-exempt, conduit Housing Revenue Bonds in one or more series in 2021 (the "Bonds") to
finance the acquisition, construction, and equipping of an approximately 112-unit rental
housing facility to be located at the property currently identified as 4849 and 3943 Old Hwy 8
in the City (the "Project Facilities").
Conduit revenue bonds give the borrower access to tax exempt financing so the borrower
realizes lower interest costs and the City achieves a public purpose, in this case the
construction of new affordable housing units. If authorized by the City Council, the Bonds will
be issued as conduit revenue bonds secured solely by the revenues derived from a loan
agreement (the "Loan Agreement") to be executed by Mounds View and the Borrower and
from other security provided by the Borrower. The lender or bondholders provide the funds for
the loan, either directly or through a trustee, and Mounds View assigns its rights and obligations
under the Loan Agreement to the lender or the trustee. No money actually flows through
Mounds View. No money or assets of Mounds View would ever be pledged or available to pay
the Bonds.
The Bonds will not constitute general or moral obligations of Mounds View and will not be
secured by or payable from any property or assets of Mounds View and will not be secured by
any taxing power of Mounds View. The Bonds will not affect any debt limitation imposed on
Mounds View and the issuance of the Bonds will not have any adverse impact on the credit
rating of Mounds View, even in the event that Borrower encounters financial difficulties with
respect to the Project Facilities to be financed with the proceeds of the Bonds.
The Bonds are proposed to be issued as tax-exempt obligations, the interest on which is
excluded from gross income for federal income tax purposes. However, because the Project
Facilities will be owned by a for -profit owner, the Bonds cannot be designated as "qualified tax-
exempt obligations" for purposes of Section 265(b)(3) of the Internal Revenue Code of 1986,

as amended (the "Code") which relates to a deduction available to banks and other financial
institutions (sometimes referred to as "bank -qualified bonds"). Because this type of Bond is
not eligible for designation as bank -qualified bonds, the Bonds will not count against Mounds
View's $10,000,000 limit in 2021 on its ability to designate its own bonds, if any, as bank
qualified bonds and issuing the Bonds in 2021 will have no impact on Mounds View's ability to
issue bank -qualified bonds in future years.
Because of the for -profit ownership of the Project Facilities, the Bonds will need an allocation
of bonding authority from the State. The amount of tax-exempt bonds for this purpose is limited
by federal tax-exempt bond law and that limit has not been sufficient for the amount of projects
seeking tax exempt bonds in Minnesota. Kennedy and Graven, as bond counsel, will prepare
all of the application documents.
In order to proceed, Mounds View would need to give preliminary approval in June. This would
not initially require a public hearing, instead the hearing would be held in 2021 after the
allocation of bonding authority has been received. Before issuing the Bonds, Mounds View
will need to hold a public hearing, adopt a resolution authorizing the issuance of the Bonds,
and execute various related documents, including the Bonds and the Loan Agreement.
Kennedy and Graven, as bond counsel, will provide forms of resolutions and all the necessary
documents.
The Borrower will be required to pay all the expenses of Mounds View paid or incurred with
respect to the Bonds and will be required to indemnify Mounds View for any potential liability
incurred by Mounds View with respect to the Bonds, the Project Facilities, and granting
necessary approvals.
Discussion: MWF Properties has indicated that the conduit bond is necessary for the project
to continue. A representative from Kennedy & Graven and MWF Properties will be present to
answer any questions the City Council may have.

RESOLUTION RELATING TO THE ISSUANCE OF CONDUIT REVENUE
BONDS TO FINANCE THE COSTS OF A MULTIFAMILY HOUSING
DEVELOPMENT UNDER MINNESOTA STATUTES, CHAPTER 462C;
GRANTING PRELIMINARY APPROVAL THERETO; ESTABLISHING

UNDER THE INTERNAL REVENUE CODE OF 1986, AS AMENDED;
AND TAKING CERTAIN OTHER ACTIONS WITH RESPECT THERETO

WHEREAS, the City of Mounds View, Minnesota (the "City") is a home rule charter city duly
organized and existing under the Constitution and laws of the State of Minnesota.
WHEREAS, pursuant to Minnesota Statutes, Chapter 462C, as amended (the "Act'), the City is
authorized to carry out the public purposes described in the Act by providing for the issuance of revenue
bonds to provide funds to finance or refinance multifamily housing developments located within the City.
WHEREAS, as a condition to the issuance of such revenue bonds, the City must adopt a housing
program providing the information required by Section 462C.03, subdivision 1 a, of the Act (the "Housing
Program"). Under Section 462C.04, subdivision 2, of the Act, a public hearing must be held on the Housing
Program after one publication of notice in a newspaper circulating generally in the City, at least 15 days
before the hearing.
WHEREAS, Skyline Apartments, Limited Partnership, a Minnesota limited partnership (or another
entity to be formed by or affiliated with MWF Properties, LLC, the "Borrower"), has proposed that the City,
pursuant to the Act, issue its revenue bonds in an aggregate principal amount not to exceed $14,500,000,
in one or more series at one time or from time to time (the "Bonds"), the proceeds of which will be loaned
by the City to the Borrower to be applied by the Borrower to (i) finance the acquisition, construction, and
equipping of an approximately 112-unit rental housing facility to be located at the property currently
identified as 4849 and 3943 Old Hwy 8 in the City (the "Project'); (ii) fund one or more reserve funds to
secure the timely payment of the Bonds; and (iii) pay certain costs of issuing the Bonds.
WHEREAS, under Section 147(f) of the Internal Revenue Code of 1986, as amended (the "Code"),
prior to the issuance of the Bonds a public hearing duly noticed must be held by the City Council.
WHEREAS, under Section 146 of the Code, the Bonds must receive an allocation of the bonding
authority of the State of Minnesota. An application for such an allocation must be made pursuant to the
requirements of Minnesota Statutes, Chapter 474A, as amended (the "Allocation Act').
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View, Minnesota
the "Council"), as follows:
Section 1. Preliminary Findings. Based on representations made by the Borrower to the City to
date, the Council hereby makes the following preliminary findings, determinations, and declarations:
a) The Project consists of the acquisition, construction, and equipping of a multifamily rental
housing development designed and intended to be used for rental occupancy.

b) The proceeds of the Bonds will be loaned to the Borrower and the proceeds of the loan will
be applied to: (i) the acquisition, construction, and equipping of the Project; (ii) the funding of one or more
reserve funds to secure the timely payment of the Bonds; and (iii) the payment of the costs of issuing the
Bonds. The City will enter into a loan agreement (or other revenue agreement) with the Borrower requiring
loan repayments from the Borrower in amounts sufficient to repay the loan when due and requiring the
Borrower to pay all costs of maintaining and insuring the Project, including taxes thereon.
c) In preliminarily authorizing the issuance of the Bonds and the financing of the acquisition,
construction, and equipping of the Project and related costs, the City's purpose is to further the policies of
the Act.
d) The Bonds will be limited obligations of the City payable solely from the revenues pledged
to the payment thereof, and will not be a general or moral obligation of the City and will not be secured by
or payable from revenues derived from any exercise of the taxing powers of the City.
Section 2. Public Hearing. The City will conduct a public hearing on a date to be determined by
the City Administrator in order to meet publication requirements in accordance with applicable law, on the
Housing Program, the Project, and the issuance of revenue Bonds by the City, notice of which hearing in
substantially the form attached as Exhibit A (the "Public Notice") will be published as required by Minnesota
Statutes, Section 462C.04, subdivision 2, of the Act, and Section 147(f) of the Internal Revenue Code of
1986, as amended. City staff is hereby authorized to cause the publication of the Public Notice in
accordance with applicable law. The Public Notice will provide a general, functional description of the
Project, as well as the maximum aggregate face amount of the obligations to be issued for the purposes
referenced above, the identity of the initial owner, operator, or manager of the Project, and the location of
the Project. The Public Notice is authorized to be published in a newspaper circulating generally in the City
on a date at least 15 days before the meeting of the City Council at which the public hearing will take place.
At the public hearing reasonable opportunity will be provided for interested individuals to express their
views, both orally and in writing, on the Project and the proposed issuance of such revenue obligations.
Section 3. Housing Program. Bond counsel, as described below, shall prepare and submit to the
City a draft Housing Program to authorize the issuance by the City of up to $14,500,000 in revenue Bonds
to finance the acquisition, construction, and equipping of the Project by the Borrower. City staff is hereby
authorized to review, approve and submit the Housing Program to the Metropolitan Council for its review
on or before the date of publication of the Public Notice.
Section 4. Preliminary Approval. The City Council hereby provides preliminary approval to the
issuance of the Bonds in the approximate aggregate principal amount of $14,500,000 to finance all or a
portion of the costs of the Project pursuant to the Housing Program of the City, subject to: (i) review of the
Housing Program by the Metropolitan Council; (ii) receipt of an allocation of the bonding authority from the
State of Minnesota; (iii) a public hearing as required by the Act and Section 147(f) of the Code; (iv) final
approval following the preparation of bond documents; and (v) final determination by the City Council that
the financing of the Project and the issuance of the Bonds are in the best interests of the City.
Section 5. Submission of an Application for an Allocation of Bonding Authority. Under Section 146
of the Code, the Bonds must receive an allocation of the bonding authority of the State of Minnesota. An
application for such an allocation must be made pursuant to the requirements of the Act. The City Council
hereby authorizes the submission of an application for allocation of bonding authority pursuant to Section
146 of the Code and the Allocation Act in accordance with the requirements of the Allocation Act. The
Mayor of the City, the City Administrator, and Kennedy & Graven, Chartered, acting as bond counsel with
respect to the Project and the Bonds, are each individually hereby authorized and directed to take all
actions, in cooperation with the Borrower, as are necessary to submit an application for an allocation of
bonding authority to Minnesota Management & Budget.

Section 6. Reimbursement of Costs under the Code.
a) The United States Department of the Treasury has promulgated regulations governing the
use of the proceeds of tax-exempt bonds, all or a portion of which are to be used to reimburse the City or
the Borrower for project expenditures paid prior to the date of issuance of such bonds. Those regulations
Treasury Regulations, Section 1.150-2) (the "Regulations") require that the City adopt a statement of
official intent to reimburse an original expenditure not later than 60 days after payment of the original
expenditure. The Regulations also generally require that the bonds be issued and the reimbursement
allocation made from the proceeds of the bonds occur within 18 months after the later of: (i) the date the
expenditure is paid; or (ii) the date the project is placed in service or abandoned, but in no event more than
3 years after the date the expenditure is paid. The Regulations generally permit reimbursement of capital
expenditures and costs of issuance of the bonds.
b) To the extent any portion of the proceeds of the Bonds will be applied to expenditures with
respect to the Project, the City reasonably expects to reimburse the Borrower for the expenditures made
for costs of the Project from the proceeds of the Bonds after the date of payment of all or a portion of such
expenditures. All reimbursed expenditures shall be capital expenditures, a cost of issuance of the Bonds,
or other expenditures eligible for reimbursement under Section 1.150-2(d)(3) of the Regulations and also
qualifying expenditures under the Act.
c) Based on representations by the Borrower, other than (i) expenditures to be paid or
reimbursed from sources other than the Bonds, (ii) expenditures permitted to be reimbursed under prior
regulations pursuant to the transitional provision contained in Section 1.150-20)(2)(i)(B) of the Regulations,
iii) expenditures constituting preliminary expenditures within the meaning of Section 1.150-2(f)(2) of the
Regulations, or (iv) expenditures in a "de minimus" amount (as defined in Section 1.150-2(f)(1) of the
Regulations), no expenditures with respect to the Project to be reimbursed with the proceeds of the Bonds
have been made by the Borrower more than 60 days before the date of adoption of this resolution of the
City.
d) Based on representations by the Borrower, as of the date hereof, there are no funds of the
Borrower reserved, allocated on a long term -basis or otherwise set aside (or reasonably expected to be
reserved, allocated on a long-term basis or otherwise set aside) to provide permanent financing for the
expenditures related to the Project to be financed from proceeds of the Bonds, other than pursuant to the
issuance of the Bonds. This resolution, therefore, is determined to be consistent with the budgetary and
financial circumstances of the Borrower as they exist or are reasonably foreseeable on the date hereof.
Section 7. Costs. The Borrower will pay the administrative fees of the City and pay, or, upon
demand, reimburse the City for payment of, any and all costs incurred by the City in connection with the
Project and the issuance of the Bonds, whether or not the Bonds are issued.
Section 8. Commitment Conditional. The adoption of this resolution does not constitute a
guarantee or a firm commitment that the City will issue the Bonds as requested by the Borrower. If, as a
result of information made available to or obtained by the City during its review of the Project, it appears
that the Project or the issuance of Bonds to finance or refinance the costs thereof is not in the public interest
or is inconsistent with the purposes of the Act, the City reserves the right to decline to give final approval to
the issuance of the Bonds. The City also retains the right, in its sole discretion, to withdraw from
participation and accordingly not issue the Bonds should the City Council, at any time prior to the issuance
thereof, determine that it is in the best interests of the City not to issue the Bonds or should the parties to
the transaction be unable to reach agreement as to the terms and conditions of any of the documents for
the transaction.
Section 9. Effective Date. This Resolution shall be in full force and effect from and after its
passage.

NOTICE IS HEREBY GIVEN that the City Council of the City of Mounds View, Minnesota (the
City") will meet on Monday, , 2021 at 7:00 p.m. in the City Hall at 2401 Mounds View Boulevard
in the City for the purpose of conducting a public hearing on (i) a proposal of Skyline Apartments, Limited

Introduction:
Belden River Properties, LLC, requests Final Plat approval for four single-family lots (one
existing home), located at 3032 County Road I. This is the southeast intersection of County
Road I and Pleasant View Drive, on the western edge of the city.
Discussion:
Currently, the existing house (Lot 1) has Mounds View sewer, and a private well. Lots 2, 3, and
4 will have sewer/water through Fridley. At some point, the City will reconstruct County Road I
and Pleasant View Drive. At that time, Lot 1 will need to connect to city water.

Traffic: Lots 2, 3, & 4 will have driveways onto Pleasant View Drive.
Utilities: Lot 1 (existing house) is served by private well and Mounds View
sewer. This house is not required to connect to municipal water
because Lot 1 is not adjacent to a water main.3 Staff is
recommending a Condition of Approval requiring Lot 1 to connect
to municipal water, once it is available.
Lots 2, 3, and 4 will be served by Fridley (sewer & water). Fridley
will assess the owner for a sewer/water connection charge.
Drainage: Rice Creek Watershed District (RCWD) has granted a conditional
permit (CAPROC).
Lots 2, 3, & 4 will include a storm water infiltration basin,
approximately 60' X 120' (bottom of basin on Lots 3 & 4). The
basin looks large because it handles storm water from County
Road I and Pleasant View Drive (no curb on County Road 1). The
basin is to be maintained by the property owners. The developer
is suggesting that the City maintain this basin because it serves
the street, and not just the four lots. The Council may wish to
discuss.
Community Facilities: N/A
Public Safety: There are four fire hydrants within 600' of the development.
Neighboring Land Uses: The development is in a single-family neighborhood.
Natural Features: The property is heavily wooded. Almost all of the trees will be
removed because of the need to raise the house pads, and
accommodate the storm water infiltration basin. Trees will be
maintained along the project perimeter, and on Lot 1
Open Space: The lots exceed the minimum lot size.
Comprehensive Plan: The property is guided for single-family detached homes.
Strategic Plan Strategy/Goal:
Continue BR&E program, maximize utilization of development space and current list of available
sites, encourage land owners to maintain their properties, & consider residential development.

Planning Commission Recommendation:
The Planning Commission does not review Final Plats unless there are significant changes
since the Preliminary Plat approval (there are none).
Staff Recommendation:
Staff recommends approval of the Final Plat.
A Public Hearing was held for the Preliminary Plat on March 8, 2021. At that time, resident's
expressed concerns about; small lot sizes (compared to neighboring lots); increased traffic;
affordable housing, loss of trees, and displaced wildlife.

RESOLUTION APPROVING THE FINAL PLAT OF BELDEN RIVER VIEW
Planning Case MA2021-001)
WHEREAS, the applicant, Kelly Wilson, (Belden River Properties, LLC), is requesting
Final Plat approval of a Subdivision, located at 3032 County Road I, legally described as:
PID: 07-30-23-22-0029
Lots 55 and 56, Spring Lake Park Knolls, Ramsey County, Minnesota
WHEREAS, a Subdivision Application and Preliminary Plat were submitted on January
12, 2021, and determined to be complete as of February 5, 2021. Plans were distributed by Staff

WHEREAS, Staff reviewed the Preliminary Plat dated February 4, 2021, and Site
Development Plans, dated February 4, 2021, finding it to be consistent with requirements of the
Mounds View Municipal Code. The Mounds View Planning Commission reviewed the
Preliminary Plat at its March 3, 2021 meeting, recommending approval (Resolution 1130-21).
The City Council held a duly noticed Public Hearing on March 8, 2021, approving the
Preliminary Plat (Resolution 9405); and,
WHEREAS, Staff reviewed the Final Plat received March 19, 2021, Title Commitment,
dated March 21, 2021, and most current Final Plat received June 4, 2021, finding them to be
consistent with the approved Preliminary Plat, City Code, Comprehensive Plan, and Plat
Opinion. Comments were received from;

NOW, THEREFORE, BE IT RESOLVED, the Mounds View City Council, hereby
Approves the Final Plat of Belden River View, with the following conditions:
Approval of this Final Plat is subsequent upon approval for water/sewer supply. The
Developer shall obtain sewer/water permits from the City of Fridley (Lots 3, 4, & 5), and
comply with requirements stated in Fridley's Public Works Director's letter, dated
February 17, 2021.
2. The Developer shall comply with all requirements of the Mounds View City Engineer's
letter, dated January 21, 2021.
3. The Developer shall comply with all requirements of the Rice Creek Watershed District.
4. The Developer shall satisfy all requirements made by the City Attorney as stated in the
Plat Opinion, or as amended by the City Attorney.
5. Upon Final Plat approval, the Developer shall sign a Development Agreement.
6. Upon Final Plat approval the Developer shall reimburse the City for review fees by the
City Attorney, City Engineer, and any consultants.
7. Upon Final Plat approval, the Developer shall pay a Park Dedication Fee of $3,500 per
lot, with credit for one lot ($10,500 total).
8. Prior to recording the Plat with Ramsey County, the Developer shall provide an updated
and certified Abstract of Title and/or Registered Property Abstract as required by Minn.
Stat. § 505.03, or in the alternative, the Developer must provide a Commitment for a Title
Insurance Policy for the Property naming the City as the proposed insured and with the
amount of coverage for this policy being equal to $100,000.00.
9. The Owner of Lot 1 (3032 County Road I) acknowledges that Mounds View City Code
generally requires new and existing buildings to be connected to the municipal water
system if a municipal water main is constructed adjacent to such property. The Owner
acknowledges and agrees that it shall connect to the City's municipal water system if and
when a municipal water main adjacent to the Property becomes accessible to the
Property. The Owner further acknowledges and agrees that it shall abide by any and all
City's requirements related to connections to the municipal water system.
10. The Developer shall remove or relocate the shed and pergola on Lot 1 and Lot 3, such
that any relocation is compliant with zoning setbacks.
11. The Developer shall burry all overhead utilities.

Background / Discussion:
During regular cleaning and inspection of the sanitary sewer system, Staff discovered
several manholes that require repairs due to cracking which is allowing infiltration/ground
water to enter the system.
Staff contacted two contractors to provide proposals for the repairs on the manholes. The
repairs include power washing, removing old motor, sealing all joints and lining of the
manhole structures.
Staff received proposals for the repairs as follows:
Thul Specialty Contracting Inc.- (4 manholes) $17,230.00
Innovating High Performance Costings (3 manholes) $12,823.00
The funding for these repairs is budgeted in the Sanitary Sewer fund, which includes
30,000.00 for the sewer pipe re -lining program.
Strategic Plan Strategy/Goal: Maintain and Plan for Infrastructure Improvements.
Financial Impact: No Impact to the 2021 Budget as repairs are budgeted, Sanitary
Sewer Fund, 730-4823-7050, for these necessary repairs.
Recommendation:
Staff recommends approval and authorization for Thul Specialty Coatings of Elk River,
MN for $17,230.00 to repair the sanitary sewer manholes as proposed in the quote dated
June 2021 from 730-4823-7050. It should be noted that Thul Specialty has performed
many repairs for the City; their craftsmanship and product has responded very well to our
system.

Fee Schedule Regarding Mobile Food Units
Introduction:
Staff reviews the Mounds View fee schedule on an annual basis to keep pricing and fees
current. However, often times there is a need to amend the fee schedule more than just
once a year.
Discussion:
Over the past few months, the City of Mounds View has received a significant increase
in inquries and requests for mobile food units (MFU)/food trucks in the City. As the City
Code and Fee Schedule does not specifically address MFU's, as well as ice cream
trucks, Staff sees the need to amend the fee schedule at this time to address the
upcoming summer season. The City currently uses the fee schedule for transient
merchants/peddlers for MFU's but these fees are not comparible.
Staff recommends adding the following fees to the 2021 City of Mounds View Fee
Schedule:
Mobile Food Unit (MFU) 25 per day
100 per ten (10) days
200 per thirty (30) days
400 per year
Ice Cream Truck/Street Vending 20 per day
100 per year
Staff is also in the process of amending the City Code to include MFU's and ice
cream/street vending. That ordinance will be brought before the City Council at a future
meeting.
Recommendation: Staff recommends approval of Resolution 9436, a resolution
approving an amendment to the 2021 Fee Schedule regarding mobile food units and ice
cream/street vending trucks.
