PUBLIC COMMENT Celena Monn, 2357 Sherwood Road, explained she has lived in Mounds View for the past 23 years. She stated she enjoys living in this community and believed this was a beautiful place to live. She reported she was involved in the community and hosts block parties on an annual basis. She indicated she wants everyone to love this City as much as she does, while also feeling welcome and heard. She discussed the numerous plans the City has in place for its parks, streets and to address its sustainability efforts. She encouraged the City to consider becoming more aware and equitable of its community members. She commented on May 28, 2021 she sent the City Council an email regarding equity and inclusion. She discussed how the population of Mounds View was changing as the schools now had 50% people of color and 40% of its students received free and Mounds View City Council June 28, 2021 Regular Meeting Page 2 1 reduced lunch. She commented on an event that occurred 15 years ago with her father at her 2 daughter's school and stated she wanted to see the City more actively addressing the racial 3 problems in the community. 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 Mayor Mueller stated the Council welcomed these comments and stated she would be responding to Ms. Monn individually after the meeting. She reported the Council has met with five different speakers to explore the topic of diversity. She indicated there was much more to come regarding this topic and she understood there were improvements that could be made. She thanked Ms. Monn for sharing her experiences and concerns with the Council. 7. SPECIAL ORDER OF BUSINESS None. 8. COUNCIL BUSINESS A. Public Hearing: First Reading and Introduction of Ordinance 976, an Ordinance Adopting the Recodification of the Mounds View Municipal Code and Updating the City of Mounds View's 2021 Fee Schedule. Assistant City Administrator Beeman requested the Council introduce an Ordinance that would recodify the Mounds View Municipal Code while also updating the City's 2021 fee schedule. He reviewed the proposed changes in detail with the Council and recommended introduction of the Ordinance. Mayor Mueller opened the public hearing at 7:06 p.m. Hearing no public input, Mayor Mueller closed the public hearing at 7:07 p.m. MOTION/SECOND: Hull/Bergeron. To Waive the First Reading and Introduce Ordinance 976, an Ordinance Adopting the Recodification of the Mounds View Municipal Code and Updating the City of Mounds View's 2021 Fee Schedule. Council Member Meehlhause thanked staff for moving the fees to the fee schedule versus having this information within the Ordinance. He stated this was the right direction for the City to move in. This item was removed from the agenda. C. Resolution 9437, Approving Lease Amendments to the Water Tower Site Lease Agreements for T-Mobile and Sprint. Mounds View City Council June 28, 2021 Regular Meeting Page 3 2 Public Works/Parks and Recreation Director Peterson requested the Council approve lease 3 amendments to the water tower site lease agreements for T-Mobile and Sprint. He reported T- 4 Mobile would be merging with Sprint. He discussed the terms within the T-Mobile lease which 5 began in 2016, noting all equipment at the base of the water tower had to be removed. He 6 commented further on the proposed amendments within the lease and recommended approval. 7 8 Finance Director Beer explained until the merger is final, the two companies have to act as separate 9 entities. 10 11 Council Member Meehlhause questioned how much the City received from the T-Mobile and 12 Sprint leases. Finance Director Beer commented the City received $30,000 from T-Mobile and 13 $27,000 from Sprint each year. 14 15 MOTION/SECOND: Meehlhause/Bergeron. D. Resolution 9438, Approving a Contract with Rainbow Treecare for the (EAB) Emerald Ash Borer Injection Program. Public Works/Parks and Recreation Director Peterson requested the Council approve a contract with Rainbow Treecare for the Emerald Ash Borer (EAB) injection program. He discussed how EAB migrated into the community over the past five years and noted the Department of Agriculture has required the City to create an EAB program. He reported this topic was reviewed by the Park, Recreation and Forestry Commission and proposed going out to bid for EAB tree injections. Staff commented further on the proposed program and recommended approval of the EAB contract with Rainbow Treecare. Council Member Meehlhause asked if there was an issue of having a City contracting with a service provider and allowing them to use the City logo. City Attorney Riggs explained this was a fairly routine practice and shows there was an approved process in place for this type of work. Mayor Mueller asked if the City had an opportunity to provide input to the design, printing and the mailing of the co -branded flyers. Public Works/Parks and Recreation Director Peterson reported the City would review these flyers each year before being sent out to residents in Mounds View. Mayor Mueller commented she was uncomfortable with having the City logo on this flyer, especially given the experience the City had with the service line warranty letters that were sent out. She questioned if the logo was used on this mailing, if other all City consultants could use the City logo for their mailings. Public Works/Parks and Recreation Director Peterson stated this was not the case. City Attorney Riggs indicated this was something the Council was approving as a joint effort. Mounds View City Council June 28, 2021 Regular Meeting Page 4 2 Mayor Mueller asked if the logo was not allowed if the discount would not be offered to Mounds 3 View residents. Public Works/Parks and Recreation Director Peterson explained the discount 4 would still be offered but Rainbow Treecare was finding in other cities that without the partnership 5 they were having fewer clients and more ash trees were dying. 6 7 Council Member Meehlhause discussed the agreement with the service line warranty company. 8 He stated three mailings were allowed per year and this was where the issue came into play. He 9 explained the feeling at the time was that the average resident was not aware of their responsibility 10 for the sewer line. He stated he did not have a problem with this request given the fact there were 11 residents in Mounds View that had ash trees that needed injections. 12 13 MOTION/SECOND: Bergeron/Meehlhause. Resolution 9439, Accepting Improvements and Approving Final Payment for 20 HVAC upgrades and replacements at the Community Center, City Hall and 21 Public Works Facilities. 22 23 Public Works/Parks and Recreation Director Peterson requested the Council accept improvements 24 and approve final payment for HVAC upgrades and replacements at the Community Center, City 25 Hall and Public Works facilities. He discussed the improvements that were completed through the 26 use of CARES Act funds. The project costs were reviewed with the Council and staff 27 recommended approval of the final payment. 28 29 MOTION/SECOND: Meehlhause/Hull. REPORTS 38 A. Reports of Mayor and Council. 39 40 Council Member Bergeron stated it was nice to be holding this meeting in person. He commented 41 the July NineNorth Commission meeting would be live and in person. 42 43 Council Member Meehlhause reviewed the May financials from Twin Cities Gateway with the 44 Council. Mayor Mueller reported the Festival in the Park Committee was working diligently to plan this year's event. She noted a medallion hunt has been added this year, along with an accident/rescue demonstration from Mounds View Police, Allina, SBM Fire and Life Link. She requested Nine North film this event. She explained the Festival in the Park Committee was still seeking volunteers and those interested should contact her for further information. She then reviewed the schedule of events for this year's festival which was scheduled for Friday, August 19, 2021 and Saturday, August 20, 2021. Mayor Mueller indicated she virtually attended the League of Minnesota Cities annual conference last week and discussed the session she participated in. She explained the 2022 LMC conference will be held in Duluth, Minnesota. Mayor Mueller encouraged residents to visit the splash pad. B. Reports of Staff. Finance Director Beer reported Metro INET has posted for the Executive Director position and would be filled as soon as possible. This person would be in charge of transitioning employees away from the City of Roseville to Metro INET. Finance Director Beer explained at the joint Charter Commission/City Council meeting the Charter Commission asked for an updated model on what the amount would need to be in order for the City to have a balanced budget. He explained this would be about 4.5% each year, with an additional 2%. He commented further on the vote that would be required to change the levy percentage. Assistant City Administrator Beeman discussed the items the Council would be addressing at the July worksession meeting. Finance Director Beer(?) provided the Council with an update on the status of the Water Treatment Plant — Phase I. C. Reports of City Attorney. City Attorney Riggs had nothing additional to report. 10. All monetary figures, e.g. dollar amounts for fees and fines, are proposed to be replaced with the phrase "as approved by ordinance", and are proposed to be included in the City's fee schedule moving forward. Said fee schedule is adopted annually by the City and so moving forward, changes to said monetary figures would efficiently occur by amending the fee schedule rather than by amending various sections of the Code. For that same reason, it is further proposed that those instances where the phrase "as approved by resolution" appears be replaced with "per the City's approved fee schedule." 4. To maintain consistency throughout the City Code, certain titles or departments are proposed to be renamed to establish consistency with current city titles and departments. Although other clean-up might have occurred, said amendments include the following: a) The terms City Administrator, City Clerk and City Clerk -Administrator are proposed to be replaced with the term City Administrator. b) The terms Finance Director/Treasurer and Treasurer are proposed to be replaced with Finance Director. c) The terms Park and Recreation Department, Parks or Recreation Division are proposed to be replaced with Parks and Recreation Department. d) The terms Public Works Director or Public Works Director/City Engineer are proposed to be replaced with Director of Public Works/Parks and Recreation. e) All references to zoning district designations are proposed to include a hyphen between the letter and number (for example, R-1, R-2, etc.). f) The terms Building Official or Building Inspector are proposed to be replaced with the term Authority Having Jurisdiction. g) All references to the Redemption Fund are proposed to be replaced with the term Debt Service Fund. The current Code provisions related to City repairs of water service line leaks in section 906.06 are proposed to be amended to specify in more detail when such repairs may be made. 8. A new section 51.011 regarding unsafe water connections is proposed to be added to the Code to prohibit and prevent backflow and/or contamination of the City's water system. 9. The sewer construction requirements are proposed to be amended to update said requirements to current standards. 10. The current Code reference to disorderly conduct, i.e. disturbing the peace, is proposed to be removed due to recent case law and general inclusion of such violations in state law. 11. The peddlers and solicitors chapter is proposed to be amended to clarify that persons engaging in door-to-door advocacy are not required to obtain a permit or register with the city as a solicitor. 12. The City's curfew chapter is proposed to be amended to establish certain bona fide exceptions to the city's curfew. It also is proposed to include certain responsibilities on parents and guardians of minors and on operators of places of amusement, entertainment, or refreshment related to such curfews. 13. The following amendments are proposed to be made to the city's zoning regulations: (i) section 1103.10 of the current code related to smoke, dust, and odors is proposed to be revised to only reference the requirements in Minnesota Rules Chapters 7001 through 7028, as amended; (ii) section 1103.11 of the current code related to noise is proposed to be revised by replacing the 2 reference to Minnesota's NPC 1-4 Regulations with a reference to the requirements in Minnesota Rules Chapter 7030, as amended; (iii) the 120-square-foot threshold in section 1106.03, subd. 1(b) of the current code related to accessory building separation requirements in the R-1 district is proposed to be modified to a 200-square-foot threshold; (iv) the one -person threshold for boarding or renting of rooms as an allowed accessory use in the R-1 district, contained in section 1106.03, subd. 6 of the current code, is proposed to be increased to a two -person threshold; and (v) the illustrations related to accessory dwelling units in the R-1 district, contained in sections 1106.03 and 1106.04 of the current code, are proposed to be replaced with revised illustrations to better depict the code requirements. 14. The city's fire regulations are proposed to be updated to add the following definition for "limiting access" in regard to ignition devices: "Limiting access means placing ignition devices behind sales counters out of reach of children or for items used for cooking or work placing on the top shelf of the display rack." 15. The city's sign regulations are proposed to be revised to be consistent with state law and the non- commercial sign language in Minnesota Statutes, section 211B.045, which apply statewide. 16. The tables contained in the Code are proposed to be updated to include all special ordinances that are not otherwise codified in their entirety, e.g. house and building number changes, street name changes and vacation, and rezonings. ORDINANCE NO.976 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA AN ORDINANCE ADOPTING THE RECODIFICATION OF THE MOUNDS VIEW MUNICIPAL CODE AND UPDATING THE CITY'S 2021 FEE SCHEDULE THE CITY OF MOUNDS VIEW ORDAINS: ARTICLE I. Authority. Minnesota Statutes, sections 415.02, 415.021, and 599.13 (collectively the "Act") and the Mounds View City Charter, section 3.04 et seq. authorize the City of Mounds View (the "City") to adopt and codify ordinances. The Act also provides that any ordinance included in a new city code, but not previously published, is sufficiently published if a substantial quantity of the code is printed for general distribution to the public. ARTICLE II. Back ound. At the direction of the Mounds View City Council, City staff and consultants undertook an extensive process to review and update the Mounds View City Code with the understanding that once all the amendments were finalized, they would be incorporated into a new code book, which would be reformatted and readopted as a single unified Mounds View City Code. The general purpose of the recodification is not to implement or incorporate substantive revisions to local laws and policies, but rather to remove outdated and unnecessary code language, reformat the code, update staff titles, and modernize the code to conform to current City practices and state law, as necessary. There were, however, a limited number of substantive amendments that were made due to staff s determination that such amendments were warranted and it was most efficient to accomplish said amendments during this process. The updated code has been prepared and it is the intent of this ordinance to adopt said recodification, which is entitled The Mounds View Municipal Code (the "Code"). Because it incorporates a small amount of changes to the City's current zoning ordinance, the planning commission has reviewed and provided a recommendation, pursuant to state and local law, and the City Council held a duly noticed public hearing regarding such changes on June 28, 2021. A complete copy of the Code has been presented to the City Council and the public together with this ordinance and is further on file with the City Clerk and available on the City's website. Additionally, a separate document summarizing the changes that were made to the previous code has also been made available to the City Council and the public with this ordinance and is further on file with the City Clerk and the City's website. ARTICLE III. Adoption. Pursuant to the City's authority contained in the Act and in the Mounds View City Charter, the Code is hereby adopted. ARTICLE IV. Copies. The City Clerk is authorized and directed to prepare sufficient copies of the Code for use by the City Council and City staff and for general distribution to the public in accordance with any City policies regarding the distribution and availability of City documents. The City Clerk shall also keep an official copy of the Code in the office of the City Clerk and ensure that a copy is available online or otherwise through the City's website. The Code shall be controlling and shall supersede and replace previously adopted ordinances pertaining to the same subjects contained within the Code, which are hereby repealed as of the effective date of this ordinance. Furthermore, nothing in this ordinance or the Code is to be construed to modify, abrogate or abridge: (i) the rights, duties, liabilities, privileges or immunities of the City; (ii) the qualifications or terms of office of City officers as they existed prior to adoption; or (iii) any special ordinance or franchise not embodied in the Code. The Code is declared to be prima facie evidence of the law of the City and shall be received in evidence as provided by Minnesota Statutes by the courts of the State of Minnesota. ARTICLE VI. General Penalty. Unless another penalty is expressly provided in the Code, every person convicted of a violation of any provision of the Code or any ordinance, rule or regulation adopted or issued in pursuance thereof may be punished for a misdemeanor violation, as defined in state law, and with a fine and/or incarceration up to the maximum permitted or required by law. Each act of violation and each day upon which any such violation shall continue or occur shall constitute a separate offense. The penalty provided herein, unless another penalty is expressly provided in the Code, shall apply to the amendment of any Code section, whether or not such penalty is reenacted in the amendatory ordinance. In addition to the penalty prescribed above, the City Council may pursue other remedies, including without limitation, abatement of nuisances, injunctive relief and revocation of licenses or permits. ARTICLE VII. Amendments. Additions or amendments to the Code when passed in such form as to indicate the intention of the City Council to make the same part of the Code shall be deemed to be incorporated in the Code in so that reference to the Mounds View Municipal Code includes such additions and amendments. ARTICLE VIII. Corrections. Given the size of this project and refinements made as part of the Code, the City Council recognizes the Code may contain certain errors, such as cross-references to changed subsections, typographical errors, and other non -substantive matters that may be discovered once the Code is placed into use. The City Council hereby authorizes the City Clerk to work with city consultants, as necessary, to make any non -substantive corrections to the Code as may be needed upon discovery. Such corrected provisions shall be incorporated in and made part of the official Mounds View Municipal Code without further action by the City Council. ARTICLE IX. Updated Fee Schedule. As part of the recodification contemplated herein, City staff also reviewed various fees that were previously expressed within the code. References to such fees were replaced with reference to the City of Mounds View's Fee Schedule, which shall hereby be amended by adding the fees contained on the attached Exhibit A. ARTICLE X. Summary Publication. The property is zoned B-4 Regional Business (the only property zoned B-4), which prohibits drive-thru restaurants. Paster Properties (owner) has had some interest from fast-food restaurants. The topic was discussed by the City Council's Development Committee, and at the Council's April 5th Work Session, which favored allowing a drive-thru. The City's intent is to remove zoning constraints (when warranted) that may be prohibiting redevelopment opportunities. Discussion: Mounds View Square shopping center consists of three buildings. The main building and El Loro are zoned B-4. The Caribou building (formerly Hardee's) is zoned B-3. The B-3 district allows drive-thru's as a Conditional Use Permit (CUP). The B-4 district prohibits them. The original intent when Mounds View Square was developed in 1974 was for a traditional sit-down restaurant (e.g. Bridgeman's, Totino's, El Loro). Since this time, dining habits have changed, favoring fast-food restaurants (e.g. McDonalds, Subway), and fast casual restaurants (e.g. Chipotle, Noodle's & Company). In winter/spring 2020, there was a proposal to remodel El Loro into "Sofa Tap House and Grill" (no drive-thru), but was pulled due to the pending Covid-19 pandemic. The proposed Ordinance Amendment changings the term "Drive-in and convenience food establishments" to "Drive-Thru Business". This change would treat any drive-thru the same, whether a restaurant, or a pharmacy. Additionally, the amendment removes duplicate language (# a - k), which refers to other sections of the City Code. In Staff's opinion, this provides a false - sense that the drive-thru must only comply with those regulations referenced, and not others. In 2019, Caribou began constructing "Caribou Cabins" a drive-thru only coffee shop. Caribou operates 291 coffee shops in Minnesota, of which, nine are Caribou Cabins, the nearest being in Fridley and Coon Rapids. A revised Preliminary Plat was received on July 5'", adding Lot 3, consisting of 14 parking stalls to be sold from the AP Mounds View (e.g. theater owner) to Moe's for additional parking, and potentially outdoor seating. Staff has not had an opportunity for review. Thus, Staff is requesting that the City Council conduct the Public Hearing (Open & Close), and table Action. The attached Resolution does not sufficiently address the addition of Lot 3. Discussion: Anthony Properties was approved as a Planned Unit Development (PUD) in 1998, and subdivided in 1999. As a PUD, lot sizes and setbacks are customized to the project. Most City Code requirements are considered a guideline, unless specified in the PUD Narrative. This project requires approvals of; (1) Subdivision; (2) Amendment to the PUD Narrative; and (3) Development Review of the coffee shop. Caribou Cabin will reduce the Theater's parking lot by 48 parking stalls (34 for Caribou, and 14 for Moe's). The theater closed in March 2020 due to the Covid-19 pandemic closure of public venues. New Vision Theaters went into bankruptcy in July, 2020. AMC Theaters has taken over the lease, and intends to re -brand, and re -open in summer 2021, as AMC Classic Mounds View 15.' Whereas New Vision had planned on remodeling the theater to include stadium seating, thereby reducing seating and parking by 50%, AMC has not communicated any plans for improvements. It is Staff's opinion that the parking lot is more than adequate to serve the theater as -is, with the reduction of 48 parking stalls. Analysis: Zoning The property is zoned Planned Unit Development (PUD), and is within the County Highway 10 Corridor Overlay District. Preliminary Plat As a PUD, minimum lot size and dimensions are intended to be clarified in the PUD Narrative. At the July 71h Planning Commission meeting, it was asked if a traffic study had been conducted (no), and some concerns expressed about a pinch point at the drive-thru exit into the parking lot. The Developer has stated that most of Caribou's traffic will be before 10:00 AM. Surface Water Drainage The Developer has applied for permits from Rice Creek Watershed District. An existing storm water infiltration basin will be altered (split in half, with Caribou in-between). The basin will be 3' — 4' below grade, about the same as current. Trail A trail is existing along Mounds View Boulevard. Caribou will have a sidewalk and bike rack in-between the trail and the walk-up order window. The 1997 PUD Narrative required the owner to dedicate a 15' wide easement to the City along Mounds View Boulevard for use in implementing a Highway 10 design theme (it is not evident that an easement was recorded). The trail was built outside of the intended 15' easement. The Resolution includes a condition that a 25' easement be dedicated alongside the right-of-way, for the trail. Parking3 The 15-screen theater has 2,160 seats, requiring 540 parking stalls (1 stall per 4 seats )4. Caribou Cabin will have 5 customer parking stalls, including 1 ADA stall, plus stacking for eight vehicles in the drive-thru lane. Within the Overlay District, parking requirements are a guideline. The requirements (guideline) are 1 stall per 3 seats (5 stalls for four 4-person tables), and 1 stall per employee. The parking plan does not include employee parking. The Developer has stated that there will be shared parking on the Theater's lot, for Caribou employees. A Condition of Approval requires that the Developer submit evidence of a shared parking agreement with the Theater, for Caribou employees. O'Neil Property Planned Unit Development, #10 (Landscaping; Highway 10 Design Theme) s Mounds View Municipal Code, Section 160.342 (Schedule of Off -Street Parking Requirements) 4 Mounds View Municipal Code, Section 160.342 (Schedule of Off -Street Parking Requirements) Item 08D Page 3 of 11 Lot 3 consists of 14 parking stalls which will be sold by AP Mounds View to Infinity Properties (Moe's Restaurant). During the July 711 Planning Commission meeting, Moe's expressed interest in expanding outdoor seating. If any permanent structures are built on Lot 3, it will likely require an amendment to the PUD Narrative to change the allowable uses, or to remove Lot 3 from the O'Neil Property PUD Narrative. The 1997 PUD Narrative required the Theater to have 662 parking stalls (proof of parking for 700 stalls). Only 487 parking stalls exist, and will be reduced to 439 stalls (loss of 48 stalls). It is not known why the PUD Narrative is more restrictive than the City Code, unless the theater was built smaller than what was planned in 1997. It is Staff's opinion that the theater has sufficient parking, and is unlikely to have every seat occupied at the same time, requiring parking for 662 vehicles. During the July 71" Planning Commission meeting, the Commission discussed what -if the Theater becomes a different use, such as a church? The PUD Narrative would need to be amended, and the needs would be re -addressed at that time. Tree Preservations All trees within the project area will be removed, including a line of mostly ash trees along the trail. Such trees will be replaced by the Stormwater infiltration basin. The tree removal is consistent with the City's tree protection requirements; to attempt to preserve the maximum number of significant and specimen trees (Ash is neither a significant, nor a specimen tree). All trees to be removed within the project area, between the trail and the storm water infiltration basin (photo, April 23, 2021). The Developer is requesting to thin -out and remove trees within the right-of-way, on the southeast corner of Mounds View Boulevard & Edgewood Drive, to improve motorists' view of Caribou. Lot 2 (theater parking lot) will be left unchanged. The storm water infiltration basin will have a grass/flower seed - mix, intended for stromwater basins. Highway 10 Design Theme In 1998, the City contracted with Hoisinton Koegler Group to complete a Design Theme for Highway 10. Lighting/Glare Three light posts will be added. The Municipal Code allows up to 1.0 footcandles, measured from the centerline of the street (Mounds View Blvd). The application includes a photometric plan, but does not extend past Lot 1. Any light glare onto Mounds View Blvd is just as likely to be from existing trail lighting, as it would from the project. Therefore, Staff is comfortable as proposed. It is not practical for the building to be set back 5' from Mounds View Boulevard, because that is where the trail is. Exterior Materials$ The building's exterior will be cultured stone below the windows, and lap siding & trim above (about 50% - 75% of exterior is siding & trim). Within the County Road 10 Overlay District, the Municipal Code requires at least 50% of all wall finishes consist of a combination of stone, glass, masonry, or other comparable materials. Non - decorative exposed concrete block, and pre-engineered metal buildings, and corrugated metal siding, is prohibited. It is Staff's opinion that the use of cement board siding is a "comparable material" within in the context of the overall architectural "cabin" theme. The proposed dumpster enclosure is rock -faced block. This is similar to dumpsters elsewhere in the development. (4) The approval of this PUD includes approval of joint use of the parking area by the theater and the office buildings because of offsetting hours. A minimum of 97 total parking stalls shall be provided on the office sites. If the office buildings are constructed in advance of the theater use, parking at a ratio of i space per 250 square feet shall be provided. (5) The number of parking spaces required for the restaurant and retail sites shall be based on the approved developmnent stage plan and the exact use determined at the time of building permit review, based on ordinance requirements. Restaurant and retail uses shall be self-sufficient and shall not require use of theater parking. 6. Review and Construction Process ■ General Concept Plan The approved general concept plan shall be as approved by Resolution No. 5119 including stipulations found in Exhibit 1 of MOUNDS VIEW PLANNING CASE NO. 5I7-98/471-97 EXHIBIT 1 OF RESOLUTION NO. 544-98 APPROVED BY THE MOUNDS VIEW PLANNING COMMISSION ON 4/15/98 0`NEIL PROPERTY PLANNED UNIT DEVELOPMENT Resolution 5119 and the plan prepared by HLM Architects, Inc., dated 2-7-97, and placed on file in the Mounds View Community Development Department under Planning Case No.471-97. ■ Development Stage Plan The approved develoment stage plan shall be as approved by Resolution No. 5226 and as specified in Exhibit 1 of Resolution 5226 including stipulations and attached plans dated 3/6198 and revised on 4/24/98. Where there are conflicts or inconsistencies between the general concept plan and the development stage plan, the development stage plan shall apply. ■ Final Plan Prior to the issuance of any building or grading permits, the property owner or their agent shall obtain approval for a final plan and construction drawings from the City administration, in accordance with Sections 1120.04 and 1000 of the Mounds View Municipal Code. Approval of the final plan and construction drawings may be in phases depending on the construction schedule for the development.. The final plan shall be recorded by the property owner with the County Recorder's Office, and proof of recordation shall be provided to the Community Development Department within 30 days of the date of approval. No permits shall be issued until such proof of recordation is provided_ ■ Construction In accordance with Section 1120.04, construction shall commence within one year after the approval of a final plan for the PUD. Construction may be accomplished in phases. Failure to commence construction within two years shall, unless an extension shall have been granted, automatically render void the approval of the PUD. In such case, the City Council shall adopt a resolution repealing the PUD O�NEIL PLANNED UNIT DEVELOPMENT 2430 HIGHWAY 10 plan, and re-establishing the PUD plan shall require a new application, review and approval. 7. Accessory Buildings; Outdoor Storage No accessory buildings shall be permitted in this PUD except trash enclosures. No outdoor storage of any type other than parking of customer and employee vehicles during business hours shall be permitted. 8. Preservation of Tree Coverage In its undeveloped state, this site was covered by a mature oak woodland except for the area in wetland. The applicant has completed an inventory of all trees 10 inches or more in diameter as part of the development stage plan. Every effort shall be made to preserve the existing tree coverage as part of this plan, including the use of setback and buffer areas, and parking lot islands. The approval of this PUD requires the preservation of the existing tree coverage in as natural a state as is practical in all areas not shown for either building footprints, paving, or manicured landscaping within the developed portion of the site. Tree coverage shall also be preserved in the wetland buffer, unless removal is approved by the City Council as part of a wetland alteration permit. The property owner shall address problems with infectious tree diseases such as oak wilt as directed by the City Forester. During the lifetime of this project, If trees die due to natural causes or must be cleared because of tree diseases, the property owner shall be responsible for replacing them with trees of at least 2-1/2" caliper and of similar hardwood species, as directed by the City Forester. New trees shall be spaced so as to replicate the existing density of tree coverage within 10 years. During construction, the property owner and/or developer shall be responsible for installation of protective fencing around treed areas MOUNDS VIEW PLANNING CASE NO. 517-98/471-97 EXHIBIT I OF RESOLUTION NO, 544-98 PAGE 3 OF 9 APPROVED BY THE MOUNDS VIEW PLANNING COMMISSION ON 4/15/99 O'NEIL PROPERTY PLANNED UNIT DEVELOPMENT which are to be preserved so construction activity does not damage the trees or their root systems, and die off from construction disturbance does not occur. The type of fencing and its placement shall be approved by the City Forester prior to issuance of any grading or building permits. The property owner and/or developer shall be responsible for maintaining the fencing in good repair throughout construction and for assuring construction activity and the parking of equipment is kept out of these areas. 9. Buffer Area; Screening Fence A critical element in the approval of this PUD is the preservation of a buffer area at least 50 feet deep along County Road H2. No construction of any buildings, paving, or other improvements, other than installation of utility lines, landscaping and berming, shall be permitted in this area. The specific treatment to be used in the buffer area shall be as shown on the approved development stage plan . Areas used for installation of utility lines shall be revegetated in accordance with the approved landscaping plan. The existing tree cover to be retained shall be preserved as provided in #8. No pedestrian or vehicular access shall be permitted through this buffer area. A screening fence shall be installed along County Road H2 (as shown on the development stage plan) and tied off at each end to prevent pedestrian traffic from the PUD development off the site. The fence shall be opaque and at least six feet in height. The area shown for office buildings may be graded and seeded until such time as the office buildings are developed, 10. Landscaping; Highway 10 Design Theme A detailed landscaping plan showing species, numbers and sizes of all plant materials has been provided as part of the development stage plan. The overall character of the landscape plan shall preserve the forested feel of the site, with allowance made for visibility of the PUD development from Highway 10. Prior to approval of permits for any O'NEIL PLANNED UNIT DEVELOPMENT 2430 HIGHWAY 10 PAGE 4 OF 9 building construction, the property owner shall grant an easement to the City for 15 feet in width along the Highway 10 frontage for use in implementing a Highway 10 design theme, as provided in Section 21. The property owner and/or developer shall incorporate landscaping materials necessary to implement the design theme selected for the Highway 10 frontage, if such a theme has been selected at the time building permits are requested. If a theme is selected subsequent to that time, the easement shall allow the City or City's agent to implement this design theme, The design improvements shall not unreasonably obstruct the visibility of the PUD development from Highway 10. During the lifetime of the PUD development, the property owner shall be responsible for the replacement of any dead or dying plant materials, and shall maintain the landscaping through regular watering, mowing, mulching, feeding, weeding and pruning. 11. Wetland; Wetland Buffer Area The wetland on the O'Neil property is protected by the Minnesota Department of Natural Resources (#171 W). No construction is permitted in the wetland, at or below an elevation of 895.8 feet or as determined by a wetland delineation study accepted by the Department of Natural Resources and the Rice Creek Watershed District. Construction in the wetland buffer area is anticipated as shown in the development stage plan, and will include water quality ponds (NURP ponds) and a portion of the theater, restaurant, and retail buildings, trash enclosures and parking areas. The detailed location of these improvements shall be established at the development plan stage. The property owner and/or developer shall obtain approval of a wetland alteration permit from the City for these encroachments into the buffer area prior to issuance of any building and grading permits. A minimum 10 foot wide natural buffer easement shall be provided adjacent to the wetland. 12. Drainage The approval of this PUD includes approval of a preliminary drainage MOUNDS VIEW PLANNING CASE N0.517-98/471-97 EXHIBIT 1 OF RESOLUTION NO, 544-99 APPROVED BY THE MOUNDS VIEW PLANNING COMMISSION ON 4/15/98 O'NEIL PROPERTY PLANNED UNIT DEVELOPMENT design. This design includes the construction of two NURP (National Urban Runoff Program) ponds as shown on the development stage plan. The design shows runoff from the developed portion of the site being collected and directed to these ponds, where pollutants settle, and then into the existing wetland. A 15" pipe carries water from the wetland to the storm drain system in Long Lake Road. The 15" pipe is to be left as is, since the size of the pipe keeps the rate of flow from the wetland at historic levels and prevents overloading of the storm drain system in Long Lake Road. A detailed, engineered drainage plan has been submitted with the development stage plan for review and approval by the City Engineer_ Final sizing of the NURP ponds and the design of the on -site drainage system shall be based on the detailed drainage study. No building or grading permits shall be issued until a final drainage plan is approved. The drainage improvements shall be constructed prior to the issuance of any occupancy permits for the theater or the office buildings. Prior to the issuance of any building or grading permits, the property owner is responsible for obtaining : ■ approval of a permit from the Rice Creek Watershed District, Department of Natural Resources, and U.S. Army Corps of Engineers, if such approvals are required: ■ the written statement from the Minnesota Department of Natural Resources that the development plan is in compliance with State regulations regarding wetlands (letter dated 3/26/98). ■ a written statement from the U.S. Army Corps of Engineers that the development plan is in compliance with Federal regulations regarding wetlands (letter dated 417/98). 13. Lighting A lighting plan submitted with the development stage plan, includes O'NEIL PLANNED UNIT DEVELOPMENT 2430 HIGHWAY 10 PAGE 5 OF 9 the location of lighting standards, a detail of the lighting standard design, and photometrics for the site if lighting is installed according to the plan. Lighting standards shall not exceed 24 feet in height unless sight line studies show that 40 foot high light standards are not visible from residential neighborhoods to the south of the site. The lens of the lighting fixtures shall not extend below the housing and the housing shall include sharp cutoffs so that light rays are directed downward rather than outward. Light levels shall not exceed 1.0 foot candle when measured at the center line of any abutting street, and .4 foot candle on adjacent property_ 14. Parking Lot Security The property owner shall put in place security measures if it is determined by the Mounds View Police Chief that there are persistent security problems associated with this PUD development. 15. Trash Dumpsters The development stage plan shows locations for trash dumpsters for each use in the PUD development. The trash dumpsters shall be placed within enclosures. The walls of the enclosures shall be constructed from the same building materials as the primary structure and shall have solid, opaque gates with a latching mechanism so that the doors remain closed except when trash is being dumped or removed. Chain link with plastic inserts is not acceptable for the gates. The enclosures shall be sized to allow maneuvering of the dumpster by trash trucks during winter weather conditions. 16. Site Maintenance; Snow Storage The property owner(s) shall be responsible for maintaining the landscaping, paving and other site improvements in high quality condition throughout the life of the development. The property owner(s) shall execute and record a maintenance agreement which assigns responsibility for maintenance of any common parking areas, landscaping and open space areas. The theater operator shall police the parking lot and remove all trash and debris every morning, prior to 9:00 AM, and on weekend evenings, prior to 6:30 PM. During the winter months, snow shall be plowed from the parking lot and placed in areas designated for snow storage or removed off -site. Snow shall not be stacked in the parking lot where it could result in reducing available parking. The site shall be maintained in a clean, attractive manner at all times. Snow storage areas, outside of the paved parking lot area, shall be as designated on the approved development stage plan. 17. Signage Signage shall be consistent with the coordinated sign program for this site submitted as part of the development stage plan. This sign program may propose different dimensions and types of signs than are allowed by the Mounds View Sign Code, while using the overall amount of signage allowed by the Sign Code for commercial businesses as a guide_ The sign program is subject to review by the Planning Commission and approval by the City Council. The sign program shall establish a design theme through using similar colors, type styles, and materials so that the signage on the site has an overall, coordinated appearance. 18. Architectural Character A colors and materials board, elevations and architectural renderings have been submitted as part of the development stage plan review for each building requesting such approval. ■ Theater Building: The theater building shall be of high -quality masonry construction, using either brick, split face block, stone, or exterior insulation finish system (EIFS), and shall have architectural detailing to add interest O'NEIL PLANNED UNIT DEVELOPMENT 2430 HIGHWAY 10 PAGE 6 OF 9 and character to the building. Materials and detailing shall be continued on all exterior sides of the building. A "false front" style of construction where materials and detailing appear only on the front facade shall not be allowed. Colors used for the theater building shall tend to minimize rather than accentuate the bulk of the building. ■ Office Buildings: The office buildings shall be of high -quality masonry construction, compatible with the theater building. The style of the buildings shall be residential in character. Materials and detailing shall be continued on all exterior sides of the building. There shall be windows on the south elevations similar to the design of the north elevation. No service doors shall be permitted on the south side. ■ Restaurant and Retail Buildings: The restaurant and retail buildings shall be high -quality masonry construction, or its equivalent, and presenting a substantial image. Allowance shall be made for the corporate style of a particular restaurant company, as long as a quality image is presented. Materials and detailing shall be continued on all exterior sides of the building. The provision of outdoor patio dining, visible from Highway 10, is encouraged. 19. Access; On -Site Circulation The development stage plan includes one signalized right -in, right -out access point from Highway 10 approximately midway between Long Lake Road and County Road H2. A secondary right in right out access shall be provided to Highway 10 at the southside of the property. The width and design of the access points shall meet the requirements of the Blaine -Spring Lake Park -Mounds View Fire Department and MnDOT. There shall be no traffic access to Long Lake Road except from the MOUNDS VIEW PLANNING CASE NO. 517-98/471-97 EXHIBIT I OF RESOLUTION NO. 544-98 APPROVED BY THE MOUNDS VIEW PLANNING COMMISSION ON 4/15/98 O'NEIL PROPERTY PLANNED UNIT DEVELOPMENT restaurant site at the corner of Long Lake Road and Highway 10. The access from the restaurant site shall be located north of the intersection of Long Lake Road and Mounds View Drive. There shall be no vehicular access from the restaurant site to any other parcel within the PUD. The property ownerldeveloper and the City shall undertake efforts to obtain final approval from MnDOT for a full movement signalized intersection to serve this development. The outcome of this effort shall not affect the ability of the property owner/developer to obtain use and occupancy permits for the theater complex or the office buildings. The final design of internal circulation on this site shall be determined as part of the development plan. Internal circulation shall be designed to move traffic off of Highway 10 quickly, and shall separate the drive aisles leading to the parking bays from the drop-off area in front of the theater building so congestion does not occur and traffic does not back up on Highway 10. 20. Acceleration/Deceleration Lanes; Sidewalks The property ownerldeveloper shall construct acceleration and deceleration lanes on Highway 10 at any access point as required by MnDOT. The property owner/developer shall construct a sidewalk or pathway along Highway 10 between Long Lake Road and County Road H2, and along the north edge of the wetland to provide a connection to the existing sidewalkltrailway along Mounds View Drive which leads to Silver View Park. The design, width and placement of these sidewalks shall be determined by the City. 21. Platting & Easements ■ Platting and Park Dedication Requirements The property is to be subdivided into 0 lots.The land division shall be considered a major subdivision and as such shall comply with Title O'NEIL PLANNED UNIT DEVELOPMENT 2430 HIGHWAY 10 PAGE 7 OF 9 1200 of the Mounds View Municipal Code. This title includes a requirement for dedication of park land or, at the option of the City of Mounds View and at its sole discretion, payment of park dedication fees in lieu of land dedication, based on the fair market value of the undeveloped land. The requirements for easements noted below shall be fulfilled as part of the platting process, except that no final plan shall be approved and no building or grading permits issued until the requirements for easements have been fulfilled either by platting or by separate recorded documents. ■ Cross Access and Parking Easement The property owner shall provide to the City a cross access and parking easement which allows use of the access point(s), drive aisles and parking by the theater complex and the office buildings. The cross access and parking easement shall be approved as to form by the City Attorney, executed and recorded prior to approval of the final plan. ■ Drainage Easement The property owner shall provide to the City perpetual drainage easement for that area lying within the delineated boundary of the wetland, and for the NURP ponds. The drainage easement shall be approved as to form by the City Attorney, executed and recorded prior to approval of the final plan. The property owner shall assume maintenance of the NURP ponds if so required by the City in the easement, ■ Easement for Implementation of Highway 10 Design Theme The property owners(s) shall provide to the City an easement of not less than 15 feet along the Highway 10 frontage to allow for design improvements such as landscaping, sidewalks, and lighting which would implement a design theme for Highway 10. This easement may coincide with the setback requirement for parking areas from Highway MOUNDS VIEW PLANNING CASE NO, 517-98/471-97 EXHIBIT 1 OF RESOLUTION NO, 544-98 APPROVED BY THE MOUNDS VIEW PLANNING COMMISSION ON 4/15/98 O'NEIL PROPERTY PLANNED UNIT DEVELOPMENT 10. A perpetual easement obtained from MnDOT for use of Highway 10 right-of-way for this purpose may be substituted for an easement on the O'Neil property. 22. Fire Protection The design of the access point(s) and placement of on -site fire hydrants shall be approved by the Blaine -Spring Lake Park -Mounds View Fire Department. The requirements of the Fire Department shall be met prior to issuance of any use and occupancy permits on the property. 23. Undergrounding of Utilities; Utility Design All existing utilities within the site boundaries and any additional utility lines installed in conjunction with this development shall be installed underground. Existing utilities may be placed underground concurrent with the installation of new utilities. A monetary guarantee for the placement of utilities underground shall be provided if required by a development agreement. Development in this PUD shall connect to public water, sewer and storm sewer systems. The requirement for utility shut-off values and service manholes shall be determined at the time of development stage plan and plat approval, based on the criteria in Section 1120.02 of the Mounds View Municipal Code. 24. Site Improvement Agreement A site improvement agreement shall be signed by the property owner prior to approval of the final plan. The agreement shall specify the on - site and off -site improvements to be constructed and shall be guaranteed through an escrow account, letter of credit or surety bond as determined by the City Clerk -Administrator.
