Mayor lankner stated she had received four letters 5. Residents

Attorn~y Karney advised one person has already been
prosec ted for violation of the public nuisance code.
Mayor ankner asked Attorney Karney and Clerk/Admini-
strato Pauley to look into what other legal procedures
could e followed, what is in the City's jurisdiction,
or wha laws would have to be changed for the City to
have c ntrol.
Attorn y Karney advised residents to call the police
depart ent with complaints, as they would then cite
the ow er of the property. He added if it is in
receiv rship, TCF would also be cited.
Mayor ankner advised Staff will look into what legal
positi n they have under current law and what would
be re fired to change state and local ordinances.

Jim Cater, 7660 Greenfield, stated moving the signs
to the other! side of the street is not going to help.

end, a'd they have had numerous problems with the
conduc of people in the apartments.
Mayor ankner noted the Council is trying to respect
the wi'hes mf the residents and the request they made.

the petition presented to the City.
Mayor Hankn~r stated that had the petition been worded
to not'have''parking on either side, the Council most
likel wou1~1 have done that. However, the request

Arlen Ubeng e, 7594 Greenfield, explained he had started
the p titio , and his concern was getting the parking

parkin and raffic control problems, and agreements

Mayor H nkne requested that a 12 month evaluation be
added to the development agreement. '

Hardee jump through hoops in setting operating hours,
and if it wo ld be arbitrary and capricious to require

the Ci y wit the same zoning.
A repr senta ive from Hardees reported the Planning
Commis ion s ggested Hardees set their hours as
busine s dic ates, with the Council to review in 12
months
The ma orit of the Council agreed the City needs to
give H rdee the opportunity to set their own hours
and ei her rove or disprove problems, with a review
to be one n July 31. The criteria to be considered
in the revi w is whether they create a public nuisance,
or any chan es to the public health, safety and welfare.
JoAnne Kole n, 2617 County Road I, asked if Burger
King o erat s 24 hours a day.
Attorney Ka ney reported they could, but they chose
to close.
Councilmemb r Wuori added Burger King discovered they
did n t hav enough volume, and it is their corporate
polic to c ose.
Mrs. ee, 7 45 Eastwood, stated that just because the
grope ty wa zoned that way for the past 20 years, does
not m an a estaurant was there.
It wa$ agreled the hours for delivery would be 6 AM to
8 PM.
The d~velo~ment agreement will require landscaping to
be ma ntai ed, including a fence, if it is required.
Mr. S'ncla'r stated they would like the landscaping
to re ain s it is proposed. The proposed plantings
would be e ergreens, which would provide year-round
cover.
There was iscussion on the height of a fence, and
policing c ncerns. The majority of the Council agreed
to requiri g a fence on the inside of the berm,
dire tly a jacent to the drive lane, to policing heights.

Mr. Pas er s ated they have had fences in other cities,
as requ sted by residents, but they cannot control
vandali m an have maintenance and upkeep problems with
them.
It is the po icy of Hardees to make sure litter is
picked up at all times.

Ms. Ry n sta ed it is very apparent to her that the
Counci is u responsive to the needs of the residents,

that would ble remembered at election time.
Counci memb r Blanchard replied that Council has done
its be t to be responsive, and the residents put the
Counci in difficult spot by not appearing until
after he p blic hearing and then wanting the Council
to cha ge e erything. She added a lawsuit would have
been v ry e pensive. The Council has leaned over
backwa ds t work with the residents, and the residents
admitt d th y had received the notices of the hearing
but ha oth r things going on and didn't attend.

the people f Mounds view and must keep in mind what
is best for all.
Mayor Hankn r noted how difficult it is to get people
