The Mounds View City Council was called 1. Called to
to order by Mayor Hankner at 7:02 PM on Order
Monday, December 17, 1990.
MEMBERS PRESENT: Councilmembers Wuori
Quick, Blanchard and Mayor Hankner.
Acting Clerk-Administrator Ric Minetor 2. Mounds

Mr. Bill Franke of Everest Development spoke
about the removal of the technical requirement
of January of 1990 as presented in the past
by Mr. Bob Dieke.
Motion/Second: Wuori/Quick to adopt Amendment
#1 to the Contract for Private Redevelopment,
Mounds View Business Park South

Mayor Hankner opened the public hearing
on the Wetland Zoning Ordinance at 7:06 p.m.
City Attorney Richard Meyers stated that the 3. Wetland
ordinance is very comprehensive; summarized Zoning
the .history of the ordinance. He stated Ordinance
the ordinance is tough and clarifies some
administrative issues.
Mayor Hankner questioned whether the fee
structure had changed. Fees are not
listed in the ordinance.
Acting Clerk-Administrator Minetor stated
the permit fee has been discussed $10.00.
and is estimated to be $10.00. This
fee would come from a resolution. Cost would
include fee for staff reviewal of construction
in a wetland district. This would be addressed
if ordinance revisions are adopted.

Mayor Hankner stated that a policy is needed to
state the purpose of the fee and the penalty for
failure to obtain a permit.
Acting Clerk-Administrator Minetor stated
that the resolution would have to include
the purpose of fee and penalties.
Peter Sabee of Barr Engineering clarified
page 14 of the ordinance.
Mayor Hankner inquired whether a permit is
needed for people mowing lawn in the
wetland district. Buffer zone would not
be included in permit requirements for
maintaining landscaping.
Councilmember-elect Pat Rickaby concerned
about the enhancement of the wetlands and
questioned whether the committee looked at
the surface water plan.
• Mayor Hankner replied that the committee
looked at that along with many other criteria.
All citizens were welcome at those meetings.
Councilmember-elect Rickaby stated her concern
about wetland enhancement with surface water
management in the forefront. The Ardan
Drainage Plan should be looked at. It will
be very costly. Pat was concerned about
page 25 of the ordinance. She is not in
agreement with justification #1 on page 25.
Mayor Hankner inquired if Councilmember-
elect Rickaby has had any experts provide
information to her.
Councilmember-elect Rickaby reviewed Barr
Engineering Report and studied all reports.
She approached many people with a petition.
Councilmember-elect Rickaby stated that
Gary Quick and Sue Hankner attended a
neighborhood meeting in the past and
recommended
Mayor Hankner stated she never suggested a
'; • storm sewer plan. Mayor Hankner stated the City
has a good, strict ordinance and it will be a model
for other cities.

Tom Foster, 2516 Ridge Lane spoke with regard
to Whiteoak Homeowner's Association. petition that
related to homeowner's yard work and allowed
removal of refuse from lake. He asked that
the .Council look at their petition again.
They want to do landscaping maintenance
without a permit.
Acting Clerk-Administrator Minetor stated the
committee did look at the petition and other
items. No group should have carte blanche.
To use fertilizers and weedkillers you must
have a permit.
Mr. Foster, 2516 Ridge Lane stated they need
a DNR permit to treat weeds, etc. He inquired
as to why a City permit is needed.
Acting Clerk-Administrator Minetor stated
different items were looked at for what was
appropriate for permits. The DNR has been
lax in some areas and that is-the reason for
• the City ordinance.
Peter Sabee, Barr Engineering he understands
it will be a burden to obtain a permit, but it
is necessary. Page 14, Item B covers this.
It is very specific rather than vague and its
intent is important.
City Attorney Richard Meyers stated that years
ago the Council stated they would protect wetlands
and that a 100 foot buffer zone would allow for
mowing, weed control, etc. The DNR has not always
been responsive in the past.
Tom Foster, 2516 Ridge Lane inquired if the City
has phosphate fertilizer ban?
Acting Clerk-Administrator Minetor replied it did
not.
Peter Sabee, Barr Engineering discussed the pros
and cons of phosphate fertilizer.
Acting Clerk-Administrator Minetor stated the
ordinance does not prohibit mowing in a buffer
zone. It prohibits mowing only in a wetland
district. Maintenance is allowed in the buffer
zone.

Council needs to look at key words in the
ordinance and more clearly define these words.
Acting Clerk-Administrator Minetor stated the
ordinance has to work for everyone.
Mayor Hankner called for the first reading of the
Wetland Zoning Ordinance.
Motion/Second: Blanchard/Quick to approve first
reading of the Wetland Zoning Ordinance.

will be set for December 26, 1990.
