On page eight, paragraph 10, remove the words, is only about one-third and add the words, return would be small,.smaller than 1500. Also, add, Ms. Orduno stated that the response would be approximately one-third and add that Councilmember Rickaby stated that one-third would be a generous estimate, return would not be that big. Mayor Linke wished Councilmember Rickaby well in her future endeavors. �RESIDENTS REQUESTS AND COMMENTS FROM THE FLOOR There were no residents requests or comments pertaining to issues not on the agenda presented at this meeting. PUBLIC HEARTNGS Michele Severson, Administrative Secretary, reviewed Staff Report No. 93- 53bC regarding the Renewal of On-Sale Intoxicating Liquor, Off-Sale Intoxicating Liquor and Wine On-Sale Licenses. Severson reported that staff had asked the Ramsey County Health Department and the Fire Department to conduct inspections on all establishments, including restaurants. All establishments passed their inspections. The Ramsey County Property Tax Department was contacted regarding the status of property taxes, the City's �olice Department was asked if there were any incidents that would prevent he establishments from having their licenses renewed and the City's Utility Department was asked for the status on the utility accounts. Severson reported that all property taxes were current, all utility billings were current and there wer� no incidences that would prevent the renewal of the licensing of the establishments. VOTE• � 5 ayes 0 nays Motion Carried Mounds View City Council Page Four �egular Meeting June 28, 1993 Public Hearing * Request for Conditional Use Permit * 7312 Park View Drive Mayor Linke opened the Public Hearing to consider a request for a Conditional Use Permit for 7312 Park View Drive at 7:14 p.m. Pau1 Harrington, City Planner, reviewed Staff Report No. 93-537C, regarding a Request for ConditionaT Use Permit (Oversized Garage) at 7312 Park View Drive. Harrington stated that Gerald Setterholm had made application for a Conditional Use Permit to allow the construction of an addition to an existing garage which would bring the total square footage of the structure to a number which exceeds the maximum allowable square footage per Mounds View Municipal Code. Harrington reported that the applicant's request, if granted, would a21ow the construction of a 16' x 24' addition to an existing garage. Because the total square footage of the garage and addition exceeds 1,000 square feet, no additional accessory structures would be allowed on the property. Harrington added that the request meets all other applicable requirements set forth in Chapter 40 of the Mounds View Municipal Code including height, area and setbacks. Harrington further stated that the Planning Commission had reviewed this request and had recommended approval via resolution to the City Council. Mr. Harrington also reported that he had received three letters regarding this request. The first letter was from Gerald V. Sweet, 2760 Hodges Lane, Mounds View, MN. The Zetter reads: ,'une 21, 1993 Mounds View City Council Ladies and Gentlemen In regard to the Notice of Public Hearing Meeting scheduled on June 28, 1993; pertaining to Lot 4, Block 6 Silver Lake Woods. I am opposed to allowing a buil.ding permit variance to construct an oversized accessory building (Garage) at 7312 Park View Drive. Allowance of such a structure invites commercial activities in our zoned residential neighborhood. Construction of the proposed dwelling addition will obstruct our view from our.deck and add an undesirable dimension. A property appraiser reports that this type of view delimiter can reduce adjacent property value from 3 to 7 percent. The letter reads as follows: June 23, 1993 City Planner City of Mounds View 2401 Highway 10 Mounds View, MN 55112 Dear Sir: This is in response to the Notice of Public Hearing meeting scheduled for June 28, 1993 with regard to Lot 4, Block 6 Silver Lake Woods construction of an oversized building. I am opposed to allowing a building permit variance to construct an oversized accessory building at 7312 Park View Drive. Allowance of such a structure invites commercial activities in our zoned residential neighborhood. It also sets a precedent for other homeowners in the area to build similar structures which would very quickly deteriorate the family atmosphere that is currently there and devaluate the homes in the area. One of the reasons we built our home in this area was because there were regulations on the types of housing being built so that �ur home would retain its value. We also liked the quiet residential treets so our children can ride their bikes and not be concerned about commercial vehicles entering the area. Allowing structures such as the one currently proposed will change that. Therefore, I vote no to the construction permit requested. Sincerely, (signed by Gail Whetherhult) ' 2751 Hodges Lane Mounds View, MN 55112 The third letter received by Paul Harrington, City Planner was from David Petri, 2750 Hodges Lane, and its contents are as follows: Mounds View Town Board Meeting Monday June 28th 1993 Re: Enlarged garage To Whom It May Concern: I live at 2750 Hodges Lane, if this building is allowed to be put up it will cover all windows on the southern part of my home. It will leave us with a view of just 1 window on the easterly side of my home. I have been told by appraisers that view accounts for approximately 5% to 6% of your properties value. • Mounds View City Council Page Six �egular Meeting June 28, 1993 Also we moved from New York and picked Moundsview and this area because we� loved the beauty of the area. By allowing a commercial style building to go up it will first take away from this beauty and two, set a precedent we will not be able to stop later. My family and I would not have purchased this home had we had any idea this was going up and are prepared to retain an attorney to protect our interests. Petri) 786-6939, David Petri These letters are also attached to the minutes as part of the permanent record. Fred Squires, 2770 Hodges Lane, stated he was against the proposed variance request. Mr. Squires stated that Setterholm is a good neighbor and does not intend to devaluate his property or those properties surrounding his property. Mr. Squire stated that, in his opinion, the oversized garage is �ot appropriate and is out of character for the style of homes in the eighborhood. Mr. Squire further stated that this oversized garage building could invite light commercial use in the future. Mr. Squire stated that Mr. Setterholm could make the garage a three stall garage which would be better suited for the neighborhood. Mr. Squire asked that the Council deny the variance. Gerald Sweet, 2760 Hodges Lane, stated his letter was read before the Council this evening and that he wanted to let the Council know that he was present at the meeting. Peg Mountin, 7321 Park View Drive, stated that Mr. Setterholm's property is well kept and that she is confident that the addition to the garage would reflect the same good taste in construction. Ms. Mountin stated that this is not a variance, but a Conditional Use Permit for a specific permitted use. Mountin further reported that if the applicant meets all conditions set forth by the City Code, the City has no alternative but to grant the. permit. Ms. Mountin stated that there are a lot of worse things environmentally going on in the neighborhood than that of enlarging a garage. Ms. Mountin cited that there is a neighbor who weeds the garden, which half of the garden is in the park, and throws the weeds into the park, another neighbor has six years worth of grass clippings composting on the lot line in a wetland boundary area, and, another neighbor, backwashes his swimming pool into the street. Ms. Mountin stated that those kinds of activities have �ore impact on the environment than an oversized garage which is, at least, architecturally more interesting to look at than a 7 foot fence. Mounds View City Council Page Seven �egular Meeting June 28, 1993 The applicant should be allowed to put the addition on the garage and make good use of it . Paul Harrington commented that Mr. Setterholm would be using a portion of the garage to store a boat. Dave Petri, 2750 Hodges Lane, stated that he would like to apologize to Mr. Setterholm because in the beginning Mr. Petri had told the applicant that he would support him in the request for a conditional use permit for an oversized garage until he became aware of the size of the structure. This structure would diminish Mr. Petri's view of the neighborhood. The applicant, Mr. Setterholm, was present at the meeting but had no comments to make. Councilmember Rickaby stated that she has been liaison on the Planning Commission for a short while and she has observed more persons coming in to get permits to increase the size of their garages for the storage of boats and so forth. Rickaby stated that this is a sign of the times because people have more items to store. An alternative for the applicant might be to keep the boat outside and this would also obstruct the view. The view would be better served by housing the boat and keeping it sheltered from �ear and tear at which time it would become a nuisance and a bad site. ouncilmember Rickaby stated that she supports the ability of per.sons to build garages of substantial size to house boats. Mayor Linke stated that a conditional use permit is not a variance and asked if the applicant met all laws required? Paul Harrington replied that the applicant had m�t all requirements. Mr. Harrington indicated that a conditional use permit is granted ior a principal use which requires special limitations in order to protect the public welfare. A true variance would be when an applicant would ask for a variance from the code. The City keeps track of issued conditional use permits because the City does not want to encourage small businesses taking place in these oversized garages. Mayor Linke closed the public hearing at 7:27 p.m. MOTIONLSECOND: Rickaby/Blanchard to adopt Resolution No. 4379 Regarding Request for Conditional Use Permit.(Oversized Garage) 7312 Park View Drive, Planning Case No. 364-93 Mayor Linke stated that the applicant has met all code requirements, therefore, the City is bound legally to grant the permit. The City has no legal grounds to deny the request. VOTE: 5 ayes 0 nays Motion Carried � Mounds View City Council Page Eight �eqular Meeting June 28, 1993 Mr. Sweet stated that the conditional use permit granted tonight could attract potential buyers who would do commercial business from the garage. Mr. Sweet feels that an oversized structure encourages this type of activity. Mayor Linke stated that this can happen in a regular sized garaqe. Mr. Sweet stated that a regular sized garage does not encourage it as much as a large garage. Harrington stated that as part of the resolution for the conditional use permit, which is recorded against the deed for the property, potential buyers would be aware of the stipulations or conditions of the resolution. The property has to be used for stipulated purposes. The property owner could be issued administrative offenses in the amount of $100 per day for improper use of the property. Mayor Linke stated that the City is in the process of revoking a conditional use permit on a property. If the building is not used for what is stated on the resolution, the City Council can ask that the building be torn down. Councilmember Rickaby stated that the conditional use permit gives the homeowners more control over something like that happening. Rickaby stated �hat there is a property owner in her neighborhood that repairs cars or hatever in a non-oversized garage. The City has nothing that prohibits this activity at this time as long as the activity is not visible from outside of the building and has no impact on the street. Mr. Sweet then asked if a person could be Joe's corner garage and do work from his qarage? Mayor Linke explained that there are limits and restrictions regarding traffic and parking. Harrington stated that persons cannot park a vehicle that advertises their business outside of their home if they are doing business from the home. The vehicle must be parked in their garage. Councilmember Rickaby stated that by using conditional use permits it may stop this activity in other areas by making people aware that this premises cannot be used for commercial activity. Councilmember Rickaby stated that this gives the residents more control because this property cannot be used for anything except what is allowed. Severson stated that the City Council accepted Pat Rickaby's resignation at their June 14, 1993 meeting and declared August 24, 1993 as the date for a Special Municipal Election. Severson further stated that the City must hire election judges to conduct the election. Patricia Coffey, Kathy MacRunnels, Alice Frits and Amy Hodges have been selected to conduct the Special Municipal Election upon Council approval. Kathy MacRunnels would be the Chair person and Alice Frits would be the Co-Chair with Amy Hodges and Patricia Coffey being election judges. The General Chair and Co-Chair would receive $5.50 per hour and the judges would receive $5.00 per hour. Severson reviewed the procedures for new voter reg�stration. Ulrich stated that due to the volume of records, applications and reports, staff is requesting the City Council's authorization to purchase a more efficient computer. Ulrich stated that staff had received two bids. The bids were from PC express in the amount of $2,249 for a computer and $1,449.for a printer and from PC Tailors in the amount of $2,295 for a computer and this company does not sell laser printers. Updated software would be purchased at this same time Ulrich stated that staff would use some of the funds from the 1993 5treets, Capital Equipment Fund. $12,000 was budget for a changeable messaqe sign and $4,000 was budgeted for a patching trailer out the water and sewer budgets. Short-Elliot-Hendrickson conducted the reference checks and recommended the award of the bid to New Mech Companies in the amount of $166,400 to be funded from account number 680-4121. Staff also asked that the Public Works Supervisor be authorized to sign all change orders up to 10% of the bid amount. Mayor Linke asked what the standard amount that can be authorized without the approval of the City Council. Linke stated that ten percent of $166,400 is $16,000. Mike U2rich, Public Works Supervisor, reviewed Staff Report No. 93-545C regarding the bid award for controls for Treatment Plants 2 and 3. Ulrich reported that on June 17, 1993, staff received a quote for revisions to the control systems for water treatment plants 2 and 3 from Autocon Industries. Ulrich further reported to maintain compatibility with the City's current control system, this equipment was not open to competitive bidding. Four years ago when the new system was bid, it was open for competitive bidding. Ulrich stated that this quote was referred to SEH's electrical engineer for review and the engineer's findings were that the prices for modification and new equipment were within competitive markets. Ulrich noted that since this is a sole source bid, a resolution stating such must accompany this award. Ulrich presented Resolution No. 4384 for Council's consideration. Wuori• No report. Rickabv No report. Report of Mayor a. Mayor Linke congratulated the Irondale Marching Band on winning several awards while competing in the Alexandria competitions last weekend. Linke reported that this is the third year that the Irondale Band has swept all categories. Linke further reported that there were bands competing from Iowa, Minnesota and South Dakota. � Councilmember Quick asked if there were many seniors in the band. Mayor Linke r�sponded that there are a few seniors, but as 8th and 9th graders have been added there are only a few "graduated seniors" in the band. Councilmember Quick stated that the band's dedication is incredible. Mayor Linke stated that the band is very loyal to its director. Mayor Linke also reported that on July 6th the Irondale Band will lead the parade for the Lion's Club Convention to b� held in Minneapolis. This is the largest convention ever held in Minneapolis. There will be 30 bands in the parade. The parade will begin at 9:00 a.m. starting on Third and Washington in Minneapolis. Mayor Linke invited those who could to come and watch the parade. The Trondale Band will perform at the Festival In the Park on July is. Mayor Linke reminded the cable audience and the residents of Mounds View about the forthcoming FOCUS 2000 public forums to be held July 21 and 22. c. Mayor Linke reported that the Association of Metropolitan Municipalities' Housing and Economic Development Committee was looking for a representative for that committee from Mounds View. The Council appointed Councilmember Blanchard to fill that position. Mayor Linke stated that he is a member of the General Legislative Committee and that Samantha Orduno is a member of the Revenue Committee and the League of Minnesota Cities Legislative Committee. Report of Administrator Samantha Orduno, City Administrator, reported that two weeks ago the Council authorized the settlement of $26,600 for the Oak Grove Landfill Superfund litigation. Orduno reported that, at that time, she also indicated that this would not be the last landfill litigation that the City of Mounds View would be involved in. The City has received notification that it has been named in regards to another landfill. Orduno reviewed a cartoon that had been in the paper regarding the proposed responsible parties in a landfill site. The caption read, "...tab will be picked up by the understanding taxpayers." EPA is goinq after the cities not the companies. Mayar Linke commented that the City's settlement was $27,000 for four loads of brush. Mounds View City Council Page Thirteen ..egular Meeting June 28, 1993 Orduno commented that in the early 1980's there was a movie ca.11ed, "Network" and in that movie there is a scene where a person is telling the people to throw open their windows and doors and yell, "I'm mad as hell and I won�t take it anymore." The people of Mounds View need to get angry and not take it anymore. �The taxpayers of the City of Mounds View should not have to pay for someone else's garbage. Orduno stated that the City will join again with other cities and will Pight in the Legislature and in Congress - the City will not pay for someone elses' garbage and trash. Mayor Linke stated that the Oak Grove LandfilZ set a precedent that allows the City to settle as a group. The City is not stuck like the old Mom and Pop grocery stores. Mayor Linke stated that he is aware of a company that is being sued by a landfill site because the site has on record that a garbage hauler stated that he remembered haulinq one load of trash from the company. This company's bill will be as large as our bi21 was. The smaller company will pay a great deal when the larger companies that create toxic waste will pay a pittance. Orduno reported that when the City receives a piece of legislation, whether it be federal or local, it will be brought forth and the residents will be made aware of who to contact. Orduno encouraged the � residents to contact their legislators because if they are contacted, residents could pay thousands of dollars out of their pockets over the next 10 years for something the City hasn't done. Mayor Linke announced the dates for the upcoming Council Work Session and next Council Meeting.
