PLEDGE OF ALLEGIANCE The Pledge of Allegiance was said. ROLL CALL MEMBERS PRESENT: Mayor Linke, Councilmembers Quick, Wuori, Blanchard and Rickaby. Tim Cruikshank, Assistant to the City Administrator, presented to the Mounds View City Council and Mounds View City Staff a Meritorious Achievement Award in Recognition of Outstanding Accident Prevention Performance in Occupational Safety. Cruikshank explained that each year the Minnesota Safety Council, in conjunction with the Governor's Office, awards those organizations who have shown exemplary efforts and achievements in the area of occupational safety. Cruikshank, on behalf of the .City, congratulated all City employees and, in particular, the Public Works Maintenance workers, the Parks, Recreation and Forestry Maintenance workers and the patrol officers for their efforts in minimizing accidents in the City of Mounds View. Mayor Linke accepted this award on behalf of the City Council and commended all employees of the City for their conscientious efforts in the area of occupational safety. b. Mayor Linke read a proclamation that was presented to D.A,R.E. Officer Bob Nelson proclaiming Friday, May 28, 1993, as "Officer Bob Day" in the City of Mounds View. In the proclamation it was explained that Officer Bob Nelson has gone far above and beyond what might be expected of a D.A.R.E. officer. Officer Bob Nelson accepted the proclamation and thanked the Council, Pinewood School Staff, City Hall Staff, the parents of the students of Pinewood Elementary School and the children themselves for all the support he has received regarding the D.A.R.E. Program. RESIDENTS REOUESTS AND COMMENTS FROM THE FLOOR There were no residents requests or comments pertaining to issues not on the agenda presented at this meeting. PUBLIC HEARINGS Mayor Linke called to order the public hearing regarding a request for Conditional Use Permit, 8371 Pleasant View Drive, Planning Case No. 361-93, Oversized Accessory Building at 7:08 p.m. Paul Harrington, City Planner, reviewed Staff Report No. 93-509C reporting that the applicant had made application for a Conditional Use Permit to allow the construction of an accessory building which exceeds the maximum allowable square footage as per Mounds View Municipal Code. Harrington stated that the Planning Commission recommended approval of this request at the May 5, 1993, Planning Commission Meeting. Harrington further stated that he had included in Council Packet Resolution No. 4371 approving the Conditional Use Permit. No discussion followed staff's reviewal of the request for Conditional Use ~ermit for 8371 Pleasant View Drive. Mayor Linke asked if there were any items the Council desired removed from the Consent Agenda. There were no items removed. MOTION[SECOND: Blanchard/Quick to adopt the Consent Agenda as presented. Councilmembers Blanchard and Quick both emphasized Item B. on the Consent Agenda regarding the Informational. Meeting to be held on the Storm Water Management Utility scheduled for June 21, 1993, at 7:30 p.m. • VOTE: 5 ayes 0 nays Motion Carried COUNCIL BUSINESS: A. Mary Saarion, Director of Parks, Recreation and Forestry, reviewed Staff Report No. 93-511C regarding Resolution No. 4369 Authorizing the City of Mounds View to .Act As Legal Sponsor of Community. Development Application Submitted on May 25, 1993. Saarion explained that Resolution No. 4369 is a part of the administrative process of the LAWCON grant which the City is receiving for the paving of Silver View Park trail. Orduno stated that residents are not aware of how frequently City staff applies for grant money and, in the Metro area, Mary Saarion is known as the "Queen of Grants" because of the number of grants she applies for and her success in receiving grant monies for the. City of Mounds View. Mary Saarion, Director o • Staff Report No. 93-512C paving of Random Parking located off of Long Lake 0 nays Motion Carried E Parks, Recreation and Forestry, reviewed regarding a request for contingency funds for Lot. Saarion reported that Random Park is Road and that this parking lot has been a Mounds View City Council ~egular Meeting Page Four May 24, 1993 disaster in the past due to heavy mud and persons becoming stuck in the lot. Saarion further reported that she inquired about having the parking lot paved at the same time as the contractor will be completing other driveway jobs for homeowners living on Long Lake Road. The contractor doing the paving jobs has offered the City a very good price for paving of the Random Parking Lot. The cost for the paving of the lot would be $4,000 and Saarion is asking for Contingency Funds to be used to pave Random Park parking lot. MOTION/SECOND: Quick/Rickaby to Approve the Use of Contingency Funds at a Cost Not to Exceed $4.,000 for the Paving of Random Park Parking Lot Councilmember Quick commented that Silver View Park parking lot and basketball court was completed similarly in conjunction with work being accomplished on County Road I, benefiting from lower prices using the paving contractor for the County Road I project. Alice Frits, 8072 Long Lake Road, questioned this amount of money being. taken from the Contingency Fund as the fund balance is down to approximately $12,000 after the Council pulled $20,000 out of this fund for the Visioning Process. . Mayor Linke stated that there is approximately $32,000 in the Contingency Fund and that the Contingency Fund is set up for this type of spending. Bill Frits, 8072 Long Lake Road, asked again about the $20,000 being taken out of the Contingency Fund for the Visioning process. Samantha Orduno, City Administrator, responded to the question by stating that the funds for the Visioning Process were taken out of the Fund Balance which used to be called Reserves. Orduno invited Mr. Frits to come into the office and she would explain all expenditures and fund balances to him. Mr. Frits stated that perhaps it is time for an audit to find out if the City has money or not. Mr. Frits stated that some type of report should be given to the citizens with regard to the financial state of the City. Mayor Linke stated that just prior to this meeting the City Council had met with the auditors and went over all of the funds through the end of 1992. Orduno stated that information was in the newsletter regarding the availability of the auditor's report and-that there are public copies . available at City Hall which can be loaned out to residents as well as copies in City Hall that could be read here and that she would be happy to respond to any questions that one might have while reviewing Mounds View City Council Page Five ~egular Meeting May 24, 1993 the financial statement. Orduno further stated that letters had been sent to all residents who attended the budget hearings informing them that this information was available to them. Saarion also. explained that in each issue of the City Newsletter there is a page devoted to "Want Help from the City". This is where the residents of the community can provide feedback to the City regarding concerns that they might have. The information is given to the proper department. One of these concerns was given to the Parks, Recreation and Forestry Department which concerned the paving of Random Park parking and how troublesome it was for residents participating in recreation programs to get in and out of the lot with the six inch deep mud. VOTE: 5 ayes 0 nays Motion Carried C. Mary Saarion, Director of Parks, Recreation and Forestry, reviewed Staff Report No. 93-513C regarding a lease-purchase agreement for a double axle trailer at a cost of $4,032.09. Saarion explained that the Parks Department needs the trailer to haul the Skid Loader to projects when it has on tracks rather than wheels. Saarion further explained the trailer could be used for hauling mowers when they break down in • the field. Currently, Saarion reported, the City must rent a trailer to accomplish getting the mowers into the shop for repair. Saarion explained that an agreement had been reached with Carlson Tractor for a lease purchase agreement pending Council approval and partial payment of the trailer would consist of a trade of an attachment that was not used and bought for another mower. The rest of the dollars would be requested in the 1994 Capital budget program. Mayor Linke asked if the City would save money by paying the entire amount now. Saarion explained that no extra dollars were being charged for the rest of the dollars and that sales tax was included in the price. MOTION/SECOND: Wuori\Quick to Approval the Lease Purchase Arrangement for a Double Axle Trailer, Including $1,200 paid in 1993 with Monies Received from the Howard Price Vac, and the Remainder of the $2,832 Paid with Monies from the Parks Capital Budget Program VOTE: 5 ayes 0 nays Motion Carried D. Paul Harrington, City Planner, reviewed Staff Report No. 93-514C regarding Road Maintenance Agreement with Silver Lake Woods Condominium Association, Inc. Harrington reported that, as previously discussed with Council, the agreement allows the City to provide certain road maintenance including snow plowing, pothole patching, curb maintenance and seal coating. Harrington stated that the Association is to provide long term maintenance including, but not Mounds View City Council ~egular Meeting • Page Six May 24, 1993 limited to; repaving, resurfacing, overlays, major improvements and all maintenance not provided by the City. Harrington further reported that he and Mike Ulrich, Public Works Supervisor, went over this agreement and had a concern regarding snow removal. Harrington spoke with the City Attorney regarding his concerns and, where the agreement refers to snow fall in Item 2., the wording would include, snowfall accumulation will be required to be removed within five days rather than 30 which applies to other portions of this agreement. The Association's attorney was in agreement with this recommendation and will be forwarding the appropriate language to the Mounds View City Attorney. Harrington further reported that the agreement is fair and equitable to both parties involved. MOTION/SECOND: Rickaby/Blanchard to Approve the Agreement and Authorize the Mayor and Clerk-Administrator to Execute the Maintenance Agreement Between the City of Mounds View and Silver Lake Woods Condominium Association, Inc., on Behalf of the City of Mounds View VOTE: 5 ayes 0 nays Motion Carried Mike Ulrich, Public Works Supervisor, explained that staff had discussed with Ramsey County the proposed turnback of Pleasant View Drive and Spring Lake Road. Ulrich stated that the County has funds designated for upgrading roads to be turned .back to municipalities that cannot be utilized on other roads. Ulrich reported that Pleasant View and Spring Lake Road are authorized to be rehabilitated under these funds. Ulrich further reported that the County indicated that they would be willing to enter into. an agreement that would delay the turnback of these roads until the Legislature allows additional Municipal State Aid mileage for these roads. Ulrich also reported that Fridley is planning on holding a public meeting to discuss the rehabilitation of Pleasant View Drive and the possibility of curb and gutter along their portion of the road. Ulrich stated that the concept is that residents could request curb and gutter if they are willing to pay the cost. Ulrich reported that he was not familiar with this item and would like to further investigate this. item as he did not know when Fridley would hold the meeting and he was not knowledgeable of the cost of curb and gutter to the residents. MOTION,J SECOND: Linke/Quick to Remove Planning Case No. 358-92 from the Table (Simon T. Simon Variance Request) for Discussion VOTE: 5 ayes 0 nays Motion Carried Paul Harrington, City Planner, reported that at the February 8, 1993 Council Meeting consideration of the appeal of Planning Case No. 358- 92 was tabled indefinitely pending the applicant's receipt of easement area for the expansion of his off-street parking area at 2840 Highway 10. Harrington further reported that the applicant has contacted City staff and reported that an easement agreement has been reached. Harrington recommended that this item be referred back to the Planning Commission for a recommendation considering that there would be a new layout for parking. Councilmember Blanchard expressed some concern in the fact that to recommend this back to the Planning Commission would delay any action on the applicant's part for at least two months. Mayor Linke shared Councilmember Blanchard's concern, but felt that it would be hard to make a decision on this item without having Planning Commission's approval as .there is a new layout for parking. . Harrington reported, in order to expedite the process, he would hand carry the item to the .two Planning Commission Meetings scheduled for this month. This item was referred back to the Planning Commission via concurrence of all Councilmembers. G. Tim Cruikshank, Assistant to the City Administrator, reviewed Staff Report No. 93-517C regarding declaring obsolete computer equipment surplus. Cruikshank reported that an inventory had been taken on computer equipment that is no longer in use and has become obsolete. Cruikshank asked that the Council declare this equipment obsolete in order to sell. it to a computer vendor. Councilmember Blanchard read a letter that was received from Elaine Voss regarding the counting of absentee ballots at the Mounds View City Council Page Eight ~egular Meeting May 24, 1993 November General Election for Legislative District 52B. Blanchard stated that there had been reports and rumors that the City of Mounds View had rejected a large amount of absentee ballots, 300 or more. Blanchard reported that this report indicated that all absentee ballots in question were properly rejected by the election judges n the manner provided by law. The actual total number of absentee ballots rejected was 41. Councilmember Blanchard commended the election judges for a job well done and hoped that this report eased a lot of tension that had been felt by the judges. Councilmember Wuori reported that the Garden Club planted the flowers at City Hall on Saturday, Mother Nature provide the necessary rain and now it is hoped that there will be sunshine in order for them to grow and be beautiful in time for the City's .Festival. Councilmember Wuori extended a "thank you" to the Garden Club for their work. • Rickabv - No report Report of Mayor• Mayor Linke supported the information Councilmember Wuori gave with respect to the Garden Club and the plantings at City Hall. Report of Administrator a. Samantha Orduno reported that she had accepted Ric Minetor's (Director of Public Works) resignation pending Council's acceptance today, May 24, 1993. Ric is seeking other professional and educational opportunities. Orduno asked Council to accept Mr. Minetor's resignation and provide him with a moderate severance package which would consist of all accrued vacation leave, as per City Code; upon exhaustion of vacation leave, severance pay at the current rate of pay and method of payment until July 30, 1993 and payment of $308 for a previously agreed upon professional training course that was approved in January of this year. MOTION/SECOND: Rickaby/Blanchard to Accept Mr. Ric Minetor's Resignation as Director of Public Works/City Engineer with the City of Mounds View and to Provide a Modest Severance Package VOTE: 5 ayes 0 nays Motion Carried b. Orduno also reported that a Golf Course Task Force Meeting was held Wednesday, May 19, which involved a tour of the .Mounds View City Council ~egular Meeting Page Nine May 24, 1993 area golf courses. Councilmember Blanchard was out of town and did not attend the tour. Orduno stated that these golf courses were designed by the architect the City selected and they were beautiful and very playable courses. Orduno further reported that one of the courses had a large wetland area that had not been changed but enhanced through the addition of trees and plantings. The Task Force agreed that the right architect had been selected after touring these courses. Report of Staff• a. Michele Severson, Administration Secretary/Deputy Clerk, reported that Magel Carnival Midways, Inc., had conducted a carnival on the Mounds View Square site from May 18 - May 23, 1993 and there had been no reported incidences or problems with the carnival. b. Mary Saarion, Director of Parks, Recreation and Forestry, reported that on May 15 the City's new disc golf course was initiated. Saarion invited everyone to try out this new game. Saarion described the different discs used and how the game is played., Saarion stated that this disc golf course is located at Silver View Park and it is a sport everyone can take part in. Saarion also reported that a tape will be played for the month of June • on Cable TV regarding the disc golf game. Rules and score cards can be picked up at City Hall. This course was paid for by Park Dedication Funds. ' Report of Attorney: Jim Thomson, City Attorney, had no report. Mayor Linke announced the dates for the upcoming Council Work Session and next Council Meeting.
