PLEDGE OF ALLEGIANCE ROLL CALL MEMBERS PRESENT: .Mayor Linke, Councilmembers Trude, Wuori, Blanchard and Quick. MEMBERS ABSENT: None ALSO PRESENT: Samantha Orduno, City Administrator; Mike Ulrich, Public Works Supervisor; APPROVAL OF MINUTES MOTION/SECOND: Wuori/Trude to approve minutes of October 11, 1993 as amended. Councilmember Trude asked that the minutes be amended by adding, "naming parks after their locations not after people or organizations" on page 9, paragraph 1, line 11. Councilmember Blanchard also asked that the minutes be amended by removing "County" from page 9, paragraph 3, line 6. VOTE: 5 ayes 0 nays Motion Carried SPECIAL ORDER OF BUSINESS: There was no special order of business. Mounds View City Council Page Two • Regular Meeting October 25, 1993 CONSENT AGENDA Samantha Orduno, City Administrator, read the Consent Agenda. Mayor Linke asked if there were any items the Council desired removed from the Consent Agenda. Councilmember Trude asked that Item D. be removed from the Consent Agenda for discussion. MOTION/SECOND: Quick/Blanchard to adopt the Consent Agenda minus Item D. VOTE: 5 ayes 0 nays Motion Carried Councilmember Trude asked what the Lion's Club does with the funds from the charitable gambling events. Mayor Linke introduced the President of the Lion's Club, Bob Wharton, to explain what is meant by premise permit applications and to give some background on the request for premise permit applications and also to • briefly explain how the proceeds from the charitable gambling events are spent. Mr. Wharton explained the procedure of obtaining the premise permits for the three establishments in Mounds View -- Robert's Off 10, Donatelles Supper Club and Mermaid Supper Club. Mr. Wharton presented the Council with a list of Charitable Gambling Donations made by the Lion's Club. Mayor Linke added that 75 percent of the funds remained in the City of Mounds View or immediate surrounding area. Mayor Linke stated that 25~ more than what was donated was given to the State. Councilmember Trude asked Mr. Wharton to explain how the Lion's Club finds out about those in need. Mr. Wharton explained the application process and the fact that these applications visit two committees before coming to the full membership for a vote. MOTION/SECOND: Blanchard/Wuori to Adopt Resolution No. 4434 Approving Premise Permit Applications for the Lion's Club to Permit Charitable Gambling at the Mermaid, Donatelle's and Robert's Off 10 -VOTE: 5 ayes 0 nays Motion Carried RESIDENTS REQUESTS AND COMMENTS FROM THE FLOOR There were no requests nor comments from the residents at this meeting . concerning any issues not on the agenda. • Mounds View City Council Page Three Regular Meeting October 25, 1993 PUBLIC HEARINGS a. 7:05 p.m. - Consideration of Off-Sale Intoxicating Liquor License for Stanley Murzyn, 2840 Highway 10 Mayor Linke called the public hearing to order at 7:12 p.m. Michele Severson, Administration Secretary, reported that Mr. Murzyn had provided the City with all required information with regard to the licensing of off-sale intoxicating liquor establishments per City Code. Severson further stated that as a part of Resolution No. 4438, a contingency to the liquor licensing stipulates that available off- street parking on the site will be provided according to the plan provided by the property owner dated December 8, 1992 and approved by the City Council by the adoption of Resolution No. 4410. Severson also stated that Paul Harrington, City Planner, had visited the site and the paving is near completion and the striping has not been completed. • Mayor Linke closed the public hearing at 7:17 p.m. MOTION/SECOND: Trude/Blanchard to Adopt Resolution No. 4438 Approving Off-Sale Intoxicating Liquor License for Stanley Murzyn, 2840 Highway 10 VOTE: 5 ayes 0 nays Motion Carried b. 7:06 p.m. - Continuation of Public Hearing Regarding Potential _Revocation of Conditional Use Permit, 3030 County Road J Mayor Linke continued the public hearing regarding the potential revocation of conditional use permit, 3030 County Road J at 7:18 p.m. Mayor Linke explained that Jim Thomson, City Attorney, recommended continuing this public hearing to the November 8, 1993 Council Meeting. Consideration of Approval of the Contract Between the Spring Lake Park, Blaine and Mounds View Fire Department and the Twin City Army Ammunition Plant (TCAAP). Samantha Orduno, City Administrator, • Mounds View City Council Page Four Regular Meeting October 25, 1993 explained that in an effort to reduce the costs to the three cities, the Fire Department has successfully negotiated a contract for fire services with the Twin Cities Army Ammunition Plant (TCAAP). Orduno stated that it is a very good contract, one that represents a fine example of intergovernmental cooperation and an opportunity to reduce the three cities budget amount for fire services. MOTIONJSECOND: Quick/Trude to Approve the Contract for Fire Services between Spring Lake Park - Blaine - Mounds View - Fire Department and the Twin City Army Ammunition Plant (TCCAP) VOTE: 5 ayes 0 nays Motion Carried B. Consideration of Resolution No. 4437 Supporting the Award of the County .Hazardous Waste Management Contract to Dynex Industries of Mounds View Samantha Orduno, City Administrator, explained that Dynex has held the contract with the County since 1991 and has provided exceptional service not only to the City of Mounds View but to the entire County. Orduno further stated that Dynex has a fine reputation in the community as a business and has also been an outstanding partner in many public/private cooperative efforts in the City. • Orduno read a letter from Zach Hansen, Manager, Ramsey County Department of Public Health, Division of Solid Waste, explaining to the City that Dynex is one of three facilities being considered for the Ramsey County hazardous waste management contract. Orduno then introduced Brian Sjoberg, President of Dynex. Mr. Sjoberg introduced Don Wodich, Environmental Manager and General Counsel for .Dynex, Industries. Mr. Wodek presented a brief history of Dynex with regards to the County contract that Dynex has held since 1991 Mr. Wodek asked that the City Council support Dynex in its efforts to be awarded the hazardous waste management contract for the County of Ramsey for the year 1994 and beyond. Councilmember Trude asked Mr. Wodek to give a brief explanation of what happens to the hazardous .waste materials collected by Dynex. • Mr. Wodek explained that most of the items collected are latex paints and pesticides. The latex paints are shipped to Toledo where they are incinerated and turned into binder for cement block. The pesticides are shipped to Arkansas and incinerated for disposal. Mr. Wodek stated that there are approximately 8,000 residents using the facility and stated the hours and days of operation. Mr. Wodek also mentioned that there is no charge to the residents for this hazardous waste collection. Mounds View City Council Page Five Regular Meeting October 25, 1993 MOTION/SECOND:, Quick/Blanchard to adopt Resolution No. 4437 Supporting the Award of the County Hazardous Waste Management Contract to Dynex Industries of Mounds View Councilmember Wuori is a user of the facility and stated that Dynex is a wonderful site with a very professional and courteous staff. Wuori stated that she has never had to wait more than 2 to 3 minutes before being helped. • VOTE: 5 ayes 0 nays Motion Carried C. Consideration of Patching Contract Approving Pay Request of $44,137.37 to Bituminous Consulting, Inc. to be Funded from Account No. 100-4270-705 Mike Ulrich, Public Works Supervisor, explained that the City Council awarded the patching contract to Bituminous Consulting, Inc. in August for a sum of $33,547.75. Ulrich stated that to complete a more thorough job some repairs were extended resulting in a more effective, efficient use of funds, considering that staff would not have to repair questionable areas that could result in temporary patching of potholes in the early spring and permanent patches during the summer. Ulrich stated that the City had received $50,150.00 in payment requests and anticipates approximately $7,000 more. Ulrich explained that the City .has been very pleased with the work performed by the contractor.. Ulrich further stated that the contractor, where possible, fixed dips in front of driveways and mailboxes. Councilmember Trude had heard-from many residents what a good job had been done on the streets. Trude stated the contractor spent a lot of time and took a lot of care to complete an excellent job on the roads. MOTION/SECOND: Trude/Quick to Approve Patching Contract Pay Request In the Amount of $44,137.37 to Bituminous Consulting, Inc. to be Funded From Account No. 100-4270-705 • VOTE: 5 ayes 0 nays Motion Carried D. Consideration of Agreement with GME for Geotechnical and Hydrogeological Ana psis for the Proposed Golf Course Site Samantha Orduno, City Administrator, explained that field explorations, geotechnical testing and environmental site assessments as well as work with the MPCA and EPA would be conducted by GME to determine site readiness. Orduno stated that the cost for these services would be $7500 which had already been allotted as part of the costs of development of the golf course. Mounds View City Council Page Six Regular Meeting October 25, 1993 Councilmember Trude asked if these tests have to be conducted before the City closes on the properties. Orduno explained that the tests would be completed before the purchase agreements were signed.: These tests can be completed before closing with written permission. REPORTS' 1. The-City will be hosting a flea market/boutique on Saturday, October 30th at Edgewood Middle School. The Lioness' will be serving food and beverages. U b. The Mounds View Lions Club will be holding a pasta dinner on November 11, 1993. Tickets are $6.00 for adults and $3 for children. Mayor Linke will be selling tickets. 3. Report of Administrator At the October 6th Planning Commission the members unanimously recommended Jerry Peterson to serve as Chair of this Commission to finish out Peg Mountin's term. The Planning Commission has asked the Council to approve this recommendation. MOTION/SECOND: Linke/Quick to Approve the Appointment of Jerry Peterson as Chair of the Planning Commission to Finish Out Peg. Mountin's - December 31, 1993 VOTE: 5 ayes 0 nays Motion Carried Orduno commented that this leaves a vacancy on the Commission, the City has two applicants that had previously filled out applications approximately one year ago. 4.
