PLEDGE OF ALLEGIANCE The Pledge of Allegiance was said. ROLL CALL MEMBERS PRESENT: Councilmembers Rickaby, Wuori, Quick, Blanchard and Linke. ALSO PRESENT: Clerk-Administrator Orduno and City Attorney Barney ~ROVAL OF MINUTES: March 18, 1991 Special Meetintx MOTION/SECOND: Quick/Blanchard to approve minutes of March 18, 1991 Special Meeting 5 ayes 0 Nays Motion Carried March 25, 1991 Regular Meetincr MOTION/SECOND: Wuori/Quick to approve minutes of March 25, 1991 Regular Meeting 5 ayes 0 Nays Motion Carried SPECIAL ORDER OF BUSINESS: Mayor Linke proclaimed May 19, 1991 through May 25, 1991 as National Public Works Week in the City of Mounds View. RESIDENT'S REQUESTS AND COMMENTS FROM THE FLOOR: Alice Frits, 8072 Long Lake Road had questions regarding the compost site on Ardan Avenue. Alice inquired as to the definition of "woody materials". Planning Technician Paul Harrington gave the definition of woody materials as non-soft body materials, i.e. tree limbs, branches and twigs. ice Frits reported that on Wednesday a gentleman with a Load of brush was c.urned away from the compost site. This person returned on Friday and was unds View City Council Page Two ~gular Meeting April 8, 1991 reported to City Hall by Ms. Frits. The Public Works Department was dispatched to the compost site and found no one dumping. The Police Department also was dispatched to the compost site. On Saturday, April 6, 1991 it was reported that this same person was chipping tree limbs at the site and disposing of the chips there. Ms. Frits questioned how the wood chips would be separated from the compost and if this would be an extra cost to the residents as a result of the chips having to be removed from the compost. Residents should be informed as to what can be dumped at the compost site. Clerk-Administrator Orduno suggested that activity of this type should be reported to her or to the Public Works Director, Ric Minetor. Bill Frits, 8072 Long Lake Road asked who hired the attendant at the compost site. Councilmember Wuori questioned whether there was a sign at the compost site describing what is acceptable and what is not acceptable. Bill Frits affirmed that there is a sign posted describing what can and nnot be accepted. The attendant also passes out a slip to each car as to ~e hours of the site. Bill Frits also asked who was working on County Road J as there is a large sign which reads, "This road closed effective April 15." Clerk-Administrator Orduno will check on what is being done on County Road J. The assumption of the Council was Ramsey County was working on it. PUBLIC HEARING: Conditional Use Permit, John Engberg, 3030 County Rd. J Mayor Linke opened the public hearing at 7:16 p.m. Paul Harrington reviewed the request by John Engberg for the Conditional Use Permit. Mayor Linke closed the public hearing at 7:18 p.m. Mr. Alan Johnson introduced himself at this time as being Mr. Engberg's attorney. Mayor Linke introduced Resolution No. 4067 Approving the Request by John Engberg for a Conditional Use Permit to allow an Oversized Accessory Building on his Property at 3030 County Road J MOTION was made by Councilmember Rickaby to deny Resolution No. 4067 Approving the Request by John Engberg for a Conditional Use Permit to Allow an Oversized Accessory Building on His Property at at 3030 County Road J unds View City Council ~gular Meeting Page Three April 8, 1991 Motion failed due to lack of a second. MOTION/SECOND: Linke/Quick to approve Resolution No. 4067 Approving the Request by John Engberg for a Conditional Use Permit to Allow an Oversized Building on His Property at 3030 County Road J Councilmember Rickaby explained her reasoning for denial of this resolution. Councilmember Rickaby states that if the City approves this Conditional Use Permit it will set a precedent to our code by renaming certain structurs and still being able to put up another garage. Councilmember Rickaby stated that she felt putting up a wall did not make one portion a porch and one portion an accessory building. Councilmember Rickaby felt that the garage door should be removed and windows or screens added to the portion called porch in order for her to approve the Conditional Use Permit. Mayor Linke asked Councilmember Rickaby if she would like to amend the previous motion to include that the garage door be removed and windows be added. MOTION/SECOND: Rickaby/Blanchard to amend original motion by adding that the garage door be removed and windows or screens added to the portion of the accessory building called a porch. 1 aye 4 nays MOTION FAILED City Attorney Barney stated there are no requirements that order the garage door be taken off. The tracks and hardware could be taken off making the door non-operable but the City has no authorization to require the door be taken off. Councilmember Rickaby stated that anything reasonable then could be called a porch. City Attorney Karney again stated that the City would be liable for a lawsuit because the City has no authorization to require the door be taken off. Councilmember Wuori states there is a list of contingencies that must be followed. The concrete apron cannot be within five feet of the accessory building, no cars can be stored in the building unless they are collector vehicles as cars cannot be stored in a porch. Planning Technician Harrington stated that the City cannot control what homeowners decide to call their own structures. • If a homeowner wants to call it a porch that is up to him but essentially what it is is a cold storage portion of his home. unds View City Council ~gular Meeting Page Four April 8, 1991 Mayor Linke concurred with Councilmember Rickaby but also felt that Mr. Engberg had met all requirements. Councilmember Rickaby states that she felt that if this "porch" acts like a garage, walks like a garage, quacks like a garage then it should be a garage, otherwise we can call any structure anything we want and then build another garage. Mayor Linke called for a vote on the first motion made and seconded by Councilmember Quick to approve Resolution No. 4067. 4 ayes 1 nay MOTION PASSED APPROVAL OF THE CONSENT AGENDA MOTION/SECOND: Wuori/Blanchard to approve the Consent Agenda as presented. 5 ayes 0 nays MOTION CARRIED ~CIL BUSINESS: 1. Consideration of Staff Memorandum Regarding Spring Clean Up Day Fees Clerk-Administrator Orduno reviewed the proposed fee schedule for the 1991 Spring Clean Up Day. Orduno stated the fees were raised because of increased costs to the City from the haulers for these items. Orduno noted two new services that are available this year: 1) Goodwill charge of $5 per load; and 2) brush - $5/$10 depending on load size. Alice Frits, 8072 Long Lake Road questioned why there is a charge for Goodwill. Councilmember Wuori responded that Goodwill has always charged the City but now the City is returning the charge to the residents. Alice Frits questioned if any other agencies have been contacted who collect the same types of items as Goodwill and why Goodwill was selected. Orduno replied that Goodwill was easy to work with. • Alice Frits commented that maybe the City should contact Disable American Vets as they collect the same types of items. unds View City Council ~gular Meeting Page Six April 8, 1991. MOTION/SECOND: Wuori/Quick to approve fee schedule for 1991 Spring Clean Up Day 5 ayes 0 nays MOTION CARRIED REPORTS: 1. Report of Attorney - No report 2. Report of Councilmembers Councilmember Wuori - No report. Councilmember Quick - No report. Councilmember Blanchard - The Local Government Committee heard and approved a measure that allows local governments the option of not complying with a state mandate if the state does does not provide sufficient funding. The bill, authored by Sen. Jim Vickerman (DFL-Tracy), places a sunset of five years on all mandates imposing an accumulative, • non-funded fiscal impact of more than $50,000 per year to all local units of government, unless explicitly reenacted by law. The bill was referred to the Governmental Operations Committee. Residents should contact their legislators and ask them to follow up on this bill and vote for its passage. 3. Report of Mayor: o Mayor Linke announced that there are two openings on the Planning and Zoning Committee and invited anyone interested to stop in and fill out an application or to contact a councilmember for more information regarding the committee. o Environmental Quality Task Force also has some openings.
