PLEDGE OF ALLEGIANCE The Pledge of Allegiance was said. ROLL CALL MEMBERS PRESENT: Councilmembers Rickaby, Wuori, Quick, Blanchard and Mayor Linke. ALSO PRESENT: Clerk-Administrator Orduno, City Attorney Barney, Finance Director-Treasurer Don Brager, Public Works Foreman Mike Ulrich, and Parks, Recreation and Forestry Director Mary Saarion. APPROVAL OF MINUTES: April 8, 1991 Regular Meeting MOTION/SECOND: Wuori/Quick to approve minutes of April 8, 1991 Regular Meeting 5 ayes 0 Nays Motion Carried SPECIAL ORDER OF BUSINESS: - On behalf of the City, Mayor Linke presented Resolution No. 4070 Regarding Recognition for Being the First Student to Represent District 621 in the Star Tribune State Spelling Bee to Mark Gibson, a student at Edgewood Middle School. Also present with Mark was Penny Howard, principal of Edgewood Middle School. - Mayor Linke proclaimed April 24, 1991 as Arbor Day and the month of May as Arbor Month in the City of Mounds View. - On behalf of the Lion's Club, Mylo Gjerde President of the Lion's Club,presented the City of Mounds View with a check in the amount of $2100 for the DARE Program activities. unds View City Council ~gular Meeting RESIDENT REQUESTS AND COMMENTS FROM THE FLOOR: Greg Johnson, 2865 N.E. Highway April 8th meeting minutes which was "residential in character." a statement. He further stated to rezone his property and began conditions of the Comprehensive Page Two April 22, 1991 10, expressed his disagreement with the stated that he had said that his property Mr. Johnson stated that he never made such that he intends to sue the City for failure 1 questioning Councilmember Blanchard about Plan and what properties will be downzoned. City Attorney Barney stated that if there was a litigation in the mill the City Councilmembers do not have to submit to interrogation during a Council Meeting. No further comments were made regarding this matter. PUBLIC HEARINGS: No public hearings were scheduled. APPROVAL OF THE CONSENT AGENDA City Administrator Orduno read the Consent Agenda. MOTION/SECOND: Blanchard/Quick to approve the Consent Agenda • as presented. 5 ayes 0 nays MOTION CARRIED COUNCIL BUSINESS: 1. Approve Resolution No. 4069 Relating to the Issuance of Certain General Obligation Bonds for Fire Protection Purposes and Levying Taxes for the City's Share Thereof Finance Director Don Brager informed the Council that the City's share of the issue is $1,012,375. Bill Frits, 8072 Long Lake Road had many questions regarding sewer bonds that were sold 30 years ago and the City's charging over the percentage rate quoted to residents by 2-5~. One concern was the disposition of the surplus monies, are they ever returned to the residents. Finance Director Don Brager and Mr. Ron Langness from Springsted, the City's financial consultant responded to Mr. Frits' questions. The explanation was that .whether it was special assessments or property taxes the state statutes require that the Cities levy more than the annual debt service to allow for delinquent taxes. unds View City Council ~gular Meeting With regards to the question regarding surplus monies in the fund, those monies can be used to pay off the bonds or to reduce property taxes. City Attorney Karney also stated that any excess or surplus monies are reported and he gave an example from several months ago of the unused monies from the Everest Development project. Tamara Hessburg, 7635 Woodlawn Drive asked if surplus funds were given back to the taxpayers or do they always stay in the fund? Finance Director Brager responded by saying it varies with each situation. Many times these funds are used to keep levy limits down and at other times they may be used for street repairs or sealcoating so the resident does benefit or see a return of these funds. Approve Resolution No. 4073 Providing for the Issuance and Sale of $2,875,000 General Obligation Water Revenue Bonds, Series 199].A Finance Director Don Brager introduced Mr. Ron Langness, Springsted, the City's Financial Consultant. Mr. Langness discussed details of the $2,875,000 General Obligation Water Revenue Bonds issue. MOTION/SECOND: Wuori/Rickaby to approve Resolution No. 4073 Providing for the Issuance and Sale of $2,875,000 General Obligation Water Revenue Bonds, Series 1991A 5 ayes 0 nays Motion Carried 3. Consideration of Appointments to the Land Use Study Task Force Parks, Recreation and Forestry Director Mary Saarion reviewed the list of names submitted for the Land Use Study Task Force. It was suggested that the task force consist of 9 members; 2 Councilmembers, 3 staff personnel, unds View City Council ~gular Meeting Page Four April 22, 1991 1 Parks and Recreation Commission Member, 1 Planning Commissioner and 2 at large community residents. The Council was asked to approve 2 names from the list provided. MOTION/SECOND: Quick/Blanchard to appoint Tom Fischer and Stephanie Shaner to the Land Use Study Task Force. 5 ayes 0 nays Motion Carried 4. Consideration of Staff Report Regarding Purchase of Seeder for Public Works Public Works Foreman Mike Ulrich presented the details regarding the purchase of the seeder. Foreman Ulrich stated that a truck and vacuum system were purchased for under the budgeted amount. The seeder is over the budget amount by $610. Public Works Foreman Ulrich asked the Council if some of the money saved from being under budget could be utilized to purchase the seeder. The amount under budget was approximately $1700. Mayor Linke congratulated Public Works Foreman Ulrich for a great job done in purchasing the truck and vacuum system under the budgeted amount. Councilmember Blanchard inquired as to why the seeder came in over budget. Public Works Foreman Ulrich explained that the City's current seeder has only one capability and the new seeder has multi-function capabilities. The cost of the old single function seeder has come down some, therefore, the trade in value is less on the new seeder. MOTION/SECOND: Quick/Blanchard to approve purchase of seeder utilizing a portion of the money saved from the truck and vacuum system. 5 ayes 0 nays Motion Carried 5. Consideration of Resolution No. 4074 Regarding Approving the Variance Request of Charles Cook, 2673 Sherwood Road City Administrator Orduno reviewed this resolution before the Council. The homeowner is asking for a variance to allow the construction of a single family home at a 30 • foot setback where a 58 foot setback is required by a previous planning action. unds View City Council ~gular Meeting Page Five April 22, 1991 Jerry Ruhland, 8121 Red Oak Court was concerned with the fact that his children play between the house and Sherwood Road and with a 30 foot setback children could not see cars coming down Sherwood. Mr. Ruhland asked if Mr. Cook could come out and stake the property so he could get a better idea of how things were going to be placed. Bill Frits, 8072 Long Lake Road inquired as to why this particular case was a hardship case. Who plotted the lot? Mayor Linke explained that the lot is very narrow and this should have been caught by the City but was not. City Attorney commented that a 30' easement is the minimum easement that the City grants. Report of Mayor: o Mayor Linke announced that there is a Joint Meeting of the Ramsey County Cities scheduled for Saturday, April 27th at Mounds View City Hall Regarding the Continued Discussion of Municipal Cooperative Efforts. o Mayor Linke also announced that the City Council has been invited to the unveiling of the band trailer for the Irondale Knights Marching Band on Saturday, April 27th at 1:00 p.m. at Irondale High School. 2. Report of .Administrator: City Administrator Orduno received a memorandum from Public Works Director/City Engineer Ric Minetor regarding the City's Building Official. Orduno stated that the City had contracted with the City of Blaine for Building Inspection services until the end of April. This arrangement has not been working effectively and to the City's benefit . Page Six April 22, 1991 In the memo, Public Works Director Minetor stated that we need someone in-house on a part-time temporary basis to do the building inspections. Orduno asked the Council to consider authorizing staff to pursue the hiring of a Building Inspector on a temporary, part-time basis until the position can be fully evaluated. City Administrator Orduno stated the County was doing some roadwork on this road. The closing date has been extended to April 23, 1991. City Administrator Orduno also reported on the continuing saga of the Ramsey County cooperative efforts. Orduno attended a meeting of the Ramsey County League of Local Governments to discuss the many various pieces of legislation currently coming forth. One of these pieces of legislation was a bill proposed by Senator Cohen of St. Paul which would establish a consolidation commission to unds View City Council ~gular Meeting Page Seven April 22, 1991 look into service delivery processes and make a determination as to what services can be cooperatively shared. Ramsey County cities had requested that the Ramsey County League of Local Governments, which was created by the legislature, conduct the study. However, the legislature will mandate who will conduct the study. The Ramsey County delegation has given approval to the creation of a 6 member board or commission to investigate the concept of a suburban center which-would eliminate New Brighton Municipal Court and Maplewood Municipal Court. City Administrator Orduno announced the Goal Setting Session that will be attended by Council, Department Heads and staff on the 10th and 11th of May at the IDS Conference Center in Chaska, Minnesota. • 4. Report of Staff: Finance Director-Treasurer Don Brager introduced Mr. Charles Clysdale from the MacGuire Agency, the City's insurance agency, who introduced the City's insurance proposal received from the League of Minnesota Cities. Renewal of the City's insurance coverage with the League of Minnesota Cities will be $142,255. MOTION/SECOND: Quick/Rickaby to approve the renewal of the City's insurance coverage with the League of Minnesota Cities at a rate of $142,255. 5 ayes 0 nays Motion Carried 5. Report of Attorney: City Attorney Barney commented that if the New Brighton and Maplewood Courts are moved downtown as part of a suburban center the cost to Mounds View will be 1/2 again of its current prosecution budget.
