Call to Order to order by Mayor Linke at 7:01 p.m. on Monday, January 28, 1991. The Pledge of Allegiance was said. MEMBERS PRESENT: Councilmembers Wuori, Quick, Blanchard, Rickaby and Linke. ALSO PRESENT: City Attorney Barney, Acting Clerk/Administrator Minetor, Finance Director Brager, and Parks, Recreation and Forestry Director Saarion and Public Works Foreman Mike Ulrich. tion Second: Rickaby/Quick to approve anuary 14, 1991 minutes as presented. 5 ayes 0 Nays 2. Approval of January 14, 1991 Minutes Motion Carried Mayor Linke explained that due to the 5. death of his mother, Finance Director Brager would be unable to be at the Council Meeting for the Presentation of the Budget Award. Mayor Linke announced that Pam Rose was unable to be present to accept the resolution of commendation for her service to the City Council and Planning Commission as Recording Secretary. Motion/Second: Wuori/Blanchard to adopt Resolution No. 4046 commending Pam Rose as Recording Secretary. Acting Clerk- Administrator Minetor read the resolution. 5 ayes 0 nays Special Order of Business: Presenta- tion of Budget Award Presentation of Resolution 4046 Commending Pam Rose as Recording Secretary Motion Carried • mounds View City Council January 28, 1991 lar Meeting Page Two --------------------------------------------------------------------------- Parks, Recreation and Forestry Director Saarion reported copies of the 1990 Annual Report from the Parks, Recreation and Forestry Department for the general public to review. Ms. Saarion presented a recap of 1990 highlights for the department, major improvements made in the parks, and also reviewed the 1991 departmental goals. Public Works Foreman Mike Ulrich reviewed the accomplishments in the water and sewer, streets, parks, and garage divisions of the Public Works Department for the year 1990. Mr. Ulrich also presented many statistics regarding snowplowing and sanding and compared them to last year. Bill Frits, 8072 Long Lake Road asked for clarification of the monetary return from Everest Development regarding the Contract for Private Redevelopment. ~ty Attorney Karney explained the matter in detail stating that the funds received from Everest Development were Tax .Increment Financing Funds and would have to be used in accordance with state laws. Acting Clerk-Administrator Ric Minetor further explained the ways in which these funds could be put to use. 1990 Fourth Quarter Department Head Reports 5. Residents Requests Mayor Linke closed the regular meeting and 6. opened the public hearing at 7:38 p.m. Planning Technician Harrington reviewed the circumstances revolving around the variance request by John Engberg to allow 1,644 square feet of accessory building area where only 1,264 feet is allowed by Mounds View Municipal Code. I The Planning Commission has denied the request ~r a variance. mounds View City Council January 28, 1991 lar Meeting Page Three --------------------------------------------------------------------------- Mr. Engberg stated that he had been working with the City to try to resolve the problem. Lonny Gee, 8462 Pleasantview Drive stated that due to Mr. Engberg's all concrete driveway that last spring when there was a heavy thaw Mr. Engberg had a drainage problem and pumped water into his backyard. Mr. Engberg believes he has resolved that problem by adding 40 feet of drainage tile. Mayor Linke stated that it is his under- standing that Mr. Engberg did not obtain a building permit to construct the accessory building that is in question. Councilmember Rickaby stated that she believes too much concrete is a problem. She .would like to see square footage of concrete kept to a minimum. Mayor Linke closed the public hearing and opened the regular meeting at 7:45 p.m. Motion/Second: Wuori/Rickaby to approve Resolution No. 4038 denying the variance request by John Engberg, 3030 County Road I. 5 ayes 0 nays 7. Consideration of Resolution No. 4038 Motion Carried Mayor Linke closed the regular meeting and 8. Public Hearing: opened the next public hearing at 8:10 p.m. Consider Land Division, 2601 and 2617 Sherwood Rd. Wayne and Barb Depew Planning Technician Harrington reviewed the land division explaining that it was merely a reconfiguration of lot lines to be able to sell one lot. Verna Lauterbach, 8193 Eastwood questioned whether Greenwood would be extended. Discussions followed regarding what is necessary for Greenwood or any road be extended in terms of a petition. ~unds View City Council January 28, 1991 gular Meeting Page Four -------------------------------------------------------------------------- Mayor Linke closed public hearing at 7:52 and opened the regular meeting. Councilmember Quick inquired as to the status of the water bill on the property. Acting Clerk-Administrator Minetor stated that the amount due had been certified on the property taxes for this year. City Attorney Barney concurred that the amount .due is already on the tax roles and will be collected. Mayor Linke closed the public hearing and opened the regular meeting at 7:52 p.m. MotionlSecond: Blanchard/Wuori to adopt 8. Consideration of Resolution No. 4040 Approving the Land Resolution No. vision Request at 2601 and 2617 Sherwood 4040 ad, Wayne and Barb Depew. 5 ayes 0 nays Mayor Linke opened the next public hearing at 7:54 p.m. Planning Technician Harrington reviewed the rezoning request of Greg Johnson to have his property rezoned from R-0 to B-3. Mr. Greg Johnson stated that his property is residential in character. His property would become more saleable if rezoned from R-0 to B-3. Discussions evolved around the previous lawsuit against the City regarding the radiator shop owned by Mr. Johnson. Motion Carried 9. Public Hearing: Rezoning Request for 2865 Highway 10, Greg Johnson Mayor Linke stated that the Comprehensive Plan would be finalized this spring. Ray Dro11, 8080 Groveland Road also states he opposes this rezoning as he feels these other properties would be affected. Mayor Linke closed the public hearing at 8:04 p.m. and opened the regular meeting. Motion/Second: Rickaby/Wuori to adopt 10. Set Public for February 11, 1991 at 7:05 p.m. Hearing Motion/Second: Quick/Blanchard to approve the date of February 11, 1991 at 7:05 p.m. for a public hearing on Surface Water Management. Councilmember Rickaby requested that at the public hearing or before we have a more thorough review of the impact of each proposed capital improvement on the amount of runoff that will leave Mounds View through the drainage system, itemization of $20,000 to implement utility - admininstrative costs, trim the plan to be more cost effective and still meet the State mandates. 5 ayes 0 nays Motion Carried Acting Clerk Administrator Minetor stated 13. Duane McCarty, 8060 Long Lake Road, stated he served on the Wetlands Ordinance Committee. Mr. McCarty congratulated Mounds View for appearing in the Metro News Report under DNR news regarding the wetland ordinance. Mr. McCarty brought up the subject of "No Net Loss" with regards to wetlands. He felt it would be something that should be looked into. Acting Clerk-Administrator Minetor stated that at this time there is no agreement in the State Legislature as to what the rms of "No Net Loss" would be. There is no ear definition. Mr. Minetor stated that the ordinance had been researched and reviewed by the City's Environmental Quality Task Force. Mr. Minetor also indicated that if desirable "No Net Loss" could be inserted into the City's ordinance in the future. Councilmember Quick had no report. Councilmember Blanchard reported that she had received a copy of the Metro Monitor regarding Metropolitan Council picking three sites at the airports. She announced there will be a public hearing on February 26 from 7-9:30 p.m. at the Isanti Middle School in Isanti concerning the northern site. Councilmember Rickaby had no report. Mayor Linke had no report, however, did state that the City's new Clerk- Administrator, Samantha Orduno, would begin her new position on Monday, February 4th. 16.
