RESIDENTS REQUESTS AND COMMENTS FROM THE FLOOR: There were no comments from the floor. PUBLIC HEARINGS: Mayor Linke opened the public hearing for the On-Sale Intoxicating Liquor License Renewal for Robert's Off 10 at 7:05 p.m. Mr. Bill Zwieg, 5292 Edgewood Drive, stated the following: Robert's disposes of .glass bottles at approximately 1:30 a.m. which creates a noise disturbance. Stated .that the outdoor party recently held was unknown to him until the bandstand was set up. The residents weren't advised of this concert. How did Mr. Waste get a permit to do this? Mayor Linke responded that no permit is necessary for the outdoor concerts. Mayor Linke also stated that Mr. Waste had notified the Council of the event well ahead of time and that it was advertised on the radio and newspapers. Mr. Zwieg asked if there were any regulations regarding noise during the day. Mayor Linke stated that the City has a noise ordinance but it is rather difficult to enforce during the day. Councilmember Rickaby stopped by the concert and stated the music was rather loud. Rickaby talked to the manager and advised him that there had been some residential complaints. The manager assured Councilmember Rickaby that when the next band came on stage he would have them turn down the music. Mr. Zwieg commented that it would be nice if the residents could talk to Mr. Waste and come up with a suggestion for the stage so that it wouldn't bother the neighbors as much. ~yor Linke stated he would keep that in mind when talking with Mr. Waste out the next outdoor concert if there would be another. unds View City Council ~gular Meeting Page Three June 24, 1991 Councilmember Rickaby stated she made a comment to the manager that maybe in the future the neighbors could be advised ahead of time when an outdoor concert would be held. Councilmember Rickaby also stated that another resident, Ms. Grace Zwieg, 5309 Greenfield, told her that she was not aware of an outdoor concert until Robert's personnel roped off her garden. Mr. Zwieg also stated that a berm with pine trees had been part of the agreement when Robert's Off 10 came into business. The berm kept garbage from being disposed of on his property. The berm also helped with head lights shining in the windows. Mr. Zwieg states he continually picks up bottles and papers from his property. The berm is no longer there and the pine trees have been taken out. Mayor Linke will check with regards to the berm and pine trees with staff and then with Mr. Waste, owner of Robert's Off 10. Mr. Zwieg suggested that a fence be constructed from the parking lot north and south, between the building and the property line would help keep people in the parking lot area and persons from cutting across into the parking Iot. ~yor Linke stated that the Fire Department needs free access to the building from all sides and a fence would prevent this access. Mr. Ron Michna, 5287 Edgewood Drive, stated the following with regards to Robert's Off 10: Public urination on his yard as well as the neighbor's yards. No entrance or exit signs on the driveway. Mr. Michna states that he was almost hit from people leaving the parking lot due to no signage, the berm being destroyed and the pine trees removed. Mr. Michna stated that he has suggested to the former owner that there are electrical boxes on the west side of the building where lights could be installed and perhaps this would keep .the public urination and other unpleasant activities to a minimum. Mr. Michna was also concerned about the parking problems that are sometimes created by Robert's Off 10. Persons park along Edgewood to the Edgewood Middle School and along H2 and on Greenfield Drive. Mr. Michna questioned if perhaps Mr. Waste is in violation of the fire code. Who enforces the ordinance? unds View City Council ~gular Meeting Page Four June 24, 1991 Mayor Linke informed Mr. Michna that the Fire Department enforces the Fire Code. Mr. Michna stated that when he calls the Fire Department, they advise him to call 911. When he calls 911, they send the Police Department because they are closer to the area and can respond faster. Mr. Michna stated that there had been few problems regarding Robert's Off 10 and he doesn't want them to get out of hand. Mayor Linke closed the public hearing for Robert's Off 10 at 7:22 p.m. and opened the public hearing for the On-Sale Intoxicating Liquor License Renewal for Donatelle's Supper Club at 7:23 p.m. Mr. Ed Donatelle, 2400 Highway 10, asked about the intoxicating on-sale liquor license renewal fees. Samantha Orduno, City Administrator, explained the details surrounding the fees and how through past transposition errors, the fees were incorrect. Staff discovered these errors while calculating renewal fees for this licensing period. Fees are now correct and in accordance with the square footage of each building. Donatelle stated that if the fees were too high he may have to become a ~verage/alcohol establishment rather than a primary food establishment. Mayor Linke closed the public hearing for Donatelle's Supper Club at 7:27 p.m. Mayor Linke opened the public hearing for Mermaid Lounge at 7:27 p.m. There were no comments regarding this license, therefore, Mayor Linke closed this public hearing at 7:27 p.m. Mayor Linke opened the public hearing for B and R Liquor at 7:28 p.m. Samantha Orduno, City Administrator, stated that Mr. Waste had withdrawn his application for renewal for B and R Liquor. Mayor Linke closed the public hearing at 7:28 p.m. Mayor Linke opened the public hearing for Budget Liquor at 7:28 p.m. Hearing no comments, Mayor Linke closed this public hearing at 7:28 p.m. Mayor Linke opened the public hearing for Bel-Rae Ballroom at 7:29 p.m. Hearing no comments, Mayor Linke closed this public hearing at 7:29 p.m. CONSENT AGENDA: Mayor Linke asked the Council if there were any items that should be taken off of the Consent Agenda. Councilmember Rickaby stated that Robert's Off 10 was not in conformance with City Code per memo from staff dated June 24, 1991 referring to the requirement of food service for a Sunday liquor license. Councilmember Rickaby noted that she had questioned a resident at the recent outdoor concert about the type of food served by Robert's Off 10. 'ckaby was told that Robert's Off 10 serves hot dogs and hamburgers. unds View City Council lar Meeting Page Six June 24, 1991 Mayor Linke stated that all licenses should be approved contingent upon completion of requirements or corrections within 30 days of the date of their approval. Mr. Ron Michna stated that his belief regarding the liquor licensing was that when legislature set up the Sunday Sales for food establishments it was meant that these establishments sell food all week in order to sell liquor on Sunday. Councilmember Blanchard also stated that the intent was that these establishments serve food as well as the sale of liquor. Mayor Linke stated that in the past the City had required these establishments to submit a menu. Samantha Orduno, City Admininstrator, commented that she had walked into Robert's Off 10 at approximately 5:00 p.m, today and noticed there was no one sitting at the tables. Orduno asked for a menu and was advised that there are no menus. Orduno was also advised that they sometimes have hot dogs on Sundays. Mr. Bill Frits, 8072 Long Lake Road, stated that the City has heard the same complaints year after year regarding Robert's Off 10. Mr. Frits stated the City should take a stand and not issue a license until the ~tablishment was in conformance; don't issue under contingency. Mayor Linke stated that Mr. Waste has little control aver activities beyond his property. Linke also stated that in regards to the signs, they have nothing to do with his license, nor does the berm. These are more safety issues and zoning issues rather than licensing issues. Mayor Linke appreciates the comments from the residents and these are things to keep in mind when Mr. Waste advises the City of his outdoor concerts. City Attorney Karney advised the Council that these licensees are required to meet certain conditions in order to obtain a license such as insurance, current property taxes, current utilities , fire inspections, and health inspections. These are minor issues and the City would be setting itself up for a lawsuit if it did not allow these licensees to have a period of time to meet these conditions. Councilmember Quick further stated that the City did deny a license in the past and was sued by the establishment. The City did win in that suit, but the circumstances were very different and involved more than just the licensing requirements. City Attorney Karney explained that these comments that are being heard from the residents regarding the establishments are complaints rather than factors that would affect the license for the establishment. These complaints should be reported to the Police Department and then to the City ~orney's office. The complaints are not grounds for taking away a sense from an establishment. ands View City Council Page Seven ~gular Meeting June 24, 1991 Mr. Bill Frits suggested that Mr. Waste attend a meeting of staff and residents to talk about these problems. Councilmember Wuori asked when these licenses have to be renewed? Samantha Orduno, City Administrator, informed the Council that these licenses have to be renewed by July 1, 1991. This gives the City approximately one week to talk to Mr. Waste about these concerns. City Attorney Karney also advised the residents with complaints regarding Robert's Off 10 to speak directly to Mr. Waste. Councilmember Rickaby asked that the subject of outdoor concerts and off site parking related to these concerts be put on a future Work Session Agenda. Councilmember Wuori inquired as to whether this parking problem was only during the outdoor concerts of if the problem occurs every Friday and Saturday evening ? Councilmember Blanchard suggested that B and R Liquor be pulled from Item 3 as Mr. Waste is not renewing the B&R Liquor License. ~• Mr. Zwieg asked the Council to advise him of when there will be a meeting with Mr. Waste and where it would be held so he could attend. MOTION/SECOND: Wuori/Rickaby to approve renewal of on-sale intoxicating liquor license for Robert's Off 10, Mermaid Lounge, and Donatelle's contingent upon the fact that all mandatory require- ments are met within 30 days. 5 ayes 0 nays Motion Carried Mayor Linke removed B and R Liquor from the Off-Sale Intoxicating Liquor License Renewal list. Ric Minetor, Public Works Director/City Engineer reviewed Staff Report No. 91-36C regarding Resolution No. 4098 Establishing Design Standards for the Construction of Garbage Enclosures with the City. Minetor asked the Council whether or not they would require the dumpster enclosures to meet applicable side, rear and front yard setbacks. Councilmember Rickaby asked why dumpster enclosures have to be constructed on an impervious surface. Minetor stated that often liquid waste and snowmelt become a factor in making the ground mushy and the dumpsters sink and the hauler may damage fences trying to lift dumpster. Also, for aesthetic purposes it is much easier to keep the impervious surface clean and looking neat. Mayor Linke suggested that the enclosures be a minimum • of 6 feet in height so as to prevent garbage from being tossed into garbage into the enclosure area from a car. Mayor Linke also inquired if the dumpsters are attached to buildings do they need a top on them for fire code purposes? Minetor suggested that an Item 4 be added to the location section which would state that any enclosure attached to a building would have to meet all applicable fire and building codes. Councilmember Wuori expressed concern regarding the type of materials used to make the enclosures. She indicated chain link fence should not be used as it is easily vandalized and needs a lot of upkeep. Samantha Orduno, City Administrator indicated that most times requirements are stipulated that require the enclosure to conform or be consistent with the building's image. Samantha Orduno, City Administrator, reviewed Resolution No. 4096 Requesting the Metropolitan Council HRA to Apply for and Implement a Deferred Loan Program within the City of Mounds View. Orduno stated that press releases will be put in the local newspapers so that residents are made aware of the fact that these low income loans are available. Ric Minetor, Director of Public Works/City Engineer, reviewed Staff Report No. 91-38 Regarding the official zoning map to reflect the original intent of the rezoning action which was taken on May 14, 1984 by Ordinance No. 358 which, in part, created an R-5 Zone District. Two adjacent properties were inadvertently included in the legal description of the rezoning action. MOTION/SECOND: Quick/Wuori to direct staff to make the appropriate changes to the official Zoning Map to reflect the original intent of the rezoning action. 5 ayes 0 nays Motion Carried 4. Samantha Orduno, City Administrator, reviewed Staff Report No. 91-40C Declaring the Property Located on Groveland Road, Across From Groveland Park as City Owned Open Space. Orduno read the resolution so as to reiterate. the restrictions of designated Open Space as outlined in the City Code, Chapter 52. Councilmember Blanchard - Received the By-laws from the Fire Department regarding the Fireman's Relief Association. This document includes the deletions and changes that they are • planning to adopt in order to bring them into compliance with state laws. Councilmember Blanchard turned this document over to the City. Councilmember Rickaby would like two items place on the July 1, 1991 Work Session Agenda. They are as follows: Discuss the screening or lack of screening at the Public Works Building. Area). Revision of ordinances and programs regarding tree diseases in the City. Councilmember Wuori attended the League of Minnesota Cities Conference in Rochester. Wuori collected information that other Councilmembers may be interested in and will make it available to them in the City offices by their mail boxes. The conference was very informative, interesting and lots of fun. Mayor Linke's Report: Mayor Linke reminded everyone that the next regular meeting of the City Council will be Monday, July 8, 1991. Mayor Linke will meeting regarding the selection of committee Administrator's Report: G At their June 3rd, 1991 meeting Council directed staff to advertise and interview for the positions of Management Intern and also Planning Intern. On June 21, 1991 Samantha Orduno, City Admininstrator, interviewed seven very qualified candidates. Tim Cruikshank was selected as the candidate most qualified for the City of Mounds View's Management Intern position. Mr. Cruikshank has accepted a conditional offer of employment with the City pending Council approval. The wage will be $7.50 per hour. Interviews were conducted for Planning Intern. The candidate selected for this intern position is Carla Asleson. Ms. Asleson would start at $7.50 per hour. A transfer from the Local Government Reserve Fund into the salary accounts in the administration and planning budgets is needed to fund the two positions. Councilmember Blanchard asked if there was a job description for the engineering, planning and management intern. City Administrator Orduno handed out a job description for the management intern and explained the contents of the handout. Orduno also explained that these interns will augment staff activites and also receive valuable on-the- job training. MOTION/SECOND:. Quick/Wuori to approve hiring of Tim Cruikshank as Management Intern and Garla Asleson as Planning Intern at a salary of $7.50 per hour. These interns will begin their employment with the City of Mounds View on July 8, 1991. 5 ayes 0 nays Motion Carried Orduno also stated that the North Suburban Cooperative Commission which consists of Shoreview, Arden Hills, St. Anthony, New Brighton and Mounds View will meet to discuss cooperative efforts in terms of services/needs and equipment for cost minimizing. This meeting will take place on Wednesday, June 26, 1991 at 7:00 p.m. at the Shoreview Community Center because New Brighton did not have enough tables. • Mounds View City Council Regular Meeting Page Twelve June 24, 1991 Orduno also announced that City Hall would be closed on July 4th and 5th in observation of the July 4th holiday. Orduno passed out a copy of the Long Term Financial Plan to the Councilmembers. She announced that this document would be discussed at the July 1st Work Session. The public is welcome and encouraged to attend. Report of Staff: Ric Minetor, Director of Public Works/City Engineer reported to the Council that the candidate chosen for the Engineering Intern position was, John Hanson. Mr. Hanson will receive $7.50/hour and will receive no benefits other than Worker's Compensation and PERA, if applicable. Mr. Hanson's salary will be divided between the water and sewer departments. • MOTION/SECOND: Quick/Wuori to approve the hiring of John Hanson at $7.50 per hour with his salary being split between the water and sewer departments. Councilmember Blanchard asked if there was a position description or defined jobs for him to do. 5 ayes 0 nays Motion Carried Minetor also explained to the City Council that the Public Works Department always holds back the hiring of one seasonal employee to begin later so that the City can retain him later. Minetor proposed the hiring of Doug Dazenski at a wage of $6.00 per hour split between the water and sewer departments. Motion Carried R unds View City Council Page Thirteen gular Meeting June 24, 1991 Additional Information: Mayor Linke announced that the Irondale Marching Knights have received first place in 3 out of 4 parades. The last parade they received a 3rd place. Mayor Linke stated the Knights will be marching in parades in Grand Rapids on Saturday, Alexandria on Sunday and Roseville on Monday. Linke also stated were to march in a parade in Albert Lea very soon. Mayor Linke stated the band is fun to watch. The Knights will be marching on August 10 in connection with the Festival In The Park.
