PLEDGE OF ALLEGIANCE The Pledge of Allegiance was said. ROLL CALL MEMBERS PRESENT: Councilmembers Quick, Blanchard, Wuori, Rickaby and Mayor Linke. MEMBERS ABSENT: None ALSO PRESENT: Samantha Orduno, City Administrator, Ric Minetor, Public Works Director/City Engineer, Tim Cruikshank, Management Assistant APPROVAL OF MINUTES: MOTION/SECOND: Rickaby/Wuori to approve March 23, 1992 minutes as presented. VOTE: 5 ayes 0 nays Motion Carried SPECIAL ORDER OF BUSINESS: 1. Mayor Linke introduced Resolution No. 4214 Commending Mounds View High School Girls Basketball Team for their Second Place Finish in the 1992 State Tournament and asked if there was anyone in attendance to accept the resolution. There was no one in attendance at the meeting to Mounds View City Council ~'.egular Meeting Page Two April 13, 1992 accept the resolution, but Mayor Linke stated that this resolution would be given to the Mounds View High School Girls Basketball Team. 2. Mayor Linke read Resolution No. 4215 Commending the Irondale Basketball Association Sixth Grade Girls' Traveling Team and presented the same to the team and their coaches. 3. Rick Wriskey, Forester for the City of Mounds View, presented the City with the "Ten Year Tree City USA Award" given by the Arbor Day Foundation in that the City had to meet certain criteria. In addition to this award the City of Mounds View will receive a Ten Year Tree City USA-flag and Ten Year Tree City USA signs. RESIDENTS REQUESTS AND COMMENTS FROM THE FLOOR: Michael Janssen, 2440 Clearview, asked if the Council was looking into residential parking only on Clearview Avenue. Mayor Linke responded that parking signs had just been placed on the other streets and that the Council had not heard if there were any problems on ^learview. The Council will not take any action until they are informed hat there are problems. Mayor Linke asked Mr. Janssen how the parking was now that the signs were up. Mr. Janssen indicated that Clearview had received some overflow parking, but not a major amount. Mr. Janssen stated that he had brought in a petition signed by his neighbors previously and that he and his neighbors on Clearview felt that residential parking was the way to proceed. Mayor Linke reassured Mr. Janssen that the residential parking is not a dead issue and is still under advisement by the Council. CONSENT AGENDA Samantha Orduno, City Administrator, read the proposed Consent Agenda. Mayor Linke asked if any member of the Council desired to remove any item from the proposed Consent Agenda. No items were removed. MOTION/SECOND: Wuori/Quick to approve the Consent Agenda as presented. VOTE: 5 ayes 0 nays Motion Carried PUBLIC HEARINGS• There were no public hearings scheduled for this evening. Mounds View City Council ~.egular Meeting Page Three April 13, 1992 COUNCIL BUSINESS: 1. Tim Cruikshank, Management Assistant, reviewed Staff Report No. 92-226C regarding expenditures for City code recodification at a cost not to exceed $10,000. Cruikshank stated that he had requested and received written quotes from four separate vendors. Cruikshank explained what services each vendor would provide, what the draft of the code would contain, timeframe for the recodificaton and cost of the same. Cruikshank indicated that Sterling Codifiers is the most cast effective and have a shorter lead time than the other vendors. The City also received positive reports from others who have used their services. Discussion followed by the Council regarding the additional services that could be obtained but were not included in the price quotes. Samantha Orduno, City Administrator, explained that the City would receive the Code on disk so at a future date the City could update the Code as necessary by using the disks. Orduno also stated that the actual quote from the vendor is $7,950 but by the Council adopting $10,000 the City would have leadway to perhaps take advantage of some of the additional services that the City may want. This quote saves the City $6,000 to $7,000. MOTION/SECOND: Wuori/Blanchard to approve Sterling Codifiers as the vendor to update the City Code at a cost not to exceed $10,000 and authorize the City Administrator to enter into an agreement with Sterling Codifiers Mayor Linke asked Orduno what fund these monies would come from. Orduno responded that the fund would be Other Professional Services under Administration. VOTE: 5 ayes 0 nays Motion Carried 2. Samantha Orduno, City Administrator, reviewed Staff Report No. 92-227C which is a contract between the City of Mounds View and the New Brighton Veterinary Clinic for Animal Pound services. Orduno stated that this is an annual contract and its purpose is to assure the City of a place to take animals that are abandoned or running loose. Michele Severson and Dave Brick reviewed this contract with respect to other options and found this contract to be the most cost effective and the clinic is close in proximity to the City. i Mounds View City Council ~egular Meeting Page Four April 13, 1992 MOTION/SECOND: Quick/Blanchard to approve Animal Pound Contract Between the City of Mounds View and the New Brighton Veterinary Clinic 3. 4. • VOTE: 5 ayes 0 nays Motion Carried Samantha Orduno, City Administrator, stated that as per Council direction, staff prepared an ordinance which would put a one year moratorium on the siting of any adult uses-principal within any zoning district in the City of Mounds View. Orduno stated that this ordinance determines the following: 1) declares that evidence reviewed by the Council supports the following conclusions: a) sexually oriented businesses are associated with high crime rates and depression of property value and b) adverse impacts which Adult Uses-Principal have on the surrounding areas diminish as the distance from the Adult Uses- Principal increases, 2) that Mounds View shares many of the municipal characteristics with the cities cited in the evidence, 3) appropriate planning for the siting of Adult Uses-Principal within the City is necessary to protect the City's planning process and the health, safety and welfare of the citizens, the City is in the process of updating and amending the City's Comprehensive Plan, including the Zoning Code, which could affect the siting of Adult Uses-Principal within the City, 5) it is the desire of the Council to study, and if necessary implement, changes to its Comprehensive Plan to provide for the orderly development of the City and to preserve the public peace, health, welfare and safety of its citizens, 6) the City Council finds it to be in the best interest of the City to adopt an interim ordinance placing a one year moratorium on the locating of Adult Uses- Principal within certain specified distances from churches, residential zoning district boundaries, schools and youth facilities in order to protect the integrity of the planning process and the on-going process of the updating and amendment of the Comprehensive Plan. MOTION/SECOND: Quick/Wuori to waive the actual reading and approve the first reading of Ordinance No. 509 Placing a Moratorium on the Siting of Adult Uses-Principal as Defined Herein Within Any Zoning District of the City of Mounds View VOTE: 5 ayes 0 nays Motion Carried Ric Minetor, Director of Public Works/City Engineer reviewed Staff Report No. 92-229C regarding revisions to Chapter 70 of the Munici- pal Code Allowing Certain Properties to Maintain Private Wells. Minetor stated that there are seven properties within the City that currently do not have a municipal water main adjacent to their properties. These residents would incur significantly higher costs to connect to City water than residents with mains adjacent to their property. In some cases, this could easily be triple the normal connection cost. The major concern for these residents is the health aspects of maintaining a primary drinking water supply with a private well. Mounds View City Council Page Five ~'.egular Meeting April 13, 1992 After discussing the problems that residents would have with connecting to City water, staff recommends that Chapter 70 of the Municipal Code be modified to allow these residents to maintain their private wells as their source of drinking water and require these residents to have their water tested for bacteria and nitrates each spring and fall. Wells that fail the nitrate test should be either fitted with a treatment unit or abandoned. These tests would be consistent with the Minnesota Department of Health Codes for Private Wells. • C, MOTIONjSECOND: Blanchard/Quick to waive the actual reading and approve the first reading of Ordinance No. 503 Amending Chapter 70 of the Municipal Code of Mounds View to Allow Use of Private Wells for Residences not Adjacent to City Water Mains Councilmember Wuori asked if the Ordinance should, in Subdivision 2, specify April and October for testing. This would include submitting certified documentation of passing the test. Mayor Linke asked the maker and seconder of the motion if they were in agreement with adding those months for testing of the wells. The maker and seconder were in agreement that April and October should be added to Ordinance 503, Subdivision 2. VOTE: 5 ayes 0 nays Motion Carried Ric Minetor, Public Works Director/City Engineer, reviewed Staff Report No. 92-230C regarding revisions to Chapters 25, 48, 49, 49A and 59 to reference the City's Local Water Management Plan. Minetor stated that these amendments make the Code consistent with the Local Water Management Plan adopted previously by the Council. Minetor further explained that the reason there were five ordinances is, per the City's Charter, only one subject can be referenced per ordinance. MOTION/SECOND: Quick/Blanchard to approve and waive the first reading of Ordinance Nos. 504, 505, 506, 507 and 508. VOTE- 4 ayes 1 nay Motion Carried Councilmember Rickaby stated that her vote against these amendments was consistent with how she voted regarding the Surface Water Management Plan and the revision of the Wetland Ordinance. These documents removed preservation of the wetlands and added management. The ordinance carries the philosophy of the existing Council. The Council and staff do not have as much preservation of wetland ideaism as she would like to see when it comes to wetlands. Councilmember Rickaby stated that, when the golf course was discussed by the Council previously it was stated that a nine hole golf course is being considered but in the future if the Feds change the law to ease up on wetland preservation, we could put in an eighteen hole golf course. Rickaby stated that she doesn't like to leave all the alternatives up to the Council when it comes to wetland preservation. Mayor Linke stated that Councilmember Rickaby's statement was geared at the present Council. Bill Frits, 8072 Long Lake Road, asked when the Storm Water Management Plan was adopted or approved. Mr. Frits stated that he recalled that the Storm Water Management Plan surfaced two years ago but was not voted on. Ric Minetor, Director of Public Works/City Engineer, stated that the plan was adopted in February of 1992. Mayor Linke explained to Mr. Frits that the financing portion of the plan had not been discussed, but rather the verbiage of the plan. .The financing for the plan has not been approved yet. • Mr. Frits asked why do anything. Why have a Storm Water Management Plan? Mayor Linke explained that state law mandated the City to have a Storm Water Management Plan. Mayor Linke further stated that this item was discussed and voted on during open meetings of the City Council. Bill Frits stated that the Council promised public hearings on the sidewalk on Long Lake Road and there were none held. Ric Minetor, Director of Public Works/City Engineer stated that there were public information meetings held on the Long Lake Road project. There were no assessments abutting properties, therefore, no assessment hearings had to be held per state law. Mayor Linke explained that there were meetings held on the street, but meetings weren't held separately on the sidewalk. Mr. Frits stated his opposition to the sidewalk on Long Lake Road and further stated that the Council is not listening to the people. Mr. Frits also stated that the City Council hired a firm to find out what the people want at a cost of $8,000 and still haven't listened to what the people on Long Lake Road want. Mayor Linke explained that there were public information meetings held on the entire Long Lake Road project, not on parts of the project. Mounds View City Council Page Seven ~egular Meeting April 13, 1992 Councilmember Rickaby added that the Council had discussed the financial portion of the Surface Water Management Plan at the last Work Session and that it would be brought up again at the next Council Work Session. Mayor Linke stated that the financial portion of the Surface Water Management Plan was brought up as part of the entire plan, not an individual item. 6. Ric Minetor, Director of Public Works/City Engineer reviewed Staff Report no. 92-231C regarding the remodeling of the existing water filtration plant area for police garage and evidence storage. Minetor stated that the contractor had not yet obtained all the estimates from the subcontractors and that this item should be tabled for two weeks. MOTION/SECOND: Quick/Blanchard to Table for Two Weeks the Issue of the Proposed Remodeling of the Existing Water Filtration Plant Area for Police Garage and Evidence Storage VOTE: 5 ayes 0 nays Motion Carried Ric Minetor, Public Works Director/City Engineer, reviewed Staff ~. Report No. 92-232C regarding the purchase of a Skidloader and Asphalt Planer. Minetor stated that staff had budgeted these items to improve the street maintenance and patching work in the City. Minetor stated that staff received three bids on this equipment. Only two of those bids met specifications. The low bid was received from Carlson Tractor in the amount of $34,838. Also requested on the bids were some accessories for this equipment. Minetor stated that previously, staff had saved $6,000 on the purchase of the tank monitoring system and would like to use $3,000 of the savings from this purchase to buy some accessories for the Skidloader. The total cost of equipment would be $38,306.00. MOTION/SECOND: Quick/Wuori to award bid to Carlson Tractor for a 1992 New Holland Skidloader with accessories for a Total Cost of $38,306.00 to be Charged Equally to 700-4121-703, 730-4121- 703 and 100-4270-703. VOTE: 5 ayes 0 nays Motion Carried 8. Ric Minetor, Director of Public Works/City Engineer, reviewed Staff Report No. 92-233C regarding the hiring of Bill Sjulstad for Seasonal Employment in the Sewer Department. Minetor stated that Sjulstad has worked as a seasonal employee for the City during the last three summers. Mr. Sjulstad would not work for more than 100 days. Sjulstad would be assigned to the sewer department. Sjulstad's hire date would be April 8, 1992 at wage of $6.50 per hour. Ric Minetor, Director of Public Works/City Engineer, reviewed Staff Report No. 92-234C regarding Resolution No. 4217 a Request for Variance, 2673 Sherwood Road, MacMay Homes. Minetor stated that MacMay Homes, Inc. requested a variance to allow the construction of a single family home at 2673 Sherwood Road, with a side yard setback of five feet where a ten foot setback is required by Municipal Code and a front yard set back of 30.5 feet where a setback of 58 feet is required by a previous planning action. Steven May, 2359 Pinewood Circle, stated that he is a general contractor who builds houses in several communities and understands why sideyard setbacks are set. Mr. May described how this home would fit. on the property and why the variance was being requested. In this particular situation, the rear yard would face the sideyard setback. • Mr. May had received a visit from the adjoining neighbor to this property who had some concerns. After discussing the concerns with Mr. May. the neighbor stated to Mr. May that he felt much better about the variance and placement of the home on the property. Councilmember Rickaby was concerned that with the setbacks as shown, the homeowner would have difficulty getting to his rear yard. Rickaby stated there had been a problem with a homeowner that could not drive to his backyard and, therefore, drove across a wetland. Mr. May stated that this lot has a 25' drain easement on the property and this makes the building pad for the home only 45'. Mr. May stated that this makes the selection of the type of home and the price of the home difficult because of the small area to build on. Councilmember Rickaby stated that this hardship was self created by the developer as he wanted to make the lots small. Councilmember Rickaby stated that she is against this variance as this situation could set a precedence. Mayor Linke stated that it will be impossible for the homeowner to get to his backyard as he will not be able to encroach on the 25' drainage easement. Mayor Linke stated that the original developer did the plotting and the City made an error in not noting that this was a non-standard sized lot. Linke further stated that a 45' pad is hard to build on. ~ounds View City Council egular Meeting Page Nine April 13, 1992 Councilmember Wuori stated concern that noise intrusion from the neighbor might be a problem for this homeowner and that this would cause problems between the two residences. Wuori stated that this house may not be the best match for the neighborhood. Minetor stated that in another City he was employed for a privacy fence was included in the approval as a solution. Councilmember Rickaby stated that this property was discussed by a neighbor with small children when the setback from the street was discussed. The neighbor had small children that play in the yard and the view of cars coming was blocked. The addition of a privacy fence on this property could create more difficulty. Mr. May stated that there is more than a normal distance between the two sideyards, approximately 40' of separation. Councilmember Blanchard stated that Mr. May stated that the neighbor, after reviewing the plans, did not have a problem with the property. • MOTION/SECOND: Blanchard/Linke to Adopt Resolution No. 4217 Approving Setback Variance Requests by Mac May Homes, Inc., 2673 Sherwood Road 3 ayes 2 nays Motion Carried REPORT OF COUNCILMEMBERS: Councilmember Blanchard - No report. Councilmember Rickaby - No report. Councilmember Wuori - No report. Councilmember Quick- No report. REPORT OF MAYOR LINKE: Mayor Linke announced that the annual Easter Egg Hunt would be held at City Hall beginning at 10:00 a.m. this Saturday, April 18th. This, event has been held for approximately 25 years now. Mayor Linke welcomes all those children under the age of 10 to participate. REPORT OF ADMINISTRATOR: 1. Samantha Orduno, City Administrator stated that the Presidential Primary Election is over. 774 people voted in this election which is equivalent to 10.19 percent of the registered voters in the City. • 51 new voter registrations were taken. Orduno thanked all the election judges for doing a fine job, Alice Frits was thanked personally as she Mounds View City Council Page Ten ~egular Meeting April 13, 1992 was in attendance at the Council Meeting and Orduno commended Michele Severson, Deputy Clerk, for a very smoothly run election. Orduno commented also that there is an individual who called the City today who was very. impressed with the way Mounds View handled this election and is talking about this fact to other cities, i.e., single polling place designation. 2. Orduno also announced that City Hall will be closed on Friday, April 17 in observance of the Good Friday Holiday. Mayor Linke announced that the next Council Meeting would be April 27, 1992 and the next Work Session would be May 4, 1992.
