PLEDGE OF ALLEGIANCE :he Pledge of Allegiance was said. ROLL CALL MEMBERS PRESENT: Councilmembers Blanchard, Wuori, and Rickaby. Mounds View City Council Page Two ~egular Meeting June 8, 1992 CONSENT AGENDA Samantha Orduno, City Administrator read the Consent Agenda. Acting Mayor Blanchard asked if the Council wished to remove any item from the Consent Agenda. No items were removed. MOTIONLSECOND: Rickaby/Wuori to adopt the Consent Agenda as presented. VOTE: 3 ayes 0 nays Motion Carried PUBLIC HEARING: Acting Mayor Blanchard opened the public Hearing at 7:05 p.m. to consider organized collection of solid waste and recyclable materials. Acting Mayor Blanchard read an opening statement and explained the procedure that would follow for citizens to speak at the hearing. Carla Asleson, Recycling Coordinator reviewed the City's options with respect to changing the current open system of garbage and recycling collection. Asleson stated that one of the alternatives available is organized collection and the state mandate requires that the City hold a public hearing and pass a resolution of intent to study several options. sleson further stated that passage of the resolution of intent does not ~bligate the City to pursue any one type of system over another. The adoption of the resolution begins a legally required period of study and discussion with local trash haulers and residents to determine what is in the best interest of the City. Councilmember Wuori, expressed thanks to the Environmental Quality Task Force for the time spent on this issue and has hopes that as the process moves forward the Task Force will see what benefit came from their research. The haulers had an opportunity to express their concerns and the public was afforded an opportunity to ask questions and express their concerns. The following were the comments made by the haulers and the residents. Mr. William Werner, Sr. asked what the purpose was of this meeting. Acting Mayor Blanchard stated that the public hearing is being held to obtain resident input, ideas and comments regarding a change to the City's hauling system. Councilmember Rickaby stated that the state mandate was not a question at the time this process of looking at organized collection began. The Environmental Quality Task Force started processing this information a number of months ago. The recommendation was to increase recycling. The EQTF studied what other cities were doing in terms of recycling. The EQTF felt that the organized collection system would be more successful because the City would not be dealing with a number of haulers. If the City contracted with one hauler, this hauler could handle both recycling and solid waste. Mounds View City Council ~.egular Meeting Page Three June 8, 1992 Acting Mayor Blanchard read a letter to the residents signed by Mayor Linke regarding the organized collection public hearing and assured the public that he would be reviewing the minutes and viewing the tape of the meeting to learn what the resident's comments and concerns were. Mr. William Werner,. Sr. made a comment that the letter seemed to be biased with respect to favoring a single hauler approach. Acting Mayor Blanchard stated that she would not presume to say what the Mayor's thoughts are. Acting Mayor Blanchard stated that she is keeping an open mind with regard to many different options and is sure that the Mayor is too. Acting Mayor Blanchard stated once again that the City has to pass the resolution of intent in order to begin the 180 day study period. Councilmember Rickaby corrected a statement that Mayor Linke had made in his letter to the residents. Rickaby stated that the majority vote of the Environmental Quality Task Force was for multiple haulers. Mr. Tom Moline, BFT hauler, stated that he has operated under a number of different systems so he is familiar with organized collection. Mr. Moline stated concern regarding organized collection as far as the service level. The City could set standards level with organized collection and where under the open hauling system service could be limited which leads to a better ~ervice level. Mr. Moline also stated that the City claims to have sixteen licensed haulers on their streets, but he believes quite a number of those haulers are commercial only. Mr. Moline further stated that BFI practices volume based collection. Mr. Moline believes that most haulers have different rates for different levels of service. BFI has three different levels with three different prices. Councilmember Rickaby interjected that at this point that volume based collection is not a requirement. Lew Nelson, 780 Groveland Road, resident, asked if a person owned a business and disposed of his recyclables and solid waste at his business, would he need garbage collection? Will everyone have to have a garbage hauler? Why does every household have to have a garbage man if they dispose of their garbage in an environmentally safe manner? Samantha Orduno, City Administrator, responded that the City must monitor all garbage haulers to determine that every commercial and residential property has waste collection that is environmentally safe. Orduno stated that this public hearing and adoption of the resolution of intent is for the purpose of looking at organized collection and defining what an environmentally safe manner of disposal is. The process begins with a •:esolution of intent and a 90 day study. Mounds View City Council ~egular Meeting Page Four June 8, 1992 Lew Nelson stated that he is employed at a landfill and takes his solid waste with him to work. He stated that he would not look favorably on paying $300 per year for a garbage man. Acting Mayor Blanchard stated that the City Council is taking all things into consideration. Mr. William Siercks, 2210 Pinewood Drive, stated that his concern is that two companies, BFI and Waste Management, could put all of the other companies out of business. Mr. Siercks stated that it angers him to have the City tell him who will haul his garbage. Mr. Siercks stated that in the future the City will tell him what milkman to have. Mr. Siercks stated that, in his opinion, the City should have no less than four haulers. Siercks further stated that the City of Blaine has only one hauler. Mr. Sierks stated that his son lives in Blaine and pays the same amount for one bucket of garbage as those who have 10 buckets of garbage. Siercks stated that this is another area where government is sticking its nose in where it doesn't belong. Siercks also stated that he does not want to be dictated to. Siercks stated that if the City is having trouble with people not taking proper care to dispose of their garbage, then the City has to find a way to get at them. cting Mayor Blanchard thanked Mr. Siercks for his opinion and stated that ~he City is looking at all options and listening to the residents. The Council is getting input as to what the citizens want whether it be one hauler, four haulers, sixteen haulers, whatever it takes. Blanchard further stated that the Environmental Quality Task will be looking over all input and thanked Mr. Siercks for his ideas. C. Frye, 5329 Raymond Avenue, stated that this state mandate takes away the peoples rights and choices. Mr. Frye stated that everyone should have choices as they pay money for this service. Mr. Frye stated by killing the competition in going to one hauler, the City isn't saving anybody anything in the long run. Josey Warren, 8044 Greenwood Drive, stated that she understands that this mandate forces the city to keep track of what happens to the trash and report it to the county, state agency or Metropolitan Council. The residents want to know what their options are. Ms. Warren stated that she is a fifteen year resident of the City. Ms. Warren asked that the City Council keep an open mind and do a thorough study. There are many people in this City who do a very good job of recycling and reducing trash levels. Ms. Warren stated that she does not have BFI or Ace, but has a small businessman for a hauler. Ms. Warren further stated that his hauler was here before she came to the City and when she started with this business they had one truck and now they have many. Ms. Warren feels that the haulers have gone to considerable expense to remain competitive. ~s. Warren stated that she has recycling by volume. Warren stated that she oesn't have the one bag rate but could have because on an average she has Mounds View City Council ~egular Meeting Page Five June 8, 1992 two bags per week. Ms. Warren feels that the small trash generator should not be penalized for the person who generates more trash and vice versa. The residents should have an option of sharing trash hauling with another resident. Ms. Warren feels there are many creative ways to keep track of the trash. Ms. Warren stated that organized collection may cost less in the beginning but are the residents billed less to have their trash picked up but pay more in property taxes for City services. Ms. Warren's last comment was that the City-would not be giving her a choice of haulers if they divided the City up into quadrants and had one hauler for each quadrant. Acting Mayor Blanchard stated that volume based charges will be considered. Four quadrants is one of many ideas. The Council is looking for your ideas and options tonight. Richard Oman, 8205 Groveland Road, had been a member of the Environmental Quality Task Force. Mr. Oman stated that it became very apparent to him that Mounds View was behind the times compared to neighboring communities with regards to recycling and garbage hauling. Mr. Oman also stated that the communities that have the lowest rates are communities with single hauler systems. ~a1t Witzke, 771 Emerald Drive, New Brighton, stated that he is the Ralph Nader of recycling. Mr. Witzke passed out a memorandum to the Council and requested that it be made part of the official record of the meeting. Mr. Witzke reviewed the contents of his memorandum and then stated that Mounds View should worry about its recycling and set a plan for collection of recyclables and not worry about the haulers. Ric Minetor, Director of Public Works/City Engineer, stated that the public hearing held tonight was held in order that a resolution of intent could be passed so the City could study this issue for a 90 day period and study all of the options available. Acting Mayor Blanchard stated that she had received calls from residents and wanted to have them added to the record. They are as follows: Ellie Lenz, 8467 Eastwood Road stated that she would like to see the collection kept as is. August Spitzer, 7888 Bona Road, that the City could do a better job at a lower cost and one hauler would save our streets. Earl Meyer, no address, stated that having no competition would increase the rates. City should go with volume based prices. Larry Saba, owner of Larry's Quality Sanitation, stated he had met with the ~ouncil a while ago and the issue at that time was recycling. Mr. Saba ~tated that what this mandate is getting at is so garbage is taken care Mounds View City Council Page Six ~egular Meeting June 8, 1992 of properly and not laying around the streets in the cities. Mr. Saba stated that even if someone is putting trash in the City parking lot barrel, it is being properly disposed of. Mr. Saba is not encouraging this method of trash collection. Mr. Saba stated that he was not in favor of recycling as a hauler. He stated that he was forced to do something he didn't want to do. He had to go out and buy special equipment to do the job. The City stated that the haulers would handle recycling or they would not be able to obtain a city hauler's license. Mr. Saba stated that he was angered by this. Mr. Saba further stated that his hauling business is a family owned and operated business. Mr. Saba stated that if a big company loses business they still have a job, but that if this business is taken away from him, then he loses everything. Mr. Saba stated that his prices have always been volume based. Saba states that customers should only pay for trash they generate. In the past Mr. Saba stated that his company also had a senior citizen's rate. Saba stated that the City had a chance to have one hauler do the City's recycling. Saba stated that there was financial strain on the budget from the City not receiving money from the county for recycling and the recycling that was being done by one hauler was discontinued. Saba stated residents were paying towards the recycling program on their property tax. The haulers never saw a penny of this money to help them with recycling costs. aba stated that his company had to set limitations on what it would accept ~s recyclables. Saba stated that his company does not take plastics as it costs too much to get rid of them. Mr. Saba stated he will do what he has to do to stay in business. Mr. Saba further stated that if people are not happy with their haulers, look in the yellow pages and choose another. Mr. Saba stated that it is not fair to take away person's right to choice. Mr. Saba made a comment in that every year the haulers have to face MnDOT and the highway department as far as weight restrictions, but does not agree that the City should .have their public works persons around the corner tagging trucks for being over weight. These trucks are in the City to help keep it clean. If there is a problem with a certain hauler running over weight on the streets constantly, that person should be checked. Acting Mayor Blanchard stated that state and federal government is demanding more and taking more finances away from the cities. Blanchard stated that she is not in favor of user fees but sees no alternatives. Blanchard stated that she was happy to listen and hear what some other methods might be. Earl Meyer, 2264 Lois Drive, stated that he was in agreement with Mr. Saba. Mr. Meyer is not for the single hauler system. Mr. Meyer stated there could be one hauler for recycling and one hauler for garbage. Meyer stated that the recycling person could come once per month or every two to three weeks. Mr. Meyer felt that the price ranges were $15 to $5 which is too much of a difference from different carriers for different levels of service. illiam Werner asked if state mandate begins in July of 1992 and what are he requirements of this mandate. Mounds View City Council Page Seven ~egular Meeting June 8, 1992 Ric Minetor, Director of Public Works/City Engineer, stated that the City has to be aware of how each resident disposes of their garbage. The City needs to be informed as to what the residents are doing with garbage and recycling. The first thing that the City has to do with regard to this mandate is to hold a public hearing to inform the residents that the City desires to consider methods of solid waste collection and recycling. The Council needs to pass a resolution of intent to consider these methods and has 90 days with a 90 day extension to prove the best method. The Council must adopt the resolution prior to July 1, 1992. William Werner, does the City run a list to report to the state or PCA. Minetor stated that the state mandate states that the City be aware of how each residential and commercial property is disposing of their garbage. This takes in what hauler they have, when they change haulers, complaints the City receives regarding properties not taking care of trash removal and making sure that each property is disposing of trash in an environmentally safe manner, whatever that is defined to be. No reports have to be sent but in order to be in compliance with the state mandate the City must be aware of how each property owner handles disposal. William Werner stated that he supports the option to choose his own hauler ~or garbage pickup. Mr. Werner stated that he has no idea what to do with ecycling because he does not have enough information on it. Mr. Werner asked if there would be another meeting to collect public input. Ric Minetor stated that there will be a study period of 90 days and before a new ordinance is passed there will be two public hearings. Nelly Domeier, 8171 Eastwood Road, stated that she knows people who began recycling years ago. Why should they pay for haulers to do it. They take their recycling to the recycling centers. Walt Witzke, New Brighton, stated that recycling and solid waste hauling are two separate entities and there is a cost for each. Mr. Witzke stated that it is cheaper to recycle than to pay a trash hauler. Naja Werner, 2765 Sherwood Road, stated that it is possible for families to cut down on trash generated. Her family has cut down and it costs her $32.50 per year. Ms. Werner stated that she recycles vegetable clippings, glass, cans, and newspapers go to the church. Werner stated that everyone can cut down on garbage generated. She stated that she does not like to have the City tell her who is going to take her garbage. Werner stated that she uses no pampers, huggies or styrofoam pizza containers. Werner concluded with everybody needs to cut down to help save this planet we live on. Acting Mayor Blanchard closed the public hearing on organized collection at 8:04 p.m. and opened the regular meeting. • Mounds View City Council regular Meeting Page Eight June 8, 1992 Gouncilmember Rickaby stated that she was the Council liaison with regard to the Environmental Quality Task Force when the Task Force went through the process. Rickaby stated that she has a hauler that will pick up at garage side. Rickaby stated that she did have a hauler that picked up curb side and it did not work for her. Rickaby stated that she has a hauler, Larry, of Larry's Quality Sanitation who picks up at the side of her garage. When the City went with the hauler for recycling Rickaby stated that she was not happy with the collection because he would not pick up at the side of her garage and plastics weren't picked up. Rickaby stated that she is greatly opposed to haulers who only have curb side collection. If the City went to a one hauler system she wouldn't be opposed if the hauler could address her concerns. The first item would be the hauler would have to have a bag rate. Rickaby stated she would be violently opposed to the City going with a hauler who doesn't have a bag rate. The second item would be the hauler would have to come to the side of her garage for pick up. Rickaby stated that Ric Minetor stated that garbage trucks damage the streets. Rickaby stated that the trucks that do damage to the roads are those doing curbside pick up. Gouncilmember Rickaby stated that she would support going with one hauler and place a provision in the resolution of opting out if it didn't work out ~or the resident. Rickaby stated this should be added to the resolution as ne of the items the Council could consider. Gouncilmember Wuori stated that she was glad to have a six month study period. There are many options to consider. For the past two months Gouncilmember Wuori stated that she has paid close attention to haulers on her street. Every single day one hauler comes with a truck for trash and a truck for recycling. One particular hauler has little trucks that take the trash to the big trucks and then all three trucks go down the street. Repair of roads is a large part of the City's budget. Gouncilmember Wuori stated that she was glad to see all of the citizens in attendance and she stated that she hopes the Council continues to see the residents turn out at these meetings. Acting Mayor Blanchard stated that she was very happy with the input from the residents and is anxious to go over it. If the Council passes the resolution of intent tonight, the City can begin the study process. There are a number of options. open to the city and she stated that she believes no Gouncilmember had made up their mind as to their choice at this time. Wuori moved to adopt Resolution No. 4239 resolution of intent of the City of Mounds View to study the organized collection of solid waste and recyclable items. This motion failed for lack of a second. Gouncilmember Rickaby stated that she would like to amend this resolution to include a contract with one hauler with opt out system for study and also a Mounds View .City Council Page Nine ~egular Meeting June 8, 1992 non-organized collection system as recommended by Walt Witzke and Josey Warren. Councilmember Wuori requested to change the wording of Councilmember Rickaby's motion to amend the resolution to include a bid contract by one hauler with opt out system. Wuori stated that rather than adding this to that part of the resolution, make it a descriptive phrase of its own and therefore, with any system there could be an opt out system. Wuori stated that this was a friendly suggestion amending the motion. The friendly suggestion was okayed by Councilmember Rickaby. VOTE: 3 ayes 0 nays Motion Carried COUNCIL BUSINESS: 1. Mr. Bill Morris of Decision Resources, Ltd. was scheduled to present the community services survey results. Mr. Morris was not in attendance at this time. 2. Ric Minetor, Director of Public Works/City Engineer, reviewed Staff Report No. 92-298C regarding the development request known as Greenfield Estates, Harstad Companies. Jeff Roos representing Harstad Companies gave a full presentation of the proposal at the meeting. Peter Sabee, Barr Engineering, reported on how the Greenfield Development met the City of Mounds View's criteria for a wetland alteration permit per the Municipal Code. Councilmember Rickaby asked if anybody had looked at the boundary line of the wetland since November of 1987. Rickaby stated that she recalled that was when we were in drought times and a lot of the wetland boundaries were kind of pulled in at that time. Rickaby stated that from her observations this year the wetlands are up. Rickaby further stated that as she recalled also back in 1987 when the wetlands were studied the DNR indicated from the time they put the wetlands on the map for DNR purposes they indicated that this should have qualified for DNR protection from the studies that were done back in 1987. They indicated that the land had become more wet since that time. Rickaby stated that from her observations, she sees a lot of wetlands way up compared to 1987. Peter Sabee explained the different classifications of wetlands and how soils, vegetation and presence of water is really the key in defining what type of a wetland they are. • Mounds View City Council ~egular Meeting During the presentation by Peter Sabee, a letter Council dated September 1, 1987 from Molly Shode~ regarding the above referenced property by Sandy evolved around the previous study regarding this Page Ten June 8, 1992 was given to the an, Area Hydrologist, Krogh. Discussion wetland. Councilmember Quick and Mayor Linke joined the Council Meeting at 8:55 p.m. MOTION/SECOND: Linke/Wuori to set public hearing for 7:05 p.m., Monday, July 13, 1992 to consider development proposal known as Greenfield Estates. VOTE: 4 ayes 0 nays Motion Carried Mayor Linke apologized for popping in and disrupting the meeting. He had attended his son's graduation and was off to the all night senior party at Irondale High School. Kay Weseman, 7807 Bona Road, asked that in preparation for the public hearing could the City have copies of the Audobon report, the Molly Shodeen letter and the entire packet from the planning commission. There were two letters from Molly Shodeen referenced by the developer that the public would also like. Acting Mayor Blanchard stated that everything is copied to the City Council. Councilmember Wuori suggested that letters be written to be entered into the public hearing. Charles Miller, 2408 Laport Drive, asked if it was possible to get an outline of the criteria that the Council will use to decide what will happen with this development. Paul Harrington, City Planner, invited Mr. Miller to come into City Hall and look at all the material that was submitted as part of the application. Harrington further stated that decisions are based on allowances in relationship to the ordinance. Councilmember Wuori stated that if all criteria matches our ordinance and we deny the development, the party can sue us and the court could overturn the judgment. 3. Bill Morris of Decision Resources, Ltd. made a presentation of the outcome of the City Services Survey. Mr. Morris explained that there was a portion of the survey whereby the citizens could set a budget for the City. If the resident was required to make cuts they could but didn't want to give up any services after making the • cuts. The City received some very favorable and positive comments from the residents of the City. Mounds View City Council ~egular Meeting Page Eleven June 8, 1992 4. Mr. Miller stated he is a single parent and was watching the cable cast but decided to come to City Hall, but it would be easier for him to call in. Ric Minetor, Public Works Director/City Engineer, stated that in the past the Council had tried the phone in method and hadn't received any calls. There was a phone in the Council Chambers, but the phone has since been removed. Two residents stated they would donate their time and the wire to reconnect the phone in the Chambers. Samantha Orduno, City Administrator, read a letter received from a family with regards to the actions taken by Patrol Officer Mike Kampa that were beyond the call. of duty during a crisis their family was experiencing. The family was very grateful to Officer Kampa. Acting Mayor Blanchard commented that this was another good job done by the Police Department. This public hearing is for the purpose of meeting the State requirements regarding the proposal before the City Council on organizing the trash collection in the City of Mounds View. The City Council has received a report from the Environmental Quality Task Force which studied the question of the best way to handle the collection of both trash and recyclables within the City. The majority report recommended that the City have a single hauler system. The Council decided, after talking about it at two work sessions, to look at organized collection. I have supported this decision as it will solve some of the problems that now confront us as a City. 1. Per a requirement of the State, the City of Mounds View must verify that all of the residents and businesses within the City have solid waste collection or are disposing of their trash in an environmentally safe manner. 2. We must make our roads last longer as we do not have the resources to rebuild them all the time. Right now we have 16 licensed haulers in the City which means that just about any weekday we have at least 4 to 5 garbage trucks on any given street. This amount of heavy traffic beats up the roads which forces us to work on them, with a single hauler it would mean only one truck on any given street per week. 3. As the contracting agent, the City can require the hauler to meet certain standards regarding garbage and recycling pickup. This could be anything from requiring that the hauler • set rates for the amount of garbage collected at your home to what type of items should be recycled. Right now some of the current haulers do not have different rates for different amounts of trash picked up, those that have very little pay the same as those who have a lot, you should only have t pay for the amount that you normally put out. 4. It has been proven that when a hauler picks up every house on a street, he can do it cheaper than if he picked up only a few homes. With the City acting as the agent for all the residents, the rate for trash pick up will be lower than now being charged to you as individuals. i This; hearing is only the second step (the first being the Environmental Quality Task Force Report). Now, we and the EQTF must study all the possible methods of collection and look at how it will impact the residents of Mounds View so that we will end up with a system that satisfies most of the needs of the residents. In 1979 - 1980, I conducted the Ramsey-County Wetland Inventory which involved field inspection and typing of all potential wetland .areas meeting certain criteria. We used a base- map prepared through aerial photo interpretation of .vegetation types by the University of Minnesota. The infra-red aerial photos were taken in 1978 after a dry year. The vegetation typing from the aerials showed predominantly reed canary grass and shrubs. When I field checked the wetland in 1980, I determined that the vegetation typing was accurate and the wetland was Type 2. The State has jurisdiction over Types 3 - 5 only. I am enclosing a description of the wetland types that were used. When we met on August 28th I found that the wetland has indeed changed character, as many wetlands do. We have been in a wetter period and there is now more development is the area. Generally when there is more impervious surface from roofs,- driveways:.and streets, storm sewers direct more runoff into wetland areas: In my opinion, the increased development has added significantly more water to this basin to cause the vegetation to become, over time, predominantly cattail. Cattail require a wetter moisture regime than grasses and shrubs. Instead of being seasonally flooded as is characteristic of a Type 2, it now appears to be at~least waterlogged.-throughout- the growing season in order to support the cattail growth.-.~.Zf I were to type this wetland now, I would unquestionably call it a good Type 3. ., ~; . If the- wetland area is further encroached upon by fill, there will be less surface'ared to retain the water which may lead to even higher water levels'than~ is presently evident.. .. The only organization Mounds View should provide would be a city-wide recycling program using one company. Recycling company should be selected on a bid basis. To receive the minimum bid with maximum resident protection, the contract should run for 2-3 years with twice monthly pickup always on the same day of the week. The bid should be at a fixed price for the contract period and stated as dollars per ton of collected recyclables and not on a per household basis. • This method of charging provides an incentive for the recycler to increase the material collected. It also provides the city with an automatic reporting system for the tonnage collected, because the city pays its bill based upon weight and not households. The city receives its funding to pay for the recycling charges by having the county place the estimated recycling cost divided by the number of residence as a recycling service charge on each Mounds View homeowners property tax bill. The county charges 10 cents per household for the above service. I do not think the city can come close to this annual fee by placing the recycling charges on the water bill. To handle uncollected taxes, the city has a 5%, revolving reserve fund to cover recycling contingencies. This fund is then adjusted yearly. The city can continue to work with the recycler and residents to increase the items that can be recycled. It costs the residents approximately $85 per ton to dispose of recycled trash and approximately $200 per ton to dispose of non- recycled trash. Mounds View City Council • June 8, 1992 Hauler No Contract Let the residents select their own hauler. The hauler with the most volume sensitive rates will appeal to the resident who is committed to recycling. With market driven competitive hauler rates there is no need for organized collection in Mounds View. Do not force the resident to have his own trash hauler.
