January 3, 2011, Special City Council Meeting Minutes Item No: 7A Meeting Date: January 10, 2011 Type of Business: Public Hearing Administrator Review: ________ City of Mounds View Staff Report To: Honorable Mayor and City Council From: Heidi Heller, Planning Associate Item Title/Subject: Public Hearing, First Reading & Introduction of Ordinance 856, Amending Chapter 1113 by Adding More Permitted and Conditional Uses to the B-2, Limited Business Zoning District Introduction: City staff received a sign permit application for a new Chinese restaurant that wants to move into Silver View Plaza. Because of this request, staff decided to discuss increasing the allowed uses in a B-2 zoning district with the Planning Commission and City Council. Background: On December 6, 2010, City staff discussed with the City Council the idea of adding permitted and conditional uses to the B-2 zoning district, including restaurants. The City Council was supportive of the idea and directed staff to proceed with preparing a code amendment to make the changes to the B-2 zoning district. The Planning Commission passed Resolution 936-11, approving the proposed amendments to the B-2 zoning code on January 5, 2011. Discussion: The B-2 zoning designation allows commercial and service oriented businesses such as laundromats, locksmiths, delicatessens, financial offices, florists, sporting goods and hardware, to name a few. The property owner, Kraus Anderson, continues to struggle to get tenants in Silver View Plaza and the City wants to help where it can. City Staff asked the Planning Commission if they would be open to adding more permitted or conditional uses to the B-2 zoning code, particularly relating to restaurants. The Planning Commission agreed that it did not make sense to limit the types of restaurants based on what type of cooking is done. The Commission suggested amending the zoning code to allow a “small restaurant, café and tea room” as a permitted use in a B-2 district. The Code would define a small restaurant as being limited to 24 seats and no more than 2,000 square feet in size. The Commission also suggested allowing restaurants with more than 24 seats and more than 2,000 square feet in floor area in a B-2 zoning district as a conditional use. As noted above, the Council was in agreement with the code changes as proposed by the Planning Commission, and directed staff to prepare an ordinance with the amendments as discussed. The City Council of the City of Mounds View hereby amends Title 1113, Section 1113.02 of the Mounds View Zoning Code pertaining to “B-2, Limited Business District Permitted Uses” by deleting the stricken language and adding the underlined text as follows: 1113.02: PERMITTED USES: The following are permitted uses in a B-2 District: Subd. 2. Retail: Limited retail uses which have, as the principle use, sales with warehousing or display secondary to that use. Adult establishment as defined and regulated in Chapter 513 of the Municipal Code. Ord. 574, 5-13-96) All permitted uses as allowed in the B-1 Neighborhood Business Districts. Antique shop. The Mounds View City Council hereby amends Title 1113, Section 1113.04 of the Mounds View Zoning Code pertaining to “B-2, Limited Business District Conditional Uses” by deleting the stricken language and adding the underlined text as follows: 1113.04: CONDITIONAL USES: The following are conditional uses in a B-2 District requiring a conditional use permit based upon procedures set forth in and regulated by Section 1125.01 of this Title): Subd. 10. Restaurants, cafes and tea rooms with more than 24 seats and/or 2,000 square feet of floor area. In accordance with Section 3.07 of the City Charter, City staff shall have the following summary printed in the official City newspaper in lieu of the complete ordinance: On January 24, 2011, the City Council adopted Ordinance 856 that amends Chapter 1113 of the Mounds View Municipal Zoning Code about B-2, Limited Business District, Permitted and Conditional Uses. This action is at the request of the property owner and to protect the City in the event of a foreclosure. Individual notice of the meeting was sent by first class mail to the affected property owner on December 21, 2010. Attached is the roll for the assessment notice that was sent out. This account was delinquent as of January 1, 2011. The Owner may prepay the assessment between January 11, 2011 and February 11, 2011 without paying additional interest. After that, interest at the rate of 5.5% will accrue from January 10, 2011 through the payment date. The interest rate and administrative fee were set by the City Council in Resolution 7135. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View that: 1. Such proposed assessment roll, a copy of which is attached hereto and made a part hereof, is accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein is hereby found to be benefited by the public utility services in the amount of the assessment levied against it. 2. The assessments as adopted and confirmed shall be payable with ad valorem taxes in 2012 in one annual installment with interest thereon at five and one half (5.5) percent per annum, and shall bear interest on the entire assessment from January 10, 2011 through December 31, 2012. 3. Staff has identified several parts of Title 1000 that the City should change and update. Background: On December 6, 2010, the City Council reviewed and discussed possible changes to Title 1000 (Building and Development Regulations). The Council appeared supportive of the proposed changes and directed staff to proceed with preparing an ordinance to amend the City Code to put the changes into effect. Discussion: Since the Council work session on December 6, 2010, City staff has investigated further when a property owner must use a licensed contractor to do work or to make improvements to their property. To summarize, if a contractor is doing work that requires a building permit, they must have either a State license or a City license. For a City license, staff ensures that the contractor has liability and worker's compensation insurance. We have attached the Mounds View City Contractor License Information handout and a copy of the city contractor license application for your reference. These provide much detail about City licenses and City contractor licensing requirements. State residential contractor licenses apply to contractors working on buildings with up to four units. These licensed contractors must prove competency and complete continuing education in order to maintain their State license. The Department of Labor and Industry DOLI) does the licensing of contractors for the State. Chapter 326B of Minnesota State Statutes defines residential buildings with one to four units as residential real estate and those with more than four units as a commercial property. The State considers contractors working on dwellings with more than four units as commercial contractors and no State contractor license is required. The City of Mounds View licenses these commercial contractors (MV Code Section 1006.04). As part of this requirement, the City requires the contractors to provide proof of general liability insurance as outlined in City Ordinance 853 Staff Report January 10, 2011 Page 2 Code 1006.04 Subd. 6. Sufficient insurance is critical in the case of an accident or any unforeseen expense from doing substandard work. As we noted in December, staff did a thorough review of all of Title 1000 of the City Code. This review by staff revealed several parts of Title 1000 that the City needs to change and update. The Code changes are necessary because changes in State regulations, changes in City practices and policies and a need to help clarify various parts of the Code. More specifically, the City should update the Code references to State statutes (especially those related to the electrical and plumbing codes), clarify the practices and penalty sections, and clarify what projects need building permits and what projects need zoning permits from the City. Staff also is proposing changes to the Code language about contractor licensing including the removal of the language that requires City Council approval of contractor licenses. Since the City Council does not investigate the contractors or have any detailed information about them, it is unnecessary for the City Council to approve contractor licenses. This is an administrative task that City staff can and should perform. Recommendation: Staff recommends that the City Council approve the introduction and first reading of Ordinance 853. This is an ordinance that makes changes to Title 1000 (Building and Development regulations) of the City Code. These are the same Code changes that Staff proposed and the Council reviewed in December. No minor may possess any ignition device, unless under the direct supervision of, or with the direct permission of, a parent or legal guardian; b. No person may sell, give, deliver, or make accessible, any ignition device to a minor; and c. No owner of a place of business may make ignition devices accessible to minors at the place of business. Subd. 3. Confiscation: Any ignition device possessed by a minor may be confiscated by any peace officer, Fire Chief or authorized designee of the Fire Chief. Once confiscated, the ignition device shall become property of the confiscating authority and shall be processed accordingly as evidence in the commission of a crime or made inoperable and disposed of properly. Subd.4. Penalties: a. Any person who shall that violates any of the provisions of this Section hereby adopted shall for each and every violation, be punished by a forfeiture of the ignition devices and/or a fine of not less than fifty dollars ($50.00) nor but no more than two -hundred dollars 200.00) for each offense as determined by the Fire Marshal, plus any costs and surcharges as required by law; and b. Permit and Application Fee Refunds: The City may refund permit fees for work that has shall be made in writing by and the City will reimburse the paid fees to the party who made the initial payment unless the Building Official authorizes the payment to another person or party. If the City has performed a plan check, this fee shall not be refunded unless authorized by the Building Official. The City shall not refund State Surcharges that have been reported to the State of Minnesota. 1006.03: PERMIT EXTENSIONS: If the work for which a permit was issued does not commence within one hundred eighty (180) days or if the work is suspended or abandoned for a period of one hundred eighty (180) days, the permit shall be considered void and invalid. The Building Official may grant, in writing, extensions for periods not more than one hundred eighty 180) days each. The extension shall be requested in writing and justifiable cause demonstrated. The decision of the Building Official may be appealed to the City Council. See Chapter 1001 of this Title. 10 1006.04: LICENSING PROVISIONS: Subd. 1. General Commercial Contractors: A City license granted to a general Commercial contractor shall include the right to perform all of the work included in the general contract but shall exclude anv work that requires a separate license issued by the State of Minnesota. Such license shall include any or all of the persons performing the work under the general contract, providing that each person perfomning such work is in the regular employ of such general contractor and qualified under State law and the provisions of this Code to perform such work. In these cases, the general contractor shall be responsible for all of the work so performed. Subcontractors, who are persons not in the regular employ of a general contractor, shall be required to ^e-a,ply -with meet the Sections of this Code pertaining to license and insurance qualifications for the subcontractor's particular type of work. Subd. 6. Insurance: Any person holding requesting a contractor's license shall file with the Clerk C Administrator poheies- rn oof of public liability and property damage insurance showing the City of Mounds View as the certificate holder, which shall remain and be in force and effect during the entire term of said license or a renewal certificate shall be provided to the Citv at least ten (10) days before the expiration of the certificate on file with the City. Expiration and Renewal: All licenses shall expire on December 31 following the date of issuance unless sooner revoked or forfeited. Authority of Council: The Council shall have the power to suspend or revoke the City license of any person licensed under the regulations of this Code whose work is found to be improper or defective or so unsafe as to jeopardize life or property, providing the person holding such license is given twenty (20) days' notice and granted the opportunity to be heard before such action is taken. Suspension: A City contractor's license suspension shall be not less than thirty (30) days nor more than one (1) year, such period being determined by the Council. c. Second Offense: When any person holding a City contractor's license as provided herein has been convicted for the second time by a court of competent jurisdiction for violation of any of the provisions of this Code, the Council City shall automatically revoke the license of the person so convicted. Such person may not make application to the City for a new license for a period of one (1) year. 1006.05: (Reserved) 1006.06: DEVELOPMENT CONTROLS: Subd. 1. Purpose: It is the intent and purpose of this Section to provide for orderly development of land to safeguard life, health, safety, property and public welfare by regulating and controlling all development within the City. This Section shall be in addition to the requirements of any other provisions of the 114runieipal City_Code regulating such development. Subd. 2. Application of Development Controls: All new construction and expansions of existing construction shall be reviewed by the Planning and Zoning Commission and approved by the City Council as conforming to this Section, except as follows: a. Pools and associated mechanical equipment shall be maintained so as not to constitute an unattractive, public or private nuisances. Swimming pools shall be located on property in a manner so as to comply with all applicable provisions of Title 1100 of this Code. Subd. 2. Utility Easements: Pools shall not be located within any utility easement or be over or under any utility lines. 1009.04: FENCING REQUIREW: Subd. 1. All outdoor swimming pools shall be made inaccessible when not in use by a non_ climbable type of fence, wall or barrier. All openings or points of entry into the pool area enclosure shall be equipped with locking gates. The fence and gates shall be at least four (4) feet in height and shall be constructed of a material approved by the building official. All fence posts shall be decay resistant or corrosion resistant and shall be set in concrete bases or other suitable protection. The opening between the bottom of the fence and the ground or other surface shall not be more than two (2) inches. Subd. 2. All gates shall be equipped with self-closing hinges and a self -latching device. Where the release mechanism of the self latching device is located less than fifty-four (54) inches from the bottom of the gate, the release mechanism shall be located on the pool side of the gate at least three (3) inches below the top of the gate. All gates shall be equipped with a lock which will render the gate inaccessible when the pool is not in use. Ladders and steps shall be capable of being secured, locked or removed to prevent access. All locks shall be of the type that which cannot be opened without the use of a key or numerical combination. Subd. 4. No person owning or operating an outdoor swimming pool shall use, operate, or allow the use of such swimming pool unless such pool complies with the above provisions. The required safety fencing shall be completely installed with installation of the pool. 1009.05: GENERAL RESTRICTIONS: Subd. 1. Pool Lighting: All pool lighting shall be directed toward the pool. Subd. 2. Use ofMxrtieipal City Sanitary Sewer: Pool water drained through the Munieipal City's sanitary sewer system must be obtained from a metered source within Mounds View2. By partnering with the Greater Metropolitan Housing Corporation, Mounds View residents and property owners have one-stop-shop access to a variety of housing, improvement, efficiency, loan and enhancement programs that they might not otherwise. The services offered by the HRC provide an invaluable resource for the community. Discussion: The Housing Resource Center (HRC) is a division of the Greater Metropolitan Housing Corporation (GMHC) whose stated mission is to preserve, improve and increase affordable housing for low and moderate income families, as well as to assist communities with housing revitalization. The HRC provides construction management consultations, program administration, provides information on a variety of relevant housing programs and coordinates and manages several grant and loan programs geared toward home improvement and renovation. In 2007, the HRC agreed to manage the City’s Housing Replacement Program’s demolition reimbursement component as part of the agreement, at no additional cost to the City. The fee for the contracted service is $11,000 which is has not increased in many years. Beginning in 2011, the HRC will also coordinate the administration and underwriting of the City’s new pilot loan programs intended to provide residents with low or no interest financing for home improvements, needed renovations, blight elimination and remediation of code violations. The fee for this additional service is $400 per loan closed plus a monthly processing fee charged by the servicer, Community Reinvestment Fund (CRF). RECITALS A. The Consultant has a division called The Housing Resource Center (“HRC”). GMHC has agreed to provide certain Services through HRC (as defined below) in connection with the City’s housing program. B. The City desires to hire the Consultant to render this technical, professional, and marketing assistance in connection with housing programs in the City for the term as set forth in this Agreement. C. Consultant is willing to provide such services on the terms and conditions set forth herein. In consideration of the foregoing recitals and following terms, conditions and mutual promises contained herein, the parties agree as follows: 1. Scope of Services. The Consultant shall provide services as follows (the “Services”): a. Administer the following home improvement programs for residents of the City of Mounds View: MHFA Fix Up Fund, Community Fix Up Fund, the MHFA Rental Rehab Program and the MHFA Rehabilitation Loan Program (collectively the MHFA Programs”): 1. Providing information to residents and property owners about the programs, upon request; 2. Assist the City in developing procedures for the programs; 3. Receipt of applications from residents; 4. Processing applications; 5. Closing loans to qualified applicants in accordance with the applicable program; 6. Overseeing the draw process for the funds, including, as necessary, reviewing draws, reviewing the progress of the work and collecting lien waivers and certificates of occupancy. Consultant may, for this purpose, rely on third- party representations and certifications. 7. Provide monthly reports about the number of loans closed and the balance in each loan program. b. Assist City residents considering rehabilitation, including property visits, meet with homeowners and potential contractors, suggest alternatives for rehabilitation to homeowners, educate homeowners on the construction bid process, assist homeowners to evaluate bids and work completed and construction progress. c. Provide housing information to City residents, including information on emergency assistance, housing rehabilitation, first time homebuyers and limited rental information; d. Assist the City in its Housing Replacement Program; e. Assist the City in developing programs to purchase and rehabilitate homes; f. Coordinate these services out of Consultant’s Housing Resource Center, 1170 Lepak Court, Shoreview, MN 55126; and g. Have Consultant’s staff visit residences as determined necessary by Consultant. 2. Term. This Agreement shall be in full force and effect from January 1, 2011 and shall continue through December 31, 2011, unless otherwise terminated as set forth below. 3. Compensation. For services provided under this Agreement, the City shall pay to the Consultant Eleven Thousand Dollars ($11,000.00) within thirty (30) days after execution of this Agreement. The Consultant shall receive compensation for administering the MHFA Programs directly from the Minnesota Housing Finance Agency and not from the City. 4. Termination. Notwithstanding any other provision hereof to the contrary, this Agreement may be terminated as follows: a. The parties, by mutual written agreement, may terminate this Agreement at any time in which case the parties shall agree to the amount of fees payable to Consultant. b. The City may terminate this Agreement upon the breach by Consultant of any of its material covenants contained herein, where such breach shall have continued for a period of thirty (30) days following the receipt by Consultant of a written notice from the City, specifying the alleged breach; provided, however, if the nature of a non- monetary breach is such that Consultant cannot reasonably cure same in the thirty 30) day period, Consultant shall not be deemed to be in breach if it commences to cure within the thirty (30) day period, and diligently pursues same to completion within ninety (90) days following receipt by Consultant of such written notice. In the event of termination by the City hereunder, Consultant shall be entitled to fees due to the date the notice of breach is sent by the City. c. If Consultant or City (as applicable) (i) files a voluntary petition in bankruptcy ii) files a voluntary petition for reorganization under any bankruptcy law, statute or regulation or other similar statute or regulation, (iii) is adjudicated a bankrupt, iv) makes an assignment for the benefit of creditors or applies for or consents to the appointment of a receiver or trustee as part of or in conjunction with a “creditor plan” with respect to any substantial part of its assets, or (v) a receiver or trustee is appointed, or an attachment or execution levied with respect to any substantial part of its assets, and said appointment is not vacated, or the attachment or execution not released, within sixty (60) days, then this Agreement shall, effective as of such date, without notice or further action by either party, immediately terminate. d. Consultant may terminate this Agreement upon the breach by City of any of its material covenants contained herein, where such breach shall have continued for a period of thirty (30) days following the receipt by City of a written notice from Consultant, specifying the alleged breach; provided, however, if the nature of a non- monetary breach is such that City cannot reasonably cure same in the thirty (30) day period, City shall not be deemed to be in breach if it commences to cure within the thirty (30) day period, and diligently pursues same to completion within ninety (90) days following receipt by City of such written notice. In the event of termination by Consultant hereunder. Consultant shall be entitled to retain the entire fee under this Agreement. 5. Insurance. a. During the term of this Agreement, the Consultant shall obtain and maintain workers compensation, comprehensive general liability, and automobile liability insurance. Comprehensive general liability insurance shall have an aggregate limit of Two Million Dollars ($2,000,000.00). b. Upon request by the City, the Consultant shall provide a certificate or certificates of insurance relating to the insurance required. Such insurance secured by the Contractor shall be issued by insurance companies licensed in Minnesota. The insurance specified may be in a policy or policies of insurance, primary or excess. c. Such insurance shall be in force on the date of execution of an Agreement and shall remain continuously in force for the duration of the Agreement. 6. Indemnification. a. Notwithstanding anything to the contrary in this Agreement, the City, its officers, agents, and employees shall not be liable or responsible in any manner to the Consultant, the Consultant’s successors or assigns, the Consultant’s subcontractors, or to any other person or persons for any third party claim, demand, damage, or cause of action of any kind, nature, or character, including intentional acts, arising out of or by reason of the performance of this Agreement by Consultant. The Consultant, and the Consultant’s successors or assigns, agree to protect, defend and save the City, and its officers, agents, and employees, harmless from all third party claims, demands, damages, and causes of action, to the extent caused by the negligence or wrongful acts of Consultant, and the costs, disbursements, and expenses of defending the same, including but not limited to, attorneys fees, consulting services, and other technical, administrative or professional assistance. b. Nothing in this Agreement shall constitute a waiver or limitation of any immunity or limitation of any immunity or limitation on liability to which the City is entitled under Minnesota Statutes, Chapter 466, or otherwise. 7. Assignment. This Agreement shall not be assigned, sublet, or transferred, in whole or in part without the prior written approval of the City. 8. Conflict of Interest. The Independent Contractor shall use best efforts to meet all professional obligations to avoid conflicts of interest and appearances of impropriety in representation of the City. In the event of a conflict, the Independent Contractor, with the prior written consent of the City, shall arrange for suitable alternative services. 9. Compliance with Laws. The Consultant shall comply with all applicable Federal, State, and local laws, rules, ordinances, and regulations at all times and in the performance of the services pursuant to this Agreement. 10. Finance DirectorBeer13 explained the 3% increase was an increase over the tax levy of 2010 with the funds going intothe14 general fund. 15 16 Mr. Amundsen expressed concern about the decreases in LGA. He encouraged the Councilto17 view LGA as a bonus and not a given. He noted the State had to make a great deal of cuts dueto18 the economic climate. Finance Director Beer indicated the budget for 2011 does not includeany19 LGA funds. 20 21 Mr. Amundsen expressed his disappointed in the Council’s lack of leadership concerningthe22 budget. He felt there was a lack of new ideas brought forward and he has not seen a prioritylist23 of services necessary to residents. He urged the Council to deny the budget and speakfurther24 about the critical services that need to be provided by the City. Mr. Amundsen recommendedthe25 Council lead staff in this area and reduce the levy increase to 1% or 2%. 26 27 Mayor Flaherty explained $484,000 was taken out of the 2011 budget due to theadditional28 decreases in LGA funds. He felt this showed a great deal of leadership and initiative onthe29 Council’s behalf. He understood that residents did not want to see an increase in the tax levy, 30 and noted there has not been an increase in five years. The Council has been leading theway31 through this process and tough decisions have been made to sustain the budget going intothe32 future. He noted the Council and Staff worked diligently to reduce the need to use theLevy33 Reduction Fund. 34 35 Council Member Mueller added that staff has reduced spending and capital purchase in 2011. 36 She explained many purchases have been postponed. She felt the Council reviewed allthe37 numbers thoroughly and must provide essential services to the residents. She indicatedthe38 Council was working to minimize spending and eliminate all expenditures that werenot39 absolutely essential. 40 41 Hearing no additional public input, Mayor Flaherty closed the public hearing at 7:17 p.m. 42 43 Mayor Flaherty questioned when the openings in the police department would be filled. To increase the tax levy by 2%. 6 7 Council Member Hull questioned how much the tax levy increase would impact theaverage8 house in Mounds View. Finance Director Beer explained the impact would amountto9 approximately $20 for the average household. 10 11 Council Member Mueller indicated the contingency fund was eliminated with the 2011 budget. 12 The recent snow event would draw from these funds in 2010. She questioned how theCity13 would be affected if this continued into 2011. Finance Director Beer indicated the Cityhas14 drawn from the contingency fund in the past. However, with this fund being eliminated, staff15 would bring forward a resolution to request a fund transfer. 16 17 Council Member Mueller requested further information from staff on the number ofhours18 worked by the public works department to clear the streets and parks after a major snow storm. 19 Public Works Director DeBar estimated his staff spent 70+ hours clearing streets and parkinglots20 and another 40+ hours in the parks. 21 22 Mayor Flaherty recommended the 2% levy increase over the 3% levy increase due to the factthat23 the City has recognized savings since originally discussing the preliminary budget in September. 24 25 Council Member Stigney questioned if the 2% levy increase could be sustained. He feltthe26 Council should be working harder to make reductions to assure that the decreases canbe27 sustained into the future. The Council could then work to further reduce the costs to theCity28 while utilizing the levy reduction fund. 29 30 FRIENDLY AMENDMENT: Stigney: To increase the tax levy 0%. Resolution 7717, Relating to Issuance of the City’s MultifamilyHousing1 Revenue Bonds (Select Senior Living of Mounds View Project), Series20102 as Temporary Bonds and Authorizing the Issuance of MultifamilyHousing3 Revenue Refunding Bonds (Select Senior Living of Mounds View Project), 4 Series 2011 and the Execution of Various Related Documents. 5 6 Finance Director Beer explained the Council began the bonding process with SelectSenior7 Living in July by passing Resolution 7672 which authorized the issuance of housingrevenue8 bonds. At this time, Select Senior Living was requesting temporary bonds which wouldallow9 the market place to clear the over abundance of revenue bonds. Staff recommended approvalof10 the resolution as submitted. 11 12 Scott McLendan, Oppenheimer, explained Select Senior Living was facing several concernswith13 the timing of this bond issuance. The market was flooded with housing revenue bonds atthis14 time due to the Build America Program. These excess bonds have created a glut in themarket15 which needed to clear before a favorable bond rate could be guaranteed. The temporaryissuance16 of the $14 million in bonds was a positive option for the developer to continue with the project. 17 He indicated the bonds would then be refunded at a more favorable rate in the near future. Mr. 18 McLendan further reviewed bond market specifications with the Council. 19 20 Council Member Mueller questioned if the stock market had any bearing on the bond rating. Mr. 21 McLendan stated the stock market had no effect on the bond rating but when there wasmore22 confidence on the stock market, funds moved from bonds to stocks. 23 24 Council Member Mueller asked what impact an extension of the Build America bondswould25 have on the proposed housing revenue bonds. Mr. McLendan indicated he did not anticipatean26 extension of the program. However, there was always a chance and if extended moreissuers27 would be moving to the bond market during third and fourth quarter of 2011. 28 29 Council Member Mueller questioned if the City was at any additional risk by issuingtemporary30 bonds that would then need to be refunded in the future. Mr. McLendan stated there wasno31 more risk than the original request to issue bonds as Mounds View was acting as the conduitand32 was not fiduciarily responsible for these bonds. Jenny Bolton, Kennedy & Graven, agreedthere33 was no difference in this bond issuance as the borrower was responsible for the paymentson34 these bonds. 35 36 Council Member Hull asked why the request was before the Council and if the project wasstill37 on schedule. Joe Larson, Select Senior Living developer, explained the bond allocation wasdue38 tomorrow at noon and if not completed the project would be done. 39 40 Mayor Flaherty questioned if Oppenheimer was underwriting the temporary bonds. Mr. 41 McLendan stated a private purchaser was funding the entire $14 million in temporary bonds. 42 43 Mayor Flaherty commended Mr. Larson for working so diligently on this project. He feltthe44 project would greatly benefit the City of Mounds View. 45 Mounds View City Council December 13, 2010 Regular Meeting Page 6 1 Council Member Mueller asked how much Mr. Larson had invested in the project to date. Mr. 2 Larson stated he has invested approximately $500,000 in the project to date. Mr. McLendan3 added that Oppenheimer supported the project 100% and would underwrite the project toassure4 that the temporary bonds were refunded. Investors were supportive of the project oncebond5 rates were more favorable. 6 7 Council Member Stigney requested that Oppenheimer keep the Council apprised of thebond8 situation. The position became vacant when Mike Kampa retired in July. The PoliceCivil24 Service Commission met and reviewed the promotional process from internal candidates. The25 interview process was discussed in detail. He recommended the promotion of Officer Zender, as26 noted by the Civil Service Commission to Sergeant. 27 28 Council Member Mueller questioned why Step 3 was chosen for Officer Zender. PoliceChief29 Kinney explained Step 3 was the first step above his current level of pay. 30 31 City Administrator Ericson noted a change to the Resolution as Officer Zender would notmove32 from Step 3 to Step 4 until after 12 months, per the sergeant’s contract. The Town Hall meetingcould31 be held at City Hall or the Community Center. The Council would need to determine a datefor32 that meeting. He requested the Council approve the meeting schedule as submitted. 33 34 Council Member Gunn suggested the April meeting date be avoided as this was theMonday35 between Palm Sunday and Easter, as this may be the same week as spring break. Sherequested36 March 21st be chosen for the Town Hall meeting date. City Administrator Ericson notedspring37 break was the week of March 14th. 38 39 Mayor Flaherty commented he was more in favor of the April date as this may bring in alarger40 crowd, as the weather would be warmer. The one year term would go to the applicant that applied after the stated deadline date. 18 19 Council Member Mueller indicated the individual that turned in his application past thedeadline20 was hoping to serve for three years. Resolution 7713, Authorizing INSPEC, Inc. to Design and PrepareBidding36 Documents for 2011 City Roof Replacement Projects. 37 38 Public Works Director DeBar indicated the City has been addressing roofing issues sincethis39 past summer. All facilities were inspected by INSPEC, Inc. through a recently approvedRoof40 Management Plan. Detailed recommendations were made by INSPEC through the plan basedon41 each facility. 42 43 Public Works Director DeBar further reviewed the scope of work and which buildingswere44 recommended to have roof work completed. City Hall was slated for a partial roof replacement, 45 Mounds View City Council December 13, 2010 Regular Meeting Page 9 several well buildings, along with a complete replacement of the Community Center roof. The1 estimated expense for the recommended roof replacements is $339,720. He recommendedthe2 Council proceed with the roof replacements and authorize INSPEC to design andpreparing3 bidding documents. The City had $250,000 in the 2011 budget for the roof replacements. While4 the numbers were off by $90,000, staff felt INSPEC’s preliminary numbers were quite high. 5 6 Council Member Hull asked what would happen if the bids come in over $250,000. Public7 Works Director DeBar stated he would have to work with Finance Director Beer afterreceiving8 the plans and specifications from INSPEC. 9 10 Council Member Mueller questioned if staff could complete the plans and specifications in-11 house. Public Works Director DeBar indicated the consulting costs were necessary as this wasa12 public bid item. He noted there were not a lot of firms that complete this type of work. 13 14 Council Member Stigney asked what the 20 year warranty covered for the roof replacement. 15 Public Works Director DeBar explained the 60 mm membrane would have a 20 year warranty. 16 He indicated he could provide the Council with further information within the design plans. 17 18 Mayor Flaherty clarified that the City had $250,000 for this project in total and not just forCity19 Hall. He questioned if the water tower revitalization surplus could be used on this project. 20 Finance Director Beer indicated the funds to cover the water tower revitalization expensewere21 from water funds and could only be used for the roof replacements on the wells. PublicWorks22 Director DeBar reiterated that this would be a public bid and the climate was highlycompetitive23 at this time. If the bids returned over and above $250,000 the Council could revisit the optionsor24 bid alternates of the project. 25 26 Mr. Amundsen expressed concern with INSPEC bidding highly on these items. He questionedif27 the roof life would be longer than 20 years and if any of the roofs currently had a warranty. 28 Public Works Director DeBar indicated bids typically had an inflated estimate as thiswould29 allow the numbers to come down in final design. He indicated the Community Center had a1030 year life and the 10 years had elapsed. City Administrator Ericson indicated this has not occurred to date. 4 5 Council Member Stigney suggested the personnel manual be changed to “at will” instead of “just6 cause.” City Administrator Ericson explained the “at will” language would affect 10employees7 at City Hall. This has been discussed with the City Attorney and this change could be madeif8 the Council deemed necessary.
