Staff has identified several parts of Title 1000 that the City should change and update. Background: On January 10, 2011, the City Council approved the introduction and first reading of Ordinance 853. This is an ordinance that makes changes to Title 1000 (Building and Development regulations) of the City Code. Discussion: Since the Council work session on December 6, 2010, City staff has investigated further when a property owner must use a licensed contractor to do work or to make improvements to their property. To summarize, if a contractor is doing work that requires a building permit, they must have either a State license or a City license. For a City license, staff ensures that the contractor has liability and worker's compensation insurance. State residential contractor licenses apply to contractors working on buildings with up to four units. These licensed contractors must prove competency and complete continuing education in order to maintain their State license. The Department of Labor and Industry DOLI) does the licensing of contractors for the State. Chapter 326B of Minnesota State Statutes defines residential buildings with one to four units as residential real estate and those with more than four units as a commercial property. The State considers contractors working on dwellings with more than four units as commercial contractors and no State contractor license is required. The City of Mounds View licenses these commercial contractors (MV Code Section 1006.04). As part of this requirement, the City requires the contractors to provide proof of general liability insurance as outlined in City Code 1006.04 Subd. 6. Sufficient insurance is critical in the case of an accident or any unforeseen expense from doing substandard work. Ordinance 853 Staff Report January 24, 2011 Page 2 As we noted in December, staff did a thorough review of all of Title 1000 of the City Code. This review by staff revealed several parts of Title 1000 that the City needs to change and update. The Code changes are necessary because changes in State regulations, changes in City practices and policies and a need to help clarify various parts of the Code. More specifically, the City should update the Code references to State statutes (especially those related to the electrical and plumbing codes), clarify the practices and penalty sections, and clarify what projects need building permits and what projects need zoning permits from the City. Staff also is proposing changes to the Code language about contractor licensing including the removal of the language that requires City Council approval of contractor licenses. Since the City Council does not investigate the contractors or have any detailed information about them, it is unnecessary for the City Council to approve contractor licenses. This is an administrative task that City staff can and should perform. At the direction the Council on January 10, staff changed Section 1006.02, Subd. 4 of the ordinance (on page 10) about the City refunding (or not refunding) permit and plan check fees. Recommendation: Staff recommends that the City Council approve the second reading and adoption of Ordinance 853. This ordinance makes changes to Title 1000 (Building and Development regulations) of the City Code. Residential Certificate of Occupancy shall be granted upon completion of work and final approval by the Building Official. Subd. 2. Commercial Certificate of Occupancy shall be granted in conjunction with the Fire and Building Code Officials only after a fire inspection has been conducted and approved when the business is completely moved in and ready to operate. Subd. 3. The exterior of any building shall be completed prior to occupancy of that building. 1001.08: TEMPORARY CERTIFICATE OF OCCUPANCY: Subd. 1. Residential: A Temporary Certificate of Occupancy may be granted prior to sodding or seeding the lawn and finishing the driveway if approved by the Building Official. Subd. 2. Commercial: A temporary certificate of occupancy for not more than sixty (60) days for commercial and industrial applications may be granted prier to before the required fire inspection approval. The City must inspect and approve all required fire protection systems. SECTION 3. The Mounds View City Council hereby amends Title 1000, Chapter 1002 of the Mounds View City Code about the Fire Code by deleting the strieken language and adding the underlined text as follows: 1002.01: ADOPTION OF STATE CODES: Subd. 1. The most current edition of the Minnesota State Fire Code, as adopted by the Commissioner of Public Safety pursuant to Minnesota State Statutes, Chapter 299F.01 1, including all the amendments, rules and regulations established, adopted and published from time to time by the Minnesota Commissioner of Public Safety, through the State Fire Marshal Division is hereby adopted by reference including Minnesota State Amendments H and I. The Fire Chief may amend these regulations from time to time as needed. Copies of the regulations are available at City Hall or the Fire Department. 1002.03: ENFORCEME NT OF PROVISIONS: Subd. 1. Enforcement of Fire Code: The Minnesota State Fire Code shall be enforced by the Fire Marshal, who shall be appointed by and operate under the supervision of the Chief of the Fire Department. Subd. 2. Inspectors: The Code Official shall have the authority to appoint a deputy code official, other related technical officers and inspectors as shall, from time to time, be necessary. Subd. 3. Annual Report: A report of the Bureau of Fire Prevention shall be made annually and transmitted to the Council. 1002.04: PERMIT FEES: All Fire Department permit fees shall be set in accordance with a fee schedule adopted by resolution of the City Council. 1002.05: APPEALS BOARD: The Fire Department Board of Directors and the Fire Chief shall act as the local board of appeals with regard to enforcement of this Chapter and the Minnesota Uniform Fire Code. 1002.06: PENALTIES: Subd. 1. Any persons, firm or corporation whieh shall that violate any provisions of this Chapter and/or of the Minnesota Uniform Fire Code shall be guilty of a misdemeanor. Subd. 2. The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions. Subd. 3. Each day any such violation shall continue shall constitute a separate offense. 1002.07: MINOR POSSESSION OF IGNITION DEVICES PROHIBITED: Subd. 1. Definitions: Ignition device, for the purpose of this Section shall be defined as: a. Matches. 11 b. Lighters. c. Any other materials when used for purposes of ignition. Subd.2. Prohibitions: a. No minor may possess any ignition device, unless under the direct supervision of, or with the direct permission of, a parent or legal guardian; b. No person may sell, give, deliver, or make accessible, any ignition device to a minor; and c. No owner of a place of business may make ignition devices accessible to minors at the place of business. Subd. 3. Confiscation: Any ignition device possessed by a minor may be confiscated by any peace officer, Fire Chief or authorized designee of the Fire Chief. Once confiscated, the ignition device shall become property of the confiscating authority and shall be processed accordingly as evidence in the commission of a crime or made inoperable and disposed of properly. Subd.4. Penalties: a. Any person, -she shall that violates any of the provisions of this Section hereby adopted shall for each and every violation, be punished by a forfeiture of the ignition devices and/or a fine of not less than fifty dollars ($50.00) ner but no more than two -hundred dollars 200.00) for each offense as determined by the Fire Marshal, plus any costs and surcharges as required by law; and b. The Fire Marshal may waive any penalties if a guilty minor attends and pays for the cost of the Anoka County Juvenile Fire Setter Intervention Program or an equivalent program approved by the Fire Marshal. 1002.09: EXPIRATION OF FIRE PERNIITS: Fire Permits will exnire in accordance with the provisions of the Minnesota State Fire Code. 1002.10: STOP WORK ORDERS: Whenever any work is being done contrary to the provisions of the Fire Code or the City Code, the Fire Marshal may order the work stopped by written notice served on !Uy persons engaged in doing or causing such work to be done. Building Permit Required a. Before proceeding with the construction, enlargement, alteration, repair, moving', improvement removal conversion or demolition of any part of any building or structure, the owner or agent shall first obtain a building permit for such purpose from the City Building Official. b. Exceptions: The City does not require a building permit for such work specified as being exempt from permits in the Minnesota State Building Code. Subd. 2. Payment of Fees and Expenses: A permit fee, established a.,..., time to fi .. the amount for which is approved by resolution of the Council, shall be paid to the City before Muaieipality prior to the issuance of any permit herein prescribed. Subd. 3. Building and Construction Valuation: Building valuation, for the purpose of establishing building permit fees, shall be as adopted by the City Council by resolution and may be amended from time to time. Valuation for alterations, repairs or extensions shall be determined by the Building Inspeeter Official based on the Building Inspeeter's--Official's estimate of the materials cost and the labor cost to put the construction in place. Subd 4 Permit and Application Fee Refunds: The City may refund building permit fees for work that has not commenced within one hundred eighty (180) days of the City issuing the permit The City will not make any fee refunds after one hundred eighty (180) dys of the City issuing the permit All persons requesting a refund shall make the refund request in writing. The City will reimburse the paid fees to the person or party that made the initial payment unless the Building_ Official authorizes the payment to another person or party. The City will not refund the plan check fee if the City has performed a plan check The City shall not refund State Surcharges or fees that the City has reported to the State of Minnesota. 1006.03: PERMIT EXTENSIONS: If the work for which a permit was issued does not commence within one hundred eighty (180) days or if the work is suspended or abandoned for a period of one hundred eighty (180) days, the permit shall be considered void and invalid. The Building Official may grant, in writing, extensions for periods not more than one hundred eighty 180) days each. The extension shall be requested in writing and justifiable cause demonstrated. General Commercial Contractors: A City -license granted to a general Commercial contractor shall include the right to perform all of the work included in the general contract but shall exclude ary work that reauires a separate license issued by the State of Minnesota. Such license shall include any or all of the persons performing the work under the general contract, providing that each person performing such work is in the regular employ of such general contractor and qualified under State law and the provisions of this Code to perform such work. In these cases, the general contractor shall be responsible for all of the work so performed. Subcontractors, who are persons not in the regular employ of a general contractor, shall be required to ,., mplyly v^4 meet the Sections of this Code pertaining to license and insurance qualifications for the subcontractor's particular type of work. Subd. 6. Revocation or Suspension: a. Authority of Council: The Council shall have the power to suspend or revoke the City license of any person licensed under the regulations of this Code whose work is found to be improper or defective or so unsafe as to jeopardize life or property, providing the person holding such license is given twenty (20) days' notice and granted the opportunity to be heard before such action is taken. If and when such notice is sent to the address of the licensee as stated on the application and applicant fails or refuses to appear or respond at the said hearing, the license will be automatically suspended or revoked. five (" days ester twe date of heafing. b. Suspension: A City contractor's license suspension shall be not less than thirty (30) days nor more than one (1) year, such period being determined by the Council. c. Pools and associated mechanical equipment shall be maintained so as not to constitute an unattractive, public or private nuisances. Swimming pools shall be located on property in a manner so as to comply with all applicable provisions of Title 1100 of this Code. Subd. 2. Utility Easements: Pools shall not be located within any utility easement or be over or under any utility lines. 1009.04: FENCING REQUIRED': Subd. 1. All outdoor swimming pools shall be made inaccessible when not in use by a non_ climbable type of fence, wall or barrier. All openings or points of entry into the pool area enclosure shall be equipped with locking gates. The fence and gates shall be at least four (4) feet in height and shall be constructed of a material approved by the building official. All fence posts shall be decay resistant or corrosion resistant and shall be set in concrete bases or other suitable protection. The opening between the bottom of the fence and the ground or other surface shall not be more than two (2) inches. Subd. 2. All gates shall be equipped with self-closing hinges and a self -latching device. Where the release mechanism of the self latching device is located less than fifty-four (54) inches from the bottom of the gate, the release mechanism shall be located on the pool side of the gate at least three (3) inches below the top of the gate. All gates shall be equipped with a lock which will render the gate inaccessible when the pool is not in use. Ladders and steps shall be capable of being secured, locked or removed to prevent access. All locks shall be of the type that W14 cannot be opened without the use of a key or numerical combination. Subd. 4. No person owning or operating an outdoor swimming pool shall use, operate, or allow the use of such swimming pool unless such pool complies with the above provisions. Because of this request, staff decided to discuss increasing the allowed uses in a B-2 zoning district with the Planning Commission and City Council. Background: On December 6, 2010, City staff discussed with the City Council the idea of adding permitted and conditional uses to the B-2 zoning district, including restaurants. The City Council was supportive of the idea and directed staff to proceed with preparing a code amendment to make the changes to the B-2 zoning district. The Planning Commission passed Resolution 936-11, approving the proposed amendments to the B-2 zoning code on January 5, 2011. Discussion: The B-2 zoning designation allows commercial and service oriented businesses such as laundromats, locksmiths, delicatessens, financial offices, florists, sporting goods and hardware, to name a few. The property owner, Kraus Anderson, continues to struggle to get tenants in Silver View Plaza and the City wants to help where it can. City Staff asked the Planning Commission if they would be open to adding more permitted or conditional uses to the B-2 zoning code, particularly relating to restaurants. The Planning Commission agreed that it did not make sense to limit the types of restaurants based on what type of cooking is done. The Commission suggested amending the zoning code to allow a “small restaurant, café and tea room” as a permitted use in a B-2 district. The Code would define a small restaurant as being limited to 24 seats and no more than 2,000 square feet in size. The Commission also suggested allowing restaurants with more than 24 seats and more than 2,000 square feet in floor area in a B-2 zoning district as a conditional use. As noted above, the Council was in agreement with the code changes as proposed by the Planning Commission, and directed staff to prepare an ordinance with the amendments as discussed. This resolution requires that the City Council approve all seasonal positions. Discussion: Annually the City Council has approved the hiring of seasonal Public Works positions. Resolution 5546 requires that approval take place six weeks prior to actual hire of seasonal employees; therefore, this is typically done early in the calendar year. Seasonal Employees benefit the City by providing labor services during periods of higher labor demand at much lower pay rates keeping overall labor costs down. In return, seasonal employees benefit from the skills and work ethics they learn on the job. As a result, the employees, the City, citizens, and taxpayers all benefit from this program. Historically, there have been three time periods throughout the year when the City has employed seasonal workers. These periods have been: Summer (10 positions), Fall (2 positions), and Winter (1 position). In 2009, it was the consensus of the City Council and Staff to decrease the Summer seasonal positions from 10 to 8 positions, due to the budgetary cuts in state aid. This number was further reduced in 2010 when the part-time water division position was eliminated and reclassified as a public works seasonal position. Staff is recommending 8 seasonal positions for 2011. Summer Seasonal Employees – Duties include general Public Works and parks maintenance duties. The employees generally are employed for about three months in the summer – mid-to late-May to mid-to late-August. Typically one Parks Division seasonal employee and the Water Division seasonal employee begin employment in April. Fall Seasonal Employee – There are two (2) seasonal positions, one (1) in Public Works Water Division and one (1) in the Parks Division. Duties performed by the Public Works Water Division seasonal employee include assisting with the utility locates and water hydrant and valve maintenance among other duties. The Sewer Division fall seasonal employee is not proposed to be filled for 2011. The duties of the fall seasonal employee in the Parks Division include fall activities such as leaf clean up and providing assistance to both Public Works and Parks in year-end maintenance activities. These positions would start approximately in late August. The Parks Division seasonal employee would work until the end of November. The Public Works Sewer seasonal employee would work until the end of December, weather permitting. Winter Seasonal Employee – In the past, one winter seasonal position was provided to service and maintain the City’s ice rinks and warming houses. This position typically ran from December to February of the following year. Although the position was approved for the 2010/2011 Winter, Staff did not fill this position to assist with budget constraints. Staff is proposing not filling the Winter Seasonal Employee position for the 2011/2012 Winter. Wage Proposal for 2011 Seasonals: Staff recommends no wage increases for 2011 Public Works Seasonals. In 2010, new hire seasonal positions were filled at $11.00/hour, and returning seasonal workers were compensated at $11.75/hour. Each summer seasonal employee will work 40 hours per week. The fall seasonal employees and ice rink employee may also work 40 hours per week: however, hours may be fewer since these positions are often filled with college students. All seasonal positions will remain on staff for a period no longer than six months. Recommendation: Staff recommends approving the Seasonal Public Works Positions for 2011. Background/Discussion: As part of the Urban Forestry activities, the City hires a tree contractor to perform tree trimming for trees on public property (rights-of-way and parkland) during winter months. Winter is often the best time to trim trees since no active growth is occurring and frozen ground provides better access to remote trees and minimizes restoration. Trees require regular maintenance, like trimming, to remain healthy and prevent damage from storms, high winds, insects, and disease. Some common hazards from boulevard trees include dead or overgrown branches making traffic signs difficult to see or interfering with vehicles sightlines at intersections. The City contracts with a licensed tree contractor to perform the tree trimming activities. Quotes were solicited and received by two qualified tree contractors to provide a two -person crew, bucket truck, chipper, and a chip truck as follows: 1. 4 Seasons Tree Care, Inc. (Pierz, MN): $130 per hour 2. Upper Cut Tree Services (Forest Lake, MN): $150 per hour All work direction and inspection is done by the City's Forestry Consultant, Mr. Rick Wriskey. The work areas for this winter include east -west roadway corridors and two parks: Silverview and Lambert. The 2011 adopted Budget includes $9,000 in the Forestry fund (100-4380- 3030) and $2,000 in the Parks Fund (100-4360-3030) for tree trimming activities. A standard Independent Contractor Agreement will be used for the tree trimming work.
