42 A. 2024 MVPD Annual Report—Police Chief Zender.

44 Police Chief Zender reviewed the 2024 Mounds View Police Department Annual Report with the
45 City Council. He thanked all of the residents who donated to the Polar Plunge this year noting
46 $2,900 was raised for Special Olympics. He discussed the departments staffing at this time,noting

1 the department currently has 17 officers. He commented on the outreach events noting the
2 department continues to be active in the community.He reported the K9 team continues to do great
3 things for Mounds View and neighboring communities. He discussed the stats for 2024 noting
4 calls for service were relatively the same as were arrests, but citations,mental health calls, DWI's
5 and traffic stops were up. He explained he appreciated how FLOCK was positively impacting the
6 community and commented further on the training his officers received in the previous year.

8 Council Member Gunn requested further information on the New American's Academy. Police
9 Chief Zender explained he would be coordinating with the SBM Fire and the city of Blaine to
10 create a New American's Academy for Mounds View residents.
11
12 Council Member Meehlhause commended Police Chief Zender for hiring high quality officers and
13 for maintaining the right culture within the Mounds View Police Department.
14
15 Council Member Smith thanked Police Chief Zender for his detailed presentation and high-quality
16 annual report.

18 Council Member Clark questioned how residents could sign up for a firearms safety course. Police
19 Chief Zender explained residents can register through the DNR website or through word of mouth.
20 He stated he tries to hold courses in the spring and fall. He reported children must be at least 11
21 years of age when signing up for the course.
22
23 Mayor Lindstrom requested further information on the police work that has been assisted by
24 FLOCK. Police Chief Zender reported FLOCK has been paying for itself and has been a force
25 multiplier. He explained FLOCK was used to assist with the recent copper theft at The Mermaid.
26
27 Mayor Lindstrom thanked Police Chief Zender and the entire team for the great work they do on
28 behalf of the community.

30 B. 2024 Tubman Annual Report.
31
32 Jennifer Dickinson, Tubman representative, reviewed the 2024 Annual Report with the City
33 Council. She commented on the legal advocacy services provided to Mounds View residents that
34 have experienced relationship violence, other forms of violence, mental health issues, trafficking
35 or homelessness. She explained her primary focus was on those experiencing relationship violence,
36 orders for protection, and harassment/restraining orders. She stated the legal advocacy services
37 provided were confidential and client centered between a client and the courts. She explained she
38 works really hard to provide an attorney and an advocate for each client. She noted Tubman has a
39 shelter and youth housing in Maplewood that serves people from Ramsey, Hennepin and
40 Washington County's. She commented further on the services that were being provided to youth
41 to encourage healthy relationships. She encouraged the Council to visit the Tubman website to see
42 the organizations entire program guide. She reported Tubman has a 24/7 number for law
43 enforcement to call in the event a resident of Mounds View was in need of assistance and further
44 described the services that can be provided to victims. She stated Tubman worked on 40 new cases
45 for Mounds View residents in 2024, developed 91 safety plans and offered 366 total advocacy
46 services. She reported ongoing challenges continue to be lengthy court processes, multiple needs

1 of clients as well as the need for more resources and government funding. She commented
2 Harriet's Haven for Pets, a pet sanctuary that would house up to eight dogs, would be up and
3 running later this year. She then reviewed a client success story from a Mounds View resident and
4 thanked the City for their continued support of Tubman.

6 Council Member Meehlhause thanked Ms. Dickinson for her detailed presentation. He asked what
7 type of federal funding Tubman currently received. Ms. Dickinson explained Tubman received
8 29% of their funding through federal funding. She indicated if Tubman were to lose this funding
9 her organization would be greatly impacted.
10
11 Council Member Gunn thanked Ms.Dickinson for everything she does on behalf of the community
12 and those who were in need of Tubman's advocacy services. She reported the City of Mounds
13 View does assist with funding Tubman services and she was proud to support this organization.
14 She commented further on how Tubman had lost its funding from Ramsey County.
15
16 Council Member Smith questioned when Harriet's Haven for Pets would be open. Ms. Dickinson
17 stated her goal was to have this service available this fall.
18
19 Mayor Lindstrom questioned if Tubman received any other city partners in the past year. Ms.
20 Dickinson explained Tubman had partnerships with Mounds View, Falcon Heights, Vadnais
21 Heights and Roseville.
22
23 Mayor Lindstrom encouraged Ms. Dickinson to speak with the Ramsey County Board to see if the
24 new Commissioners would be willing to support Tubman again going forward. Ms. Dickinson
25 stated she would be speaking with the Ramsey County Board.

27 7. PUBLIC COMMENT

29 Mayor Lindstrom encouraged the public to speak with kindness and respect when addressing the
30 City Council during Public Comment.

32 Vince Meyer, 8380 Spring Lake Road, asked if the City was required to receive three bids for the
33 Tribute Park.
34
35 City Attorney Riggs responded by addressing the City's requirements for projects that must be
36 competitively bid versus projects that do not require a formal bidding process.
37
38 Mr. Meyer stated he understood the City has raised over$65,000 already for the Tribute Park. He
39 questioned how much the park would cost in total and wondered how much the maintenance fees
40 would be for the park long term.

42 Luke Edmond, 8407 Spring Lake Road, reported he had an Ace Solid Waste representative
43 peddling at his home last Friday. He explained he wanted to be more diligent about keeping the
44 riff raff out of his neighborhood and to ensure these solicitors were not taking advantage of his
45 neighbors.

1 Kris Lillemo, stated he was highly concerned with the new Tribute Park. He indicated the City
2 was proposing to spend$175,000 to honor people within the park,but noted these people chose to
3 fight for people. He feared that Mounds View would not have funding for its parks in the future or
4 that taxes would continue to increase exponentially.He encouraged the City to address its spending
5 and perhaps consider spending$175,000 to turn Woodcrest Park into a nature park versus creating
6 a Tribute Park. He believed a better honor to those who have served this country would be to create
7 parks that serve the overall community.

31 cigarette license holders to have a background check every time they renew their license.

7 home occupations for massage therapy.

18 B. Resolution 10062, Authorize Sanitary Sewer Line Rehabilitation Project -
19 CIPP (cured-in-place pipe).

21 Public Works/Parks and Recreation Director Peterson requested the Council authorize Sanitary
22 Sewer Line Rehabilitation Project - CIPP (cured-in-place pipe). He explained the City did not do
23 a project last year but was looking to complete CIPP improvements in 2025. He reviewed the lines
24 that would be targeted this year noting the City had $1 million in the budget for this project and
25 the project would be publicly bid.

27 Council Member Meehlhause questioned what percentage of the City's pipes have been lined.
28 Public Works/Parks and Recreation Director Peterson stated the City had 80% of its pipes lined.
29
30 Mayor Lindstrom asked how big the lines were that were being lined. Public Works/Parks and
31 Recreation Director Peterson reported the lines were anywhere from 12" to 16". He commented
32 on how the number of deep lines in the City has assisted with reducing the number of lift stations
33 that were required.

40 C. Resolution 10063, Approving Cooperative Agreement with Ramsey County
41 for the 2024/2025 Mounds View Boulevard Improvement Project.

43 Public Works/Parks and Recreation Director Peterson requested the Council approve a
44 Cooperative Agreement with Ramsey County for the 2024/2025 Mounds View Boulevard
45 Improvement Project. He explained this agreement was for the signal lights along Mounds View
46 Boulevard. He reported Ramsey County has estimated the City's portion of this project would be

1 $1,051,323.01. Staff commented further on the project and recommended approval.

3 Council Member Meehlhause asked if staff received a detailed breakdown on the costs per
4 intersection. Public Works/Parks and Recreation Director Peterson stated he had received this
5 information from the County noting each intersection was relatively close to the same amount.
6
7 Council Member Smith reported the City budgeted $818,000 for this project. She inquired how
8 the City would make up the difference. Finance Director Bauman reported the difference would
9 be taken into account within the five-year CIP and adjustments would be made. Public
10 Works/Parks and Recreation Director Peterson added that this project would be completed in 2025,
11 but the City would not be billed until 2026.

13 Mayor Lindstrom commented he spoke with the City Administrator and County Manager
14 regarding the price increase for this project. He understood this change was not the Public Works
15 Director's fault. Public Works/Parks and Recreation Director Peterson explained he expressed his
16 frustration with the County for changing the price for this project after an agreement had already
17 been reached.

21 Boulevard Improvement Project.

23 Council Member Clark asked if Safe Routes to School dollars could be used for this project.Public
24 Works/Parks and Recreation Director Peterson reported the school district would have to sign off
25 on this project and noted staff has not had success in working with the school district in the past.

29 D. Resolution 10064, Requesting Municipal State Aid Funds Advance for the
30 Ramsey County 2024/2025 Mounds View Boulevard Improvement Project.

32 Public Works/Parks and Recreation Director Peterson requested the Council request Municipal
33 State Aid Funds Advance for the Ramsey County 2024/2025 Mounds View Boulevard
34 Improvement Project. He commented on how the one-time advancement in MSA funds would
35 assist with covering the overages for the Ramsey County Mounds View Boulevard improvement
36 project.

38 Mayor Lindstrom stated if this funding were granted, would the State withhold payment for what
39 was owed to the City. Public Works/Parks and Recreation Director Peterson reported this was the
40 case.

42 Council Member Clark asked if the City would be receiving the same amount of money over time,
43 or does this request just change when it comes in.Finance Director Bauman stated this was correct.
44
45 Council Member Meehlhause indicated MSA funds can only be used for roadways the City has
46 designated as a State Aid route.

8 E. Resolution 10066, Approve the Directive to Limit Duties Regarding Diseased
9 Trees on Private Property.

11 Public Works/Parks and Recreation Director Peterson requested the Council approve the directive
12 to limit duties regarding diseased trees on private property. He reviewed a chart that address the
13 amount spent on tree removal from 2021 through 2025 as well as noting the amount that was billed
14 to property owners. He commented in 2025 there would be an estimated 190 private trees removed
15 and in 2024 there were 593 private trees and 75 boulevards trees removed. He explained in 2025,
16 private trees were to be marked by the City and notices would be given to the property owners and
17 trees would only be removed if requested by the property owner. Staff commented further on the
18 options available within the diseased tree removal program and requested final confirmation from
19 the City Council on how to proceed. He reported he spoke with the City Attorney and the City
20 Attorney recommended the program remain as is.

22 City Administrator Zikmund stated staff was obligated to bring the City Attorney's
23 recommendation to the Council. He suggested the City Attorney speak further to his
24 recommendation.

26 City Attorney Riggs explained he discussed the diseased tree program with Public Works/Parks
27 and Recreation Director Peterson.He reported the City had a reasonably robust and very defensible
28 process in place. He indicated the removal of trees has become a concern in communities due to
29 Emerald Ash Borer and Oak Wilt. He commented on the liability issues that were being created
30 when these trees are not removed. He urged the City Council to trust the City Forester on which
31 trees need to be removed. He reported if a tree were to land or hit a private party in a public right
32 of way, the City would be liable. He indicated it was better for the City to have a process in place
33 to have diseased trees removed than to risk a tree falling on a private party.

35 Council Member Smith stated if Option 2 were pursued, a tree would be marked but not removed
36 and this removal would be up to the resident. City Attorney Riggs reported this was the case,noting
37 if the homeowner failed to remove the tree after it was marked, the homeowner could risk not
38 receiving a payout from their homeowners insurance if the tree were to fall and do damage. He
39 explained the City was trying to make the tree removal voluntary,but noted this was a safety issue.

41 Council Member Smith commented if the City were to continue with the current diseased tree
42 removal program, could more time be provided to the homeowners. She asked if there were grants
43 available to assist with the removal costs for homeowners with multiple trees. Public Works/Parks
44 and Recreation Director Peterson stated the timeline for the tree removal depends on the tree. He
45 indicated elms have to be taken down immediately to assist with not spreading Dutch Elm. He
46 reported oaks have to be taken down after the first hard frost or before March 1. He explained ash

1 trees should be taken down immediately because they become more and more brittle over time.
2 He stated he has given homeowners more time to receive quotes for the tree removal, but most
3 times, they are not able to find a contractor that can do it cheaper than the City's contractor. He
4 commented on how the City works with homeowners on repayment of assessments and noted there
5 may be grants available to assist homeowners that have to have multiple trees removed.
6
7 Council Member Meehlhause stated the City controls the timing of the trees being removed from
8 the boulevard. Public Works/Parks and Recreation Director Peterson reported this was the case.
9 He commented on how the number of trees needing to be removed was going to go down,because
10 the ash trees will have been removed.
11
12 A resident attending the meeting asked if trees in the boulevard were the City's full responsibility
13 if needing to be removed.
14
15 Mayor Lindstrom reported there would be a 50150 cost share between the City and the resident for
16 these trees.
17
18 A resident attending the meeting stated he did not believe a dead pine tree in the middle of his yard
19 should be a City issue.
20
21 Council Member Smith reported the program being discussed only addressed diseased trees.
22
23 Luke Edmond asked if the City would be replanting trees given the number that have been
24 removed. Public Works/Parks and Recreation Director Peterson reported when the City removes
25 trees from public property they have to be replaced at a 2:1 ratio. He indicated this was not the
26 case for trees removed on private property or within the right-of-way.

28 Sharon Kircher stated she had eight oak trees in her yard and asked if oak wilt was growing in
29 Mounds View. Public Works Director Peterson explained when oak trees are stressed or in a time
30 of drought, oak wilt can spread.

32 Council Member Smith asked if it was necessary to remove the stumps for diseased oak and ash
33 trees. Public Works/Parks and Recreation Director Peterson reported it was not necessary to
34 remove the stumps.

36 Council Member Clark commented on how oak wilt would spread into her yard quicker if her
37 neighbors diseased trees were not treated. Public Works/Parks and Recreation Director Peterson
38 stated generally with oak wilt, the disease cycles after drought years. He commented on how new
39 tree varieties were being created that were more disease resistant.

2 Vehicle Along with Additional Equipment and Set Up Costs.

4 Police Chief Zender requested the Council approve the purchase of one police administrative
5 vehicle along with additional equipment and set up costs. He explained he was scheduled to
6 replace one administrative vehicle in 2025, noting the funds for this expense would be covered by
7 the Vehicle and Equipment Fund. He reviewed the proposed costs for the vehicle and set up and
8 recommended approval from the Council.
9
10 Council Member Clark questioned if this would be the second vehicle the department would have
11 like this. Police Chief Zender reported this was the case noting the current Chevy Impala would
12 be going to State auction.
13

36 Council Member Clark indicated there would be a joint City Council/Park,Recreation and Forestry
37 meeting on Thursday, February 27 at City Hall where the park master plan will be discussed.

39 Council Member Clark commented on the flyer that was included in the recent water bill and
40 encouraged teens in the community to consider attending the Teen Center at the Community
41 Center Mondays and Wednesday from 3:00 p.m. to 6:00 p.m. She noted there was a toddler open
42 gym time at the Community Center on Wednesday from 8:00 a.m. to 11:00 a.m.

44 Council Member Clark encouraged the community to attend the March into Spring garden expo at
45 the Community Center on Saturday, March 1 from 10:00 a.m. to 2:00 p.m.

19 Finance Director Bauman reported the auditors were with the City all of last week.

21 Public Works/Parks and Recreation Director Peterson stated there were 140 properties that have
22 yet to replace their water meter. He noted a certified letter would be sent to these properties as a
23 final notice to have the water meter replaced. If action is not taken, a $175 fee will be placed on
24 the quarterly utility bills for these properties until the water meter is replaced.

26 Public Works/Parks and Recreation Director Peterson reviewed a letter that would be sent out
27 regarding the Silver View Pond project. He indicated this project would begin on Monday, March
28 10 with tree removal. He noted the contractor would be working on this project through the spring
29 and summer of 2025.

31 Public Works/Parks and Recreation Director Peterson reported staff is seeking approval from the
32 Council to apply for a Safe Streets and Roads for All Grant that would help study streets that have
33 speeding issues. He indicated this was a grant through the federal government that would assist
34 with providing traffic calming measures. Staff was recommending grants be pursued for Groveland
35 Road and Spring Lake Road.

RESOLUTION OF APPRECIATION TO THE MOUNDS VIEW
ECONOMIC DEVELOPMENT COMMISSION FOR THEIR DEDICATED SERVICE
WHEREAS,the Mounds View Economic Development Commission (EDC)was established in 1994; and
WHEREAS, the Commission has served as an advisory commission to the Economic Development Authority on
matters relating to fostering a positive economic climate, encouraging economic development, and enhancing the tax base of
the city;and
WHEREAS, the Commission has made recommendations to the Economic Development Authority regarding
retention and expansion of existing businesses, attraction of desirable new businesses, redevelopment and rehabilitation
opportunities and other appropriate economic development strategies; and
WHEREAS, because of reduced economic development activity as Mounds View is nearly fully development and
the fact that the EDC has accomplished most of the priority items over the years, the City Council has approved to dissolve
the Commission; and
WHEREAS, the City of Mounds View would like to acknowledge the members serving on the Commission at the
time of its dissolvement;and
WHEREAS,these members have served on the Economic Development Commission with heartfelt dedication and
enthusiasm;and
WHEREAS,these members have shown a sincere interest in the welfare of the citizens of Mounds View during their
tenure on the Commission.
NOW,THEREFORE,BE IT RESOLVED that the City Council,on behalf of Staff and the residents of the City of
Mounds View, expresses its sincere appreciation to the members of the Economic Development Commission for their

Introduction: Chapter 90.005 of the Mounds View Code allows limited and controlled
raising and keeping of chickens and/or ducks on properties zoned R-1, Single Family. Shelly
Rosene has applied to raise and keep chickens on her property.
Discussion: The applicant, Shelly Rosene, has applied to raise and keep chickens on
her property located at 2809 County Road H2. The City Code allows up to twelve chickens
at one time and requires that backyard areas within which the chickens roam be fenced.
Ms. Rosene has indicated that she plans to raise and keep 12 chickens at this time. Ms.
Rosene has also indicated that the entire backyard is enclosed with a chain link fence.
Also, the chicken coop will meet the City Code requirement of a minimum of 20 feet from
all property lines.
In accordance with Chapter 90.0005, initial applications shall be considered by the City
Council after holding a public hearing. Approval of renewal applications are done
administratively unless the City has received substantial complaints or related violations
have been documented during the previous year.
As required, staff has published a public hearing notice in the Monday, February 24, 2025,
edition of the Pioneer Press, the City's official newspaper. In addition, as required, notices
were mailed to residents within 350 feet of the subject property.
It appears Ms. Rosene meets all requirements of Chapter 90.005.
Ms. Rosene has indicated that she will be present at the City Council meeting/public hearing
to answer any questions you may have.
This is an annual license and will expire December 31, 2025.

for no more than 12 chickens or 12 ducks or a combination of both.
BE IT FURTHER RESOLVED that the license may be revoked or denied by the
City Council based on negligence, nuisance, or violation Chapter 90.005.
BE IT FINALLY RESOLVED that the license will expire December 31, 2025, and
shall be renewed annually.

Chicken and Duck Permit Requirements:
1. Located on single-family residential properties only
2. Limit of a total of 12 chickens and/or ducks
3. New chicken/duck keeping permits require a public hearing (notices will be mailed to all property owners with 350 feet of applicant's
property) and approval by the City Council
4. Annual renewal permits may be approved administratively unless there have been substantiated complaints or related violations during
the previous year

Coop dimensions
Coop setbacks from all property lines and the house
6. Zoning permit if the coop will be a new structure. The coop must meet all accessory building requirements in Section 1106.06 of the
Zoning Code
No more than 3 accessory buildings are allowed per property (this includes all garages, sheds and coops)
Maximum of 1,800 square feet total of accessory building per property.
Coop Structure and Bird Containment Requirements:
1. Cool structures must be set back at least 20 feet from all property lines and the applicant's house,
2. Coop structures shall only be located in rear yards,
3. Backyard areas within which chickens or ducks are allowed to roam shall be fenced to confine the birds to applicant's property (zoning
permit required for new fences).
Additional Requirements:
1. No roosters or drakes allowed,
2. No slaughtering or beheading of the birds is permitted,
3. Food shall be stored in a watertight, rodent-proof container.

Introduction:
Staff keeps a running list of proposed revisions needed to the Mounds View City Code.
We bring before you the following proposed ordinances with amendments to several
chapters of the City Code.
Discussion:
Here is a brief description of the proposed ordinance changes to the City Code:
Ordinance 1026, Chapter 10 — Add City Administrator and Code Enforcement Officer to
list of those authorized to issue administrative offenses for Mobile Food Vehicles and
Peddlers, Solicitors, Transient Merchants.
Ordinance 1027, Chapter 33 — Remove the entire section regarding "Police Advisory
Commission" from the City Code as the commission has been disbanded.
Ordinance 1028, Chapter 71 — Update the definition of "Truck" to include recreation
vehicles as requested by the Code Enforcement Inspector.
Ordinance 1029, Chapter 90 — Update conditions of a honeybee-keeping license to
include Staff to contact licensees on an annual basis to confirm that hives are still
active.
Ordinance 1030, Chapter 91 - Add "recreational vehicle to the definition of a
"commercial vehicle" AND remove definition of noxious weeds and replace with MN
Department of Ag's "Noxious Weed List".
Ordinance 1031, Chapter 118 — Add criminal background check to conditions of City
cigarette/tobacco license as Staff already conducted background check for new
licenses. However, we are including renewals.
Ordinance 1032, Chapter 120 — Remove mobile food truck/vendor license requirement,
but keep certain operating conditions.
Ordinance 1033, Chapter 160 — Fix wording and numbering/lettering issues.

SECTION 1. The City Council of the City of Mounds View hereby amends Title I: General

Code, Chapter 71: Parking Rules; Section 71.001 Definitions, of the Mounds View City
Code by inserting the underlined language as follows:
§ 71.001 DEFINITIONS.
TRUCK.
(1) A motor vehicle with a gross weight classification of G (12,001 to 15,000 pounds)
or higher, as identified on the license plate and specified in state statutes.
(2) Ordinary pick-up trucks, recreational vehicles, and passenger vans customary
in residential districts with such a weight classification shall not be considered a
TRUCK for purposes of this chapter.
SECTION 2. In accordance with Section 3.07 of the City Charter, City staff shall have the

GENERAL REGULATIONS, CHAPTER 90: ANIMALS AND ANIMAL CONTROL,
SECTION 90.005 RAISING, KEEPING DOMESTIC OR FARM ANIMALS
THE CITY OF MOUNDS VIEW ORDAINS:
SECTION 1. The City Council of the City of Mounds View hereby amends Title IX,
General Regulations, Chapter 90: Animals and Animal Control, Section 90.005, Keeping
Domestic or Farm Animals, by inserting the underlined language as follows:
90.005 RAISING, KEEPING DOMESTIC OR FARM ANIMALS.
b) Residents on properties zoned R-1. Single-family residential, may be permitted to
keep and raise honeybees under the following conditions and restrictions.
1. Residents seeking approval to keep and raise honeybees shall submit an
application, application fee and site plan. Applications shall be considered by the City
Council which shall hold a public hearing on the matter.
2. Applicants for a beekeeping license shall provide proof of applicable training
or provide a waiver indicating how required experience has been obtained.
3. Hives shall only be located in rear yards and be set back at least ten feet
from property lines and subject home, and at least 25 feet from any public trail or
walkway. No more than four hives shall be permitted. Hive openings shall face in toward
subject property's backyard.
4. A clean water source shall be provided on the subject property.
5. A beekeeper may receive temporary allowance for an additional hive in the
event a swarm is collected and until a new home is found for the colony. In no event
shall temporary allowance exceed six months.
6. Equipment shall be maintained in good condition in accordance with
accepted best management practices. Unused beekeeping equipment shall be properly
disposed of or stored indoors.
7. Licenses are valid indefinitely so long as the hives are operated
continuously. License may be revoked or denied by the City Council based on
negligence or nuisance. In such event, the property owner shall be provided with an

opportunity to be heard. Licenses shall expire upon lapse in use for a period exceeding
two years or upon a transfer of property ownership.
8. City staff shall administratively survey licensee on an annual basis to
validate that hives are still actively in use. Licensee shall respond to staff's
request in writing within thirty (30) days of survey.
SECTION 2. In accordance with Section 3.07 of the City Charter, City staff shall have the
following summary printed in the official City newspaper in lieu of the complete ordinance:
On March 10, 2025, the City Council adopted Ordinance 1029 amending the
Mounds View City Code, Section 90.005 Raising, Keeping Domestic or Farm
Animals, of the Mounds View City Code, regarding an annual administrative
survey.

GROWTH OF GRASS AND WEEDS UNLAWFUL
THE CITY OF MOUNDS VIEW ORDAINS:
SECTION 1. The City Council of the City of Mounds View hereby amends Title IX,
Chapter 91, Section 91.001 Rules and Definitions, of the Mounds View City Code by
inserting the underlined language as follows:
COMMERCIAL VEHICLE. Any vehicle with a gross weight classification of E (6,001 to
10,000 pounds) or higher, as identified on the license plate and specified in state
statutes. Ordinary pick-up trucks, recreational vehicles (RVs) and passenger vans
customary in residential districts with such a weight classification shall not be
considered COMMERCIAL VEHICLES for purposes of this subchapter.
SECTION 2. The City Council of the City of Mounds View hereby amends Title IX, Chapter
91, Section 91.006 (13)(4) of the Mounds View City Code by inserting the underlined
language and removing the stricken language as follows:
§ 91.006 OUTSIDE PARKING AND STORAGE.
(B) Unlawful parking and storage
(4) No person owning, driving or in charge of any commercial vehicle with a gross
weight classification higher than G (12,001 to 15,000 pounds) as identified on the license
plate and specified in state statutes, may cause or permit that vehicle to be parked outside
or stand continuously for more than two hours on residential property or public street
within a residential zone in the city.
SECTION 3. The City Council of the City of Mounds View hereby amends Title IX, Chapter

A criminal background check is required of the applicant prior to the issuance of
a new or a renewal Cigarette/Tobacco license. The applicant information shall be
referred to the chief of police or his or her designee for a computerized criminal
history from the Minnesota Bureau of Criminal Apprehension. The chief must

directed to the City Council for further investigation recommendation, approval or
denial of the license application.

Business Regulations, Chapter 120 Mobile Food Vehicles and Vendors, of Mounds View
City Code by inserting the underlined language as follows:
120.002 PARKING AND LOCATION.
(A) Site plan. Any person operating a mobile food vehicle in the City shall
provide to the City a site plan showing the location of the parked truck or trailer on
the property and its distance from all permanent structures and property lines
(moving mobile food vendors are exempt from this requirement).
(B) Location duration. Mobile food vehicle shall operate no more than 21 days
annually at any one place without the approval of the regulatory authority as
defined in Minnesota Statutes.
(C) Authorization to use property. Any person operating a mobile food vehicle
shall submit a signed agreement from the property owner or its authorized agent.
SECTION 4. The City Council of the City of Mounds View hereby amends Title XI
Business Regulations, Chapter 120 Mobile Food Vehicles and Vendors, Section 120 of
the Mounds View City Code by inserting the underlined language as follows:
§ 120.003 COUNTY OR STATE LICENSING.
Any person operating a mobile food vehicle shall adhere to any county or state
licensing requirements or any city requirements related to organized events. Proof
of county or state licensing shall be provided to the City prior to operation.

No person, liGensed hereunder to operate as a mobile food vehicle operator or mobile
food vendor shall conduct business in any of the following manners and in the following
areas:
(A) Calling attention to his or her business or the items to be sold by means of blowing
any horn or whistle, ringing any bell, crying out, or by any other noise, so as to be
unreasonably audible.
(B) Obstructing the free flow of traffic, either vehicular or pedestrian, on any street,
sidewalk, alleyway, or other public right-of-way.
(C) Conducting business in away as to create a threat to the health, safety and welfare
of any specific individual or the general public.
(D) Conducting business before 7:00 a.m. or after 10:00 p.m., unless expressly
authorized in the license issued hereunder.
(E) Failing to provide proof of license and identification when requested.
(F) Using the license of another person.
(G) Alleging false or misleading statements about the products being sold, including
untrue statements of endorsement. No mobile food vehicle or mobile food vendor shall
claim to have the endorsement of the city solely based on the city having issued a license
to that person.
(H) Remaining on the property of another when requested to leave or returning to that
property after leaving, without written permission of the property owner.

SECTION 6. In accordance with Section 3.07 of the City Charter, City staff shall have the
following summary printed in the official City newspaper in lieu of the complete ordinance:
On March 10, 2025, the City Council adopted Ordinance 1032 amending the Mounds
View City Code, Chapter 120, relating the licensing of Mobile Food Vehicles and
Mobile Food Vendors.

TITLE XV: LAND USAGE; CHAPTER 160: ZONING; SECTION
160.087 ACCESSORY USES; RELATED TO HOME OCCUPATIONS
THE CITY OF MOUNDS VIEW ORDAINS:
SECTION 1. The City Council of the City of Mounds View hereby amends Title XV: Land
Usage, Chapter 160: Zoning, Section 160.087 Accessory Uses, by inserting the
underlined language and removing the language, and updating numbering as
follows:
§ 160.087 ACCESSORY USES.
The following are permitted accessory uses in an R-1 District:
(C) Home occupations. The regulation of home occupations within residential
structures and accessory buildings is intended to ensure that the occupational use is
clearly accessory or secondary to the principal dwelling use and that compatibility with
surrounding residential uses is maintained. , ^^me 06
(1) No home occupation shall be allowed which involves employees other than
persons residing on the premises;
(2) Involves alteration or construction features not customarily found in dwellings or
accessory buildings;
(3) Has an exterior display or sign in excess of one square foot. The sign, for
identification purposes only, shall be located on either the principal structure or garage.
Any sign existing prior to 12-29-1972 shall not be enlarged, but may be continued at the
size and location upon the date, except as hereinafter specified or subsequently
amended. Any sign erected after 12-29-1972, but prior to the effective date hereof shall
come into compliance herewith by 04-01-1983;
(4) Involves exterior storage of equipment or materials;
(5) Generates any on-street parking. All vehicles associated with a home occupation
shall be parked off-street and in compliance with the city's parking requirements;
(6) Results in violation of the provisions of Ch. 91 of this code of ordinances;
(7) Involves activity visible from the public streets.
(8) Massage therapy is permitted as a home occupation, subject to the
requirements of Chapter 114 of this code of ordinances.

community center, public and private educational institution limited to elementary, junior

high and senior high schools, and religious institutions, such as churches, chapels,
temples and synagogues; subject to the following conditions.

requirements of Ch. 161 of this code of ordinances.

nursery and the Highway 10 right-of-way line shall be a minimum of 200 feet, except as
provided in § 160.376(A)(3) of this chapter.
04 4) No day care center or group nursery shall be permitted where the distance
from the property line for the day care center or group nursery to a premises requiring a
liquor license, as provided in Ch. 110 of this code of ordinances, or a license for an adult
establishment, as provided in Ch. 116 of this code of ordinances, is 500 feet or less;
except that, the 500-foot requirement shall not apply to any liquor establishment receiving
at least 60% of its annual gross sales revenue from the sale of food.
W ) The operator shall secure all necessary county or state licenses and
approvals.

{ID4 (E) Recreational facilities. Swimming pools, patios, decks, gazebos, swing sets,
play systems and play houses, outdoor living rooms, tennis courts and other recreational
facilities which are operated for the enjoyment and convenience of the residents of the
principal use and their guests. The facilities shall be set back five feet or more from a
property line, except swimming pools, which shall be set back ten feet or more from a
property line.
(E-) Boarding. Boarding or renting of rooms to not more than two roomers or
boarders.
�F+n Other uses. Other allowed uses incidental to the dwelling unit, including but not
limited to: clothes lines and poles; lawn and garden ornaments and other landscaping
features; and pet house, facility or kennel. A pet house, facility or kennel shall be set back
five feet or more from a property line.
{G) (H) Solar energy sources and systems and the like. Solar energy sources and
systems and geothermal energy sources and systems as regulated by
§§ 160.435 through 160.439 of this chapter.
{-H-)Ifl Columbaria. Columbarium as an accessory use to a religious institution; subject
to the following conditions.
(1) The religious institution must own the property on which the columbarium is
placed.
(2) The exterior of the columbaria must be stone, brick, bronze, stainless steel or
aluminum.

(3) The combined square footage of all accessory buildings, including columbaria,
shall not exceed 1,800 square feet.
(4) Columbaria shall only be placed in a side yard or rear yard area.
(5) Columbaria shall have a minimum side yard and rear yard setback of five feet.
(6) Columbaria height shall not exceed 18 feet or that of the principal structure,
whichever is less.
(7) If the religious institution ceases operation, all urns and remains must be
removed from the property within three months.
{I} () Accessory dwelling unit (internal).
(1) One accessory dwelling unit may be located on a lot occupied by a single-
family home (principal dwelling). The lot must comply with minimum dimensional
standards. The accessory dwelling unit shall be located within the existing single-family
home and shall not require any exterior modifications to the existing home, excluding
doors and windows;

Background/Discussion:
The City is in the process of rehabilitating streets that were not included in the 2007 Street
Rehabilitation Plan. The 2025 proposed street project includes the following:
• Bronson Drive from Long Lake Road to Edgewood Drive
• Bronson Drive from Edgewood Drive to Quincy Street
• Edgewood Drive and Pinewood Circle cul-de-sacs
• Construction of a parking lot in the City Hall campus near the Splash Down amenity
The street segments have concrete curb and gutter (MN/DOT Design B618) with a
bituminous pavement surface. The proposed project area contains (1) commercial business
(Tommy Carwash), the Public Works Department and multiple residential properties.
Streets were originally constructed in the following years:
• Bronson Drive from Long Lake Road to Edgewood Drive — originally built in 1967
reconstructed 1993
• Bronson Drive from Edgewood Drive to Quincy Street— originally built in 1967 and
reconstructed in 1993.
• Edgewood Drive and Pinewood Circle cul-de-sacs -originally built in 1993, and 1983.
Following the proposed schedule for the project:
• City Council reviewed the concept designs at the October 28, 2024, Work Session,
and directed Staff to pursue the necessary plans for the proposed street project.
• February 10, City Council Meeting - Council Review the 66% plans, provide Staff
direction moving forward.
• March 10, City Council Meeting — Council Reviews accepts the plans and
specifications, authorizes for bidding.
• March 14, Plans out for bidding.
• April 4, Bid opening.
• April 14, Council Accepts bids and awards contract.

Further Discussion:
Stantec has completed the plans and specifications for the 2025 Street Project; this does not
include any water main work, gate valves and sanitary sewer main line repairs, or cured in
place pipe work (CIPP).
*Costs and pavement design are also based on the American Engineering Testing Inc. (AET)
geotechnical and pavement evaluation report.
Strategic Plan Strategy/Goal: Maintain and Plan for Infrastructure Improvements.
Financial Impact: No Financial Impact to the 2025 Budget. The Street Improvement CIP-
fund, 485-4470-7050 includes $110,500.00 for engineering costs for this proposed project.
Recommendation: Staff recommends the City Council adopt the attached Resolution
approving the plans, specifications and bidding documents for the 2025 Street Improvement
Project. Staff further recommends the Council Approve the bidding of the project.

WHEREAS, maintenance over the years has included seal coating, pothole patching
and skim coating as needed. The current pavement is in poor condition with significant
surface patching, potholes, and moderate to high severity traverse cracking and pavement
heaving; and
WHEREAS, City Council reviewed the concept designs at the October 28, 2024,
Work Session, and directed Staff to pursue the necessary plans for the proposed street
project; and
WHEREAS, Stantec has completed the plans and specifications for the 2025 Street
project; and
WHEREAS, Staff recommends the City Council adopt the Resolution accepting the
plans and specifications, and bidding documents for the 2025 Street Improvement Project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds
View, Ramsey County, Minnesota as follows:
