MEETING IS CALLED TO ORDER 2. PLEDGE OF ALLEGIANCE 3. ROLL CALL: Flaherty, Stigney, Hull, Mueller, Gunn. NOT PRESENT: None. 4. APPROVAL OF AGENDA A. Monday, October 12, 2009, City Council Agenda. • MOTION/SECOND: Mueller/Hull. To Approve the Monday, October 12, 2009, agenda as revised to add Item 6B, Introduction of Ms. Mounds View Senior 2009 Shirley Manson. Ayes - 5 Nays - 0 Motion carried. 5. PUBLIC INPUT Tom Winiecki, 2748 Sherwood Road, advised the Council that outcrops on Red Oak Road restrict right hand turns and stated his opinion they need to be removed. He also stated his objection to the infiltration system created on his neighbor's property, calling it the "Grand Canyon of Mounds View," which he believed to be unsightly. Public Works Director DeBar stated he met on site with Harvey Kowalzek, 2756 Sherwood Road, about the infiltration swale twice before and twice after construction. He explained that after modifications were made to lessen the impact, it was his understanding that Mr. Kowalzek was satisfied. Mayor Flaherty stated he will visit the property again and asked Mr. Winiecki to check with Mr. Kowalzek to determine if there is still a problem. If so, staff will meet with Mr. Kowalzek to resolve his concerns. Council Member Mueller stated she visited the property after a significant rain event and found the infiltration system had operated correctly. Mounds View City Council October 12, 2009 Regular Meeting Page 2 6. SPECIAL ORDER OF BUSINESS A. Proclaim October 26-30, 2009, as Minnesota Manufacturers Week in Mounds View. Economic Development Specialist Steinmetz advised of the events planned for Minnesota Manufacturers Week and staff's recommendation for approval of the proclamation. Based on the Council's consensus of support; Mayor Flaherty read in full a proclamation declaring October 26-30, 2009, as Minnesota Manufacturers Week in Mounds View. B. Introduction of Ms. Senior Mounds View 2009 Shirley Manson. Mayor Flaherty commented on a recent Sun Focus article about the Ms. Senior Minnesota pageant and recognized Shirley Manson who recently competed on behalf of Mounds View. Ms. Manson explained that while she did not win the title of Ms. Senior Minnesota, she did win the talent contest. She reviewed her work history as a retired teacher and current involvement with school-aged students. 7. COUNCIL BUSINESS • A. 7:05 p.m. Public Hearing: Resolution 7506, to Consider Special Assessments for Delinquent Utility Payments. Finance Director Beer presented staff's recommendation to certify delinquent utilities payments for collection through special assessments including a $35 administrative fee and 5.5% interest. Mayor Flaherty opened the public hearing at 7:18 p.m. Hearing no public input, Mayor Flaherty closed the public hearing at 7:18 p.m. Council Member Mueller asked about collection of delinquent utilities on properties owned by financial institutions. Finance Director Beer explained that assessments have to be paid in full at the time the property is sold. MOTION/SECOND: Mueller/Hull. To Waive the Reading and Adopt Resolution 7506, Adopting a Special Assessment Levy for Delinquent Public Utility Accounts. Ayes - 5 Nays - 0 Motion carried. B. 7:10 p.m. Public Hearing: Resolution 7507, to Consider Special Assessments for Unpaid Administrative Offense Fines, Diseased Tree Charges, and Unpaid Property Abatement Charges. Finance Director Beer presented staff's recommendation to certify unpaid administrative offense fines, diseased tree charges, and property abatement charges for collection through special Mounds View City Council October 12, 2009 Regular Meeting Page 3 i assessments including a $35 administrative fee and 5.5% interest. Mayor Flaherty opened the public hearing at 7:25 p.m. Hearing no public input, Mayor Flaherty closed the public hearing at 7:25 p.m. MOTION/SECOND: Mueller/Stigney. Ayes - 5 Nays - 0 Motion carried. C. 7:15 p.m. Public Hearing: Second Reading and Adoption of Ordinance 836, Vacating a Sanitary Sewer Easement at 2200 County Road 10. Community Development Director Roberts presented staff's recommendation to adopt Ordinance 836 to vacate the sanitary sewer easement on The Mermaid property and to publish an ordinance summary. Mayor Flaherty opened the public hearing at 7:27 p.m. Hearing no public input, Mayor Flaherty closed the public hearing at 7:27 p.m. . Council Member Mueller asked whether utility fees have been paid for this property. Finance Director Beer advised the fees have been paid. MOTION/SECOND: Mueller/Stigney. To Waive the Second Reading and Adopt Ordinance 836, Authorizing a Vacation of a Sanitary Sewer Easement on the Mermaid Property, Located at 2200 County Highway 10, and authorize publication of a summary as authorized by City Charter Section 3.07. Mayor Flaherty asked what the City is giving up through this vacation. Community Development Director Roberts explained the rights afforded to the City through an easement to install utilities. However, with this easement the City never installed a sanitary sewer and has no intention to do so in the future. ROLL CALL: Stigney/Hull/Mueller/Gunn/Flaherty. Ayes - 5 Nays - 0 Motion carried. D. Resolution 7509, Approving an Agreement Renewal with Northwest Youth and Family Services. Clerk-Administrator Ericson explained that Mounds View has partnered with Northwest Youth and Family Services (NYFS) for many years to provide services to benefit its residents and • youth. He noted they have provided Mounds View with yearly reports detailing how they have substantially leveraged the City's contribution to benefit its residents. Clerk-Administrator Mounds View City Council October 12, 2009 Regular Meeting Page 4 Ericson stated staff has reviewed the draft five-year agreement and recommend renewal. Jerry Hromatka, representing NYSF, provided a brief PowerPoint presentation to describe the cost-effective services collaboratively provided to its member northern suburbs since 1976, fund raising activities, and households served, resulting in a regional impact. Mr. Hromatka reviewed the positive outcomes of the City's contribution, their dedication to provide the best services, and invited the Council to the October 28, 2009 grand opening of the Discovery Center. He stated the rates for 2010 will be a little less than in 2009 and advised of NYFS' partnerships with communities, school districts, the faith community, and businesses. Council Member Stigney asked what is the base amount. Mr. Hromatka stated in 2010 it would be the 2009 base amount minus 1.1 %. Council Member Gunn commented that the work and success stories of NYFS are remarkable. MOTION/SECOND: Gunn/Hull. To Waive the Reading and Adopt Resolution 7509, Renewal of an Agreement for Services between the City of Mounds View and Northwest Youth and Family Services. Mayor Flaherty read a listing of the number of Mounds View residents who used NYFS services. He stated this is a worthwhile program available to all Mounds View residents and he appreciates the efforts of this organization. Ayes - 5 Nays - 0 Motion carried. Mayor Flaherty left the Council Chambers at 7:49 p.m. E. Resolution 7513, Approving a Revised Property Tax Payment Plan for Moe's, Located at 2400 Highway 10. Assistant Clerk-Administrator Crane advised the property taxes for Moe's remains delinquent and a revised payment plan has been submitted by Jeff Moritko, owner of Moe's. She noted that the Council had invited Jeff Moritko to attend the meeting tonight to discuss the revised plan. Assistant Clerk-Administrator Crane presented the draft resolution that would approve the revised property tax payment plan and the Council's options to adopt the resolution, start the process to revoke the liquor license, or table consideration to the October 26, 2009 Council meeting. Clerk-Administrator Ericson stated Mr. Moritko called him this evening to say he was unable to attend tonight because his children are ill and wife is not yet home. Mr. Moritko had asked the Council to act favorably on the revised tax payment plan. Mayor Flaherty returned to the Council Chambers at 7:51 p.m. MOTION/SECOND: Mueller/Hull. Ayes - 5 Nays - 0 Motion carried. F. Resolution 7512, Authorizing Fencing Improvements to Ball Field Backstops at Silver View Park, City Hall Park, Groveland Park, and Hillview Park. Public Works Director DeBar reported on the aging fence conditions at Silver View Park, City Hall Park, Groveland Park, and Hillview Park and recommendation of the Parks and Recreation Commission and staff for Lambert Parl, fencing improvements. With regard to Lambert Park, fencing improvements are needed but recommended to be performed when the Lambert Park building is constructed. He reviewed the specifications of proposed fencing to assure player and spectator safety and presented the three quotes received. Public Works Director DeBar stated the improvements are in the current year budget and would be paid from the Park Dedication Fund. Council Member Mueller asked if the need for these improvements was raised several years ago. Mayor Flaherty stated it was first brought up in 2005 or 2006. Council Member Mueller asked if shrubbery recently removed at Groveland Park contributes to fence deterioration, is that why the bushes were removed from Groveland Park? Public Works Director DeBar stated that removing those particular shrubs had more to do with maintenance since the faster growth vegetation had gotten out-of hand. MOTION/SECOND: Mueller/Stigney. To Waive the Reading and Adopt Resolution 7512, Authorizing Fencing Improvements to Ball Field Backstops at Silver View Park, City Hall Park, Groveland Park, and Hillview Park, with the correction of several typographical errors. Mayor Flaherty stated this need was put off several years ago; however, there is a need to assure safety to protect spectators from foul balls. Ayes - 5 Nays - 0 Motion carried. 8. CONSENT AGENDA Council Member Mueller asked to remove Item F. A. Licenses for Approval. B. Set a Public Hearing for Monday, November 23, 2009, at 7:05 p.m., to Approve the 2010 Mounds View Fee Schedule. C. Resolution 7511, Authorizing a One-Day Charitable Gambling Permit (Raffle) for the New Brighton/Mounds View Rotary at The Mermaid on Apri116, 2010. D. Set a Public Hearing for Monday, October 26, 2009, at 7:05 p.m. for the Introduction and First Reading of Ordinance 837, Code Amendment about Voting Requirements for Zoning Code Amendments. Set a Public Hearing for Monday, October 26, 2009, at 7:10 p.m. for the Introduction and First Reading of Ordinance 838, Code Amendment to Chapter 1125.06 about Penalties. MOTION/SECOND: Gum~/Mueller. To Approve the Consent Agenda Items A - E. Ayes - 5 Nays - 0 Motion carried. F. Resolution 7508, Approval to Expend the Funds Awarded in the 2009 Justice Assistance Recovery Grant. Council Member Mueller stated the Police Department was awarded a grant of $21,299 from the U.S. Department of Justice as part of the Recovery Funding Act that will be used to purchase in- squad and City Hall security cameras. She noted this is another opportunity that the Police Chief has pursued and resulted in a nice award to purchase needed equipment. MOTION/SECOND: Mueller/Stigney. To Waive the Reading and Adopt Resolution 7508, Approval to Expend the Funds Awarded in the 2009 Justice Assistance Recovery Grant. Ayes - 5 Nays - 0 Motion carried. 9. JUST AND CORRECT CLAIMS Council Member Mueller referenced Page 2, repairs made to a vehicle. Finance Director Beer advised it is a police vehicle. Council Member Mueller referenced Page 2, a charge for road striping and painting. Finance Director Beer advised that work was conducted all over the City, except in the street project areas. Council Member Mueller explained that the lane striping at Silver Lake Road and County Road 10 was not done. Public Works Director DeBar explained the arrows at that intersection were placed when the paving occurred, and the latex lane striping will be done later by the city's contractor. Council Member Stigney referenced Page 4, MR Sign for $1,640. Public Works Director DeBar stated they are traffic signs for the street project. Council Member Mueller referenced Page 4, North Valley, Inc. for $716,398.90. Public Works Director DeBar stated it is the September monthly payment for the 2009 street improvement project. He provided an update on the project status and that temporary transitions will be placed around manholes and extension boxes if the wear course cannot be laid (due to cold weather conditions). APPROVAL OF MINUTES A. September 14, 2009, City Council Minutes. Council Member Mueller requested a clarification on Page 2, Line 28. Clerk-Administrator Ericson stated staff will check the audio tape and make the correction. Council Member Hull requested a correction on Page 3, Line 12: "... so staff cuts may be needed or wages..." MOTION/SECOND: Gunn/Mueller. To approve the September 14, 2009, City Council Meeting Minutes as corrected above. Ayes - 5 Nays - 0 Motion carried. B. September 28, 2009, Executive Session Minutes. MOTION/SECOND: Gum~/Mueller. To approve the September 28, 2009, Executive Session Meeting Minutes as presented. Ayes - 5 Nays - 0 Motion carried. 11. REPORTS A. Reports of Mayor and Council. Mayor Flaherty commented on the successful Fall Family Fun Day at the Community Center that was enjoyed by over 200 people and listed the sponsors who contributed. He announced the December 12, 2009, Winter Family Fun Day and encouraged residents to participate. Council Member Mueller reported on the Irondale football homecoming game and outstanding half time show. She encouraged residents to attend an upcoming football game. Council Member Mueller referenced a Star Tribune article about contracted garbage service that would result in a cost saving to residents and lower the number of garbage trucks using City streets. She asked for resident input on a contracted garbage service if it results in a cost savings. Mayor Flaherty asked staff to schedule this discussion at the next Council Work Session. Council Member Gunn stated this was discussed years ago when it was decided to limit pick up to one day a week. She read statistics on the number of cars equivalent to one garbage truck and the impact to the City's streets. Council Member Mueller referenced the League of Minnesota Cities publication that lists tax information of 854 municipalities. She noted that Mounds View's tax per person in 2008 averaged $284, and for cities of the same size the average was $310 per person. Mounds View City Council October 12, 2009 Regular Meeting Page 8 • Council Member Hull updated the Council on discussion held at the YMCA Advisory Committee meeting, advising that all Saturdays are booked at the Event Center for the remainder of 2009 and April through September of 2010. B. Reports of Staff. Clerk-Administrator Ericson reported on the following: • October 3, 2009, Fall Clean-Up Day and apologized that one area of Mounds View received the flyers late. • October 21, 2009, Airport Advisory Commission meeting to tour the Blaine Anoka County Airport. • Commission and Committee vacancies and encouraged residents to make application by October 30, 2009. • Metro I-Net Consortium meeting that now has 1,000 users and 19 cities, which is a tremendous value to Mounds View. • October 14, 2009, Charter Commission meeting and invited the Council and staff to attend the open house held that same evening. Clerk-Administrator Ericson updated the Council on the County Road H, Silver Lake Road intersection project and expressed hope the easements can be obtained in 2009 and the project completed in 2010. Community Development Director Roberts announced that Select Seniors has received financing and still hopes to start construction in 2009. Mayor Flaherty reminded homeowners that the second half property taxes are due on Thursday, October 15. C. Reports of City Attorney. Noted. 12.
