Departmental Secretary: Performs all of the clerical duties related to the Civil Defense program. e o J MOUNDS VIEW, MINNESOTA CIVIL DEFENSE ORGANIZATIONAL CHART Civil Defense Director Departmental Secretary MEMO TO: Mayor and City Council ) FROM: Clerk -Administrator DATE: July 14, 1982 SUBJECT: INJURY ON DUTY PAY TO CHRIS WESTON As you may recall, Chris Weston was absent from work from March 25 to April 18, 1982 due to a disability which he claimed resulted from an injury he incurred while on duty with the City of Mounds View. The Injury on Duty clause in our Labor Agreement with IUOE Local No. 49 states, "The injury on duty will be 60 days, with the first three days to come out of sick leave, and then 60 days injury on duty. Any days beyond the 60 days will be taken from the employee's banked sick leave." As it is a common understanding between the union and all cities in the M.A.M.A. group that injury on duty benefits will not be paid until it has been determined that Worker's Compensation benefits are payable, thus, legitimizing the claim that the injury was incurred while on duty, staff advised Mr. Weston that injury on duty benefits would not be paid until such a determination was made by our Worker's Compensation insurance carrier and that the disability exceeded the three day waiting period. On April 22, 1982 Western Insurance Companies, the City's Worker's Compensation insurance carrier, paid Mr. Weston benefits for the period cited above and on that same date the City of Mounds View submitted to Mr. Weston a check from the City reflecting the injury on duty benefits due to him pursuant to the provisions of the Labor Agreement. On June 21, 1982 this office received correspondence from Mr. Kirk Newton of Western Insurance indicating that Mr. Weston's claim,which they had previously paid,was now being denied as it was their determination that the disability did not result from a work related injury. In telephone conversations with Mr. Newton, it was revealed that the benefits were originally paid due to the State requirements that benefits be pnid within 14 days of notice of injury which normally does not allow for sufficient opportunity to investigate a claim. Upon completion of their investigation, it was the determination of Western Insurance that the disability did not result from a work related injury and that not only were benefits not payable but that Mr. Weston would be responsible for repaying those benefits previously paid in error. Based on this information staff contacted Mr. Cy Smythe of Labor Relations Associates, the City's labor relations consultant, in a letter dated June 25, 1982, copy attached, requestinq quidance with respect to the City's position regarding the injury on duty benefits -2- paid as a result of the Western Insurance Company's payment for disability benefits which was later determined to be in error. Mr. Smythe, in a letter dated July 7, 1982, copy attached, indicates that it is his recommendation that the City should deny the injury on duty payments and recover such payments from the employee's sick leave bank or accumulated vacation: Staff is aware that Mr. Weston is presently appealing the determina- tion of Western Insurance Companies regarding their denial of his claim, however, we feel that Mr. Weston should be further advised of the City's position in this matter regarding the payment of injury on duty benefits. For this reason, staff would request Council direction in this matter regarding your desire to either require the repayment of these benefits based upon the determination of West,= Insurance Companies that the disability did not result from an injury incurred on duty or to allow for Mr. Weston to retain these payments which would establish a somewhat dangerous precedent for all future injury on duty claims, especially those which might be false claims. Staff would appreciate Council direction in this matter. The claim was forwarded to our insurance company, Western Insurance Companies, for an evaluation of the claim and determination relative to the payment of worker's compensation benefits. My office advised Mr. Weston at that time that Injury on Duty benefits would be paid by the City if it was determined by Western Insurance that it was a valid claim, worker's compensation benefits were paid, and the period of disability exceeded 3 days, copy of letter attached. On April 22, 1982, Western Companies paid Mr. Weston benefits for a period from March 25, 1982, through April 18, 1982, copy of notice attached. On that same date, this office submitted to Mr. Weston his second Worker's Compensation benefit check along with a check from the City reflecting Injury on Duty benefits pursuant to our labor agreement with AFL-CIO Local No. 49. Upon completion of their investigation of ,the claim, it was Western Insurance's determination that the disability did not result from a work related injury. Mr. Smythe Page Two June 25, 1502 ' All of this leads us to the question now facing the City of Mounds View, and that is: Do we attempt to recover the Injury on Duty benefits we have paid based on Western's actions and, if so, how do we go about doing so? Any advice or information you might be able to provide in this matter will be greatly appreciated. We recognize this as being a sensitive i•$sue, especially during con- tract negotiations, and we wish to handle it in an appropriate manner. Your labor agreement with I.U.O.E., Local No. 49 in its LOCAL ADDENDUM entitled "RESOLUTION NO. 1144" in Item No. 3 staees: "The injury on duty will be sixty (60) days with the first three (3) to come out of sick leave and then sixty (60) days injury on duty. Any days beyond the sixty (60) will then be taken from the employee's banked sick leave." While your Item No. 3 does not specifically state that Injury On Duty pay from the City is contingent on eligibility for Workers' Compensation benefits (which should be taken care of in 1983) the common understanding is that such eligibility is a requirement. The City did make Injury On Duty payments based on an initial determination of eligibility for Workers' Compensation. This eligibility was later denied and the City should therefore deny City Injury On Duty payments and recover such payments from the employee's sick leave bank or accumulated vacation account. Smy CFS:hfc MEMO TO: MAYOR AND CITY COUNCIL FROM: Clerk -Administrator DATE: July 14, 1982 SUBJECT: JOINT POWERS AGREEMENT WITH THE CITY OF CIRCLE PINES Pursuant to Council direction at the July 12th meeting, staff has revised the attached Joint Powers Agreement to provide for a limitation on the time of the Engineering/Planning Technician in view of the City of Circle Pines desire to limit expenditures to $1,000 without prior approval. Please note the Time Allocation section on Page 2 which in the second paragraph states, "The total time to be expended by the Engineering/Planning Technician for completion of the Trails System Mastcr Plan shall not exceed 85 hours without the prior written approval of the Council of the City of Circle Pines." It is felt that this provision would provide sufficient protection for the City of Mounds View in that an expenditure of 85 hours of staff time would not cause for the City's total cost to exceed the $1,000 limitation and would provide for the City of Circle Pines to approve additional expenditures of staff time and money. Should you find this modification acceptable, staff would request your approval for the Mayor and Clerk -Administrator to enter into this contract with the City of Circle Pines. DFP/pf Attachment JOINT POWERS AGREEMENT BETWEEN THE CITIES OF CIRCLE PINES AND MOUNDS VIEW Purpose WHEREAS, it is the desire of ,the City of Circle Pines to prepare a Trails System Master Plan requiring the ser- vices of a landscape architect; and WHEREAS, the City of Mounds View has a staff member, Engineering/Planning Technician, who has a landscape archi- tect degree from the University of Minnesota; and WHEREAS, the City of Mounds View submitted a proposal, Attachments A, B, and C, to the City of Circle Pines whereby said staff member would provide the design and planning ser- vices for a Trails System Master Plan; and WHEREAS, the City of Circle Pines has indicated that it is their desire to have said Mounds View staff member prepare a Trails System Master Plan; and WHEREAS, it is the desire of the Cities of Circle Pines and Mounds View to enter into a Joint Power Agreement estab- lishing the conditions for the preparation of a Trails System Master Plan. NOW, THEREFORE, BE IT RESOLVED, it is agreed between the Parties as follows: Employing Municipality The City of Mounds View hereby agrees to be the employing municipality for the joint powers agreement. The City of Mounds View shall be accountable for the receipt of that portion of the labor costs paid by the City of Circle Pines. No property shall be acquired as a result of this agreement. Staff Responsibilities and Accountability The responsibilities of staff in the preparation of a Trails System Master Plan are outlined in Attachment B, Design Pro- cess. The staff shall be responsible to ''-he Parks Director of the City of Circls. Pines for all work related to the prep- aration of the Trails System Master Plan and to the City of Mounds View Director of Public Works/Community Development for all other duties related to his employment. -1- -2- Time Allocation The Engineering/Planning Technician's time will be allocated at the weekly rate of two days performing work related to the Trails System Master Plan either in Circle Pines or at the Mounds View City Offices and three days performing duties related to his Mounds View employment until the Plan is com- plete. The total time to be expended by the Engineering/Planning Technician for completion of the Trails System Master Plan shall not exceed 85 hours without the prior written approval of the Council of the City of Circle Pines. Allocation of Cost The City of Mounds View shall invoice the City of Circle Pines upon completion of the Plan based on the following: 1. Ten dollars per hour for each hour the Engineering/ Planning Technician works on the Plan. 2. Nineteen cents per mile for the use of a City of Mounds View vehicle for travel related to the prep- aration of the Plan. 3. Actual costs incurred by the City of Mounds View in the printing of 15 copies of the Plan. The amounts due under this agreement will not exceed $1,000 without the prior written approval of the Council of the City of Circle Pines. Administration and Clerical Support The City of Mounds View will be responsible for all general clerical and administrative work including Worker's Compen- sation and insurance. The City of Circle Pines will be respon- sible for the publication and mailing of official notices and making available all information necessary for the prepara- tion of the Plan. Miscellaneous Expenses All miscellaneous expenses including but not limited to post- age, photocopying, and long-distance telephone charges will be the responsibility of the City of Circle Pines. Equipment Provided The City of Mounds View hereby agrees to make available a vehicle for transportation purposes and all needed printing equipment for the printing of the Plan. -3- Indemnification The City of Mounds View hereby agrees to indemnify and hold harmless and defend the City of Circle Pines, its agents and employees, against any and all claims for damages, of whatever nature, arising from or in consequence of the duties it has assumed hereunder, except for vehicles and/or equipment owned by the City of Circle Pines. Authority Each party executes this agreement pursuant to the authority of their respective governing bodies. Duration and Term This agreement shall remain in effect until the Plan is com- plete, unless terminated by either party subject to thirty (30) day written notice. Agreement entered into this 1982. Staff recommends vacating the north 210 feet of the existing 30 foot easement between Laport Drive and Ardan Avenue but also retain the west 10 feet as a drainage and utility easement with a walkway over this 10 foot area. The cul-de-sac would be provided to create access to the rear of 8205 and 8227 Groveland Road. Connections to both water and sanitary sewer mains could occur at Laport Drive and Fairchild and is feasible. The issue at the present time is the street right-of-way vacation. Mr. Werner stated that while he approved of the plat, he did not feel the street would be asthetically pleasing. Engineer Hubbard reported that if the street were put in, only two lots could be assessed; which wo-Id -amount to innroximately a $14,000 assessment per lot for the street only, or about $33,000 total for both lots for the street, sewer and water. Mr. Sjodin stated that at approximately $16,500 per lot, the assess- ments would exceed- the actual value of the property. PLANNING 1. Previous subdivision east of this parcel has provided 30' easement for the extension of Fairchild Avenue, north of LaPort Drive to Ardan Avenue. Applicant should be required to dedicate the east 30' of Lot 67 for Fairchild Avenue. Only one additional 115' x 30' strip easement from 8205 ^ Groveland Road would be necessary for the required easements for the extension of Fairchild Avenue. 2. No sewer or water services are available on Ardan Avenue between Groveland Road and Fairchild Avenue. Applicant should be required to petition for services, grant any additional easement necessary and waive the right of public hearing if he wishes to expedite matters or he can install the services himself, under City requirements and inspection. 3. An additional lot could be created which would front on proposed Fairchild Avenue. This would require the relocation of the applicant's garage and oversized accessory building. 4. Construction of proposed Fairchild Avenue would also minimally provide one additional lot from 8205 Groveland fronting Fairchild. 5. Applicant's existing driveway is located on Lots 1, 2 and 3. Drive will have to be relocated. 6. Applicant's plat request meets frontage and size requirements. :n additional lot could be created. 7. Additional utility and drainage casements are necessary generally along the south 5' of Lots 1-4 and the north 5' of Lot 5 depending on the final plat. 11. Existing Fairchild easements should be vacated should the extension of Fairchild south of. Ardan be disapproved. STAFF RECOMMENDATION Deny preliminary plat as proposed. Recommend the plat be revised according to Sketch B with the joint platting of 8227 and 8205 Groveland to create nine lots. Staff feels that Fairchild Avenue should be extended south at this point in time to maximize the land use of this area and to equitably apportion the cost of the improvement. It will be less expensive to do it now at today's costs than at the predicted cost five to ten years from now. Options 1. Recommend approval of Preliminary Plat as submitted (without the extension of Fairchild south). 2. Recommend Preliminary Plat with revisions of granting a 30' Fairchild road easement and the creation of a sixth lot (Sketch A). 3. Report of --. had received $185,000 from the State for the Administrator O'Connell Drive acquisition, and also received just under $9,000 from the government for the I&I study. Clerk/Administrator Pauley asked the Council to set a special meeting to discuss the policy issues that were brought up during the first round of budget meetings. Mayor McCarty set the meeting for 7 PM on July 20. Clerk/Administrator Pauley reported the Association of Metropolitan Municipalities would be holding a meeting on August 6 on surface water management, which Director Johnson was planning to attend. He asked that anyone else who was interested in attend- ing let him know so registration could be sent in. Clerk/Administrator Pauley reported that an additional $860 is needed to complete the lighting at Lambert Park, and reviewed the three options proposed by the Park and Rec Director for funding. Mayor McCarty directed Clerk/Administrator Pauley to take the steps necessary to have the work performed and submit a recommendation for a source of fundinq. Paul Donley, of the Mounds View School District, asked the Council for temporary approval to begin the transformation of Edgewood from a school to a community center. He explained they have a tenant that must move in by July 1. Upon questioning by the City Attorney and Council, he agreed that if for some reason they were unable to meet the con- ditions of the conditional use permit, they would move the tenant out. He explained the beer would be sold on the Waste property, but the patrons would also be on his lift parking lot, and asked if he would be in violation of an ordinance. Attorney Meyers explained the ordinance and the reasons behind it. He stated Mr. Povlitzki would not be in violation by selling the beer off his own property, but he could not guarantee there would not be problems. Attorney Meyers explained they had been questioned by a citizen who was concerned with a business being operated in a residential zone, and they are gathering the evidence to take Mr. Johnson to court for a home occupation that is inconsistent with residential property. Jim Bremmer, 2765 LaPort Drive, explained he had 5A. Fairchild Avenue initiated the proposal for the vacation of Right -of -Way Fairchild, and summarized the history of the area, Vacation citing the problems in maintaining it and the kids who play and ride their mini bikes there. Sue Gale, 8227 Groveland, stated she was there also to speak for Debbie Yost, her neighbor, and explained that if the vacation is approved, both of them would have the backs of their lots land -locked, and would not be able to subdivide in the future. Mayor McCarty closed the public hearing and reopened the regular meeting at 8:12 PM. There was considerable discussion regarding both positions. Mayor McCarty explained that when the ile addition was approved, it was felt then that cul-de-sac could one day be put in to service the two lots in question. Ile added he was reluctant to land -lock the property. Attorney Meyers also reviewed the history of the property. She also felt that Mounds View was very progressive in the steps they are taking now. Councilmember Hodges reported the Youth Service ireau had left their budget the same as last ,ear. He added they will be moving to the Edgewood Community Center. Councilmember Hodges read a notice of Zak MacRunnels, who will be awarded as an Eagle Scout on July 14.
