SUBJECT: APPRECIATION DINNER
Pursuant to your direction at the June 13, 1983 Council Meeting,
I discussed the possibil.it.y and legality of providing free dinners
for City Commission and Committee members at the July 9, 1983
Appreciation Dinner. City Attorney Meyers has advised me in a
telephone conversation of this date that as the Appreciation Dinner
is part of the 25th Anniversary Celebration of the City, which is
sponsored by the Festivities Commission as part of the Festival in
the Park, and since the City provides a budgeted amount of $5,000
for the activities of the Festivities Commission, this expenditure
could be interpreted as a legitimate expense of the Festivities
Commission as part of this year's celebration.
In doing a head count of all Commissions and Committees of the
City, excluding the City Council, there are 38 individualswho could
be provided with free tickets to the Appreciation Dinner which
would cost the City a total of $380. As the Festivities Commission
has been unable to keep their expenses for the Festival in the Park
equal to or below the amount budgeted by the City in previous years,
the additional expenditure of $380 would most likely result in
increasing the deficit position of the Festivities Commission
activities during 1983.
RECOMMENDATION: It is the recommendation of staff that the City
Council use whatever cash donations are received from local businesses
and municipal consultants to offset the expenses of a few nice door
prizes to be awarded the evening of the Appreciation Dinner, with
the remainder of the donations used to offset the expense of providing
free dinners to attending Commission or Committee members. Any costs
for these free dinners not covered by the cash donations could be
charged to the Festivities Commission line item which is part of the
Advisory Commission's account in the General Fund.

SUBJECT: EMERGENCY WARNING SYSTEM IMPROVEMENTS
As previously mentioned in a recent Administrative Newsletter,
this office has resurrected previous plans developed by the City
of Mounds View to improve our emergency warning system which
presently consists of two sirens covering approximately 30% of
the City's population. As you can note from the attached grant
application material, staff proposes that a third siren be purchased
and placed at the intersection of Edgewood Drive and County Road I
which, along with the relocation of the existing two sirens in the
extreme southeast and northwest corners of the City, would provide
siren coverage to approximately 90% of the City's population and,
in particular, the three trailer courts within the City of Mounds
View. It is estimated that the cost of the purchase of the new
siren, as well as the relocation of the existing two sirens, would
total $15,000.
The attached information for your review is
plan submitted to the State of. Minnesota for
application for 50% Federal funding for this
warning development
their approval and a
project.
Finally, attached is Resolution No. 1622 approving the submission
of the warning development plan and application for Federal assistance.
Should you approve of the program proposed by staff and the filing
of the grant application, adoption of this resolution will be
necessary to authorize the submittal of these items to the State,
with their ultimately being forwarded to the Federal government for
their funding considerations.
RECOMMENDATION: Adoption of Resolution No. 1622 authorizing
submission of a warning development plan and application for Federal
assistance.

STATE Of MINNESOTA
RESOLUTION APPROVING AND AUTHORIZING THE SUBMISSION
OF A WARNING DEVELOPMENT PLAN AND APPLICATION
FOR FEDERAL ASSISTANCE
WHEREAS, it is the desire of the City of Mounds View to
provide adequate emergency warning system coverage to the residents
of the City of Mounds View; and
WHEREAS, the City's present system provides coverage to only
30% of the City's population which has been determined to be inade-
quate; and
WHEREAS, the Mounds View Warning Development Plan, dated
June 1, 1983, proposes the addition of a third siren to the City's
system, as well as the relocation of the existing two sirens which
would provide warning coverage for 90% of the City's population; and
WHEREAS, the City of Mounds View wishes to obtain Federal
assistance in the purchase and installation of the third siren, as
f� well as the relocation of the existing two sirens, which is estimated
to cost $15,000; and
WHEREAS, it is the intention of the City of Mounds View to
comply with all of the requirements of the State of Minnesota and
Federal government relating to the Warning Development Plan and
receipt of Federal assistance.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Mounds View approves the Warning Development Plan, dated
June 1, 1983, and application for Federal assistance, and authorizes
their submission to the State of Minnesota, Department of Emergency
Services.
BE IT FURTHER RESOLVED that the Clerk -Administrator is
authorized to sign all documents required for the submission of the
aforementioned Warning Development Plan and application for Federal
assistance on behalf of the City of Mounds View and act as the City's
authorized representative with respect to this project.

On a Warning Development Plan (Will'), Block B is used to indicate your
existing or planned use of "Alert Receivers" (on the Direction and
Control Net) or telephone "hot-lines" for warning dissemination. Other
types of communication equipnent, such as mobile or portable radios, are
rot to be indicated on a WDP.
In the "Titles" Column, list the CD Title of those personnel tha t
receive, or plan to receive, warning notification from your warning point
via "Alert Receivers" or "hot-line" telephones.
In Column 2, place an "R" next to those officials who have, or plan to
have, an "Alert Receiver" activated by the local warnitr point. Iit
Column 11 place. an "V for existing "Alert Receiver" or an 110" for
planned "Alert Receiver" next to tie• appropriate official's title.
In Column 3, place an"V for existing or an "0" for planned, next to
those officials who receive, or plan to receive, warning notification
from the local warning point via dedicated or "hot-line" telephone
circuits. (Bell and Light units are considered dedicated telephone
circuits in those areas that have this service.) If no "hot-line"
exists or is planned for an official, place it "-" in Colummn 3.
If no "Alert Receivers" or "het -lines" exist nor are any planned in
your community, place a large "N/A" in the "Titles" column and pro- k,-

Project Justification: The Deficiency Report portion of the Mounds View
Civil Defense Warning Plan, tinted .tune 1, 1977
and approved by the State of Minnesota and
Regional Office in July 1977, indicated that the
City's warning system provided coverage to only
30% of the Mounds View population according to
the 70/Ill standards. These conditions have not
changed as evidenced by the City's Warning Develop-
ment Plan dated ,little I , 1983.
It is the City's desire to relocate the two (2) existing llll db sirens and
purchaso a new 125 dh siren in order to provide warning coverage to 900 of the
population. Particular emphasis is placed on providing adequate warning coverage
to the three (3) trailer parks located in the City which are considered high risk
areas due to the type of construction and the frequent high wind conditions
experienced in the City.
The tripling of siren warning coverage proposed by this project will signifi-
cantly enhance the City's capability to warn its residents of pending weather
conditions or other potentially serious situations. The City will assume full
responsibility for the maintenance and operation of the system.
The locations for the sirens are not within any identified flnnd zone :areas or
known areas of historical significance.

RE: Peterson property at 2294 Bronson Drive.
On 6/10/83 1 contacted Mr. Glen Westerheim by phone and asked what I might
do to help alleviate his problems. He stated that on Mrs. Peterson's property
were two unlicensed vehicles. Ile also stated that, "on hot days, when the
wind blew from the Southwest, there was an odor of dog manure." He went
on to state that he certainly wished something could be done about these
problems as he'd had nothing but problems over the years with Mrs. Peterson.
He commented, in closing, that he was very happy with the service he'd
received personally from me throughout the past fifteen years or so.
I advised him that 1 would have Mrs. Stevens, the Community Service Officer,
check out his complaint within the next half hour. Ile stated that he'd be
home and that she could come into his back yard and observe the problem from
his property line.
I talked to Mrs. Stevens during the next half hour and told her that I wanted
her to view the problem area and advise me of her findings.
She returned to my office a short time later and reported that she'd found
two unlicensed vehicles; one plate expired in 1982 and another expired
on May 10, 1983. She also found two unlicensed dogs chained to stakes in
the back yard. She stated that she could detect no odor of dog manure and
could not see any telltale signs thereof. Mr. Westerheim asked to be notified
of the action taken and if nothing could be done he was "either going to
sell out or drop dead or something."
I advised Mrs. Stevens to issue fourteen day warning citations to Mrs. Peterson
for unlicensed vehicles and dogs.
Mrs. Stevens attempted to contact Mrs. Peterson on a number of occasions and
finally resorted to leaving warning notices and copies of the ordinances in
the back door of the home.
On 6/15/83, Mr. Westerheim was advised by Mrs. Stevens of the action taken and
proposed remedies. He stated to Mrs. Stevens that he was very happy with the
attention being given to the problem,
Mrs. Stevens was unable to contact Mrs. Peterson but did, however talk to Mrs.

SUBJECT: PRIORITIES FOR JOINT CITY AND COUNTY ROAD IMPROVEMENTS
Attached are the following items:
1) Copy of December 27, 1982, letter to Elmer Morris which
transmitted the MSA 5-year plan for Mounds View.
2) Copy of April 13, 1983, letter from Ken Weltzin on
Ramsey County 5-year plan.
Initial contact has been made with Ken Weltzin to see if projects
along County Road I from Pleasant View to Silver Lake Road would
be fundable under a joint city/county program. The answer was
affirmative if funding is available. Ramsey County currently has
a $100,000/y5r program for county road reconstruction. This is
typically used to fund the center 24 feet of roadway improvements
with the local cities funding the balance. The county will also
share in cost of necessary drainage improvements through an assess-
ment formula procedure.
(� In order for the city/county project to move ahead, the following
items need to be addressed:
1) Project priority and justification at both city and
county levels.
2) Funding source and project timing.
3) Determine scope of project.
Previous discussions with the City Council have indicated that
County Road I is first priority with other projects falling in line
per MSA 5-year plan.
Staff is requesting confirmation of these priorities.

INTRODUCTION
Ramsey County lleparlmenl of Public
Works has responsibility for the provision
of a transportation network of county
roads in the portion of the County
outside the City of St. Pail. Suburban
Ramsey County consists of 74,147 acres
of land with a 1980 populntion of
189,433.
There are two types of roods under the
jurisdiction of the County: county slate
aid highways, numbered one through 79,
whose construi1;e" and mainterianie is
funded primarily from the Minnesota
Highway User Tax Distribution Fund; and
county roads, numbered 80 through 163,
which are funded from property taxes.
All of these roads and the bridges on
them require monitoring and
maintenance by tine Public (Yorks
Department of Ramsey County. The
improvements scheduled to be performed
to these roads and bridges are contained
in this Capital Improvement Program for
1983 to 1987.
The Public Works Department also has
responsibility for 23 lakes within the
County. Major improvement projects
proposed for these lakes are also
included in this Capital Improvement
Program.
The Capital Improvement Program is
developed by assessing the condition of
the existing system and its adequacy to
meet needs. Deficiencies are analyzed
and alternative actions to correct them
are considered. Priorities are estab-
1 shed with community involvement. The
need for a project is considered along
with technical staff capabilities and
funding availability. The listing of the
projects to be implemented by the Public
Works Department is contained in the
Capital Improvement Program.
There are five categories included in the
Capital Improvement Program: capital
improvement projects currently under
contract, capital improvement projects
for 1983-87, capital improvement
projects which are not programmed,
maintenance projects for 1983 and a
deficient bridge program.
Tile Capital Improvement Program,
which covers a five-year period, is
revised annually to reflect changes due
to budget limitations, additional funding
sources, federal requirements and other
factors.

Dear Mr. Morris:
f� Enclosed is a copy of the M.S.A. 5-year plan for the City of
Mounds View. As can be noted in the plan, the City anticipates
using the majority of its M.S.A. monies to compliment county
projects in the City of Mounds View.
The City has identified its priority areas as follows:
1) Upgradinq of County Road I from Interstate 35W to Highway
10.
2) Upgrading Old Highway 8 from County Road Il to the south
City limits. In particular, improve geometries at
County Road II and Highway 10.
3) Improvements to County Road J from New Highway 10 (Long
Lake Road to the west City limits). This section of road
is experiencing very heavy traffic and safety improvements
would appear to be necessary in the near term.
4) Improvement of traffic control and geometries at the
County Road H-2 and Highway 10 intersection.
5) Resurfacing of Groveland and Long Lake Roads.
The City will be embarking on a more thorough investigation of
total community street needs and the street maintenance program in
1983. At that time, a more thorough evaluation of the M.S.A.
improvement program will be conducted,

the :;ysL•em as of December, 1982. We have noted the additional
streets added to our system in the Silver Lake Woods development
area. 'These roads were included in the previously submitted
annual certification of. mileage.

Elliott-Ilendrickson, Inc. I had sent you a letter previously

Mayor McCarty stated that, concerning Item K, for
a conditional use permit for an oversize accessory
building, the conditions for a conditional use
permit have been met under the present code, but
that the proposed revision to Chapter 40 is much
more restrictive, and he did not feel this
conditional use would be allowed once Chapter 40
was passed. He also expressed concern in not
allowing the transfer of the conditional use
permit to a new owner, as a future Council and

Planning Coimnission might think along different lines
and not allow a conditional use permit. There was
discussion among the Council as to potential problems
if the permit was transferrable, as far as someone
running a home occupation out of the building, and
what type of door would be put on the building,
Mayor McCarty recommended the item go back to the
Planning Commission for additional consideration,
and asked that they also discuss the size of
accessory buildings allowed.

the item to the Planning Commission for further
disposition.

Sydney Lang, 12 Buffalo Road, St. Paul stated she
has always had children in the Mounds View School
District, and commended the City for their position
on the 19 year old legal drinking age, and asked
that they do what they can when issuing liquor
licenses to see that ID's are checked.
Mayor McCarty stated that he agreed 19 is too low
an age and that they will do all they can.
Clerk/Administrator Pauley briefly explained the
purpose of proposed Ordinance No. 342, which
adopts Rule #8*of the Minnesota Air Pollution
Control Agency, which allows the Fire Chief to
issue open burning permits.
Motion/Second: Linke/Blanchard to approve the
first rea ing of Ordinance No. 342, amending
Chapter 63.05 of the Municipal Code of the City
of Mounds View, entitled "Fire Code".

Clerk/Administrator Pauley explained the proposed
resolution, stating that it was prepared under
advisement from Attorney Meyers.
Director Johnson added that Chapters 60, 61, 62
and 63 will require amendments, and to make all the
changes inclusive, they are proposing to modify

Attorney Meyers reported he was asked to cosnnent on

the Knollwood Green condominium proposal and the

development, and stated Development Agreement No.
83-57 indicates the developer will follow the

requirements of the City. lie explained the code
does not specify the type of screening, and the
Development Agreement calls for a site plan, and
Exhibit 2A does not specifically require it. He
advised that to have it as part of the Development
Agreement, there is a provision in the contract to
do by mutual consent. He stated that Staff feels"
the planting buffer will be adequate. He summarized
that unless the contract is amended, the developer
is not required to put up a fence.
Mayor McCarty stated that several residents had asked
to be present when Attorney Meyers provided his
opinion, and recommended they be invited to the next
meeting.
;jerk/Administrator Pauley replied that he has asked
Attorney Meyers to provide his opinion in writing,
and that he plans to mail a copy of it to all concerned,
and that if anyone still has questions, they could then
come before the Council.
Mayor McCarty questioned why the City couldn't have the
same fencing requirements for all, and stated he was
not sure that fencing could be required based on
density, Attorney Meyers replied that if a pniiry is
established, they would have to have some reasoning for
it, and that something could be added to the code.
Attorney Meyers reviewed a proposed amendment regarding
legislation on the Anoka County Airport, and advised the
Council of how it would affect the City's lawsuit.
Mayo_ McCarty asked that Clerk/Administrator Pauley
draft a letter on the Council's position on the airport
situation, for the next agenda session.
Councilmember Hankner had no report. 12, Reports of

Councilmember Blanchard reported she had received
a complaint regarding the height of the duplex
being built at Greenfield and County Road I.
Clerk/Administrator Pauley replied that the Building
Inspector has checked it, and the grade is what was
stipulated, based on previous City requirements.
Councilmember Linke reported the Festivities
Commission would be meeting June 26, and updated
the Council on what is bei:• Tanned.

Councilmember Linke asked if more notice could be ,
given on the deadline for articles for the City
Newsletter. Ile also asked if what is now known t
as the Mayor's Message could be turned over to

the other Council members for some issues, to
allow them the opportunity to submit articles
and become better known by the citizens. He

pointed out that the Newsletter is published

six times yearly, so each Councilmember could

have one issue, and the Mayor two issued.

Mayor McCarty replied that per the Charter, it
has been determined that the Mayor should write
a message to the citizens, and it has been
determined also that the City Newsletter is the
method to use. He recommended that they could
also add a Council's Corner, for the Councilmembers
to use for their articles.
There was considerable discussion on whether
there should be separate articles, or whether
they should be combined. Mayor McCarty stated
he would like to keep the Mayor's Message
separate, due to the Charter requirements. Ile
stated he would request an opinion from the
Charter Commission as to whose responsibility
the Mayor's Message is, and whether the City
Council could have a Council's Corner.
Mayor McCarty asked Staff to prepare a proposal
for the Council, regarding the City Appreciation
Dinner, and having the City pay for the dinner
of all active Commission memuers, as a sign of
the City's appreciation of them. He asked that
Attorney Meyers determine what funds could be used.
Clerk/Administrator Pauley advised that all 13. Report of
Councilmembers will be receiving 15 dinner tickets Administrator
sometime in the next week, to sell for the
Appreciation Dinner.
Clerk/Administrator Pauley reported that a large
number of government organizations in the State
are co -sponsoring a 3 day symposium in Duluth
in July, on computer usage. He stated he would
like to make use of part of the $200 training
money available this year, and would have Finance
Director Brager attend with him. He reviewed
the expenses involved.
I. Clerk/Administrator Pauley asked Attorney Meyers
_ if the City has a legal means to require Bob
Waste to separate his commercial from his residen-
tial water usage, for his sewer and water billing.

the process of a public hearing, and stated that
since there were so many citizens who would like
to speak, that while each would be given their turn,
he asked that they not repeat each others comments
but rather state if they agreed with what had already
been said, and had any additional comments to add.
Colleen Olson, 7641 Edgewood Drive, presented the
Council with a petition against the proposed
development, signed by all those who would be
adversely affected. She read a prepared statement
to the Council, stating she was against the
proposed development and would like the area left
residential.

Bruce Markwardt, 7635 Edgewood Drive, stated he
agreed with Ms. Olson, and that he had lived there
4z years and wanted to see the area remain residential.
Dave Bjur, 7639 Edgewood Drive, stated he was not
concerned about the additional children because he
is anti -children but right now the neighborhood has
15 children in 11 homes and he felt the proposed
development could add approximately 50 more children.
Dave Olson, 7641 Edgewood Drive, stated he was concerned
about the traffic problem, as one child had already
been run over by a car, as well as there is a problem
with the cars traveling too fast.
Mike Anderson, 7628 Greenfield Avenue, stated he lives
next to the lot for the proposed development and he
would like to see a single family home built there.
Robert Winne, 7656 Greenfield Avenue, stated he is
against the proposal because of the traffic and
parking problems already experienced.
Wes Johnson, 7630 Greenfield Avenue, presented the
Council with pictures of the parking on the street
in the neighborhood and explained some of the problems
they have been having. He stated he is concerned
with more apartment buildings going in, as they will
be creating an island for the 11 residential homes,
and they will be cut off from the rest of the resi-
dential area in the City.
Cheryl Johnson, 7630 Greenfield Avenue, stated there
is a serious traffic problem during the winter already,
with so much parking on the street that the plows have
trouble getting through. She added that there is a
problem also with children from the existing rental
property coming into all their yards to play.
Helen Gould, 7643 Edgewood, stated she had reviewed
a copy of minutes from 1976, when a public hearing was
held on the rezoning of the property, and that since
then, four single family homes have been built and
have all sold. She stated she would like to see the
area remain residential.
Bob O'Neil, 7644 Greenfield, stated he agreed with
comments made already and that he wished to see it
remain single family.
Dave Williams, 7625 Edgewood, stated he agreed with the
comments made so far, and asked the Council to consider,
if they decide to pass the proposal, to come out and
appraise the homes in the area, as a single family area,
and then come again and appraise them with the apartments,
and see if the developer is willing to pay the difference
to the property owners.

Ms. Olson stated she had reviewed Planning Commission
minutes and did not find any comments or acknowledge-
ments that this would be going next to a single family
home, and asked why the residents were never notified
when the item was before the Planning Commission.
Mayor McCarty replied that the law requires the City
Council to conduct public hearings, and that in the
past they have always tried to notify the effected
property owners at the Planning Commission level, and
they will try to insure it happens from now on.
Planning Coimnissioner Josey Warren stated that many
members of the Planning Commission felt it should
happen, but that notices haven't been sent out since
she became a member. She explained for those present
the procedure the Planning Commission follows in
reviewing proposed developments.
Mayor McCarty advised anyone interested to come in
and read the Housing Plan portion of the Comprehensive
Plan.
It was questioned if transitional zoning had been con-
sidered, with Ms. Olson, Ms. Gould and Mr. Johnson
speaking against it, stating they want the area to
remain single family. 0
Mr. Markwardt stated he was concerned with the proposed
apartments, that since he has seen many vacancy signs
in Mounds View, and if these were not fully occupied,
he could envision them becoming run-down.
Ms. Warren stated the Planning Commission was very
concerned with the parking situation, in reviewing the
proposed development, and felt there should be some
resolution to the problem, which is City wide, but they
felt it would have to be handled at the Council level.
Mayor McCarty asked that the Planning Commission check
into it first.
Ms. Olson stated they would be dealing with transient
people, who often do not have pride in their residence
or neighborhood.
Mr. Johnson stated that he is also a landlord, and that
while he personally keeps his rental property acceptable,
he does not take care of it with the same pride and
effort he does to his own home, as it is rental property,
and he is into it for the financial gain,
Mr, Olson stated he was concerned with the parking situ-
ation from the Bel Rae Ballroom, as there is already a
problem for blocks around when they have an event going
on,.

,� Attorney Meyers advised that if the Council has been
fully informed of the development, it would be per-
mitted to now have the developer give his side of
the proposal,
Larry Malmin and Richard Van Sickle, of Van Sickle,
Allan, reviewed the proposed development, showing the
blueprint of the project.
Mayor McCarty asked if any study had been done on the
potential impact of value for the existing home owners,
and asked if the developer would be willing to indem-
nify the City against lawsuits from home owners.
Mr. Malmin stated he was not certain if any study had
been done, and that while he could not speak for the
developer, he did not feel he would be willing to
indemnify the City against lawsuits.
Mr. O'Neil stated that he had noticed at the four plex
across the street that the people park on the street,
rather than in the parking lot, which creates a
problem. It was also noted that these renters have
as many possessions as home owners, such as boats
and trailers and campers and so forth, which they
must find some place to park, as well as a place for
their cars. It was also noted that their garages are
often used totally for storage, rather than the parking
of vehicles.
Ms. Warren stated the Planning Commission takes into
consideration the amount of green space available
for snow storage.
Mr. Johnson stated he was concerned with traffic and
the impact of the vehicles to be parked. He stated
he did not feel the minimum requirements were
sufficient.
Ms. Olson stated she did not feel the 8 trees shown
on the blueprint were sufficient for buffering the
residential area. Mr. Van Sickle stated lie believed
the developer would be willing to put more trees in
if it was felt they were needed.
The resident who has the wood pile on the developers
land stated lie would be willing to move the pile
upon request.
Ernie Gustafson, owner of the property in question,
stated that in dealing with the developer, they
had discussed how to screen the residents, and had
proposed a 6' redwood fence, as well as other options.

Mr. Gustufson informed the residents he has been
paying taxes on the property for over 40 years,
and they have been increasing $5,000 to $6,000 each
year, and it is to the point where he cannot afford
to keep up with the taxes. Ile stated he felt the
residents property was devalued already when they
purchased it, with the apartment buildings already
present, lie added that the proposed development
will be pleasing in appearance.
Mr. Gustufson stated this was the fifth time he has
come before the City to try and develop the property,
but had been turned down each Lime because of the
residents complaints. He presented examples of how
the residents in the area have been using his property,
and asked for the right to use his own property.
Mayor McCarty asked if the property was R-1 when Mr.
Gustufson purchased it. Mr. Gustufson replied he
purchased it 40 years ago, and it was just one solid
piece of ground at that time, and that he put in his
own road. He added he did not ask to have the
property zoned to R-1, and that the Council did that
of their own authority, and that while he did not
protest it at that time, there was no objective to
it then. 1
Mr. Gustufson stated he had recently been discussing
the sale of the property to a residential developer,
but after viewing the type of home the developer
built, felt the four plexes would be of a much higher
quality.
Several of the residents replied to Mr. Gustufson,
stating they would prefer to see him sell to the
residential developer, as the opportunity was there.
They also expressed concern with pride in ownership.
James Carter, 7660 Greenfield, stated he has had a
problem with garbage in the neighborhood and people
litering, as well as problems with no privacy, and
the apartment residents and children coming into
his back yard, which is fenced. He stated he is
opposed to the development as there nre enough
transient people already that they have to deal
with. He also stated there is a parking problem.
Mayor McCarty closed the public hearing and reopened
the regular meeting at 9:08 PM.
Attorney Meyers advised that the Council can consi-
der the items that have been brought up, and that
if additional parking problems would be created,
they could be taken into consideration, as well
as the reliance of the people based on the current

zoning, for any increase in traffic that would occur
over and above the permitted use. He stated there
is evidence of an adverse effect on single family
dwellings, and they should take into consideration
the nature of the neighborhood now and the existing
use of the abutting property, and they can take
into consideration the transient nature of renters, but not
race, color, creed or economic status. Ile advised
that if the proposal and rezoning is granted, they
could put into the development agreement that the
parking lots be kept clear in the winter, and back
it up by a bond, which would be carried down to any
future owners. He added that the screening with
trees could be covered for a reasonable time for
replacement. He also advised the courts are not
concerned with the profit a developer might make.
Attorney Meyers also advised that the Comp Plan
designation should be used as a guide only, and
that whatever the correct zoning is would control
the use, and that to adopt the proposal would re-
quire a 4/5 vote.
Councilmember Blanchard asked if there was any
room for compromise between the developer and
residents, and suggested tabling action if there
is a possibility of compromise.

Mayor McCarty stated that in reference to the
Comp Plan, it is not to be viewed as a hard and
fact outline of the community, but that they
are dealing with guidelines. He stated that
there seem to be some continuing problems with
parking, snow plowing and garbage and so forth,
which can be dealt with. However, there is
a problem with the compatibility with the
surrounding neighborhood. He stated he felt it
is good planning to do transitional zoning, and
that they could maintain the neighborhood as
R-1, for some distance, and then allow the
higher zoning toward the Bel Rae Ballroom.
Attorney Meyers advised the item could be tabled,
but there would be a logistics problem, as everyone
involved would have to be notified again for further
discussion and action.
Motion/Second: McCarty/Linke to deny the plat as
presented, with the reasons for denial based upon
the existing ZonimU, Cauprehcnsive Plmi usxl Chapter 40 of
the Municipal Code, and further, to table the
Babinski proposal and rerefer it to the Planning
Commission for further disposition, taking into
consideration transitional zoning.

Councilmember Linke stated he felt four-plexes
against R-1 would not be desirnble and that he would
like to see transitional zoning. Ile also asked that
a tot lot be considered for the development.
Councilmember Blanchard stated she felt the proposal
is high density but there is room for compromise,
and she hopes something can come out of it.
Councilmembers Hankner and Doty stated they both
agreed with Councilmembers Linke and Blanchard.
Mayor McCarty stated this is a very close neighborhood
and it may be to their advantage to appoint two or
three people to act as spokesmen for the group in
further meetings with the City.
Councilmember Hankner left the meeting at 9:27 PM
to return to work.
Mayor McCarty closed the regular meeting and opened
the third public hearing at 9:45 PM.

Mr. Dalberg stated he is requesting that the north lot be rezoned to
be R-3, and the south lot be rczolim to R-2.
Director Johnson explained that on May 18, the
Planning Commission met and discussed the proposal
in detail, and forwarded on Resolution 78-83, and
that they will take formal action at their first
meeting of June, on June 1.
There was discussion on what the Council was to `J
consider tonight and what the Planning Commission
will be discussing and what their intent is.

Clerk/Administrator Pauley explained that hearing
notices had been sent out, informing people that it
was for rezoning from R-1 to R-2 and/or R-3.
Mark Baxter stated he was the neighbor living next
door to Mr. Hanson and asked for the status of the
development.
Mr. Dalberg stated that the direction from the Planning
Commission was that they would approve R-3 on the north
lot, and R-2 on the south lot, and take official action
on June 1.
Mayor McCarty reviewed the action taken to date for
Mr. Baxter.
Mayor McCarty closed the public hearing and reopened
the regular meeting at 10:05 PM.

No. , amending the legal description to refer only
to the south lot, rezoning it from R-1 to R-2, and
adding a Section II for the north lot to rezone it from

7900 Edgewood Drive appears to be abandoned,
and that in checking, they have found it un-
secured and have issued the required legal

to proceed at the end of 10 days to secure
the vacant building.

unsecured buildings.

Sta to secure the building at 7900 Edgewood
Drive, pursuant to the provisions under
Minnesota Statute 463.251, wherein the building
is vacant and unoccupied and is deemed hazardous
due to the fact that the building is open to
trespassers and has not been secured, and the
building could be made secure, and that any
costs incurred should be assessed to the
property.

Director Johnson stated lie would be reporting on the
status of the storm water management plan and his
seminar in Madison at the June 6 agenda session.
Clerk/Administrator Pauley stated that Mr. Donut
needs the City seal on two legal documents for the
splitting of their two lots,
Mr. Welch explained they had a minor subdivision
Brooks, which was approved by both the Planning
Commission and City Council, and the subdivision
has been done but it was not recorded at the County
offices.
Attorney Meyers advised Mr. Welch to come in for a
closer review of the documcnt°.,
Attorney Meyers reported that it appears the Legis-
lature has tightened up the DWI laws, and reviewed
the changes made.
Councilmember Linke reported he had attended the
Ramsey County League meeting last Wednesday and
gave the highlights of the presentation on
volunteerism. He also reported the watershed
issue was discussed, and the League is asking
the Rice Creek Watershed District to attend the
August meeting, to discuss the item.
Councilmember Linke reported he had attended
the May 18 Planning Commission meeting and
discussed the traffic signal at Pleasant View
and Highway 10, and that the residents present
were opposed, so he has notified both Spring
Lake Park and the State that the meeting was
held and there was opposition.
Councilmember Linke reported he is now working
out of his home, until his new employer locates
an office for him, so will be reachable during
the day at his home phone number.
Councilmember Blanchard reported she had attended
the May 18 Planning Commission meeting and that
most of what was discussed there has already been
brought up this evening.
Councilmember Blanchard presented a check to Mayor
McCarty as a donation from the family of Melvin
Sinderson, in his memory. Mayor McCarty thanked
kL Councilmember Blanchard and her family.

Mayor McCarLy reported he had attended a meeting at
the Edgewood Community Center regarding enrichment
class offerings. Ile rcporLed the congregate dining
program is having a problem in transporting senior
citizens to and from its meals and asked Staff to
check into the Lransportation problem and see if
the City could help in some way.
Mayor McCarty reported the City had received a
certificate last week from the Jaycees, stating
their appreciation for the City letting them
hold their haunted house at City Hall. Ile
explained the funds are used to help retarded
citizens. Mayor McCarty read the award.

PROPOSED USE OF GENERAL REVENUE SHARING
Notice is hereby given that the Council of the City of
Mounds View will meet on Monday June 27, 1983 at 7:40 p.m.
at City Hall, 2401 Highway 30, Mounds View, MN. 55112 to
consider proposed uses of General Revenue Sharing monies for the
period January 1, 1984 through December 31., 1984. The City
anticipates payment of $51,593.00 in Revenue Sharing monies for
the period January 1, 1984 through December 31, 1984; making
$51,593.00 available for appropriation.
Citizens of Mounds View may make oral and written suggestions
regarding possible uses of these Revenue Sharing monies at the
meeting.
