The project is being coordinated by our City Forester, Rick Wriskey, who is being assisted by Mr. Paul Gollnick, as part of his Eagle Scout project. In addition to proclaiming April 23 as Arbor Day, the proclamation reinforces the joint powers agreement and cooperative efforts between the Cities of New Brighton and Mounds View which has been a positive relationship during the past three years. The $2,530.00 is based on 20 hours of employment per week at $5.50 per hour for a 23 week period. The total hours staff has budgeted for is 450 and staff has enclosed copies of two contracts which would allocate the hours to two suecific individuals, Mr. Odas Newton a Mounds View senior citizen who has worked for the City for the past two years, and Mr. Ken Lelm who has also worked for the City for the past four years. The building interior is nearly complete and check lists are now being submitted and completed. Staff would request authorization from the City Council to issue a temporary occu- pancy certificate in order to allow tenants to move in and occupy units. Issuance of the temporary certificate would only be is- sued if the building is substantially complete and safe. Cos- metic and exterior items may be completed at a later date after which the full occupancy certificate would be issued and a release of D.A. would be made. I and Edgewood Avenue. The subdivision is called Edgewood Square and was owned by Robert Eigenheer. We are requesting that the development contract which has been approved for the completion of utilities on this parcel be transferred from Robert Eigenheer to Good Value Homes. Assuming that this transfer is approved, we would like to begin development work as soon as is practical. We would also like permission to have homes under construction at the same time the utilities are being constructed. I MEMO TO: Clerk -Administrator FROM: Director of Public Works/Coimiwnity Development DATE: April 15, 1983 SUBJECT: EIGENHEER/GOOD VALUE DEVELOPMENT AGREEMENT Attached are revision for Eigenheer development agreement for Council approval on April 25, 1983. Also on April 25, 1983, Mr. Eigenheer is requesting approval of assignment of development agreement to Good Value Homes. It is my understanding that Good Value Homes is requesting permission to take out building permits on lots before final acceptance of proposed improvements. I would recommend approval of up to four building permits before final acceptance but no Certificate of Occupancy. I suggest the following two additions to Good Value development agreement (not Eigenheer) as a condition of transfer (Exhibit 2A): 14. Developer may obtain up to four building permits after filing final plat but prior to final acceptance by the City of proposed improvements, but no Certificates of Occupancy shall be issued prior to final acceptance by the City of the proposed street and utility improve- ments. 15. Developer shall provide construction inspection and have professional engineer certify to the City that street and utility improvements were installed according to the specifications and plans. JCJ/bc Attachments LJ DEVELOPMENT AGREEMENT NO. 82-54 U8XII1.111T 2A In addition to the foregoing conditions, Developer agrees to the following: 1) The Developer hereby agrees to pay all bills for expenses incurred by the City within 30 clays of receipt. 2) Post $5,000 in cash to the City to cover inspection and administrative costs of the City regarding the improvement of the property. 3) An additional ten (10) feet of• drainage and utility easement be placed along the north line of Lot 8. 4) That easement documents for filing on Lots 17, 18 and 19 and part of• Lot• 16 denoted drainage easement on the Edgewood Square Plat be prepared and submitted to the City subject to approval of the City Attorney. 5) The Developer submit• a 7-year security in the amount- of $5,000.00 covering the requirements of Resolution No. 983 for the Plat. ® 6) That the Developer agrees to the changes in the public improvement plan and specifications discussed and agreed to in Meeting Minutes dated 3/30/82 (Exhibit 2B) and a letter from Sliort•-Elliott-liendrickson dated 4/7/82 (Exhibit 2C) hereby attached. This includes the installation of an out- side drop for sewer as stated in #1 of Exhibit 2B. 7) The Developer agrees to allow a special assessment in the amount of $6,944.82 to be assessed against the benefitting lots of the property to be known as Edgewood Square. 8) The public improvement shall be completed no later than October 15, 1983. 9) That the as-builts for the public improvements be submitted no later than 30 days after final acceptance of the project. 10) No sewer and water connections shall be allowed to the new improvement prior to its final acceptance. 11) The Developer agrees to provide drainage to the west along the front• of lots 3, 4, 5 and 6 which abut• County Road I per plan approved by the City Council on 3/28/83 subject to t the approval of the Ramsey County Engineer. Drainage charge will require adjustment of top elevation or detention pond bank. We would recommend approval of the final plans and specifications subject to the following: 1. That the street width for Pinewood Circle be changed to 34' back-to-back of curb so that the street width will be 32' as required. 2. That paragraph SP-13 be modified to read "corporation stops shall be Mueller II-15000 ." 3. That paragraph SP-14 be modified to read "curb stops shall be Mueller 11-15150, A.Y. McDonald 4717 or approved equal." 4. That the maintenance related changes agreed to at the March 30, 1982 meeting between the developer, city personnel, and consultants, be agreed to by the developer.
