Adjournment ,..ern. *3A CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA NOTICE OF PUBLIC HEARING VACATTON OF FATRCHILD AVENUE NOTICE IS HEREBY GIVEN that the Council of the City of Mounds View will meet on Monday, August 9, 1982 at 7:40 p.m. at City Hall, 2401 Highway 10, Mounds View, Minnesota 55112, to consider the vacation of the Fairchild Avenue Street right-of-way between Laport Drive and Ardan Avenue. Anyone desiring to be heard with reference to this matter may make oral or written presentation at this meeting. Donald F. Pauley Clerk -Administrator (Bulletin: July 29, 1982) D R A F T RESOLUTION NO. 19•b I CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION VACATING FAIRCHILD AVENUE RIGHT-OF-WAY BETWEEN LAPORT DRIVE AND ARDAN AVENUE WHEREAS, the City has existing 30 feet of street right-of-wav, named Fairchild Avenue, between Laport Drive and Ardan Avenue; and WHEREAS, the City has received a petition from the required number of property owners to vacate this portion of right-of-way; and WHEREAS, there are presently large subdividable parcels of land which abut this existing 30 feet of right-of-way; and WHEREAS, the City Council has determined that future access i be available to these subdividable lots; and WHEREAS, access to these parcels can occur from existing Laport Drive via a cul-de-sac type roadway; and WHEREAS, the City has deemed that 60 feet is the minimum street right-of-way width; and WHEREAS, the City Council chooses to provide the owners of the subdividable parcels reasonable time to convey the necessary easements and installation of streets and utilities for the cul-de- sac; NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council approves the vacation of the north 210 feet of the existing 30 feet of right-of-way, legal description as follows: The north 210 feet of that portion of street right- of-way westerly of Lot 6, Block 2, Degardncr Addition and also west of Lot 5, Block 1, Mid -States Estates, all in Section 6, 'Township 30, Range 23 in the City of Mounds View, Ramsey County with the following conditions: 1) The west portion of the right-of-way ("area to be dedicated" on attached map) be dedicated at the present time for future street purposes. Resolution No. lgloq Page 2 2) That within one year following the date of the adoption of this resolution, construction will. be commenced on the paving, curb and gutter., sterm drainage, watermain and sanitary sewer systems for• the portion of Fairchild Avenue cul-de-sac lying northerly of Laport Drive. Such installation shall meet the criteria of the City. BE IT FURTHER RESOLVED that the City will retain thu westerly 10 feet of the north 210 feet of this vacated area for drainage and utility purposes. ATTEST: (SEAL) Adopted this day of , 1982. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Mounds View hereby appoints election judges for the State Primary Election on September. 14, 1982 as indicated on the attached listing. OF MINNESOTA RESOLUTION COMMLNIIING MOUNDS VIEW FLSIIVITILS COMMISSION FOR THE 1982 'FESTIVAL 1N THE PARK" WHEREAS, the Mounds View Festivities Commission was responsible for coordin- ating and implementing the Eighth Annual "Festival in the Park" which was conducted on Sunday, July 18, 1982; and WHEREAS, the festival was attended by over 7,000 Mounds View residents; and WHEREAS, highlights of the 1982 'Festival in the Park" included an ecumenical church service, refreshments, youth parade, color guard, showmobile entertainment, bingo, youth and adult games and a hot air balloon race; and WHEREAS, the afternoon and evening festivities were concluded with a spec- tacular fireworks display; and WHEREAS, the entire afternoon and evening was made possible through the generous and dedicated donation of volunteer labor and time from not only the Festiv- ities Commission Members but also other civic interested residents. NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Mounds View, on behalf of the residents of Mounds View, hereby congratulate and heartily commend each of the 1982 Festivities Commission Members including Shirley Munholand, Chairperson; Barb McCluskey, Sandra Shackle, Russell Warren, Dorothy Willhaus, Mark Mack, Patricia Coffey, Cindy Wermager, Tom Gow, Shirley Buntrock, Mary Saarion and City Council Liason Bill Doty for their outstanding contribution; and BE IT FURTHER RESOLVED that the City Council of the City of Mounds View also extends their thanks and appreciation to the Mounds View Parks and Recreation Depart- ment and their staff for their involvement in making the 'Festival in the Park" a success; and BE IT FURTHER RESOLVED that the City Council of the City of Mounds View commend the city Public Works Department for their efforts in preparing the grounds for the 1982 "Festival in the Park". On July 29th staff received one copy of the complete report with notifi- cation that the County Board would be meeting on the matter at 10:00 a.m. on Monday, August 2nd. As written communication had already been sent indicating the position taken by the Council, staff did not attend the meeting. Staff has reviewed the proposal in its entirety and would offer the following brief summary. The proposal provides for the reduction in the need for landfill sites by offering four basic programs which would reduce the amount of solid waste being taken to landfills. These are: '1. Curbside collection of recyclables. 2. Area composting of solid waste and sewage sludge. 3. Waste -to -energy by means of mass burning of solid waste to generate steam for heat and electricity. 4. Yard waste management by providing for backyard or neighborhood composting of yard waste. Although the program was felt to increase costs to the consumer, revenues produced from the sale of compost and recyclables and electricity or heat are anticipated to hold such an increase to 20 percent. Of a variety of implementation programs reviewed in the proposal which ranged from mandatory to voluntary and county versus municipal regula- tion, it is the recommendation of. the Advisory Council to the County Board to establish a county -wide management program which would have the County Board adopt a solid waste management ordinance. Such an ordinance would establish organized collection districts, recycling districts, and yard waste and processing districts. Although the program would provide for county -wide management, it would allow for municipal control of the program on a local basis within the parameters established by the County. The final portion of the proposal outlines a variety of mechanisms for implementing the various portions of the plan as were previously summarized. These small jets have increased in both volume and noise impact on the community of Mounds View because of both their numbers and the flight paths being used by their pilots in taking off from and landing at the Anoka County -Blaine Airport. These planes are operating in the early morning hours prior to 8:00 a.m. and in the late evening hours after 8:00 p.m. when increased noise levels are more noticeable to residents of. the community. The flight patterns presently being used by the majority of the pilots operating these planes brings them over a large portion of the City of Mounds View at very low altitudes and the impact is being felt over. the entire City. Ile feel that on more than one occasion we have been led to believe that incidents such as these would be avoided due to modifications in the rules by which the Metropolitan Airports Commission operates the airports under its jurisdiction. It has become quite obvious in recent days, however, that either the regulations were not implemented or the pilots are ignoring these regulations. Therefore, as previously stated, we must at this time voice our strongest objections to the problems we are presently facing which we feel are a direct result of the methods by which the Metropolitan Airports Commission is operating the Anoka County -Blaine Airport and demand that immediate action be taken to remedy this untenable situation ox we will be forced to seek whatever appropriate legal recourse might be available to us. -z- We will await your response to our objections in the form of both a letter and an elimination of the problem we are presently facing. The Planning Commission, following much discussion, is recommending a variance from the present R-4 requirements of 100 spaces (60 uncovered, 40 garage) to 40 spaces. The developer has indicated that funding at this time is available for only 26 spaces which were initially submitted to 11.13.D. and the City for approval. The Planning Commission decision requiring 40 spaces at the start of the project has prompted the developer to submit a letter of appeal to this decision (attached). I have spoken to Attorney Meyers regarding this issue and he mentioned that the Planning Commission has granted a variance to 40 spaces, they have not denied a variance. The Council could determine that ultimately 40 spaces will be required but26 spaces could be constructed at the onset of the project and the additional 14 to be constructed at a later date. This could be made part of the development agree- ment. The Council would then not be overruling the Planning Commis- sion decision of requiring 40 spaces but the entire 40 spaces would not be constructed initially; 26 would be constructed during initial construction and 14 would be added at a date to be determined by the Council, to be included in the development ag developer has indicated that funding is just not available for 14 additional spaces at this time. Also, for your information at this time, attached is Planning Commis- sion Resolution No. 58-62 recommending the amending of Chapter 40 to include a definition and parking requirements for senior citizen housing. Discussion of this resolution will be scheduled for your agenda meeting of August 16. B (all definitions following senior citizen housing would be renumbered) Senior Citizen Housing. A residential housing development, or that portion of a housing development, in which 60 percent or more of the units are designed for occupancy by individu- als over 60 years of age or by an elderly couple with one or both members over 60 years of age (40.13, Subd. D). 40.07, Subd. (28) Senior Citizen Housing. At least a total of one (1) space per housing unit including not less than one (1) designated handicapped space per handicapped housing unit and at least 25% of the total spaces shall be no less than 11' by 20' or equivalent angle stall, including the designated handicapped spaces. 40.13, Subd. The development is assisted by the U.S. Department of Housing and Urban Development under one of its programs for housing low and moderate income elderly or such housing is constructed and/or operated by a profit or a non-profit organization which can demonstrate experience and a commitment to housing for the elderly, and provided such agency shall record at least a 20-year covenant and other land use controls on the property, executed in a form approved by the City, which will limit use of the property or a portion thereof to the occupancy by the elderly under the terms of the provisions governing '- senior citizen housing. d. The development provides for a lounge or other inside common areas amounting to at least 15 square feet for each unit. e. The development is provided with other special features which meet the needs of low and moderate income elderly persons. ' f. It was the intent of the Park and to outline succinctly what direction the city is heading ment and construction of park shelter buildings. a draft resolution Commission on Thursday, stated by the Park and Recreation Commission towards in the develop - As you are aware we have just completed our first neighborhood park shelter building at Lambert Park for an approximate cost of $20,000.00. In addition to our Phase I construction we have, through the use of community groups, removed the old condemned buildings at Lambert, Woodcrest, Hillview and Oakwood Parks. The building at Greenfield Park is currently being used for storage and the Park and Recreation Commission recommends that this building also be removed once an alternate building is constructed. The basic premise of the enclosed resolution requests that the City Council estab- lish a goal of constructing one shelter building each year, that the buildings be designed with a multitude of purposes, and outlines where and what type of build- ings might be constructed. The Park and Recreation Commission also directed staff to draft a recommendation regarding priorities for construction of the park shelter buildings which staff is currently in the process of completing. Staff would recommend that the City Council authorize payment of the final balance totaling $2,361.03 and acceptance of Lambert Park Shelter Building in its completed state. Staff is extremely pleased with the quality of the construction and our final product. Although there may be some minor changes that staff would recommend for future building construction, i.e. possible sky lights in the ceiling, a change in the garage door pattern and possible drinking fountain installation, but in general we feel that we have a very high quality, vandal resistent building at a nominal cost. In addition to the enclosed statement, I had also requested Stenco Construction to include two mechanics lein rights for the two projects that were sub-letted, i.e. the garage doors and some additional building materials. Staff would recommend that the City Council personally observe the building at Lambert prior to Monday's meeting should you have any questions regarding the final product. DATE: August 5, 1982 RE: Grounds Maintenance Specification for Silver View Park During the past two months staff has been meeting with a number of private contract maintenance firms to determine the feasibility of subcontracting out the maintenance of Silver View Park. The culmination of these meetings is attached in the form of ground raintenance specifications for Silver View Park. As this is the first time (to my knowledge) that a municipality has actively pursued a private contractor for maintenance purposes, it may need some fine tuning. The proposed specifications request the contractor to maintain the turf areas at Silver View Park to what we feel is an acceptable level. Staff envisions that a pre -construction or bid meeting would be held with each individual contractor to personally review the site and the City's expectations. To facilitate this process staff would request that the bid specifications be approved and staff be directed to set a bid opening date for Wednesday, August 25, 1982 at 10:30 a.m. C.S.T. in the City Hall Council Chambers. The City Council could then review the bids at their September 6, 1982 Agenda Session. Should you have any questions, feel free to give me a call at ext. ARTICLE 2 COMPENSATION AND TERMS 2.1 Compensation - As consideration for Contractor providing the services described hereinatter, Contractee shall pay to Contractor per month for maintenance of the Grounds. All invoices for services rendered shall be due and payable within thirty (30) days of receipt. 2.2 Construction - Nothing herein contained shall be construed as an obligation on the part of Contractor to extend credit to Contractee, nor as an obligation to continue to provide services to Contractee in the event timely pay- ments are not received. In such event, Contractor may terminate this contract as provided in Article 5.1 herein. ARTICLE 3 MAINTENANCE SERVICE 3.1 S_Rr_in9 Cl—e_a�n-u - Spring clean-up is to be completed as soon as weather and ground con itiodT' ns permit and no later than May 15th. Spring clean-up to include the following activities: a. Power sweep or hand rake, as required, the entire turf (sodded and seeded ) area of development. b. Remove all debris and leaves from turl area and removal from the wild areas of all foreign materials, i.e. paper, refuse, etc. 3.2 Mowing - Mowing of turf area to be completed on a regular schedule considering weather conditions to maintain a well -kept appearance. a. Spot mowing, as required, during periods of uneven growth. b. A cutting height of approximately 2 inches with normal moisture. C. Mowing. Clippings will not be caught on a regular basis. Only if mowing schedule is severely delayed due to weather or any other reason; then excess clippings laying on the grass will be mechanically raked up and disposed of. d. Repair of any excessive scalping. 3.5 Trimming. a. Trimming around buildings, backstops, players benches, planting, light poles, and other obstructions to be completed on a weekly basis, as required, to assure a well -kept appearance. Contractor to be responsible for any excessive damage to trees, shrubs, structures and paint caused by trimming. b. Once annually the weeds (tall growth) around the pond will be weedwhipped. Hourly rate applies. 3.4 rertmZdtion a. Fertilizer to be applied twice annually to turf areas prior to May 30th and September 15th. b. Turf analysis shall be done annually with a plan locating the following items: 1. Areas needing crabgrass prevention 2. Areas needing fumacide 3. Areas needing dirt 4. Areas need special attention Fertilizer quantities and costs to be provided to the City of Mounds View for approval prior to purchase. 3.5 Week Control a. Pre -emergent to be applied once in selected areas no later, than April 30, 1983, weather permitting. Material quantities and costs to be provided to the City of Mounds View prior to purchase. b. Grounds to be cleaned of debris and refuse once a week. 3.9 Lawn and Tree Watering - Watering of designated per attached plot to be completed to maintain adequate standards of ground moisture necessary for uniform and green appearances. ARTICLE 4 INSURANCE AND LIABILITY 4.1 Contractor's Insurance and Liabilit - Contractor will assume liability for damages to real estate and personal property caused by Contractor's personnel or equip- ment, if reported in writing within seventy-two (72) hours after the accident, and after inspection by Contractor to determine the validity of the claim. Contractor agrees to carry applicable insurance, and shall provide to the Contractee a Certificate of Insurance for Contractee's records. 4.2 Contractor Not Liable - Contractor is not liable for any of the following: a. Damage to planting, flowers or shrubs which are not separated by an edger, allowing routine trimming with machinery. eplacement of b damaged tby an exceptionally yharchfr rwinter, or any other shrubs, other cause of nature. Liability for bodily injury or damage to personal property due to snow and/or ice on roadways, parking areas and driveways. 4.3 Contractee's Agreements - Contractee does hereby specifically agree that Contractor will —not be held liable for any of the events described in Section 4.2 and agrees to hold Contractor harmless should any of those events occur and agree l� that liability for such events, if any, shall rest with the Contractee. ARTICLE 5 MISCELLANEOUS 5.1 Term - The term of this agreement is one (1) year and shall commence on April 1,1983 and terminate on November I,1983; this agreement may only be terminated as follows, and is otherwise non -cancellable: a. Contractee may terminate this agreement with the Contractor, after by giving the Contractor a thirty (30) days date notice. b. Contractor may terminate this agreement upon Contractee's failure to pay invoices and accrued interest on a timely basis, provided that Contractor gives Contractee notice of its intention to terminate this agreement due to said non-payment, and gives Contractee ten (10) days from the date notice is received in which to satisfy all outstanding indebtedness owed to Contractor by Contractee. 5.2 Contractor's Performance - In the event Contractor is prevented from ful- filling its contractual obligations under this agreement in the time deadlines herein specified due to natural disasters or abnormally severe weather conditions, Contractor shall be held harmless for such breach, provided that Contractor performs the requir- ed service as soon as practically possible when conditions permit. 5.3 Severable - In the event any portion of this agreement shall be held to be invalid, the same shall not affect in any respect whatsoever the validity of the remainder of this agreement. 5.4 Captions - Article, paragraph or section titles or, other headings contained in this agreement are convenience only, and shall not be deemed a part of the context of this agreement. 5.5 Waiver - Any waiver by an party of a breach of any provision of this agree- ment shall not operate as, or be construed to be, a waiver of any subsequent breach hereof. 5.6 Situs - This agreement was entered into in the State of Minnesota, and shall be controTled by the laws of that state. 5.7 Notice - Any notice required or permitted to be given under this agree- ment shall be sufficient if in writing, and if sent by registered or certified mail to the other party at the address set forth below: CONTRACTOR: CONTRACTEE: City of Mounds View Firm Name 2401 Hinhwa{ 10 Mounds View, Minnesota 55112 Address Telephone Number 5.8 Entire Agreement - This agreement sets forth the entire understanding between the parties, there being no terms, conditions, warranties or representations other than those contained herein, and no amendments hereto shall be valid unless made in writing and sinned by the parties hereto.
