CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
AN ORDINANCE VACATING A PORTION OF FAIRCHILD AVENUE
The Council of the City of Mounds View does hereby ordain:
SECTION I. The following legally described street
right-of-way shall be vacated:
The north 210 feet of that portion of
street right-of-way westerly of Lot 6,
Block 2, De Gardner Addition and also
west of Lot 5, Block 1, Mid -States
Estates, all in Section 6, Township 30,
Range 23 in the City of Mounds View,
Ramsey County.
SECTION II. The west portion of the right-of-way
("area to be dedicated" on attached map)
shall be dedicated at the present time
for future street purposes.
' SECTION III. Within one year following the date of the
adoption of this ordinance, the Council
will consider construction of the paving,
curb and gutter, storm drainage, water -
main and sanitary sewer systems for the
portion of Fairchild Avenue cul-de-sac
lying northerly of Laport Drive.
SECTION IV. The City will retain the westerly 10 feet
of the north 210 feet of this vacated area
for drainage, utility, and bike/pedestrian
pathway purposes.

SUBJECT: 1982 SEAL COAT PROJECT 82-4
Allied Blacktop Co. has submitted a statement for final payment on
the 1982 Seal Coat Project in the amount of $52,390.42. The
original bid price was $52,854.98. The final oil and rock quanti-
ties were slightly lower that estimated but well within specifica-
tion tolerances.
In order to close out the project it is necessary to obtain from
the contractor the following items:
1) Mechanics lien waiver from contractor and supplies.
2) Certification from Minnesota Department of Revenue of
payment of appropriate taxes.
3) Payroll records per requirements of Davis Bacon Law.
4) Consent of Surety to final payment.
It is recommended that five perrrnt of final payment ($2,619.52) be
retained until required paperwork is submitted to the City.
The contractor started the seal coat installation on July 21, 1982
and completed oil and rock application on Ardan Avenue, Knollwood
Drive, Groveland Road (north of Ardan Avenue), Groveland Court, and
Fairchild Avenue (north of Ardan Avenue). Work started with the
relative humidity at 79 percent versus naximum allowed by specifi-
cations of 75 percent. The relative humidity did drop by later
afternoon reducing probability of defective work. Approximately
44,000 square yards (or 29.5 percent) of wort: was completed on July
21, 1982. It is recommended that final acceptance be delayed until
September 30, 1982 and area be reinspected to determine if any unusual
deterioration has occurred. Pending final acceptance of work com-
pleted on July 21, 1982, it is recommended to retain 10 percent of the
payment for work done July 21, 1982 or $1,546.00. It is further
recommended that area in question should be reinspected in June of
1983 to determine if further claims should be made under guarantee
provisions of the specifications.

SUBJECT: SUBDIVISION RECORDING EXTENSION REQUEST
Attached please find the following regarding a request by Kenneth
Bourke of 8249 Spring Lake Road regarding an extension to the
time allowed for filing of a deed with Ramsey County:
1) Resolution No. 1333 approving the minor subdivision.
2) Staff's letter to Mr. Bourke outlining requirements
prior to deed signature.
3) Letter from Mr. Bourke requesting an extension.
Section 42.05, Subd. 1(15) of the Mounds View Municipal Code
states that the subdivider shall record a deed with County Regis-
ter of Deeds within 60 days following Council approval. This
60 day time period would have expired near the end of September,
1981. Staff has not received another extension request prior to
the one submitted at the present time. The subdivider is waiting
for a potential buyer of the lot so that he can pay for the
assessments and par): fund dedication. A six month extension is
requested.
Please direct staff regarding this issue.

RESOLUTION APPROVING PLANNING CASE 91-81,
A MINOR SUBDIVISION REQUEST
WHEREAS, a minor subdivision has been requested by Kenneth
E. Bourke, referred to as Planning Case 91-81; and
WHEREAS, the minor subdivision request meets minimum code
requirements in frontage and area; and
WHEREAS, Kenneth E. Bourke has also agreed to pay a special
assessment in the amount of $1,742.30 and a park fund dedication of
$64.00 as required by City Code; and
WHEREAS, the Mounds View Planning Commission has reviewed the
minor subdivision request and recommended approval in Resolution No.
31-81;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City
Council hereby approves the minor subdivision as requested in Planning
Case 91-81;
BE IT FURTHER RESOLVED that the Mounds View City Council re-
quires payment of a special assessment in the amount of $1,742.30 and
payment of the park fund dedication in the amount of $64.00 before
the City Clerk approves and signs the subdivision deed.

SUBJECT:� DYNAMIC DESIGNISRS
Staff received a phone call from Mr. Jim Cepress of Dynamic
Designers requesting consideration by the City to construct the
two fourplex buildings as was approved by the Council back in 1980.
To provide some background information, a development agreement
(N80-40) was drafted and resolution passed approving the develop-
ment agreement but because of housing marketing conditions/lack of
financing, etc., the developer dropped plans for the project and
the development agreement was never signed. During the latter
stages of the approval process, a certain amount of fill was depos-
ited on the lots per the site plan which was approved for the
development. The deposition of this fill was unauthorized. but do
to the fact that the project was nearing completion and fill would
have been required for development of the buildings, the developer
was not required to remove the fill at that time. The developer is
now requesting the process to continue where it left off back in 1981.
I spoke to Dick Meyers regarding this issue and it was his opinion
that Mr. Cepress would have to go through the process once again to
develop this property. The resolution 0 1373) which rescinded the
resolution approving Development Agreement No. 80-40 and also author-
ized a refund of the fees paid is attached for your review. Please
note the last paragraph of this resolution which states that the City
will review any future proposal for the property under existing or
future ordinances and resolutions that may pertain when a future
application is made. Ordinance No. 301 was not in effect when the
proposal was first approved but it is in effect at the present time.
The two lots in question lie almost entirely within the area regulated
by Ordinance No. 301. Ordinance No.305 gives the City Council the
authority to grant a permit for now building developments fcr the dry,
buildable portion of parcels affected by the ordinance. A determina-
tion may now have to be made if the fill that was deposited on the
site has made portions of the site dry, buildable and thus approval
could be granted under Ordinance No.,305.
Please direct staff what the Council would like done regarding this
item and also if any additional information is needed.

WHEREAS, the City Cuuncil of thu City of Mounds View authorized
the execution of Development Agreement: 80-44 vil:h Dynamic Designers in
Resolution No. 1180; and
WHEREAS, the permit authorized by Development Agreement 80-40
uas never issued by City Staff; and
WHEREAS, Dynamic Designers has paid partial permit fees in the
amount of $3,000.00; and
WHEREAS, Dynamic Designers has requested a refund of permit
fees paid; and
WHEREAS, the City has encumbered expenses in the amount of
$932.20;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Mounds View authorizes a refund to Dynamic Designers in the amount
of $2,067.80 and rescinds Resolution No. 1180 which authorized permit
approval;
BE IT FURTHER RESOLVED that the City Council of the City of Mounds
View will review any future proposal for the property involved in
Development Agreement 80-40 under existing or future ordinances and
resolutions that may pertain when a future development application is
made.

RE: City Newsletter Delivery
Staff has received a request from Ms. Sharon Nelson, representing Buy Scout
Troop 11400, to deliver the City Newsletter as d possible fund raiser. I
indicated to Ms. Nelson that I had to discuss this issue with you prior to
providing her with a response.
As you are aware, we did have the Swim Club deliver the newsletter on one
occasion which met with mixed reactions. Problems we experienced included
brochures not delivered, inconsistanl location at homes, apartments did not
receive them, etc.

is aware of the scope of the projects

they feel
confident
that
they
could
handle the project.

Attorney Karney stated that regarding the workers

He added that for future reference, the City should
let the insurance company determine if benefits
are due, and then follow suit on their recommenda-

The Council directed Clerk/Administrator Pauley
to draft a resolution of appreciation and thanks

stated the Council could send a letter to everyone
involved, and have the Festivities Commission come
in to a Council meeting, to give their thanks
personally.

Mayor McCarty had no report.
Clerk/Administrator Pauley explained that Reso- 17. Report of

notice from the MAMA negotiating committee that
negotiations with AFL/CIO Local 49, which is the
public works union, will be going into mediation

success with mediation in the past.
Mayor McCarty asked the status of the Council's
request to the Planning Commission for further
information regarding their decision on County Road

it with the Planning Commission and will be preparing
a report which will be in the agenda packet.
