Call to Order by Mayor McCarty at 7:35 PM on August 9, 1982. MEMBERS PRESENT: Councilmembers Doty, Hodges, 2. Consent Agenda Motion/Second: Forslund/Hodges to approve the consent agenda, minus Item C, and waive the reading of the resolutions. 5 ayes 0 nays Motion Carried Councilmember Doty asked that his name be removed from the resolution commending the Mounds View Festivities Commission for the 1982 Festival in the Park, as he had not worked with the Commission. Mounds View City Council August 9, 1982' Regular Meeting Page Two ------------------------------------------ Motion/Second: Doty/Blanchard to approve Reso- ution o, 74, as corrected, and waive the reading. 11 5 ayes 0 nays Motion Carried The Council requested the Festivities Commission be invited to attend the next regular meeting, where they could be thanked personally for a job well done. Mayor McCarty closed the regular meeting and opened the public hearing for the Fairchild Avenue right- of-way vacation at 7:41 PM. Director Johnson summarized the request for the vacation of Fairchild Avenue. 6. Continuation of Public Hearing � Mr, .Werner stated he was not in favor of havin Fairchild Avenui the road developed. g Right-of-way Vacation Peg Mountin, Chairman of the Planning Commission, reported the Planning Commission was recommending the City retain the right-of-way so as not to pre- clude development of the two southern parcels of land, as well as potentially develop the bike and foot path. Sue Gale, 8227 Groveland Road, stated she Celt the City had given a verbal agreement earlier to put a road through. Mayor McCarty replied that that agreement was for a cul-de-sac. Deb Yost, 8205 Groveland Road, asked why a one year time limit had been placed on putting a road in. Mayor McCarty replied the Council is considering a resolution that requires that within one year of adoption, construction be commenced. He explained the City has been petitioned to have the area vacated, so must take some action to either vacate it or develop it. There was considerable discussion regarding liabil- ity if someone were to be injured on the property, the feasibility of putting through a walk -way, the difference between a dedicated right-of-way and ease- ment, why the City had cleaned up the property earlier, and why a variance for a 60' lot could not be granted. Mayor McCarty closed the public hearing and reopened the regular meeting at 7:59 PM. Motion/Second: Doty/Hodges to approve Resolution NO-7769 as —amended, and waive the reading of the resolution. 5 ayes 0 nays Motion Carried Mounds View City Council Regular Meeting .-� Mrs. Mountin asked the Council if they would direct Staff to go out and examine the property and send a letter to the owner, to have it cleaned up, Motion/Second: Doty/Blanchard to direct Staff to contact the -property owner of records to see that the property is cleaned up on the easement between Ardan Avenue and LaPort Drive. 5 ayes 0 nays Motion/Second: McCarty/Doty that if it is determined t e ity is t e owner of record, that it immediately clean up that part the City is responsible for. 5 ayes 0 nays Motion/Second: McCarty/Forslund to move the senior citizen housing project ahead on the agenda 5 ayes 0 nays Pete VanHauer, representative for Mounds View Residents, Inc., stated they were present to try and reach some type of compromise with the Council, based upon action the Planning Commission had taken, regwiring 40 parking spaces, while they only had funding for 26. He explained he had met with HUD staff and they are approximately $7,000 short of funds for the extra parking spaces and do not want to see the project fall through at this late date. Upon auesti.oning, he stated they would be willing to put 26 spaces in now, and add 14 later, if it was determined they were required, or they would be willing to put in 30 now, if no more were required. Mayor McCarty asked if they would be able to have the 40 spaces completed by August 1983. Mr. VanHauer replied they would like a justifi- cation study done, which they would be willing to fund, and would like to have until June 1985 to make a determination. He added that it is HUD's opinion that 40 spaces are not necessary, and they will not allow any type of temporary parking that is not paved and curbed. Mrs Mvu tin cuplaiued that the proposed Chapter 40 update would allow for a conditional use permit, with a 15 percent deviation on parking, which would then make the requirement 34 spaces. She also pointed out there was no additional off-street parking provided for, and it was the Planning Commissions feeling that it would present a problem. Motion/Second: McCarty/Doty Lhat the City Council deny the appeal from the variance granted by the Planning Commission and authorize preparation of the development agreement, requiring 40 parking spaces, with 26 to be constructed now, and an additional 14 spaces by August 1, 1984, unless prior to that date the Council receives a recommendation from the Planning Commission, allowing for less than 14 additional spaces. 5 ayes 0 nays Motion Carried Park Director Anderson reported that to date, 125 8. 2nd Quarter 198 dieseased trees have been removed, compared to 200 Department Head at this time last year, with 932 trees being planted. Reports He reported Phase I of Silver View Park has been completed, with four contracts to be closed out yet. He reported the pond is completely opened now and getting a good water flow, fie also reported the Lambert Park shelter building was completed the previous week. ice' Park Director Anderson reported the City would be scheduling pool time for the Edgewood Community Center, with 90 hours per week. He also reported the Festival in the Park had been very successful, that the softball program is continuing to grow, that the. youth volunteer program has supplied approximately 60 part-timers, that the joint powers agreement with New Brighton for the puppet wagon has been very successful, as well as the summer playground program for the City. Mayor McCarty asked the status of the neighborhood park group. Park Director Anderson replied he has spoken with them and they will be having a meeting at Groveland Park on August 11. He added he has told them very firmly that anything they decide will still have to go through the Park and Rec Commission and City Council. He reported the new patrolman has been working for three months and seems to be working out well, that the new patrol car is in and everyone seems happy with the full size model and that the vacation period is almost over, so they will be back with a full crew. Mounds View City Council Regular Meeting Motion/Second: McCarty/Blanchard to approve eso union fTo. 1473, the Park Shelter Building policy, and waive the reading of the resolution 5 ayes 0 nays Motion/Second: Doty/Forslund to set project and authorize payment of $2,361.03 to Stenco Con- struction for the completion of the Lambert Park shelter building. 5 ayes 0 nays Finance Director Brager reported the Finance Department had wrapping up the audit, and preparing the 1981 financial statements, as well as doing the regular daily work. Ile reported the City is doing very well with it's investments, earning between 13 and 14 percent, for $376,000 during the first half of the year. He added, however, the interest rates have fallen now to between 10 and 11 percent. Finance Director Brager reported the City has made it's last payment on the 1960 water improvement project. He also reported the department is in the process of working on the budget, and will be involved in elections, as well as helping the Engineering Department in the Silver Lake Woods assessment project. He reported also that Mary Tetarik has returned full time from her sick leave. Director Johnson reported 99 building permits had been issued in the second quarter, as well as 149 housing inspections and reinspections, and 30 HRA inspections. He added they have been working on the reorganization, getting in place a working foreman and a director on a part-time basis. Director Johnson reported the seal coating is com- plete, with the root treatment and sewer cleaning program near completion, with the tv camera finding some problem area. He added they are working on the rusty water problem, have completed the installa- tion of a manhole on Ardan Avenue, and are nearing completion of several other projects. He stated the Council had gone through this with an employee in the Finance Depart- ment earlier and had come to an acceptable solution. Mayor McCarty recommended the Council set the salary level that someone for the Building Inspector position would be hired for, and then separately consider the salary for the person on board, taking into considera- tion his experience and additional duties and expertise. August 9, 1982 Page Six Motion/Second: McCarty/Forslund to table until August 17, at which time the salary level will be set by policy, and during the interium, the present policy will remain in force. 5 ayes 0 nays Motion Carried Director Johnson reported that due to Steve Rose's long term involvement with the Silver Lake Woods project, it was impossible for the other Staff to handle it, per the reorganization, and they had to rely on Mr. Rose for his knowledge and experience. ' Mayor McCarty replied that prior to the reorganization of Staff, they had had one individual involved in projects from beginning to end, which would have left the City in trouble if he had left. He stated that they are now spreading the responsibilties among three people, and agrees they should pay fairly, which will retain good employees and maintain a high morale. Councilmember Forslund agreed that all information should be made available before setting the salary. Finance Director Brager reported arrangements could be made to take out a temporary loan from other funds if the cost would be in the $50-60,000 range, but if it is more than that, they could have problems in getting the funds. Attorney Meyers reported he had received a memo on home occupations, which he understands the Planning Commission will be reviewing. Councilmember Forsiund stated she felt it was very important to keep in close contact with the Rice Creek Watershed District, as they are now working on projects for 1986 and 1987, and asked that some of the material from the conference she and Director Johnson had attended be forwarded to the Council. Said improvements include the acquisition of road right-of-way and the construction of sanitary sewer, water, storm sewer, curb and gutter, street and streetlights. The area proposed to be assessed includes all of Blocks 1 through 12 of the Plat of Silver Lake Woods. The proposed assessment roll is on file for public inspection at the office of the City Clerk, 2401 Highway 10, Mounds View, Minnesota. Written or oral objections will be considered at the hearing. An owner may appeal an assessment to district court pursuant to Chapter 26.12 of the Municipal Code by serving notice of the appeal upon the Mayor or City Clerk within thirty days after the adoption or the assessment and filing such notice with the district court within ten days after service upon the Mayor or City Clerk. An owner may also petition the City Council under the provisions of Chapters 26.18, 26.19, and 26.20 for a senior citizens hardship special assessment deferral. Notary I Public . _ RESOLUTION NO. 1476 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION ADOPTING ASSESSMENT ROLL WHEREAS, pursuant to proper notice duly given as required by the Home Rule Charter and Chapter 26.10 of the Municipal Code, the City Council has met and heard and passed upon all objections to the proposed assessment roll for the improvement of Blocks 1 through 12, Silver Lake Woods Plat. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Mounds View: 1. Such proposed assessment roll, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assess- ment against the lands named therein, and each tract of land therein included is hereby found to be . benefited by the improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable over a period of 10 years with interest only to be paid in the first three years and principal and interest to be paid over the remaining seven years, or such other payment schedule as approved by the City VV Yll�r ll, Lila first of the to uac payable on or before the first Monday in January 1983 and shall bear interest at the rate of 10.2553% annum from the date of adoption of this assessment resolution. Anderson, Dir o Parks, Recreation A s y DATE: August 19, 1982 RE: 1982 Part-time seasonal help It has called to my attention that the City Council has not fonlally adopted a number of our part-time seasonal positions for the sunnier of 1982. As stated, a number these part-time seasonal positions are either in the process of completing their position or have completed their time of duty, but staff feels that it will clarify any misunder- standings regarding part-time salaries for the auditor as well as Finance/Bookkeeping Department. _ We do have signed contracts for the majority of the part-time staff which were approved by the Director of Parks and Recreation as well as the Program Supervisor and signed by the individual participant. As we hire approximately 225 part-time people, staff would request further directions as to how the council would like to see us handle part-time emplqyees on future issues so that no problems arise. The attached resolution outlines each of the positions and the budget fund they have been budgeted for and their length of tern. It should be noted that all the positions have been budgeted for and it appears that we will have a budget surplus for 1982 for part-time personnel services costs. E. Duoos Construction regarding a request for occupancy of the Standard Oil Station located at 2155 Highway Avenue. Since the project site is not entirely completed at this point in time, the usual action taken by the City at this time would be to grant a temporary occupancy. Keep in mind that the overall development and completion of the project site is covered by Development Agreement No. 81-51, with a security of $15,000. Since in most cases with commercial, industrial or high density residential development, building completion is often completed prior to all of the site work. Sometimes partial occu- pancy or total occupancy, depending on the size of the building, is requested prior to completion of that overall site such as is being requested by J. E. Duoos. The City's past policy then has been to issue a temporary pending completion of the entire site. At that time, the City Council would authorize a resolution noting completion of the project and release of the agreement security. Staff would then follow up the Council's subsequent action with the issuance of a final occu- pancy permit for the building. You will recall that approximately one month ago you were informed by staff that Tyson Warehouse may be requesting a temporary occu- pancy in which to start their distribution center before total completion of the project site. It was staff's understanding at that point in time that Council had no objection to that and we could proceed issuing the temporary occupancy if it were requested prior to total completion of the project site. Tn HM-A staff has not issued a temporary occupancy, but it may be requested within the next week. Staff has taken the policy of notifying Council prior to the issuance of temporary occupancies so that Council is aware of activities that may be occurring on the project site and also to receiveyour input should you not request or desire to have that temporary occupancy permit granted should certain specific problems exist that staff may not be aware of. The granting of it temporary occupancy generally only applies specifically to the building code as to whether or not the building is safe for the occupancy being requested. It does not, however, extend itself to completion of overall development site in all cases. The issuance of that temporary occupancy does not take any specific direction or approval by the Council unless you deem that necessary. The particulars of the incomplel.ion for Lhe SLandard Oil site would be: 1) Completion of grading. 2) Completion of the si-gnage. 3) Completion and approval of storm water detention areas by Rice Creek Watershed District. Please direct staff in two areas regarding these types of matters: 1) The Council's preference as to the procedures and approval of granting temporary occupancies. 2) Direction as to whether or not temporary occupancies can be granted for both the Standard oil Station and Tyson Warehouse. By e 7 of 7 MEMO TO: Mayor and City Council FROM: Clerk -Administrator DATE: August 18, 1982 SUBJECT: RESIDENTS' COMPLAINTS ON HILLVIEW ROAD APARTMENT BUILDINGS As a result of the discussion the City Council had with residents in the Hillview area on the apartment buildings east of Quincy and on the north side of Hillview Road, I began an investigation of their allegations with the Police Department and Building Inspections Department to determine if City staff had not been prompt and courteous in their responding to complaints voiced by the citizens in the past. I have been assured by members of the Police Department that complaints regarding the problems voiced by these residents have been handled as promptly as possible and within the confines of the law. In some cases items voiced in the letter submitted by these residents dated August 16, 1982 have not previously been filed with the Police Department and they were generally unaware of these problems existing in this area. It was pointed out, however, that the Police Department is aware that this area is one having more than the normal number of problems and, therefore, they have place? a greater emphasis on patrollinq this area and regulating the activities of residents in this area in the past. The Police Department, in an effort to solicit the input of residents in the area and obtain their cooperation in enforcing the laws of the City, has set up a meeting with the residents who signed the August 16th letter for the evening of September 23, 1982 at the residence of Mr. and Mrs. Max Leitz, Jr., 2138 Hillview Road, at 7:00 p.m. The Police Department•, recognizing that the Council has a 7:30 p.m. meeting on that evening, requested that any Councilmembers that are interested attend the meeting up to the time it is necessary for them to leave and attend the Council meeting on that evening. Discussions with the Ci.ty's Building Inspections Department indicate that most of. the buildings which have been identified as being problem buildings by the complaining residents have been inspected by the City within the last six months and that corrective action has been taken by the apartment building owners, ig in the process of being taken, or the City is in the process of citing the owners and bringing suit against them to force those repairs which are necessary. A report from Building Inspector Rose is attached to this memorandum for your information. A general observation in response to a statement made in the August 16th letter is that these buildings are not candidates for condemnation as they are habitable and most violations of our (lousing Code relate to general maintenance rather than structural factors in the buildings. -2- Based on a discussion: of these complaints with City Attorney Meyers, the following action has been. or will be taken by City staff: 1. The Police Department has been made aware of these complaints and instructed to step up our patrolling efforts in that area to determine the severity of the problem and enforce the laws of the City to a greater extent. The Police Department, as previously stated, has also set up a meeting with the complaining residents to solicit their support and assistance in this effort. 2. The Building Inspections Department has previously completed inspections on all of these buildings and been instructed to perform additional inspections on all of these structures to determine what additional violations of our (lousing Code or other City Codes might exist and enforce these Codes to their fullest extent. 3. City Attorney Meyers has recommended that,with the approval of the Council, this office meet with all owners of these buildings in a joint meeting to advise them of the complaints _ that we are receiving from residents in the area and solicit their cooperation in resolving the problems being experienced by residents of the neighborhood. Staff would request Council direction in the matter of setting up a meeting with the apartment building owners and any other direction you might feel is necessary to respond to these complaints. Numerous occasiops we have contacted the Police Department because of the noise, traffic, parking problems, children playing in the street, children and adults relieving themselves outside, excessive use of drugs and alcohol, careless and wreckless driving, fowl language being screamed throughout the neighborhood at 4:00 a.m. and in general a disrespect for the quality of life that suburban living should offer. The general influence this quality of people have on our children is very frightening to us as parents. Our neigh- borhood reminds us of the quality of life one expects to find in the Dale and Selby area. We are all long time residents of the Mounds View area and each year the area seems to decay more and more. Besides the lack of quality of the people in these buildings, the buildings should be thoroughly inspected to determine how close these buildings are to being condemned. We have a few questions concerning these buildings: 1. Have these buildings been inspected lately? 2. Ito these buildings meet the building codes? 0. Are there any regulations concerning the number of occupants per residency? We feel as though you have been helpful to on in the past - and we certainly feel confident that you will assist us In this matter. The Mounds View Pollee Department have been of no help and we desperatly need somennes assistance. During my visit on the 12th one of the department officials was not present and I was unable to obtain his additional direc- tion. Now that f have completed discussion with this other official in the land descriptions section, I would recommend the City take action by the use of a resolution to stop any further filing of subdivisions/land divisions without City approval. In discussion with this official with regard to the City's sub- division regulations as well as the present moritorium, it became more clear that the easiest way to stop divisions in not only wetland areas or any other in the City, would be to establish a resolution stating that all subdivisions/land divisions require City approval before filing with the County. Attached is a proposed resolution that the City Council could use to address and notify Ramsey County officials of the City's requirements. After drafting a resolution, .I discussed its con Lents with both the City Attorney and the Ramsey County official to assure that proper direction had been taken. In discussion with City Attorney Meyers, he eluded that he would discuss the existing division filed without City approval further with the City Council during his report at the next regular Council mccLing. SOAR/bc Attachment el- RESOLUTION No. 1411 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION REGARDING LAND DIVISION REQU111EMLNTS FOR THE RAMSEY COUNTY RECORDING DEPARTMENT AND TAXATION DEPARTMRNT OFFICES WHEREAS, the City of Mounds View has had subdivision ordinance regulations since August 4, 1959; and WHEREAS, the City of Mounds View, in their subdivision ordinance, has established regulations regarding qualifications for subdivisions; and WHEREAS, these qualifications include submission require- ments for applicants proposing subdivisions; and WHEREAS, these submission requirements are then reviewed by the City Commissions and Council for action of approval or denial based on application of City ordinances and resolutions; and WHEREAS, the Mounds View Subdivision Ordinance requires that all subdivisions/land divisions require official City approval prior to filing at Ramsey County; and WHEREAS, the City Council of the City of Mounds View does not recognize subdivisions/land divisions filed at Ramsey County without City approval; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of -Mounds View directs its Staff to present this resolution to the County Offices of Recording and Taxation notifying them to accept subdivision/land division requests only if they are accom- panied with official Mounds View documents or stamps which indicate City approval; DE IT FURTHER RESOLVED that the City Council of the City of Mounds View will not recognize subdivisions/land divisions filed ir. the past, present or future with Ramsey County that have not raceived City approval. Anderson, Director Parks, Recreation and Forestry DATE: August 19, 1982 RE: Silver View Park The Mounds View Parks and Recreation Commission met at their regular scheduled July meeting on July 22, 1982. They reviewed a number of issues at their scheduled meeting, one of them being the current progress and status of Silver View Park. Staff indicated that at this time the Phase I development has basically been completed with a number of contracts not approved due to poor quality. One of those items that was not approved was the seeding phase of the contract through J and S Sod and Service. Staff forwarded the figures to the commission indicating a positive balance of approximately $5,806.95 in the Silver View Park account and the Park Commission made a motion to have the soccer field sodded rather than the existing poor quality of the seed. The specific motion was made by Cormissioner Dennehy, seconded by Commissioner Silvis to direct staff to request from the Mounds View City Council that a dollar figure not to exceed $3,000.00 he allocated for the sodding of the soccer field at Silver View Park. The motion passed unanamously. The rationale behind the commissions decision on this issue is that the city currently does not have a full sized soccer or football field within the city's park system. The soccer/football field at Silver View Park would receive an extensive amount of use and should be developed in its highest possible level, Should the Council desire this scheduled approvement it would leave us a balance of approximately $2,800.00 in the Silver View Park fund and the sodding could be completed internally by city staff using summer C.E.T.A. crew hopefully be- fore the year is out.
